15. Book of Blood Money

١٥۔ كِتَابُ الدِّيَاتِ

[Machine] I heard the Messenger of Allah ﷺ say, "Whoever is afflicted with a wound or a boil, and the boil is a kind of wound, then he has three options. If he wishes for a fourth option, then you should take hold of his hands between whether he seeks retribution, or forgives, or takes compensation. If he takes anything from that and then goes beyond that, then the Fire is for him, he will abide therein forever."  

الدارمي:٢٣٩٦أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أَنْبَأَنَا مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ الْحَارِثِ بْنِ فُضَيْلٍ عَنْ سُفْيَانَ بْنِ أَبِي الْعَوْجَاءِ السُّلَمِيِّ عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ قَالَ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ أُصِيبَ بِدَمٍ أَوْ خَبْلٍ وَالْخَبْلُ الْجُرْحُ فَهُوَ بِالْخِيَارِ بَيْنَ إِحْدَى ثَلَاثٍ فَإِنْ أَرَادَ الرَّابِعَةَ فَخُذُوا عَلَى يَدَيْهِ بَيْنَ أَنْ يَقْتَصَّ أَوْ يَعْفُوَ أَوْ يَأْخُذَ الْعَقْلَ فَإِنْ أَخَذَ مِنْ ذَلِكَ شَيْئًا ثُمَّ عَدَا بَعْدَ ذَلِكَ فَلَهُ النَّارُ خَالِدًا فِيهَا مُخَلَّدًا»

[Machine] The Messenger of Allah ﷺ wrote to the people of Yemen and in his letter, he stated: "Whoever kills a believer without a just cause, his hands are to be tied, unless the relatives of the slain demand blood money." Abu Muhammad said: "Killing without a valid reason is considered murder."  

الدارمي:٢٣٩٧أَخْبَرَنَا الْحَكَمُ بْنُ مُوسَى حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ عَنْ سُلَيْمَانَ بْنِ دَاوُدَ حَدَّثَنِي الزُّهْرِيُّ عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ عَنْ أَبِيهِ عَنْ جَدِّهِ

أَنَّ رَسُولَ اللَّهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ وَكَانَ فِي كِتَابِهِ «أَنَّ مَنْ اعْتَبَطَ مُؤْمِنًا قَتْلًا عَنْ بَيِّنَةٍ فَإِنَّهُ قَوَدُ يَدِهِ إِلَّا أَنْ يَرْضَى أَوْلِيَاءُ الْمَقْتُولِ» قَالَ أَبُو مُحَمَّد «اعْتَبَطَ قَتَلَ مِنْ غَيْرِ عِلَّةٍ»

[Machine] "Then, they went against Abdullah and he was killed. His neck was struck until it was severed, then he was thrown into a pit among the pits of Khaybar. His companions called out to him, and they pulled him out and concealed him. Then, they arrived in Medina to the Messenger of Allah ﷺ . His brother, Abdullah ibn Sahl, came forward. He had accompanied the Messenger of Allah ﷺ and his two cousins, Huwayshah ibn Mas'ud and Muhayyisah. Abdullah spoke, and he was the youngest among them in age, but he had spilled blood and was respected among his people. When he finished speaking, the Messenger of Allah ﷺ said, 'Al-Kubra! (The greatest!)' He then stepped back, and Huwayshah and Muhayyisah spoke. Then, the Messenger of Allah ﷺ said, 'You call your killer, then you swear fifty oaths upon him, then we will hand him over to you.' They said, 'O Messenger of Allah! We would not swear upon something we do not know. We do not know who killed him except that it was a Jew, our enemy, and among their ranks he was killed.' He said, 'So, they would swear to you by Allah that they are innocent of the blood of your companion, and then they would dissociate themselves from it.' They said, 'We would not accept oaths from Jews. There is no greater crime than them swearing falsely.' He said, 'By Allah! The Messenger of Allah desires from it one hundred camels as compensation.'"  

الدارمي:٢٣٩٨حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الرَّقَاشِيُّ حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ حَدَّثَنَا بُشَيْرُ بْنُ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ قَالَ خَرَجَ عَبْدُ اللَّهِ بْنُ سَهْلٍ أَحَدُ بَنِي حَارِثَةَ إِلَى خَيْبَرَ مَعَ نَفَرٍ مِنْ قَوْمِهِ يُرِيدُونَ الْمِيرَةَ بِخَيْبَرَ قَالَ

فَعُدِيَ عَلَى عَبْدِ اللَّهِ فَقُتِلَ فَتُلَّتْ عُنُقُهُ حَتَّى نُخِعَ ثُمَّ طُرِحَ فِي مَنْهَلٍ مِنْ مَنَاهِلِ خَيْبَرَ فَاسْتُصْرِخَ عَلَيْهِ أَصْحَابُهُ فَاسْتَخْرَجُوهُ فَغَيَّبُوهُ ثُمَّ قَدِمُوا عَلَى رَسُولِ اللَّهِ ﷺ الْمَدِينَةَ فَتَقَدَّمَ أَخُوهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَكَانَ ذَا قِدَمٍ مَعَ رَسُولِ اللَّهِ ﷺ وَابْنَا عَمِّهِ مَعَهُ حُوَيِّصَةُ بْنُ مَسْعُودٍ وَمُحَيِّصَةُ فَتَكَلَّمَ عَبْدُ الرَّحْمَنِ وَكَانَ أَحْدَثَهُمْ سِنًّا وَهُوَ صَاحِبُ الدَّمِ وَذَا قَدَمٍ فِي الْقَوْمِ فَلَمَّا تَكَلَّمَ قَالَ رَسُولُ اللَّهِ ﷺ «الْكُبْرَ الْكُبْرَ» قَالَ فَاسْتَأْخَرَ فَتَكَلَّمَ حُوَيِّصَةُ وَمُحَيِّصَةُ ثُمَّ هُوَ فَقَالَ رَسُولُ اللَّهِ ﷺ «تُسَمُّونَ قَاتِلَكُمْ ثُمَّ تَحْلِفُونَ عَلَيْهِ خَمْسِينَ يَمِينًا ثُمَّ نُسَلِّمُهُ إِلَيْكُمْ» قَالُوا يَا رَسُولَ اللَّهِ مَا كُنَّا لِنَحْلِفَ عَلَى مَا لَا نَعْلَمُ مَا نَدْرِي مَنْ قَتَلَهُ إِلَّا أَنَّ يَهُودَ عَدُوُّنَا وَبَيْنَ أَظْهُرِهِمْ قُتِلَ قَالَ «فَيَحْلِفُونَ لَكُمْ بِاللَّهِ إِنَّهُمْ لَبُرَءَاءُ مِنْ دَمِ صَاحِبِكُمْ ثُمَّ يَبْرَءُونَ مِنْهُ» قَالُوا مَا كُنَّا لِنَقْبَلَ أَيْمَانَ يَهُودَ مَا فِيهِمْ أَكْبَرُ مِنْ أَنْ يَحْلِفُوا عَلَى إِثْمٍ قَالَ «فَوَدَاهُ رَسُولُ اللَّهِ ﷺ مِنْ عِنْدِهِ بِمِائَةِ نَاقَةٍ»

[Machine] The Messenger of Allah ﷺ wrote to the people of Yemen in his letter, saying, "A man is killed by a woman."  

الدارمي:٢٣٩٩أَخْبَرَنَا الْحَكَمُ بْنُ مُوسَى حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ عَنْ سُلَيْمَانَ بْنِ دَاوُدَ حَدَّثَنِي الزُّهْرِيُّ عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ عَنْ أَبِيهِ عَنْ جَدِّهِ

أَنَّ رَسُولَ اللَّهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ وَكَانَ فِي كِتَابِهِ «أَنَّ الرَّجُلَ يُقْتَلُ بِالْمَرْأَةِ»

A girl was found with her head crushed between two stoned. She was asked: Who did it with you ? Was it so and so ? Was it so and so ? Until the Jew was named. Thereupon she gave a sign with her head. The Jew was arrested and he admitted. So the Prophet ﷺ gave command that his head should be crushed with stones. (Using translation from Abū Dāʾūd 4535)   

الدارمي:٢٤٠٠أَخْبَرَنَا عَفَّانُ حَدَّثَنَا هَمَّامٌ حَدَّثَنَا قَتَادَةُ عَنْ أَنَسٍ

أَنَّ جَارِيَةً رُضَّ رَأْسُهَا بَيْنَ حَجَرَيْنِ فَقِيلَ لَهَا مَنْ فَعَلَ بِكِ هَذَا؟ أَفُلَانٌ؟ أَفُلَانٌ؟ حَتَّى سُمِّيَ الْيَهُودِيُّ؟ فَأَوْمَأَتْ بِرَأْسِهَا فَبُعِثَ إِلَيْهِ فَجِيءَ بِهِ فَاعْتَرَفَ «فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَرُضَّ رَأْسُهُ بَيْنَ حَجَرَيْنِ»  

darimi:2401Isḥāq > Jarīr > Muṭarrif > al-Shaʿbī > Abū Juḥayfah

"I said to 'Ali: O Commander of the Believers! Do you have anything written that is not in Allah's Book?' He said: 'By the One Who splits the seed and creates the soul, I have not learned from it except what understanding of the Qur'an Allah gives to a man, and what is in this sheet of paper.' I said: 'What is in the paper?' He said: 'It is the 'Aql, the (ransom for) release of captives, and the judgement that no believer is killed for a disbeliever.'" (Using translation from Tirmidhī 1412)   

الدارمي:٢٤٠١أَخْبَرَنَا إِسْحَاقُ أَنْبَأَنَا جَرِيرٌ عَنْ مُطَرِّفٍ عَنْ الشَّعْبِيِّ عَنْ أَبِي جُحَيْفَةَ قَالَ

قُلْتُ لِعَلِيٍّ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ عَلِمْتَ شَيْئًا مِنَ الْوَحْيِ إِلَّا مَا فِي كِتَابِ اللَّهِ تَعَالَى؟ قَالَ «لَا وَالَّذِي فَلَقَ الْحَبَّةَ وَبَرَأَ النَّسَمَةَ مَا أَعْلَمُهُ إِلَّا فَهْمًا يُعْطِيهِ اللَّهُ الرَّجُلَ فِي الْقُرْآنِ وَمَا فِي الصَّحِيفَةِ» قُلْتُ وَمَا فِي الصَّحِيفَةِ؟ قَالَ «الْعَقْلُ وَفِكَاكُ الْأَسِيرِ وَلَا يُقْتَلُ مُسْلِمٌ بِمُشْرِكٍ»  

darimi:2402Jaʿfar b. ʿAwn > Ismāʿīl b. Muslim > ʿAmr b. Dīnār > Ṭāwus > Ibn ʿAbbās

that the Prophet ﷺ said: 'The Hudud are not carried in the Masjid, and the father is not killed for the son." (Using translation from Tirmidhī 1401)   

الدارمي:٢٤٠٢أَخْبَرَنَا جَعْفَرُ بْنُ عَونٍ عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ طَاوُسٍ عَنْ ابْنِ عَبَّاسٍ قَالَ

قَالَ النَّبِيُّ ﷺ «لَا تُقَامُ الْحُدُودُ فِي الْمَسَاجِدِ وَلَا يُقَادُ بِالْوَلَدِ الْوَالِدُ»  

darimi:2403Saʿīd b. ʿĀmir > Shuʿbah > Qatādah > al-Ḥasan > Samurah b. Jundub

[Machine] The Messenger of Allah ﷺ said, "Whoever kills his slave, we will kill him. And whoever mutilates him, we will mutilate him." Then Al-Hasan forgot this Hadith and used to say, "A free man should not be killed for a slave."  

الدارمي:٢٤٠٣أَخْبَرَنَا سَعِيدُ بْنُ عَامِرٍ عَنْ شُعْبَةَ عَنْ قَتَادَةَ عَنْ الْحَسَنِ عَنْ سَمُرَةَ بْنِ جُنْدُبٍ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَهُ جَدَعْنَاهُ» قَالَ ثُمَّ نَسِيَ الْحَسَنُ هَذَا الْحَدِيثَ وَكَانَ يَقُولُ لَا يُقْتَلُ حُرٌّ بِعَبْدٍ  

darimi:2404Aḥmad b. ʿAbdullāh al-Hamdānī > Abū Usāmah > ʿAwf > Ḥamzah Abū ʿUmar > ʿAlqamah b. Wāʾil al-Ḥaḍramī > Abīh Wāʾil b. Ḥujr

[Machine] I witnessed the Prophet ﷺ when a killer was brought to him, bound in chains. The Messenger of Allah ﷺ said to the guardian of the slain person, "Will you pardon him?" He replied, "No." The Prophet ﷺ then asked, "Will you accept blood money?" He again replied, "No." The Prophet ﷺ then asked, "Will you kill him?" He finally replied, "Yes." The Prophet ﷺ said, "If you forgive him, then he will bear your sin and the sin of his companion." The guardian decided to forgive him and said, "I have seen him dragging his chains, and he has been forgiven."  

الدارمي:٢٤٠٤أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ الْهَمْدَانِيُّ حَدَّثَنَا أَبُو أُسَامَةَ عَنْ عَوْفٍ عَنْ حَمْزَةَ أَبِي عُمَرَ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ الْحَضْرَمِيِّ عَنْ أَبِيهِ وَائِلِ بْنِ حُجْرٍ قَالَ

شَهِدْتُ النَّبِيَّ ﷺ حِينَ أُتِيَ بِالرَّجُلِ الْقَاتِلِ يُقَادُ فِي نِسْعَةٍ فَقَالَ رَسُولُ اللَّهِ ﷺ لِوَلِيِّ الْمَقْتُولِ «أَتَعْفُو» قَالَ لَا قَالَ «فَتَأْخُذُ الدِّيَةَ» قَالَ لَا قَالَ «فَتَقْتُلُهُ» قَالَ نَعَمْ قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّكَ إِنْ عَفَوْتَ عَنْهُ فَإِنَّهُ يَبُوءُ بِإِثْمِكَ وَإِثْمِ صَاحِبِكَ» قَالَ فَتَرَكَهُ قَالَ «فَأَنَا رَأَيْتُهُ يَجُرُّ نِسْعَتَهُ قَدْ عَفَا عَنْهُ»

The Prophet [SAW] said: "The major sins are: Associating others with Allah, disobeying parents, killing a soul (murder) and swearing a false oath knowingly." (Using translation from Nasāʾī 4011)   

الدارمي:٢٤٠٥أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ حَدَّثَنَا شُعْبَةُ عَنْ فِرَاسٍ عَنْ الشَّعْبِيِّ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو

عَنِ النَّبِيِّ ﷺ قَالَ «الْكَبَائِرُ الْإِشْرَاكُ بِاللَّهِ وَعُقُوقُ الْوَالِدَيْنِ وَقَتْلُ النَّفْسِ شُعْبَةُ الشَّاكُّ أَوِ الْيَمِينُ الْغَمُوسُ»  

darimi:2406And Hb b. Jarīr > Hishām > Yaḥyá > Abū Qilābah > Thābit b. al-Ḍaḥḥāk

[Machine] The Messenger of Allah ﷺ said, "Cursed is the believer as he kills, and whoever kills himself with something in this world will be punished with it on the Day of Judgment."  

الدارمي:٢٤٠٦حَدَّثَنَا وَهْبُ بْنُ جَرِيرٍ حَدَّثَنَا هِشَامٌ عَنْ يَحْيَى عَنْ أَبِي قِلَابَةَ عَنْ ثَابِتِ بْنِ الضَّحَّاكِ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَعْنُ الْمُؤْمِنِ كَقَتْلِهِ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ فِي الدُّنْيَا عُذِّبَ بِهِ يَوْمَ الْقِيَامَةِ»  

darimi:2407Yaʿlá b. ʿUbayd > al-Aʿmash > Abū Ṣāliḥ > Abū Hurayrah

The Prophet ﷺ said, "Whoever purposely throws himself from a mountain and kills himself, will be in the (Hell) Fire falling down into it and abiding therein perpetually forever; and whoever drinks poison and kills himself with it, he will be carrying his poison in his hand and drinking it in the (Hell) Fire wherein he will abide eternally forever; and whoever kills himself with an iron weapon, will be carrying that weapon in his hand and stabbing his ʿAbdomen with it in the (Hell) Fire wherein he will abide eternally forever." (Using translation from Bukhārī 5778)  

الدارمي:٢٤٠٧حَدَّثَنَا يَعْلَى بْنُ عُبَيْدٍ حَدَّثَنَا الْأَعْمَشُ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَتَلَ نَفْسَهُ بِحَدِيدَةٍ فَحَدِيدَتُهُ فِي يَدِهِ يَتَوَجَّأُ بِهَا فِي بَطْنِهِ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا وَمَنْ قَتَلَ نَفْسَهُ بِسُمٍّ فَسُمُّهُ فِي يَدِهِ يَتَحَسَّاهُ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا وَمَنْ تَرَدَّى مِنْ جَبَلٍ فَقَتَلَ نَفْسَهُ فَهُوَ يَتَرَدَّى فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا»  

darimi:2408Muʿādh b. Hāniʾ > Muḥammad b. Muslim > ʿAmr b. Dīnār > ʿIkrimah > Ibn ʿAbbās

[Machine] A man killed another man during the time of the Prophet Muhammad ﷺ , so the Prophet ﷺ set his blood money at twelve thousand. This is mentioned in the verse in the Quran: "They swear by Allah that they did not say [anything against the Prophet], while they had definitely uttered disbelief and disbelieved after their [pretense of] Islam and planned that which they were not to attain. And they were not resentful except [for the fact] that Allah and His Messenger had enriched them of His bounty." [Surah At-Tawbah, 9:74]  

الدارمي:٢٤٠٨حَدَّثَنَا مُعَاذُ بْنُ هَانِئٍ حَدَّثَنَا مُحَمَّدُ بْنُ مُسْلِمٍ حَدَّثَنَا عَمْرُو بْنُ دِينَارٍ عَنْ عِكْرِمَةَ عَنْ ابْنِ عَبَّاسٍ قَالَ

قَتَلَ رَجُلٌ رَجُلًا عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَجَعَلَ النَّبِيُّ ﷺ دِيَتَهُ اثْنَيْ عَشَرَ أَلْفًا فهو قَوْلُهُ {يَحْلِفُونَ بِاللَّهِ مَا قَالُوا وَلَقَدْ قَالُوا كَلِمَةَ الْكُفْرِ وَكَفَرُوا بَعْدَ إِسْلَامِهِمْ وَهَمُّوا بِمَا لَمْ يَنَالُوا وَمَا نَقَمُوا إِلَّا أَنْ أَغْنَاهُمُ اللَّهُ وَرَسُولُهُ مِنْ فَضْلِهِ} [التوبة 74] بِأَخْذِهِمُ الدِّيَةَ

[Machine] The Messenger of Allah ﷺ wrote to the people of Yemen, "And for the people of Ad-Dhahab, one thousand dinars."

أَنَّ رَسُولَ اللَّهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ «وَعَلَى أَهْلِ الذَّهَبِ أَلْفُ دِينَارٍ»

[Machine] The Messenger of Allah ﷺ wrote to the people of Yemen: In the name of Allah, the Most Gracious, the Most Merciful. From Muhammad, the Prophet ﷺ , to Shurahbil ibn Abd Kulal, Harith ibn Abd Kulal, and Nuaim ibn Abd Kulal, also known as Dhī Ruayn, Ma'āfir, and Hamdān. In his letter, he said, "Verily, in the soul is a hundred camels."

أَنَّ رَسُولَ اللَّهِ ﷺ كَتَبَ إِلَى أَهْلِ الْيَمَنِ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ مِنْ مُحَمَّدٍ النَّبِيِّ ﷺ إِلَى شُرَحْبِيلَ بْنِ عَبْدِ كُلَالٍ وَالْحَارِثِ بْنِ عَبْدِ كُلَالٍ وَنُعَيْمِ بْنِ عَبْدِ كُلَالٍ قِيَلِ ذِي رُعَيْنٍ وَمَعَافِرَ وَهَمْدَانَ فَكَانَ فِي كِتَابِهِ «وَإِنَّ فِي النَّفْسِ الدِّيَةَ مِائَةٌ مِنَ الْإِبِلِ»

[Machine] "Indeed, the Messenger of Allah ﷺ wrote a letter to the people of Yemen and in his letter he mentioned: 'In the nose, when its tip becomes reddish, there is a portion of blood money (Diyah). In the tongue, there is a portion of blood money (Diyah). In the lips, there is a portion of blood money (Diyah). In the two front teeth, there is a portion of blood money (Diyah). In the male organ, there is a portion of blood money (Diyah). In the chest, there is a portion of blood money (Diyah). In the eyes, there is a portion of blood money (Diyah). In one leg, there is half of blood money (Diyah). In the mamoomeh (a domestic animal other than a camel), there is one-third of blood money (Diyah). In the jaifa (a domestic animal other than a camel), there is one-third of blood money (Diyah). In the manqqilah (a type of camel), there are fifteen camels worth of blood money (Diyah)."

[Machine] "That the Messenger of Allah ﷺ made the blood money for accidental killing to be one-fifth."

أَنَّ رَسُولَ اللَّهِ ﷺ «جَعَلَ الدِّيَةَ فِي الْخَطَإِ أَخْمَاسًا»  

darimi:2413Muḥammad b. Yazīd al-Rifāʿī > Muʿādh b. Hishām from his father > Qatādah > Abū Naḍrah > ʿImrān b. Ḥuṣayn

A servant of some poor people cut off the ear of the servant of some rich people. His people came to the Prophet ﷺ and said: Messenger of Allah! we are poor people. So he imposed no compensation on them. (Using translation from Abū Dāʾūd 4590)   

الدارمي:٢٤١٣أَخْبَرَنَا مُحَمَّدُ بْنُ يَزِيدَ الرِّفَاعِيُّ حَدَّثَنَا مُعَاذُ بْنُ هِشَامٍ عَنْ أَبِيهِ عَنْ قَتَادَةَ عَنْ أَبِي نَضْرَةَ عَنْ عِمْرَانَ بْنِ حُصَيْنٍ

أَنَّ عَبْدًا لِأُنَاسٍ فُقَرَاءَ قَطَعَ يَدَ غُلَامٍ لِأُنَاسٍ أَغْنِيَاءَ فَأَتَى أَهْلُهُ النَّبِيَّ ﷺ فَقَالُوا يَا رَسُولَ اللَّهِ إِنَّهُ لِأُنَاسٍ فُقَرَاءَ؟ «فَلَمْ يَجْعَلْ عَلَيْهِ النَّبِيُّ ﷺ شَيْئًا»

[Machine] Regarding the Prophet Muhammad ﷺ , he said, "Fingers are equal." I then asked, "Ten, ten?" He replied, "Yes."

"For teeth (the Diyah is) five camels. (Using translation from Nasāʾī 4841)

darimi:2421Hāshim b. al-Qāsim > Shuʿbah > Qatādah > Zurārah b. Awfá > ʿImrān b. Ḥuṣayn > a man ʿAḍ Yad a man

[Machine] He pulled his hand away and his two fingers got dislocated, so they argued with the Messenger of Allah ﷺ. He said, "Will one of you bite his brother as a stallion bites?" You have no compensation."  

الدارمي:٢٤٢١حَدَّثَنَا هَاشِمُ بْنُ الْقَاسِمِ حَدَّثَنَا شُعْبَةُ قَالَ قَتَادَةُ أَخْبَرَنِي قَالَ سَمِعْتُ زُرَارَةَ بْنَ أَوْفَى عَنْ عِمْرَانَ بْنِ حُصَيْنٍ أَنَّ رَجُلًا عَضَّ يَدَ رَجُلٍ قَالَ

فَنَزَعَ يَدَهُ فَوَقَعَتْ ثَنِيَّتَاهُ فَاخْتَصَمُوا إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ «يَعَضُّ أَحَدُكُمْ أَخَاهُ كَمَا يَعَضُّ الْفَحْلُ؟ لَا دِيَةَ لَكَ»

The Messenger of Allah said: "The injuries caused by the well are without liability, [1] and beasts are without liability, and mines are without liability, and the Khumus is due on Rikaz." (Using translation from Nasāʾī 2498)

Messenger of Allah ﷺ said, "There is no Diya for persons killed by animals or for the one who has been killed accidentally by falling into a well or for the one killed in a mine. And one-fifth of Rikaz (treasures buried before the Islamic era) is to be given to the state." (Using translation from Bukhārī 6912)

[Machine] From the Prophet ﷺ, he said, "The metal is strong, the sailing ship is strong, the well is strong, and in the fifth is the scale."

[Machine] "From the Prophet ﷺ, that there were two women who were under the authority of a man, and they had a disagreement. One of them struck the other with a stick and killed her, along with the fetus in her womb. They brought their dispute to the Messenger of Allah ﷺ, who ruled in favor of the unborn child and made it the responsibility of the family of the woman."

عَنِ النَّبِيِّ ﷺ أَنَّ امْرَأَتَيْنِ كَانَتَا تَحْتَ رَجُلٍ فَتَغَايَرَتَا فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِعَمُودٍ فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا فَاخْتَصَمَا إِلَى رَسُولِ اللَّهِ ﷺ «فَقَضَى فِيهِ غُرَّةً وَجَعَلَهَا عَلَى عَاقِلَةِ الْمَرْأَةِ»

he asked the people about the ruling of the Prophet ﷺ concerning that - concerning a fetus. Hamal bin Malik bin Nabighah stood up and said: “I was between my two wives and one of them struck the other with a tent-pole, killing her and a fetus. The Messenger of Allah ﷺ ruled that the blood money for the fetus was a slave, and that she would be killed in retaliation.” (Using translation from Ibn Mājah 2641)   

الدارمي:٢٤٢٦حَدَّثَنَا أَبُو عَاصِمٍ حَدَّثَنَا ابْنُ جُرَيْجٍ عَنْ عَمْرٍو هُوَ ابْنُ دِينَارٍ عَنْ طَاوُسٍ عَنْ ابْنِ عَبَّاسٍ

أَنَّ عُمَرَ نَشَدَ النَّاسَ قَضَاءَ رَسُولِ اللَّهِ ﷺ فِي الْجَنِينِ فَقَامَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ فَقَالَ كُنْتُ بَيْنَ امْرَأَتَيْنِ فَضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحٍ «فَقَضَى رَسُولُ اللَّهِ ﷺ فِي جَنِينِهَا بِغُرَّةٍ وَأَنْ تُقْتَلَ بِهَا»

Messenger of Allah, why should I play blood-wit for one who neither drank, nor ate, nor spoke, nor made any noise; it is like a nonentity (it is, therefore, not justifiable to demand blood-wit for it). Thereupon Messenger of Allah ﷺ said: He seems to be one of the brothers of soothsavers on account of the rhymed speech which he has composed. (Using translation from Muslim 1681c)  

الدارمي:٢٤٢٧أَخْبَرَنَا عُثْمَانُ بْنُ عُمَرَ حَدَّثَنَا يُونُسُ عَنْ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ

أَنَّ امْرَأَتَيْنِ مِنْ هُذَيْلٍ اقْتَتَلَتَا فَرَمَتْ إِحْدَاهُمَا الْأُخْرَى بِحَجَرٍ فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا فَاخْتَصَمُوا فِي الدِّيَةِ إِلَى رَسُولِ اللَّهِ ﷺ فَقَضَى أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ عَبْدٌ أَوْ وَلِيدَةٌ وَقَضَى بِدِيَتِهَا عَلَى عَاقِلَتِهَا وَرَثَتُهَا وَلَدُهَا وَمَنْ مَعَهَا فَقَالَ حَمَلُ بْنُ النَّابِغَةِ الْهُذَلِيُّ كَيْفَ أُغَرَّمُ مَنْ لَا شَرِبَ وَلَا أَكَلَ وَلَا نَطَقَ وَلَا اسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا هُوَ مِنْ إِخْوَانِ الْكُهَّانِ مِنْ أَجْلِ سَجْعِهِ الَّذِي سَجَعَ»  

darimi:2428Sulaymān b. Ḥarb > Shuʿbah > Ayyūb > al-Qāsim b. Rabīʿah > ʿAbdullāh b. ʿAmr

"Indeed the accidental killing, which seems intentional, with a whip or a stick, (the Diyah) is one hundred camels, of which forty should be (she-camels) with their young in their wombs." (Using translation from Nasāʾī 4793)   

الدارمي:٢٤٢٨أَخْبَرَنَا سُلَيْمَانُ بْنُ حَرْبٍ حَدَّثَنَا شُعْبَةُ عَنْ أَيُّوبَ عَنْ الْقَاسِمِ بْنِ رَبِيعَةَ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «دِيَةُ قَتِيلِ الْخَطَإِ شِبْهِ الْعَمْدِ وَمَا كَانَ بِالسَّوْطِ وَالْعَصَا مِنْهَا أَرْبَعُونَ فِي بُطُونِهَا أَوْلَادُهَا»

If I were to know that you had been peeping through the door, I would have thrust that into your eyes, and Messenger of Allah ﷺ said: Permission is needed as a protection against glance. (Using translation from Muslim 2156a)

أَخْبَرَهُ أَنَّ رَجُلًا اطَّلَعَ فِي جُحْرٍ فِي حُجْرَةِ النَّبِيِّ ﷺ وَمَعَ رَسُولِ اللَّهِ ﷺ مِدْرًى يُخَلِّلُ بِهَا رَأْسَهُ فَرَآهُ رَسُولُ اللَّهِ ﷺ فَقَالَ لَوْ أَعْلَمُ أَنَّكَ تَنْظُرُنِي لَطَعَنْتُ بِهَا فِي عَيْنَيْكَ وَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا جُعِلَ الْإِذْنُ مِنْ أَجْلِ النَّظَرِ»

[Machine] While the Messenger of Allah ﷺ was in a chamber, and with him was a comb with which he would comb his hair, a man looked at him. The Messenger of Allah ﷺ said to him, "If I had known that you were watching, I would have stabbed your eyes with this comb. Indeed, permission was granted only for the purpose of looking."  

الدارمي:٢٤٣٠أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى عَنْ ابْنِ أَبِي ذِئْبٍ عَنْ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ قَالَ

بَيْنَمَا رَسُولُ اللَّهِ ﷺ فِي حُجْرَةٍ وَمَعَهُ مِدْرًى يَحُكُّ بِهِ رَأْسَهُ اطَّلَعَ عَلَيْهِ رَجُلٌ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «لَوْ أَعْلَمُ أَنَّكَ تَنْظُرُ لَقُمْتُ حَتَّى أَطْعَنَ بِهِ عَيْنَيْكَ إِنَّمَا جُعِلَ الْإِذْنُ مِنْ أَجْلِ النَّظَرِ»

I heard the Prophet ﷺ say on the day of the Conquest of Mecca: No Quraishite will be killed hound hand and foot from this day until the Day of judgment. (Using translation from Muslim 1782a)   

الدارمي:٢٤٣١أَخْبَرَنَا جَعْفَرُ بْنُ عَوْنٍ عَنْ زَكَرِيَّا عَنْ الشَّعْبِيِّ عَنْ عَبْدِ اللَّهِ بْنِ مُطِيعٍ عَنْ مُطِيعٍ قَالَ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ يَوْمَ فَتْحِ مَكَّةَ «لَا يُقْتَلُ قُرَشِيٌّ صَبْرًا بَعْدَ هَذَا الْيَوْمِ إِلَى يَوْمِ الْقِيَامَةِ»

[Machine] I heard the Messenger of Allah ﷺ and he mentioned something similar to it. Abu Muhammad said, "Interpret that as meaning that a Quraishi should not be killed for disbelief, meaning that a Quraishi would not be considered a disbeliever after that day. As for in battle, they should be killed."  

الدارمي:٢٤٣٢حَدَّثَنَا يَعْلَى حَدَّثَنَا زَكَرِيَّا عَنْ عَامِرٍ قَالَ قَالَ عَبْدُ اللَّهِ بْنُ مُطِيعٍ سَمِعْتُ مُطِيعًا يَقُولُ

سَمِعْتُ رَسُولَ اللَّهِ ﷺ فَذَكَرَ نَحْوَهُ قَالَ أَبُو مُحَمَّد «فَسَّرُوا ذَلِكَ أَنْ لَا يُقْتَلَ قُرَشِيٌّ عَلَى الْكُفْرِ يَعْنِي لَا يَكُونُ هَذَا أَنْ يَكْفُرَ قُرَشِيٌّ بَعْدَ ذَلِكَ الْيَوْمِ فَأَمَّا فِي الْقَوَدِ فَيُقْتَلُ»

[Machine] "I entered the city with my son, and we did not see the Messenger of Allah, peace be upon him. So, I went to him and the Messenger of Allah, peace be upon him, came out wearing two green garments. When I saw him, I recognized him by his description, so I approached him. He asked, 'Who is this with you?' I said, 'My son, by the Lord of the Kaaba.' He asked, 'Is he your son?' I said, 'I testify to it.' He said, 'Indeed, your son does not harm you, nor do you harm him.'  

الدارمي:٢٤٣٣أَخْبَرَنَا يُونُسُ بْنُ مُحَمَّدٍ حَدَّثَنَا جَرِيرٌ يَعْنِي ابْنَ حَازِمٍ قَالَ سَمِعْتُ عَبْدَ الْمَلِكِ بْنَ عُمَيْرٍ حَدَّثَنِي إِيَادُ بْنُ لَقِيطٍ عَنْ أَبِي رِمْثَةَ قَالَ

قَدِمْتُ الْمَدِينَةَ وَمَعِيَ ابْنٌ لِي وَلَمْ نَكُنْ رَأَيْنَا رَسُولَ اللَّهِ ﷺ فَأَتَيْتُهُ فَخَرَجَ رَسُولُ اللَّهِ ﷺ وَعَلَيْهِ ثَوْبَانِ أَخْضَرَانِ فَلَمَّا رَأَيْتُهُ عَرَفْتُهُ بِالصِّفَةِ فَأَتَيْتُهُ فَقَالَ «مَنْ هَذَا الَّذِي مَعَكَ؟» قُلْتُ ابْنِي وَرَبِّ الْكَعْبَةِ فَقَالَ «ابْنُكَ؟» فَقُلْتُ أَشْهَدُ بِهِ قَالَ «فَإِنَّ ابْنَكَ هَذَا لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ»

I went to the Prophet ﷺ with my father. The Messenger of Allah ﷺ then asked my father: Is this your son? He replied: Yes, by the Lord of the Ka'bah. He again said: Is it true? He said: I bear witness to it. The Messenger of Allah ﷺ then smiled for my resemblance with my father, and for the fact that my father took an oath upon me. He then said: He will not bring evil on you, nor will you bring evil on him. The Messenger of Allah ﷺ recited the verse: "No bearer of burdens can bear the burden of another." (Using translation from Abū Dāʾūd 4495)   

الدارمي:٢٤٣٤أَخْبَرَنَا أَبُو الْوَلِيدِ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ إِيَادٍ حَدَّثَنَا إِيَادٌ عَنْ أَبِي رِمْثَةَ قَالَ

انْطَلَقْتُ مَعَ أَبِي نَحْوَ رَسُولِ اللَّهِ ﷺ فَقَالَ لِأَبِي «ابْنُكَ هَذَا؟» فَقَالَ إِي وَرَبِّ الْكَعْبَةِ قَالَ «حَقًّا؟» قَالَ «حَقًّا أَشْهَدُ بِهِ» قَالَ فَتَبَسَّمَ رَسُولُ اللَّهِ ﷺ ضَاحِكًا مِنْ ثَبَتِ شَبَهِي فِي أَبِي وَمِنْ حَلِفِ أَبِي عَلَيَّ فَقَالَ «إِنَّ ابْنَكَ هَذَا لَا يَجْنِي عَلَيْكَ وَلَا تَجْنِي عَلَيْهِ» قَالَ وَقَرَأَ رَسُولُ اللَّهِ ﷺ {«وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى»} [الأنعام 164]
