31. Endowments
٣١۔ كِتَابُ الْوَقْفِ
[Machine] In the name of Allah, the Most Gracious, the Most Merciful.
بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ
[Machine] "O Messenger of Allah, I have acquired some land by God's will, though I have never acquired any wealth that is more cherished to me than it. Therefore, what do you command me, O Messenger of Allah?" He replied, "If you wish, you may give it in charity while keeping the principle intact." He said, "So Umar made it a perpetual charity that cannot be sold, gifted, or inherited. It is to be given in charity to the poor, to relatives, in the way of Allah, and to slaves." Ibn Awun said, and I think he said, "And to guests, and there is no harm for whoever is in possession of it to partake of it in a good manner and to extend it to a close friend who is not financially supported. This wording is from the narration of Ibn Bishran."
يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ أَرْضًا وَاللهِ مَا أَصَبْتُ مَالًا قَطُّ هُوَ أَنْفَسُ عِنْدِي مِنْهَا فَمَا تَأْمُرُنِي يَا رَسُولَ اللهِ؟ قَالَ إِنْ شِئْتَ تَصَدَّقْتَ بِهَا وَحَبَسْتَ أَصْلَهَا قَالَ فَجَعَلَهَا عُمَرُ ؓ صَدَقَةً لَا تُبَاعُ وَلَا تُوهَبُ وَلَا تُورَثُ تَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَلِذَوِي الْقُرْبَى وَفِي سَبِيلِ اللهِ وَفِي الرِّقَابِ قَالَ ابْنُ عَوْنٍ وَأَحْسِبُهُ قَالَ وَالضَّيْفِ وَلَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ وَيُطْعِمَهُ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ لَفْظُهُ حَدِيثُ ابْنِ بِشْرَانَ
'Umar got some land in Khaibar, and when to the Prophet ﷺ and said: I have acquired land in Khaibar which I consider to be more valuable than any I have acquired ; so what do you command me to do with it ? He replied: If you wish, you may make the property as inalienable possession, and give its produce as sadaqah (charity). So 'Umar gave it as a sadaqah declaring that the property must not be sold, given away, or inherited : (and gave its produce as sadaqah to be devoted) to poor, relatives, the emancipation of slaves, Allah's path, travellers. The narrator Bishr added: "and guests". Then the agreed version goes: No sin being committed by the one who administers it if he eats something from it in a reasonable manner, or gives something to a friend, who does not make his own property. The narrator Bishr added: "(provided) he is not storing-up goods (for himself)". (Using translation from Abū Dāʾūd 2878)
أَصَابَ عُمَرُ ؓ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ فَقَالَ إِنِّي أَصَبْتُ أَرْضًا لَمْ أُصِبْ مَالًا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ فَكَيْفَ تَأْمُرُنِي؟ قَالَ إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا فَتَصَدَّقَ بِهَا عُمَرُ أَنْ لَا يُبَاعَ أَصْلُهَا وَلَا يُورَثَ وَلَا يُوهَبَ لِلْفُقَرَاءِ وَالْقُرْبَى وَالرِّقَابِ وَفِي سَبِيلِ اللهِ وَالضَّيْفِ وَابْنِ السَّبِيلِ وَلَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ
Umar bin Khattab got some land in Khaibar and he went to the Prophet ﷺ to consult him about it saying, "O Messenger of Allah ﷺ I got some land in Khaibar better than which I have never had, what do you suggest that I do with it?" The Prophet ﷺ said, "If you like you can give the land as endowment and give its fruits in charity." So ʿUmar gave it in charity as an endowment on the condition that would not be sold nor given to anybody as a present and not to be inherited, but its yield would be given in charity to the poor people, to the Kith and kin, for freeing slaves, for Allah's Cause, to the travelers and guests; and that there would be no harm if the guardian of the endowment ate from it according to his need with good intention, and fed others without storing it for the future." أَصَابَ عُمَرُ ؓ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ يَسْتَأْمِرُهُ فِيهَا فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ مَالًا قَطُّ هُوَ أَنْفَسُ عِنْدِي مِنْهُ فَمَا تَأْمُرُ بِهِ؟ فَقَالَ إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا قَالَ فَتَصَدَّقَ بِهَا عُمَرُ أَنْ لَا يُبَاعَ أَصْلُهَا وَلَا يُورَثَ وَلَا يُوهَبَ قَالَ فَتَصَدَّقَ عُمَرُ فِي الْفُقَرَاءِ وَفِي الْقُرْبَى وَالرِّقَابِ وَفِي سَبِيلِ اللهِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ وَيُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ قَالَ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ مُحَمَّدًا فَلَمَّا بَلَغْتُ هَذَا الْمَكَانَ غَيْرَ مُتَمَوِّلٍ مَالًا قَالَ مُحَمَّدٌ غَيْرَ مُتَأَثِّلٍ مَالًا قَالَ ابْنُ عَوْنٍ وَأَخْبَرَنِي مَنْ قَرَأَ هَذَا الْكِتَابَ أَنَّ فِيهِ غَيْرَ مُتَأَثِّلٍ مَالًا
[Machine] I acquired land from Khaybar, which I have not acquired any wealth equivalent to it. So, I went to the Messenger of Allah ﷺ seeking his guidance. I said, "O Messenger of Allah, I have acquired land from Khaybar that I have not acquired any wealth equivalent to. He said, 'If you wish, you can keep its original state and donate it. So, Umar (may Allah be pleased with him) donated it, stipulating that it should not be sold, given as a gift, or inherited. He said, 'Donate it to the poor, close relatives, in the way of Allah, in the freeing of slaves, and to the wayfarer. There is no blame on anyone who is its guardian and eats from it in a good way and gives in a good way, without being extravagant.' Ibn Awun said, 'And I mentioned it to Ibn Sirin, and he said, 'Without being a hoarder of wealth.'
أَصَبْتُ أَرْضًا مِنْ خَيْبَرَ مَا أَصَبْتُ مَالًا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ فَأَتَيْتُ رَسُولَ اللهِ ﷺ أَسْتَأْمِرُهُ فَقُلْتُ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ أَرْضًا مِنْ خَيْبَرَ مَا أَصَبْتُ مَالًا أَنْفَسَ عِنْدِي مِنْهُ قَالَ إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا فَتَصَدَّقَ بِهَا عُمَرُ عَلَى أَنْ لَا تُبَاعَ وَلَا تُوهَبَ وَلَا تُورَثَ قَالَ فَتَصَدَّقَ بِهَا فِي الْفُقَرَاءِ وَالْأَقْرَبِينَ وَفِي سَبِيلِ اللهِ وَفِي الرِّقَابِ وَابْنِ السَّبِيلِ وَفِي الضَّيْفِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا يَأْكُلُ بِالْمَعْرُوفِ وَيُعْطِي بِالْمَعْرُوفِ صَدِيقًا غَيْرَ مُتَمَوِّلٍ قَالَ ابْنُ عَوْنٍ فَذَكَرْتُهُ لِابْنِ سِيرِينَ فَقَالَ غَيْرَ مُتَأَثِّلٍ مَالًا
[Machine] Umar said, "O Messenger of Allah, I acquired wealth from the battle of Khaybar that I have never acquired before and I hold dear to me. He said to him, "If you wish, you can give it in charity, and if you wish, you can keep its capital intact." Umar then gave it in charity to the weak, the poor, and the travelers, stating that there is no harm for anyone who is entrusted with wealth to eat from it or feed a friend who is not financially supported with it, either as a gift or as a loan. This narration is also reported by Yunus ibn Muhammad, Hammad, Ayyub, and Yazid ibn Zurai in a chain narrated by Hammad, and Bukhari has also reported it through Qutaybah from Hammad.
قَالَ عُمَرُ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ مَالًا بِخَيْبَرَ لَمْ أُصِبْ مَالًا قَطُّ أَحَبَّ إِلِيَّ مِنْهُ فَقَالَ لَهُ إِنْ شِئْتَ تَصَدَّقْتَ بِهِ وَإِنْ شِئْتَ أَمْسَكْتَ أَصْلَهُ قَالَ فَتَصَدَّقَ بِهِ عُمَرُ ؓ عَلَى الضُّعَفَاءِ وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ مَالًا أَوْ مُتَأَثِّلٍ مِنْهُ مَالًا وَكَذَلِكَ رُوِيَ عَنْ يُونُسَ بْنِ مُحَمَّدٍ عَنْ حَمَّادٍ عَنْ أَيُّوبَ وَعَنْ يَزِيدَ بْنِ زُرَيْعٍ عَنْ أَيُّوبَ وَأَرْسَلَهُ جَمَاعَةٌ عَنْ حَمَّادٍ وَأَخْرَجَ الْبُخَارِيُّ آخِرَهُ عَنْ قُتَيْبَةَ عَنْ حَمَّادٍ مَوْصُولًا
In the lifetime of Messenger of Allah ﷺ , ʿUmar gave in charity some of his property, a garden of date-palms called Thamgh. ʿUmar said, "O Messenger of Allah ﷺ! I have some property which I prize highly and I want to give it in charity." The Prophet; said, "Give it in charity (i.e. as an endowment) with its land and trees on the condition that the land and trees will neither be sold nor given as a present, nor bequeathed, but the fruits are to be spent in charity." So ʿUmar gave it in charity, and it was for Allah's Cause, the emancipation of slaves, for the poor, for guests, for travelers, and for kinsmen. The person acting as its administrator could eat from it reasonably and fairly, and could let a friend of his eat from it provided he had no intention of becoming wealthy by its means. أَنَّ عُمَرَ ؓ تَصَدَّقَ بِمَالٍ لَهُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَكَانَ يُقَالُ لَهُ ثَمْغٌ وَكَانَ نَخْلًا فَقَالَ عُمَرُ ؓ يَا رَسُولَ اللهِ إِنِّي اسْتَفَدْتُ مَالًا وَهُوَ عِنْدِي نَفِيسٌ فَأَرَدْتُ أَنْ أَتَصَدَّقَ بِهِ فَقَالَ النَّبِيُّ ﷺ تَصَدَّقْ بِأَصْلِهِ لَا يُبَاعُ وَلَا يُوهَبُ وَلَا يُورَثُ وَلَكِنْ يُنْفَقُ ثَمَرُهُ فَتَصَدَّقَ بِهِ عُمَرُ فَصَدَقَتُهُ ذَلِكَ فِي سَبِيلِ اللهِ وَفِي الرِّقَابِ وَالْمَسَاكِينِ وَالضَّيْفِ وَابْنِ السَّبِيلِ وَلِذِي الْقُرْبَى وَلَا جُنَاحَ عَلَى مَنْ وَلِيَه أَنْ يَأْكُلَ مِنْهُ بِالْمَعْرُوفِ أَوْ يُؤْكِلَ صَدِيقَهُ غَيْرَ مُتَمَوِّلٍ بِهِ
[Machine] That Umar consulted the Messenger of Allah ﷺ about whether he should give in charity with his wealth that is worth a deenar, and the Prophet ﷺ said to him, "Give charity with it, but keep the principal, it cannot be sold or inherited." Abu Al-Husayn ibn Bishran Al-Adl from Baghdad narrated to us, Abu Al-Hasan Ali ibn Muhammad Al-Misri dictated to us, Muhammad ibn Al-Rabi'i ibn Bilal narrated to us, Haramalah ibn Yahya and Ahmad ibn Abi Bakr said, Ibn Wahb informed me, Ibrahim ibn Saad narrated to me from Abdul Aziz ibn Al-Muttalib from Yahya ibn Sa'id, and he mentioned it.
أَنَّ عُمَرَ اسْتَشَارَ رَسُولَ اللهِ ﷺ فِي أَنْ يَتَصَدَّقَ بِمَالِهِ الَّذِي بِثَمْغٍ فَقَالَ لَهُ النَّبِيُّ ﷺ تَصَدَّقْ بِثَمَرِهِ وَاحْبِسْ أَصْلَهُ لَا يُبَاعُ وَلَا يُورَثُ أَخْبَرَنَاهُ أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ ثنا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ إِمْلَاءً ثنا مُحَمَّدُ بْنُ الرَّبِيعِ بْنِ بِلَالٍ ثنا حَرْمَلَةُ بْنُ يَحْيَى وَأَحْمَدُ بْنُ أَبِي بَكْرٍ قَالَا ثنا ابْنُ وَهْبٍ أَخْبَرَنِي إِبْرَاهِيمُ بْنُ سَعْدٍ عَنْ عَبْدِ الْعَزِيزِ بْنِ الْمُطَّلِبِ عَنْ يَحْيَى بْنِ سَعِيدٍ فَذَكَرَهُ
[Machine] That to Hafsah, wherever she spends her wealth, God will see it. And if she passes away, it will go to her family member with good judgment. Its root will never be sold or handed over. And whoever is in charge of it, there is no harm for him in its fruit, whether he eats it or feeds it to a friend without expecting any payment. Whatever is forgiven from its fruit is for the asker, the forbidden, the guest, the relatives, the traveler, and in the way of God, wherever God sees fit. And if it passes away, it will go to my family member and the water carrier who fed me, Muhammad, the Messenger of God, in the valley with his own hands, I did not destroy it, as it is part of his traditions that I ordered. And if the water carrier wishes, he can buy something delicate from its fruit for his work and keep records. And Abdullah ibn al-Arqam testified, "In the name of Allah, the Most Gracious, the Most Merciful, this is what Abdullah Umar, the Commander of the Faithful, advised. If something happens to it, then 100 camel, and the servant who is with it, and the 100 arrows that are in Khaybar, and its delicate fruit, and the 100 (meaning water carrier) the one whom Muhammad, the Messenger of God, fed, and then Hafsah, wherever she is, and then the family member with good judgment, it will not be sold or bought. It will be spent wherever she sees fit for the asker, the forbidden, the relatives, and there is no harm for the one in charge if he eats it, feeds it, or buys something delicate from it."
أَنَّهُ إِلَى حَفْصَةَ مَا عَاشَتْ تُنْفِقُ ثَمَرَهُ حَيْثُ أَرَاهَا اللهُ فَإِنْ تُوُفِّيَتْ فَإِنَّهُ إِلَى ذِي الرَّأْيِ مِنْ أَهْلِهَا لَا يُشْرَى أَصْلُهُ أَبَدًا وَلَا يُوهَبُ وَمَنْ وَلِيَهُ فَلَا حَرَجَ عَلَيْهِ فِي ثَمَرِهِ إِنْ أَكَلَ أَوْ أَكَّلَ صَدِيقًا غَيْرَ مُتَأَثِّلٍ مَالًا فَمَا عَفَا عَنْهُ مِنْ ثَمَرِهِ فَهُوَ لِلسَّائِلِ وَالْمَحْرُومِ وَالضَّيْفِ وَذَوِي الْقُرْبَى وَابْنِ السَّبِيلِ وَفِي سَبِيلِ اللهِ تُنْفِقُهُ حَيْثُ أَرَاهَا اللهُ مِنْ ذَلِكَ فَإِنْ تُوُفِّيَتْ فَإِلَى ذِي الرَّأْيِ مِنْ وَلَدِي وَالْمِائَةُ الْوَسْقِ الَّذِي أَطْعَمَنِي مُحَمَّدٌ رَسُولُ اللهِ ﷺ بِالْوَادِي بِيَدِي لَمْ أُهْلِكْهَا فَإِنَّهُ مَعَ ثَمْغٍ عَلَى سُنَنِهِ الَّتِي أَمَرْتُ بِهَا وَإِنْ شَاءَ وَلِيُّ ثَمْغٍ اشْتَرَى مِنْ ثَمَرِهِ رَقِيقًا لِعَمَلِهِ وَكَتَبَ مُعَيْقِيبٌ وَشَهِدَ عَبْدُ اللهِ بْنُ الْأَرْقَمِ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا أَوْصَى بِهِ عَبْدُ اللهِ عُمَرُ أَمِيرُ الْمُؤْمِنِينَ إِنْ حَدَثَ بِهِ حَدَثٌ أَنَّ ثَمْغًا وَصِرْمَةَ بْنَ الْأَكْوَعِ وَالْعَبْدَ الَّذِي فِيهِ وَالْمِائَةَ السَّهْمِ الَّذِي بِخَيْبَرَ وَرَقِيقَهُ الَّذِي فِيهِ وَالْمِائَةَ يَعْنِي الْوَسْقَ الَّذِي أَطْعَمَهُ مُحَمَّدٌ رَسُولُ اللهِ ﷺ تَلِيهِ حَفْصَةُ مَا عَاشَتْ ثُمَّ يَلِيهِ ذُو الرَّأْيِ مِنْ أَهْلِهَا لَا يُبَاعُ وَلَا يُشْتَرَى يُنْفِقُهُ حَيْثُ رَأَى مِنَ السَّائِلِ وَالْمَحْرُومِ وَذَوِي الْقُرْبَى وَلَا حَرَجَ عَلَى وَلِيِّهِ إِنْ أَكَلَ أَوْ أَكَّلَ أَوِ اشْتَرَى لَهُ رَقِيقًا مِنْهُ
The Prophet ﷺ did not leave behind him after his death, anything except his arms, his white mule, and a piece of land at Khaibar which he left to be given in charity . (Using translation from Bukhārī 2912)
لَمْ يَتْرُكْ رَسُولُ اللهِ ﷺ إِلَّا بَغْلَةً بَيْضَاءَ وَسِلَاحًا وَأَرْضًا جَعَلَهَا صَدَقَةً
[Machine] Amr ibn al-Harith, the brother of the Prophet's wife, narrated: "By Allah, the Messenger of Allah did not leave behind a dinar, a dirham, a slave, a maid, or anything except for his white mule, his weapons, and a piece of land that he left as charity."
عَنْ عَمْرِو بْنِ الْحَارِثِ خَتَنِ رَسُولِ اللهِ ﷺ أَخِي امْرَأَتِهِ قَالَ وَاللهِ مَا تَرَكَ رَسُولُ اللهِ ﷺ دِينَارًا وَلَا دِرْهَمًا وَلَا عَبْدًا وَلَا أَمَةً وَلَا شَيْئًا إِلَّا بَغْلَتَهُ الْبَيْضَاءَ وَسِلَاحَهُ وَأَرْضًا تَرَكَهَا صَدَقَةً
[Machine] The Messenger of Allah ﷺ built seven walls in the city as charity for the Banu Abdi'l-Muttalib and Banu Hashim.
رَسُولَ اللهِ ﷺ جَعَلَ سَبْعَ حِيطَانٍ لَهُ بِالْمَدِينَةِ صَدَقَةً عَلَى بَنِي عَبْدِ الْمُطَّلِبِ وَبَنِي هَاشِمٍ
[Machine] "And give a portion of it to the poor and the needy, and in the way of Allah, and to the wayfarer. That is a duty enjoined by Allah. And whatever good you give in charity, Allah is fully aware of it. It is He who causes the faces of some to be white and others to be black on the Day of Resurrection. And then He will turn His face towards them and protect them from the Fire, and admit them to Gardens wherein streams flow. This is the great success. And narrated to us from another face, from Abu Ja'far, that Umar and Ali stood on a piece of land that belongs to them."
الْوَارِثَ ثُمَّ تَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَالْمَسَاكِينِ وَفِي سَبِيلِ اللهِ وَابْنِ السَّبِيلِ الْقَرِيبِ وَالْبَعِيدِ وَفِي السِّلْمِ وَفِي الْحَرْبِ لِيَوْمٍ تَبْيَضُّ وُجُوهٌ وَتَسْوَدُّ وُجُوهٌ؛ لِيَصْرِفَ اللهُ تَعَالَى بِهَا وَجْهِي عَنِ النَّارِ وَيَصْرِفَ النَّارَ عَنْ وَجْهِي وَرُوِّينَا مِنْ وَجْهٍ آخَرَ عَنْ أَبِي جَعْفَرٍ أَنَّ عُمَرَ وَعَلِيًّا ؓ وَقَفَا أَرْضًا لَهُمَا بِتَابَتَلَا
[Machine] That Fatimah, the daughter of the messenger of Allah ﷺ , donated from her wealth to the Banu Hashim and the Banu Muttalib, and that Ali also donated to them and brought others with him.
أَنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللهِ ﷺ تَصَدَّقَتْ بِمَالِهَا عَلَى بَنِي هَاشِمٍ وَبَنِي الْمُطَّلِبِ وَأَنَّ عَلِيًّا ؓ تَصَدَّقَ عَلَيْهِمْ وَأَدْخَلَ مَعَهُمْ غَيْرَهُمْ
[Machine] Zaid ibn Thabit used to live in a house near the mosque, where he was confined until he died. Abdullah ibn Umar also did the same by confining his house, where he used to live in it.
وَكَانَ زَيْدُ بْنُ ثَابِتٍ ؓ يَسْكُنُ مَنْزِلًا فِي دَارِهِ الَّتِي حَبَسَ عِنْدَ الْمَسْجِدِ حَتَّى مَاتَ فِيهِ وَقَدْ كَانَ عَبْدُ اللهِ بْنُ عُمَرَ ؓ فَعَلَ ذَلِكَ حَبَسَ دَارَهُ وَكَانَ يَسْكُنُ مَسْكَنًا فِيهَا
[Machine] Abu Bakr, Umar, Zubayr, Uthman, Amr ibn al-Aas, and Hakim ibn Hizam intentionally do something that people see as lawful and equal, so they give it in charity to their children without their owners alongside them.
يَعْمِدُ أَبُو بَكْرٍ وَعُمَرُ وَالزُّبَيْرُ وَعُثْمَانُ وَعَمْرُو بْنُ الْعَاصِ وَحَكِيمُ بْنُ حِزَامٍ ؓ إِلَى شَيْءٍ النَّاسُ فِيهِ شُرَّعٌ سَوَاءٌ فَيَتَصَدَّقُونَ بِهِ عَلَى أَوْلَادِهِمْ دُونَ مَالِكِيهِ مَعَهُمْ
[Machine] He settled in a house in the city, so whenever he performed Hajj, he would pass by the city and stay in his house.
أَنَّهُ وَقَفَ دَارًا بِالْمَدِينَةِ فَكَانَ إِذَا حَجَّ مَرَّ بِالْمَدِينَةِ فَنَزَلَ دَارَهُ
31.2 [Machine] The prohibited form of charity, even if it is not accepted.
٣١۔٢ بَابُ جَوَازِ الصَّدَقَةِ الْمُحَرَّمَةِ وَإِنْ لَمْ تُقْبَضْ
[Machine] Umar owned some land in Khaibar, so he went to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I acquired some land in Khaibar and I have never acquired any wealth that is more precious to me than it. What do you command me to do with it?" The Messenger of Allah ﷺ said, "If you wish, you may give it as charity and retain its original ownership. Umar then made it such that it could neither be sold, gifted nor inherited, but would be given in charity to the poor, the needy, the wayfarer, for the cause of Allah, for freeing slaves. There is no harm for the one who has control over it to eat from it according to what is known to be fair and to feed others without being sponsored by it. Then he designated it to be given as charity to Hafsah bint Umar, and then to the older members of the family of Umar." Al-Shafi'i, in his book Al-Bahira, reported to me by more than one of the family of Umar and Ali, that Umar remained the guardian of his charity until he died and then he designated it to Hafsah. Ali was the guardian of his charity until he died and then it was entrusted to his son, Hasan bin Ali. Fatimah bint Rasul Allah ﷺ was the guardian of her charity until she died. It has been conveyed to me by more than one of the Ansar that they were the guardians of their charity until they died. And it was known from the ancients that Az-Zubair was the guardian of his charity until Allah took him, and Amr bin al-'As was the guardian of his charity until Allah took him, and Al-Miswar bin Makhramah was the guardian of his charity until Allah took him.
عُمَرُ أَرْضًا بِخَيْبَرَ فَأَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ وَاللهِ مَا أَصَبْتُ مَالًا قَطُّ هُوَ أَنْفَسُ عِنْدِي مِنْهَا فَمَا تَأْمُرُنِي؟ قَالَ إِنْ شِئْتَ تَصَدَّقْتَ بِهَا وَحَبَسْتَ أَصْلَهَا فَجَعَلَهَا عُمَرُ أَنْ لَا تُبَاعَ وَلَا تُوهَبَ وَلَا تُورَثَ وَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَالْمَسَاكِينِ وَابْنِ السَّبِيلِ وَفِي سَبِيلِ اللهِ وَالرِّقَابِ وَلَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ وَيُطْعِمَ مِنْهَا غَيْرَ مُتَمَوِّلٍ فِيهِ ثُمَّ أَوْصَى بِهِ إِلَى حَفْصَةَ بِنْتِ عُمَرَ ؓ ثُمَّ إِلَى الْأَكَابِرِ مِنْ آلِ عُمَرَ قَالَ الشَّافِعِيُّ فِي كِتَابِ الْبَحِيرَةِ أَخْبَرَنِي غَيْرُ وَاحِدٍ مِنْ آلِ عُمَرَ وَآلِ عَلِيٍّ أَنَّ عُمَرَ وَلِيَ صَدَقَتَهُ حَتَّى مَاتَ وَجَعَلَهَا بَعْدَهُ إِلَى حَفْصَةَ وَإِنَّ عَلِيًّا وَلِيَ صَدَقَتَهُ حَتَّى مَاتَ وَوَلِيَهَا بَعْدَهُ حَسَنُ بْنُ عَلِيٍّ وَإِنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللهِ ﷺ وَلِيَتْ صَدَقَتَهَا حَتَّى مَاتَتْ وَبَلَغَنِي عَنْ غَيْرِ وَاحِدٍ مِنَ الْأَنْصَارِ أَنَّهُ وَلِيَ صَدَقَتَهُ حَتَّى مَاتَ قَالَ فِي الْقَدِيمِ وَوَلِيَ الزُّبَيْرُ صَدَقَتَهُ حَتَّى قَبَضَهُ اللهُ وَوَلِيَ عَمْرُو بْنُ الْعَاصِ صَدَقَتَهُ حَتَّى قَبْضَهُ اللهُ وَوَلِيَ الْمِسْوَرُ بْنُ مَخْرَمَةَ صَدَقَتَهُ حَتَّى قَبَضَهُ اللهُ
[Machine] Abdullah bin Mas'ood said, "There are four things that a person should focus on: their character, their actions, their sustenance, and their time of death. No one can excel over another in these areas. As for charity, it can be given or not given."
قَالَ عَبْدُ اللهِ بْنُ مَسْعُودٍ فُرِغَ مِنْ أَرْبَعٍ مِنَ الْخَلْقِ وَالْخُلُقِ وَالرِّزْقِ وَالْأَجَلِ فَلَيْسَ أَحَدٌ أَكْسَبَ مِنْ أَحَدٍ وَالصَّدَقَةُ جَائِزَةٌ قُبِضَتْ أَوْ لَمْ تُقْبَضْ
31.3 [Machine] Endowment of the common
٣١۔٣ بَابُ وَقْفِ الْمُشَاعِ
"Umar came to the Messenger of Allah and said: 'O Messenger of Allah, I have acquired some wealth the like of which I have never acquired before. I had one hundred head (of livestock) with which I bought one hundred shares of Khaibar from its people. I wanted to draw closer to Allah, the Mighty and Sublime, by means of it.' He said: 'Freeze it and donate its fruits.'" (Using translation from Nasāʾī 3604)
أَنَّ عُمَرَ مَلَكَ مِائَةَ سَهْمٍ مِنْ خَيْبَرَ اشْتَرَاهَا فَأَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ مَالًا لَمْ أُصِبْ مِثْلَهُ قَطُّ وَقَدْ أَرَدْتُ أَنْ أَتَقَرَّبَ بِهِ إِلَى اللهِ ﷻ فَقَالَ حَبْسُ الْأَصْلِ وَسَبْلُ الثَّمَرَةِ
[Machine] "O Messenger of Allah, I have obtained wealth that I have never obtained before, equivalent to one hundred camels that were acquired from the Battle of Khaybar. And I intended to use it as a means of getting closer to Allah the Almighty." The Messenger of Allah ﷺ replied, "The basis is withheld, but the fruit can be spent." Abu Yahya As-Saji narrated that it was mentioned that Al-Hasan and Al-Husain stood in front of one of these branches and cut it. The scholars permitted it, and Ibn 'Umar gave the arrows in the forest that Hafsah had gifted to him in charity."
يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ مَالًا لَمْ أُصِبْ قَطُّ مِثْلَهُ تَخَلَّصْتُ الْمِائَةَ سَهْمٍ الَّتِي بِخَيْبَرَ وَإِنِّي قَدْ أَرَدْتُ أَنْ أَتَقَرَّبَ بِهَا إِلَى اللهِ تَعَالَى فَقَالَ لَهُ رَسُولُ اللهِ ﷺ حَبْسُ الْأَصْلِ وَسَبْلُ الثَّمَرَةِ قَالَ أَبُو يَحْيَى السَّاجِيِّ وَرُوِيَ أَنَّ الْحَسَنَ وَالْحُسَيْنَ وَقَفَ أَحَدَهُمَا أَشْقَاصًا مِنْ دُورِهِ فَأَجَازَ ذَلِكَ الْعُلَمَاءُ وَتَصَدَّقَ ابْنُ عُمَرَ بِالسَّهْمِ بِالْغَابَةِ الَّذِي وَهَبَتْ لَهُ حَفْصَةُ
31.4 [Machine] Who said: "No restriction on the obligations of Allah?".
٣١۔٤ بَابُ مَنْ قَالَ: لَا حَبْسَ عَنْ فَرَائِضِ اللهِ ﷻ
[Machine] The Messenger of Allah ﷺ said, "There is no stopping after Surah An-Nisa."
قَالَ رَسُولُ اللهِ ﷺ لَا حَبْسَ بَعْدَ سُورَةِ النِّسَاءِ
[Machine] I heard the Messenger of Allah ﷺ saying after Surah An-Nisa was revealed and the obligations were prescribed in it, he said, "There is no restriction after Surah An-Nisa."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ بَعْدَمَا أُنْزِلَتْ سُورَةُ النِّسَاءِ وَفُرِضَ فِيهَا الْفَرَائِضُ يَقُولُ لَا حَبْسَ بَعْدَ سُورَةِ النِّسَاءِ
[Machine] The Messenger of Allah ﷺ said, "There should be no restriction on the obligations of Allah." Ali, may Allah have mercy on him, said, "It has only been narrated by Ibn Lahah from his brother, and they are both weak." The sheikh said, "And this wording is only known from the statement of Shurayh the judge."
قَالَ رَسُولُ اللهِ ﷺ لَا حَبْسَ عَنْ فَرَائِضِ اللهِ قَالَ عَلِيٌّ رَحِمَهُ اللهُ لَمْ يُسْنِدْهُ غَيْرُ ابْنِ لَهِيعَةَ عَنْ أَخِيهِ وَهُمَا ضَعِيفَانِ قَالَ الشَّيْخُ وَهَذَا اللَّفْظُ إِنَّمَا يُعْرَفُ مِنْ قَوْلِ شُرَيْحٍ الْقَاضِي
[Machine] I said, "By Allah, I did not come seeking conflict, but rather, a man from this neighborhood has made his house a prison." Ata' said, "Then he entered through the door of the mosque into the enclosure, and I followed him, hearing him say it to his beloved friend who brings his opponents to him, 'Inform the man that there should be no hindrance to the obligations of Allah.'"
فَقُلْتُ إِنِّي وَاللهِ مَا جِئْتُ أُرِيدُ خُصُومَةً إِنَّ رَجُلًا مِنَ الْحِيِّ جَعَلَ دَارَهُ حَبْسًا قَالَ عَطَاءٌ فَدَخَلَ مِنَ الْبَابِ الَّذِي فِي الْمَسْجِدِ فِي الْمَقْصُورَةِ فَسَمِعْتُهُ حِينَ دَخَلَ وَتَبِعْتُهُ وَهُوَ يَقُولُهُ لِحَبِيبٍ الَّذِي يُقَدِّمُ الْخُصُومَ إِلَيْهِ أَخْبِرِ الرَّجُلَ أَنَّهُ لَا حَبْسَ عَنْ فَرَائِضِ اللهِ ﷻ
[Machine] Muhammad ﷺ came with the prohibition of imprisonment.
جَاءَ مُحَمَّدٌ ﷺ بِمَنْعِ الْحَبْسِ
[Machine] Malik said that the confinement that Muhammad ﷺ brought includes anything mentioned in the book of Allah (Quran) such as livestock, grains, slaves, and camels, as stated in verse 103 of Surah Al-Maidah. Muhammad bin Abdullah informed Abu Yusuf about this when he was with the Commander of the Believers.
مَالِكٌ الْحَبْسُ الَّذِي جَاءَ مُحَمَّدٌ ﷺ بِإِطْلَاقِهِ هُوَ الَّذِي فِي كِتَابِ اللهِ {مَا جَعَلَ اللهُ مِنْ بَحِيرَةٍ وَلَا سَائِبَةٍ وَلَا وَصِيلَةٍ وَلَا حَامٍ} [المائدة 103] قَالَ مُحَمَّدُ بْنُ عَبْدِ اللهِ كَلَّمَ بِهِ مَالِكٌ أَبَا يُوسُفَ عِنْدَ أَمِيرِ الْمُؤْمِنِينَ
[Machine] I heard Ash-Shafi'i saying that Malik and Abu Yusuf gathered before the Commander of the Believers and they talked about al-wuquf (the act of standing) and what restrains people from it. Ya'qub said, "This is false." Shurayh said, "Muhammad ﷺ came with the complete abolition of restraint." Malik said, "Muhammad ﷺ came with the abolition of what they used to restrain for their idols, such as al-bahirah (sacrificial animal set free to roam) and as-sa'ibah (camel released for idols while they perform Hajj)." As for al-wuquf, this is the act of 'Umar ibn al-Khattab (may Allah be pleased with him) when he sought permission from the Prophet ﷺ who said, "Restrain its trunk and let its fruit fall." And this is the act of az-Zubayr. The Caliph was amazed by that, and Ya'qub remained unconvinced.
سَمِعْتُ الشَّافِعِيَّ يَقُولُ اجْتَمَعَ مَالِكٌ وَأَبُو يُوسُفَ عِنْدَ أَمِيرِ الْمُؤْمِنِينَ فَتَكَلَّمَا فِي الْوُقُوفِ وَمَا يَحْبِسُهُ النَّاسُ فَقَالَ يَعْقُوبُ هَذَا بَاطِلٌ قَالَ شُرَيْحٌ جَاءَ مُحَمَّدٌ ﷺ بِإِطْلَاقِ الْحَبْسِ فَقَالَ مَالِكٌ إِنَّمَا جَاءَ مُحَمَّدٌ ﷺ بِإِطْلَاقِ مَا كَانُوا يَحْبِسُونَهُ لِآلِهَتِهِمْ مِنَ الْبَحِيرَةِ وَالسَّائِبَةِ فَأَمَّا الْوُقُوفُ فَهَذَا وَقْفُ عُمَرَ بْنِ الْخَطَّابِ ؓ حَيْثُ اسْتَأْذَنَ النَّبِيَّ ﷺ فَقَالَ احْبِسْ أَصْلَهَا وَسَبِّلْ ثَمَرَتَهَا وَهَذَا وَقْفُ الزُّبَيْرِ فَأَعْجَبَ الْخَلِيفَةَ ذَلِكَ مِنْهُ وَبَقِيَ يَعْقُوبُ
[Machine] He (someone) came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, this wall of mine is a charity, and it belongs to Allah and His Messenger." Then his parents came and said, "O Messenger of Allah, it was the means of our livelihood." So the Messenger of Allah ﷺ returned it to them. Then they passed away, and their son inherited it. After this, Abu Bakr bin Hazm was appointed as a messenger. Abdullah bin Zaid did not meet him, and it has been narrated from other sources that he (Abdullah bin Zaid) broke (his connection) with all of them. This hadith is also mentioned in relation to continuous charity, as if he (the son) had given it as voluntary charity and left the choice of its disposal to the Messenger of Allah ﷺ , so the Messenger of Allah ﷺ gave it as charity on behalf of his parents.
أَنَّهُ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ حَائِطِي هَذَا صَدَقَةٌ وَهُوَ إِلَى اللهِ وَرَسُولِهِ فَجَاءَ أَبَوَاهُ فَقَالَا يَا رَسُولَ اللهِ كَانَ قِوَامَ عَيْشِنَا فَرَدَّهُ رَسُولُ اللهِ ﷺ إِلَيْهِمَا ثُمَّ مَاتَا فَوَرِثَهُمَا ابْنُهُمَا بَعْدُ هَذَا مُرْسَلٌ أَبُو بَكْرِ بْنُ حَزْمٍ لَمْ يُدْرِكْ عَبْدَ اللهِ بْنَ زَيْدٍ وَرُوِيَ مِنْ أَوْجُهٍ أُخَرَ عَنْ عَبْدِ اللهِ بْنِ زَيْدٍ كُلُّهُنَّ مَرَاسِيلُ وَالْحَدِيثُ وَارِدٌ فِي الصَّدَقَةِ الْمُنْقَطِعَةِ وَكَأَنَّهُ تَصَدَّقَ بِهِ صَدَقَةَ تَطَوُّعٍ وَجَعَلَ مَصْرَفَهَا إِلَى اخْتِيَارِ رَسُولِ اللهِ ﷺ فَتَصَدَّقَ بِهَا رَسُولُ اللهِ ﷺ عَلَى أَبَوَيْهِ
31.5 [Machine] What came in the lake, paddle boat, ferry, and train?
٣١۔٥ بَابُ مَا جَاءَ فِي الْبَحِيرَةِ وَالسَّائِبَةِ وَالْوَصِيلَةِ وَالْحَامِ
[Machine] I heard the Messenger of Allah ﷺ say, "I saw 'Amr Al-Khuza'i dragging his staff in the fire, and he was the first to introduce the practice of impaling the captives." Ibn Al-Musayyib said, "The 'Wasilah' is a female camel that gives birth to a female camel first, then it gives birth to another female camel afterwards. They used to impale it for their false deities and call it 'Al-Hamah.' When one was connected to the other, there was no male in between them." Ibn Al-Musayyib also said, "The male camel used to strike a limited number of times with his thighs. When he completed his number of strikes, he would be handed over to the false deities and they would absolve him from carrying anything. They called him 'Al-Ham'."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ رَأَيْتُ عَمْرًا الْخُزَاعِيَّ يَجُرُّ قُصْبَهُ فِي النَّارِ وَكَانَ أَوَّلَ مَنْ سَيَّبَ السَّوَائِبَ قَالَ ابْنُ الْمُسَيِّبِ وَالْوَصِيلَةُ النَّاقَةُ الْبِكْرُ تُبَكِّرُ فِي أَوَّلِ نِتَاجِ الْإِبِلِ بِالْأُنْثَى ثُمَّ تُثَنِّي بَعْدَ ذَلِكَ بِالْأُنْثَى وَكَانُوا يُسَيِّبُونَهَا لِطَوَاغِيتِهِمْ وَيَدْعُونَهَا الْوَصِيلَةَ؛ حِينَ وَصَلَتْ إِحْدَاهُمَا بِالْأُخْرَى لَيْسَ بَيْنَهُمَا ذَكَرٌ قَالَ ابْنُ الْمُسَيِّبِ وَالْحَامُ فَحْلُ الْإِبِلِ كَانَ يَضْرِبُ الضِّرَابَ الْمَعْدُودَ فَإِذَا قَضَى ضِرَابَهُ دَعَوْهُ لِلطَّوَاغِيتِ وَأَعْفَوْهُ مِنَ الْحَمْلِ فَلَمْ يَحْمِلُوا عَلَيْهِ شَيْئًا وَسَمَّوْهُ الْحَامَ
31.6 [Machine] Imprisonment in Slavery, Walking, and Animals
٣١۔٦ بَابُ الْحَبْسِ فِي الرَّقِيقِ وَالْمَاشِيَةِ وَالدَّابَّةِ
[Machine] The Messenger of Allah, ﷺ , sent Umar ibn Al-Khattab to collect charity. Ibn Jameel, Khalid ibn Al-Walid, and Al-Abbas refused to give charity. The Messenger of Allah, ﷺ , said, "Ibn Jameel will not face any consequences unless he is in need, and Allah will enrich him. As for Khalid, you have wronged him. He has dedicated his arms and effort in the path of Allah. As for Al-Abbas, he is my uncle, and the same applies to him." Then he asked, "Have you not heard that a man resembles his father or his paternal uncle?"
بَعَثَ رَسُولُ اللهِ ﷺ عُمَرَ بْنَ الْخَطَّابِ ؓ عَلَى الصَّدَقَةِ فَمَنَعَ ابْنُ جَمِيلٍ وَخَالِدُ بْنُ الْوَلِيدِ وَالْعَبَّاسُ فَقَالَ رَسُولُ اللهِ ﷺ مَا يَنْقِمُ ابْنُ جَمِيلٍ إِلَّا أَنْ كَانَ فَقِيرًا فَأَغْنَاهُ اللهُ وَأَمَّا خَالِدٌ فَإِنَّكُمْ تَظْلِمُونَ خَالِدًا؛ فَقَدِ احْتَبَسَ أَدْرَاعَهُ وَأَعْتَادَهُ فِي سَبِيلِ اللهِ وَأَمَّا الْعَبَّاسُ عَمُّ رَسُولِ اللهِ ﷺ فَهِيَ عَلَيَّ وَمِثْلُهَا ثُمَّ قَالَ أَمَا شَعَرْتَ أَنَّ عَمَّ الرَّجُلِ صِنْوُ الْأَبِ أَوْ صِنْوُ أَبِيهِ؟
[Machine] So a woman said to her husband, "Perform the Hajj pilgrimage with me alongside the Prophet ﷺ." He replied, "I do not have enough to perform the Hajj for both of us." She said, "Perform the Hajj pilgrimage for me using your camel, Fulan." He said, "That camel is reserved for the sake of Allah." She said, "Then perform the Hajj pilgrimage for me using your slave." He said, "That is reserved for me and our son." She said, "Then sell your date harvest." He said, "That is our sustenance and your sustenance." When the Messenger of Allah ﷺ arrived, she sent her husband to the Prophet ﷺ, saying, "Send him my greetings of peace and the mercy of Allah, and ask him if there is a lesser form of pilgrimage that I can perform with him." So her husband went to the Prophet ﷺ and said, "O Messenger of Allah, my wife sends you her greetings of peace and the mercy of Allah. She asked me to perform the Hajj pilgrimage for her, and I told her that I do not have enough to perform it for her." She said, "Perform the Hajj pilgrimage for me using your camel, Fulan." I said, "That is reserved for the sake of Allah." The Prophet ﷺ said, "If you had performed it for her, it would have been in the way of Allah." She said, "Then perform the Hajj pilgrimage for me using your slave." I said, "That is reserved for me and our son." She said, "Then sell your date harvest." At this, the Prophet ﷺ laughed at her eagerness for the Hajj pilgrimage. Ibrahim ibn Al-Hajjaj mentioned in his narration of this incident that the Prophet ﷺ laughed with amazement at her eagerness for the Hajj pilgrimage. He said, "She ordered me to ask you if there is a lesser form of Hajj that is equivalent to performing it with you." The Prophet ﷺ said, "Send her my greetings of peace and the mercy of Allah, and inform her that an 'Umrah pilgrimage during Ramadan is equivalent to performing the Hajj pilgrimage with me." The judge said, "That is how it happened."
فَقَالَتِ امْرَأَةٌ لِزَوْجِهَا حُجَّ بِي مَعَ النَّبِيِّ ﷺ قَالَ مَا عِنْدِي مَا أُحِجُّكِ عَلَيْهِ قَالَتْ أَحِجَّنِي عَلَى جَمَلِكَ فُلَانٍ قَالَ ذَاكَ حَبِيسُ فِي سَبِيلِ اللهِ قَالَتْ فَحُجَّ بِي عَلَى نَاضِحِكَ قَالَ ذَاكَ نَعْتَقِبُهُ أَنَا وَابْنُكِ قَالَتْ فَبِعْ ثَمَرَتَكَ قَالَ ذَاكَ قُوتِي وَقُوتِكِ فَلَمَّا قَدِمَ رَسُولُ اللهِ ﷺ أَرْسَلَتْ زَوْجَهَا إِلَى النَّبِيِّ ﷺ فَقَالَتْ أَقْرِئْهُ السَّلَامَ وَرَحْمَةَ اللهِ وَسَلْهُ مَا يَعْدِلُ حِجَّةً مَعَكَ؟ فَأَتَى زَوْجُهَا النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ امْرَأَتِي تُقْرِئُكَ السَّلَامَ وَرَحْمَةَ اللهِ إِنَّهَا سَأَلَتْنِي أُحِجُّهَا فَقُلْتُ مَا عِنْدِي مَا أُحِجُّكِ عَلَيْهِ فَقَالَتْ أَحِجَّنِي عَلَى جَمَلِكَ فُلَانٍ قُلْتُ ذَلِكَ حَبِيسٌ فِي سَبِيلِ اللهِ فَقَالَ النَّبِيُّ ﷺ لَوْ كُنْتَ أَحْجَجْتَهَا عَلَيْهِ كَانَ فِي سَبِيلِ اللهِ قَالَتْ فَأَحِجَّنِي عَلَى نَاضِحِكَ فَقُلْتُ ذَاكَ نَعْتَقِبُهُ أَنَا وَابْنُكِ قَالَتْ فَبِعْ ثَمَرَتَكَ فَضَحِكَ النَّبِيُّ ﷺ مِنْ حِرْصِهَا عَلَى الْحَجِّ وَقَالَ إِبْرَاهِيمُ بْنُ الْحَجَّاجِ فِي حَدِيثِهِ فَضَحِكَ النَّبِيُّ ﷺ عَجَبًا مِنْ حِرْصِهَا عَلَى الْحَجِّ قَالَ فَإِنَّهَا أَمَرَتْنِي أَنْ أَسْأَلَكَ مَا يَعْدِلُ حِجَّةً مَعَكَ؟ قَالَ أَقْرِئْهَا السَّلَامَ وَرَحْمَةَ اللهِ وَأَخْبِرْهَا أَنَّهَا تَعْدِلُ حَجَّةً مَعِي عُمْرَةٌ فِي رَمَضَانَ قَالَ الْقَاضِي هَكَذَا
31.7 [Machine] Charity towards relatives
٣١۔٧ بَابُ الصَّدَقَةِ فِي الْأَقْرَبِينَ
Abu Talha had the greatest wealth of date-palms amongst the Ansar in Medina, and he prized above all his wealth (his garden) Bairuha', which was situated opposite the Mosque (of the Prophet ﷺ ). The Prophet used to enter It and drink from its fresh water. When the following Divine Verse came:-- "By no means shall you attain piety until you spend of what you love," (3.92) Abu Talha got up saying. "O Messenger of Allah ﷺ! Allah says, 'You will not attain piety until you spend of what you love,' and I prize above al I my wealth, Bairuha' which I want to give in charity for Allah's Sake, hoping for its reward from Allah. So you can use it as Allah directs you." On that the Prophet ﷺ said, "Bravo! It is a profitable (or perishable) property. (Ibn Maslama is not sure as to which word is right, i.e. profitable or perishable.) I have heard what you have said, and I recommend that you distribute this amongst your relatives." On that Abu Talha said, "O Messenger of Allah ﷺ! I will do (as you have suggested)." So, Abu Talha distributed that garden amongst his relatives and cousins. (Using translation from Bukhārī 2769)
أَنَّهُ سَمِعَ أَنَسَ بْنَ مَالِكٍ يَقُولُ كَانَ أَبُو طَلْحَةَ أَكْثَرَ أَنْصَارِيٍّ بِالْمَدِينَةِ مَالًا مِنْ نَخْلٍ وَكَانَتْ أَحَبَّ أَمْوَالِهِ إِلَيْهِ بِئْرٌ تُسَمَّى بَيْرُحَاءَ وَكَانَتْ مُسْتَقْبِلَةَ الْمَسْجِدِ وَكَانَ رَسُولُ اللهِ ﷺ يَدْخُلُهَا وَيَشْرَبُ مِنْ مَاءٍ كَانَ فِيهَا طَيِّبٍ قَالَ أَنَسٌ فَلَمَّا نَزَلَتْ هَذِهِ الْآيَةُ {لَنْ تَنَالُوا الْبِرَّ حَتَّى تُنْفِقُوا مِمَّا تُحِبُّونَ} [آل عمران 92] قَالَ قَامَ أَبُو طَلْحَةَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ اللهَ يَقُولُ {لَنْ تَنَالُوا الْبِرَّ حَتَّى تُنْفِقُوا مِمَّا تُحِبُّونَ} [آل عمران 92] وَإِنَّ أَحَبَّ مَالِي إِلِيَّ بَيْرُحَاءُ وَإِنَّهَا صَدَقَةٌ للَّهِ أَرْجُو بِرَّهَا وَذُخْرَهَا عِنْدَ اللهِ فَضَعْهَا يَا رَسُولَ اللهِ حَيْثُ أَرَاكَ اللهُ فَقَالَ رَسُولُ اللهِ ﷺ ذَلِكَ مَالٌ رَائِحٌ وَقَدْ سَمِعْتُ مَا قُلْتَ وَإِنِّي أَرَى أَنْ تَجْعَلَهَا فِي الْأَقْرَبِينَ قَالَ أَبُو طَلْحَةَ أَفْعَلُ يَا رَسُولَ اللهِ فَقَسَمَهَا أَبُو طَلْحَةَ فِي أَقَارِبِهِ أَوْ بَنِي عَمِّهِ قَالَ إِسْمَاعِيلُ يَعْنِي بِالْمَالِ الرَّائِحِ الَّذِي يَغْدُو بِخَيْرٍ وَيَرُوحُ بِخَيْرٍ
Anas said When the verse “You will never attain righteousness until you give freely of what you love" came down, Abu Talhah said Messenger of Allah ﷺ, I think our Lord asks us for our property. I call you as witness that I dedicate my land at Ariha ‘to Him’. The Messenger of Allah ﷺ said to him Divide it among your nearest relatives. So he divided it among Hassan bin Thabit and Ubayy bin Ka’b. Abu Dawud said I have been gold by an Ansari Muhammad bin ‘Abdallah that the name of Abu Talhah is Zaid bin Sahal bin al-Aswad bin Haram bin ‘Amar bin Zaid bin Manat bin ‘Adi bin ‘Amr bin Malik bin al-Najjar; and Hassan bin Tabit is son of al-Mundhir in al-Haram. Thus both of them (Abu Talhah and Hassan) have their common link in Haram who is the third great grandfather. Ubbay bin Ka’b is son of Qais bin ‘Atik bin Zaid bin Mu’awiyah bin ‘Amr bin Malik bin al-Najjar. Thus the common tie between Hassan, Abu Talhah and Ubbay is ‘Amr (bin Malik). The Ansari said between Ubbay and Abi Talhah there are six great grandfathers. (Using translation from Abū Dāʾūd 1689)
لَمَّا نَزَلَتْ هَذِهِ الْآيَةُ {لَنْ تَنَالُوا الْبِرَّ حَتَّى تُنْفِقُوا مِمَّا تُحِبُّونَ} [آل عمران 92] قَالَ أَبُو طَلْحَةَ أَرَى رَبَّنَا يَسْأَلُنَا مِنْ أَمْوَالِنَا فَأُشْهِدُكَ يَا رَسُولَ اللهِ أَنِّي قَدْ جَعَلْتُ أَرْضِي بَيْرُحَاءَ لِلَّهِ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ اجْعَلْهَا فِي قَرَابَتِكَ قَالَ فَجَعَلَهَا فِي حَسَّانَ بْنِ ثَابِتٍ وَأُبِيِّ بْنِ كَعْبٍ
[Machine] And Abu Bakr Al-Siddiq said, in what he used as evidence against the Ansar on the day of Al-Saqifah, "Allah sent Muhammad ﷺ with guidance and the religion of truth. So the Messenger of Allah ﷺ invited to Islam, and Allah took hold of our hearts and bodies towards what he called us to. We, the Muhajireen, were the first to accept Islam, and we were his tribe and close relatives." Abu Abdullah Al-Hafiz narrated this to us, and Abu Ja'far Al-Baghdadi narrated it to us, and Muhammad ibn Amr ibn Khalid narrated it to us, and my father narrated it to me, from Ibn Lahe'ah, from Abu Al-Aswad, from Urwah ibn Al-Zubayr. And Abu Al-Husain ibn Al-Fadl informed us that Abu Bakr, Muhammad ibn Abdullah ibn Attab narrated it to us, and Al-Qasim ibn Abdullah narrated it to us, and Ibn Abi Uways narrated it to us, and Ismail ibn Ibrahim ibn Uqbah narrated it to us, from Musa ibn Uqbah. And Musa mentioned it from Abu Bakr. Additionally, Musa added in his narration, "and the one with the ties of kinship."
وَقَالَ أَبُو بَكْرٍ الصِّدِّيقُ ؓ فِيمَا يَحْتَجُّ بِهِ عَلَى الْأَنْصَارِ يَوْمَ السَّقِيفَةِ بَعَثَ اللهُ مُحَمَّدًا ﷺ بِالْهُدَى وَدِينِ الْحَقِّ فَدَعَا رَسُولُ اللهِ ﷺ إِلَى الْإِسْلَامِ فَأَخَذَ اللهُ بِقُلُوبِنَا وَنَوَاصِينَا إِلَى مَا دَعَا إِلَيْهِ وَكُنَّا مَعْشَرَ الْمُهَاجِرِينَ أَوَّلَ النَّاسِ إِسْلَامًا وَنَحْنُ عَشِيرَتُهُ وَأَقَارِبُهُ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو جَعْفَرٍ الْبَغْدَادِيُّ ثنا مُحَمَّدُ بْنُ عَمْرِو بْنِ خَالِدٍ ثنا أَبِي ثنا ابْنُ لَهِيعَةَ عَنْ أَبِي الْأَسْوَدِ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ ح وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ أنبأ أَبُو بَكْرٍ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَتَّابٍ ثنا الْقَاسِمُ بْنُ عَبْدِ اللهِ ثنا ابْنُ أَبِي أُوَيْسٍ ثنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ بْنِ عُقْبَةَ ثنا مُوسَى بْنُ عُقْبَةَ فَذَكَرَاهُ عَنْ أَبِي بَكْرٍ ؓ زَادَ مُوسَى فِي رِوَايَتِهِ وَذُو رَحِمِهِ
31.8 [Machine] Charity for Sons and Daughters and those who take the name of the child and son from them
٣١۔٨ بَابُ الصَّدَقَةِ فِي وَلَدِ الْبَنِينَ وَالْبَنَاتِ وَمَنْ تَنَاوَلَهُ اسْمُ الْوَلَدِ وَالِابْنِ مِنْهُمْ
The Messenger of Allah ﷺ delivered a speech to us; meanwhile al-Hasan and al-Husayn came upon there stumbling, wearing red shirts. He came down from the pulpit, took them and ascended it with them. He then said: Allah truly said: "Your property and your children are only trial" (Ixiv.15). I saw both of them, and I could not wait. Afterwards he resumed the speech. رَسُولُ اللهِ ﷺ يَخْطُبُ فَأَقْبَلَ الْحَسَنُ وَالْحُسَيْنُ ؓ وَعَلَيْهِمَا قَمِيصَانِ أَحْمَرَانِ يَعْثُرَانِ وَيَقُومَانِ فَلَمَّا رَآهُمَا نَزَلَ فَأَخَذَهُمَا ثُمَّ صَعِدَ فَوَضَعَهُمَا فِي حِجْرِهِ ثُمَّ قَالَ صَدَقَ اللهُ {إِنَّمَا أَمْوَالُكُمْ وَأَوْلَادُكُمْ فِتْنَةٌ} [التغابن 15] رَأَيْتُ هَذَيْنِ فَلَمْ أَصْبِرْ حَتَّى أَخَذْتُهُمَا
[Machine] I heard Abu Bakr say, "I saw the Prophet ﷺ on the pulpit and with him was Al-Hasan bin Ali, and he looked at him once and at the people once, and he said, 'Indeed, my son here is a master and perhaps Allah will make peace between two groups of Muslims through him.'"
سَمِعْتُ أَبَا بَكْرَةَ يَقُولُ رَأَيْتُ النَّبِيَّ ﷺ عَلَى الْمِنْبَرِ وَمَعَهُ الْحَسَنُ بْنُ عَلِيٍّ وَهُوَ يَنْظُرُ إِلَيْهِ مَرَّةً وَإِلَى النَّاسِ مَرَّةً وَهُوَ يَقُولُ إِنَّ ابْنِي هَذَا سَيِّدٌ وَلَعَلَّ اللهَ أَنْ يُصْلِحَ بِهِ بَيْنَ فِئَتَيْنِ مِنَ الْمُسْلِمِينَ
When al-Hasan was born, I named him Harb [which means war], then the Messenger of Allah ﷺ came and said: ʿShow me my son; what did you name him?ʿ We said: Harb. He said: ʿRather he is Hasan.” When al-Husain was born, I named him Harb, then the Messenger of Allah ﷺ came and said: “Show me my son; what did you name him?” We said; Harb. He said: “Rather he is Husain.” When the third one was born, I named him Harb. The Prophet ﷺ came and said: “Show me my son, what did you name him?” I said. Harb. He said: ʿRather, he is Muhassin.ʿ Then he said: ʿI have named them after the fashion of the sons of Haroon, Shabbar and Shabeer and Mushabbir.” (Using translation from Aḥmad 769)
لَمَّا وُلِدَ الْحَسَنُ سَمَّيْتُهُ حَرْبًا فَجَاءَ رَسُولُ اللهِ ﷺ فَقَالَ أَرُونِي ابْنِي مَا سَمَّيْتُمُوهُ؟ فَقُلْتُ حَرْبًا فَقَالَ بَلْ هُوَ حَسَنٌ ثُمَّ وُلِدَ الْحُسَيْنُ فَسَمَّيْتُهُ حَرْبًا فَجَاءَ رَسُولُ اللهِ ﷺ فَقَالَ أَرُونِي ابْنِي مَا سَمَّيْتُمُوهُ؟ فَقُلْتُ حَرْبًا قَالَ بَلْ هُوَ حُسَيْنٌ فَلَمَّا وُلِدَ الثَّالِثُ سَمَّيْتُهُ حَرْبًا فَجَاءَ رَسُولُ اللهِ ﷺ أُرَاهُ فَقَالَ أَرُونِي ابْنِي مَا سَمَّيْتُمُوهُ؟ قُلْتُ حَرْبًا قَالَ بَلْ هُوَ مُحْسِنٌ ثُمَّ قَالَ سَمَّيْتُهُمْ بِأَسْمَاءِ وَلَدِ هَارُونَ شَبَّرَ وَشَبِيرَ وَمُشَبَّرَ
31.9 [Machine] Charity in Inheritance
٣١۔٩ بَابُ الصَّدَقَةِ فِي الْعِتْرَةِ قَالَ الْقُتَيْبِيُّ: هِيَ لِوَلَدِهِ وَوَلَدِ وَلَدِهِ الذُّكُورِ وَالْإِنَاثِ وَلِعَشِيرَتِهِ الْأَدْنَيْنَ، يَدُلُّكَ عَلَى ذَلِكَ قَوْلُ أَبِي بَكْرٍ الصِّدِّيقِ : نَحْنُ عِتْرَةُ رَسُولِ اللهِ ﷺ الَّتِي خَرَجَ مِنْهَا، وَبَيْضَتُهُ الَّتِي تَفَقَّأَتْ عَنْهُ
[Machine] I heard Abu Bakr Al-Siddiq saying, "Ali Ibn Abi Talib is the family of the Messenger of Allah ﷺ in this chain of narration, and some of those who are unknown are mentioned about Abu Bakr that he said on the day of the Saqifah, 'We are the family of the Messenger of Allah ﷺ."
سَمِعْتُ أَبَا بَكْرٍ الصِّدِّيقَ يَقُولُ عَلِيُّ بْنُ أَبِي طَالِبٍ عِتْرَةُ رَسُولِ اللهِ ﷺ فِي هَذَا الْإِسْنَادِ بَعْضُ مَنْ يُجْهَلُ وَيُذْكَرُ عَنْ أَبِي بَكْرٍ ؓ أَنَّهُ قَالَ يَوْمَ السَّقِيفَةِ نَحْنُ عِتْرَةُ رَسُولِ اللهِ ﷺ
31.10 [Machine] Charity in the Progeny: Who Inherits the Progeny's Name?
٣١۔١٠ بَابُ الصَّدَقَةِ فِي الذُّرِّيَّةِ وَمَنْ يَتَنَاوَلُهُ اسْمُ الذُّرِّيَّةِ
[Machine] Al-Hajjaj was not from the progeny of the Prophet ﷺ . He had Yahya ibn Yamar with him, so he said to him, "You have lied, O Amir." He said, "Come to me with clear evidence from the Book of Allah to support what you have said, or I will kill you." He said, "{And from his progeny were Dawud, Sulayman, Ayyub, Yusuf, Musa, and Harun}, and {Zakariya, Yahya, and Isa}" [Al-An'am 85]. So Allah informed that Isa is from the progeny of Adam through his mother, and Al-Husayn ibn Ali is from the progeny of Muhammad ﷺ through his mother. He said, "You have spoken the truth. So what made you deny in my presence?" He said, "Allah has not made it obligatory upon the Prophets to disclose it to the people, and they should not hide it" [Al-Imran 187]. Allah said, "{So they cast him behind their backs and exchanged him for a small price}" [Al-Imran 187]. He said, "So he was exiled to Khurasan."
الْحَجَّاجُ لَمْ يَكُنْ مِنْ ذُرِّيَّةِ النَّبِيِّ ﷺ وَعِنْدَهُ يَحْيَى بْنُ يَعْمَرَ فَقَالَ لَهُ كَذَبْتَ أَيُّهَا الْأَمِيرُ فَقَالَ لَتَأْتِيَنِّي عَلَى مَا قُلْتَ بِبَيِّنَةٍ مِنْ مِصْدَاقٍ مِنْ كِتَابِ اللهِ أَوْ لَأَقْتُلَنَّكَ قَالَ {وَمِنْ ذُرِّيَّتِهِ دَاوُدَ وَسُلَيْمَانَ وَأَيُّوبَ وَيُوسُفَ وَمُوسَى وَهَارُونَ} إِلَى قَوْلِهِ {وَزَكَرِيَّا وَيَحْيَى وَعِيسَى} [الأنعام 85] فَأَخْبَرَ اللهُ ﷻ أَنَّ عِيسَى مِنْ ذُرِّيَّةِ آدَمَ بِأُمِّهِ وَالْحُسَيْنُ بْنُ عَلِيٍّ مِنْ ذُرِّيَّةِ مُحَمَّدٍ ﷺ بِأُمِّهِ قَالَ صَدَقْتَ فَمَا حَمَلَكَ عَلَى تَكْذِيبِي فِي مَجْلِسِي؟ قَالَ مَا أَخَذَ اللهُ عَلَى الْأَنْبِيَاءِ {لَتُبَيِّنُنَّهُ لِلنَّاسِ وَلَا تَكْتُمُونَهُ} [آل عمران 187] قَالَ اللهُ ﷻ {فَنَبَذُوهُ وَرَاءَ ظُهُورِهِمْ وَاشْتَرَوْا بِهِ ثَمَنًا قَلِيلًا} [آل عمران 187] قَالَ فَنَفَاهُ إِلَى خُرَاسَانَ
31.11 [Machine] Charitable donation according to the conditions set by the benefactor regarding legacy, advancement, and equality.
٣١۔١١ بَابُ الصَّدَقَةِ عَلَى مَا شَرَطَ الْوَاقِفُ مِنَ الْأَثَرَةِ وَالتَّقْدُمَةِ وَالتَّسْوِيَةِ
[Machine] Narrated by the Messenger of Allah ﷺ , the Muslims are bound by their conditions.
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ الْمُسْلِمُونَ عَلَى شُرُوطِهِمْ
[Machine] "To live in a dwelling that is neither harmful nor harmed by it, and if she becomes independent through a husband, then she has nothing." Abu 'Ubayd said: Al-Asma'i replied: "The divorced woman who is completely independent."
أَنْ تَسْكُنَ غَيْرَ مُضِرَّةٍ وَلَا مُضَرٍّ بِهَا فَإِنِ اسْتَغْنَتْ بِزَوْجٍ فَلَا شَيْءَ لَهَا قَالَ أَبُو عُبَيْدٍ قَالَ الْأَصْمَعِيُّ الْمَرْدُودَةُ الْمُطَلَّقَةُ
31.12 [Machine] Building Mosques, Watering Troughs, and Others
٣١۔١٢ بَابُ اتِّخَاذِ الْمَسْجِدِ وَالسِّقَايَاتِ وَغَيْرِهَا
You discuss it very much whereas I have heard Messenger of Allah ﷺ as saying: He who builds a mosque-- and the narrator Bukair said: I think he also said: (for) seeking the pleasure of Allah- Allah would build (a similar house for him in Paradise). and in the narration of Harun (the words are):" A house for him in Paradise." (Using translation from Muslim 533c)
أَنَّهُ سَمِعَ عُثْمَانَ بْنَ عَفَّانَ عِنْدَ قَوْلِ النَّاسِ فِيهِ حِينَ بَنَى مَسْجِدَ رَسُولِ اللهِ ﷺ إِنَّكُمْ قَدْ أَكْثَرْتُمْ وَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ بَنَى لِلَّهِ مَسْجِدًا قَالَ بُكَيْرٌ أَحْسِبُهُ قَالَ يَبْتَغِي بِهِ وَجْهَ اللهِ بَنَى اللهُ لَهُ بَيْتًا فِي الْجَنَّةِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever builds a mosque for Allah, Allah will build for him a house in Paradise."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ بَنَى مَسْجِدًا لِلَّهِ بَنَى الله لَهُ بَيْتًا فِي الْجَنَّةِ
[Machine] I swear by God, and I only swear by the Companions of the Prophet, ﷺ . You know that the Messenger of Allah, ﷺ , said: "Whoever digs the well of Roomah, Paradise is for him." So did I dig it? Don't you know that he also said: "Whoever prepares the army of Usrah, Paradise is for him." So did I prepare them? They believed him in what he said.
أَنْشُدُكُمُ اللهَ وَلَا أَنْشُدُ إِلَّا أَصْحَابَ النَّبِيِّ ﷺ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ حَفَرَ بِئْرَ رُومَةَ فَلَهُ الْجَنَّةُ فَحَفَرْتُهَا؟ أَلَسْتُمْ تَعْلَمُونَ أَنَّهُ قَالَ مَنْ جَهَّزَ جَيْشَ الْعُسْرَةِ فَلَهُ الْجَنَّةُ فَجَهَّزْتُهُمْ؟ فَصَدَّقُوهُ بِمَا قَالَ
[Machine] The Messenger of Allah ﷺ was on Mount Hira and he said, "Stay, Hira, for there is only a Prophet, a truthful person, or a martyr upon you." They said, "O Allah, yes." He said, "I ask you by Allah, do you know that the Messenger of Allah ﷺ said during the Battle of Uhud, 'Whoever spends a spending that is accepted?' And the people at that time were suffering and exhausted. So I prepared one-third of that army with my money." They said, "O Allah, yes." Then he said, "I ask you by Allah, do you know that nobody used to drink from the well of Rumah except by paying a price? So I bought it with my money and made it accessible to the rich, the poor, and the traveler." They said, "O Allah, yes, in things that can be numbered."
أَنَّ رَسُولَ اللهِ ﷺ كَانَ عَلَى جَبَلِ حِرَاءَ فَقَالَ اسْكُنْ حِرَاءُ فَمَا عَلَيْكَ إِلَّا نَبِيٌّ أَوْ صِدِّيقٌ أَوْ شَهِيدٌ ؟ قَالُوا اللهُمَّ نَعَمْ قَالَ أَنْشُدُكُمْ بِاللهِ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي غَزْوَةِ الْعُسْرَةِ مَنْ يُنْفِقُ نَفَقَةً مُتَقَبَّلَةً؟ وَالنَّاسُ يَوْمَئِذٍ مُعْسِرُونَ مَجْهُودُونَ فَجَهَّزْتُ ثُلُثَ ذَلِكَ الْجَيْشِ مِنْ مَالِي؟ قَالُوا اللهُمَّ نَعَمْ ثُمَّ قَالَ أَنْشُدُكُمْ بِاللهِ هَلْ تَعْلَمُونَ أَنَّ رُومَةَ لَمْ يَكُنْ يَشْرَبُ مِنْهَا أَحَدٌ إِلَّا بِثَمَنٍ فَابْتَعْتُهَا بِمَالِي فَجَعَلْتُهَا لِلْغَنِيِّ وَالْفَقِيرِ وَابْنِ السَّبِيلِ؟ قَالُوا اللهُمَّ نَعَمْ فِي أَشْيَاءَ عَدَّدَهَا
[Machine] The Messenger of Allah ﷺ said, "Whoever buys the mare of Bani Fulan, Allah will forgive him." So I bought it. I thought that he said for twenty or twenty-five thousand. So I came to the Messenger of Allah ﷺ and said, "I have bought it." He said, "Place it in our mosque and its reward is for you." They said, "Yes." He said, "I adjure you by Allah, besides whom there is no deity, do you know that the Messenger of Allah ﷺ said, 'Whoever buys the well of Rumah, Allah will forgive him.'" So I bought it for such and such price. Then I came to the Messenger of Allah ﷺ and said, "Indeed, I bought the well of Rumah." He said, "Make it a source of water for the Muslims and its reward is for you." They said, "Yes." He said, "I adjure you by Allah, besides whom there is no deity, do you know that the Messenger of Allah ﷺ looked at the faces of the people on the day of the Battle of Uhud and said, 'Who will equip these people?' Allah will forgive him." So I equipped them until they did not lose a noseband or a rein." They said, "Yes." He said, "O Allah, bear witness; O Allah, bear witness; O Allah, bear witness." And he mentioned the hadith.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ يَبْتَاعُ مِرْبَدَ بَنِي فُلَانٍ غَفَرَ اللهُ لَهُ فَابْتَعْتُهُ قَالَ أَحْسِبُ أَنَّهُ قَالَ بِعِشْرِينَ أَوْ بِخَمْسَةٍ وَعِشْرِينَ أَلْفًا فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ قَدِ ابْتَعْتُهُ قَالَ اجْعَلْهُ فِي مَسْجِدِنَا وَأَجْرُهُ لَكَ ؟ قَالُوا نَعَمْ قَالَ نَشَدْتُكُمْ بِاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ أَتَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ يَبْتَاعُ بِئْرَ رُومَةَ غَفَرَ اللهُ لَهُ فَابْتَعْتُهَا بِكَذَا وَكَذَا فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ إِنِّي ابْتَعْتُ بِئْرَ رُومَةَ قَالَ اجْعَلْهَا سِقَايَةً لِلْمُسْلِمِينَ وَأَجْرُهَا لَكَ ؟ قَالُوا نَعَمْ قَالَ نَشَدْتُكُمْ بِاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ نَظَرَ فِي وُجُوهِ الْقَوْمِ يَوْمَ جَيْشِ الْعُسْرَةِ فَقَالَ مَنْ يُجَهِّزُ هَؤُلَاءِ غَفَرَ اللهُ لَهُ فَجَهَّزْتُهُمْ حَتَّى مَا يَفْقِدُونَ خِطَامًا وَلَا عِقَالًا؟ قَالُوا نَعَمْ قَالَ اللهُمُ اشْهَدِ اللهُمَّ اشْهَدِ اللهُمُ اشْهَدْ وَذَكَرَ الْحَدِيثَ
[Machine] The Messenger of Allah ﷺ arrived in Medina where there was no accessible water except for the well of Rumah. He asked, "Who would buy the well of Rumah so that its bucket would be in it along with the Muslim's buckets in Paradise?" So I bought it from the core of my wealth. He said, "And today, you prevent me from drinking from it until I drink from the water of the sea?" They said, "O Allah, yes." He said, "I adjure you by Allah and by Islam, do you know that the mosque was crowded with its people?" So the Messenger of Allah ﷺ said, "Who would buy the land of such and such a family with something better for him in Paradise?" So I bought it from my wealth or he said, from the core of my wealth, and I added it to the mosque. And today, you prevent me from praying in it?" They said, "O Allah, yes." And he mentioned the hadith in the preparation of the army of 'Usrah and the incident of Thabeer.
أَنَّ رَسُولَ اللهِ ﷺ قَدِمَ الْمَدِينَةَ لَيْسَ فِيهَا مَاءٌ يُسْتَعْذَبُ غَيْرُ بِئْرِ رُومَةَ فَقَالَ مَنْ يَشْتَرِي بِئْرَ رُومَةَ فَيَكُونُ دَلْوُهُ فِيهَا مَعَ دِلَاءِ الْمُسْلِمِينَ بِخَيْرٍ لَهُ مِنْهَا فِي الْجَنَّةِ؟ فَاشْتَرَيْتُهَا مِنْ صُلْبِ مَالِي قَالَ وَأَنْتُمُ الْيَوْمَ تَمْنَعُونَنِي أَنْ أَشْرَبَ مِنْهَا حَتَّى أَشْرَبَ مِنْ مَاءِ الْبَحْرِ قَالُوا اللهُمَّ نَعَمْ قَالَ أَنْشُدُكُمُ اللهَ وَالْإِسْلَامَ هَلْ تَعْلَمُونَ أَنَّ الْمَسْجِدَ كَانَ ضَاقَ بِأَهْلِهِ فَقَالَ رَسُولُ اللهِ ﷺ مَنْ يَشْتَرِي بُقْعَةَ آلِ فُلَانٍ بِخَيْرٍ لَهُ مِنْهَا فِي الْجَنَّةِ؟ فَاشْتَرَيْتُهَا مِنْ مَالِي أَوْ قَالَ مِنْ صُلْبِ مَالِي فَزِدْتُهَا فِي الْمَسْجِدِ فَأَنْتُمُ الْيَوْمَ تَمْنَعُونَنِي أَنْ أُصَلِّيَ فِيهَا؟ قَالُوا اللهُمَّ نَعَمْ وَذَكَرَ الْحَدِيثَ فِي تَجْهِيزِ جَيْشِ الْعُسْرَةِ وَقِصَّةِ ثَبِيرٍ
[Machine] In the Mosque of the Messenger of Allah ﷺ , its extension fell on the house of Abbas ibn Abdul Muttalib. Umar wanted to include it in the Mosque of the Messenger of Allah ﷺ and compensate Abbas for it, but he refused and said it was a piece of land that severed from the Mosque of the Messenger of Allah ﷺ . They disagreed, so they asked Ubayy ibn Ka'b to mediate between them. They went to his house, and he was called the leader of the Muslims. He ordered them a cushion, which was placed in front of him. Umar mentioned what he wanted, and Abbas mentioned the piece severed from the Mosque of the Messenger of Allah ﷺ . Ubayy said: "Indeed, Allah commanded His servant and Prophet Dawud ﷺ to build a house for him." Dawud asked: "O Lord, where is this house?" He replied: "Wherever you see the angel lowering his sword." So, Dawud saw it on the rock. On that day, it was more valuable than the whole world to a young boy from the Children of Israel. So Dawud came to him and said: "I have been commanded to build a house for Allah." The boy asked: "Did Allah command you to take it from me without my consent?" Dawud replied: "No." Then Allah revealed to Dawud: "Indeed, I have made the treasures of the earth in your hands to please him." So, Dawud came to him and said: "I have been commanded to please you. Would you take this piece of land, or would you prefer a chest full of gold?" The boy asked: "Is it not better than a chest full of gold?" Dawud replied: "Indeed, it is better." The boy said: "Then I am pleased." Dawud continued to insist on giving him more until the boy was pleased with nine chests of gold. Abbas said, "O Allah, I will not accept any reward for it, and I have already donated it to the Muslims." So Umar accepted it from him and included it in the Mosque of the Messenger of Allah ﷺ .
فِي مَسْجِدِ رَسُولِ اللهِ ﷺ وَقَعَتْ زِيَادَتُهُ عَلَى دَارِ الْعَبَّاسِ بْنِ عَبْدِ الْمُطَّلِبِ ؓ فَأَرَادَ عُمَرُ ؓ أَنْ يُدْخِلَهَا فِي مَسْجِدِ رَسُولِ اللهِ ﷺ وَيُعَوِّضَهُ مِنْهَا فَأَبَى وَقَالَ قَطِيعَةُ رَسُولِ اللهِ ﷺ وَاخْتَلَفَا فَجَعَلَا بَيْنَهُمَا أُبِيَّ بْنَ كَعْبٍ ؓ فَأَتَيَاهُ فِي مَنْزِلِهِ وَكَانَ يُسَمَّى سَيِّدَ الْمُسْلِمِينَ فَأَمَرَ لَهُمَا بِوِسَادَةٍ فَأُلْقِيَتْ لَهُمَا فَجَلَسَا عَلَيْهَا بَيْنَ يَدَيْهِ فَذَكَرَ عُمَرُ مَا أَرَادَ وَذَكَرَ الْعَبَّاسُ قَطِيعَةَ رَسُولِ اللهِ ﷺ فَقَالَ أُبَيٌّ إِنَّ اللهَ ﷻ أَمَرَ عَبْدَهُ وَنَبِيَّهُ دَاوُدَ عَلَيْهِ السَّلَامُ أَنْ يَبْنِيَ لَهُ بَيْتًا قَالَ أَيْ رَبِّ وَأَيْنَ هَذَا الْبَيْتُ؟ قَالَ حَيْثُ تَرَى الْمَلَكَ شَاهِرًا سَيْفَهُ فَرَآهُ عَلَى الصَّخْرَةِ وَإِذَا مَا هُنَاكَ يَوْمَئِذٍ أَنْدَرٌ لِغُلَامٍ مِنْ بَنِي إِسْرَائِيلَ فَأَتَاهُ دَاوُدُ فَقَالَ إِنِّي قَدْ أُمِرْتُ أَنْ أَبْنِيَ هَذَا الْمَكَانَ بَيْتًا لِلَّهِ ﷻ فَقَالَ لَهُ الْفَتَى آللَّهُ أَمَرَكَ أَنْ تَأْخُذَهَا مِنِّي بِغَيْرِ رِضَايَ؟ قَالَ لَا فَأَوْحَى اللهُ إِلَى دَاوُدَ عَلَيْهِ السَّلَامُ أَنِّي قَدْ جَعَلْتُ فِي يَدِكَ خَزَائِنَ الْأَرْضِ فَأَرْضِهِ فَأَتَاهُ دَاوُدُ فَقَالَ إِنِّي قَدْ أُمِرْتُ بِرِضَاكَ فَلَكَ بِهَا قِنْطَارٌ مِنْ ذَهَبٍ قَالَ قَدْ قَبِلْتُ يَا دَاوُدُ وَهِيَ خَيْرٌ أَمِ الْقِنْطَارُ؟ قَالَ بَلْ هِيَ خَيْرٌ قَالَ فَأَرْضِي قَالَ فَلَكَ بِهَا ثَلَاثُ قَنَاطِيرَ قَالَ فَلَمْ يَزَلْ يُشَدِّدُ عَلَى دَاوُدَ حَتَّى رَضِيَ مِنْهُ بِتِسْعِ قَنَاطِيرَ قَالَ الْعَبَّاسُ اللهُمَّ لَا آخُذُ لَهَا ثَوَابًا وَقَدْ تَصَدَّقْتُ بِهَا عَلَى جَمَاعَةِ الْمُسْلِمِينَ فَقَبِلَهَا عُمَرُ ؓ مِنْهُ فَأَدْخَلَهَا فِي مَسْجِدِ رَسُولِ اللهِ ﷺ
[Machine] Make between me and you a man from the companions of the Prophet ﷺ , so they chose Ubay ibn Ka'b between them. He ruled in favor of Abbas over Umar, so Umar said, "No one among the companions of the Prophet ﷺ is more audacious towards me than you." Ubay ibn Ka'b said, "Or I am more sincere to you than others." Then he said, "O Amir al-Mu'minin, have you not heard the narration of Dawood that Allah commanded him to build Bayt al-Maqdis (Jerusalem) and he entered the house of a woman without her permission, so when the men were prevented from entering, Allah prevented him from building it." Dawood said, "O Lord, if You prevent me from building it, then place it in my offspring." Abbas said, "Didn't you rule in my favor and it became mine?" Umar said, "Yes." Abbas said, "Then I bear witness that I have made it for Allah."
اجْعَلْ بَيْنِي وَبَيْنَكَ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ فَجَعَلَا بَيْنَهُمَا أُبِيَّ بْنَ كَعْبٍ فَقَضَى لِلْعَبَّاسِ عَلَى عُمَرَ فَقَالَ عُمَرُ مَا أَحَدٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَجْرَأَ عَلَيَّ مِنْكَ فَقَالَ أُبِيُّ بْنُ كَعْبٍ أَوْ أَنْصَحَ لَكَ مِنِّي ثُمَّ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ أَمَا بَلَغَكَ حَدِيثُ دَاوُدَ أَنَّ اللهَ ﷻ أَمَرَهُ بِبِنَاءِ بَيْتِ الْمَقْدِسِ فَأَدْخَلَ فِيهِ بَيْتَ امْرَأَةٍ بِغَيْرِ إِذْنِهَا فَلَمَّا بَلَغَ حُجَزَ الرِّجَالِ مَنَعَهُ اللهُ بِنَاءَهُ قَالَ دَاوُدُ أَيْ رَبِّ إِنْ مَنَعْتَنِي بِنَاءَهُ فَاجْعَلْهُ فِي خَلَفِي فَقَالَ الْعَبَّاسُ أَلَيْسَ قَدْ قَضَيْتَ لِي بِهَا وَصَارَتْ لِي؟ قَالَ بَلَى قَالَ فَإِنِّي أُشْهِدُكَ أَنِّي قَدْ جَعَلْتُهَا لِلَّهِ
