A man of Hudhail has two wives. One of them struck her fellow-wife with a tent-pole and killed her and her unborn child. They brought the dispute to the Prophet ﷺ. One of two men said: How can we pay bloodwit for the one who did not make a noise, or ate, nor drank, nor raised his voice ? He (the Prophet) asked: Is it rhymed prose like that of bedouin? He gave judgement that a male or female slave of the best quality should be paid in compensation, and he fixed it to be paid by woman's relatives on her father's side. أَنَّ امْرَأَتَيْنِ كَانَتَا تَحْتَ رَجُلٍ فَغَارَتَا فَضَرَبَتْهَا بِعَمُودِ فُسْطَاطٍ فَقَتَلَتْهَا فَاخْتَصَمُوا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ كَيْفَ نَدِي مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ؟ فَقَالَ النَّبِيُّ ﷺ أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ؟ قَالَ فَقَضَى فِيهِ غُرَّةً قَالَ وَجَعَلَهُ عَلَى عَاقِلَةِالْمَرْأَةِ

A woman killed her fellow-wife with a tent-pole. Her case was brought to Messenger of Allah ﷺ, and he gave judgment that blood-wit should be paid by the relatives (of the offender) on the father's side. And as she was pregnant, he decided regarding her unborn child that a male or a female slave of good quality be given. Some of her offender's) relatives said: Should we make compensation for one who never ate, nor drank, nor made any noise, who was like a nonentity? Thereupon Messenger of Allah ﷺ said: He was talking rhymed phrases like the rhymed phrases of desert Arabs.

a woman struck her co-wife with a tent pole and killed her, and she (the slain woman) was pregnant. She was brought to the Prophet, and the Messenger of Allah ruled that the 'Asabah of the killer should pay the Diyah , and a slavae (should be paid) for the fetus. Her 'Asabah said: "Should Diyah be paid for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked." The prophet said: "Rhyming verse like the verse of the Bedouins."

They referred the dispute to the Prophet and they said: "how can we pay the Diyah for one who neither shouted nor cried (at the moment of birth), or ate or drank? Such a one should be overlooked." He said: "Rhyming verse like the verse of the Bedouins?" And the ruled that the 'Aqilah of the women should give a slave 9asdiyah).

"And the Messenger of Allah ruled that a make or female slave shouted be given (as dihahj) for him (the unborn child), to be paid but the'Aqila h of the woman.

there were two co-wives, one of whom struck the other with a tent people and killed her. The Messenger of Allah ruled that the Diyah was to be paid by the 'Asabah of the killer, and that a slave should be given (as diyah) for the child in her womb. The Bedouin Said: "Are you penalizing me for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked/" He said: "Rhyming verse like the verse of the Jahiliyyah," and he ruled that a slave should e given (as Diyah) for the child in her womb. [Machine] "From the Prophet ﷺ, that there were two women who were under the authority of a man, and they had a disagreement. One of them struck the other with a stick and killed her, along with the fetus in her womb. They brought their dispute to the Messenger of Allah ﷺ, who ruled in favor of the unborn child and made it the responsibility of the family of the woman."

[Machine] There was a man from these people who had two wives. One of them became jealous of the other and threw her with a stone or a stick of chaff, causing her to miscarry. This matter was brought to the attention of the Prophet ﷺ , who made a sudden judgment in it and said, "Should the child bear the consequences of one who neither shouted, nor pleaded, nor drank, nor ate?" He said ﷺ , "Is this not a crime like the crimes of the pre-Islamic era?" And he placed it upon the guardians of the woman

[Machine] The Messenger of Allah ﷺ was brought a woman who had beaten her slave with a stick, causing her to die along with the fetus in her womb. The Messenger of Allah ﷺ ordered that the punishment for the woman should be that her head be struck with the same stick she used, and that the fetus be buried. A man from the people stood up and said, "O Messenger of Allah, how should we deal with someone who did not eat, drink, scream, or express herself?" He ﷺ said, "Indeed, this fetus speaks with the words of a diviner, who predicts that it is a male or female slave."

أَنَّ امْرَأَتَيْنِ كَانَتَا تَحْتَ رَجُلٍ مِنْ هُذَيْلٍ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودِ فُسْطَاطٍ فَأَسْقَطَتْ فَاخْتَصَمُوا إِلَى رَسُولِ اللهِ ﷺ فَقَالُوا كَيْفَ نَدِيَ مَنْ لَا صَاحَ وَلَا اسْتَهَلَّ وَلَا شَرِبَ وَلَا أَكَلَ فَقَالَ النَّبِيُّ ﷺ «أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ؟» فَقَضَى بِالْغُرَّةِ عَلَى عَاقِلَةِ الْمَرْأَةِ

a man of Hudhail had two wives, and one of them threw a tent pole at the o0ther and caused her to miscarry. It was said: "What do you think of one who neither ate nor drank, or shouted nor cried (at the moment of birth)?" he said: (Rhyming verse like the verse of the Bedouins. "And the Messenger of Allah ruled that a make or female slave shouted be given (as dihahj) for him (the unborn child), to be paid but the'Aqila h of the woman. (Using translation from Nasāʾī 4826)   

البيهقي:١٦٣٨٦أَخْبَرَنَا أَبُو بَكْرِ بْنُ فُورَكٍ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يُونُسُ بْنُ حَبِيبٍ ثنا أَبُو دَاوُدَ ثنا شُعْبَةُ أَخْبَرَنِي مَنْصُورٌ قَالَ سَمِعْتُ إِبْرَاهِيمَ يُحَدِّثُ عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ

أَنَّ رَجُلًا مِنْ هُذَيْلٍ كَانَتْ لَهُ امْرَأَتَانِ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودِ فُسْطَاطٍ فَأَسْقَطَتْ فَقِيلَ أَرَأَيْتَ مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ وَلَا اسْتَهَلَّ فَقِيلَ أَسَجْعٌ كَسَجْعِ الْجَاهِلِيَّةِ؟ قَالَ فَقَضَى فِيهِ رَسُولُ اللهِ ﷺ بِغُرَّةٍ وَجَعَلَهُ عَلَى عَاقِلَةِ الْمَرْأَةِ  

أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ شُعْبَةَ
