30. Giving Life to the Dead Land (1/3)
٣٠۔ كِتَابُ إِحْيَاءِ الْمَوَاتِ ص ١
[Machine] The Messenger of Allah ﷺ said, "Whoever occupies a land that does not belong to anyone, then he has more right to it." Urwah said, "Umar ibn al-Khattab ruled according to this during his caliphate."
رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ مَنْ عَمَّرَ أَرْضًا لَيْسَتْ لِأَحَدٍ فَهُوَ أَحَقُّ بِهَا قَالَ عُرْوَةُ قَضَى بِذَلِكَ عُمَرُ بْنُ الْخَطَّابِ ؓ فِي خِلَافَتِهِ
The Prophet ﷺ said: If anyone brings barren land into cultivation, it belongs to him, and the unjust vein has no right. (Using translation from Abū Dāʾūd 3073)
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
I testify that the Messenger of Allah ﷺ decided that the land is the land of Allah, and the servants are the servants of Allah. If anyone brings barren land into cultivation, he has more right to it. This tradition has been transmitted to us from the Prophet ﷺ by those who transmitted the traditions about prayer from him. (Using translation from Abū Dāʾūd 3076)
أَنَّ رَسُولَ اللهِ ﷺ قَضَى أَنَّ الْأَرْضَ أَرْضُ اللهِ وَالْعِبَادَ عِبَادُ اللهِ وَمَنْ أَحْيَا مَوَاتًا فَهُوَ أَحَقُّ بِهِ جَاءَنَا بِهَذَا عَنِ النَّبِيِّ ﷺ الَّذِينَ جَاءُونَا بِالصَّلَوَاتِ عَنْهُ
[Machine] About his father, he narrates from the Prophet ﷺ that he said, "Whoever brings a dead land to life, it belongs to him and not to any unjust person."
عَنْ أَبِيهِ يَرْفَعُهُ إِلَى النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنْ أَحْيَا مَوَاتًا مِنَ الْأَرْضِ فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
[Machine] The Messenger of Allah ﷺ said, "Whoever revives a dead land, he is the rightful owner of it and no unjust person has the right to it." Hisham also said, "The unjust person is the one who comes to the wealth of others and digs into it."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهُوَ أَحَقُّ بِهَا وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ قَالَ وَقَالَ هِشَامٌ الْعِرْقُ الظَّالِمُ أَنْ يَأْتِيَ مَالَ غَيْرِهِ فَيَحْفِرَ فِيهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever revives a dead land that no one has owned before, it belongs to him and not to any unjust person. It is his right." He said, "The narrator of this Hadith told me that he saw two men from Bayadhah disputing in front of the Messenger of Allah ﷺ about a piece of land. One of them had planted a palm tree in it. So the Messenger of Allah ﷺ ruled in favor of the owner of the land and ordered the owner of the palm tree to remove it. He said, "I saw him striking the roots of the palm tree with an axe, and indeed, it was a healthy palm tree." Yahya bin Adam said, "Al-'Um is referred to by some as neither short nor long." Some said, "Al-'Um is the old one," and others said, "The tall one." The Sheikh said, "It has been narrated from Muhammad bin Ishaq bin Yasar that he said, 'Al-'Um is the youth.'"
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحْيَا أَرْضًا مَيْتَةً لَمْ تَكُنْ لِأَحَدٍ قَبْلَهُ فِهيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ قَالَ فَلَقَدْ حَدَّثَنِي صَاحِبُ هَذَا الْحَدِيثِ أَنَّهُ أَبْصَرَ رَجُلَيْنِ مِنْ بَيَاضَةَ يَخْتَصِمَانِ إِلَى رَسُولِ اللهِ ﷺ فِي أَجَمَةٍ لِأَحَدِهِمَا غَرَسَ فِيهَا الْآخَرُ نَخْلًا فَقَضَى رَسُولُ اللهِ ﷺ لِصَاحِبِ الْأَرْضِ بِأَرْضِهِ وَأَمَرَ صَاحِبَ النَّخْلِ أَنْ يُخْرِجَ نَخْلَهُ عَنْهُ قَالَ فَلَقَدْ رَأَيْتُهُ يَضْرِبُ فِي أُصُولِ النَّخْلِ بِالْفُئُوسِ وَإِنَّهُ لَنَخْلٌ عُمٌّ قَالَ يَحْيَى بْنُ آدَمَ وَالْعُمُّ قَالَ بَعْضُهُمُ الَّذِي لَيْسَ بِالْقَصِيرِ وَلَا بِالطَّوِيلِ وَقَالَ بَعْضُهُمُ الْعُمُّ الْقَدِيمُ وَقَالَ بَعْضُهُمُ الطَّوِيلُ قَالَ الشَّيْخُ وَقَدْ رُوِيَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ بْنِ يَسَارِ أَنَّهُ قَالَ الْعُمُّ الشَّبَابُ
[Machine] The Messenger of Allah ﷺ said: "Whoever revives a dead land without right over a Muslim, it belongs to him and not to an unjust oppressor."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَحْيَا مَوَاتًا مِنَ الْأَرْضِ فِي غَيْرِ حَقِّ مُسْلِمٍ فَهُوَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
[Machine] The Messenger of Allah, ﷺ , said: "Whoever has control over something, he has more right to it, and there is no right for an oppressor over it."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحَاطَ عَلَى شَيْءٍ فَهُوَ أَحَقُّ بِهِ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
I came to the Prophet ﷺ, and took the oath of allegiance to him. He said: If anyone reaches a water which has not been approached before by any Muslim, it belongs to him. The people, therefore, went out running and marking (on the land). (Using translation from Abū Dāʾūd 3071)
أَتَيْتُ النَّبِيَّ ﷺ فَبَايَعْتُهُ فَقَالَ مَنْ سَبَقَ إِلَى مَا لَمْ يَسْبِقْهُ إِلَيْهِ مُسْلِمٌ فَهُوَ لَهُ قَالَ فَخَرَجَ النَّاسُ يَتَعَادَوْنَ يَتَخَاطَوْنَ
30.2 [Machine] Whoever brings life to a dead land, it belongs to him as a gift from the Messenger of Allah ﷺ without the authority.
٣٠۔٢ بَابُ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ بِعَطِيَّةِ رَسُولِ اللهِ ﷺ دُونَ السُّلْطَانِ
[Machine] The Messenger of Allah ﷺ said, "The servants are the servants of Allah, and the lands are the lands of Allah. So whoever brings something to life from the dead lands, it is for him and not for any unjust oppressor."
قَالَ رَسُولُ اللهِ ﷺ الْعِبَادُ عِبَادُ اللهِ وَالْبِلَادُ بِلَادُ اللهِ فَمَنْ أَحْيَا مِنْ مَوَاتِ الْأَرْضِ شَيْئًا فَهُوَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
The Prophet ﷺ said: If anyone brings barren land into cultivation, it belongs to him, and the unjust vein has no right. (Using translation from Abū Dāʾūd 3073)
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
that the Prophet ﷺ said: "Whoever revives a barren land, then it is for him." (Using translation from Tirmidhī 1379)
مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ
30.3 [Machine] No dhimmi should be left without being given life, for the Messenger of Allah ﷺ made it for those Muslims who support them.
٣٠۔٣ بَابُ لَا يُتْرَكُ ذِمِّيٌّ يُحْيِيهِ؛ لِأَنَّ رَسُولَ اللهِ ﷺ جَعَلَهَا لِمَنْ أَحْيَاهَا مِنَ الْمُسْلِمِينَ
[Machine] About the Prophet ﷺ , he said: "Whoever gives life to a dead land, that land belongs to him, and it is a reward for Allah and His Messenger, then it will be yours after me." It was narrated by Hisham ibn Hujayr from Tawus who said: "And then it belongs to you from me."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَحْيَا مَيْتًا مِنْ مَوَتَانِ الْأَرْضِ فَلَهُ رَقَبَتُهَا وَعَادِيُّ الْأَرْضِ لِلَّهِ وَلِرَسُولِهِ ثُمَّ لَكُمْ مِنْ بَعْدِي وَرَوَاهُ هِشَامُ بْنُ حُجَيْرٍ عَنْ طَاوُسٍ فَقَالَ ثُمَّ هِيَ لَكُمْ مِنِّي
[Machine] The Messenger of Allah ﷺ said: "The land belongs to Allah, and His Messenger, and then to you. So whoever brings to life something from the dead lands, it will be his ownership."
قَالَ رَسُولُ اللهِ ﷺ عَادِيُّ الْأَرْضِ لِلَّهِ وَلِرَسُولِهِ ثُمَّ لَكُمْ مِنْ بَعْدُ فَمَنْ أَحْيَا شَيْئًا مِنْ مَوَتَانِ الْأَرْضِ فَلَهُ رَقَبَتُهَا
إِنَّ عَادِيَّ الْأَرْضِ لِلَّهِ وَلِرَسُولِهِ وَلَكُمْ مِنْ بَعْدُ فَمَنْ أَحْيَا شَيْئًا مِنْ مَوَتَانِ الْأَرْضِ فَهُوَ أَحَقُّ بِهِ
[Machine] The Messenger of Allah ﷺ said, "The two deaths of the earth belong to Allah and His Messenger, so whoever revives anything from it, it will be his." Mu'awiyah ibn Hisham narrated this hadith, which is elevated and connected.
قَالَ رَسُولُ اللهِ ﷺ مَوَتَانِ الْأَرْضِ لِلَّهِ وَلِرَسُولِهِ فَمَنْ أَحْيَا مِنْهَا شَيْئًا فَهِيَ لَهُ تَفَرَّدَ بِهِ مُعَاوِيَةُ بْنُ هِشَامٍ مَرْفُوعًا مَوْصُولًا
30.4 [Machine] The cutting of the deceased
٣٠۔٤ بَابُ إِقْطَاعِ الْمَوَاتِ
[Machine] Abu Abdullah Al-Hafiz informed us that Abu Abdullah Al-Saffar told us that Ismail ibn Ishaq told us that Sulaiman ibn Harb told us that Hammad ibn Zaid told us that Yahya ibn Sa'id said: "I heard Anas ibn Malik narrating that the Messenger of Allah ﷺ gathered the Ansar and asked them to divide the two seas for them. They replied, 'No, not until you divide like you have divided us for our brothers from the Muhajirun.' The Messenger of Allah ﷺ said, 'Indeed, you will soon see the results after me; so be patient until you meet me.'"
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ الصَّفَّارُ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا حَمَّادُ بْنُ زَيْدٍ ثنا يَحْيَى بْنُ سَعِيدٍ قَالَ سَمِعْتُ أَنَسَ بْنَ مَالِكٍ يُحَدِّثُ قَالَ دَعَا رَسُولُ اللهِ ﷺ الْأَنْصَارَ لِيُقْطِعَ لَهُمُ الْبَحْرَيْنَ فَقَالُوا لَا حَتَّى تُقْطِعَ لِإخْوَانِنَا مِنَ الْمُهَاجِرِينَ مِثْلَ الَّذِي تُقْطِعُنَا فَقَالَ رَسُولُ اللهِ ﷺ أَمَا إِنَّكُمْ سَتَرَوْنَ بَعْدِي أَثَرَةً؛ فَاصْبِرُوا حَتَّى تَلْقَوْنِي
[Machine] "That the Prophet ﷺ settled in a land that I know nothing about except what he said in Hadhramaut."
أَنَّ النَّبِيَّ ﷺ أَقْطَعَهُ أَرْضًا لَا أَعْلَمُ إِلَّا مَا قَالَ بِحَضْرَمَوْتَ
[Machine] That the Messenger of Allah ﷺ passed by a certain land and said to me, "Send Muawiyah with me to give it to him or teach it to him." Muawiyah said to me, "Let me follow you." I said to him, "Do not be like the rear of the kings." Muawiyah said, "Give me your sandals." I said to him, "Wear the shadow of the camel." When Muawiyah was appointed as the governor, I went to him and he sat me with him on the bed. He reminded me of the conversation. Sumak said, Wail wished I had carried it in my hands.
أَنَّ رَسُولَ اللهِ ﷺ أَقْطَعَهُ أَرْضًا قَالَ فَأَرْسَلَ مَعِي مُعَاوِيَةَ أَنْ أَعْطِهَا إِيَّاهُ أَوْ قَالَ أَعْلِمْهَا إِيَّاهُ قَالَ فَقَالَ لِي مُعَاوِيَةُ أَرْدِفْنِي خَلْفَكَ فَقُلْتُ لَا تَكُنْ مِنْ أَرْدَافِ الْمُلُوكِ قَالَ فَقَالَ أَعْطِنِي نَعْلَيْكَ فَقُلْتُ انْتَعِلْ ظِلَّ النَّاقَةِ قَالَ وَلَمَّا اسْتُخْلِفَ مُعَاوِيَةُ أَتَيْتُهُ فَأَقْعَدَنِي مَعَهُ عَلَى السَّرِيرِ قَالَ فَذَكَّرَنِي الْحَدِيثَ قَالَ سِمَاكٌ قَالَ وَائِلٌ وَدِدْتُ أَنْ كُنْتُ حَمَلْتُهُ بَيْنَ يَدِيَّ
The Prophet ﷺ gave az-Zubayr the land as a fief up to the reach of his horse when he runs. He, therefore, made his horse run until it stopped. He then threw his flog. Thereupon he said: Give him (the land) up to the point where his flog has reached. (Using translation from Abū Dāʾūd 3072)
أَنَّ رَسُولَ اللهِ ﷺ أَقْطَعَ الزُّبَيْرَ حُضْرَ فَرَسِهِ فَأَجْرَى الْفَرَسَ حَتَّى قَامَ ثُمَّ رَمَى سَوْطَهُ فَقَالَ رَسُولُ اللهِ ﷺ أَعْطُوهُ حَيْثُ بَلَغَ السَّوْطُ
[Machine] That he came to the Prophet ﷺ and pledged allegiance to him, pledging allegiance to Islam, and he affirmed the Prophet's trust in his wealth. The Prophet ﷺ divided few water sources for him, naming them, but our sheikh did not accurately capture the names of those places. The Prophet ﷺ also set a condition for Ibn Mushammit regarding the water source he divided for him, that his water should not be sold, his pasture should not be leased, and his trees should not be used for support.
أَنَّهُ وَفَدَ إِلَى النَّبِيِّ ﷺ وَبَايَعَهُ بَيْعَةَ الْإِسْلَامِ وَصَدَّقَ إِلَيْهِ مَالَهُ وَأَقْطَعَهُ النَّبِيُّ ﷺ مِيَاهًا عِدَّةً فَسَمَّاهُنَّ إِلَّا أَنَّ شَيْخَنَا لَمْ يَضْبِطْ أَسَامِيَ تِلْكَ الْمَوَاضِعِ قَالَ وَشَرَطَ النَّبِيُّ ﷺ لِابْنِ مُشَمِّتٍ فِيمَا أَقْطَعَهُ إِيَّاهُ أَنْ لَا يُبَاعُ مَاؤُهُ وَلَا يُعْقَدُ مَرْعَاهُ وَلَا يُعْضَدُ شَجَرُهُ
[Machine] Abu Bakr cut off Zubayr between the ravine and the canal 11792. Yahya reported that Al-Hasan ibn Salih said, "I heard Ja'far ibn Muhammad say, 'The Messenger of Allah ﷺ gave Ali between Qays and the tree 11792.'" Al-Hasan ibn Salih said, "I heard Abdullah ibn Al-Hasan say, 'Ali asked Umar ibn Al-Khattab and he cut it off in Yanbu'.'"
أَنَّ أَبَا بَكْرٍ ؓ أَقْطَعَ الزُّبَيْرَ مَا بَيْنَ الْجُرُفِ إِلَى قَنَاةَ 11792 قَالَ يَحْيَى وَقَالَ الْحَسَنُ بْنُ صَالِحٍ سَمِعْتُ جَعْفَرَ بْنَ مُحَمَّدٍ يَقُولُ أَعْطَى رَسُولُ اللهِ ﷺ عَلِيًّا بَيْنَ قَيْسٍ وَالشَّجَرَةِ 11792 قَالَ قَالَ الْحَسَنُ بْنُ صَالِحٍ سَمِعْتُ عَبْدَ اللهِ بْنَ الْحَسَنِ يَقُولُ إِنَّ عَلِيًّا ؓ سَأَلَ عُمَرَ بْنَ الْخَطَّابِ ؓ فَأَقْطَعَهُ يَنْبُعَ
[Machine] Nafi 'Abu Abdullah came to 'Umar and said, "Verily, in Basra there is land that is not part of the Kharaaj land and does not harm any of the Muslims." Abu Musa wrote to him informing him of that, so 'Umar wrote to Abu Musa, "If it does not harm any of the Muslims and is not part of the Kharaaj land, then cut it off from them."
نَافِعٌ أَبُو عَبْدِ اللهِ فَأَتَى عُمَرَ ؓ فَقَالَ إِنَّ بِالْبَصْرَةِ أَرْضًا لَيْسَتْ مِنْ أَرْضِ الْخَرَاجِ وَلَا تَضُرُّ بِأَحَدٍ مِنَ الْمُسْلِمِينَ وَكَتَبَ إِلَيْهِ أَبُو مُوسَى يُعْلِمُهُ بِذَلِكَ فَكَتَبَ عُمَرُ إِلَى أَبِي مُوسَى ؓ إِنْ كَانَ لَيْسَتْ تَضُرُّ بِأَحَدٍ مِنَ الْمُسْلِمِينَ وَلَيْسَتْ مِنْ أَرْضِ الْخَرَاجِ فَأَقْطِعْهَا إِيَّاهُ
[Machine] "Abdullah's father asked me for a piece of land on the banks of the Tigris River, where his horses could graze. If it is not part of the jizya land and the jizya water does not reach it, then give it to him."
أَنَّ أَبَا عَبْدِ اللهِ سَأَلَنِي أَرْضًا عَلَى شَاطِئِ دِجْلَةَ تَخْتَلِي فِيهَا خَيْلُهُ فَإِنْ كَانَتْ لَيْسَتْ مِنْ أَرْضِ الْجِزْيَةِ وَلَا يَجْرِي إِلَيْهَا مَاءُ الْجِزْيَةِ فَأَعْطِهَا إِيَّاهُ
[Machine] That Uthman bin Affan expelled five of the Companions of the Prophet Muhammad, ﷺ , which were Zubayr, Saad bin Malik, Ibn Mas'ud, Khabbab, and Usamah bin Zaid. So, I saw Saad and Ibn Mas'ud giving away their lands with one-third.
أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ أَقْطَعَ خَمْسَةً مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ الزُّبَيْرَ وَسَعْدَ بْنَ مَالِكٍ وَابْنَ مَسْعُودٍ وَخَبَّابًا وَأُسَامَةَ بْنَ زَيْدٍ فَرَأَيْتُ جَارِي سَعْدًا وَابْنَ مَسْعُودٍ يُعْطِيَانِ أَرْضَيْهِمَا بِالثُّلُثِ
30.5 [Machine] Writing the provinces
٣٠۔٥ بَابُ كِتَابَةِ الْقَطَائِعِ
[Machine] I heard Anas saying that the Messenger of Allah ﷺ called the Ansar to write a letter for them to Bahrain. They said, "No, by Allah, not until you write a letter for our brothers from Quraysh with the same content." He said to them, "That is what Allah wills. All of that, they say. He said, 'After me, you will see the consequence, so be patient until you meet me."
سَمِعْتُ أَنَسًا يَقُولُ دَعَا رَسُولُ اللهِ ﷺ الْأَنْصَارَ لِيَكْتُبَ لَهُمْ إِلَى الْبَحْرَيْنِ فَقَالُوا لَا وَاللهِ حَتَّى تَكْتُبَ لِإِخْوَانِنَا مِنْ قُرَيْشٍ بِمِثْلِهَا فَقَالَ لَهُمْ ذَلِكَ مَا شَاءَ اللهُ كُلُّ ذَلِكَ يَقُولُونَ ذَلِكَ قَالَ فَإِنَّكُمْ سَتَرَوْنَ بَعْدِي أَثَرَةً؛ فَاصْبِرُوا حَتَّى تَلْقَوْنِي
The Prophet ﷺ assigned as a fief to Bilal ibn al-Muzani the mines of al-Qabaliyyah both which lay on the upper side and which lay on the lower side, and (the land) which was suitable for cultivation at Quds. He did not give him (the land which involved) the right of a Muslim. The Prophet ﷺ wrote a document for him. It goes: "In the name of Allah, the Compassionate, the Merciful. This is what the Messenger of Allah ﷺ assigned to Bilal ibn Harith al-Muzani. He gave him the mines of al-Qabaliyyah, both which lay on the upper side and which lay on the lower side, and (the land) which is suitable for cultivation at Quds. He did not give him the right of any Muslim." Abu Uwais said: A similar tradition has been narrated to me by Thawr b. Zaid, client of Banu al-Dail b. Bakr b. Kinahah from 'Ikrimah on the authority of Ibn 'Abbas. (Using translation from Abū Dāʾūd 3062)
أَنَّ رَسُولَ اللهِ ﷺ أَقْطَعَ بِلَالَ بْنَ الْحَارِثِ الْمُزَنِيَّ مَعَادِنَ الْقَبَلِيَّةِ جَلْسِيَّهَا وَغَوْرِيَّهَا وَحَيْثُ يَصْلُحُ الزَّرْعُ مِنْ قُدْسٍ وَلَمْ يُعْطِهِ حَقَّ مُسْلِمٍ وَكَتَبَ لَهُ النَّبِيُّ ﷺ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا أَعْطَى مُحَمَّدٌ رَسُولُ اللهِ بِلَالَ بْنَ الْحَارِثِ أَعْطَاهُ مَعَادِنَ الْقَبَلِيَّةِ جَلْسِيَّهَا وَغَوْرِيَّهَا حَيْثُ يَصْلُحُ الزَّرْعُ مِنْ قُدْسٍ وَلَمْ يُعْطِهِ حَقَّ مُسْلِمٍ 11798 وَأَخْبَرَنَا مُحَمَّدٌ ثنا أَبُو الْعَبَّاسِ مُحَمَّدٌ ثنا حُسَيْنُ بْنُ مُحَمَّدٍ ثنا أَبُو أُوَيْسٍ عَنْ ثَوْرِ بْنِ زَيْدٍ مَوْلَى بَنِي الدِّيلِ بْنِ بَكْرِ بْنِ كِنَانَةَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ ﷺ مِثْلَهُ
[Machine] By Allah, I planned it with my own hands. Abu Bakr al-Zubayr claimed ownership of a piece of land and I was writing it down. Then Umar came and Abu Bakr handed him the book and he placed it between the folds of the mattress. Umar entered and said, "It seems like you're in need?" Abu Bakr replied, "Yes." Then he went out and Abu Bakr took out the book and I completed it.
وَاللهِ خَطَطْتُهُ بِيَدِي أَقْطَعَ أَبُو بَكْرٍ الزُّبَيْرَ ؓ أَرْضًا فَكُنْتُ أَكْتُبُهَا قَالَ فَجَاءَ عُمَرُ فَأَخَذَ أَبُو بَكْرٍ يَعْنِي الْكِتَابَ فَأَدْخَلَهُ فِي ثِنْيِ الْفِرَاشِ فَدَخَلَ عُمَرُ ؓ فَقَالَ كَأَنَّكُمْ عَلَى حَاجَةٍ؟ فَقَالَ أَبُو بَكْرٍ ؓ نَعَمْ فَخَرَجَ فَأَخْرَجَ أَبُو بَكْرٍ الْكِتَابَ فَأَتْمَمْتُهُ
30.6 [Machine] All dead beings are equal, with no owner wherever they may be.
٣٠۔٦ بَابٌ: سَوَاءٌ كُلُّ مَوَاتٍ لَا مَالِكَ لَهُ أَيْنَ كَانَ
[Machine] My father took me to the Messenger of Allah ﷺ when I was a young boy. He prayed for blessings upon me, wiped my head, and drew a house for me in Madinah with a bow. Then he said, "Shall I add something for you?"
انْطَلَقَ بِي أَبِي إِلَى رَسُولِ اللهِ ﷺ وَأَنَا غُلَامٌ شَابٌّ فَدَعَا لِي بِالْبَرَكَةِ وَمَسَحَ رَأْسِي وَخَطَّ لِي دَارًا بِالْمَدِينَةِ بِقَوْسٍ ثُمَّ قَالَ أَلَا أَزِيدُكَ؟
[Machine] When the Messenger of Allah ﷺ arrived at Medina, he cut off the people in their homes. One man from the tribe of Banu Zuhra called Haysah, who is referred to as the son of Umm Abd, said to him, "Remove Ibn Umm Abd from us." The Messenger of Allah ﷺ said, "Why did Allah send me then? Indeed, Allah does not sanctify a nation in which the rights of the weak are not taken."
لَمَّا قَدِمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ أَقْطَعَ النَّاسَ الدُّورَ فَقَالَ لَهُ حَيٌّ مِنْ بَنِي زُهْرَةَ يُقَالُ لَهُمْ بَنُو عَبْدِ بْنِ زُهْرَةَ نَكِّبْ عَنَّا ابْنَ أُمِّ عَبْدٍ فَقَالَ رَسُولُ اللهِ ﷺ فَلِمَ ابْتَعَثَنِي اللهُ إِذًا؟ أَنَّ اللهَ ﷻ لَا يُقَدِّسُ أُمَّةً لَا يُؤْخَذُ لِلضَّعِيفِ فِيهِمْ حَقُّهُ؟
[Machine] That the Messenger of Allah ﷺ granted land to Zubayr, and that Umar ibn al-Khattab granted all of the Aqiq and asked, "Where are those who were granted?" Imam Shafi'i (may Allah have mercy on him) said, "The Aqiq is close to the city."
أَنَّ رَسُولَ اللهِ ﷺ أَقْطَعَ الزُّبَيْرَ أَرْضًا 11802 وَأَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ أَقْطَعَ الْعَقِيقَ أَجْمَعَ وَقَالَ أَيْنَ الْمُسْتَقْطَعُونَ؟ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَالْعَقِيقُ قَرِيبٌ مِنَ الْمَدِينَةِ
[Machine] That the Messenger of Allah, ﷺ , slaughtered a camel and that Abu Bakr slaughtered a camel and that Umar slaughtered the people for the Aqiqah.
أَنَّ رَسُولَ اللهِ ﷺ أَقْطَعَ الزُّبَيْرَ وَأَنَّ أَبَا بَكْرٍ أَقْطَعَ وَأَنَّ عُمَرَ أَقْطَعَ النَّاسَ الْعَقِيقَ
[Machine] I was carrying the news from the land of Zubayr that the Messenger of Allah ﷺ appointed me to deliver. It was from me for two-thirds of a farasakh, and they mentioned it in the authentic hadith of Abu Usama.
كُنْتُ أَنْقُلُ النَّوَى مِنْ أَرْضِ الزُّبَيْرِ الَّتِي أَقْطَعَهُ رَسُولُ اللهِ ﷺ عَلَى رَأْسِي وَهِيَ مِنِّي عَلَى ثُلُثَيْ فَرْسَخٍ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ أَبِي أُسَامَةَ
30.7 [Machine] What came in the fever
٣٠۔٧ بَابُ مَا جَاءَ فِي الْحِمَى
[Machine] The Messenger of Allah ﷺ said, "There is no contagious disease except for Allah and His Messenger ﷺ ." And it has reached us that the Messenger of Allah ﷺ prevented the spread of plague. And it has also reached us that Umar ibn Al-Khattab prevented the spread of leprosy. This is the wording of the hadith of Ubaid.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا حِمَى إِلَّا لِلَّهِ وَلِرَسُولِهِ قَالَ وَبَلَغَنَا أَنَّ رَسُولَ اللهِ ﷺ حَمَى النَّقِيعَ وَأَنَّ عُمَرَ بْنَ الْخَطَّابِ حَمَى الشَّرَفَ وَالرَّبَذَةَ لَفْظُ حَدِيثِ عُبَيْدٍ
[Machine] I heard the Messenger of Allah ﷺ saying, "There is no protection (i.e. security) except for Allah and His Messenger." Az-Zuhri (may Allah have mercy on him) said, "It is known that 'Umar ibn Al-Khattab had a fever, and it reached me that he used to protect him for the sake of the charity camels."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا حِمَى إِلَّا لِلَّهِ وَلِرَسُولِهِ قَالَ الزُّهْرِيُّ رَحِمَهُ اللهُ وَقَدْ كَانَ لِعُمَرَ بْنِ الْخَطَّابِ حِمًى بَلَغَنِي أَنَّهُ كَانَ يَحْمِيهِ لِإبلِ الصَّدَقَةِ
[Machine] That the Messenger of Allah ﷺ forbade the practice of burying newborn girls alive and said, "There is no protection except by Allah and His Messenger." Al-Bukhari said, "This is a false claim." The Sheikh said, "Because his statement about forbidding the practice of burying newborn girls alive is not from the saying of Al-Zuhri, and the same was said by Ibn Abi Al-Zinad from Abdul Rahman ibn Al-Harith."
أَنَّ رَسُولَ اللهِ ﷺ حَمَى النَّقِيعَ وَقَالَ لَا حِمَى إِلَّا لِلَّهِ وَلِرَسُولِهِ قَالَ الْبُخَارِيُّ هَذَا وَهْمٌ قَالَ الشَّيْخُ لِأَنَّ قَوْلَهُ حَمَى النَّقِيعَ مِنْ قَوْلِ الزُّهْرِيِّ وَكَذَلِكَ قَالَهُ ابْنُ أَبِي الزِّنَادِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ
[Machine] The Prophet ﷺ prohibited cutting the forelocks of the horses owned by Muslim men that they use for grazing.
أَنَّ النَّبِيَّ ﷺ حَمَى النَّقِيعَ لِخَيْلِ الْمُسْلِمِينَ تَرْعَى فِيهِ
عَنْ مَالِكٍ
[Machine] That they should come to him and they came to him and said to him, "Call upon the Qur'an and open the seventh (chapter)." And they used to call it the seventh chapter of Surah Yunus. So he recited it until he reached this verse {Have you seen what Allah has sent down to you of provision and made some of it unlawful and some lawful? Say, "Has Allah permitted you [to do so], or do you invent [something] about Allah?"} They said to him, "Stop, have you seen what you have forbidden from the forbidden things, has Allah permitted you or are you inventing?" So he said, "Continue, it was revealed regarding this and this. As for the forbidden things, indeed, Umar has forbidden them before me for the sake of the charity camels. When I became the ruler, the number of charity camels increased, so I increased the forbidden things for what was increased in charity."
أَنْ يَقْدَمُوا عَلَيْهِ الْمَدِينَةَ فَأَتَوْهُ فَقَالُوا لَهُ ادْعُ بِالْمُصْحَفِ وَافْتَحِ السَّابِعَةَ وَكَانُوا يُسَمُّونَ سُورَةَ يُونُسَ السَّابِعَةَ فَقَرَأَهَا حَتَّى أَتَى عَلَى هَذِهِ الْآيَةِ {أَفَرَأَيْتُمْ مَا أَنْزَلَ اللهُ لَكُمْ مِنْ رِزْقٍ فَجَعَلْتُمْ مِنْهُ حَرَامًا وَحَلَالًا قُلْ آللَّهُ أَذِنَ لَكُمْ أَمْ عَلَى اللهِ تَفْتَرَونَ} قَالُوا لَهُ قِفْ أَرَأَيْتَ مَا حَمَيْتَ مِنَ الْحِمَى آللَّهُ أَذِنَ لَكَ أَمْ عَلَى اللهِ تَفْتَرِي؟ فَقَالَ امْضِهْ نَزَلَتْ فِي كَذَا وَكَذَا فَأَمَّا الْحِمَى فَإِنَّ عُمَرَ حَمَى الْحِمَى قَبْلِي لِإبلِ الصَّدَقَةِ فَلَمَّا وُلِّيتُ زَادَتْ إِبِلُ الصَّدَقَةِ فَزِدْتُ فِي الْحِمَى لِمَا زَادَ فِي الصَّدَقَةِ
[Machine] I said, "I have purchased some camels and sent them to the pasture seeking what the Muslims seek." He (Umar ibn al-Khattab) said, "Take care of the camels of the son of the Commander of the Believers. Water the camels of the son of the Commander of the Believers, O Abdullah ibn Umar. Go with Malik to his share and leave the rest in the treasury of the Muslims." This narration indicates that besides the Prophet ﷺ , no one has the right to protect themselves, and it also indicates that the statement of the Prophet ﷺ , "There is no protection except from Allah and His Messenger," means that there is no protection except for the same one that His Messenger protected in the welfare of the Muslims. And Allah knows best.
قُلْتُ إِبِلٌ أَنْضَاءُ اشْتَرَيْتُهَا وَبَعَثَتُ بِهَا إِلَى الْحِمَى أَبْتَغِي مَا يَبْتَغِي الْمُسْلِمُونَ قَالَ فَقَالَ ارْعَوْا إِبِلَ ابنِ أَمِيرِ الْمُؤْمِنِينَ اسْقُوا إِبِلَ ابْنِ أَمِيرِ الْمُؤْمِنِينَ يَا عَبْدَ اللهِ بْنَ عُمَرَ اغْدُ عَلَى رَأْسِ مَالِكَ وَاجْعَلْ بَاقِيَهُ فِي بَيْتِ مَالِ الْمُسْلِمِينَ هَذَا الْأَثَرُ يَدُلُّ عَلَى أَنَّ غَيْرَ النَّبِيِّ ﷺ لَيْسَ لَهُ أَنْ يَحْمِيَ لِنَفْسِهِ وَفِيهِ وَفِيمَا قَبْلَهُ دَلَالَةٌ عَلَى أَنَّ قَوْلَ النَّبِيِّ ﷺ لَا حِمَى إِلَّا لِلَّهِ وَرَسُولِهِ أَرَادَ بِهِ أَنْ لَا حِمَى إِلَّا عَلَى مِثْلِ مَا حَمَى عَلَيْهِ رَسُولُهُ فِي صَلَاحِ الْمُسْلِمِينَ وَاللهُ أَعْلَمُ
30.8 [Machine] What does it mean to be alive and what is expected in return?
٣٠۔٨ بَابُ مَا يَكُونُ إِحْيَاءً، وَمَا يُرْجَى فِيهِ مِنَ الْأَجْرِ
[Machine] The Prophet ﷺ said, "Whoever develops a land that belongs to no one, he is more entitled to it." Urwah said, "Umar ibn al-Khattab implemented this during his caliphate."
النَّبِيِّ ﷺ قَالَ مَنْ عَمَّرَ أَرْضًا لَيْسَتْ لِأَحَدٍ فَهُوَ أَحَقُّ بِهَا قَالَ عُرْوَةُ قَضَى بِذَلِكَ عُمَرُ بْنُ الْخَطَّابِ فِي خِلَافَتِهِ
[Machine] The messenger of Allah ﷺ said, "Whoever revives a dead land, it is more rightful for him, and there is no right for an oppressor."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحْيَا مَوَاتًا مِنَ الْأَرْضِ فَهُوَ أَحَقُّ بِهِ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
[Machine] The Messenger of Allah ﷺ said: "Whoever brings life to a dead land, for him is the reward of what the living beings have eaten, and it is a form of charity for him." And Abu Abdullah Al-Hafiz and Abu Saeed bin Abi Amr reported to us, they said: Abu Abbas narrated to us, he said: Ahmed bin Abdul Jabbar narrated to us, he said: Abu Muawiya informed us from Hisham, from Ubaidullah bin Abdul Rahman bin Rafi, from Jabir bin Abdullah, he said: The Messenger of Allah ﷺ said: "He mentioned it to me except that it is a form of charity for him." And Hammad bin Zaid narrated it from Hisham, from Wahb bin Kaysan, from Jabir, and Abu Hassan Al-Muqri informed us, and Al-Hasan bin Muhammad bin Ishaq narrated to us, Yusuf bin Ya'qub narrated to us, Muhammad bin Ubaid narrated to us, Hammad bin Zaid narrated to us, Hisham bin Urwah mentioned it, except that he said: "And it is for him." And Abu Hassan Al-Muqri informed us, Al-Hasan bin Muhammad bin Ishaq narrated to us, Yusuf bin Ya'qub narrated to us, Abdul Wahid bin Ghayath narrated to us, Hammad bin Salama narrated to us, from Abu Al-Zubair, from Jabir, that the Prophet ﷺ mentioned it in a similar Hadith to the Hadith of Abu Muawiya from Hisham, with the addition of birds and wild animals.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَلَهُ فِيهَا أَجْرُ مَا أَكَلَتِ الْعَافِيَةُ فَهُوَ لَهُ صَدَقَةٌ 11815 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ ثنا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ ثنا أَبُو مُعَاوِيَةَ عَنْ هِشَامٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ رَافِعٍ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ قَالَ رَسُولُ اللهِ ﷺ فَذَكَرَهُ زَادَ مِنْهَا فَهُوَ لَهُ صَدَقَةٌ 11816 وَرَوَاهُ حَمَّادُ بْنُ زَيْدٍ عَنْ هِشَامٍ عَنْ وَهْبِ بْنِ كَيْسَانَ عَنْ جَابِرٍ أَخْبَرَنَاهُ أَبُو الْحَسَنِ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ عُبَيْدٍ ثنا حَمَّادُ بْنُ زَيْدٍ ثنا هِشَامُ بْنُ عُرْوَةَ فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ فَهِيَ لَهُ 11817 وَأَخْبَرَنَا أَبُو الْحَسَنِ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا عَبْدُ الْوَاحِدِ بْنُ غِيَاثٍ ثنا حَمَّادُ بْنُ سَلَمَةَ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ أَنَّ النَّبِيَّ ﷺ قَالَ فَذَكَرَهُ بِمِثْلِ حَدِيثِ أَبِي مُعَاوِيَةَ عَنْ هِشَامٍ زَادَ يَعْنِي الطَّيْرَ وَالسِّبَاعَ
The Prophet ﷺ said: If anyone surrounds a land with a wall, it belongs to him. (Using translation from Abū Dāʾūd 3077)
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحَاطَ حَائِطًا عَلَى أَرْضٍ فَهِيَ لَهُ
[Machine] The Messenger of Allah ﷺ said, "Whatever I have informed you about, it is for you, and whatever I have not informed you about, it is for Allah and His Messenger."
قَالَ رَسُولُ اللهِ ﷺ مَا أَحَطْتُمْ عَلَيْهِ فَهُوَ لَكُمْ وَمَا لَمْ يُحِطْ عَلَيْهِ فَهُوَ لِلَّهِ وَلِرَسُولِهِ
[Machine] People used to abandon land during the time of Umar. So he said, "Whoever brings life to a land, it belongs to him, with all its produce." Yahya said, "It is as if he did not allow for it to belong to him until he brings it to life."
كَانَ النَّاسُ يَحْجُرَونَ عَلَى عَهْدِ عُمَرَ ؓ فَقَالَ مَنْ أَحْيَا أَرْضًا فَهِيَ لَهُ زَادَ مَالِكٌ مَوَاتًا قَالَ يَحْيَى كَأَنَّهُ لَمْ يَجْعَلْهَا لَهُ بِالتَّحَجُّرِ حَتَّى يُحْيِيَهَا
[Machine] That Umar made the stoning punishment three years, so if he leaves it until three years pass and someone else revives it, he is more deserving of it.
أَنَّ عُمَرَ جَعَلَ التَّحَجُّرَ ثَلَاثَ سِنِينَ فَإِنْ تَرَكَهَا حَتَّى يَمْضِيَ ثَلَاثُ سِنِينَ فَأَحْيَاهَا غَيْرُهُ فَهُوَ أَحَقُّ بِهَا
[Machine] Everyone has only what their walls surround them with. Indeed, reviving the dead can only be done through planting or digging, or by being surrounded by walls. The Sheikh said, "His statement that reviving the dead until its end is, I think, from the statement of Al-Shafi'i, for he said"
لَيْسَ لِأَحَدٍ إِلَّا مَا أَحَاطَتْ عَلَيْهِ جُدْرَانُهُ إِنَّ إِحْيَاءَ الْمَوَاتِ مَا يَكُونُ زَرْعًا أَوْ حَفِيرًا أَوْ يُحَاطُ بِالْجُدْرَانِ قَالَ الشَّيْخُ قَوْلُهُ إِنَّ إِحْيَاءَ الْمَوَاتِ إِلَى آخِرِهِ أَظُنُّهُ مِنْ قَوْلِ الشَّافِعِيِّ؛ فَقَدْ
[Machine] To reward them for what they have revived with a structure or cultivation.
أَنْ أَجِزْ لَهُمْ مَا أَحْيَوْا بِبُنْيَانٍ أَوْ حَرْثٍ
30.9 [Machine] Who has cut off a piece of land or encroached on a piece of land and then did not develop it or only developed some of it.
٣٠۔٩ بَابُ مَنْ أَقْطَعَ قَطِيعَةً أَوْ تَحَجَّرَ أَرْضًا ثُمَّ لَمْ يَعْمُرْهَا أَوْ لَمْ يَعْمُرْ بَعْضَهَا
[Machine] The Messenger of Allah, ﷺ , took charity from the tribal mines, and he used to give Bilal ibn al-Harith the aqeeq stone to cut for him. When Umar (may Allah be pleased with him) became the caliph, he said to Bilal, "The Messenger of Allah did not cut you off to exclude you from people, he only cut for you to work." Bilal said, "So Umar ibn al-Khattab cut aqeeq stones for the people."
أَنَّ رَسُولَ اللهِ ﷺ أَخَذَ مِنَ الْمَعَادِنِ الْقَبَلِيَّةِ الصَّدَقَةَ وَإِنَّهُ أَقْطَعَ بِلَالَ بْنَ الْحَارِثِ الْعَقِيقَ أَجْمَعَ فَلَمَّا كَانَ عُمَرُ ؓ قَالَ لِبِلَالٍ إِنَّ رَسُولَ اللهِ ﷺ لَمْ يُقْطِعْكَ لِتُحْجِرَهُ عَنِ النَّاسِ لَمْ يُقْطِعْكَ إِلَّا لِتَعْمَلَ قَالَ فَأَقْطَعَ عُمَرُ بْنُ الْخَطَّابِ لِلنَّاسِ الْعَقِيقَ
