"كَانَتْ فِينَا امْرَأَتَانِ ضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بعَمُودٍ فَقَتَلَتْهَا وَقَتَلَتْ مَا فِى بَطنِهَا، فَقَضَى النَّبِىُّ ﷺ فِى الْمَرْأَةِ بالْعَقْلِ، وَفِى الْجَنِيَنِ بِغُرة عَبْدٍ أَوْ أَمَةٍ، أَوْ بِفَرَسٍ أَوْ بَعِيرَيْنِ مِنَ الإِبِلِ أَوْ كذا وَكَذَا مِنَ الْغَنَمِ، فَقَالَ رَجُلٌ: كَيْفَ تَعْقِلُ يَا رَسُولَ الله مَنْ لاَ أَكَلَ، وَلاَ شَرِبَ، وَلاَ صَاحَ، وَلاَ اسْتَهَلَّ؟ فَمِثْلُ ذَلِكَ يُطَلُّ، فَقَالَ رَسُولُ الله ﷺ أَسَجَّاعَةٌ أَنْتَ؟ وَقَضَى أَنَّ مِيرَاثَ الْمَرْأَةِ لِزَوْجِهَا وَوَلَدِهَا، وَأَنَّ الْعَقْلَ عَلَى عَصَبَةِ الْقَاتِلَةِ".

Messenger of Allah, why should I play blood-wit for one who neither drank, nor ate, nor spoke, nor made any noise; it is like a nonentity (it is, therefore, not justifiable to demand blood-wit for it). Thereupon Messenger of Allah ﷺ said: He seems to be one of the brothers of soothsavers on account of the rhymed speech which he has composed.

Should we pay indemnity for one who, neither ate, nor drank, nor made any noise, who was just like a nonentity? Thereupon Messenger of Allah ﷺ remarked: He speaks rhymed phrases like the people of the desert. He did impose indemnity upon them.
ضَرَبَتِ امْرَأَةٌ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍ وَهِيَ حُبْلَى فَقَتَلَتْهَا قَالَ وَإِحْدَاهُمَا لِحْيَانِيَّةٌ قَالَ فَجَعَلَ رَسُولُ اللَّهِ ﷺ دِيَةَ الْمَقْتُولَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ وَغُرَّةً لِمَا فِي بَطْنِهَا فَقَالَ رَجُلٌ مِنْ عَصَبَةِ الْقَاتِلَةِ أَنَغْرَمُ دِيَةَ مَنْ لاَ أَكَلَ وَلاَ شَرِبَ وَلاَ اسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللَّهِ ﷺ أَسَجْعٌ كَسَجْعِ الأَعْرَابِ قَالَ وَجَعَلَ عَلَيْهِمُ الدِّيَةَ
A woman killed her fellow-wife with a tent-pole. Her case was brought to Messenger of Allah ﷺ, and he gave judgment that blood-wit should be paid by the relatives (of the offender) on the father's side. And as she was pregnant, he decided regarding her unborn child that a male or a female slave of good quality be given. Some of her offender's) relatives said: Should we make compensation for one who never ate, nor drank, nor made any noise, who was like a nonentity? Thereupon Messenger of Allah ﷺ said: He was talking rhymed phrases like the rhymed phrases of desert Arabs.

A man of Hudhail has two wives. One of them struck her fellow-wife with a tent-pole and killed her and her unborn child. They brought the dispute to the Prophet ﷺ. One of two men said: How can we pay bloodwit for the one who did not make a noise, or ate, nor drank, nor raised his voice ? He (the Prophet) asked: Is it rhymed prose like that of bedouin? He gave judgement that a male or female slave of the best quality should be paid in compensation, and he fixed it to be paid by woman's relatives on her father's side.

About the story of Haml ibn Malik, Ibn Abbas said: She aborted a child who had grown hair and was dead, and the woman also died. He (the Prophet) gave judgment that the blood-wit was to be paid by the woman's relatives on the father's side. Her uncle said: Messenger of Allah! She has aborted a child who had grown hair. The father of the woman who had slain said: He is a liar: I swear by Allah, he did not raise his voice, or drink or eat. No compensation is to be paid for an offence like this. The Prophet ﷺ said: is it a rhymed prose of pre-Islamic Arabia and its soothsaying? Pay a male or female slave of the best quality in compensation for the child. Ibn 'Abbas said: The name of one of them was Mulaikah, and the name of the other was Umm Ghutaif.
فَأَسْقَطَتْ غُلاَمًا قَدْ نَبَتَ شَعْرُهُ مَيِّتًا وَمَاتَتِ الْمَرْأَةُ فَقَضَى عَلَى الْعَاقِلَةِ الدِّيَةَ فَقَالَ عَمُّهَا إِنَّهَا قَدْ أَسْقَطَتْ يَا نَبِيَّ اللَّهِ غُلاَمًا قَدْ نَبَتَ شَعْرُهُ فَقَالَ أَبُو الْقَاتِلَةِ إِنَّهُ كَاذِبٌ إِنَّهُ وَاللَّهِ مَا اسْتَهَلَّ وَلاَ شَرِبَ وَلاَ أَكَلَ فَمِثْلُهُ يُطَلُّ فَقَالَ النَّبِيُّ ﷺ أَسَجْعَ الْجَاهِلِيَّةِ وَكَهَانَتَهَا أَدِّ فِي الصَّبِيِّ غُرَّةً قَالَ ابْنُ عَبَّاسٍ كَانَ اسْمُ إِحْدَاهُمَا مُلَيْكَةَ وَالأُخْرَى أُمَّ غُطَيْفٍ
Two women of Hudhail fought together and one of them threw a stone at the other and killed her. They brought their dispute to the Messenger of Allah ﷺ who gave judgement that a male or female slave of the best quality should be given as compensation for her unborn child, and he fixed it to be paid by the woman's relatives on the father's side. He made her sons and those who were with them her heirs. Hamal b. Malik b. al-Nabighah al-Hudhali said: Messenger of Allah ! how should I be fined for one who has not drunk, or eaten or spoken, or raised his voice? - adding that compensation is not to be paid for such (an offense). The Messenger of Allah ﷺ said: This man simply belong to the soothsayers on account of his rhymed prose which he has used.

Hamal bin Malik bin An-Nabighah Al-Hudhali said: "O Messenger of Allah, how can I pay blood money for one who neither ate nor drank, or shouted such a one should be over looked." there were two co-wives, one of whom struck the other with a tent people and killed her. The Messenger of Allah ruled that the Diyah was to be paid by the 'Asabah of the killer, and that a slave should be given (as diyah) for the child in her womb. The Bedouin Said: "Are you penalizing me for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked/" He said: "Rhyming verse like the verse of the Jahiliyyah," and he ruled that a slave should e given (as Diyah) for the child in her womb.

"I woman struck her co-wife, who was pregnant, with a rock and killed her Messenger of Allah ruled that a slave should be given (as Diyah) for the child in her woman, and that her Diyah should be paid by her 'Asabah. They said:' should we be penalized for one who neither after nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked.' 'O Messenger of Allah, she miscarried a boy whose hair had grown.' The father of the killer said: "He is lying. By Allah he never cried or shouted (at the moment of birth), nor drank nor ate. Such a one should be overlooked.' The Prophet said: 'rhyming verse like the verse of the Jahiliyyah and of its soothsayers? A slave must be given (as Diyah) for the boy, ''' Ibn 'Abbes said; "One of then was Mulaikah and the other was Umm Ghatif."

أَنَّ امْرَأَتَيْنِ مِنْ هُذَيْلٍ اقْتَتَلَتَا فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا فَاخْتَصَمُوا فِي الدِّيَةِ إِلَى رَسُولِ اللَّهِ ﷺ فَقَضَى أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ وَقَضَى بِدِيَتِهَا عَلَى عَاقِلَتِهَا وَرَثَتُهَا وَلَدُهَا وَمَنْ مَعَهَا فَقَالَ حَمَلُ بْنُ النَّابِغَةِ الْهُذَلِيُّ كَيْفَ أُغَرَّمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ وَلَا نَطَقَ وَلَا اسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا هُوَ مِنْ إِخْوَانِ الْكُهَّانِ مِنْ أَجْلِ سَجْعِهِ الَّذِي سَجَعَ»
[AI] "Two women from this group fought, and one of them threw a stone at the other, hitting her abdomen and killing her. She also caused a miscarriage. The Messenger of Allah ﷺ ruled that the blood money should be paid for the rational person who was killed and for the fetus therein, whether it was a male or a female. Someone asked, 'How can a fetus that did not eat, drink, speak, or express himself be rational?' The Prophet ﷺ said, 'Just as Abu Hurairah claimed, this is from the brothers of the sorcerers.'"

Two women from Hudhail fought with each other and one of them hit the other with a stone that killed her and what was in her womb. The relatives of the killer and the relatives of the victim submitted their case to the Prophet ﷺ who judged that the Diya for the fetus was a male or female slave, and the Diya for the killed woman was to be paid by the 'Asaba (near relatives) of the killer. there were two co-wives, one of whom struck the other with a tent people and killed her. The Messenger of Allah ruled that the Diyah was to be paid by the 'Asabah of the killer, and that a slave should be given (as diyah) for the child in her womb. The Bedouin Said: "Are you penalizing me for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked/" He said: "Rhyming verse like the verse of the Jahiliyyah," and he ruled that a slave should e given (as Diyah) for the child in her womb. A man of Hudhail has two wives. One of them struck her fellow-wife with a tent-pole and killed her and her unborn child. They brought the dispute to the Prophet ﷺ. One of two men said: How can we pay bloodwit for the one who did not make a noise, or ate, nor drank, nor raised his voice ? He (the Prophet) asked: Is it rhymed prose like that of bedouin? He gave judgement that a male or female slave of the best quality should be paid in compensation, and he fixed it to be paid by woman's relatives on her father's side. ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْأَةَ الَّتِي تُوُفِّيَتْ كَانَتِ الْمَضْرُوبَةُ دُونَ الضَّارِبَةِ
About the story of Haml ibn Malik, Ibn Abbas said: She aborted a child who had grown hair and was dead, and the woman also died. He (the Prophet) gave judgment that the blood-wit was to be paid by the woman's relatives on the father's side. Her uncle said: Messenger of Allah! She has aborted a child who had grown hair. The father of the woman who had slain said: He is a liar: I swear by Allah, he did not raise his voice, or drink or eat. No compensation is to be paid for an offence like this. The Prophet ﷺ said: is it a rhymed prose of pre-Islamic Arabia and its soothsaying? Pay a male or female slave of the best quality in compensation for the child. Ibn 'Abbas said: The name of one of them was Mulaikah, and the name of the other was Umm Ghutaif. (Using translation from Abū Dāʾūd 4574)

قال اقتتلت امرأتان من هذيل فرمت إحداهما الأُخرَى بحجر فقتلتها وما في بطنها فاختصموا في الدية إِلَى رَسُولِ اللَّهِ ﷺ فقال دية جنينها عَبد أو وليدة وقضى بالدية على عاقلتها وورثها ولدها فقال حمل بن مالك كيف أدى من لا شرب ولاَ أكل ولاَ نطق ولاَ استهل ومثل ذلك يُطَلُ؟ فَقَالَ النَّبِيّ ﷺ إنما هذا من إخوان الكهان من أجل سجعه الذي سجع
قال اقتتلت امرأتان من هزيل فرمت إحداهما الأُخرَى بحجر فرمت بطنها فقتلتها وألقت جنينها فَقَضَى رَسُولُ اللَّهِ ﷺ بديتها على عاقلة الأُخرَى وفي الجنين غرة عَبد أو أمة فقال قائل نعقل من لا أكل ولاَ شرب ولاَ نظر ولاَ صاح فاستهل فمثل ذلك يُطَلُ فَقَالَ النَّبِيّ ﷺ هذا من إخوان الكهان وقد روى هذا الحديث عَن الزُّهْرِيّ عَن سَعِيد وَأَبي سَلَمة رواه يُونُس وغيره
[AI] From his father, who had accompanied the Messenger of Allah ﷺ , it is narrated that there were two women fighting and one of them struck the other with a stick, causing her death along with the baby in her womb. The Prophet ﷺ then made a judgment regarding the woman's intellect and the fetus, whether it be a male or female, a bondman or a bondwoman, a horse or two camels, or such and such from the livestock. A man from the tribe of the killer then asked the Messenger of Allah ﷺ , "How can we be fair, O Messenger of Allah, to one who did not eat, drink, or shout, but was still killed?" The Messenger of Allah ﷺ responded, "Are you a foolish person?" and the Messenger of Allah ﷺ ruled that the inheritance of the woman belongs to her husband and children, and that her intellect should be upon the liability of the killer.

'O Messenger of Allah, she miscarried a boy whose hair had grown.' The father of the killer said: "He is lying. By Allah he never cried or shouted (at the moment of birth), nor drank nor ate. Malik b. al-Nabighah al-Hudhali said: Messenger of Allah ! how should I be fined for one who has not drunk, or eaten or spoken, or raised his voice? - adding that compensation is not to be paid for such (an offense). Should we pay indemnity for one who, neither ate, nor drank, nor made any noise, who was just like a nonentity? Thereupon Messenger of Allah ﷺ remarked: He speaks rhymed phrases like the people of the desert. He did impose indemnity upon them. (Using translation from Muslim 1682a)
ضَرَبَتِ امْرَأَةٌ ضَرَّتَهَا بِعَمُودِ الْفُسْطَاطِ وَهِيَ حُبْلَى فَقَتَلَتْهَا فَجَعَلَ رَسُولُ اللهِ ﷺ دِيَةَ الْمَقْتُولَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ وَغُرَّةً لِمَا فِي بَطْنِهَا فَقَالَ رَجُلٌ مِنْ عَصَبَةِ الْقَاتِلَةِ أَنَغْرَمُ دِيَةَ مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا اسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللهِ ﷺ «أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ؟» فَجَعَلَ عَلَيْهِمُ الدِّيَةَ
there were two co-wives, one of whom struck the other with a tent people and killed her. The Messenger of Allah ruled that the Diyah was to be paid by the 'Asabah of the killer, and that a slave should be given (as diyah) for the child in her womb. The Bedouin Said: "Are you penalizing me for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked/" He said: "Rhyming verse like the verse of the Jahiliyyah," and he ruled that a slave should e given (as Diyah) for the child in her womb. "I woman struck her co-wife, who was pregnant, with a rock and killed her Messenger of Allah ruled that a slave should be given (as Diyah) for the child in her woman, and that her Diyah should be paid by her 'Asabah. They said:' should we be penalized for one who neither after nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked.' 'O Messenger of Allah, she miscarried a boy whose hair had grown.' The father of the killer said: "He is lying. By Allah he never cried or shouted (at the moment of birth), nor drank nor ate. Such a one should be overlooked.' The Prophet said: 'rhyming verse like the verse of the Jahiliyyah and of its soothsayers? A slave must be given (as Diyah) for the boy, ''' Ibn 'Abbes said; "One of then was Mulaikah and the other was Umm Ghatif." (Using translation from Nasāʾī 4828)
كَانَتِ امْرَأَتَانِ جَارَتَانِ كَانَ بَيْنَهُمَا صَخَبٌ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَأَسْقَطَتْ غُلَامًا قَدْ نَبَتَ شَعْرُهُ مَيْتًا وَمَاتَتِ الْمَرْأَةُ فَقَضَى عَلَى الْعَاقِلَةِ الدِّيَةَ فَقَالَ عَمُّهَا إِنَّهَا قَدْ أَسْقَطَتْ يَا رَسُولَ اللهِ غُلَامًا قَدْ نَبَتَ شَعْرُهُ فَقَالَ أَبُو الْقَاتِلَةِ إِنَّهُ كَاذِبٌ وَاللهِ مَا اسْتَهَلَّ وَلَا شَرِبَ وَلَا أَكَلَ فَمِثْلُهُ يُطَلُّ قَالَ النَّبِيُّ ﷺ «أَسَجْعٌ كَسَجْعِ الْجَاهِلِيَّةِ وَكَهَانَتِهَا؟ أُدَّ فِي الصَّبِيِّ غُرَّةً» قَالَ ابْنُ عَبَّاسٍ كَانَتْ إِحْدَاهُمَا مُلَيْكَةَ وَالْأُخْرَى أُمَّ غَطِيفٍ
[AI] Two women from among these people fought, and one of them threw a stone at the other, hitting her abdomen and causing her death. She also miscarried a fetus. The Messenger of Allah ﷺ ruled that the blood money should be paid by the family of the woman who committed the killing, and in the fetus there was a female or male slave. Someone asked, "How can we determine the responsibility of someone who neither eats nor drinks, speaks nor makes any sound?" The Prophet ﷺ said, "Just as Abu Huraira claimed, this belongs to the brothers of jinn."

Two women of Hudhail fought together and one of them threw a stone at the other and killed her. They brought their dispute to the Messenger of Allah ﷺ who gave judgement that a male or female slave of the best quality should be given as compensation for her unborn child, and he fixed it to be paid by the woman's relatives on the father's side. He made her sons and those who were with them her heirs. Hamal b. Malik b. al-Nabighah al-Hudhali said: Messenger of Allah ! how should I be fined for one who has not drunk, or eaten or spoken, or raised his voice? - adding that compensation is not to be paid for such (an offense). The Messenger of Allah ﷺ said: This man simply belong to the soothsayers on account of his rhymed prose which he has used. (Using translation from Abū Dāʾūd 4576)

Messenger of Allah ﷺ gave his verdict about two ladies of the Hudhail tribe who had fought each other and one of them had hit the other with a stone. The stone hit her ʿAbdomen and as she was pregnant, the blow killed the child in her womb. They both filed their case with the Prophet ﷺ and he judged that the blood money for what was in her womb. was a slave or a female slave. The guardian of the lady who was fined said, "O Messenger of Allah ﷺ! Shall I be fined for a creature that has neither drunk nor eaten, neither spoke nor cried? A case like that should be nullified." On that the Prophet ﷺ said, "This is one of the brothers of soothsayers. (Using translation from Bukhārī 5758)

[AI] Two women from the tribe of Hudhayl fought, and one of them threw a stone at the other, hitting her stomach and causing her death. The Messenger of Allah ﷺ decided that the killer's blood money should be paid by the family of the victim, because the fetus she carried was a slave or a servant. One person questioned, "How can we hold accountable someone who does not eat, drink, speak, or perform any actions?" The Prophet ﷺ responded, "As Abu Hurairah claims, such people are classified as the siblings of soothsayers."

Should we pay indemnity for one who, neither ate, nor drank, nor made any noise, who was just like a nonentity? Thereupon Messenger of Allah ﷺ remarked: He speaks rhymed phrases like the people of the desert. He did impose indemnity upon them. (Using translation from Muslim 1682a)

About the story of Haml ibn Malik, Ibn Abbas said: She aborted a child who had grown hair and was dead, and the woman also died. He (the Prophet) gave judgment that the blood-wit was to be paid by the woman's relatives on the father's side. Her uncle said: Messenger of Allah! She has aborted a child who had grown hair. The father of the woman who had slain said: He is a liar: I swear by Allah, he did not raise his voice, or drink or eat. No compensation is to be paid for an offence like this. The Prophet ﷺ said: is it a rhymed prose of pre-Islamic Arabia and its soothsaying? Pay a male or female slave of the best quality in compensation for the child. Ibn 'Abbas said: The name of one of them was Mulaikah, and the name of the other was Umm Ghutaif. (Using translation from Abū Dāʾūd 4574)

"عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، قَالَ: ضَرَبَتْ ضَرُّةٌ ضَرَّةً لَهَا بعَمُود فِسْطَاطٍ فَقَتَلَتْهَا، فَقَضَى رَسُولُ الله ﷺ بِدِيَتِهَا عَلَى عَصَبَةِ الْقَاتِلَةِ، وَبِمَا في بَطنِهَا غُرَّة، فَقَالَ الأعْرَابِيُّ: يَا رَسُولَ الله! أَتُغَرِّمُنِى مَنْ لَا طَعِمَ وَلَا شَرِبَ وَلا صَاحَ، فَاسْتَهَلَّ لِمثْلِ ذَلِكَ يَطَلُّ، فَقَالَ النَّبِىُّ ﷺ أَسَجْعًا كسَجعْ الأَعْرَابِ".
"عن أبى هريرة قال: اقتتلت امرأتان من هذيل فرمت إحداهما الأخرى بحجر فأصابت بطنها فقتلتها، فأسقطت جنينا، فقضى رسول الله ﷺ بعقلها على عاقلة القاتلة، وفى جنينها غرة عبد أو أمة، فقال قائل: كيف نعقل من لا أكل، ولا شرب، ولا نطق، ولا استهل فمثل ذلك يُطَلُّ، فقال النبى ﷺ (هذا من إخوان الكهان) " (*).
