49. Book of Blood Money
٤٩۔ كِتَابُ الدِّيَاتِ
ذِكْرُ تَفَضُّلِ اللَّهِ جَلَّ وَعَلَا عَلَى هَذِهِ الْأُمَّةِ عِنْدَ الْقَتْلِ بِإِعْطَاءِ الدِّيَةِ عَنْهُ
[Machine] Before you, it was customary for people to take revenge by killing the killer, and no blood money was accepted from the killer. Then, Allah revealed the verse {O you who have believed, prescribed for you is legal retribution for those murdered} till the end of the verse {that is a concession from your Lord and a mercy}. He said: "So He lightened from you what was upon those before you, which is the blood money that was not accepted. So whoever gives blood money, that is an act of forgiveness and a means of good conduct. And it is to be given to him by his brother in a good manner."
«كَانَ مَنْ قَبْلَكُمْ يَقْتُلُونَ الْقَاتِلَ بِالْقَتِيلِ لَا تُقْبَلُ مِنْهُ الدِّيَةُ» فَأَنْزَلَ اللَّهُ {يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الْقِصَاصُ فِي الْقَتْلَى} إِلَى آخِرِ الْآيَةِ {ذَلِكَ تَخْفِيفٌ مِنْ رَبِّكُمْ وَرَحْمَةٌ} يَقُولُ «فَخَفَّفَ عَنْكُمْ مَا كَانَ عَلَى مَنْ قَبْلَكُمْ أَيِ الدِّيَةَ لَمْ تَكُنْ تُقْبَلُ فَالَّذِي يَقْبَلُ الدِّيَةَ فَذَلِكَ عَفْوٌ فَاتِّبَاعٌ بِالْمَعْرُوفِ وَيُؤَدِّي إِلَيْهِ الَّذِي عُفِيَ مِنْ أَخِيهِ بِإِحْسَانٍ»
ذِكْرُ وَصْفِ الدِّيَةِ فِي قَتِيلِ الْخَطَإِ الَّذِي يُشْبِهُ الْعَمْدَ
[Machine] When the Messenger of Allah ﷺ conquered Mecca, he said, "There is no god but Allah, His promise is true, and He has granted victory to His servant, and He alone has defeated the confederates. Behold, every trace of veneration beneath my feet, except for Al-Siddanah and Al-Siqayah. Indeed, the killer of a mistake is like the killer of intentional sin, and the blood money for a whip and a stick is a severe liability, with forty of its offspring in its belly."
أَنَّ رَسُولَ اللَّهِ ﷺ لَمَّا افْتَتَحَ مَكَّةَ قَالَ «لَا إِلَهَ إِلَّا اللَّهُ صَدَقَ وَعْدَهُ وَنَصَرَ عَبْدَهُ وَهَزَمَ الْأَحْزَابَ وَحْدَهُ أَلَا إِنَّ كُلَّ مَأْثُرَةٍ تَحْتَ قَدَمَيَّ هَاتَيْنِ إِلَّا السِّدَانَةَ وَالسِّقَايَةَ أَلَا إِنَّ قَتِيلَ الْخَطَإِ شِبْهِ الْعَمْدِ قَتِيلَ السَّوْطِ وَالْعَصَا دِيَةٌ مُغَلَّظَةٌ مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا»
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْمَرْءِ مِنَ الدِّيَةِ فِي قَطْعِ أَصَابِعِ أَخِيهِ الْمُسْلِمِ
that the Messenger of Allah ﷺ said: "The blood-money for the fingers on the hands and (the toes of) the feet is the same: Ten camels for each finger." (Using translation from Tirmidhī 1391)
قَالَ رَسُولُ اللَّهِ ﷺ «دِيَةُ الْيَدَيْنِ وَالرِّجْلَيْنِ سَوَاءٌ عَشَرَةٌ مِنَ الْإِبِلِ لِكُلِّ أُصْبُعٍ»
ذِكْرُ الْإِخْبَارِ بِاسْتِوَاءِ الْأَصَابِعِ عِنْدَ قَطْعِهَا فِي الْحُكْمِ بِأَنَّ فِي كُلِّ وَاحِدَةٍ مِنْهَا عَشْرًا مِنَ الْإِبِلِ
[Machine] From the Prophetﷺ he said, "The fingers are equal." I asked, "Ten, ten?" He said, "Yes."
عَنِ النَّبِيِّ ﷺ قَالَ «الْأَصَابِعُ سَوَاءٌ» قُلْتُ عَشْرٌ عَشْرٌ؟ قَالَ «نَعَمْ»
ذِكْرُ الْإِخْبَارِ بِاسْتِوَاءِ الْأَسْنَانِ عِنْدَ قَلْعِهَا فِي الْحُكْمِ بِأَنَّ فِي كُلِّ وَاحِدَةٍ مِنْهَا خَمْسَةً مِنَ الْإِبِلِ
The Prophet ﷺ said: The teeth are equal, and the fingers are equal. (Using translation from Abū Dāʾūd 4560)
قَالَ رَسُولُ اللَّهِ ﷺ «الْأَسْنَانُ سَوَاءٌ وَالْأَصَابِعُ سَوَاءٌ»
ذِكْرُ اسْتِوَاءِ الْخِنْصَرِ وَالْبِنْصَرِ فِي أَخْذِ الْأَرْشِ بِهَا
“The fingers are the same.” (Using translation from Ibn Mājah 2654)
عَنِ النَّبِيِّ ﷺ قَالَ «الْأَصَابِعُ سَوَاءٌ هَذِهِ وَهَذِهِ»
49.2 [Machine] Al-Ghurra
٤٩۔٢ بَابُ الْغُرَّةِ
ذِكْرُ وَصْفِ الْحُكْمِ فِيمَنْ ضَرَبَ بَطْنَ امْرَأَةٍ، فَأَلْقَتْ جَنِينًا مَيِّتًا
[Machine] There was a man from these people who had two wives. One of them became jealous of the other and threw her with a stone or a stick of chaff, causing her to miscarry. This matter was brought to the attention of the Prophet ﷺ , who made a sudden judgment in it and said, "Should the child bear the consequences of one who neither shouted, nor pleaded, nor drank, nor ate?" He said ﷺ , "Is this not a crime like the crimes of the pre-Islamic era?" And he placed it upon the guardians of the woman
كَانَتْ عِنْدَ رَجُلٍ مِنْ هُذَيْلٍ امْرَأَتَانِ فَغَارَتْ إِحْدَاهُمَا عَلَى الْأُخْرَى فَرَمَتْهَا بِفِهْرٍ أَوْ عَمُودِ فُسْطَاطٍ فَأَسْقَطَتْ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَقَضَى فِيهِ بِغُرَّةٍ فَقَالَ وَلِيُّهَا أَنَدِي مَنْ لَا صَاحَ وَلَا اسْتَهَلَّ وَلَا شَرِبَ وَلَا أَكَلْ؟ فَقَالَ ﷺ «أَسَجْعٌ كَسَجْعِ الْجَاهِلِيَّةِ؟ » وَجَعَلَهَا عَلَى أَوْلِيَاءِ أَوْلِيَاءِ الْمَرْأَةِ
ذِكْرُ وَصْفِ الْغُرَّةِ الَّتِي تَجِبُ فِي الْجَنِينِ السَّاقِطِ مِنْ بَطْنِ الْمَرْأَةِ الْمَضْرُوبَةِ عَلَى ضَارِبِهَا
Two women from the tribe of Hudhail (fought with each other) and one of them threw (a stone at) the other, causing her to have a miscarriage and Messenger of Allah ﷺ gave his verdict that the killer (of the fetus) should give a male or female slave (as a Diya). (Using translation from Bukhārī 6904)
أَنَّ امْرَأَتَيْنِ مِنْ هُذَيْلٍ رَمَتْ إِحْدَاهُمَا الْأُخْرَى فَطَرَحَتْ جَنِينَهَا فَقَضَى فِيهِ رَسُولُ اللَّهِ ﷺ بِغُرَّةٍ «عَبْدٍ أَوْ وَلِيدَةٍ»
ذِكْرُ لَفْظَةٍ أَوْهَمَتْ عَالِمًا مِنَ النَّاسِ أَنَّ الْمَرْأَةَ الضَّارِبَةَ الَّتِي ذَكَرْنَاهَا مَاتَتْ قَبْلَ أَخْذِ الْعَقْلِ مِنْ عَصَبَتِهَا
[Machine] A woman from the Banu Lihyan tribe hit another woman who was pregnant, causing her to miscarry. The Messenger of Allah ﷺ decreed that the compensation for the woman who caused the miscarriage is the price of a slave, whether a male or a female. The woman who suffered the miscarriage passed away due to the complications. The Messenger of Allah ﷺ then decreed that the compensation goes to the husband and son of the deceased woman, and that her inheritance is to be given to them.
أَنَّ امْرَأَةً مِنْ بَنِي لِحْيَانَ ضَرَبَتْ أُخْرَى كَانَتْ حَامِلًا فَأَمْلَصَتْ فَقَضَى رَسُولُ اللَّهِ ﷺ فِي إِمْلَاصِ الْمَرْأَةِ بِغُرَّةٍ عَبْدٍ أَوِ أَمَةٍ قَالَ فَتُوُفِّيَتِ الْمَرْأَةُ الَّتِي عَلَيْهَا الْعَقْلُ «فَقَضَى رَسُولُ اللَّهِ ﷺ أَنَّ الْعَقْلَ عَلَى عَصَبَتِهَا وَأَنَّ مِيرَاثَهَا لِزَوْجِهَا وَابْنِهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْأَةَ الَّتِي تُوُفِّيَتْ كَانَتِ الْمَضْرُوبَةُ دُونَ الضَّارِبَةِ
About the story of Haml ibn Malik, Ibn Abbas said: She aborted a child who had grown hair and was dead, and the woman also died. He (the Prophet) gave judgment that the blood-wit was to be paid by the woman's relatives on the father's side. Her uncle said: Messenger of Allah! She has aborted a child who had grown hair. The father of the woman who had slain said: He is a liar: I swear by Allah, he did not raise his voice, or drink or eat. No compensation is to be paid for an offence like this. The Prophet ﷺ said: is it a rhymed prose of pre-Islamic Arabia and its soothsaying? Pay a male or female slave of the best quality in compensation for the child. Ibn 'Abbas said: The name of one of them was Mulaikah, and the name of the other was Umm Ghutaif. (Using translation from Abū Dāʾūd 4574)
كَانَتِ امْرَأَتَانِ ضَرَّتَانِ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَمَاتَتِ الْمَرْأَةُ فَقَضَى رَسُولُ اللَّهِ ﷺ عَلَى الْعَاقِلَةِ الدِّيَةَ فَقَالَتْ عَمَّتُهَا إِنَّهَا قَدْ أَسْقَطَتْ يَا رَسُولَ اللَّهِ غُلَامًا قَدْ نَبَتَ شَعْرُهُ فَقَالَ أَبُو الْقَاتِلَةِ إِنَّهَا كَاذِبَةٌ إِنَّهُ وَاللَّهِ مَا اسْتَهَلَّ وَلَا شَرِبَ وَلَا أَكَلْ فَمِثْلُهُ يُطَلُّ؟ فَقَالَ النَّبِيُّ ﷺ «سَجْعَ الْجَاهِلِيَّةِ غُرَّةٌ» قَالَ ابْنُ عَبَّاسٍ «اسْمُ إِحْدَاهُمَا مُلَيْكَةُ وَالْأُخْرَى أُمُّ غُطَيْفٍ»
ذِكْرُ الْخَبَرِ الْمُصَرِّحِ بِأَنَّ الْمُتَوَفَّاةَ مِنَ الْمَرْأَتَيْنِ اللَّتَيْنِ ذَكَرْنَاهُمَا كَانَتِ الْمَضْرُوبَةَ دُونَ الضَّارِبَةِ
Two women from Hudhail fought with each other and one of them hit the other with a stone that killed her and what was in her womb. The relatives of the killer and the relatives of the victim submitted their case to the Prophet ﷺ who judged that the Diya for the fetus was a male or female slave, and the Diya for the killed woman was to be paid by the 'Asaba (near relatives) of the killer. اقْتَتَلَتِ امْرَأَتَانِ مِنْ هُذَيْلٍ فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا فَاخْتَصَمُوا إِلَى رَسُولِ اللَّهِ ﷺ «فَقَضَى رَسُولُ اللَّهِ ﷺ أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ وَقَضَى بِدِيَةِ الْمَرْأَةِ عَلَى عَاقِلَتِهَا وَيَرِثُهَا وَلَدُهَا وَمَنْ تَبِعَهُمْ» فَقَالَ حَمَلُ بْنُ النَّابِغَةِ أَنَدِي يَا رَسُولَ اللَّهِ؟ كَيْفَ أَغْرَمُ مَنْ لَا أَكَلَ وَلَا شَرِبَ وَلَا نَطَقَ وَلَا اسْتَهَلَّ فَمِثْلُ هَذَا يُطَلُّ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا هَذَا مِنْ أَحْدَاثِ الْكُهَّانِ» مِنْ أَجْلِ سَجْعِهِ الَّذِي سَجَعَ
ذِكْرُ خَبَرٍ قَدْ يُوهِمُ عَالِمًا مِنَ النَّاسِ أَنَّهُ مُضَادٌّ لِإِخْبَارِ أَبِي هُرَيْرَةَ الَّتِي ذَكَرْنَاهَا
[Machine] "I was between two women, and one of them struck the other, causing her to die along with her unborn child. The Messenger of Allah ﷺ ruled in this case that a male or female slave should be killed in compensation."
«كُنْتُ بَيْنَ امْرَأَتَيْنِ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى فَقَتَلَتْهَا وَجَنِينَهَا فَقَضَى رَسُولُ اللَّهِ ﷺ فِيهِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ وَأَنْ تُقْتَلَ بِهَا»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ الْغُرَّةَ فِي الْجَنِينِ السَّاقِطِ لَا يَجِبُ عَلَى الضَّارِبِ إِلَّا عَبْدٌ، أَوْ أَمَةٌ
“The Messenger of Allah ﷺ ruled concerning a fetus that (the blood money) was a slave, male and female. The one against whom this verdict was passed said: ' Should we pay blood money for one who neither ate, drunk, shouted, nor cried, (at the moment of birth)? One such as this should be overlooked .' The Messenger of Allah ﷺ said: 'This man speaks like a poet. (But the blood money for a fetus is) a slave, male, or female.'” (Using translation from Ibn Mājah 2639)
«قَضَى رَسُولُ اللَّهِ ﷺ فِي الْجَنِينِ بِغُرَّةِ عَبْدٍ أَوْ أَمَةٍ أَوْ فَرَسٍ أَوْ بَغْلٍ فَقَالَ الَّذِي قَضَى عَلَيْهِ أَنَعْقِلُ مَنْ لَا أَكَلْ وَلَا شَرِبَ وَلَا صَاحَ وَلَا اسْتَهَلَّ مِثْلُ ذَلِكَ يُطَلُّ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ » إِنَّ هَذَا لَيَقُولُ بِقَوْلِ شَاعِرٍ فِيهِ غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ أَوْ فَرَسٌ أَوْ بَغْلٌ «
