"عَنْ مَعْمَرٍ، عَنْ الزُّهْرِىِّ، سُئِل عَنْ رَجُلٍ وَلَدَتْ امْرَأَتُهُ وَلَدًا فَأَقَرَّ بِهِ ثُمَّ نَفَاهُ، قَالَ: يُلْحَقُ بِهِ إِذَا أَقَر بِهِ وُلِدَ عَلَى فِراشِهِ، وَقَالَ: إِنَّمَا كَانَتْ الملاعَنَةُ الَّتِى كَانَتْ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ: رَأَيْتُ الفَاحِشَةَ عَلَيْهَا، ثُمَ ذَكَرَ الزُّهرىُّ حَدِيثَ الفَزارىِّ فَقَالَ: حَدَّثَنِى سَعِيدُ بْنُ المُسَيَّبِ، عَنْ أَبِى هُرَيْرَةَ، قَالَ: جَاءَ رَجُلٌ إِلى النَّبِىِّ ﷺ فَقَالَ: وَلَدَتْ امْرَأتِى غُلَامًا أَسْوَدَ، وَهُوَ حِينَئِذٍ يُعَرِّضُ بِأَنْ يَنْفِيَهُ فَقَالَ رَسُولُ اللهِ ﷺ : أَلَكَ إِبِلٌ؟ قَالَ: نَعَمْ، قَالَ: مَا أَلْوَانُهَا؟ قَالَ: حُمْرٌ، قَالَ: أَفِيهَا أَوْرَقُ؟ قَالَ: نَعَمْ فِيهَا ذَوْدٌ وَرْقٌ، قَالَ: مِمَّ ذَاكَ تَرَى؟ قَالَ: مَا أَدْرِىِ لَعَلَّهُ أَنْ يَكُونَ نَزَعَهَا عِرْقٌ، قَالَ: وَهَذَا لَعَلَّهُ أَنْ يَكُونَ نَزَعَهُ عِرْقٌ وَلَمْ يُرَخِّصْ لَهُ في الانْتِفَاءِ مِنْهُ".

A bedouin came to Messenger of Allah ﷺ and said, "My wife has delivered a black child." The Prophet ﷺ said to him, "Have you camels?" He replied, "Yes." The Prophet ﷺ said, "What color are they?" He replied, "They are red." The Prophet ﷺ further asked, "Are any of them gray in color?" He replied, "Yes." The Prophet asked him, "Whence did that grayness come?" He said, "I thing it descended from the camel's ancestors." Then the Prophet ﷺ said (to him), "Therefore, this child of yours has most probably inherited the color from his ancestors."
أَنَّ رَسُولَ اللَّهِ ﷺ جَاءَهُ أَعْرَابِيٌّ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ امْرَأَتِي وَلَدَتْ غُلاَمًا أَسْوَدَ فَقَالَ هَلْ لَكَ مِنْ إِبِلٍ قَالَ نَعَمْ قَالَ مَا أَلْوَانُهَا قَالَ حُمْرٌ قَالَ فِيهَا مِنْ أَوْرَقَ قَالَ نَعَمْ قَالَ فَأَنَّى كَانَ ذَلِكَ قَالَ أُرَاهُ عِرْقٌ نَزَعَهُ قَالَ فَلَعَلَّ ابْنَكَ هَذَا نَزَعَهُ عِرْقٌ
A bedouin came to Messenger of Allah ﷺ and said, "My wife has delivered a black boy, and I suspect that he is not my child." Messenger of Allah ﷺ said to him, "Have you got camels?" The bedouin said, "Yes." The Prophet said, "What color are they?" The bedouin said, "They are red." The Prophet ﷺ said, "Are any of them Grey?" He said, "There are Grey ones among them." The Prophet ﷺ said, "Whence do you think this color came to them?" The bedouin said, "O Messenger of Allah ﷺ! It resulted from hereditary disposition." The Prophet ﷺ said, "And this (i.e., your child) has inherited his color from his ancestors." The Prophet ﷺ did not allow him to deny his paternity of the child.

There came a person to the Prophet (may peace he upon him) ) from Banu Fazara and said: My wife has given birth to a child who is black, whereupon Allah's Apostle ﷺ said: Have you any camels? He said: Yes. He again said: What is this colour? He said: They are red. He said: Is there a dusky one among them? He said: Yes, there are dusky ones among them He said: How has it come about? He said: It is perhaps the strain to which it has reverted, whereupon he (the Holy Prophet) said: It is perhaps the strain to which he (the child) has reverted.

A desert Arab came to Messenger of Allah ﷺ and said: My wife has given birth to a dark-complexioned child and I have disowned him. Thereupon Allah's Apostle ﷺ said: Have you any camels? He said: Yes. He said: What is their colour? He said? They are red. He said: Is there anyone dusky among them? He said: Yes. Messenger of Allah ﷺ said: How has it come about? He said: Messenger of Allah, it is perhaps due to the strain to which it has reverted, whereupon the Prophet ﷺ said: It (the birth) of the black child may be due to the strain to which he (the child) might have reverted.

Abu Hurairah said A man from Banu Fazarah came to the Prophet ﷺ and said “My wife has given birth to a black son”. He said “Have you any camels?” He said “They are red”. He asked “Is there a dusky one among them?” He replied “Some of them are dusky”. He asked “How do you think they have come about?” He replied “This may be a strain to which they reverted”. He said “And this is perhaps a strain to which the child has reverted.”
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ مِنْ بَنِي فَزَارَةَ فَقَالَ إِنَّ امْرَأَتِي جَاءَتْ بِوَلَدٍ أَسْوَدَ فَقَالَ هَلْ لَكَ مِنْ إِبِلٍ قَالَ نَعَمْ قَالَ مَا أَلْوَانُهَا قَالَ حُمْرٌ قَالَ فَهَلْ فِيهَا مِنْ أَوْرَقَ قَالَ إِنَّ فِيهَا لَوُرْقًا قَالَ فَأَنَّى تُرَاهُ قَالَ عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ قَالَ وَهَذَا عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ
"that a man from [Banu] Fazarah came to the Prophet ﷺ and said: 'O Messenger of Allah ﷺ! My wife gave birth to black boy." So the Prophet ﷺ said: "[Do you have any camels?]" He said: 'Yes." He said: "Then what are their colors?" He said: "Red." He said: "Is there a gray one among them?" He said: "Yes, there is a grey one among them." He said: "From where does that come?" He said: "Perhaps it is hereditary." He said: "Then in the same way, perhaps it is his heredity."

"My wife has given birth to a black boy." The Messenger of Allah said: "Do you have camels?" He said: "Yes." He said: "What color are they?" He said: "Red." He said: "Are there any gray ones among them?" He said: "There are some gray ones among them." He said: "Where do you think they come from?" He said: "Perhaps it is hereditary." He said: "Likewise, perhaps this is hereditary."

"A man from Banu Fazarah came to the Prophet and said: 'My wife has given birth to a black boy' -and he wanted to disown him. He said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any gray ones among them?' He said: 'There are some gray camels among them.' He said: 'Why is that do you think?' He said: 'Perhaps it is hereditary.' He said: 'Perhaps this is hereditary.' And he did not permit him to disown him."
جَاءَ رَجُلٌ مِنْ بَنِي فَزَارَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلاَمًا أَسْوَدَ وَهُوَ يُرِيدُ الاِنْتِفَاءَ مِنْهُ فَقَالَ هَلْ لَكَ مِنْ إِبِلٍ قَالَ نَعَمْ قَالَ مَا أَلْوَانُهَا قَالَ حُمْرٌ قَالَ هَلْ فِيهَا مِنْ أَوْرَقَ قَالَ فِيهَا ذَوْدٌ وُرْقٌ قَالَ فَمَا ذَاكَ تُرَى قَالَ لَعَلَّهُ أَنْ يَكُونَ نَزَعَهَا عِرْقٌ قَالَ فَلَعَلَّ هَذَا أَنْ يَكُونَ نَزَعَهُ عِرْقٌ قَالَ فَلَمْ يُرَخِّصْ لَهُ فِي الاِنْتِفَاءِ مِنْهُ
"While we were with the Prophet, a man stood up and said: 'O Messenger of Allah, a black boy has been born to me.' The Messenger of Allah said: 'How did that happen?' He said: 'I do not know.' He said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any gray camels among them?' He said: 'There are some gray camels among them.' He said: 'Where do they come from?' He said: 'I do not know, O Messenger of Allah! Perhaps it is hereditary.' He said: 'Perhaps this is also hereditary.' Because of this, the Messenger of Allah decreed the following: 'It is not allowed for a man, to disown a child who was born on his bed, unless he claimed that he had seen an immoral act (Fahishah).'"
بَيْنَمَا نَحْنُ عِنْدَ رَسُولِ اللَّهِ ﷺ قَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي وُلِدَ لِي غُلاَمٌ أَسْوَدُ فَقَالَ رَسُولُ اللَّهِ ﷺ فَأَنَّى كَانَ ذَلِكَ قَالَ مَا أَدْرِي قَالَ فَهَلْ لَكَ مِنْ إِبِلٍ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا قَالَ حُمْرٌ قَالَ فَهَلْ فِيهَا جَمَلٌ أَوْرَقُ قَالَ فِيهَا إِبِلٌ وُرْقٌ قَالَ فَأَنَّى كَانَ ذَلِكَ قَالَ مَا أَدْرِي يَا رَسُولَ اللَّهِ إِلاَّ أَنْ يَكُونَ نَزَعَهُ عِرْقٌ قَالَ وَهَذَا لَعَلَّهُ نَزَعَهُ عِرْقٌ فَمِنْ أَجْلِهِ قَضَى رَسُولُ اللَّهِ ﷺ هَذَا لاَ يَجُوزُ لِرَجُلٍ أَنْ يَنْتَفِيَ مِنْ وَلَدٍ وُلِدَ عَلَى فِرَاشِهِ إِلاَّ أَنْ يَزْعُمَ أَنَّهُ رَأَى فَاحِشَةً
"A man from Banu Fazdrah came to the Messenger of Allah, and said: 'O Messenger of Allah, my wife has given birth to a black boy! The Messenger of Allah said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any grey ones among them?' He said: 'Yes, there are some grey ones among them.' He said: 'Where does that come from?' He said: 'Perhaps it is hereditary.' He said: 'Likewise, perhaps this is hereditary! "

a man frorn the desert people came to the Prophet and said: "O Messenger of Allah, my wife has given birth on my bed to a black boy, and there are no black people among my family." He said: "Do you have camels?" He said: "Yes." He said: "What color are they?" He said: "Red." He said: are there any black ones among them?" He said, "No." He said: "Are there any grey ones among them?" He said- "Yes." He said "How is that?" He said: "Perhaps it is hereditary." He said: "Perhaps (the color of) this son of yours is also hereditary."
أَنَّ رَجُلاً مِنْ أَهْلِ الْبَادِيَةِ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ امْرَأَتِي وَلَدَتْ عَلَى فِرَاشِي غُلاَمًا أَسْوَدَ وَإِنَّا أَهْلُ بَيْتٍ لَمْ يَكُنْ فِينَا أَسْوَدُ قَطُّ قَالَ هَلْ لَكَ مِنَ إِبِلٍ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا قَالَ حُمْرٌ قَالَ هَلْ فِيهَا أَسْوَدُ قَالَ لاَ قَالَ فَهَلْ فِيهَا أَوْرَقُ قَالَ نَعَمْ قَالَ فَأَنَّى كَانَ ذَلِكَ قَالَ عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ قَالَ فَلَعَلَّ ابْنَكَ هَذَا نَزَعَهُ عِرْقٌ
[AI] A man from the tribe of Bani Fazarah came to the Prophet ﷺ and said, "O Prophet of Allah, my wife has given birth to a black boy, as if he is about to be repelled from him." The Messenger of Allah ﷺ asked him, "Do you have any camels?" He replied, "Yes." The Prophet ﷺ asked, "What color are they?" He replied, "They are red." The Prophet ﷺ asked, "Do they have any striped ones?" He replied, "Yes, there are striped ones among them." The Prophet ﷺ asked, "And what is the reason for that?" He said, "Perhaps it is because of an artery that has been removed." The Messenger of Allah ﷺ then said, "And perhaps this (black color) is also because of an artery that has been removed."
أَنَّ رَجُلًا مِنْ بَنِي فَزَارَةَ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا نَبِيَّ اللهِ إِنَّ امْرَأَتَهُ وَلَدَتْ غُلَامًا أَسْوَدَ وَكَأَنَّهُ يُعَرِّضُ أَنْ يَنْتَفِيَ مِنْهُ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ أَلَكَ إِبِلٌ؟ قَالَ نَعَمْ قَالَ مَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ هَلْ فِيهَا ذَوْدٌ أَوْرَقُ؟ قَالَ نَعَمْ فِيهَا ذَوْدٌ أَوْرَقُ قَالَ وَمِمَّا ذَاكَ؟ قَالَ لَعَلَّهُ نَزَعَهُ عِرْقٌ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ وَهَذَا لَعَلَّهُ يَكُونُ نَزَعَهُ عِرْقٌ

[AI] From the Prophet ﷺ , he said, "My wife has given birth to a dark-skinned boy and it was being suggested to me to disown him." The Messenger of Allah ﷺ said, "Do you have any camels?" He said, "Yes." He said, "What are their colors?" He said, "Red." He said, "Are there any white ones among them?" He said, "Yes, there are a few with white spots." He said, "From which do you think they come?" He said, "I do not know, maybe it is because of a vein." He said, "Likewise, maybe it is because of a vein." But he never permitted him to deny his son.

The Prophet ﷺ asked, "What are their colors?" He answered, "They are reddish-brown." The Prophet ﷺ then said, "Is it not possible that one of the camels may give birth to a grayish camel?" He replied, "Yes, O Messenger of Allah." The Prophet ﷺ further asked, "So, how do you see it?" He replied, "I think it is due to the lineage." The Prophet ﷺ said, "Likewise, this black color is due to the lineage."
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ هَلْ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا؟ قَالَ رُمْكٌ قَالَ النَّبِيُّ ﷺ ألَيْسَ َرُبَّمَا جَاءَتْ بِالْبَعِيرِ الْأَوْرَقِ قَالَ يَا رَسُولَ اللهِ نَعَمْ قَالَ فَأَنَّى تَرَى ذَلِكَ؟ قَالَ أُرَاهُ نَزَعَهُ عِرْقٌ فَقَالَ النَّبِيُّ ﷺ وَهَذَا نَزَعَهُ عِرْقٌ
There came a person to the Prophet (may peace he upon him) ) from Banu Fazara and said: My wife has given birth to a child who is black, whereupon Allah's Apostle ﷺ said: Have you any camels? He said: Yes. He again said: What is this colour? He said: They are red. He said: Is there a dusky one among them? He said: Yes, there are dusky ones among them He said: How has it come about? He said: It is perhaps the strain to which it has reverted, whereupon he (the Holy Prophet) said: It is perhaps the strain to which he (the child) has reverted. (Using translation from Muslim 1500a)

"My wife has given birth to a black boy." The Messenger of Allah said: "Do you have camels?" He said: "Yes." He said: "What color are they?" He said: "Red." He said: "Are there any gray ones among them?" He said: "There are some gray ones among them." He said: "Where do you think they come from?" He said: "Perhaps it is hereditary." فقال يا رَسولَ اللهِ إن امرأتي ولدت غلاما أسود فقال النَّبِيّ هل لك من إبل؟ قال نعم قال فما ألوانها قال حمر قال هل فيها من أورق؟ قال نعم فيها ذود ورق قال ما شأنه؟ قال لعلها أن تكون نزعها عِرْقٌ قال النَّبِيّ ﷺ وهذا لعله أن يكون نزعه عِرْقٌ وَهَذَا الْحَدِيثُ لاَ نعلمُهُ يُرْوَى إلاَّ مِنْ هذا الوجه بهذا الإسناد م حَدَّثنا علي بن الفضل قَال حَدَّثنا سفيان بن عُيَينة عَن الزُّهْرِيّ عَن سَعِيد بن الْمُسَيَّب عَن أَبِي هُرَيرة عَن النَّبِيّ ﷺ؛ أَنَّه قال جعلت لي الأرض مسجدًا وطهورا وهذا الحديث لم نسمعه إلاَّ من علي بن الفضل الكرابيسي عَن ابن عُيَينة

"A man from Banu Fazarah came to the Prophet and said: 'My wife has given birth to a black boy' -and he wanted to disown him. He said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any gray ones among them?' He said: 'There are some gray camels among them.' He said: 'Why is that do you think?' He said: 'Perhaps it is hereditary.' He said: 'Perhaps this is hereditary.' And he did not permit him to disown him." (Using translation from Nasāʾī 3479)

"While we were with the Prophet, a man stood up and said: 'O Messenger of Allah, a black boy has been born to me.' The Messenger of Allah said: 'How did that happen?' He said: 'I do not know.' He said: 'Do you have camels?' He said: 'Yes.' He said: 'What color are they?' He said: 'Red.' He said: 'Are there any gray camels among them?' He said: 'There are some gray camels among them.' He said: 'Where do they come from?' He said: 'I do not know, O Messenger of Allah! Perhaps it is hereditary.' He said: 'Perhaps this is also hereditary.' Because of this, the Messenger of Allah decreed the following: 'It is not allowed for a man, to disown a child who was born on his bed, unless he claimed that he had seen an immoral act (Fahishah).'" بَيْنَمَا نَحْنُ عِنْدَ رَسُولِ اللهِ ﷺ قَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ إِنِّي وُلِدَ لِي غُلَامٌ أَسْوَدُ فَقَالَ النَّبِيُّ ﷺ «فَأَنَّى كَانَ ذَلِكَ؟» قَالَ مَا أَدْرِي قَالَ «فَهَلْ لَكَ مِنْ إِبِلٍ؟» قَالَ نَعَمْ قَالَ «فَمَا أَلْوَانُهَا؟» قَالَ حُمْرٌ قَالَ «فَهَلْ فِيهَا جَمَلٌ أَوْرَقُ؟» قَالَ فِيهَا إِبِلٌ وُرْقٌ قَالَ «فَأَنَّى كَانَ ذَلِكَ؟» قَالَ مَا أَدْرِي يَا رَسُولَ اللهِ إِلَّا أَنْ يَكُونَ نَزَعَهُ عِرْقٌ قَالَ «وَهَذَا لَعَلَّهُ نَزَعَهُ عِرْقٌ» فَمِنْ أَجْلِهِ «قَضَى رَسُولُ اللهِ ﷺ هَذَا لَا يَجُوزُ لِرَجُلٍ أَنْ يَنْتَفِيَ مِنْ وَلَدٍ وُلِدَ عَلَى فِرَاشِهِ إِلَّا أَنْ يَزْعُمَ أَنَّهُ رَأَى فَاحِشَةً»
[AI] That the Messenger of Allah, ﷺ , made Qunut in the Witr prayer in the last Rak'ah after saying "Allah hears the one who praises Him." He would say in his Qunut: "O Allah, save Al-Walid bin Al-Walid, O Allah, save Salamah bin Hisham, O Allah, save 'Ayyash bin Abi Rabiah, O Allah, save the oppressed ones among the believers, O Allah, strengthen your punishment upon Mudar, O Allah, make it years upon them like the years of Yusuf." Abu 'Ali Al-Rawdhbari informed us, Muhammad bin Bakr narrated to us, Abu Dawud narrated to us, 'Abdulrahman bin Ibrahim narrated to us, Al-Walid - the son of Muslim - narrated to us, Al-Awza'i mentioned it in his chain. He said: The Messenger of Allah, ﷺ , made Qunut in the Witr prayer for a month, saying the same words except that he did not mention 'Ayyash bin Abi Rabiah. At the end, Abu Hurairah said: One day the Messenger of Allah, ﷺ , went (to prayer) and did not invoke (Qunut) for them. I mentioned that to him, and he said: What do you think? They have already come (to Islam).
أَنَّ رَسُولَ اللهِ ﷺ قَنَتَ فِي صَلَاةِ الْعَتَمَةِ فِي الرَّكْعَةِ الْأَخِيرَةِ بَعْدَمَا قَالَ سَمِعَ اللهُ لِمَنْ حَمِدَهُ شَهْرًا يَقُولُ فِي قُنُوتِهِ اللهُمَّ أَنْجِ الْوَلِيدَ بْنَ الْوَلِيدِ اللهُمَّ أَنْجِ سَلَمَةَ بْنَ هِشَامٍ اللهُمَّ أَنْجِ عَيَّاشَ بْنَ أَبِي رَبِيعَةَ اللهُمَّ أَنْجِ الْمُسْتَضْعَفِينَ مِنَ الْمُؤْمِنِينَ اللهُمَّ اشْدُدْ وَطْأَتَكَ عَلَى مُضَرَ اللهُمَّ اجْعَلْهَا عَلَيْهِمْ سِنِينَ كَسِنِي يُوسُفَ وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ ثنا الْوَلِيدُ هُوَ ابْنُ مُسْلِمٍ ثنا الْأَوْزَاعِيُّ فَذَكَرَهُ بِإِسْنَادِهِ قَالَ قَنَتَ رَسُولُ اللهِ ﷺ فِي صَلَاةِ الْعَتَمَةِ شَهْرًا يَقُولُ فِي قُنُوتِهِ فَذَكَرَهُ بِمِثْلِهِ إِلَّا أَنَّهُ لَمْ يَذْكُرْ عَيَّاشَ بْنَ أَبِي رَبِيعَةَ وَزَادَ فِي آخِرِهِ قَالَ أَبُو هُرَيْرَةَ وَأَصْبَحَ رَسُولُ اللهِ ﷺ ذَاتَ يَوْمٍ فَلَمْ يَدْعُ لَهُمْ فَذَكَرْتُ ذَلِكَ فَقَالَ وَمَا تُرَاهُمْ قَدْ قَدِمُوا
[AI] Abdullah ibn Umar and Abu Hurairah reported that they heard the Messenger of Allah ﷺ saying while standing on the steps of his pulpit, "A time will come when some people will stop attending Friday prayers, or Allah will seal their hearts, and they will become among the heedless."
أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ وَأَبَا هُرَيْرَةَ حَدَّثَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ يَقُولُ وَهُوَ عَلَى أَعْوَادِ مِنْبَرِهِ لَيَنْتَهِيَنَّ أَقْوَامٌ عَنْ وَدْعِهِمُ الْجُمُعَاتِ أَوْ لَيَخْتِمَنَّ اللهُ عَلَى قُلُوبِهِمْ ثُمَّ لَيَكُونُنَّ مِنَ الْغَافِلِينَ
[AI] He witnessed the Prophet ﷺ praying over a deceased, and heard him say, "O Allah, forgive our living and our dead, our present and our absent, our young and our old, our males and our females." Abu Salamah said, "During this conversation, he said, 'Whoever among us you keep alive, let him live according to Islam, and whoever among us you cause to die, let him die in a state of faith.'" It was narrated by Muhammad ibn Ishaq ibn Yasār from Muhammad ibn Ibrāhīm al-Taymi from Abu Salamah from Abu Hurayrah that the Messenger of Allah ﷺ used to say in the prayer for the funeral, and he mentioned its meaning. Abu ‘Isa al-Tirmidhi said, in what was reported to me by Muhammad ibn Isma’il al-Bukhari about this chapter, “I asked Muhammad (meaning al-Bukhari), ‘Which of the reports about praying for the deceased from Yahya ibn Abi Kathir is the most sound?’” He said, ‘The most sound reports on the prayer for the deceased are the hadiths of Abu Ibrāhīm al-Ash’hali from his father and grandfather, and even though the name of Abu Ibrāhīm is not known.’ Abu ‘Isa (al-Tirmidhi) said, ‘I said to him, ‘The one who is said to be Abu ‘Isa al-Qatadah, he denied that he is Abu ‘Isa al-Qatadah, and Abu Qatadah is Salimi and this is Ash’hali.’ Muhammad said, ‘The hadith of Abu Salamah from Abu Hurayrah, ‘A’ishah, and Abu Qatadah in this chapter is not confirmed, and the most sound reports in this chapter are the hadiths of ‘Awf ibn Malik.’'
أَنَّهُ شَهِدَ النَّبِيَّ ﷺ صَلَّى عَلَى مَيِّتٍ قَالَ فَسَمِعْتُهُ يَقُولُ اللهُمَّ اغْفِرْ لِحَيِّنَا وَمَيِّتِنَا وَشَاهِدِنَا وَغَائِبِنَا وَصَغِيرِنَا وَكَبِيرِنَا وَذَكَرِنَا وَأُنْثَانَا قَالَ وَقَالَ أَبُو سَلَمَةَ مَعَ هَذَا الْكَلَامِ مَنْ أَحْيَيْتَهُ مِنَّا فَأَحْيِهِ عَلَى الْإِسْلَامِ وَمَنْ تَوَفَّيْتَهُ مِنَّا فَتَوَفَّهُ عَلَى الْإِيمَانِ 6975 وَرُوِيَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ بْنِ يَسَارٍ عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ التَّيْمِيِّ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَقُولُ فِي الصَّلَاةِ عَلَى الْجِنَازَةِ فَذَكَرَ مَعْنَاهُ أَخْبَرَنَاهُ أَبُو أَحْمَدَ الْحُسَيْنُ بْنُ عَلُوسَا الْأَسَدَابَاذِيُّ ثنا أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ إِبْرَاهِيمَ بْنِ مَاسِيٍّ الْبَزَّازُ أَخْبَرَنِي أَبُو مُسْلِمٍ إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ الْبَصْرِيُّ أنبأ أَبُو عُمَرَ الضَّرِيرُ حَفْصُ بْنُ عُمَرَ أنبأ حَمَّادُ بْنُ سَلَمَةَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ فَذَكَرَهُ بِمَعْنَاهُ وَقَالَ أَبُو عِيسَى التِّرْمِذِيُّ فِيمَا بَلَغَنِي عَنْهُ سَأَلْتُ مُحَمَّدًا يَعْنِي الْبُخَارِيَّ عَنْ هَذَا الْبَابِ فَقُلْتُ أِيُّ الرِّوَايَاتِ عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ أَصَحُّ فِي الصَّلَاةِ عَلَى الْمَيِّتِ؟ فَقَالَ أَصَحُّ شَيْءٍ فِيهِ حَدِيثُ أَبِي إِبْرَاهِيمَ الْأَشْهَلِيِّ عَنْ أَبِيهِ وَلِوَالِدِهِ صُحْبَةٌ وَلَمْ يُعْرَفِ اسْمُ أَبِي إِبْرَاهِيمَ قَالَ أَبُو عِيسَى قُلْتُ لَهُ فَالَّذِي يُقَالُ هُوَ عَبْدُ اللهِ بْنُ أَبِي قَتَادَةَ فَأَنْكَرَ أَنْ يَكُونَ هُوَ عَبْدَ اللهِ بْنَ أَبِي قَتَادَةَ وَقَالَ أَبُو قَتَادَةَ هُوَ سَلْمِيٌّ وَهَذَا أَشْهَلِيٌّ قَالَ مُحَمَّدٌ وَحَدِيثُ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ وَعَائِشَةَ وَأَبِي قَتَادَةَ فِي هَذَا الْبَابِ غَيْرُ مَحْفُوظٍ وَأَصَحُّ شَيْءٍ فِي هَذَا الْبَابِ حَدِيثُ عَوْفِ بْنِ مَالِكٍ
[AI] The Messenger of Allah, ﷺ , sent Umar ibn Al-Khattab to collect charity. Ibn Jameel, Khalid ibn Al-Walid, and Al-Abbas refused to give charity. The Messenger of Allah, ﷺ , said, "Ibn Jameel will not face any consequences unless he is in need, and Allah will enrich him. As for Khalid, you have wronged him. He has dedicated his arms and effort in the path of Allah. As for Al-Abbas, he is my uncle, and the same applies to him." Then he asked, "Have you not heard that a man resembles his father or his paternal uncle?"
بَعَثَ رَسُولُ اللهِ ﷺ عُمَرَ بْنَ الْخَطَّابِ ؓ عَلَى الصَّدَقَةِ فَمَنَعَ ابْنُ جَمِيلٍ وَخَالِدُ بْنُ الْوَلِيدِ وَالْعَبَّاسُ فَقَالَ رَسُولُ اللهِ ﷺ مَا يَنْقِمُ ابْنُ جَمِيلٍ إِلَّا أَنْ كَانَ فَقِيرًا فَأَغْنَاهُ اللهُ وَأَمَّا خَالِدٌ فَإِنَّكُمْ تَظْلِمُونَ خَالِدًا؛ فَقَدِ احْتَبَسَ أَدْرَاعَهُ وَأَعْتَادَهُ فِي سَبِيلِ اللهِ وَأَمَّا الْعَبَّاسُ عَمُّ رَسُولِ اللهِ ﷺ فَهِيَ عَلَيَّ وَمِثْلُهَا ثُمَّ قَالَ أَمَا شَعَرْتَ أَنَّ عَمَّ الرَّجُلِ صِنْوُ الْأَبِ أَوْ صِنْوُ أَبِيهِ؟
[AI] He informed him that when the Messenger of Allah ﷺ passed away and Abu Bakr was appointed as his successor, those Arab polytheists who had disbelieved said, "O Abu Bakr, how can you fight the people when the Messenger of Allah ﷺ had commanded us to fight until they say, 'There is no deity but Allah'? Whoever says 'There is no deity but Allah' will be protected by me for his wealth and life, except for his due punishment, which will be accounted for by Allah." Abu Bakr said, "By Allah, I will fight those who differentiate between prayer and zakat, for zakat is the right of wealth. By Allah, if they withhold even a small rope (used for tethering livestock), which they used to give to the Messenger of Allah ﷺ, I will fight them for withholding it." Umar said, "By Allah, it is nothing but that I saw that Allah had opened the heart of Abu Bakr for fighting, so I understood that it is the truth."
أَخْبَرَهُ قَالَ لَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ وَاسْتُخْلِفَ أَبُو بَكْرٍ ؓ بَعْدَهُ وَكَفَرَ مَنْ كَفَرَ مِنَ الْعَرَبِ قَالَ عُمَرُ يَا أَبَا بَكْرٍ كَيْفَ تُقَاتِلُ النَّاسَ وَقَدْ قَالَ رَسُولُ اللهِ ﷺ أُمِرْتُ أَنْ أُقَاتِلَ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَمَنْ قَالَ لَا إِلَهَ إِلَّا اللهُ عَصَمَ مِنِّي مَالَهُ وَنَفْسَهُ إِلَّا بِحَقِّهِ وَحِسَابُهُ عَلَى اللهِ ؟ قَالَ أَبُو بَكْرٍ ؓ وَاللهِ لَأُقَاتِلَنَّ مَنْ فَرَّقَ بَيْنَ الصَّلَاةِ وَالزَّكَاةِ فَإِنَّ الزَّكَاةَ حَقُّ الْمَالِ وَاللهِ لَوْ مَنَعُونِي عَنَاقًا كَانُوا يُؤَدُّونَهَا إِلَى رَسُولِ اللهِ ﷺ قَاتَلْتُهُمْ عَلَى مَنْعِهَا قَالَ عُمَرُ ؓ فَوَاللهِ مَا هُوَ إِلَّا أَنْ رَأَيْتُ اللهَ قَدْ شَرَحَ صَدْرَ أَبِي بَكْرٍ ؓ لِلْقِتَالِ فَعَرَفْتُ أَنَّهُ الْحَقُّ
[AI] The Messenger of Allah ﷺ was approached by a Bedouin man who said, "Indeed, my wife has given birth to a dark-skinned boy." The Messenger of Allah ﷺ asked, "Do you have any camels?" The man replied, "Yes." He then asked, "What color are they?" The man replied, "Red." The Messenger of Allah ﷺ asked, "Do they have any spots?" The man replied, "Yes." The Messenger of Allah ﷺ said, "Perhaps your son inherited that trait from them."
أَنَّ رَسُولَ اللهِ ﷺ جَاءَهُ أَعْرَابِيٌّ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ هَلْ تَكُونُ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ مَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ هَلْ فِيهَا أَوْرَقُ؟ قَالَ نَعَمْ قَالَ بِمَ ذَاكَ؟ قَالَ ذَاكَ عِرْقٌ نَزَعَهُ قَالَ رَسُولُ اللهِ ﷺ فَلَعَلَّ ابْنَكَ نَزَعَهُ عِرْقٌ
[AI] A woman came to the Prophet ﷺ and said, "O Messenger of Allah, I have given myself to you." So she stood up for a long time. Then a man stood up and said, "O Messenger of Allah, marry her to me if you do not need her." The Messenger of Allah ﷺ said, "Do you have anything that you can give her as a dowry?" He said, "I only have my waistcloth." So the Prophet ﷺ said, "If you give it to her, you will have to sit without a waistcloth. So seek something else." He said, "I cannot find anything." The Prophet ﷺ said, "Seek something, even if it is an iron ring." So he searched but did not find anything. Then the Prophet ﷺ asked him, "Do you have anything from the Quran?" He said, "Yes, I have Surah So-and-So and Surah So-and-So." The Prophet ﷺ said, "I have married her to you with what you have from the Quran."
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي قَدْ وَهَبْتُ نَفْسِي لَكَ فَقَامَتْ قِيَامًا طَوِيلًا فَقَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ زَوِّجْنِيهَا إِنْ لَمْ تَكُنْ لَكَ بِهَا حَاجَةٌ فَقَالَ رَسُولُ اللهِ ﷺ هَلْ عِنْدَكَ مِنْ شَيْءٍ تُصْدِقُهَا إِيَّاهُ؟ فَقَالَ مَا عِنْدِي إِلَّا إِزَارِي هَذَا فَقَالَ النَّبِيُّ ﷺ إِنْ أَعْطَيْتَهَا إِيَّاهُ جَلَسْتَ لَا إِزَارَ لَكَ فَالْتَمِسْ شَيْئًا فَقَالَ مَا أَجِدُ شَيْئًا قَالَ الْتَمِسْ وَلَوْ خَاتَمًا مِنْ حَدِيدٍ فَالْتَمَسَ فَلَمْ يَجِدْ شَيْئًا فَقَالَ لَهُ رَسُولُ اللهِ ﷺ هَلْ مَعَكَ مِنَ الْقُرْآنِ شَيْءٌ؟ قَالَ نَعَمْ سُورَةُ كَذَا وَسُورَةُ كَذَا لِسُوَرٍ سَمَّاهَا فَقَالَ رَسُولُ اللهِ ﷺ قَدْ زَوَّجْتُكَهَا بِمَا مَعَكَ مِنَ الْقُرْآنِ
[AI] He was asked while on the pulpit about a man who divorced his wife three times, then someone else married her, closed the door, removed the veil, and revealed her face, then divorced her. He said, "She is not permissible for the first man until the other man tastes her honey." This is the wording of the Hadith of Al-'Abdiyy. Al-'Abdiyy also said it in his narration, as did Abu Ahmad Al-Zubayri. The authentic narration is from 'Abd Al-Rahman bin Mahdi, and it was narrated by Waki' once from Sufyan, who narrated from 'Alqamah, from Razeen bin Sulaiman Al-Ahmarri. He was contradicted by Shu'bah in his chain of narrators, so he narrated it from 'Alqamah bin Marthad, from Salim bin Razeen, from Salim bin 'Abdullah, from Sa'id bin Al-Musayyib, from Ibn 'Umar. The Prophet informed us of this and it was narrated by Abu 'Abdullah Al-Hafiz and Abu Bakr Ahmad bin Al-Hasan. They said, "Abu Al-Abbas Muhammad bin Ya'qub informed us, Muhammad bin Ishaq informed me, and I am the successor of Yahya bin Ma'in." They said, "Ghandar informed us, Shu'bah mentioned it to us, and I received it from Muhammad bin Isma'il Al-Bukhari that he weakened the Hadith of Shu'bah and Sufyan together. And Abi Zar'ah said that the Hadith of Sufyan is the most authentic."
ﷺ سُئِلَ وَهُوَ عَلَى الْمِنْبَرِ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَهَا غَيْرُهُ وَأَغْلَقَ الْبَابَ وَأَرْخَى السِّتْرَ وَكَشَفَ الْخِمَارَ ثُمَّ فَارَقَهَا قَالَ لَا تَحِلُّ لِلْأَوَّلِ حَتَّى يَذُوقَ عُسَيْلَتَهَا الْآخَرُ لَفْظُ حَدِيثِ الْعَبْدِيِّ وَكَمَا قَالَ الْعَبْدِيُّ فِي إِسْنَادِهِ قَالَهُ أَيْضًا أَبُو أَحْمَدَ الزُّبَيْرِيُّ وَالصَّحِيحُ رِوَايَةُ عَبْدِ الرَّحْمَنِ بْنِ مَهْدِيٍّ وَرَوَاهُ وَكِيعٌ مَرَّةً عَنْ سُفْيَانَ فَقَالَ عَنْ عَلْقَمَةَ عَنْ رَزِينِ بْنِ سُلَيْمَانَ الْأَحْمَرِيِّ 15199 وَخَالَفَهُ شُعْبَةُ فِي إِسْنَادِهِ فَرَوَاهُ عَنْ عَلْقَمَةَ بْنِ مَرْثَدٍ عَنْ سَالِمِ بْنِ رَزِينٍ عَنْ سَالِمِ بْنِ عَبْدِ اللهِ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنِ ابْنِ عُمَرَ ؓ عَنِ النَّبِيِّ ﷺ أَخْبَرَنَاه أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ قَالَا نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نَا مُحَمَّدُ بْنُ إِسْحَاقَ أَنَا خَلَف وَيَحْيَى بْنِ مَعِين قَالاَ نَا غَنْدَر نَا شُعْبَة فَذَكَرَه وَبَلَغَنِي عَنْ مُحَمَّدٌ بْنِ إِسْمَاعِيلِ البُخَارِي أَنَّهُ وَهَنَ حَدِيث شُعْبَة وَسُفْيَان جَمِيعاً وَعَنْ أَبِي زَرْعَةَ أَنَّهُ قَالَ حَدِيثُ سُفْيَان أَصَح 15200 فَقَدْ
[AI] A man from the Ansar came to the Prophet ﷺ and said, "O Messenger of Allah, what should a man do if he finds his wife with another man? Should he kill him and be killed himself?" So Allah revealed in the Quran regarding this matter. The Prophet ﷺ said, "The matter has been decided for you and your wife." They both cursed each other, and then the man left his wife in the presence of the Prophet ﷺ . It became a practice after them that if a couple curses each other, they should be separated. The wife was pregnant, and he denied that the child was his. His son was called to his mother. Abu Abdullah Al-Hafiz informed us, Abu Al-Abbas I am Ar-Rabi' reported in the hadith of Ibn Abi Dhia' that it indicates that Sahl ibn Sa'd said, "It was the practice of the cursed ones." In the hadith of Malik and Ibrahim ibn Sa'd, it is as if it is the statement of Ibn Shihab, and it may be that this is not a difference mentioned by Ibn Shihab once without mentioning Sa'ad and another time mentioning Sa'ad. Ibn Abi Dhia' agreed with Ibrahim ibn Sa'd in what he added to the end of the hadith in addition to the hadith of Malik. As for the hadith of Ibn Abi Dhia' it was informed by Abu Abdullah Al-Hafiz, Abu Sa'd Ahmad ibn Ya'qub ibn Ahmad Al-Thaqafi. Umar ibn Hafs As-Sadusi informed us, Asim ibn Ali narrated to us, Ibn Abi Dhia' narrated from Az-Zuhri, from Sahl ibn Sa'd As-Sa'idi, that Uwaimir came to Asim ibn Adi and mentioned the hadith in the meaning of the narration of Abdullah ibn Naafi'.
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَأَنْزَلَ اللهُ ﷻ فِي شَأْنِهِ مَا ذُكِرَ فِي الْقُرْآنِ مِنْ أَمْرِ الْمُتَلَاعِنَيْنِ قَالَ النَّبِيُّ ﷺ قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ ثُمَّ فَارَقَهَا عِنْدَ النَّبِيِّ ﷺ فَكَانَتْ سُنَّةً بَعْدَهُمَا أَنْ يُفَرَّقَ بَيْنَهُمَا أَيِ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا فَكَانَ ابْنُهُ يُدْعَى إِلَى أُمِّهِ 15315 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ نا أَبُو الْعَبَّاسِ أَنَا الرَّبِيعُ أَنَا الشَّافِعِيُّ قَالَ فِي حَدِيثِ ابْنِ أَبِي ذِئْبٍ دَلِيلٌ عَلَى أَنَّ سَهْلَ بْنَ سَعْدٍ قَالَ كَانَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ وَفِي حَدِيثِ مَالِكٍ وَإِبْرَاهِيمَ بْنِ سَعْدٍ كَأَنَّهُ قَوْلُ ابْنِ شِهَابٍ وَقَدْ يَكُونُ هَذَا غَيْرَ مُخْتَلِفٍ يَقُولُهُ مَرَّةً ابْنُ شِهَابٍ وَلَا يَذْكُرُ سَهْلًا وَيَقُولُهُ أُخْرَى وَيَذْكُرُ سَهْلًا وَوَافَقَ ابْنُ أَبِي ذِئْبٍ إِبْرَاهِيمَ بْنَ سَعْدٍ فِيمَا زَادَ فِي آخِرِ الْحَدِيثِ عَلَى حَدِيثِ مَالِكٍ قَالَ الشَّيْخُ أَمَّا حَدِيثُ ابْنِ أَبِي ذِئْبٍ 15316 فَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو سَعْدٍ أَحْمَدُ بْنُ يَعْقُوبَ بْنِ أَحْمَدَ الثَّقَفِيُّ نا عُمَرُ بْنُ حَفْصٍ السَّدُوسِيُّ نا عَاصِمُ بْنُ عَلِيٍّ نا ابْنُ أَبِي ذِئْبٍ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِيِّ أَنَّ عُوَيْمِرًا جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ فَذَكَرَ الْحَدِيثَ بِمَعْنَى رِوَايَةِ عَبْدِ اللهِ بْنِ نَافِعٍ
[AI] How do you say about a man who finds another man with his wife, should he kill him and you kill him or what should he do? He said, ask the Messenger of Allah ﷺ about that. So Asim came to the Prophet ﷺ and said, "O Messenger of Allah, a man finds another man with his wife, should he kill him and you kill him or what should he do?" So the Messenger of Allah ﷺ disliked the questions and criticized them. So Uwaimir said, "By Allah, I will not stop until I ask the Messenger of Allah ﷺ about that." So Uwaimir came and said, "O Messenger of Allah, a man finds another man with his wife, should he kill him and you kill him or what should he do?" So the Messenger of Allah ﷺ said, "Allah has revealed the Quran concerning you and your companion. So the Messenger of Allah ﷺ commanded both of them to curse each other with what Allah mentioned in His Book." So he said, "So she cursed him." Then he said, "O Messenger of Allah, if I divorce her, I have wronged her." He said, "So he divorced her, and it was a Sunnah for those who came after them from among the cursing parties." Then the Messenger of Allah ﷺ said, "Be cautious, for if she comes with a child called As'ham, it should be attributed to her. It will darken the two eyes, make the legs skinny, and I do not think Uwaimir except that he will be speaking the truth about her. And if she comes with a child called Uhaymir, it will be as if he is a free-roaming bull and I do not think Uwaimir except that he will be lying about her." He said, "She came with him with a description similar to the one the Messenger of Allah ﷺ attributed to him due to Uwaimir's testimony." He said, "After that, he was traced back to his mother."
كَيْفَ تَقُولُ فِي رَجُلٍ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ قَالَ سَلْ لي رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ قَالَ فَأَتَى عَاصِمٌ النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ فَسَأَلَهُ عُوَيْمِرٌ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ قَدْ كَرِهَ الْمَسَائِلَ وَعَابَهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ قَالَ فَجَاءَ عُوَيْمِرٌ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَقَالَ رَسُولُ اللهِ ﷺ قَدْ أَنْزَلَ اللهُ الْقُرْآنَ فِيكَ وَفِي صَاحِبَتِكَ فَأَمَرَهُمَا رَسُولُ اللهِ ﷺ بِالْمُلَاعَنَةِ بِمَا سَمَّى اللهُ فِي كِتَابِهِ قَالَ فَلَاعَنَهَا ثُمَّ قَالَ يَا رَسُولَ اللهِ إِنْ حَبَسْتُهَا فَقَدْ ظَلَمْتُهَا قَالَ فَطَلَّقَهَا وَكَانَتْ بَعْدُ سُنَّةً لِمَنْ كَانَ بَعْدَهُمَا مِنَ الْمُتَلَاعِنَيْنِ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ أَبْصِرُوا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ الْعَيْنَيْنِ عَظِيمَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَلَا أَحْسَبُ عُوَيْمِرًا إِلَّا وقَدْ صَدَقَ عَلَيْهَا وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةٌ فَلَا أَحْسَبُ عُوَيْمِرًا إِلَّا وَقَدْ كَذَبَ عَلَيْهَا قَالَ فَجَاءَتْ بِهِ عَلَى النَّعْتِ الَّذِي نَعَتَ رَسُولُ اللهِ ﷺ مِنْ تَصْدِيقِ عُوَيْمِرٍ قَالَ فَكَانَ يُنْسَبُ بَعْدَ ذَلِكَ لِأُمِّهِ
[AI] That the Messenger of Allah ﷺ was approached by a Bedouin man who said, "O Messenger of Allah, in the narration of Al-Shafi'i, it is mentioned that a man from the desert came to the Prophet ﷺ and said to him, 'Indeed, my wife has given birth to a dark-skinned boy.' The Prophet ﷺ said to him, 'Do you have any camels?' He replied, 'Yes.' The Prophet ﷺ asked, 'What color are they?' He answered, 'Red.'" The Prophet ﷺ then asked, 'Are there any gray ones among them?' He replied, 'Yes.' The Prophet ﷺ asked, 'How do you see that?' He said, 'By a vein that I removed.' So the Prophet ﷺ said, 'Perhaps this vein is the cause.'
أَنَّ رَسُولَ اللهِ ﷺ جَاءَهُ رَجُلٌ أَعْرَابِيٌّ فَقَالَ يَا رَسُولَ اللهِ وَفِي رِوَايَةِ الشَّافِعِيِّ أَنَّ رَجُلًا مِنْ أَهْلِ الْبَادِيَةِ أَتَى النَّبِيَّ ﷺ فَقَالَ لَهُ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ لَهُ النَّبِيُّ ﷺ هَلْ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ فَهَلْ فِيهَا مِنْ أَوْرَقَ؟ قَالَ نَعَمْ قَالَ أَنَّى تَرَى ذَلِكَ؟ قَالَ عِرْقًا نَزَعَهُ فَقَالَ النَّبِيُّ ﷺ فَلَعَلَّ هَذَا نَزَعَهُ عِرْقٌ
[AI] "A Bedouin man from the tribe of Banu Fazara came to the Prophet ﷺ and said, 'Indeed, my wife has given birth to a dark-skinned boy.' The Prophet ﷺ said to him, 'Do you have any camels?' He replied, 'Yes.' The Prophet ﷺ asked, 'What are their colors?' He answered, 'Red.' The Prophet ﷺ then asked, 'Do any of them have white markings?' He replied, 'Yes, some of them have white markings.' The Prophet ﷺ said, 'Perhaps it is from the genes of one of them that the child inherited this.' The phrase 'perhaps it is from the genes of one of them' is a narration from Imam Shafi'i, and in the narration of Qutaiba, it mentions that a man from the tribe of Banu Fazara came to the Prophet ﷺ and said, 'Perhaps it is from the genes of one of them.'"
أَنَّ أَعْرَابِيًّا مِنْ بَنِي فَزَارَةَ أَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ لَهُ النَّبِيُّ ﷺ هَلْ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ هَلْ فِيهَا مِنْ أَوْرَقَ؟ قَالَ إِنَّ فِيهَا لَوُرْقًا قَالَ فَأَنَّى أَصَابَهَا ذَلِكَ؟ قَالَ لَعَلَّهُ عِرْقٌ نَزَعَهُ فَقَالَ النَّبِيُّ ﷺ وَهَذَا لَعَلَّهُ نَزَعَهُ عِرْقٌ لَفْظُ حَدِيثِ الشَّافِعِيِّ وَفِي رِوَايَةِ قُتَيْبَةَ جَاءَ رَجُلٌ مِنْ بَنِي فَزَارَةَ إِلَى النَّبِيِّ ﷺ وَقَالَ عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ
[AI] Abu Huraira and Zaid ibn Khalid narrated that a man from the Bedouins came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I swear by Allah, except if Allah decides otherwise, then I will definitely be judged according to the Book of Allah." Another man, who was more knowledgeable than him, said, "Yes, judge between us according to the Book of Allah and give me permission." The Messenger of Allah ﷺ said, "Say what you have to say." He said, "My son was a shepherd and he committed adultery with his wife. I was informed that stoning was required for my son, so I ransomed him with one hundred sheep and a slave-girl. I asked the people of knowledge and they informed me that my son should be lashed one hundred times and exiled for one year, and that his wife should be stoned." The Messenger of Allah ﷺ said, "By the One in Whose Hand is my soul, I will judge between you according to the Book of Allah. The slave-girl and the sheep shall be returned to you, and your son shall be lashed one hundred times and exiled for one year. Go, O Unais, and deal with the matter of this woman, and if she confesses, then stone her." So, the next day she confessed and the Messenger of Allah ﷺ ordered that she be stoned.
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ أَنَّهُمَا قَالَا إِنَّ رَجُلًا مِنَ الْأَعْرَابِ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ فِيَّ بكِتَابِ اللهِ فَقَالَ الْآخَرُ وَهُوَ أَفْقَهُ مِنْهُ نَعَمْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي فَقَالَ رَسُولُ اللهِ ﷺ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ وَإِنِّي أُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَوَلِيدَةٍ وَسَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَتِهِ الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ الْوَلِيدَةُ وَالْغَنَمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ اغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا قَالَ فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَأَمَرَ بِهَا رَسُولُ اللهِ ﷺ فَرُجِمَتْ
[AI] Abu Huraira, Zaid bin Khalid al-Juhani, and Shibl said, "We were with the Prophet ﷺ when a man came to him and said, 'I adjure you by Allah, do not judge between us except according to the Book of Allah and allow me to speak first.' The Prophet ﷺ said, 'Say your statement.' The man said, 'My son was a shepherd for this man's wife and he committed adultery with her. I redeemed myself from him by giving him a hundred sheep and a servant. Then I asked some knowledgeable people who informed me that he should be punished with a hundred lashes and one year of exile, and that his wife should be stoned to death.' The Messenger of Allah ﷺ said, 'By the One in Whose hand is my soul, I will judge between you according to the Book of Allah. The hundred sheep and the servant are to be returned to you, and your son is to be punished with a hundred lashes and one year of exile. And you, O Unays, go and announce that if the wife of this man admits (to the adultery), then stone her.' So Unays went and announced this, and the wife admitted (to the adultery), so he stoned her.' Sufyan and Unays both said, 'Unays was a man who had embraced Islam.'
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَيْهِ جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ ﷻ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاحِدٍ وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ سُفْيَانُ وَأُنَيْسٌ رَجُلٌ مِنْ أَسْلَمَ
[AI] The Messenger of Allah ﷺ was asked about a female slave who commits adultery but is not married. He said, "If she commits adultery, flog her. If she commits adultery again, flog her. Then, sell her even if it is for a rope." Ibn Shihab said, "I do not know if the third or fourth time was meant." Abu Ali Ar-Rawzbary informed us that Abu Bakr ibn Dasa narrated to us from Abu Dawud, who narrated from Abdullah ibn Muslimah from Malik, who mentioned it with a similar chain of narration except that he said it was narrated from Abu Hurairah and Zaid ibn Khalid Al-Juhani. He added, "If she commits adultery again, sell her even if it is for a rope." Ibn Shihab said, "I do not know if it was meant for the third or fourth time. The rope refers to a piece of string."
أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصَنْ قَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لَا أَدْرِي أبَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ 17099 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا عَبْدُ اللهِ بْنُ مَسْلَمَةَ عَنْ مَالِكٍ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ إِلَّا أَنَّهُ قَالَ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ زَادَ قَالَ ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لَا أَدْرِي فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ وَالضَّفِيرُ الْحَبْلُ
A bedouin came to Messenger of Allah ﷺ and said, "My wife has delivered a black child." The Prophet ﷺ said to him, "Have you camels?" He replied, "Yes." The Prophet ﷺ said, "What color are they?" He replied, "They are red." The Prophet ﷺ further asked, "Are any of them gray in color?" He replied, "Yes." The Prophet asked him, "Whence did that grayness come?" He said, "I thing it descended from the camel's ancestors." Then the Prophet ﷺ said (to him), "Therefore, this child of yours has most probably inherited the color from his ancestors." أَنَّ رَسُولَ اللهِ ﷺ جَاءَهُ أَعْرَابِيٌّ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ قَالَ هَلْ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ مَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ هَلْ فِيهَا أَوْرَقُ؟ قَالَ نَعَمْ قَالَ مِمَّ ذَاكَ؟ قَالَ ذَاكَ عِرْقٌ نَزَعَهُ قَالَ رَسُولُ اللهِ ﷺ فَلَعَلَّ ابْنَكَ نَزَعَهُ عِرْقٌ لَفْظُ حَدِيثِ الْأَسْفَاطِيِّ
"that a man from [Banu] Fazarah came to the Prophet ﷺ and said: 'O Messenger of Allah ﷺ! My wife gave birth to black boy." So the Prophet ﷺ said: "[Do you have any camels?]" He said: 'Yes." He said: "Then what are their colors?" He said: "Red." He said: "Is there a gray one among them?" He said: "Yes, there is a grey one among them." He said: "From where does that come?" He said: "Perhaps it is hereditary." He said: "Then in the same way, perhaps it is his heredity." (Using translation from Tirmidhī 2128)
جَاءَ أَعْرَابِيٌّ مِنْ بَنِي فَزَارَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ النَّبِيُّ ﷺ فَهَلْ لَكَ مِنْ إِبِلٍ؟ فَقَالَ نَعَمْ قَالَ مَا أَلْوَانُهَا؟ قَالَ حُمْرٌ فَقَالَ رَسُولُ اللهِ ﷺ فَهَلْ فِيهَا مِنْ أَوْرَقَ؟ قَالَ إِنَّ فِيهَا لَوُرْقًا قَالَ فَأَنَّى أَتَاهَا ذَلِكَ؟ قَالَ لَعَلَّهُ عِرْقٌ نَزَعَهَا قَالَ رَسُولُ اللهِ ﷺ وَلَعَلَّ عِرْقًا نَزَعَهُ
[AI] A woman from the Bani Makhzum tribe stole something, so she was brought to the Prophet ﷺ. She sought refuge with Umm Salama, the wife of the Prophet ﷺ. The Prophet ﷺ said, "By Allah, if Fatimah had done this, I would have cut off her hand." Abu Abdullah Al-Hafidh informed us, Abu Ja'far Muhammad bin Salih bin Hane' informed us, Ibrahim bin Muhammad As-Saydalani informed us, Salamah bin Shabib informed us, Al-Hasan bin Muhammad bin A'yan informed us, Ma'qu'il narrated it to us from Abu Zubair from Jabir, and he mentioned it.
أَنَّ امْرَأَةً مِنْ بَنِي مَخْزُومٍ سَرَقَتْ فَأُتِيَ بِهَا النَّبِيُّ ﷺ فَعَاذَتْ بِأُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ ﷺ فَقَالَ النَّبِيُّ ﷺ وَاللهِ لَوْ كَانَتْ فَاطِمَةُ لَقَطَعْتُ يَدَهَا فَقُطِعَتْ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ صَالِحِ بْنِ هَانِئٍ ثنا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ الصَّيْدَلَانِيُّ ثنا سَلَمَةُ بْنُ شَبِيبٍ ثنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ أَعْيَنَ ثنا مَعْقِلٌ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ فَذَكَرَهُ
[AI] The Messenger of Allah, ﷺ , said, "I don't know if Tubba was blind or not. And I don't know if Dhul-Qarnayn was a prophet or not. And I don't know if the prescribed punishments are expiations for those who commit them or not. This is how it is."
قَالَ رَسُولُ اللهِ ﷺ مَا أَدْرِي تُبَّعٌ أَلَعِينًا كَانَ أَمْ لَا؟ وَمَا أَدْرِي ذُو الْقَرْنَيْنِ أَنَبِيًّا كَانَ أَمْ لَا؟ وَمَا أَدْرِي الْحُدُودَ كَفَّارَاتٌ لِأَهْلِهَا أَمْ لَا فَهَكَذَا
