We were along with Messenger of Allah ﷺ in an expedition that a person from amongst the emigrants struck at the back of a person from the Ansir. The Ansiri said: O Ansar! And the Muhijir said: O Emigrants! Thereupon Messenger of Allah ﷺ said: What are these proclamations of the Days of Ignorance? They said: Messenger of Allah, a person from the emigrants struck at the back of an Ansari, whereupon he said: It is something disgusting. 'Abdullah b. Ubayy heard it and said: They have indeed done it. By Allah, when we would return to Medina the respectable amongst them (the Ansar) would turn away the mean (the emigrants). Thereupon 'Umar said: Permit me so that I should strike the neck of this hypocrite. But he (the Holy Prophet) said: Leave him, the people may not say that Muhammad kills his companions. ابن حبّان:٥٩٩٠أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا عَمْرُو بْنُ مُحَمَّدٍ النَّاقِدُ حَدَّثَنَا سُفْيَانُ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ قَالَ

كَسَعَ رَجُلٌ مِنَ الْمُهَاجِرِينَ رَجُلًا مِنَ الْأَنْصَارِ فَقَالَ الْأَنْصَارِيُّ يَا لَلْأَنْصَارِ وَقَالَ الْمُهَاجِرِيُّ يَا لَلْمُهَاجِرِينَ قَالَ فَسَمِعَ النَّبِيُّ ﷺ ذَاكَ فَقَالَ «مَا بَالُ دَعْوَى الْجَاهِلِيَّةِ؟ » فَقَالُوا يَا رَسُولَ اللَّهِ رَجُلٌ مِنَ الْمُهَاجِرِينَ كَسَعَ رَجُلًا مِنَ الْأَنْصَارِ فَقَالَ «دَعُوهَا فَإِنَّهَا مُنْتِنَةٌ» فَقَالَ عَبْدُ اللَّهِ بْنُ أَبَيِّ ابْنُ سَلُولٍ قَدْ فَعَلُوهَا لَئِنْ رَجَعْنَا إِلَى الْمَدِينَةِ لَيُخْرِجَنَّ الْأَعَزُّ مِنْهَا الْأَذَلَّ فَقَالَ عُمَرُ دَعْنِي يَا رَسُولَ اللَّهِ أَضْرِبْ عُنُقَ هَذَا الْمُنَافِقِ فَقَالَ «دَعْهُ لَا يَتَحَدَّثُ النَّاسُ أَنَّ مُحَمَّدًا يَقْتُلُ أَصْحَابَهُ»  

ذِكْرُ الْحُكْمِ فِي الْقَوَدِ عَنِ الْمُسْلِمِينَ وَأَهْلِ الذِّمَّةِ، أَوْ بَعْضِهِمْ مَعَ بَعْضٍ

a Jew killed a young girl for her jewelry, so the Messenger of Allah killed him in retaliation for her. (Using translation from Nasāʾī 4740)   

ابن حبّان:٥٩٩١أَخْبَرَنَا الْحُسَيْنُ بْنُ عَبْدِ اللَّهِ بْنِ يَزِيدَ الْقَطَّانُ بِالرَّقَّةِ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ سَابُورَ حَدَّثَنَا دَاوُدُ بْنُ عَبْدِ الرَّحْمَنِ الْعَطَّارُ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ قَتَادَةَ عَنْ أَنَسٍ

«أَنَّ يَهُودِيًّا قَتَلَ جَارِيَةً عَلَى أَوْضَاحٍ فَقَتَلَهُ رَسُولُ اللَّهِ ﷺ»  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ الْقَوَدَ لَا يَكُونُ إِلَّا بِالسَّيْفِ أَوِ الْحَدِيدِ

Has so and so killed you? She indicated with the nod of her head: No. He said for the second time, and she again said: No with the nod of her head. He asked for the third time, and she said: Yes with the nod of her head and Messenger of Allah ﷺ commanded to crush his head between two stones. (Using translation from Muslim 1672a)  

ابن حبّان:٥٩٩٢أَخْبَرَنَا زَكَرِيَّا بْنُ يَحْيَى بْنِ عَبْدِ الرَّحْمَنِ السَّاجِيُّ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ وَمُحَمَّدُ بْنُ الْمُثَنَّى قَالَا حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ هِشَامِ بْنِ زَيْدِ بْنِ أَنَسٍ عَنْ أَنَسِ بْنِ مَالِكٍ

أَنَّ يَهُودِيًّا قَتَلَ جَارِيَةً عَلَى أَوْضَاحٍ لَهَا قَتَلَهَا بِحَجَرٍ قَالَ فَجِيءَ بِهَا وَبِهَا رَمَقٌ قَالَ لَهَا «أَقَتَلَكِ فُلَانٌ»؟ فَأَشَارَتْ بِرَأْسِهَا أَنْ لَا ثُمَّ قَالَ لَهَا الثَّانِيَةَ فَأَشَارَتْ بِرَأْسِهَا أَنْ لَا ثُمَّ سَأَلَهَا الثَّالِثَةَ فَقَالَتْ نَعَمْ وَأَشَارَتْ بِرَأْسِهَا فَقَتَلَهُ رَسُولُ اللَّهِ ﷺ بَيْنَ حَجَرَيْنِ  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ قَتَلَ قَاتِلَ الْمَرْأَةِ الَّتِي وَصَفْنَاهَا بِإِقْرَارِهِ عَلَى نَفْسِهِ بِقَتْلِهِ إِيَّاهَا، لَا بِإِقْرَارِهَا عَلَيْهِ بِهِ

A girl was found with her head crushed between two stones. She was asked: Who has done this to you ? Is it so and so ? Is it so and so, until a Jew was named, and she gave a sign with her head. The Jew was caught ad he admitted. So the Prophet ﷺ gave command that his head should be crushed with stones. (Using translation from Abū Dāʾūd 4527)   

ابن حبّان:٥٩٩٣أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ قَالَ حَدَّثَنَا هُدْبَةُ بْنُ خَالِدٍ الْقَيْسِيُّ قَالَ حَدَّثَنَا هَمَّامُ بْنُ يَحْيَى قَالَ حَدَّثَنَا قَتَادَةُ عَنْ أَنَسِ بْنِ مَالِكٍ

أَنَّ جَارِيَةً وُجِدَ رَأْسُهَا قَدْ رُضَّ بَيْنَ حَجَرَيْنِ فَقَالُوا لَهَا مَنْ فَعَلَ هَذَا بِكِ؟ فُلَانٌ وَفُلَانٌ؟ حَتَّى ذُكِرَ رَجُلٌ يَهُودِيٌّ فَأَوْمَأَتْ بِرَأْسِهَا فَأُخِذَ الْيَهُودِيُّ فَأَقَرَّ «فَأَمَرَ بِهِ رَسُولُ اللَّهِ ﷺ أَنْ يُرَضَّ رَأْسُهُ بِالْحِجَارَةِ»  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْءَ يَجِبُ أَنْ يُحْسِنَ الْقِتْلَةَ فِي الْقِصَاصِ، إِذْ هُوَ مِنْ أَخْلَاقِ الْمُؤْمِنِينَ

The Prophet ﷺ said: The most merciful of the people in respect of killing are believers (in Allah). (Using translation from Abū Dāʾūd 2666)   

ابن حبّان:٥٩٩٤أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ حَدَّثَنَا حَامِدُ بْنُ يَحْيَى الْبَلْخِيُّ حَدَّثَنَا جَرِيرُ بْنُ عَبْدِ الْحَمِيدِ عَنْ مُغِيرَةَ عَنْ إِبْرَاهِيمَ عَنْ هُنَيِّ بْنِ نُوَيْرَةَ عَنْ عَلْقَمَةَ عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «إِنَّ أَعَفَّ النَّاسِ قِتْلَةً أَهْلُ الْإِيمَانِ»  

ذِكْرُ الْإِخْبَارِ عَنْ نَفْيِ جِنَايَةِ الْأَبِ عَنِ ابْنِهِ، وَالِابْنِ عَنِ أَبِيهِ

[Machine] "I accompanied my father to the Messenger of Allah ﷺ . When I saw him, my father asked, 'Who is this?' I replied, 'I do not know.' My father said, 'This is the Messenger of Allah ﷺ .' Hearing that, I got goosebumps because I had always thought that the Messenger of Allah ﷺ did not resemble other people. But there he was, with a large abundance of abundant black hair, with traces of henna on it, and wearing two green garments. My father greeted him, and then he started speaking to us for a while. He asked, 'Is this your son?' My father replied, 'Yes, I swear by the Lord of the Kaaba, I bear witness to it.' The Messenger of Allah ﷺ said, 'Indeed, your son will not harm you, nor will you harm him.' Then the Messenger of Allah ﷺ recited the verse, 'No bearer of burdens will bear the burden of another.' Then he looked at the merchandise that was between his shoulders and said, 'O Messenger of Allah, I am like a skilled physician. Should I treat it?' He replied, 'Its physician is the one who created it.'" (Translation is subject to human interpretation and may vary.)  

ابن حبّان:٥٩٩٥أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ الْجُمَحِيُّ قَالَ حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ قَالَ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ إِيَادِ بْنِ لَقِيطٍ قَالَ حَدَّثَنِي إِيَادُ بْنُ لَقِيطٍ عَنْ أَبِي رِمْثَةَ قَالَ

انْطَلَقْتُ مَعَ أَبِي إِلَى رَسُولِ اللَّهِ ﷺ فَلَمَّا رَأَيْتُهُ قَالَ أَبِي مَنْ هَذَا؟ قُلْتُ لَا أَدْرِي قَالَ هَذَا رَسُولُ اللَّهِ ﷺ فَاقْشَعْرَرْتُ حِينَ قَالَ ذَلِكَ وَكُنْتُ أَظُنُّ أَنَّ رَسُولَ اللَّهِ ﷺ لَا يُشْبِهُ النَّاسَ فَإِذَا لَهُ وَفْرَةٌ بِهَا رَدْعٌ مِنْ حِنَّاءٍ وَعَلَيْهِ بُرْدَانِ أَخْضَرَانِ فَسَلَّمَ عَلَيْهِ أَبِي ثُمَّ أَخَذَ يُحَدِّثُنَا سَاعَةً قَالَ «ابْنُكَ هَذَا»؟ قَالَ إِي وَرَبِّ الْكَعْبَةِ أَشْهَدُ بِهِ قَالَ «أَمَا إِنَّ ابْنُكَ هَذَا لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ» ثُمَّ قَرَأَ رَسُولُ اللَّهِ ﷺ {لَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى} ثُمَّ نَظَرَ إِلَى السِّلْعَةِ الَّتِي بَيْنَ كَتِفَيْهِ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي كَأَطَبِّ الرِّجَالِ أَلَا أُعَالِجُهَا؟ قَالَ «طَبِيبُهَا الَّذِي خَلَقَهَا»  

ذِكْرُ نَفْيِ الْقِصَاصِ فِي الْقَتْلِ، وَإِثْبَاتِ التَّوَارُثِ بَيْنَ أَهْلِ مِلَّتَيْنِ

[Machine] Khuzayah were allies of the Messenger of Allah ﷺ , and Bani Bakr were a faction from the tribe of Kinanah, allies of Abu Sufyan. There was a period of reconciliation between them during the time of Hudaybiyyah. However, the Bani Bakr tribe became jealous of the Khuzayah tribe during that period and thus sent a message to the Messenger of Allah ﷺ seeking his support. The Messenger of Allah ﷺ then sent a representative to assist them during the month of Ramadan. He fasted until he reached Qudayd, and then he broke his fast. He said, "Let the people fast during travel and break their fast. Whoever fasts, his fast is valid, but whoever breaks his fast must make up for it." Allah then granted victory to the Muslims in Makkah, and when the Messenger of Allah ﷺ entered the city, he leaned his back against the Ka'bah and said, "Disarm except for Khuzayah on behalf of Bani Bakr." A man came to him and said, "O Messenger of Allah, a man has been killed in a sacred area (Muzdalifah)." He replied, "This place is sacred according to Allah's decree. It was not permissible for anyone who came before me, and it will not be permissible for anyone who comes after me. It was only permissible for me for an hour. It is not permissible for a Muslim to bear arms in it, raise his voice, disturb wild animals, or cut a tree." A man asked, "O Messenger of Allah, except for the Ithkhar stone? It is part of our houses and graves." He replied, "Except for the Ithkhar stone. The most hostile people to Allah are three: the one who kills in the sacred area, the one who kills without any just cause, and the one who kills to perpetuate the practices of the pre-Islamic period of ignorance." A man stood up and said, "O Messenger of Allah, I have slept with a woman from the tribe of so-and-so and she has given birth to a child. Can I take my child back?" The Messenger of Allah ﷺ said, "Your child is not permissible for you. This is not permissible in Islam. The accused is entitled to a chance to prove her innocence by producing evidence that the child belongs to the owner of the marriage bed. The adulteress should be stoned to death. A man asked, "O Messenger of Allah, what is 'Al-Athlib'?" He replied, "It is the stone. Whoever commits adultery with a woman who is not lawful for him, or with a woman from another tribe, and she gives birth, the child is not his and he does not inherit from him, nor is he inherited from. The believers are equal in their blood, they reciprocate and support one another. The first of them defends the last and the last defends the first. A believer shall not be killed for an unbeliever or for someone on a treaty. Two people from different religions cannot inherit from one another. A woman cannot be married to her paternal or maternal aunt, and she cannot travel without a Mahram. Do not pray after Fajr until the sun rises, and do not pray after Asr until the sun sets."  

ابن حبّان:٥٩٩٦أَخْبَرَنَا الْحُسَيْنُ بْنُ مُحَمَّدِ بْنِ مُصْعَبٍ بِمَرْوَ وَبِقَرْيَةِ سِنْجَ حَدَّثَنَا مُحَمَّدُ بْنُ عَمْرِو بْنِ الْهَيَّاجِ حَدَّثَنَا يَحْيَى بْنُ عَبْدِ الرَّحْمَنِ الْأَرْحَبِيُّ حَدَّثَنِي عُبَيْدَةُ بْنُ الْأَسْوَدِ حَدَّثَنَا الْقَاسِمُ بْنُ الْوَلِيدِ عَنْ سِنَانِ بْنِ الْحَارِثِ بْنِ مُصَرِّفٍ عَنْ طَلْحَةَ بْنِ مُصَرِّفٍ عَنْ مُجَاهِدٍ عَنِ ابْنِ عُمَرَ قَالَ

كَانَتْ خُزَاعَةُ حُلَفَاءٍ لِرَسُولِ اللَّهِ ﷺ وَكَانَتْ بَنُو بَكْرٍ رَهْطٌ مِنْ بَنِي كِنَانَةَ حُلَفَاءً لِأَبِي سُفْيَانَ قَالَ وَكَانَتْ بَيْنَهُمْ مُوَادَعَةٌ أَيَّامَ الْحُدَيْبِيَةِ فَأَغَارَتْ بَنُو بَكْرٍ عَلَى خُزَاعَةَ فِي تِلْكَ الْمُدَّةِ فَبَعَثُوا إِلَى رَسُولِ اللَّهِ ﷺ يَسْتَمِدُّونَهُ فَخَرَجَ رَسُولُ اللَّهِ ﷺ مُمِدًّا لَهُمْ فِي شَهْرِ رَمَضَانَ فَصَامَ حَتَّى بَلَغَ قُدَيْدًا ثُمَّ أَفْطَرَ وَقَالَ «لِيَصُمِ النَّاسُ فِي السَّفَرِ وَيُفْطِرُوا فَمَنْ صَامَ أَجْزَأَ عَنْهُ صَوْمُهُ وَمَنْ أَفْطَرَ وَجَبَ عَلَيْهِ الْقَضَاءُ» فَفَتَحَ اللَّهُ مَكَّةَ فَلَمَّا دَخَلَهَا أَسْنَدَ ظَهْرَهُ إِلَى الْكَعْبَةِ فَقَالَ «كُفُّوا السِّلَاحَ إِلَّا خُزَاعَةَ عَنْ بَكْرٍ» حَتَّى جَاءَهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ قُتِلَ رَجُلٌ بِالْمُزْدَلِفَةِ فَقَالَ «إِنَّ هَذَا الْحَرَمَ حَرَامٌ عَنْ أَمْرِ اللَّهِ لَمْ يَحِلَّ لِمَنْ كَانَ قَبْلِي وَلَا يَحِلُّ لِمَنْ بَعْدِي وَإِنَّهُ لَمْ يَحِلَّ لِي إِلَّا سَاعَةً وَاحِدَةً وَإِنَّهُ لَا يَحِلُّ لِمُسْلِمٍ أَنْ يُشْهِرَ فِيهِ سِلَاحًا وَإِنَّهُ لَا يَخْتَلِي خَلَاهُ وَلَا يُعْضَدُ شَجَرُهُ وَلَا يُنَفَّرُ صَيْدُهُ» فَقَالَ رَجُلٌ يَا رَسُولَ اللَّهِ إِلَّا الْإِذْخَرَ فَإِنَّهُ لِبُيُوتِنَا وَقُبُورِنَا فَقَالَ رَسُولُ اللَّهِ ﷺ «إِلَّا الْإِذْخَرَ وَإِنَّ أَعْتَى النَّاسِ عَلَى اللَّهِ ثَلَاثَةٌ مَنْ قَتَلَ فِي حَرَمِ اللَّهِ أَوْ قَتَلَ غَيْرَ قَاتِلِهِ أَوْ قَتَلَ لِذَحْلِ الْجَاهِلِيَّةِ» فَقَامَ رَجُلٌ فَقَالَ يَا نَبِيَّ اللَّهِ إِنِّي وَقَعْتُ عَلَى جَارِيَةِ بَنِي فُلَانٍ وَإِنَّهَا وَلَدَتْ لِي فَأْمُرْ بِوَلَدِي فَلْيُرَدَّ إِلَيَّ فَقَالَ ﷺ «لَيْسَ بِوَلَدِكَ لَا يَجُوزُ هَذَا فِي الْإِسْلَامِ وَالْمُدَّعَى عَلَيْهِ أَوْلَى بِالْيَمِينِ إِلَّا أَنْ تَقُومَ بَيِّنَةٌ الْوَلَدُ لِصَاحِبِ الْفِرَاشِ وَبِفِي الْعَاهِرِ الْأَثْلِبُ» فَقَالَ رَجُلٌ يَا نَبِيَّ اللَّهِ وَمَا الْأَثْلِبُ؟ قَالَ «الْحَجَرُ فَمَنْ عَهَرَ بِامْرَأَةٍ لَا يَمْلِكُهَا أَوْ بِامْرَأَةِ قَوْمٍ آخَرِينَ فَوَلَدَتْ فَلَيْسَ بِوَلَدِهِ لَا يَرِثُ وَلَا يُورَثُ وَالْمُؤْمِنُونَ يَدٌ عَلَى مَنْ سِوَاهُمْ تَتَكَافَأُ دِمَاؤُهُمْ يُجِيرُ عَلَيْهِمْ أَوَّلُهُمْ وَيَرُدُّ عَلَيْهِمْ أَقْصَاهُمْ وَلَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِهِ وَلَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ وَلَا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلَا عَلَى خَالَتِهَا وَلَا تُسَافِرُ ثَلَاثًا مَعَ غَيْرِ ذِي مَحْرَمٍ وَلَا تُصَلُّوا بَعْدَ الْفَجْرِ حَتَّى تَطْلُعَ الشَّمْسُ وَلَا تُصَلُّوا بَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ»  

ذِكْرُ إِسْقَاطِ الْقَوَدِ عَنِ الثَّنَايَا الْعَاضِّ إِنْسَانًا آخَرَ

"I went on a campaign with the Messenger of Allah in the Army of Hardship, and this was the deed of which I was most sure. I had a hired man who fought with another person. One of them bit the finger of the other, who pulled his finger away and a front tooth fell out. He went to the Prophet who considered the tooth to be in vain, and said: "Would he put his hand in your mouth for you to bite it?" (Using translation from Nasāʾī 4769)   

ابن حبّان:٥٩٩٧أَخْبَرَنَا عُمَرُ بْنُ مُحَمَّدٍ الْهَمْدَانِيُّ قَالَ حَدَّثَنَا أَبُو الطَّاهِرِ بْنُ السَّرْحِ قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي ابْنُ جُرَيْجٍ عَنْ عَطَاءٍ أَنَّ صَفْوَانَ بْنَ يَعْلَى بْنِ أُمَيَّةَ حَدَّثَهُ عَنْ يَعْلَى بْنِ أُمَيَّةَ قَالَ

غَزَوْتُ مَعَ رَسُولِ اللَّهِ ﷺ غَزْوَةَ الْعُسْرَةِ وَكَانَتْ أَوْثَقَ أَعْمَالِي فِي نَفْسِي وَكَانَ لِي أَجِيرٌ فَقَاتَلَ إِنْسَانًا فَعَضَّ أَحَدُهُمَا صَاحِبَهُ فَانْتَزَعَ أُصْبُعَهُ فَسَقَطتْ ثَنِيَّتَاهُ فَجَاءَ إِلَى النَّبِيِّ ﷺ فَأَهْدَرَ ثَنِيَّتَهُ قَالَ وَحَسِبْتُ أَنَّ صَفْوَانَ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «أَيَدَعُ يَدَهُ فِي فِيكَ فَتَقْضِمُهَا كَقَضْمِ الْفَحْلِ؟ »  

ذِكْرُ إِبْطَالِ الْقِصَاصِ فِي ثَنِيَّةِ الْعَاضِّ يَدَ أَخِيهِ إِذَا انْقَلَعَتْ بِجَذْبِ الْمَعْضُوضِ يَدَهُ مِنْهُ

[Machine] A man killed another man, then he bit his hand and it swelled. The Prophet ﷺ said, "Does one of you bite like a male camel?" and he invalidated it.  

ابن حبّان:٥٩٩٨أَخْبَرَنَا أَبُو خَلِيفَةَ قَالَ حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ عَنْ يَحْيَى عَنْ شُعْبَةَ عَنْ قَتَادَةَ عَنْ زُرَارَةَ بْنِ أَوْفَى عَنْ عِمْرَانَ بْنِ حُصَيْنٍ

أَنَّ رَجُلًا قَاتَلَ رَجُلًا فَعَضَّ يَدَهُ فَنَدَرَتْ ثَنِيَّتُهُ فَقَالَ النَّبِيُّ ﷺ «يَعَضُّ أَحَدُكُمْ كَمَا يَعَضُّ الْفَحْلُ؟ » وَأَبْطَلَهَا  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ شُعْبَةَ لَمْ يَسْمَعْ هَذَا الْخَبَرَ عَنْ قَتَادَةَ

[Machine] With his hand, he pulled it out from within him, and his two fingers met and clashed. They came to argue with the Prophet Muhammad ﷺ , so he said, "Is one of you biting his brother like a stallion? You have no blood money."

ابن حبّان:٦٠٠٠أَخْبَرَنَا أَبُو يَعْلَى قَالَ حَدَّثَنَا شَيْبَانُ بْنُ فَرُّوخٍ قَالَ حَدَّثَنَا هَمَّامُ بْنُ يَحْيَى قَالَ حَدَّثَنَا عَطَاءُ بْنُ أَبِي رَبَاحٍ عَنْ صَفْوَانِ بْنِ يَعْلَى بْنِ أُمَيَّةَ عَنْ أَبِيهِ قَالَ

أَتَى النَّبِيَّ ﷺ رَجُلٌ قَدْ عَضَّ يَدَ رَجُلٍ فَانْتَزَعَ يَدَهُ مِنْهُ فَسَقَطَتْ ثَنِيَّتَا الَّذِي عَضَّهُ قَالَ فَأَبْطَلَهَا النَّبِيُّ ﷺ وَقَالَ «أَرَدْتَ أَنْ تَقْضِمَهُ كَمَا يَقْضَمُ الْفَحْلُ؟ »  

ذِكْرُ الْإِخْبَارِ عَنْ إِسْقَاطِ الْحَرَجِ عَمَّنْ فَقَأَ عَيْنَ النَّاظِرِ فِي بَيْتِهِ بِغَيْرِ إِذْنِهِ

ibnhibban:6001Muḥammad b. al-Ḥasan b. Qutaybah > Yazīd b. Mawhab > al-Layth b. Saʿd And Sufyān b. ʿUyaynah > Ibn Shihāb > Sahl b. Saʿd al-Sāʿidī

If I were to know that you had been peeping through the door, I would have thrust that into your eyes, and Messenger of Allah ﷺ said: Permission is needed as a protection against glance. (Using translation from Muslim 2156a)  

ابن حبّان:٦٠٠١أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ قَالَ حَدَّثَنَا يَزِيدُ بْنُ مَوْهَبٍ حَدَّثَنِي اللَّيْثُ بْنُ سَعْدٍ وَسُفْيَانُ بْنُ عُيَيْنَةَ عَنِ ابْنِ شِهَابٍ أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ

أَخْبَرَهُ أَنَّ رَجُلًا اطَّلَعَ مِنْ جُحْرٍ فِي بَابِ رَسُولِ اللَّهِ ﷺ وَمَعَ رَسُولِ اللَّهِ مِدْرًى يَحُكُّ بِهَا رَأْسَهُ فَلَمَّا رَآهُ رَسُولُ اللَّهِ ﷺ قَالَ «لَوْ أَعْلَمُ أَنَّكَ تَنْظُرُنِي لَطَعَنْتُ بِهِ فِي عَيْنِكَ إِنَّمَا جُعِلَ الْإِذْنُ مِنْ أَجْلِ الْبَصَرِ»  

ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ إِنَّمَا هُوَ إِخْبَارٌ دُونَ الْحُكْمِ

ibnhibban:6002Ismāʿīl b. Dāwud b. And Rdān Bimiṣr > ʿĪsá b. Ḥammād > al-Layth > Ibn ʿAjlān from his father > Abū Hurayrah

[Machine] On the authority of the Messenger of Allah ﷺ , he said, "If a person were to look at you with evil intent, and you were to gouge out their eye, you would not be blamed for it." Isma'il narrated this to us on the authority of Aqib, who narrated it to us on the authority of 'Isa ibn Hammad, who narrated it to us on the authority of Layth, who narrated it to us on the authority of Ibn 'Ajlān, who narrated it to us on the authority of Abu al-Zinad, who narrated it to us on the authority of al-A'raj, who narrated it to us on the authority of Abu Hurairah, who narrated it to us on the authority of the Messenger of Allah ﷺ with the same wording.  

ابن حبّان:٦٠٠٢أَخْبَرَنَا إِسْمَاعِيلُ بْنُ دَاوُدَ بْنِ وَرْدَانَ بِمِصْرَ حَدَّثَنَا عِيسَى بْنُ حَمَّادٍ أَخْبَرَنَا اللَّيْثُ عَنِ ابْنِ عَجْلَانَ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «لَوْ أَنَّ إِنْسَانًا اطَّلَعَ عَلَيْكَ فَحَذَفْتَ عَيْنَهُ فَفَقَأْتَهَا لَمَا كَانَ عَلَيْكَ جُنَاحٌ» أَخْبَرَنَاهُ إِسْمَاعِيلُ فِي عَقِبِهِ حَدَّثَنَا عِيسَى بْنُ حَمَّادٍ أَخْبَرَنَا اللَّيْثُ عَنِ ابْنِ عَجْلَانَ عَنْ أَبِي الزِّنَادِ عَنِ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ عَنْ رَسُولِ اللَّهِ ﷺ بِمِثْلِ ذَلِكَ  

ذِكْرُ نَفْيِ الْجُنَاحِ عَمَّنْ فَقَأَ عَيْنَ النَّاظِرِ فِي بَيْتِهِ بِغَيْرِ إِذْنِهِ

ibnhibban:6003Muḥammad b. ʿUbaydullāh b. al-Faḍl al-Kalāʿī Biḥimṣ > ʿAmr b. ʿUthmān b. Saʿīd from my father > Shuʿayb b. Abū Ḥamzah > Abū al-Zinād > al-Aʿraj > Abū Hurayrah

[Machine] The Messenger of Allah ﷺ said, "If someone enters your house without permission and you throw a stone at him that causes him to lose an eye, you are not at fault."  

ابن حبّان:٦٠٠٣أَخْبَرَنَا مُحَمَّدُ بْنُ عُبَيْدِ اللَّهِ بْنِ الْفَضْلِ الْكَلَاعِيُّ بِحِمْصَ حَدَّثَنَا عَمْرُو بْنُ عُثْمَانَ بْنِ سَعِيدٍ حَدَّثَنَا أَبِي حَدَّثَنَا شُعَيْبُ بْنُ أَبِي حَمْزَةَ عَنْ أَبِي الزِّنَادِ عَنِ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «لَوِ اطَّلَعَ أَحَدٌ فِي بَيْتِكَ وَلَمْ تَأْذَنْ لَهُ فَخَذَفْتَهُ بِحَصَاةٍ فَفَقَأْتَ عَيْنَهُ مَا كَانَ عَلَيْكَ جُنَاحٌ»  

ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «مَا كَانَ عَلَيْكَ جُنَاحٌ» أَرَادَ بِهِ نَفْيَ الْقِصَاصِ وَالدِّيَةِ

"Whoever looks into a house without the permission of the occupants and they put out his eye, he has no right to blood money or retaliation." (Using translation from Nasāʾī 4860)   

ابن حبّان:٦٠٠٤أَخْبَرَنَا أَحْمَدُ بْنُ يَحْيَى بْنِ زُهَيْرٍ بِتُسْتَرَ حَدَّثَنَا زَيْدُ بْنُ أَخْزَمَ حَدَّثَنَا مُعَاذُ بْنُ هِشَامٍ حَدَّثَنِي أَبِي عَنْ قَتَادَةَ عَنِ النَّضْرِ بْنِ أَنَسٍ عَنْ بَشِيرِ بْنِ نَهِيكٍ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ قَالَ «مَنِ اطَّلَعَ إِلَى دَارِ قَوْمٍ بِغَيْرِ إِذْنِهِمْ فَفَقَؤُوا عَيْنَهُ فَلَا دِيَةَ وَلَا قِصَاصَ»  

ذِكْرُ الْإِخْبَارِ عَنْ إِسْقَاطِ الْحَرَجِ عَنْ مُسْتَأْجِرِ الْمَرْءِ فِي الْمَعْدِنِ إِذَا انْهَارَ عَلَيْهِ

The Messenger of Allah said: "The injuries caused by the well are without liability, [1] and beasts are without liability, and mines are without liability, and the Khumus is due on Rikaz." (Using translation from Nasāʾī 2498)  

ابن حبّان:٦٠٠٥أَخْبَرَنَا الْحُسَيْنُ بْنُ إِدْرِيسَ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «الْعَجْمَاءُ جُرْحُهَا جُبَارٌ وَالْبِئْرُ جُبَارٌ وَالْمَعْدِنُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ»  

ذِكْرُ إِثْبَاتِ الْجُبَارِ مَا كَانَ مِنَ الْعَجْمَاءِ، وَالْبِئْرِ، وَالْمَعْدِنِ

ذِكْرُ الْإِخْبَارِ عَنْ نَفْيِ لُزُومِ الْحَرَجِ عَنْ مَالِكِ الْعَجْمَاءِ إِذَا لَمْ يَكُنْ مَعَهَا سَائِقٌ، أَوْ قَائِدٌ، أَوْ رَاكِبٌ بِمَا أَتَتْ عَلَيْهِ

ابن حبّان:٦٠٠٧أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ حَدَّثَنَا أَبُو الْوَلِيدِ حَدَّثَنَا لَيْثٌ عَنِ ابْنِ شِهَابٍ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ وَسَعِيدِ بْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «الْعَجْمَاءُ جُرْحُهَا جُبَارٌ وَالْبِئْرُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ»  

ذِكْرُ مَا يُحْكَمُ فِيمَا أَفْسَدَتِ الْمَوَاشِي أَمْوَالَ غَيْرِ أَرْبَابِهَا لَيْلًا أَوْ نَهَارًا

ibnhibban:6008Ibn Qutaybah > Ibn Abū al-Sarī > ʿAbd al-Razzāq > Maʿmar > al-Zuhrī > Ḥarām b. Muḥayyiṣah from his father

The she-camel of Bara' ibn Azib entered the garden of a man and did damage to it. The Messenger of Allah ﷺ gave decision that the owners of properties are responsible for guarding them by day, and the owners of animals are responsible for guarding them by night. (Using translation from Abū Dāʾūd 3569)   

ابن حبّان:٦٠٠٨أَخْبَرَنَا ابْنُ قُتَيْبَةَ قَالَ حَدَّثَنَا ابْنُ أَبِي السَّرِيِّ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَخْبَرَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ حَرَامِ بْنِ مُحَيِّصَةَ عَنْ أَبِيهِ

أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ «فَقَضَى رَسُولُ اللَّهِ ﷺ عَلَى أَهْلِ الْأَرْضِ حَفِظَهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ»
