42. Annulment and Divorce (6/6)
٤٢۔ كِتَابُ الْخُلْعِ وَالطَّلَاقِ ص ٦
[Machine] The Messenger of Allah ﷺ said: "Whoever says to his wife, 'You are divorced, if Allah wills,' or to his slave, 'You are free, if Allah wills,' or commands him to go to the House of Allah, if Allah wills, then there is nothing upon him." Abu Ahmad said: "And this hadith is rejected with its chain of narration, as only Ishaq al-Ka'abi narrates it." The Sheikh said: "It is also narrated from Jarud ibn Yazid ibn Bahz ibn Hakim, from his father, from his grandfather, in a marfu' form concerning divorce. It is weak as well. And the hadith of Ibn Umar suffices us. And with Allah is the success."
رَسُولَ اللهِ ﷺ قَالَ مَنْ قَالَ لِامْرَأَتِهِ أَنْتِ طَالِقٌ إِنْ شَاءَ اللهُ أَوْ غُلَامِهِ أَنْتَ حُرٌّ إِنْ شَاءَ اللهُ أَوْ عَلَيْهِ الْمَشْيُ إِلَى بَيْتِ اللهِ إِنْ شَاءَ اللهُ فَلَا شَيْءَ عَلَيْهِ قَالَ أَبُو أَحْمَدَ وَهَذَا الْحَدِيثُ بِإِسْنَادِهِ مُنْكَرٌ لَيْسَ يَرْوِيهِ إِلَّا إِسْحَاقُ الْكَعْبِيُّ قَالَ الشَّيْخُ وَرُوِيَ عَنِ الْجَارُودِ بْنِ يَزِيدَ بْنِ بَهْزِ بْنِ حَكِيمٍ عَنْ أَبِيهِ عَنْ جَدِّهِ مَرْفُوعًا فِي الطَّلَاقِ وَحْدَهُ وَهُوَ أَيْضًا ضَعِيفٌ وَفِي حَدِيثِ ابْنِ عُمَرَ ؓ كِفَايَةٌ وَبِاللهِ التَّوْفِيقُ
42.39 [Machine] What is stated about inheritance of the deceased woman in the case of death? Imam Shafi'i, may Allah have mercy on him, said: Many scholars have said that she inherits in the waiting period (iddah). Some of our companions said that she inherits even if the waiting period has passed. Some of them said: If she marries another husband, and another person says that she inherits whatever she has withheld from the husbands. And some others said: The deceased woman does not inherit. And this is from what Allah has been consulted about.
٤٢۔٣٩ بَابُ مَا جَاءَ فِي تَوْرِيثِ الْمَبْتُوتَةِ فِي مَرِضَ الْمَوْتِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَقَوْلُ كَثِيرٍ مِنْ أَهْلِ الْفُتْيَا أَنَّهَا تَرِثُهُ فِي الْعِدَّةِ , وَقَوْلُ بَعْضِ أَصْحَابِنَا أَنَّهَا تَرِثُهُ وَإِنْ مَضَتِ الْعِدَّةُ , وَقَالَ بَعْضُهُمْ: وَإِنْ نَكَحَتْ زَوْجًا غَيْرَهُ وَقَالَ غَيْرُهُ تَرِثُهُ مَا امْتَنَعَتْ مِنَ الْأَزْوَاجِ وَفِي قَوْلِ بَعْضُهُمْ لَا تَرِثُ الْمَبْتُوتَةُ وَهَذَا مِمَّا اسْتُخِيرَ اللهُ فِيهِ
[Machine] About the man who divorces a woman and then consummates with her, and he dies while she is in her waiting period, Abdullah ibn Zubayr said that Abdul Rahman ibn Awf divorced Tumadir, the daughter of al-Asbagh al-Kalbi, then consummated with her and died while she was still in her waiting period. Uthman then inherited her. Ibn Zubayr said, "As for me, I do not believe a corpse can inherit."
عَنِ الرَّجُلِ الَّذِي يُطَلِّقُ الْمَرْأَةَ فَيَبُتُّهَا ثُمَّ يَمُوتُ وَهِيَ فِي عِدَّتِهَا فَقَالَ عَبْدُ اللهِ بْنُ الزُّبَيْرِ طَلَّقَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ؓ تُمَاضِرَ بِنْتَ الْأَصْبَغِ الْكَلْبِيَّةَ فَبَتَّهَا ثُمَّ مَاتَ وَهِيَ فِي عِدَّتِهَا فَوَرَّثَهَا عُثْمَانُ ؓ قَالَ ابْنُ الزُّبَيْرِ وَأَمَّا أَنَا فَلَا أَرَى أَنْ تَرِثَ مَبْتُوتَةٌ
[Machine] As for Uthman, he left a will, and as for me, I do not see that I should leave it for my granddaughter.
أَمَّا عُثْمَانُ ؓ فَوَرَّثَهَا وَأَمَّا أَنَا فَلَا أَرَى أَنْ أُوَرِّثَهَا بِبَيْنُونَتِهِ إِيَّاهَا
عَنْ طَلْحَةَ وَأَبِي سَلَمَةَ
عَنْ عَمِّهِ
[Machine] I was informed that a woman asked Abdul Rahman ibn Awf for a divorce, and he said to her, "When you have your menstrual period and then become pure, inform me." But she did not have her period until Abdul Rahman ibn Awf fell ill. When she became pure, she informed him, so he divorced her immediately or divorced her once, and he had no other divorces left for her. Abdul Rahman was sick at that time, so Uthman inherited her from him after her waiting period ended. Al-Shafi'i said, and this is the opinion I choose, that if she inherits after the waiting period ends, she inherits what she did not marry. But if she remarries, she does not inherit from him, so she inherits from two husbands, and it becomes like the one who abandons her right through marriage.
بَلَغَنِي أَنَّ امْرَأَةَ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ سَأَلَتْهُ أَنْ يُطَلِّقَهَا فَقَالَ لَهَا إِذَا حِضْتِ ثُمَّ طَهُرْتِ فَآذِنِينِي فَلَمْ تَحِضْ حَتَّى مَرِضَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ؓ فَلَمَّا طَهُرَتْ آذَنَتْهُ فَطَلَّقَهَا الْبَتَّةَ أَوْ تَطْلِيقَةً لَمْ يَكُنْ بَقِيَ لَهُ عَلَيْهَا مِنَ الطَّلَاقِ غَيْرُهَا وَعَبْدُ الرَّحْمَنِ يَوْمَئِذٍ مَرِيضٌ فَوَرَّثَهَا عُثْمَانُ ؓ مِنْهُ بَعْدَ انْقِضَاءِ عِدَّتِهَا قَالَ الشَّافِعِيُّ وَالَّذِي أَخْتَارُهُ إِنْ وَرِثَتْ بَعْدَ انْقِضَاءِ الْعِدَّةِ أَنْ تَرِثَ مَا لَمْ تَتَزَوَّجْ فَإِذَا تَزَوَّجَتْ فَلَا تَرِثُهُ فَتَرِثُ زَوْجَيْنِ وَتَكُونُ كَالتَّارِكَةِ لِحَقِّهَا بِالتَّزْوِيجِ
[Machine] "He said regarding the one who divorces while he is sick, we still inherit her until he recovers or remarries. And if he remains for a year, Al-Shafi'i said, and others said, she inherits him as long as the waiting period has not expired. This was narrated from Umar ibn Al-Khattab with a chain of narration that is not established like it among the people of hadith."
أَنَّهُ قَالَ فِي الَّذِي يُطَلِّقُ وَهُوَ مَرِيضٌ لَا نَزَالُ نُوَرِّثُهَا حَتَّى يَبْرَأَ أَوْ تَتَزَوَّجَ وَإِنْ مَكَثَ سَنَةً قَالَ الشَّافِعِيُّ وَقَالَ غَيْرُهُمْ تَرِثُهُ مَا لَمْ تَنْقَضِ الْعِدَّةُ وَرَوَاهُ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ بِإِسْنَادٍ لَا يَثْبُتُ مِثْلُهُ عِنْدَ أَهْلِ الْحَدِيثِ
[Machine] He inherits her in terms of inheritance, but she does not inherit him. This is a discontinued narration that Maghira did not hear from anyone except from Ibrahim. It is only mentioned by Ubaydah from Ibrahim, and Ubaydah ad-Dabbabi is weak and Ubaydah did not mention it to Umar in the narration of Yahya al-Qattan from him. It was only mentioned by Ibrahim and Ash-Sha'bi from Shurayh, but Umar is not mentioned in it. Abu Sa'id ibn Abi Amr informed us, Abu al-Abbas al-Asamm said, that Ar-Rabi' said, that Ash-Shafi'i, may Allah have mercy on him, sought guidance from Allah concerning it, meaning the Mabtuta. Ar-Rabi' said, and this is the statement of Ibn az-Zubayr and Abdur-Rahman ibn Awf. He divorced her with the condition that she does not inherit him if Allah wills, and Allah knows best.
تَرِثُهُ فِي الْعِدَّةِ وَلَا يَرِثُهَا وَهَذَا مُنْقَطِعٌ وَلَمْ يَسْمَعْهُ مُغِيرَةُ مِنْ إِبْرَاهِيمَ إِنَّمَا قَالَ ذَكَرَ عُبَيْدَةُ عَنْ إِبْرَاهِيمَ عَنْ عُمَرَ وَعُبَيْدَةُ الضَّبِّيُّ ضَعِيفٌ وَلَمْ يَرْفَعْهُ عُبَيْدَةُ إِلَى عُمَرَ فِي رِوَايَةِ يَحْيَى الْقَطَّانِ عَنْهُ إِنَّمَا ذَكَرَهُ عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ عَنْ شُرَيْحٍ لَيْسَ فِيهِ عُمَرُ ؓ 15132 أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو نا أَبُو الْعَبَّاسِ الْأَصَمُّ قَالَ قَالَ الرَّبِيعُ قَدِ اسْتَخَارَ اللهَ فِيهِ يَعْنِي الشَّافِعِيَّ رَحِمَهُ اللهُ فَقَالَ لَا تَرِثُ الْمَبْتُوتَةُ قَالَ الرَّبِيعُ وَهُوَ قَوْلُ ابْنِ الزُّبَيْرِ وَعَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ ؓ طَلَّقَهَا عَلَى أَنَّهَا لَا تَرِثُهُ إِنْ شَاءَ اللهُ عِنْدَهُ وَاللهُ أَعْلَمُ
42.40 [Machine] Doubt in divorce and the statement: "It is not prohibited except by certain prohibition.
٤٢۔٤٠ بَابُ الشَّكِّ فِي الطَّلَاقِ وَمَنْ قَالَ: لَا تُحَرَّمُ إِلَّا بِيَقِينِ تَحْرِيمٍ
[Machine] Abu Amr Ad-Diyab informed us that Abu Bakr Al-Isma'ili informed us that Abu Ya'la informed us that Abu Khaythama narrated to us that Abu Abdullah Al-Hafidh informed us that Abu Amr narrated to me that Hasan ibn Sufyan narrated to us that Abu Bakr ibn Abi Shaybah said, Sufyan reported from Az-Zuhri from Sa'id and Abbad ibn Tamim from his uncle Abdullah ibn Zaid that a man complained to the Prophet ﷺ that he imagines something during prayer and he said, "Do not leave until you hear a sound or find a smell."
أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أنا أَبُو يَعْلَى أنا أَبُو خَيْثَمَةَ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرٍو أنا الْحَسَنُ بْنُ سُفْيَانَ نا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ قَالَا نا سُفْيَانُ عَنِ الزُّهْرِيِّ عَنْ سَعِيدٍ وَعَبَّادُ بْنُ تَمِيمٍ عَنْ عَمِّهِ عَبْدِ اللهِ بْنِ زَيْدٍ شُكِيَ إِلَى النَّبِيِّ ﷺ الرَّجُلُ يُخَيَّلُ إِلَيْهِ أَنَّهُ يَجِدُ الشَّيْءَ فِي الصَّلَاةِ فَقَالَ لَا يَنْصَرِفُ حَتَّى يَسْمَعَ صَوْتًا أَوْ يَجِدَ رِيحًا
[Machine] Abbas's saying, "He will receive from divorce what they receive from inheritance," means that if a man dies after divorcing one woman but does not know which one she is, then the inheritance will be withheld from all of them until it becomes clear which one she is. Similarly, if he divorces her without knowing which one she is, then he will leave them all. If the divorce occurs three times, then only Allah knows the outcome.
عَبَّاسٍ ؓ قَوْلُهُ يَنَالُهُنَّ مِنَ الطَّلَاقِ مَا يَنَالُهُنَّ مِنَ الْمِيرَاثِ يَقُولُ لَوْ مَاتَ الرَّجُلُ وَقَدْ طَلَّقَ وَاحِدَةً لَا يَدْرِي أَيَّتَهُنَّ هِيَ فَإِنَّ الْمِيرَاثَ يَكُونُ بَيْنَهُنَّ جَمِيعًا يَعْنِي مَوْقُوفًا حَتَّى تُعْرَفَ بِعَيْنِهَا كَذَلِكَ إِذَا طَلَّقَهَا وَلَمْ يَعْلَمْ أَيَّتَهُنَّ هِيَ فَإِنَّهُ يَعْتَزِلُهُنَّ جَمِيعًا إِذَا كَانَ الطَّلَاقُ ثَلَاثًا وَاللهُ أَعْلَمُ
42.41 [Machine] does not destroy the marriage and what does not destroy it? Imam Shafi'i, may Allah have mercy on him, said: The husband destroys the marriage after the third calamity, but does not destroy it after the first or second, and he justified this with what.
٤٢۔٤١ بَابُ مَا يَهْدِمُ الزَّوْجُ مِنَ الطَّلَاقِ وَمَا لَا يَهْدِمُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: يَهْدِمُ الزَّوْجُ الْمُصِيبَهَا بَعْدَ الثَّلَاثِ وَلَا يَهْدِمُ الْوَاحِدَةَ وَلَا الثِّنْتَيْنِ وَاحْتَجَّ بِِمَا
[Machine] About a man from Bahrain who divorced his wife once or twice, and she married another man then he died or divorced her, and she returned to her first husband. What is her status with him? He said her status with him is 15,136. Abu al-Husayn ibn al-Fadl al-Qattan informed us in Baghdad that Abdullah ibn Ja'far narrated to us, Ya'qub ibn Sufyan narrated to us, al-Humaydi narrated to us, Sufyan narrated to us, and al-Zuhri mentioned it with his chain of narration, except that he said, "Then her waiting period ended, and another man married her." Al-Humaydi said, and Sufyan was asked about them, Sa'id ibn al-Musayyib, he said, "Al-Zuhri did not provide us with any additional information about these three individuals." When he finished, he said, "I don't remember what al-Zuhri said, but Yahya ibn Sa'id narrated to us from Sa'id from Abu Huraira about something similar to this, and that should be sufficient for you."
عَنْ رَجُلٍ مِنْ أَهْلِ الْبَحْرَيْنِ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً أَوِ اثْنَتَيْنِ فَنَكَحَتْ زَوْجًا ثُمَّ مَاتَ عَنْهَا أَوْ طَلَّقَهَا فَرَجَعَتْ إِلَى الزَّوْجِ الْأَوَّلِ عَلَى كَمْ هِيَ عِنْدَهُ؟ قَالَ هِيَ عِنْدَهُ عَلَى مَا بَقِيَ 15136 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ بِبَغْدَادَ أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ نا يَعْقُوبُ بْنُ سُفْيَانَ نا الْحُمَيْدِيُّ نا سُفْيَانُ نا الزُّهْرِيُّ فَذَكَرَهُ بِإِسْنَادِهِ وَمَعْنَاهُ إِلَّا أَنَّهُ قَالَ ثُمَّ انْقَضَتْ عِدَّتُهَا فَتَزَوَّجَهَا رَجُلٌ غَيْرُهُ قَالَ الْحُمَيْدِيُّ وَكَانَ سُفْيَانُ قِيلَ لَهُ فِيهِمْ سَعِيدُ بْنُ الْمُسَيِّبِ فَقَالَ نا الزُّهْرِيُّ هَكَذَا لَمْ يَزِدْنَا عَلَى هَؤُلَاءِ الثَّلَاثَةِ فَلَمَّا فَرَغَ مِنْهُ قَالَ لَا أَحْفَظُ فِيهِ عَنِ الزُّهْرِيِّ سَعِيدًا وَلَكِنْ يَحْيَى بْنُ سَعِيدٍ حَدَّثَنَا عَنْ سَعِيدٍ عَنْ أَبِي هُرَيْرَةَ نَحْوَ ذَلِكَ وَكَانَ حَسْبُكَ بِهِ
[Machine] Saeed said, and Qatadah used to adopt this saying, meaning that a man divorces his wife once or twice, then remarries her and then divorces her again.
قَالَ سَعِيدٌ وَكَانَ قَتَادَةُ يَأْخُذُ بِهَذَا الْقَوْلِ يَعْنِي فِي الرَّجُلِ يُطَلِّقُ تَطْلِيقَةً أَوْ تَطْلِيقَتَيْنِ ثُمَّ تَزَوَّجُ ثُمَّ يُرَاجِعُهَا
[Machine] He heard Ali say that she has what remains with her.
أَنَّهُ سَمِعَ عَلِيًّا ؓ يَقُولُ هِيَ عِنْدَهُ عَلَى مَا بَقِيَ
[Machine] She is on the remaining part of divorce, meaning in a man divorcing his wife and she becomes apparent from him, then he marries another woman and divorces her and then the first one marries her. She said she is on what remains of her divorce.
هِيَ عَلَى مَا بَقِيَ مِنَ الطَّلَاقِ يَعْنِي فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ فَتَبِينُ مِنْهُ فَتَزَوَّجُ زَوْجًا فَيُطَلِّقُهَا فَيَتَزَوَّجُهَا الْأَوَّلُ قَالَ هِيَ عَلَى مَا بَقِيَ مِنْ طَلَاقِهَا
عُمَرَ وَابْنِ عَبَّاسٍ ؓ بِخِلَافِ ذَلِكَ
[Machine] If a man divorces his wife once or twice, and then another man marries her, and then he marries her, he says that she is on an impending divorce.
إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ تَطْلِيقَةً أَوْ تَطْلِيقَتَيْنِ ثُمَّ تَزَوَّجَهَا رَجُلٌ آخَرُ ثُمَّ تَزَوَّجَهَا هُوَ بَعْدُ قَالَ تَكُونُ عَلَى طَلَاقٍ مُسْتَقْبَلٍ
عَلِيٍّ ؓ
[Machine] About Ali (may Allah be pleased with him), regarding a man who divorces his wife once or twice, then remarries her, and then her husband divorces her, Ali said: "If she returns to him after she has married (another man), then the divorce is to be implemented. And if he marries her during her waiting period, then she remains with him based on what is stated in the first narration from Ali (may Allah be pleased with him), which is more authentic, while the narrations from Abdul-A'la about Ibn Al-Hanifah are weak according to the scholars of Hadith. And Allah knows best."
عَنْ عَلِيٍّ ؓ فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ تَطْلِيقَةً أَوْ تَطْلِيقَتَيْنِ ثُمَّ تُزَوَّجُ فَيُطَلِّقُهَا زَوْجُهَا قَالَ إِنْ رَجَعَتْ إِلَيْهِ بَعْدَمَا تَزَوَّجَتِ ائْتُنِفَ الطَّلَاقُ وَإِنْ تَزَوَّجَهَا فِي عِدَّتِهَا كَانَتْ عِنْدَهُ عَلَى مَا بَقِيَ الرِّوَايَةُ الْأُولَى عَنْ عَلِيٍّ ؓ أَصَحُّ وَرِوَايَاتُ عَبْدِ الْأَعْلَى عَنِ ابْنِ الْحَنِيفَةِ ضَعِيفَةٌ عِنْدَ أَهْلِ الْحَدِيثِ وَاللهُ أَعْلَمُ
42.42 [Machine] The man says to his wife, "O my sister, he wants brotherhood in Islam.
٤٢۔٤٢ بَابُ الرَّجُلِ يَقُولُ لِامْرَأَتِهِ يَا أُخْتِي يُرِيدُ الْأُخُوَّةَ فِي الْإِسْلَامِ
Prophet Ibrahim (peace be upon him) never told a lie but only thrice: two times for the sake of Allah (for example, his words): "I am sick," and his words: "But it was the big one amongst them which has done that" and because of Sara (his wife). He had come in a land inhabited by haughty and cruel men along with Sara. She was very good-looking amongst the people, so he said to her: If these people were to know that you are my wife they would snatch you away from me, so if they ask you tell them that you are my sister and in fact you are my sister in Islam, and I do not know of any other Muslim in this land besides I and you. And when they entered that land the tyrants came to see her and said to him (the king): 'There comes to your land a woman, whom you alone deserve to possess', so he (the king) sent someone (towards her) and she was brought to him, and Ibrahim (peace be upon him) stood in prayer. When she visited him (the tyrant king came) he could help but stretch his hand towards her and his hand was tied up. He said: 'Supplicate to Allah so that He may release my hand and I will do no harm to you.' She did that and the man repeated (the same highhandedness) and his hand was again tied up more tightly than on the first occasion. He said the same thing to her again, and she again did that (supplicated), but he repeated (the same highhandedness and his hands were tied up more tightly than on the previous occasion). He then again said: 'Supplicate your Lord so that He may set my hand free; by Allah I shall do no harm to you.' She did and his hand was freed. Then he called the person who had brought her and said to him: 'You have brought to me the satan and you have not brought to me a human being, so turn them out from my land,' and he gave Hajar as a gift to her. She returned (along with Hajar) and when Ibrahim (peace be upon him) saw her, he said: 'How have you returned?' She said: 'With full safety (have I returned). Allah held the hand of that debauch and he gave me a maid-servant.' Abu Huraira said: 'O sons of the rain of the sky, she is your mother.' (Using translation from Muslim 2371)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَمْ يَكْذِبْ إِبْرَاهِيمُ قَطُّ إِلَّا ثَلَاثَ كَذِبَاتٍ ثِنْتَيْنِ فِي ذَاتِ اللهِ قَوْلُهُ {إِنِّي سَقِيمٌ} [الصافات 89] وَقَوْلُهُ {بَلْ فَعَلَهُ كَبِيرُهُمْ هَذَا} [الأنبياء 63] وَوَاحِدَةٌ فِي شَأْنِ سَارَةَ فَإِنَّهُ قَدِمَ أَرْضَ جَبَّارٍ وَمَعَهُ سَارَةُ وَكَانَتْ أَحْسَنَ النَّاسِ فَقَالَ لَهَا إِنَّ هَذَا الْجَبَّارَ إِنْ يَعْلَمْ أَنَّكِ امْرَأَتِي يَغْلِبْ عَلَيْكِ فَإِنْ سَأَلَكِ فَأَخْبِرِيهِ أَنَّكِ أُخْتِي فَإِنَّكِ أُخْتِي فِي الْإِسْلَامِ فَإِنِّي لَا أَعْلَمُ فِي الْأَرْضِ مُسْلِمًا غَيْرِي وَغَيْرَكِ فَلَمَّا دَخَلَ أَرْضَهُ رَآهَا بَعْضُ أَهْلِ الْجَبَّارِ فَأَتَاهُ فَقَالَ لَهُ لَقَدْ دَخَلَ أَرْضَكَ الْآنَ امْرَأَةٌ لَا يَنْبَغِي أَنْ تَكُونَ إِلَّا لَكَ فَأَرْسَلَ إِلَيْهَا فَأَتَى بِهَا وَقَامَ إِبْرَاهِيمُ عَلَيْهِ السَّلَامُ إِلَى الصَّلَاةِ فَلَمَّا دَخَلَتْ عَلَيْهِ لَمْ يَتَمَالَكْ أَنْ بَسَطَ يَدَهُ إِلَيْهَا فَقُبِضَتْ يَدُهُ قَبْضَةً شَدِيدَةً فَقَالَ لَهَا ادْعِي اللهَ أَنْ يُطْلِقَ يَدِيَّ وَلَا أَضُرُّكِ فَفَعَلَتْ فَعَادَ فَقُبِضَتْ أَشَدَّ مِنَ الْقَبْضَةِ الْأُولَى فَقَالَ لَهَا مِثْلَ ذَلِكَ فَعَادَ فَقُبِضَتْ أَشَدَّ مِنَ الْقَبْضَتَيْنِ الْأُولَيَيْنِ فَقَالَ ادْعِي اللهَ أَنْ يُطْلِقَ يَدِيَّ وَلَكِ اللهُ أَنْ لَا أَضُرُّكِ فَفَعَلَتْ فَأُطْلِقَتْ يَدُهُ وَدَعَا الَّذِي جَاءَ بِهَا فَقَالَ لَهُ إِنَّكَ إِنَّمَا أَتَيْتَنِي بِشَيْطَانٍ وَلَمْ تَأْتِنِي بِإِنْسَانٍ فَأَخْرِجْهَا مِنْ أَرْضِي وَأَعْطِهَا هَاجَرَ قَالَ فَأَقْبَلَتْ تَمْشِي فَلَمَّا رَآهَا إِبْرَاهِيمُ عَلَيْهِ السَّلَامُ انْصَرَفَ فَقَالَ لَهَا مَهْيَمْ؟ فَقَالَتْ خَيْرًا كَفَّ اللهُ يَدَ الْفَاجِرِ وَأَخْدَمَ خَادِمًا قَالَ أَبُو هُرَيْرَةَ ؓ فَتِلْكَ أُمُّكُمْ يَا بَنِي مَاءِ السَّمَاءِ
[Machine] Ibrahim ﷺ did not lie except in three instances, so he narrated the story exactly as it happened, except that he said: "While he was in a mighty land of the giants, and with him was Sarah, it was said to that king: 'Verily, there is a man and a woman with him from the best of people.' So, the king sent for Ibrahim ﷺ , and he came to him and said: 'Who is this woman?' Ibrahim ﷺ said: 'She is my sister.' He said: 'Go and send her to me.' So, he came to her and said: 'Indeed, he has asked me about you, so I informed him that you are my sister, so do not deny me before him. Verily, there is no other believer in the land except me and you, so you are my sister in Islam.' Then she went, and the story is mentioned."
لَمْ يَكْذِبْ إِبْرَاهِيمُ عَلَيْهِ السَّلَامُ إِلَّا ثَلَاثَ كَذِبَاتٍ فَذَكَرَ الْحَدِيثَ مَوْقُوفًا إِلَّا أَنَّهُ قَالَ وَبَيْنَمَا هُوَ فِي أَرْضِ جَبَّارٍ مِنَ الْجَبَابِرَةِ وَمَعَهُ سَارَةُ إِذْ قِيلَ لِذَلِكَ الْمَلِكِ إِنَّ هَاهُنَا رَجُلًا مَعَهُ امْرَأَةٌ مِنْ أَحْسَنِ النَّاسِ فَأَرْسَلَ إِلَى إِبْرَاهِيمَ عَلَيْهِ السَّلَامُ فَأَتَاهُ فَقَالَ مَا هَذِهِ الْمَرْأَةُ؟ قَالَ أُخْتِي قَالَ اذْهَبْ فَأَرْسِلْ بِهَا إِلِيَّ فَأَتَاهَا فَقَالَ إِنَّهُ قَدْ سَأَلَنِي عَنْكِ فَأَخْبَرْتُهُ أَنَّكِ أُخْتِي فَلَا تُكَذِّبِينِي عِنْدَهُ فَإِنَّهُ لَيْسَ فِي الْأَرْضِ مُسْلِمٌ غَيْرِي وَغَيْرُكِ فَأَنْتِ أُخْتِي فِي الْإِسْلَامِ قَالَ فَانْطَلَقَتْ وَذَكَرَ الْحَدِيثَ
42.43 [Machine] What is disliked from that?
٤٢۔٤٣ بَابُ مَا يُكْرَهُ مِنْ ذَلِكَ
[Machine] And I, Abu Kamil, said that Abdul Wahid and Khalid Al-Tahhan, all of them reported from Khalid, from Abu Tamimah Al-Hujaymi, that a man said to his wife, "O sister!" The Messenger of Allah ﷺ disliked that and prohibited it. This was narrated by Abdul Salam Ibn Harb from Khalid Al-Hathaa, from Abu Tamimah, from a man from his people who heard the Prophet ﷺ admonishing a man who said to his wife, "O sister!" This was also narrated by Abdul Aziz Ibn Al-Mukhtar from Khalid Al-Hathaa, from Abu Uthman, from Abu Tamimah, from the Prophet ﷺ . And it was narrated by Shu'bah from Khalid, from a man, from Abu Tamimah, from the Prophet ﷺ .
وَنا أَبُو كَامِلٍ نا عَبْدُ الْوَاحِدِ وَخَالِدٌ الطَّحَّانُ الْمَعْنَى كُلُّهُمْ عَنْ خَالِدٍ عَنْ أَبِي تَمِيمَةَ الْهُجَيْمِيِّ أَنَّ رَجُلًا قَالَ لِامْرَأَتِهِ يَا أُخَيَّةُ فَقَالَ رَسُولُ اللهِ ﷺ أُخْتُكَ هِيَ؟ فَكَرِهَ ذَلِكَ وَنَهَى عَنْهُ وَرَوَاهُ عَبْدُ السَّلَامِ بْنُ حَرْبٍ عَنْ خَالِدٍ الْحَذَّاءِ عَنْ أَبِي تَمِيمَةَ عَنْ رَجُلٍ مِنْ قَوْمِهِ أَنَّهُ سَمِعَ النَّبِيَّ ﷺ سَمِعَ رَجُلًا يَقُولُ لِامْرَأَتِهِ يَا أُخَيَّةُ فَنَهَاهُ عَنْ ذَلِكَ وَرَوَاهُ عَبْدُ الْعَزِيزِ بْنُ الْمُخْتَارِ عَنْ خَالِدٍ الْحَذَّاءِ عَنْ أَبِي عُثْمَانَ عَنْ أَبِي تَمِيمَةَ عَنِ النَّبِيِّ ﷺ وَرَوَاهُ شُعْبَةُ عَنْ خَالِدٍ عَنْ رَجُلٍ عَنْ أَبِي تَمِيمَةَ عَنِ النَّبِيِّ ﷺ
