[Machine] That to Hafsah, wherever she spends her wealth, God will see it. And if she passes away, it will go to her family member with good judgment. Its root will never be sold or handed over. And whoever is in charge of it, there is no harm for him in its fruit, whether he eats it or feeds it to a friend without expecting any payment. Whatever is forgiven from its fruit is for the asker, the forbidden, the guest, the relatives, the traveler, and in the way of God, wherever God sees fit. And if it passes away, it will go to my family member and the water carrier who fed me, Muhammad, the Messenger of God, in the valley with his own hands, I did not destroy it, as it is part of his traditions that I ordered. And if the water carrier wishes, he can buy something delicate from its fruit for his work and keep records. And Abdullah ibn al-Arqam testified, "In the name of Allah, the Most Gracious, the Most Merciful, this is what Abdullah Umar, the Commander of the Faithful, advised. If something happens to it, then 100 camel, and the servant who is with it, and the 100 arrows that are in Khaybar, and its delicate fruit, and the 100 (meaning water carrier) the one whom Muhammad, the Messenger of God, fed, and then Hafsah, wherever she is, and then the family member with good judgment, it will not be sold or bought. It will be spent wherever she sees fit for the asker, the forbidden, the relatives, and there is no harm for the one in charge if he eats it, feeds it, or buys something delicate from it."  

البيهقي:١١٨٩٣أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ مُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي اللَّيْثُ بْنُ سَعْدٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ صَدَقَةِ عُمَرَ بْنِ الْخَطَّابِ قَالَ نَسَخَهَا لِي عَبْدُ الْحَمِيدِ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُمَرَ بْنِ الْخَطَّابِ فِي ثَمْغٍ

أَنَّهُ إِلَى حَفْصَةَ مَا عَاشَتْ تُنْفِقُ ثَمَرَهُ حَيْثُ أَرَاهَا اللهُ فَإِنْ تُوُفِّيَتْ فَإِنَّهُ إِلَى ذِي الرَّأْيِ مِنْ أَهْلِهَا لَا يُشْرَى أَصْلُهُ أَبَدًا وَلَا يُوهَبُ وَمَنْ وَلِيَهُ فَلَا حَرَجَ عَلَيْهِ فِي ثَمَرِهِ إِنْ أَكَلَ أَوْ أَكَّلَ صَدِيقًا غَيْرَ مُتَأَثِّلٍ مَالًا فَمَا عَفَا عَنْهُ مِنْ ثَمَرِهِ فَهُوَ لِلسَّائِلِ وَالْمَحْرُومِ وَالضَّيْفِ وَذَوِي الْقُرْبَى وَابْنِ السَّبِيلِ وَفِي سَبِيلِ اللهِ تُنْفِقُهُ حَيْثُ أَرَاهَا اللهُ مِنْ ذَلِكَ فَإِنْ تُوُفِّيَتْ فَإِلَى ذِي الرَّأْيِ مِنْ وَلَدِي وَالْمِائَةُ الْوَسْقِ الَّذِي أَطْعَمَنِي مُحَمَّدٌ رَسُولُ اللهِ ﷺ بِالْوَادِي بِيَدِي لَمْ أُهْلِكْهَا فَإِنَّهُ مَعَ ثَمْغٍ عَلَى سُنَنِهِ الَّتِي أَمَرْتُ بِهَا وَإِنْ شَاءَ وَلِيُّ ثَمْغٍ اشْتَرَى مِنْ ثَمَرِهِ رَقِيقًا لِعَمَلِهِ وَكَتَبَ مُعَيْقِيبٌ وَشَهِدَ عَبْدُ اللهِ بْنُ الْأَرْقَمِ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا أَوْصَى بِهِ عَبْدُ اللهِ عُمَرُ أَمِيرُ الْمُؤْمِنِينَ إِنْ حَدَثَ بِهِ حَدَثٌ أَنَّ ثَمْغًا وَصِرْمَةَ بْنَ الْأَكْوَعِ وَالْعَبْدَ الَّذِي فِيهِ وَالْمِائَةَ السَّهْمِ الَّذِي بِخَيْبَرَ وَرَقِيقَهُ الَّذِي فِيهِ وَالْمِائَةَ يَعْنِي الْوَسْقَ الَّذِي أَطْعَمَهُ مُحَمَّدٌ رَسُولُ اللهِ ﷺ تَلِيهِ حَفْصَةُ مَا عَاشَتْ ثُمَّ يَلِيهِ ذُو الرَّأْيِ مِنْ أَهْلِهَا لَا يُبَاعُ وَلَا يُشْتَرَى يُنْفِقُهُ حَيْثُ رَأَى مِنَ السَّائِلِ وَالْمَحْرُومِ وَذَوِي الْقُرْبَى وَلَا حَرَجَ عَلَى وَلِيِّهِ إِنْ أَكَلَ أَوْ أَكَّلَ أَوِ اشْتَرَى لَهُ رَقِيقًا مِنْهُ

'Abd al-Hamid b. Abd 'Allah b. 'Abd Allah b. 'Umar b. al-Khattab copied to me a document about the religious endowment (waqf) made by 'Umar b. al-Khattab : In the name of Allah, the Compassionate, the Merciful. This is what Allah's servant 'Umar has written about Thamgh. He narrated the tradition like the one transmitted by Nafi'. He added: "provided he is not storing up goods (for himself)". The surplus fruit will be devoted to the beggar and the deprived. He then went on with the tradition, saying: If the man in charge of Thamgh wishes to buy a slave for his work for its fruits (by selling them), he may do so. Mu'iqib penned it and 'Abd Allah b. al-Arqam witnessed it : In the name of Allah, the Compassionate, the Merciful. This is what Allah's servant 'Umar , Commander of Faithful, directed, in case of some incident happens to him (i.e. he dies), that Thamg, Sirmah b. al-Akwa', the servant who is there, the hundred shares in (the land of) Khaibr, the servant who is there and the hundred sahres which Muhammad ﷺ had donated to me in the valley (nearly) will remain in the custody of Hafsah during her life, then the men of opinion from her family will be in charge of these (endowments), that these will neither be sold not purchased, spending (its produce) where they think (necessary on the beggar, deprived and relatives). There is no harm to the one in charge (of this endowment) if he eats himself, or feeds, or buys slaves with it.  

أبو داود:٢٨٧٩حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ حَدَّثَنَا ابْنُ وَهْبٍ أَخْبَرَنِي اللَّيْثُ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ صَدَقَةِ عُمَرَ بْنِ الْخَطَّابِ ؓ قَالَ نَسَخَهَا لِي عَبْدُ الْحَمِيدِ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ بْنِ الْخَطَّابِ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا كَتَبَ عَبْدُ اللَّهِ عُمَرُ فِي ثَمْغٍ فَقَصَّ مِنْ خَبَرِهِ نَحْوَ حَدِيثِ نَافِعٍ قَالَ
