"كَانَتْ فِينَا امْرَأَتَانِ ضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بعَمُودٍ فَقَتَلَتْهَا وَقَتَلَتْ مَا فِى بَطنِهَا، فَقَضَى النَّبِىُّ ﷺ فِى الْمَرْأَةِ بالْعَقْلِ، وَفِى الْجَنِيَنِ بِغُرة عَبْدٍ أَوْ أَمَةٍ، أَوْ بِفَرَسٍ أَوْ بَعِيرَيْنِ مِنَ الإِبِلِ أَوْ كذا وَكَذَا مِنَ الْغَنَمِ، فَقَالَ رَجُلٌ: كَيْفَ تَعْقِلُ يَا رَسُولَ الله مَنْ لاَ أَكَلَ، وَلاَ شَرِبَ، وَلاَ صَاحَ، وَلاَ اسْتَهَلَّ؟ فَمِثْلُ ذَلِكَ يُطَلُّ، فَقَالَ رَسُولُ الله ﷺ أَسَجَّاعَةٌ أَنْتَ؟ وَقَضَى أَنَّ مِيرَاثَ الْمَرْأَةِ لِزَوْجِهَا وَوَلَدِهَا، وَأَنَّ الْعَقْلَ عَلَى عَصَبَةِ الْقَاتِلَةِ".
Should we pay indemnity for one who, neither ate, nor drank, nor made any noise, who was just like a nonentity? Thereupon Messenger of Allah ﷺ remarked: He speaks rhymed phrases like the people of the desert. He did impose indemnity upon them.
ضَرَبَتِ امْرَأَةٌ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍ وَهِيَ حُبْلَى فَقَتَلَتْهَا قَالَ وَإِحْدَاهُمَا لِحْيَانِيَّةٌ قَالَ فَجَعَلَ رَسُولُ اللَّهِ ﷺ دِيَةَ الْمَقْتُولَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ وَغُرَّةً لِمَا فِي بَطْنِهَا فَقَالَ رَجُلٌ مِنْ عَصَبَةِ الْقَاتِلَةِ أَنَغْرَمُ دِيَةَ مَنْ لاَ أَكَلَ وَلاَ شَرِبَ وَلاَ اسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللَّهِ ﷺ أَسَجْعٌ كَسَجْعِ الأَعْرَابِ قَالَ وَجَعَلَ عَلَيْهِمُ الدِّيَةَ
there were two co-wives, one of whom struck the other with a tent people and killed her. The Messenger of Allah ruled that the Diyah was to be paid by the 'Asabah of the killer, and that a slave should be given (as diyah) for the child in her womb. The Bedouin Said: "Are you penalizing me for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked/" He said: "Rhyming verse like the verse of the Jahiliyyah," and he ruled that a slave should e given (as Diyah) for the child in her womb.

ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْأَةَ الَّتِي تُوُفِّيَتْ كَانَتِ الْمَضْرُوبَةُ دُونَ الضَّارِبَةِ
About the story of Haml ibn Malik, Ibn Abbas said: She aborted a child who had grown hair and was dead, and the woman also died. He (the Prophet) gave judgment that the blood-wit was to be paid by the woman's relatives on the father's side. Her uncle said: Messenger of Allah! She has aborted a child who had grown hair. The father of the woman who had slain said: He is a liar: I swear by Allah, he did not raise his voice, or drink or eat. No compensation is to be paid for an offence like this. The Prophet ﷺ said: is it a rhymed prose of pre-Islamic Arabia and its soothsaying? Pay a male or female slave of the best quality in compensation for the child. Ibn 'Abbas said: The name of one of them was Mulaikah, and the name of the other was Umm Ghutaif. (Using translation from Abū Dāʾūd 4574)
كَانَتِ امْرَأَتَانِ ضَرَّتَانِ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَمَاتَتِ الْمَرْأَةُ فَقَضَى رَسُولُ اللَّهِ ﷺ عَلَى الْعَاقِلَةِ الدِّيَةَ فَقَالَتْ عَمَّتُهَا إِنَّهَا قَدْ أَسْقَطَتْ يَا رَسُولَ اللَّهِ غُلَامًا قَدْ نَبَتَ شَعْرُهُ فَقَالَ أَبُو الْقَاتِلَةِ إِنَّهَا كَاذِبَةٌ إِنَّهُ وَاللَّهِ مَا اسْتَهَلَّ وَلَا شَرِبَ وَلَا أَكَلْ فَمِثْلُهُ يُطَلُّ؟ فَقَالَ النَّبِيُّ ﷺ «سَجْعَ الْجَاهِلِيَّةِ غُرَّةٌ» قَالَ ابْنُ عَبَّاسٍ «اسْمُ إِحْدَاهُمَا مُلَيْكَةُ وَالْأُخْرَى أُمُّ غُطَيْفٍ»
[Machine] From his father, who had accompanied the Messenger of Allah ﷺ , it is narrated that there were two women fighting and one of them struck the other with a stick, causing her death along with the baby in her womb. The Prophet ﷺ then made a judgment regarding the woman's intellect and the fetus, whether it be a male or female, a bondman or a bondwoman, a horse or two camels, or such and such from the livestock. A man from the tribe of the killer then asked the Messenger of Allah ﷺ , "How can we be fair, O Messenger of Allah, to one who did not eat, drink, or shout, but was still killed?" The Messenger of Allah ﷺ responded, "Are you a foolish person?" and the Messenger of Allah ﷺ ruled that the inheritance of the woman belongs to her husband and children, and that her intellect should be upon the liability of the killer.
عَنْ أَبِيهِ وَكَانَ قَدْ صَحِبَ رَسُولَ اللهِ ﷺ قَالَ كَانَتْ فِيهَا امْرَأَتَانِ ضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودٍ فَقَتَلَهَا وَقَتَلَتْ مَا فِي بَطْنِهَا فَقَضَى النَّبِيُّ ﷺ فِي الْمَرْأَةِ بِالْعَقْلِ وَفِي الْجَنِينِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ أَوْ بِفَرَسٍ أَوْ بَعِيرَيْنِ مِنَ الْإِبِلِ أَوْ كَذَا وَكَذَا مِنَ الْغَنَمِ فَقَالَ رَجُلٌ مِنْ رَهْطِ الْقَاتِلَةِ كَيْفَ نَعْقِلُ يَا رَسُولَ اللهِ مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ فَاسْتَهَلَّ؟ فَمِثْلُ ذَلِكَ يُطَلُّ فَقَالَ رَسُولُ اللهِ ﷺ «أَسَجَّاعَةٌ أَنْتَ؟» وَقَضَى رَسُولُ اللهِ ﷺ «أَنَّ مِيرَاثَ الْمَرْأَةِ لِزَوْجِهَا وَوَلَدِهَا وَأَنَّ الْعَقْلَ عَلَى عَصَبَةِ الْقَاتِلَةِ»
[Machine] The Messenger of Allah ﷺ was brought a woman who had beaten her slave with a stick, causing her to die along with the fetus in her womb. The Messenger of Allah ﷺ ordered that the punishment for the woman should be that her head be struck with the same stick she used, and that the fetus be buried. A man from the people stood up and said, "O Messenger of Allah, how should we deal with someone who did not eat, drink, scream, or express herself?" He ﷺ said, "Indeed, this fetus speaks with the words of a diviner, who predicts that it is a male or female slave."
أُتِيَ رَسُولُ اللهِ ﷺ بِامْرَأَةٍ ضَرَبَتْ ضَرَّتَهَا بِعَمُودٍ فَقَتَلَتْهَا وَقَتَلَتْ مَا فِي بَطْنِهَا فَجَعَلَ رَسُولُ اللهِ ﷺ عَقْلَهَا عَلَى عَصَبَةِ الْمَرْأَةِ وَفِي الْجَنِينِ غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ فَقَامَ رَجُلٌ مِنَ الْقَوْمِ فَقَالَ يَا رَسُولَ اللهِ كَيْفَ نَدِي مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا صَاحَ وَلَا اسْتَهَلَّ؟ فَقَالَ «إِنَّ هَذَا لَيَقُولُ بِقَوْلِ كَاهِنٍ فِيهِ غُرَّةُ عَبْدٍ أَوْ أَمَةٍ»
"عن أبى هريرة قال: اقتتلت امرأتان من هذيل فرمت إحداهما الأخرى بحجر فأصابت بطنها فقتلتها، فأسقطت جنينا، فقضى رسول الله ﷺ بعقلها على عاقلة القاتلة، وفى جنينها غرة عبد أو أمة، فقال قائل: كيف نعقل من لا أكل، ولا شرب، ولا نطق، ولا استهل فمثل ذلك يُطَلُّ، فقال النبى ﷺ (هذا من إخوان الكهان) " (*).
