30. Giving Life to the Dead Land
٣٠۔ كِتَابُ إِحْيَاءِ الْمَوَاتِ
An Ansari man quarreled with Az-Zubair in the presence of the Prophet ﷺ about the Harra Canals which were used for irrigating the date-palms. The Ansari man said to Az-Zubair, "Let the water pass' but Az-Zubair refused to do so. So, the case was brought before the Prophet ﷺ who said to Az-Zubair, "O Zubair! Irrigate (your land) and then let the water pass to your neighbor." On that the Ansari got angry and said to the Prophet, "Is it because he (i.e. Zubair) is your aunt's son?" On that the color of the face of Messenger of Allah ﷺ changed (because of anger) and he said, "O Zubair! Irrigate (your land) and then withhold the water till it reaches the walls between the pits round the trees." Zubair said, "By Allah, I think that the following verse was revealed on this occasion": "But no, by your Lord They can have No faith Until they make you judge In all disputes between them." أَنَّ رَجُلًا مِنَ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ عِنْدَ رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ فَقَالَ الْأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرُّ فَأَبَى عَلَيْهِ فَاخْتَصَمَا عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْ إِلَى جَارِكَ فَغَضِبَ الْأَنْصَارِيُّ فَقَالَ يَا رَسُولَ اللهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ فَقَالَ الزُّبَيْرُ ؓ وَاللهِ إِنِّي لَأَحْسِبُ هَذِهِ الْآيَةَ نَزَلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء 65] إِلَى قَوْلِهِ {وَيُسَلِّمُوا تَسْلِيمًا} [النساء 65]
Az-Zubair quarrelled with a man from the Ansar because of a natural mountainous stream at Al-Harra. The Prophet ﷺ said "O Zubair! Irrigate (your lands and the let the water flow to your neighbor The Ansar said, "O Messenger of Allah ﷺ (This is because) he (Zubair) is your cousin?" At that, the Prophet's face became red (with anger) and he said "O Zubair! Irrigate (your land) and then withhold the water till it fills the land up to the walls and then let it flow to your neighbor." So the Prophet ﷺ enabled Az- Zubair to take his full right after the Ansari provoked his anger. The Prophet ﷺ had previously given a order that was in favor of both of them Az-Zubair said, "I don't think but the Verse was revealed in this connection: "But no, by your Lord, they can have no faith, until they make you judge in all disputes between them." النَّبِيُّ ﷺ اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْهُ إِلَى جَارِكَ فَقَالَ الْأَنْصَارِيُّ يَا رَسُولَ اللهِ وَأَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ اسْقِ يَا زُبَيْرُ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ ثُمَّ أَرْسِلِ الْمَاءَ إِلَى جَارِكَ فَقَالَ وَاسْتَوْعَبَ رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ حَقَّهُ فِي صَرِيحِ الْحُكْمِ حِينَ أَحْفَظَهُ الْأَنْصَارِيُّ وَكَانَ أَشَارَ عَلَيْهِمَا قَبْلَ ذَلِكَ بِأَمْرٍ كَانَ لَهُمَا فِيهِ سَعَةٌ قَالَ الزُّبَيْرُ فَمَا أَحْسِبُ هَذِهِ الْآيَةَ إِلَّا نَزَلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء 65] قَالَ فَسَمِعْتُ غَيْرَ الزُّهْرِيِّ يَقُولُ نَظَرْتُ فِي قَوْلِ النَّبِيِّ ﷺ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ فَكَانَ ذَلِكَ إِلَى الْكَعْبَيْنِ
[Machine] The Messenger of Allah ﷺ said, "Give water to drink, then hold it back until the water returns to the gullet." Abu Amr Al-Adib narrated to us, Abu Bakr Al-Isma'ili informed me, Abdullah bin Muhammad bin Muslim narrated to me, Yusuf bin Sa'id narrated to me, Hujjaj narrated from Ibn Jurayj, who narrated from Ibn Shihab, and he mentioned it. He said, "And Ibn Shihab said, 'Restraining oneself with a piece of cloth."
قَالَ رَسُولُ اللهِ ﷺ اسْقِ ثُمَّ احْبِسْ حَتَّى يَرْجِعَ الْمَاءُ إِلَى الْجَدْرِ كَانَ ذَلِكَ إِلَى الْكَعْبَيْنِ أَخْبَرَنَاهُ أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ مُسْلِمٍ ثنا يُوسُفُ بْنُ سَعِيدٍ ثنا حَجَّاجٌ عَنِ ابْنِ جُرَيْجٍ عَنِ ابْنِ شِهَابٍ فَذَكَرَهُ قَالَ وَقَالَ ابْنُ شِهَابٍ إِخَاذٌ بِالْحَرَّةِ يَحْبِسُ الْمَاءَ
Tha'labah heard his elders say that a man from the Quraysh had his share with Banu Qurayzah (in water). He brought the dispute to the Messenger of Allah ﷺ about al-Mahzur, a stream whose water they shared together. The Messenger of Allah ﷺ then decided that when water reached the ankles waters should not be held back to flow to the lower. (Using translation from Abū Dāʾūd 3638)
أَنَّ رَجُلًا مِنْ قُرَيْشٍ كَانَ لَهُ سَهْمٌ فِي بَنِي قُرَيْظَةَ فَخَاصَمَ إِلَى رَسُولِ اللهِ ﷺ فِي مَهْزُورِ السَّيْلِ الَّذِي يَقْتَسِمُونَ مَاءَهُ فَقَضَى بَيْنَهُمْ رَسُولُ اللهِ ﷺ إِنَّ الْمَاءَ إِلَى الْكَعْبَيْنِ لَا يَحْبِسُ الْأَعْلَى عَنِ الْأَسْفَلِ
'Amr bin Shu'aib on his father's authority said that his grandfather told that the Messenger of Allah ﷺ decided regarding the stream al-Mahzur that its water should be held back till it reached the ankles, and that the upper waters should then be allowed to flow to the lower. أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِي السَّيْلِ الْمَهْزُورِ أَنْ يُمْسَكَ حَتَّى يَبْلُغَ إِلَى الْكَعْبَيْنِ ثُمَّ يُرْسِلُ الْأَعْلَى عَلَى الْأَسْفَلِ
the Messenger of Allah ﷺ ruled concerning the irrigation of palm trees from streams, that the higher ground should be irrigated before the lower, and that the water should be allowed to reach the ankles, then released to flow the nearest lower ground, and so on, until all the fields were watered or until the water ran out. إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّهُ قَضَى فِي مَشْرَبِ النَّخْلِ مِنَ السَّيْلِ أَنَّ الْأَعْلَى فَالْأَعْلَى يَشْرَبُ قَبْلَ الْأَسْفَلِ وَيُتْرَكُ فِيهِ الْمَاءُ إِلَى الْكَعْبَيْنِ ثُمَّ يُرْسَلُ الْمَاءُ إِلَى الْأَسْفَلِ الَّذِي يَلِيهِ وَكَذَلِكَ حَتَّى يَنْقَضِيَ الْحَوَائِطُ إِسْحَاقُ بْنُ يَحْيَى بْنِ عُبَادَةَ مُرْسَلٌ
