48. Book of Crimes

٤٨۔ كِتَابُ الْجِنَايَاتِ

[Machine] The Prophet ﷺ was sitting among the people when a man approached him and asked for permission to accompany him. The Prophet allowed him, and they walked together. During their journey, the man killed a hypocrite. The Prophet ﷺ raised his voice and said, "Doesn't it testify that there is no god but Allah?" The man replied, "Yes, O Messenger of Allah, but there is no testimony for him." The Prophet said, "Doesn't it testify that I am the Messenger of Allah?" The man replied, "Yes, O Messenger of Allah, but there is no testimony for him." The Prophet asked, "Doesn't he pray?" The man replied, "Yes, but there is no prayer for him." The Prophet ﷺ said, "Those are the ones I have been forbidden from."  

ابن حبّان:٥٩٧١أَخْبَرَنَا أَحْمَدُ بْنُ عُمَيْرِ بْنِ يُوسُفَ بِدِمَشْقَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ حَمَّادٍ الطِّهْرَانِيُّ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَخْبَرَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ عَطَاءِ بْنِ يَزِيدَ عَنْ عُبَيْدِ اللَّهِ بْنِ عَدِيِّ بْنِ الْخِيَارِ أَنَّ عَبْدَ اللَّهِ بْنَ عَدِيٍّ الْأَنْصَارِيَّ حَدَّثَهُ

أَنَّ النَّبِيَّ ﷺ بَيْنَمَا هُوَ جَالِسٌ بَيْنَ ظَهْرَانَيِ النَّاسِ إِذْ جَاءَهُ رَجُلٌ يَسْتَأْذِنُهُ أَنْ يُسَارَّهُ فَسَارَّهُ فِي قَتْلِ رَجُلٍ مِنَ الْمُنَافِقِينَ فَجَهَرَ النَّبِيُّ ﷺ بِكَلَامِهِ وَقَالَ «أَلَيْسَ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ؟ » قَالَ بَلَى يَا رَسُولَ اللَّهِ وَلَا شَهَادَةَ لَهُ قَالَ «أَلَيْسَ يَشْهَدُ أَنِّي رَسُولُ اللَّهِ؟ » قَالَ بَلَى يَا رَسُولَ اللَّهِ وَلَا شَهَادَةَ لَهُ قَالَ «أَلَيْسَ يُصَلِّي؟ » قَالَ بَلَى وَلَا صَلَاةَ لَهُ فَقَالَ النَّبِيُّ ﷺ «أُولَئِكَ الَّذِينَ نُهِيتُ عَنْهُمْ»  

ذِكْرُ الْبَيَانِ بِأَنَّ تَحْرِيمَ اللَّهِ جَلَّ وَعَلَا أَمْوَالَ الْمُسْلِمِينَ، وَدِمَاءَهُمْ، وَأَعْرَاضَهُمْ كَانَ ذَلِكَ فِي حَجَّةِ الْوَدَاعِ قَبْلَ أَنْ يَقْبِضَ اللَّهُ جَلَّ وَعَلَا رَسُولَهُ ﷺ إِلَى جَنَّتِهِ بِثَلَاثَةِ أَشْهُرٍ وَيَوْمَيْنِ

The Prophet ﷺ said, "Time has come back to its original state which it had when Allah created the Heavens and the Earth; the year is twelve months, four of which are sacred. Three of them are in succession; Dhul-Qa'da, Dhul-Hijja and Al-Muharram, and (the fourth being) Rajab Mudar (named after the tribe of Mudar as they used to respect this month) which stands between Jumad (ath-thani) and Sha'ban." ابن حبّان:٥٩٧٤أَخْبَرَنَا الْحُسَيْنُ بْنُ عَبْدِ اللَّهِ الْقَطَّانُ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ هَانِئٍ حَدَّثَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ حَدَّثَنَا أَيُّوبُ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنِ ابْنِ أَبِي بَكْرَةَ عَنْ أَبِي بَكْرَةَ

عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ الزَّمَانَ قَدِ اسْتَدَارَ كَهَيْئَتِهِ يَوْمَ خَلَقَ اللَّهُ السَّمَاوَاتِ وَالْأَرْضَ السُّنَّةُ اثْنَا عَشَرَ شَهْرًا مِنْهَا أَرْبَعَةٌ حُرُمٌ ثَلَاثٌ مُتَوَالِيَاتٌ ذُو الْقَعْدَةِ وَذُو الْحِجَّةِ وَالْمُحَرَّمُ وَرَجَبُ مُضَرَ الَّذِي بَيْنَ جُمَادَى وَشَعْبَانَ» ثُمَّ قَالَ «أَيُّ شَهْرٍ هَذَا»؟ قُلْنَا اللَّهُ وَرَسُولُهُ أَعْلَمُ قَالَ فَسَكَتَ حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ بِغَيْرِ اسْمِهِ قَالَ «أَلَيْسَ ذَا الْحِجَّةِ؟ » قُلْنَا نَعَمْ قَالَ «أَيُّ بَلَدٍ هَذَا؟ » قُلْنَا اللَّهُ وَرَسُولُهُ أَعْلَمُ قَالَ فَسَكَتَ حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ بِغَيْرِ اسْمِهِ قَالَ «أَلَيْسَ ذَا الْبَلْدَةَ؟ » قُلْنَا نَعَمْ قَالَ «أَيُّ يَوْمٍ هَذَا»؟ قُلْنَا اللَّهُ وَرَسُولُهُ أَعْلَمُ قَالَ «أَلَيْسَ يَوْمَ النَّحْرِ؟ » قُلْنَا بَلَى قَالَ «فَإِنَّ دِمَاءَكُمْ وَأَمْوَالَكُمْ قَالَ مُحَمَّدٌ وَأَحْسِبُهُ قَالَ وَأَعْرَاضَكُمْ عَلَيْكُمْ حَرَامٌ كَحُرْمَةِ يَوْمِكُمْ هَذَا فِي بَلَدِكُمْ هَذَا وَسَتَلْقَوْنَ رَبَّكُمْ فَيَسْأَلُكُمْ عَنْ أَعْمَالِكُمْ أَلَا فَلَا تَرْجِعُوا بَعْدِي ضُلَّالًا يَضْرِبُ بَعْضُكُمْ رِقَابَ بَعْضٍ أَلَا لِيُبَلِّغِ الشَّاهِدُ مِنْكُمُ الْغَائِبَ فَلَعَلَّ بَعْضَ مَنْ يَبْلُغُهُ يَكُونُ أَوْعَى لَهُ مِنْ بَعْضِ مَنْ سَمِعَهُ» قَالَ فَكَانَ مُحَمَّدٌ إِذَا ذَكَرَهُ يَقُولُ صَدَقَ اللَّهُ وَرَسُولُهُ قَدْ كَانَ ذَاكَ ثُمَّ قَالَ ﷺ «أَلَا هَلْ بَلَّغْتُ؟ أَلَا هَلْ بَلَّغْتُ؟ »  

ذِكْرُ الْإِخْبَارِ عَنِ اسْتِدَارَةِ الزَّمَانِ فِي ذَلِكَ الْوَقْتِ

The Prophet ﷺ said, "Time has taken its original shape which it had when Allah created the Heavens and the Earth. The year is of twelve months, four of which are sacred, and out of these (four) three are in succession, i.e. Dhul-Qa'da, Dhul-Hijja and Al-Muharram, and the fourth is Rajab which is named after the Mudar tribe, between (the month of) Jumaida (ath-thania) and Sha'ban." Then the Prophet ﷺ asked, "Which is this month?" We said, "Allah and His Apostle know better." On that the Prophet ﷺ kept quiet so long that we thought that he might name it with another name. Then the Prophet ﷺ said, "Isn't it the month of Dhul-Hijja?" We replied, "Yes." Then he said, "Which town is this?" "We replied, "Allah and His Apostle know better." On that he kept quiet so long that we thought that he might name it with another name. Then he said, "Isn't it the town of Mecca?" We replied, "Yes, " Then he said, "Which day is today?" We replied, "Allah and His Apostle know better." He kept quiet so long that we thought that he might name it with another name. Then he said, "Isn't it the day of An- Nahr (i.e. sacrifice)?" We replied, "Yes." He said, "So your blood, your properties, (The sub-narrator Muhammad said, 'I think the Prophet ﷺ also said: And your honor..) are sacred to one another like the sanctity of this day of yours, in this city of yours, in this month of yours; and surely, you will meet your Lord, and He will ask you about your deeds. Beware! Do not become infidels after me, cutting the throats of one another. It is incumbent on those who are present to convey this message (of mine) to those who are absent. May be that some of those to whom it will be conveyed will understand it better than those who have actually heard it." (The sub-narrator, Muhammad, on remembering that narration, used to say, "Muhammad spoke the truth!") He (i.e. Prophet) then added twice, "No doubt! Haven't I conveyed (Allah's Message) to you?" عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ الزَّمَانَ قَدِ اسْتَدَارَ كَهَيْئَتِهِ يَوْمَ خَلَقَ اللَّهُ السَّمَاوَاتِ وَالْأَرْضَ وَالسُّنَّةُ اثْنَا عَشَرَ شَهْرًا مِنْهَا أَرْبَعَةٌ حُرُمٌ ثَلَاثَةٌ مُتَوَالِيَاتٌ ذُو الْقَعْدَةِ وَذُو الْحِجَّةِ وَالْمُحَرَّمُ وَرَجَبُ مُضَرَ الَّذِي بَيْنَ جُمَادَى وَشَعْبَانَ» ثُمَّ قَالَ «أَيُّ شَهْرٍ هَذَا؟ » قُلْنَا اللَّهُ وَرَسُولُهُ أَعْلَمُ قَالَ فَسَكَتَ حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ بِغَيْرِ اسْمِهِ قَالَ «أَلَيْسَ ذَا الْحِجَّةِ» قُلْنَا بَلَى قَالَ «فَأَيُّ بَلَدٍ هَذَا؟ » قُلْنَا اللَّهُ وَرَسُولُهُ أَعْلَمُ قَالَ فَسَكَتَ حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ بِغَيْرِ اسْمِهِ قَالَ «أَلَيْسَ الْبَلَدَ الْحَرَامَ؟ » قُلْنَا بَلَى قَالَ «فَأَيُّ يَوْمٍ هَذَا؟ » قُلْنَا اللَّهُ وَرَسُولُهُ أَعْلَمُ قَالَ فَسَكَتَ حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ بِغَيْرِ اسْمِهِ قَالَ «أَلَيْسَ يَوْمَ النَّحْرِ؟ » قُلْنَا بَلَى قَالَ «فَإِنَّ دِمَاءَكُمْ وَأَمْوَالَكُمْ قَالَ مُحَمَّدٌ وَأَحْسِبُهُ قَالَ وَأَعْرَاضَكُمْ حَرَامٌ عَلَيْكُمْ كَحُرْمَةِ يَوْمِكُمْ هَذَا فِي شَهْرِكُمْ هَذَا فِي بَلَدِكُمْ هَذَا وَسَتَلْقَوْنَ رَبَّكُمْ فَيَسْأَلُكُمْ عَنْ أَعْمَالِكُمْ فَلَا تَرْجِعُوا بَعْدِي ضُلَّالًا يَضْرِبُ بَعْضُكُمْ رِقَابَ بَعْضٍ أَلَا لِيُبَلِّغِ الشَّاهِدُ الْغَائِبَ فَلَعَلَّ بَعْضَ مَنْ يَبْلُغُهُ يَكُونُ أَوْعَى لَهُ مِنْ بَعْضِ مَنْ سَمِعَهُ أَلَا هَلْ بَلَّغْتُ؟ »  

ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «إِنَّ دِمَاءَكُمَ حَرَامٌ عَلَيْكُمْ» لَفْظٌ عَامٌّ، مُرَادُهَا خَاصٌّ، أَرَادَ بِهِ بَعْضَ الدِّمَاءِ لَا الْكُلَّ

The blood of a Muslim man who testifies that there is no god but Allah and that I am the Messenger of Allah should not be lawfully shed but only for one of three reasons: married fornicator, soul for soul, and one who deserts his religion separating himself from the community. (Using translation from Abū Dāʾūd 4352)   

ابن حبّان:٥٩٧٦أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ الْجُمَحِيُّ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ الْعَبْدِيُّ قَالَ حَدَّثَنَا سُفْيَانُ الثَّوْرِيُّ عَنِ الْأَعْمَشِ عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ عَنْ مَسْرُوقٍ عَنِ ابْنِ مَسْعُودٍ قَالَ

قَامَ مَقَامِي هَذَا رَسُولُ اللَّهِ ﷺ فَقَالَ «وَالَّذِي لَا إِلَهَ غَيْرُهُ لَا يَحِلُّ دَمُ رَجُلٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللَّهُ وَأَنِّي رَسُولُ اللَّهِ إِلَّا فِي إِحْدَى ثَلَاثٍ التَّارِكُ الْإِسْلَامَ الْمُفَارِقُ لِلْجَمَاعَةِ وَالثَّيِّبُ الزَّانِي وَالنَّفْسُ بِالنَّفْسِ»  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلُ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ لَمْ يَسْمَعْهُ الْأَعْمَشُ عَنْ عَبْدِ اللَّهِ بْنِ مُرَّةَ

"It is not permissible to shed the blood of a Muslim except in one of three cases: A soul for a soul, a adulterer who has been married, and one who separates leaving his religion." (Using translation from Nasāʾī 4721)   

ابن حبّان:٥٩٧٧أَخْبَرَنَا مُحَمَّدُ بْنُ عُمَرَ بْنِ يُوسُفَ قَالَ حَدَّثَنَا بِشْرُ بْنُ خَالِدٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ سُلَيْمَانَ قَالَ سَمِعْتُ عَبْدَ اللَّهِ بْنَ مُرَّةَ عَنْ مَسْرُوقٍ عَنْ عَبْدِ اللَّهِ

عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ «لَا يَحِلُّ دَمُ مُسْلِمٍ إِلَّا بِإِحْدَى ثَلَاثٍ النَّفْسُ بِالنَّفْسِ وَالثَّيِّبُ الزَّانِي وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ لِلْجَمَاعَةِ»  

ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ قَوْلَهُ ﷺ «إِنَّ أَمْوَالَكُمَ حَرَامٌ عَلَيْكُمْ» أَرَادَ بِهِ بَعْضَ الْأَمْوَالِ لَا الْكُلَّ

[Machine] ہمेशاً مُحمد (صلی اللہ علیہ وسلم) نے فرمایا، "کسی شخص کو اپنے چھوٹے بھائی کی کلیہ لے لینا جس سے مطمئنیت نہ ہو، اس کا حق نہیں ہے"۔ یہ اس وجہ سے کہ اللہ تعالیٰ نے مسلمان کی مالی کی جب بھی عورت پر مسلط کردی ہو، آپس میں حرام قرار دیا ہے۔  

ابن حبّان:٥٩٧٨أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا أَبُو خَيْثَمَةَ قَالَ حَدَّثَنَا أَبُو عَامِرٍ الْعَقَدِيُّ عَنْ سُلَيْمَانَ بْنِ بِلَالٍ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ سَعْدٍ عَنْ أَبِي حُمَيْدٍ السَّاعِدِيِّ

أَنَّ النَّبِيَّ ﷺ قَالَ «لَا يَحِلُّ لِامْرِئٍ أَنْ يَأْخُذَ عَصَا أَخِيهِ بِغَيْرِ طِيبِ نَفْسٍ مِنْهُ» قَالَ ذَلِكَ لِشِدَّةِ مَا حَرَّمَ اللَّهُ مِنْ مَالِ الْمُسْلِمِ عَلَى الْمُسْلِمِ  

ذِكْرُ نَفْيِ اسْمِ الْإِيمَانِ عَنِ الْقَاتِلِ مُسْلِمًا بِغَيْرِ حَقِّهِ

The Prophet ﷺ said, "When (a person) an adulterer commits illegal sexual intercourse then he is not a believer at the time he is doing it; and when somebody steals, then he is not a believer at the time he is stealing." (Using translation from Bukhārī 6782)  

ابن حبّان:٥٩٧٩أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْأَزْدِيُّ حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ أَخْبَرَنَا مَعْمَرٌ عَنْ هَمَّامِ بْنِ مُنَبِّهٍ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ وَلَا يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ إِلَيْهَا الْمُؤْمِنُونَ أَعْيُنَهُمْ وَهُوَ حِينَ يَنْتَهِبُهَا مُؤْمِنٌ وَلَا يَقْتُلُ أَحَدُكُمْ حِينَ يَقْتُلُ وَهُوَ مُؤْمِنٌ فَإِيَّاكُمْ إِيَّاكُمْ»  

ذِكْرُ إِيجَابِ دُخُولِ النَّارِ لِلْقَاتِلِ أَخَاهُ الْمُسْلِمَ مُتَعَمِّدًا

[Machine] I heard the Messenger of Allah ﷺ say, "Every sin may be forgiven by Allah, except for a person who dies while associating partners with Allah or someone who deliberately kills a believer."  

ابن حبّان:٥٩٨٠أَخْبَرَنَا الْقَطَّانُ بِالرَّقَّةِ قَالَ حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ قَالَ حَدَّثَنَا صَدَقَةُ بْنُ خَالِدٍ قَالَ حَدَّثَنَا خَالِدُ بْنُ دِهْقَانَ قَالَ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ أَبِي زَكَرِيَّا قَالَ سَمِعْتُ أُمَّ الدَّرْدَاءِ تَقُولُ سَمِعْتُ أَبَا الدَّرْدَاءِ يَقُولُ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «كُلُّ ذَنْبٍ عَسَى اللَّهُ أَنْ يَغْفِرَهُ إِلَّا مَنْ مَاتَ مُشْرِكًا أَوْ مَنْ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا»  

ذِكْرُ التَّغْلِيظِ عَلَى مَنْ قَاتَلَ أَخَاهُ الْمُسْلِمَ حَتَّى قُتِلَ

"The Messenger [SAW] said: 'If two Muslims meet (and fight) with their swords and one of them kills the other, the killer and the slain will both be in Hell.'" (Using translation from Nasāʾī 4121)

رَسُوْلُ اللهِ صَلَّى اللهُ عَلَيهِ وَسَلَّمَ «إِذَا التَقَى المُسْلِمَان بِسَيْفَيْهِمَا فَقَتَلَ أَحَدُهُما صَاحِبَهُ فَالقَاتِلُ والمَقْتُولُ فِي النَّارِ»  

ذِكْرُ الزَّجْرِ عَنْ قَتْلِ الْمَرْءِ مَنْ أَمِنَهُ عَلَى دَمِهِ

[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever guarantees the safety of a man's life, then kills him, I am innocent of his blood, even if the murdered person was a disbeliever."  

ابن حبّان:٥٩٨٢أَخْبَرَنَا عِمْرَانُ بْنُ مُوسَى بْنِ مُجَاشِعٍ حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ قَالَ حَدَّثَنَا أَبُو أُسَامَةَ عَنْ زَائِدَةَ قَالَ حَدَّثَنِي إِسْمَاعِيلُ السُّدِّيُّ عَنْ رِفَاعَةَ الْفِتْيَانِيِّ عَنْ عَمْرِو بْنِ الْحَمِقِ قَالَ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «أَيُّمَا رَجُلٍ أَمِنَ رَجُلًا عَلَى دَمِهِ ثُمَّ قَتَلَهُ فَأَنَا مِنَ الْقَاتِلِ بَرِيءٌ وَإِنْ كَانَ الْمَقْتُولُ كَافِرًا»  

ذِكْرُ مَا يَلْزَمُ ابْنَ آدَمَ مِنْ إِثْمِ مَنْ قَتَلَ بَعْدَهُ مُسْلِمًا، لِاسْتِنَانِهِ ذَلِكَ الْفِعْلَ لِمَنْ بَعْدَهُ

“No person is killed wrongfully, but a share of responsibility for his blood will be upon, the first son of Adam, because he was the first one to kill.” (Using translation from Ibn Mājah 2616)

I heard the Messenger of Allah ﷺ as saying: Do not kill your children secretly, for the milk, with which a child is suckled while his mother is pregnant, overtakes the horseman and throws him from his horse. (Using translation from Abū Dāʾūd 3881)  

ابن حبّان:٥٩٨٤أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى قَالَ حَدَّثَنَا أَبُو خَيْثَمَةَ قَالَ حَدَّثَنَا الْفَضْلُ بْنُ دُكَيْنٍ قَالَ حَدَّثَنَا عَبْدُ الْمَلِكِ بْنُ حُمَيْدِ بْنِ أَبِي غَنِيَّةَ عَنْ مُحَمَّدِ بْنِ الْمُهَاجِرِ عَنْ أَبِيهِ عَنْ أَسْمَاءَ بِنْتِ يَزِيدَ بْنِ السَّكَنِ قَالَتْ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا تَقْتُلُوا أَوْلَادَكُمْ سِرًّا فَإِنَّ قَتْلَ الْغَيْلِ يُدْرِكُ الْفَارِسَ فَيُدَعْثِرُهُ عَنْ فَرَسِهِ»  

ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا نُهِيَ عَنْ قَتْلِ الْمُسْلِمِينَ

“I shall reach the Cistern (Haud) before you, and I will boast of your great numbers before the nations, so do not fight one another after I am gone.’” (Using translation from Ibn Mājah 3944)   

ابن حبّان:٥٩٨٥أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ قَالَ حَدَّثَنَا حَبَّانُ بْنُ مُوسَى قَالَ أَخْبَرَنَا عَبْدُ اللَّهِ عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ عَنْ قَيْسِ بْنِ أَبِي حَازِمٍ عَنِ الصُّنَابِحِ

عَنِ النَّبِيِّ ﷺ قَالَ «إِنِّي فَرَطُكُمْ عَلَى الْحَوْضِ وَإِنِّي مُكَاثِرٌ بِكُمُ الْأُمَمَ فَلَا تَقْتَتِلُنَّ بَعْدِي»  

ذِكْرُ تَعْذِيبِ اللَّهِ جَلَّ وَعَلَا فِي النَّارِ مَنْ قَتَلَ نَفْسَهُ فِي الدُّنْيَا

The Prophet ﷺ said, "Whoever purposely throws himself from a mountain and kills himself, will be in the (Hell) Fire falling down into it and abiding therein perpetually forever; and whoever drinks poison and kills himself with it, he will be carrying his poison in his hand and drinking it in the (Hell) Fire wherein he will abide eternally forever; and whoever kills himself with an iron weapon, will be carrying that weapon in his hand and stabbing his ʿAbdomen with it in the (Hell) Fire wherein he will abide eternally forever." (Using translation from Bukhārī 5778)  

ابن حبّان:٥٩٨٦أَخْبَرَنَا أَبُو خَلِيفَةَ قَالَ حَدَّثَنَا أَبُو الْوَلِيدِ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ سُلَيْمَانَ عَنْ ذَكْوَانَ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ «مَنْ قَتَلَ نَفْسَهُ بِحَدِيدَةٍ فَحَدِيدَتُهُ فِي يَدِهِ يَجَأُ بِهَا فِي بَطْنِهِ يَهْوِي فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا وَمَنْ قَتَلَ نَفْسَهُ بِسُمٍّ فَسُمُّهُ فِي يَدِهِ يَتَحَسَّاهُ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا وَمَنْ تَرَدَّى مِنْ جَبَلٍ مُتَعَمِّدًا فَقَتَلَ نَفْسَهُ فَهُوَ يَتَرَدَّى فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا»  

ذِكْرُ تَعْذِيبِ اللَّهِ جَلَّ وَعَلَا فِي النَّارِ الْقَاتِلَ نَفْسَهُ بِمَا قُتِلَ بِهِ

[Machine] From the Messenger of Allah ﷺ , he said: "Whoever suffocates himself in the world, he will suffocate himself in the Fire. And whoever stabs himself, he will be stabbed in the Fire. And whoever commits suicide, he will enter the Fire."

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «مَنْ خَنَقَ نَفْسَهُ فِي الدُّنْيَا فَقَتَلَهَا خَنَقَ نَفْسَهُ فِي النَّارِ وَمَنْ طَعَنَ نَفْسَهُ طَعَنَهَا فِي النَّارِ وَمَنِ اقْتَحَمَ فَقَتَلَ نَفْسَهُ اقْتَحَمَ فِي النَّارِ»  

ذِكْرُ تَحْرِيمِ اللَّهِ جَلَّ وَعَلَا الْجَنَّةَ عَلَى الْقَاتِلِ نَفْسَهُ فِي حَالَةٍ مِنَ الْأَحْوَالِ

[Machine] To lie about the Messenger of Allah ﷺ said that the Messenger of Allah ﷺ said: "A man from amongst those before you was afflicted with a wound, and he took a knife and cut his hand with it, and the blood did not stop till he died. Allah, the Blessed and Exalted, said: 'My slave hastened to bring death upon himself, so I have forbidden Paradise for him.'"  

ابن حبّان:٥٩٨٨أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى الزَّمِنُ حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ حَدَّثَنِي أَبِي قَالَ سَمِعْتُ الْحَسَنَ يَقُولُ حَدَّثَنَا جُنْدُبُ بْنُ عَبْدِ اللَّهِ فِي هَذَا الْمَسْجِدِ فَمَا نَسِينَا مِنْهُ حَدَّثَنَا وَلَا نَخْشَى

أَنْ يَكُونَ كَذَبَ عَلَى رَسُولِ اللَّهِ ﷺ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «خَرَجَ بِرَجُلٍ خُرَّاجٌ مِمَّنْ كَانَ قَبْلَكُمْ فَأَخَذَ سِكِّينًا فَوْجَأَ بِهَا فَمَا رَقَأَ الدَّمُ عَنْهُ حَتَّى مَاتَ فَقَالَ اللَّهُ تَبَارَكَ وَتَعَالَى عَبْدِي بَادَرَنِي بِنَفْسِهِ حَرَّمْتُ عَلَيْهِ الْجَنَّةَ»  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ تَفَرَّدَ بِهِ جَرِيرُ بْنُ حَازِمٍ

[Machine] I heard Al-Hasan saying, "Indeed, a man from among those who lived before you had a wound that continued to bleed. When it pained him, he extracted an arrow from his body and pricked the wound, however, his blood did not clot until he died. He then said, 'Your Lord has forbidden Paradise for him.'"  

ابن حبّان:٥٩٨٩أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الْأَزْدِيُّ حَدَّثَنَا مُحَمَّدُ بْنُ رَافِعٍ حَدَّثَنَا أَبُو أَحْمَدَ الزُّبَيْرِيُّ حَدَّثَنَا شَيْبَانُ بْنُ عَبْدِ الرَّحْمَنِ قَالَ

سَمِعْتُ الْحَسَنَ يَقُولُ «إِنَّ رَجُلًا مِمَّنْ كَانَ قَبْلَكُمْ خَرَجَتْ بِهِ قُرْحَةٌ فَلَمَّا آذَتْهُ انْتَزَعَ سَهْمًا مِنْ كِنَانَتِهِ فَنَكَأَهَا فَلَمْ يَرْقَأْ دَمُهُ حَتَّى مَاتَ فَقَالَ رَبُّكُمْ قَدْ حَرَّمْتُ عَلَيْهِ الْجَنَّةَ»

[Machine] The Messenger of Allah ﷺ sent a small group to raid a tribe. One man from the tribe separated from the rest, and a man from the group followed him with his sword visible. The man said, "I am a Muslim," but the other man did not pay attention to what he said and struck him, killing him. The news was conveyed to the Messenger of Allah ﷺ , who said something severe about the incident. The killer approached and said, "O Messenger of Allah, I swear by Allah, he did not say anything except seeking protection from being killed." The Messenger of Allah ﷺ turned away from him and everyone around him. He continued his sermon and then turned back to the man and said, "O Messenger of Allah, he did not say anything except seeking protection from being killed." The Messenger of Allah ﷺ turned away from him and everyone around him again. Unable to contain himself, the man said it a third time, and the anger on the Messenger's face became apparent. He said, "Allah has made it forbidden for me to kill a believer," repeating it three times.  

ابن حبّان:٥٩٧٢أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى قَالَ حَدَّثَنَا شَيْبَانُ بْنُ أَبِي شَيْبَةَ قَالَ حَدَّثَنَا سُلَيْمَانُ بْنُ الْمُغِيرَةِ* قَالَ حَدَّثَنَا حُمَيْدُ بْنُ هِلَالٍ قَالَ أَتَانِي أَبُو الْعَالِيَةِ وَصَاحِبٌ لِي فَقَالَ هَلُمَّا فَإِنَّكُمَا أَشَبُّ شَبَابًا وَأَوْعَى لِلْحَدِيثِ مِنِّي فَانْطَلَقْنَا حَتَّى أَتَيْنَا بِشْرَ بْنَ عَاصِمٍ اللَّيْثِيَّ* قَالَ أَبُو الْعَالِيَةِ حَدِّثْ هَذَيْنِ قَالَ بِشْرٌ حَدَّثَنَا عُقْبَةُ بْنُ مَالِكٍ وَكَانَ مِنْ رَهْطِهِ قَالَ

بَعَثَ رَسُولُ اللَّهِ ﷺ سَرِيَّةً فَغَارَتْ عَلَى قَوْمٍ فَشَذَّ مِنَ الْقَوْمِ رَجُلٌ وَاتَّبَعَهُ رَجُلٌ مِنَ السَّرِيَّةِ وَمَعَهُ السَّيْفُ شَاهِرُهُ فَقَالَ إِنِّي مُسْلِمٌ فَلَمْ يَنْظُرْ فِيمَا قَالَ فَضَرَبَهُ فَقَتَلَهُ قَالَ فَنُمِيَ الْحَدِيثُ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ فِيهِ قَوْلًا شَدِيدًا فَبَلَغَ الْقَاتِلَ قَالَ فَبَيْنَمَا رَسُولُ اللَّهِ ﷺ يَخْطُبُ إِذْ قَالَ الْقَاتِلُ يَا رَسُولَ اللَّهِ وَاللَّهِ مَا قَالَ الَّذِي قَالَ إِلَّا تَعَوُّذًا مِنَ الْقَتْلِ فَأَعْرَضَ عَنْهُ رَسُولُ اللَّهِ ﷺ وَعَمَّنْ قِبَلَهُ مِنَ النَّاسِ وَأَخَذَ فِي خُطْبَتِهِ قَالَ ثُمَّ عَادَ فَقَالَ يَا رَسُولَ اللَّهِ مَا قَالَ الَّذِي قَالَ إِلَّا تَعَوُّذًا مِنَ الْقَتْلِ فَأَعْرَضَ عَنْهُ رَسُولُ اللَّهِ ﷺ وَعَمَّنْ قِبَلَهُ مِنَ النَّاسِ فَلَمْ يَصْبِرْ أَنْ قَالَ الثَّالِثَةَ فَأَقْبَلَ عَلَيْهِ تُعْرَفُ الْمَسَاءَةُ فِي وَجْهِهِ فَقَالَ «إِنَّ اللَّهَ حَرَّمَ* عَليَّ أَنْ أَقْتُلَ مُؤْمِنًا» ثَلَاثَ مَرَّاتٍ

[Machine] Narrated Abu Bakrah: The Prophet ﷺ stood up on his camel and held its reins. A man held its noseband or bridle and asked, "Which day is this?" We remained silent until we thought that he might name it differently. The Prophet ﷺ said, "Is this not the day of sacrifice (Eid al-Adha)?" We replied, "Yes, it is." He then asked, "Which month is this?" Again, we remained silent until we thought that he might name it differently. The Prophet ﷺ said, "Is this not the month of Dhul-Hijjah?" We replied, "Yes, it is." He then asked, "Which land is this?" Again, we remained silent until we thought that he might name it differently. The Prophet ﷺ said, "Is this not the sacred land (Makkah)?" We replied, "Yes, it is." He said, "Then surely, the blood, wealth, and honor of every Muslim among you is as sacred as this day of yours, in this month of yours, in this land of yours. Let the witness among you convey (the message) to the absent one, for the witness may convey it to one who is more mindful of it than he is."  

ابن حبّان:٥٩٧٣أَخْبَرَنَا عُمَرُ بْنُ مُحَمَّدٍ الْهَمْدَانِيُّ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى قَالَ حَدَّثَنَا بِشْرُ بْنُ مُفَضَّلٍ قَالَ حَدَّثَنَا ابْنُ عَوْنٍ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرَةَ

عَنْ أَبِي بَكْرَةَ ذَكَرَ النَّبِيُّ ﷺ قَالَ وَقَفَ عَلَى بَعِيرِهِ وَأَمْسَكَ إِنْسَانٌ بِخِطَامِهِ أَوْ قَالَ بِزِمَامِهِ فَقَالَ «أَيُّ يَوْمٍ هَذَا»؟ فَسَكَتْنَا حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ سِوَى اسْمِهِ فَقَالَ «أَلَيْسَ بِيَوْمِ النَّحْرِ»؟ قُلْنَا بَلَى قَالَ «فَأَيُّ شَهْرٍ هَذَا»؟ فَسَكَتْنَا حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ سِوَى اسْمِهِ فَقَالَ «أَلَيْسَ بِذِي الْحِجَّةِ»؟ قُلْنَا بَلَى قَالَ «فَأَيُّ بَلَدٍ هَذَا»؟ فَسَكَتْنَا حَتَّى ظَنَنَّا أَنَّهُ سَيُسَمِّيهِ سِوَى اسْمِهِ فَقَالَ «أَلَيْسَ الْبَلَدَ الْحَرَامَ»؟ قُلْنَا بَلَى قَالَ «فَإِنَّ دِمَاءَكُمْ وَأَمْوَالَكُمْ وَأَعْرَاضَكُمْ بَيْنَكُمْ حَرَامٌ عَلَيْكُمْ كَحُرْمَةِ يَوْمِكُمْ هَذَا فِي شَهْرِكُمْ هَذَا فِي بَلَدِكُمْ هَذَا أَلَا لِيُبَلِّغِ الشَّاهِدُ مِنْكُمُ الْغَائِبَ فَإِنَّ الشَّاهِدَ عَسَى يُبَلِّغُ مَنْ هُوَ أَوْعَى لَهُ مِنْهُ»

We were along with Messenger of Allah ﷺ in an expedition that a person from amongst the emigrants struck at the back of a person from the Ansir. The Ansiri said: O Ansar! And the Muhijir said: O Emigrants! Thereupon Messenger of Allah ﷺ said: What are these proclamations of the Days of Ignorance? They said: Messenger of Allah, a person from the emigrants struck at the back of an Ansari, whereupon he said: It is something disgusting. 'Abdullah b. Ubayy heard it and said: They have indeed done it. By Allah, when we would return to Medina the respectable amongst them (the Ansar) would turn away the mean (the emigrants). Thereupon 'Umar said: Permit me so that I should strike the neck of this hypocrite. But he (the Holy Prophet) said: Leave him, the people may not say that Muhammad kills his companions. ابن حبّان:٥٩٩٠أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا عَمْرُو بْنُ مُحَمَّدٍ النَّاقِدُ حَدَّثَنَا سُفْيَانُ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ قَالَ

كَسَعَ رَجُلٌ مِنَ الْمُهَاجِرِينَ رَجُلًا مِنَ الْأَنْصَارِ فَقَالَ الْأَنْصَارِيُّ يَا لَلْأَنْصَارِ وَقَالَ الْمُهَاجِرِيُّ يَا لَلْمُهَاجِرِينَ قَالَ فَسَمِعَ النَّبِيُّ ﷺ ذَاكَ فَقَالَ «مَا بَالُ دَعْوَى الْجَاهِلِيَّةِ؟ » فَقَالُوا يَا رَسُولَ اللَّهِ رَجُلٌ مِنَ الْمُهَاجِرِينَ كَسَعَ رَجُلًا مِنَ الْأَنْصَارِ فَقَالَ «دَعُوهَا فَإِنَّهَا مُنْتِنَةٌ» فَقَالَ عَبْدُ اللَّهِ بْنُ أَبَيِّ ابْنُ سَلُولٍ قَدْ فَعَلُوهَا لَئِنْ رَجَعْنَا إِلَى الْمَدِينَةِ لَيُخْرِجَنَّ الْأَعَزُّ مِنْهَا الْأَذَلَّ فَقَالَ عُمَرُ دَعْنِي يَا رَسُولَ اللَّهِ أَضْرِبْ عُنُقَ هَذَا الْمُنَافِقِ فَقَالَ «دَعْهُ لَا يَتَحَدَّثُ النَّاسُ أَنَّ مُحَمَّدًا يَقْتُلُ أَصْحَابَهُ»  

ذِكْرُ الْحُكْمِ فِي الْقَوَدِ عَنِ الْمُسْلِمِينَ وَأَهْلِ الذِّمَّةِ، أَوْ بَعْضِهِمْ مَعَ بَعْضٍ

Has so and so killed you? She indicated with the nod of her head: No. He said for the second time, and she again said: No with the nod of her head. He asked for the third time, and she said: Yes with the nod of her head and Messenger of Allah ﷺ commanded to crush his head between two stones. (Using translation from Muslim 1672a)

أَنَّ يَهُودِيًّا قَتَلَ جَارِيَةً عَلَى أَوْضَاحٍ لَهَا قَتَلَهَا بِحَجَرٍ قَالَ فَجِيءَ بِهَا وَبِهَا رَمَقٌ قَالَ لَهَا «أَقَتَلَكِ فُلَانٌ»؟ فَأَشَارَتْ بِرَأْسِهَا أَنْ لَا ثُمَّ قَالَ لَهَا الثَّانِيَةَ فَأَشَارَتْ بِرَأْسِهَا أَنْ لَا ثُمَّ سَأَلَهَا الثَّالِثَةَ فَقَالَتْ نَعَمْ وَأَشَارَتْ بِرَأْسِهَا فَقَتَلَهُ رَسُولُ اللَّهِ ﷺ بَيْنَ حَجَرَيْنِ  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ قَتَلَ قَاتِلَ الْمَرْأَةِ الَّتِي وَصَفْنَاهَا بِإِقْرَارِهِ عَلَى نَفْسِهِ بِقَتْلِهِ إِيَّاهَا، لَا بِإِقْرَارِهَا عَلَيْهِ بِهِ

A girl was found with her head crushed between two stones. She was asked: Who has done this to you ? Is it so and so ? Is it so and so, until a Jew was named, and she gave a sign with her head. The Jew was caught ad he admitted. So the Prophet ﷺ gave command that his head should be crushed with stones. (Using translation from Abū Dāʾūd 4527)   

ابن حبّان:٥٩٩٣أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ قَالَ حَدَّثَنَا هُدْبَةُ بْنُ خَالِدٍ الْقَيْسِيُّ قَالَ حَدَّثَنَا هَمَّامُ بْنُ يَحْيَى قَالَ حَدَّثَنَا قَتَادَةُ عَنْ أَنَسِ بْنِ مَالِكٍ

أَنَّ جَارِيَةً وُجِدَ رَأْسُهَا قَدْ رُضَّ بَيْنَ حَجَرَيْنِ فَقَالُوا لَهَا مَنْ فَعَلَ هَذَا بِكِ؟ فُلَانٌ وَفُلَانٌ؟ حَتَّى ذُكِرَ رَجُلٌ يَهُودِيٌّ فَأَوْمَأَتْ بِرَأْسِهَا فَأُخِذَ الْيَهُودِيُّ فَأَقَرَّ «فَأَمَرَ بِهِ رَسُولُ اللَّهِ ﷺ أَنْ يُرَضَّ رَأْسُهُ بِالْحِجَارَةِ»  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْءَ يَجِبُ أَنْ يُحْسِنَ الْقِتْلَةَ فِي الْقِصَاصِ، إِذْ هُوَ مِنْ أَخْلَاقِ الْمُؤْمِنِينَ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِنَّ أَعَفَّ النَّاسِ قِتْلَةً أَهْلُ الْإِيمَانِ»

[Machine] "I accompanied my father to the Messenger of Allah ﷺ . When I saw him, my father asked, 'Who is this?' I replied, 'I do not know.' My father said, 'This is the Messenger of Allah ﷺ .' Hearing that, I got goosebumps because I had always thought that the Messenger of Allah ﷺ did not resemble other people. But there he was, with a large abundance of abundant black hair, with traces of henna on it, and wearing two green garments. My father greeted him, and then he started speaking to us for a while. He asked, 'Is this your son?' My father replied, 'Yes, I swear by the Lord of the Kaaba, I bear witness to it.' The Messenger of Allah ﷺ said, 'Indeed, your son will not harm you, nor will you harm him.' Then the Messenger of Allah ﷺ recited the verse, 'No bearer of burdens will bear the burden of another.' Then he looked at the merchandise that was between his shoulders and said, 'O Messenger of Allah, I am like a skilled physician. Should I treat it?' He replied, 'Its physician is the one who created it.'" (Translation is subject to human interpretation and may vary.)  

ابن حبّان:٥٩٩٥أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ الْجُمَحِيُّ قَالَ حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ قَالَ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ إِيَادِ بْنِ لَقِيطٍ قَالَ حَدَّثَنِي إِيَادُ بْنُ لَقِيطٍ عَنْ أَبِي رِمْثَةَ قَالَ

انْطَلَقْتُ مَعَ أَبِي إِلَى رَسُولِ اللَّهِ ﷺ فَلَمَّا رَأَيْتُهُ قَالَ أَبِي مَنْ هَذَا؟ قُلْتُ لَا أَدْرِي قَالَ هَذَا رَسُولُ اللَّهِ ﷺ فَاقْشَعْرَرْتُ حِينَ قَالَ ذَلِكَ وَكُنْتُ أَظُنُّ أَنَّ رَسُولَ اللَّهِ ﷺ لَا يُشْبِهُ النَّاسَ فَإِذَا لَهُ وَفْرَةٌ بِهَا رَدْعٌ مِنْ حِنَّاءٍ وَعَلَيْهِ بُرْدَانِ أَخْضَرَانِ فَسَلَّمَ عَلَيْهِ أَبِي ثُمَّ أَخَذَ يُحَدِّثُنَا سَاعَةً قَالَ «ابْنُكَ هَذَا»؟ قَالَ إِي وَرَبِّ الْكَعْبَةِ أَشْهَدُ بِهِ قَالَ «أَمَا إِنَّ ابْنُكَ هَذَا لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ» ثُمَّ قَرَأَ رَسُولُ اللَّهِ ﷺ {لَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى} ثُمَّ نَظَرَ إِلَى السِّلْعَةِ الَّتِي بَيْنَ كَتِفَيْهِ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي كَأَطَبِّ الرِّجَالِ أَلَا أُعَالِجُهَا؟ قَالَ «طَبِيبُهَا الَّذِي خَلَقَهَا»  

ذِكْرُ نَفْيِ الْقِصَاصِ فِي الْقَتْلِ، وَإِثْبَاتِ التَّوَارُثِ بَيْنَ أَهْلِ مِلَّتَيْنِ

[Machine] Khuzayah were allies of the Messenger of Allah ﷺ , and Bani Bakr were a faction from the tribe of Kinanah, allies of Abu Sufyan. There was a period of reconciliation between them during the time of Hudaybiyyah. However, the Bani Bakr tribe became jealous of the Khuzayah tribe during that period and thus sent a message to the Messenger of Allah ﷺ seeking his support. The Messenger of Allah ﷺ then sent a representative to assist them during the month of Ramadan. He fasted until he reached Qudayd, and then he broke his fast. He said, "Let the people fast during travel and break their fast. Whoever fasts, his fast is valid, but whoever breaks his fast must make up for it." Allah then granted victory to the Muslims in Makkah, and when the Messenger of Allah ﷺ entered the city, he leaned his back against the Ka'bah and said, "Disarm except for Khuzayah on behalf of Bani Bakr." A man came to him and said, "O Messenger of Allah, a man has been killed in a sacred area (Muzdalifah)." He replied, "This place is sacred according to Allah's decree. It was not permissible for anyone who came before me, and it will not be permissible for anyone who comes after me. It was only permissible for me for an hour. It is not permissible for a Muslim to bear arms in it, raise his voice, disturb wild animals, or cut a tree." A man asked, "O Messenger of Allah, except for the Ithkhar stone? It is part of our houses and graves." He replied, "Except for the Ithkhar stone. The most hostile people to Allah are three: the one who kills in the sacred area, the one who kills without any just cause, and the one who kills to perpetuate the practices of the pre-Islamic period of ignorance." A man stood up and said, "O Messenger of Allah, I have slept with a woman from the tribe of so-and-so and she has given birth to a child. Can I take my child back?" The Messenger of Allah ﷺ said, "Your child is not permissible for you. This is not permissible in Islam. The accused is entitled to a chance to prove her innocence by producing evidence that the child belongs to the owner of the marriage bed. The adulteress should be stoned to death. A man asked, "O Messenger of Allah, what is 'Al-Athlib'?" He replied, "It is the stone. Whoever commits adultery with a woman who is not lawful for him, or with a woman from another tribe, and she gives birth, the child is not his and he does not inherit from him, nor is he inherited from. The believers are equal in their blood, they reciprocate and support one another. The first of them defends the last and the last defends the first. A believer shall not be killed for an unbeliever or for someone on a treaty. Two people from different religions cannot inherit from one another. A woman cannot be married to her paternal or maternal aunt, and she cannot travel without a Mahram. Do not pray after Fajr until the sun rises, and do not pray after Asr until the sun sets."  

ابن حبّان:٥٩٩٦أَخْبَرَنَا الْحُسَيْنُ بْنُ مُحَمَّدِ بْنِ مُصْعَبٍ بِمَرْوَ وَبِقَرْيَةِ سِنْجَ حَدَّثَنَا مُحَمَّدُ بْنُ عَمْرِو بْنِ الْهَيَّاجِ حَدَّثَنَا يَحْيَى بْنُ عَبْدِ الرَّحْمَنِ الْأَرْحَبِيُّ حَدَّثَنِي عُبَيْدَةُ بْنُ الْأَسْوَدِ حَدَّثَنَا الْقَاسِمُ بْنُ الْوَلِيدِ عَنْ سِنَانِ بْنِ الْحَارِثِ بْنِ مُصَرِّفٍ عَنْ طَلْحَةَ بْنِ مُصَرِّفٍ عَنْ مُجَاهِدٍ عَنِ ابْنِ عُمَرَ قَالَ

كَانَتْ خُزَاعَةُ حُلَفَاءٍ لِرَسُولِ اللَّهِ ﷺ وَكَانَتْ بَنُو بَكْرٍ رَهْطٌ مِنْ بَنِي كِنَانَةَ حُلَفَاءً لِأَبِي سُفْيَانَ قَالَ وَكَانَتْ بَيْنَهُمْ مُوَادَعَةٌ أَيَّامَ الْحُدَيْبِيَةِ فَأَغَارَتْ بَنُو بَكْرٍ عَلَى خُزَاعَةَ فِي تِلْكَ الْمُدَّةِ فَبَعَثُوا إِلَى رَسُولِ اللَّهِ ﷺ يَسْتَمِدُّونَهُ فَخَرَجَ رَسُولُ اللَّهِ ﷺ مُمِدًّا لَهُمْ فِي شَهْرِ رَمَضَانَ فَصَامَ حَتَّى بَلَغَ قُدَيْدًا ثُمَّ أَفْطَرَ وَقَالَ «لِيَصُمِ النَّاسُ فِي السَّفَرِ وَيُفْطِرُوا فَمَنْ صَامَ أَجْزَأَ عَنْهُ صَوْمُهُ وَمَنْ أَفْطَرَ وَجَبَ عَلَيْهِ الْقَضَاءُ» فَفَتَحَ اللَّهُ مَكَّةَ فَلَمَّا دَخَلَهَا أَسْنَدَ ظَهْرَهُ إِلَى الْكَعْبَةِ فَقَالَ «كُفُّوا السِّلَاحَ إِلَّا خُزَاعَةَ عَنْ بَكْرٍ» حَتَّى جَاءَهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ قُتِلَ رَجُلٌ بِالْمُزْدَلِفَةِ فَقَالَ «إِنَّ هَذَا الْحَرَمَ حَرَامٌ عَنْ أَمْرِ اللَّهِ لَمْ يَحِلَّ لِمَنْ كَانَ قَبْلِي وَلَا يَحِلُّ لِمَنْ بَعْدِي وَإِنَّهُ لَمْ يَحِلَّ لِي إِلَّا سَاعَةً وَاحِدَةً وَإِنَّهُ لَا يَحِلُّ لِمُسْلِمٍ أَنْ يُشْهِرَ فِيهِ سِلَاحًا وَإِنَّهُ لَا يَخْتَلِي خَلَاهُ وَلَا يُعْضَدُ شَجَرُهُ وَلَا يُنَفَّرُ صَيْدُهُ» فَقَالَ رَجُلٌ يَا رَسُولَ اللَّهِ إِلَّا الْإِذْخَرَ فَإِنَّهُ لِبُيُوتِنَا وَقُبُورِنَا فَقَالَ رَسُولُ اللَّهِ ﷺ «إِلَّا الْإِذْخَرَ وَإِنَّ أَعْتَى النَّاسِ عَلَى اللَّهِ ثَلَاثَةٌ مَنْ قَتَلَ فِي حَرَمِ اللَّهِ أَوْ قَتَلَ غَيْرَ قَاتِلِهِ أَوْ قَتَلَ لِذَحْلِ الْجَاهِلِيَّةِ» فَقَامَ رَجُلٌ فَقَالَ يَا نَبِيَّ اللَّهِ إِنِّي وَقَعْتُ عَلَى جَارِيَةِ بَنِي فُلَانٍ وَإِنَّهَا وَلَدَتْ لِي فَأْمُرْ بِوَلَدِي فَلْيُرَدَّ إِلَيَّ فَقَالَ ﷺ «لَيْسَ بِوَلَدِكَ لَا يَجُوزُ هَذَا فِي الْإِسْلَامِ وَالْمُدَّعَى عَلَيْهِ أَوْلَى بِالْيَمِينِ إِلَّا أَنْ تَقُومَ بَيِّنَةٌ الْوَلَدُ لِصَاحِبِ الْفِرَاشِ وَبِفِي الْعَاهِرِ الْأَثْلِبُ» فَقَالَ رَجُلٌ يَا نَبِيَّ اللَّهِ وَمَا الْأَثْلِبُ؟ قَالَ «الْحَجَرُ فَمَنْ عَهَرَ بِامْرَأَةٍ لَا يَمْلِكُهَا أَوْ بِامْرَأَةِ قَوْمٍ آخَرِينَ فَوَلَدَتْ فَلَيْسَ بِوَلَدِهِ لَا يَرِثُ وَلَا يُورَثُ وَالْمُؤْمِنُونَ يَدٌ عَلَى مَنْ سِوَاهُمْ تَتَكَافَأُ دِمَاؤُهُمْ يُجِيرُ عَلَيْهِمْ أَوَّلُهُمْ وَيَرُدُّ عَلَيْهِمْ أَقْصَاهُمْ وَلَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِهِ وَلَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا وَلَا تُسَافِرُ ثَلَاثًا مَعَ غَيْرِ ذِي مَحْرَمٍ وَلَا تُصَلُّوا بَعْدَ الْفَجْرِ حَتَّى تَطْلُعَ الشَّمْسُ وَلَا تُصَلُّوا بَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ»  

ذِكْرُ إِسْقَاطِ الْقَوَدِ عَنِ الثَّنَايَا الْعَاضِّ إِنْسَانًا آخَرَ

"I went on a campaign with the Messenger of Allah in the Army of Hardship, and this was the deed of which I was most sure. I had a hired man who fought with another person. One of them bit the finger of the other, who pulled his finger away and a front tooth fell out. He went to the Prophet who considered the tooth to be in vain, and said: "Would he put his hand in your mouth for you to bite it?" (Using translation from Nasāʾī 4769)   

ابن حبّان:٥٩٩٧أَخْبَرَنَا عُمَرُ بْنُ مُحَمَّدٍ الْهَمْدَانِيُّ قَالَ حَدَّثَنَا أَبُو الطَّاهِرِ بْنُ السَّرْحِ قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي ابْنُ جُرَيْجٍ عَنْ عَطَاءٍ أَنَّ صَفْوَانَ بْنَ يَعْلَى بْنِ أُمَيَّةَ حَدَّثَهُ عَنْ يَعْلَى بْنِ أُمَيَّةَ قَالَ

غَزَوْتُ مَعَ رَسُولِ اللَّهِ ﷺ غَزْوَةَ الْعُسْرَةِ وَكَانَتْ أَوْثَقَ أَعْمَالِي فِي نَفْسِي وَكَانَ لِي أَجِيرٌ فَقَاتَلَ إِنْسَانًا فَعَضَّ أَحَدُهُمَا صَاحِبَهُ فَانْتَزَعَ أُصْبُعَهُ فَسَقَطتْ ثَنِيَّتَاهُ فَجَاءَ إِلَى النَّبِيِّ ﷺ فَأَهْدَرَ ثَنِيَّتَهُ قَالَ وَحَسِبْتُ أَنَّ صَفْوَانَ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «أَيَدَعُ يَدَهُ فِي فِيكَ فَتَقْضِمُهَا كَقَضْمِ الْفَحْلِ؟ »  

ذِكْرُ إِبْطَالِ الْقِصَاصِ فِي ثَنِيَّةِ الْعَاضِّ يَدَ أَخِيهِ إِذَا انْقَلَعَتْ بِجَذْبِ الْمَعْضُوضِ يَدَهُ مِنْهُ

[Machine] A man killed another man, then he bit his hand and it swelled. The Prophet ﷺ said, "Does one of you bite like a male camel?" and he invalidated it.  

ابن حبّان:٥٩٩٨أَخْبَرَنَا أَبُو خَلِيفَةَ قَالَ حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ عَنْ يَحْيَى عَنْ شُعْبَةَ عَنْ قَتَادَةَ عَنْ زُرَارَةَ بْنِ أَوْفَى عَنْ عِمْرَانَ بْنِ حُصَيْنٍ

أَنَّ رَجُلًا قَاتَلَ رَجُلًا فَعَضَّ يَدَهُ فَنَدَرَتْ ثَنِيَّتُهُ فَقَالَ النَّبِيُّ ﷺ «يَعَضُّ أَحَدُكُمْ كَمَا يَعَضُّ الْفَحْلُ؟ » وَأَبْطَلَهَا

[Machine] With his hand, he pulled it out from within him, and his two fingers met and clashed. They came to argue with the Prophet Muhammad ﷺ , so he said, "Is one of you biting his brother like a stallion? You have no blood money."

أَتَى النَّبِيَّ ﷺ رَجُلٌ قَدْ عَضَّ يَدَ رَجُلٍ فَانْتَزَعَ يَدَهُ مِنْهُ فَسَقَطَتْ ثَنِيَّتَا الَّذِي عَضَّهُ قَالَ فَأَبْطَلَهَا النَّبِيُّ ﷺ وَقَالَ «أَرَدْتَ أَنْ تَقْضِمَهُ كَمَا يَقْضَمُ الْفَحْلُ؟ »  

ذِكْرُ الْإِخْبَارِ عَنْ إِسْقَاطِ الْحَرَجِ عَمَّنْ فَقَأَ عَيْنَ النَّاظِرِ فِي بَيْتِهِ بِغَيْرِ إِذْنِهِ

If I were to know that you had been peeping through the door, I would have thrust that into your eyes, and Messenger of Allah ﷺ said: Permission is needed as a protection against glance. (Using translation from Muslim 2156a)  

ابن حبّان:٦٠٠١أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ قَالَ حَدَّثَنَا يَزِيدُ بْنُ مَوْهَبٍ حَدَّثَنِي اللَّيْثُ بْنُ سَعْدٍ وَسُفْيَانُ بْنُ عُيَيْنَةَ عَنِ ابْنِ شِهَابٍ أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ

أَخْبَرَهُ أَنَّ رَجُلًا اطَّلَعَ مِنْ جُحْرٍ فِي بَابِ رَسُولِ اللَّهِ ﷺ وَمَعَ رَسُولِ اللَّهِ مِدْرًى يَحُكُّ بِهَا رَأْسَهُ فَلَمَّا رَآهُ رَسُولُ اللَّهِ ﷺ قَالَ «لَوْ أَعْلَمُ أَنَّكَ تَنْظُرُنِي لَطَعَنْتُ بِهِ فِي عَيْنِكَ إِنَّمَا جُعِلَ الْإِذْنُ مِنْ أَجْلِ الْبَصَرِ»  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ إِنَّمَا هُوَ إِخْبَارٌ دُونَ الْحُكْمِ

[Machine] On the authority of the Messenger of Allah ﷺ , he said, "If a person were to look at you with evil intent, and you were to gouge out their eye, you would not be blamed for it." Isma'il narrated this to us on the authority of Aqib, who narrated it to us on the authority of 'Isa ibn Hammad, who narrated it to us on the authority of Layth, who narrated it to us on the authority of Ibn 'Ajlān, who narrated it to us on the authority of Abu al-Zinad, who narrated it to us on the authority of al-A'raj, who narrated it to us on the authority of Abu Hurairah, who narrated it to us on the authority of the Messenger of Allah ﷺ with the same wording.

[Machine] The Messenger of Allah ﷺ said, "If someone enters your house without permission and you throw a stone at him that causes him to lose an eye, you are not at fault."

قَالَ رَسُولُ اللَّهِ ﷺ «لَوِ اطَّلَعَ أَحَدٌ فِي بَيْتِكَ وَلَمْ تَأْذَنْ لَهُ فَخَذَفْتَهُ بِحَصَاةٍ فَفَقَأْتَ عَيْنَهُ مَا كَانَ عَلَيْكَ جُنَاحٌ»  

ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «مَا كَانَ عَلَيْكَ جُنَاحٌ» أَرَادَ بِهِ نَفْيَ الْقِصَاصِ وَالدِّيَةِ

"Whoever looks into a house without the permission of the occupants and they put out his eye, he has no right to blood money or retaliation." (Using translation from Nasāʾī 4860)   

ابن حبّان:٦٠٠٤أَخْبَرَنَا أَحْمَدُ بْنُ يَحْيَى بْنِ زُهَيْرٍ بِتُسْتَرَ حَدَّثَنَا زَيْدُ بْنُ أَخْزَمَ حَدَّثَنَا مُعَاذُ بْنُ هِشَامٍ حَدَّثَنِي أَبِي عَنْ قَتَادَةَ عَنِ النَّضْرِ بْنِ أَنَسٍ عَنْ بَشِيرِ بْنِ نَهِيكٍ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ قَالَ «مَنِ اطَّلَعَ إِلَى دَارِ قَوْمٍ بِغَيْرِ إِذْنِهِمْ فَفَقَؤُوا عَيْنَهُ فَلَا دِيَةَ وَلَا قِصَاصَ»

The Messenger of Allah said: "The injuries caused by the well are without liability, [1] and beasts are without liability, and mines are without liability, and the Khumus is due on Rikaz." (Using translation from Nasāʾī 2498)  

ابن حبّان:٦٠٠٥أَخْبَرَنَا الْحُسَيْنُ بْنُ إِدْرِيسَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ

ابن حبّان:٦٠٠٧أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ حَدَّثَنَا أَبُو الْوَلِيدِ حَدَّثَنَا لَيْثٌ عَنِ ابْنِ شِهَابٍ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ وَسَعِيدِ بْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «الْعَجْمَاءُ جُرْحُهَا جُبَارٌ وَالْبِئْرُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ»  

ذِكْرُ مَا يُحْكَمُ فِيمَا أَفْسَدَتِ الْمَوَاشِي أَمْوَالَ غَيْرِ أَرْبَابِهَا لَيْلًا أَوْ نَهَارًا

The she-camel of Bara' ibn Azib entered the garden of a man and did damage to it. The Messenger of Allah ﷺ gave decision that the owners of properties are responsible for guarding them by day, and the owners of animals are responsible for guarding them by night. (Using translation from Abū Dāʾūd 3569)   

ابن حبّان:٦٠٠٨أَخْبَرَنَا ابْنُ قُتَيْبَةَ قَالَ حَدَّثَنَا ابْنُ أَبِي السَّرِيِّ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَخْبَرَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ حَرَامِ بْنِ مُحَيِّصَةَ عَنْ أَبِيهِ

أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ «فَقَضَى رَسُولُ اللَّهِ ﷺ عَلَى أَهْلِ الْأَرْضِ حَفِظَهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ»  

ذِكْرُ وَصْفِ الْحُكْمِ فِي الْقَتِيلِ إِذَا وُجِدَ بَيْنَ الْقَرْيَتَيْنِ، عِنْدَ عَدَمِ الْبَيِّنَةِ عَلَى قَتْلِهِ

ibnhibban:6009Aḥmad b. ʿAlī b. al-Muthanná > Khalaf b. Hishām al-Bazzār > Ḥammād b. Zayd > Yaḥyá b. Saʿīd > Bashīr b. Yasār > Sahl b. Abū Ḥathmah And Rāfiʿ b. Khadīj Ḥaddathāh

Muhayysah bin Mas'ud and 'Abdullah bin Sahl went to Khaibar for some need they had there, and they parted among the palm trees. 'Abdullah bin Sahl was killed, and 'Abdullah bin Sahl was killed, and his brother 'Abdur-Rahman bin Shl, and Huwayysah, and Musayysah, his paternal cousins, came to the Messenger of Allah. 'Abdur-Rahan spoke about his brother's case, but he was the youngest of them, so the Messenger of Allah said: "Let the elders speak first." So they spoke about their companions, and the Messenger of Allah said: Let fifty of your swear an oath." The said: "O Messenger of Allah, it is something that we did not witness: how can we swear an oath?" He said: "Then let the Jews swear fifty oaths to their innocence." They said: "O Messenger of Allah, they area) a disbelieving people," So the Messenger of Allah paid the blood money himself Sahl said: "I entered a Mirbad of theirs, and one of those camels kicked me." (Using translation from Nasāʾī 4713)   

ابن حبّان:٦٠٠٩أَخْبَرَنَا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْمُثَنَّى قَالَ حَدَّثَنَا خَلَفُ بْنُ هِشَامٍ الْبَزَّارُ قَالَ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ بَشِيرِ بْنِ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ وَرَافِعِ بْنِ خَدِيجٍ حَدَّثَاهُ

أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ بْنَ مَسْعُودٍ أَتَيَا خَيْبَرَ فِي حَاجَةٍ لَهُمَا فَتَفَرَّقَا فَقُتِلَ عَبْدُ اللَّهِ بْنُ سَهْلٍ فَأَتَى النَّبِيَّ ﷺ أَخُوهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَابْنُ عَمِّهِ حُوَيِّصَةُ قَالَ فَتَكَلَّمَ عَبْدُ الرَّحْمَنِ فَقَالَ النَّبِيُّ ﷺ «الْكُبْرَ الْكُبْرَ» قَالَ فَتَكَلَّمَا بِأَمْرِ صَاحِبِهِمَا فَقَالَ النَّبِيُّ ﷺ «تَسْتَحِقُّونَ صَاحِبَكُمْ أَوْ قَالَ قَتِيلَكُمْ بِأَيْمَانِ خَمْسِينَ مِنْكُمْ» قَالُوا يَا رَسُولَ اللَّهِ لَمْ نَشْهَدْهُ كَيْفَ نَحْلِفُ عَلَيْهِ؟ قَالَ «فَتُبْرِئُكُمْ يَهُودُ بِأَيْمَانِ خَمْسِينَ مِنْهُمْ» قَالُوا يَا رَسُولَ اللَّهِ قَوْمٌ كُفَّارٌ قَالَ فَوَدَاهُ النَّبِيُّ ﷺ مِنْ قِبَلِهِ قَالَ سَهْلٌ فَدَخَلْتُ مِرْبَدًا لَهُمْ يَوْمًا فَرَكَضَتْنِي نَاقَةٌ مِنْ تِلْكِ الْإِبِلِ رَكْضَةً
