there were two co-wives, one of whom struck the other with a tent people and killed her. The Messenger of Allah ruled that the Diyah was to be paid by the 'Asabah of the killer, and that a slave should be given (as diyah) for the child in her womb. The Bedouin Said: "Are you penalizing me for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked/" He said: "Rhyming verse like the verse of the Jahiliyyah," and he ruled that a slave should e given (as Diyah) for the child in her womb. A woman killed her fellow-wife with a tent-pole. Her case was brought to Messenger of Allah ﷺ, and he gave judgment that blood-wit should be paid by the relatives (of the offender) on the father's side. And as she was pregnant, he decided regarding her unborn child that a male or a female slave of good quality be given. Some of her offender's) relatives said: Should we make compensation for one who never ate, nor drank, nor made any noise, who was like a nonentity? Thereupon Messenger of Allah ﷺ said: He was talking rhymed phrases like the rhymed phrases of desert Arabs.

Her 'Asabah said: "Should Diyah be paid for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked." two woman were married to a man of Hudhail, and one of them threw tent pole at the other and caused her to miscarry. They referred the dispute to the Prophet and they said: "how can we pay the Diyah for one who neither shouted nor cried (at the moment of birth), or ate or drank? Such a one should be overlooked." He said: "Rhyming verse like the verse of the Bedouins?" And the ruled that the 'Aqilah of the women should give a slave 9asdiyah).

a man of Hudhail had two wives, and one of them threw a tent pole at the o0ther and caused her to miscarry. It was said: "What do you think of one who neither ate nor drank, or shouted nor cried (at the moment of birth)?" he said: (Rhyming verse like the verse of the Bedouins. "And the Messenger of Allah ruled that a make or female slave shouted be given (as dihahj) for him (the unborn child), to be paid but the'Aqila h of the woman.

[Machine] A blow struck and injured her with a stick of wood, killing her. As a consequence, her killer's blood money was paid by the tribe of the victim. Inside her belly was a fetus. The Bedouin man said, "Will I be penalized for killing someone who neither ate nor drank nor screamed?" He then launched into his argument. The Prophet, ﷺ , responded, "Is a gazelle-like creature like a gazelle?" Abu Hudhayfah added more to his statement. The matter inside the belly was settled with a blood money payment.

there were two co-wives, one of whom struck the other with a tent people and killed her. The Messenger of Allah ruled that the Diyah was to be paid by the 'Asabah of the killer, and that a slave should be given (as diyah) for the child in her womb. The Bedouin Said: "Are you penalizing me for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked/" He said: "Rhyming verse like the verse of the Jahiliyyah," and he ruled that a slave should e given (as Diyah) for the child in her womb. الكبرى للنسائي:٦٩٩٨أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ

أَنَّ ضَرَّتَيْنِ ضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودِ فُسْطَاطٍ فَقَتَلَتْهَا «فَقَضَى رَسُولُ اللهِ ﷺ الدِّيَةَ عَلَى عَصَبَةِ الْقَاتِلَةِ وَقَضَى لِمَا فِي بَطْنِهَا بِغُرَّةٍ» فَقَالَ الْأَعْرَابِيُّ تُغَرِّمُنِي مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ أَسَجْعٌ كَسَجْعِ الْجَاهِلِيَّةِ؟ وَقَضَى لِمَا فِي بَطْنِهَا بِغُرَّةٍ

Should we pay indemnity for one who, neither ate, nor drank, nor made any noise, who was just like a nonentity? Thereupon Messenger of Allah ﷺ remarked: He speaks rhymed phrases like the people of the desert. He did impose indemnity upon them. (Using translation from Muslim 1682a)

"كَانَتْ فِينَا امْرَأَتَانِ ضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بعَمُودٍ فَقَتَلَتْهَا وَقَتَلَتْ مَا فِى بَطنِهَا، فَقَضَى النَّبِىُّ ﷺ فِى الْمَرْأَةِ بالْعَقْلِ، وَفِى الْجَنِيَنِ بِغُرة عَبْدٍ أَوْ أَمَةٍ، أَوْ بِفَرَسٍ أَوْ بَعِيرَيْنِ مِنَ الإِبِلِ أَوْ كذا وَكَذَا مِنَ الْغَنَمِ، فَقَالَ رَجُلٌ: كَيْفَ تَعْقِلُ يَا رَسُولَ الله مَنْ لاَ أَكَلَ، وَلاَ شَرِبَ، وَلاَ صَاحَ، وَلاَ اسْتَهَلَّ؟ فَمِثْلُ ذَلِكَ يُطَلُّ، فَقَالَ رَسُولُ الله ﷺ أَسَجَّاعَةٌ أَنْتَ؟ وَقَضَى أَنَّ مِيرَاثَ الْمَرْأَةِ لِزَوْجِهَا وَوَلَدِهَا، وَأَنَّ الْعَقْلَ عَلَى عَصَبَةِ الْقَاتِلَةِ".

"عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، قَالَ: ضَرَبَتْ ضَرُّةٌ ضَرَّةً لَهَا بعَمُود فِسْطَاطٍ فَقَتَلَتْهَا، فَقَضَى رَسُولُ الله ﷺ بِدِيَتِهَا عَلَى عَصَبَةِ الْقَاتِلَةِ، وَبِمَا في بَطنِهَا غُرَّة، فَقَالَ الأعْرَابِيُّ: يَا رَسُولَ الله! أَتُغَرِّمُنِى مَنْ لَا طَعِمَ وَلَا شَرِبَ وَلا صَاحَ، فَاسْتَهَلَّ لِمثْلِ ذَلِكَ يَطَلُّ، فَقَالَ النَّبِىُّ ﷺ أَسَجْعًا كسَجعْ الأَعْرَابِ".
