30. Giving Life to the Dead Land

٣٠۔ كِتَابُ إِحْيَاءِ الْمَوَاتِ

30.18 [Machine] Date Palm is planted in a plot of land or a man has a palm tree between two rows of palm trees belonging to someone else, and they disagreed about its ownership.

٣٠۔١٨ بَابُ النَّخْلِ يُغْرَسُ فِي مَوَاتٍ، أَوْ يَكُونُ لِرَجُلٍ نَخْلَةٌ بَيْنَ ظَهْرَانَيْ نَخِيلٍ لِغَيْرِهِ فَاخْتَلَفَا فِي حَرِيمِهَا

[Machine] Two men disputed over a date palm tree, so the Prophet ﷺ cut a branch from it and shook it. He found it had five dates, so he gave them to the woman who owned the tree. Yahya ibn Muhammad reported to me from Ibn Abi Tuwala that he said, "He found it had seven dates." Abu al-Hasan ibn Abdan informed Ahmad ibn Ubayd, who narrated from Abbas ibn al-Fadl, who narrated from Ibn Kaseb, who narrated from Abdul Aziz ibn Muhammad, who narrated from Abu Tuwala Abdul Rahman ibn Ma'mar, who narrated from Amr ibn Yahya al-Mazini, who narrated from his father, who narrated from Abu Sa'id al-Khudri, who mentioned it in the hadith of Amr. He found it had five cubits, and Abu Tuwala said it had seven cubits.  

البيهقي:١١٨٦٤أَخْبَرَنَا أَبُو الْحَسَنِ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْحَسَنِ بْنِ إِسْحَاقَ الْبَزَّازُ بِبَغْدَادَ أنبأ أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ الْفَاكِهِيُّ ثنا أَبُو يَحْيَى بْنُ أَبِي مَسَرَّةَ ثنا يَحْيَى بْنُ مُحَمَّدٍ الْجَارِيُّ ثنا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ عَنْ عَمْرِو بْنِ يَحْيَى عَنْ أَبِيهِ قَالَ عَبْدُ الْعَزِيزِ لَا أَعْلَمُهُ إِلَّا عَنْ أَبِي سَعِيدٍ قَالَ

اخْتَصَمَ رَجُلَانِ فِي نَخْلَةٍ فَقَطَعَ النَّبِيُّ ﷺ جَرِيدَةً مِنْ جَرِيدِهَا فَذَرَعَهَا فَوَجَدَهَا خَمْسًا فَجَعَلَهَا حَرِيمَهَا قَالَ يَحْيَى بْنُ مُحَمَّدٍ وَأَخْبَرَنِيهِ ابْنُ أَبِي طُوَالَةَ أَنَّهُ قَالَ وَجَدَهَا سَبْعًا 11865 وَأَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا عَبَّاسُ بْنُ الْفَضْلِ ثنا ابْنُ كَاسِبٍ ثنا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ عَنْ أَبِي طُوَالَةَ عَبْدِ اللهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ مَعْمَرٍ وَعَمْرِو بْنِ يَحْيَى الْمَازِنِيِّ عَنْ أَبِيهِ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ فَذَكَرَهُ فِي حَدِيثِ عَمْرٍو فَوَجَدَهُ خَمْسَةَ أَذْرُعٍ وَقَالَ أَبُو طُوَالَةَ سَبْعَةَ أَذْرُعٍ

[Machine] Indeed, from the rulings of the Messenger of Allah ﷺ is that he ruled in regards to the single palm tree, the two palm trees, and the three palm trees, for a man who possessed palm trees and they disagreed regarding their rights. So he ruled that each palm tree should be given its full amount of dates. And in what Abu Dawood narrated in the Maraseel with his chain of narration from Uruwah ibn Zubayr, he said that the Messenger of Allah ﷺ ruled regarding the length of the palm tree's shade.  

البيهقي:١١٨٦٦أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ ثنا الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا فُضَيْلُ بْنُ سُلَيْمَانَ ثنا مُوسَى بْنُ عُقْبَةَ حَدَّثَنِي إِسْحَاقُ بْنُ يَحْيَى بْنِ الْوَلِيدِ بْنِ عُبَادَةَ عَنْ عُبَادَةَ بْنِ الصَّامِتِ ؓ قَالَ

إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّهُ قَضَى فِي النَّخْلَةِ وَالنَّخْلَتَيْنِ وَالثَّلَاثَةِ لِرَجُلٍ فِي نَخْلٍ فَيَخْتَلِفُونَ فِي حُقُوقِ ذَلِكَ فَقَضَى أَنَّ لِكُلِّ نَخْلَةٍ لِأُولَئِكَ مِنَ الْأَرْضِ مَبْلَغَ جَرِيدِهَا وَفِيمَا رَوَى أَبُو دَاوُدَ فِي الْمَرَاسِيلِ بِإِسْنَادِهِ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ قَالَ قَضَى رَسُولُ اللهِ ﷺ فِي حَرِيمِ النَّخْلِ طُولَ عَسِيبِهَا
