53. Fighting Rebellion
٥٣۔ كِتَابُ قِتَالِ أَهْلِ الْبَغْيِ
[Machine] I have never seen anyone more honorable in leading a charge than your father, except on the day of the camel. And then a caller called out saying, "No one who retreats shall be killed or a wounded person harmed." Al-Shafi'i, may Allah have mercy on him, said, "I mentioned this hadith to Al-Darawardi, and he said, 'I don't recall it, I am amazed at its preservation.' Jafar, with this chain of narration, said, 'Al-Darawardi informed us that Jafar narrated from his father that Ali, may Allah be pleased with him, would not take any plunder, and that he would personally engage in battle and would not harm any wounded person or kill anyone fleeing.'"
مَا رَأَيْتُ أَحَدًا أَكْرَمَ غَلَبَةً مِنْ أَبِيكَ مَا هُوَ إِلَّا أَنْ وَلَّيْنَا يَوْمَ الْجَمَلِ فَنَادَى مُنَادِيهِ لَا يُقْتَلُ مُدْبِرٌ وَلَا يُذْفَّفُ عَلَى جَرِيحٍ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ ذَكَرْتُ هَذَا الْحَدِيثَ لِلدَّرَاوَرْدِيِّ فَقَالَ مَا أَحْفَظُهُ تَعْجَبُ لِحِفْظِهِ هَكَذَا ذَكَرَهُ جَعْفَرٌ بِهَذَا الْإِسْنَادِ قَالَ الدَّرَاوَرْدِيُّ أَخْبَرَنَا جَعْفَرٌ عَنْ أَبِيهِ أَنَّ عَلِيًّا ؓ كَانَ لَا يَأْخُذُ سَلْبًا وَأَنَّهُ كَانَ يُبَاشِرُ الْقِتَالَ بِنَفْسِهِ وَأَنَّهُ كَانَ لَا يُذَفِّفُ عَلَى جَرِيحٍ وَلَا يَقْتُلُ مُدْبِرًا
[Machine] Ali commanded his caller, so he called on the day of Basra, saying, "No one will be pursued, no one will be attacked on the back, and no captive will be killed. Whoever closes his door is safe, and whoever throws down his weapon is safe, and nothing will be taken from their possessions."
أَمَرَ عَلِيٌّ ؓ مُنَادِيَهُ فَنَادَى يَوْمَ الْبَصْرَةِ لَا يُتْبَعُ مُدْبِرٌ وَلَا يُذَفَّفُ عَلَى جَرِيحٍ وَلَا يُقْتَلُ أَسِيرٌ وَمَنْ أَغْلَقَ بَابَهُ فَهُوَ آمِنٌ وَمَنْ أَلْقَى سِلَاحَهُ فَهُوَ آمِنٌ وَلَمْ يَأْخُذْ مِنْ مَتَاعِهِمْ شَيْئًا
[Machine] Ali on the day of Jamal and the people have entrusted [him] that he shall not harm the wounded nor kill a slave, and whoever throws down their weapon is safe, so that burdened us with that.
عَلِيٍّ يَوْمَ الْجَمَلِ وَقَدْ وَلَّى النَّاسُ أَلَا لَا يُذَافُّ عَلَى جَرِيحٍ وَلَا يُقْتَلُ مَوْلًى وَمَنْ أَلْقَى السِّلَاحَ فَهُوَ آمِنٌ فَشَقَّ عَلَيْنَا ذَلِكَ
[Machine] If you said anything else, I would contradict you.
لَوْ قُلْتَ غَيْرَ ذَلِكَ لَخَالَفْتُكَ
[Machine] Ali did not curse on the Day of Jamali, nor on the Day of Nahrwan.
لَمْ يَسُبَّ عَلِيٌّ ؓ يَوْمَ الْجَمَلِ وَلَا يَوْمَ النَّهْرَوَانِ
[Machine] Ali on the day of the Camel (referring to the Battle of the Camel), we will testify for him that there is no god but Allah and we will inherit the fathers from their sons.
عَلِيٌّ ؓ يَوْمَ الْجَمَلِ نَمُنُّ عَلَيْهِمْ بِشَهَادَةِ أَنْ لَا إِلَهَ إِلَّا اللهُ وَنُوَرِّثُ الْآبَاءَ مِنَ الْأَبْنَاءِ
[Machine] "Our brothers rebelled against us, so we fought them. They were defeated and we accepted them."
إِخْوَانُنَا بَغَوْا عَلَيْنَا فَقَاتَلْنَاهُمْ وَقَدْ فَاؤُوا وَقَدْ قَبِلْنَا مِنْهُمْ
[Machine] I witnessed the battle of Siffin, and they wouldn't harm the wounded, nor kill a captive, nor loot a slain person.
شَهِدْتُ صِفِّينَ وَكَانُوا لَا يُجِيزُونَ عَلَى جَرِيحٍ وَلَا يَقْتُلُونَ مُوَلِّيًا وَلَا يَسْلُبُونَ قَتِيلًا
[Machine] Ali said to a captive from Muawiya's companions, "I will not kill you willingly, for I fear Allah, the Lord of the worlds." Al-Shafi'i and Al-Harbi fought fiercely on the Day of Siffin, with Muawiya fighting aggressively throughout his reign, either maintaining his position or overpowering his opponents. Ali said to the captive from Muawiya's companions, "I will not kill you willingly, for I fear Allah, the Lord of the worlds." The esteemed scholar, may Allah have mercy on him, commented on the statement of Al-Shafi'i and Muawiya fighting fiercely throughout his reign, either maintaining his position or overpowering his opponents. This means that at times they were equals in battle, and at other times one would overpower the other. The captive was a member of Muawiya's faction, yet Ali did not kill him, nor did he seek permission to do so. It is said that Ali considered himself in a state of balance regarding this matter, as he claimed to seek revenge for the blood of Uthman. And he considered himself in a position of authority in the eyes of others, as they knew that Ali was innocent of Uthman's blood. The first opinion is more authentic, although there is a weak hadith narrated on this subject.
عَلِيٌّ ؓ لَا أَقَتُلُكَ صَبْرًا إِنِّي أَخَافُ اللهَ رَبَّ الْعَالَمِينَ فَخَلَّى سَبِيلَهُ ثُمَّ قَالَ أَفِيكَ خَيْرٌ تُبَايِعُ؟ قَالَ الشَّافِعِيُّ وَالْحَرْبُ يَوْمَ صِفِّينَ قَائِمَةٌ وَمُعَاوِيَةُ يُقَاتِلُ جَادًّا فِي أَيَّامِهِ كُلِّهَا مَنْتَصِفًا أَوْ مُسْتَعْلِيًا وَعَلِيٌّ ؓ يَقُولُ لِأَسِيرٍ مِنْ أَصْحَابِ مُعَاوِيَةَ لَا أَقَتُلُكَ صَبْرًا إِنِّي أَخَافُ اللهَ رَبَّ الْعَالَمِينَ قَالَ الشَّيْخُ الْإِمَامُ رَحِمَهُ اللهُ قَوْلُ الشَّافِعِيِّ وَمُعَاوِيَةُ يُقَاتِلُ جَادًّا فِي أَيَّامِهِ كُلِّهَا مُنْتَصِفًا أَوْ مُسْتَعْلِيًا مَعْنَاهُ أَنَّهُ كَانَ يُسَاوِيهِ مَرَّةً فِي الْقِتَالِ وَيَعْلُوهُ أُخْرَى فَكَانَ فِئَةً لِهَذَا الْأَسِيرِ وَمَعَ ذَلِكَ لَمْ يَقْتُلْهُ عَلِيٌّ ؓ وَلَمْ يَسْتَجِزْ قَتْلَهُ وَقِيلَ مُنْتَصِفًا عِنْدَ نَفْسِهِ لِدَعْوَاهُ أَنَّهُ يَطْلُبُ دَمَ عُثْمَانَ ؓ وَمُسْتَعْلِيًا عِنْدَ غَيْرِهِ لِعِلْمِهِمْ بِأَنَّ عَلِيًّا ؓ كَانَ بَرِيئًا مِنْ دَمِ عُثْمَانَ ؓ وَالْأَوَّلُ أَصَحُّ وَقَدْ رُوِيَ فِي هَذَا حَدِيثٌ مُسْنَدٌ إِلَّا أَنَّهُ ضَعِيفٌ
[Machine] The Messenger of Allah ﷺ said to Abdullah bin Mas'ood, "O Ibn Mas'ood, do you know the ruling of Allah regarding those who rebel from this Ummah?" Ibn Mas'ood said, "Allah and His Messenger know best." The Prophet ﷺ said, "Indeed, the ruling of Allah regarding them is that their backs should not be followed, their captives should not be killed, their wounded should not be tortured, as mentioned in the Hadith of Al-Kharrāz and in the narration of Al-Khuwārizmī. Their property should not be divided among the Muslims." This was narrated specifically by Kawthar bin Hakeem, who is weak in his narrations.
قَالَ رَسُولُ اللهِ ﷺ لِعَبْدِ اللهِ بْنِ مَسْعُودٍ يَا ابْنَ مَسْعُودٍ أَتَدْرِي مَا حُكْمُ اللهِ فِيمَنْ بَغَى مِنْ هَذِهِ الْأُمَّةِ؟ قَالَ ابْنُ مَسْعُودٍ اللهُ وَرَسُولُهُ أَعْلَمُ قَالَ فَإِنَّ حُكْمَ اللهِ فِيهِمْ أَنْ لَا يُتْبَعُ مُدْبِرُهُمْ وَلَا يُقْتَلُ أَسِيرُهُمْ وَلَا يُذَفَّفُ عَلَى جَرِيحِهِمْ لَفْظُ حَدِيثِ الْخَرَّازِ وَفِي رِوَايَةِ الْخُوَارِزْمِيِّ وَلَا يُجَازُ عَلَى جَرِيحِهِمْ زَادَ وَلَا يُقْسَمُ فَيْؤُهُمْ تَفَرَّدَ بِه كَوْثَرُ بْنُ حَكِيمٍ وَهُوَ ضَعِيفٌ
[Machine] The Messenger of Allah ﷺ said in his Farewell Pilgrimage: "It is not lawful for a Muslim to take the wealth of his brother except what he gives willingly. This is the narration of At-Taymi, and in the narration of Ar-Raqashi, it is not lawful for anyone, meaning a Muslim, to take anyone's wealth except with their consent."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي حَجَّةِ الْوَدَاعِ ح وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أَنْبَأَ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّفَّارُ ثَنَا عَبْدُ الْأَعْلَى هُوَ ابْنُ حَمَّادٍ ثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ عَلِيِّ بْنِ زَيْدٍ عَنْ أَبِي حُرَّةَ الرَّقَاشِيِّ عَنْ عَمِّهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَحِلُّ مَالُ رَجُلٍ مُسْلِمٍ لِأَخِيهِ إِلَّا مَا أَعْطَاهُ بِطِيبِ نَفْسِهِ لَفْظُ حَدِيثِ التَّيْمِيِّ وَفِي رِوَايَةِ الرَّقَاشِيِّ لَا يَحِلُّ مَالُ امْرِئٍ يَعْنِي مُسْلِمًا إِلَّا بِطِيبٍ مِنْ نَفْسِهِ
[Machine] When Ali killed the people of Nahar, he went into their camp. Whoever knew anything, he took it until nothing remained. Then I saw it, so I took it afterwards. Sufyan narrated it from Ash-Shaybani from 'Arfajah from his father that Ali was given the inheritance of the people of Nahar, so he recognized it. Whoever recognized something, took it until nothing was left. We narrated from a man from the Banu Tamim, he said: I asked Ibn Umar about the wealth of the Khawarij, so he said: I do not see any spoils in their wealth.
لَمَّا قَتَلَ عَلِيٌّ ؓ أَهْلَ النَّهْرِ جَالَ فِي عَسْكَرِهِمْ فَمَنْ كَانَ يَعْرِفُ شَيْئًا أَخَذَهُ حَتَّى بَقِيَتْ قِدْرٌ ثُمَّ رَأَيْتُهَا أَخَذْتُ بَعْدُ وَرَوَاهُ سُفْيَانُ عَنِ الشَّيْبَانِيِّ عَنْ عَرْفَجَةَ عَنْ أَبِيهِ أَنَّ عَلِيًّا ؓ أُتِيَ بِرَثَّةِ أَهْل النَّهْرِ فَعَرَفَهَا وَكَانَ مَنْ عَرَفَ شَيْئًا أَخَذَهُ حَتَّى بَقِيَتْ قِدْرٌ لَمْ تُعْرَفْ وَرَوَيْنَا عَنْ رَجُلٍ مِنْ بَنِي تَمِيمٍ قَالَ سَأَلْتُ ابْنَ عُمَرَ ؓ عَنْ أَمْوَالِ الْخَوَارِجِ فَقَالَ لَا أَرَى فِي أَمْوَالِهِمْ غَنِيمَةً
[Machine] That he finished them off and killed them without cutting off their heads or exposing their private parts.
أَنْ فَرَغَ مِنْهُمْ وَقَتَلَهُمْ لَمْ يَقْطَعْ رَأْسًا وَلَمْ يَكْشِفْ عَوْرَةً
