30. Giving Life to the Dead Land (2/3)
٣٠۔ كِتَابُ إِحْيَاءِ الْمَوَاتِ ص ٢
[Machine] Bilal ibn al-Harith al-Muzani came to the Messenger of Allah ﷺ, so he gave him a piece of land. When Umar became the caliph, he said to him, "O Bilal, you took a long and wide piece of land that the Messenger of Allah ﷺ had given you, but the Messenger of Allah ﷺ did not withhold anything that was asked of him. However, you are unable to manage what is in your possession." Bilal replied, "Yes." Umar said, "Then see what you can handle from it, keep it, and whatever you cannot manage, return it to us so that we can distribute it among the Muslims." Bilal refused, saying, "By Allah, I will not do that. The Messenger of Allah ﷺ cut it for me." Umar said, "By Allah, you will do it." So, he took from Bilal what he was unable to manage and divided it among the Muslims.
جَاءَ بِلَالُ بْنُ الْحَارِثِ الْمُزَنِيُّ إِلَى رَسُولِ اللهِ ﷺ فَاسْتَقْطَعَهُ أَرْضًا فَقَطَعَهَا لَهُ طَوِيلَةً عَرِيضَةً فَلَمَّا وَلِيَ عُمَرُ قَالَ لَهُ يَا بِلَالُ إِنَّكَ اسْتَقْطَعْتَ رَسُولَ اللهِ ﷺ أَرْضًا طَوِيلَةً عَرِيضَةً قَطَعَهَا لَكَ وَإِنَّ رَسُولَ اللهِ ﷺ لَمْ يَكُنْ لِيَمْنَعَ شَيْئًا يُسْأَلُهُ وَإِنَّكَ لَا تُطِيقُ مَا فِي يَدَيْكَ فَقَالَ أَجَلْ قَالَ فَانْظُرْ مَا قَوِيتَ عَلَيْهِ مِنْهَا فَأَمْسِكْهُ وَمَا لَمْ تُطِقْ فَادْفَعْهُ إِلَيْنَا نَقْسِمْهُ بَيْنَ الْمُسْلِمِينَ فَقَالَ لَا أَفْعَلُ وَاللهِ شَيْءٌ أَقْطَعَنِيهِ رَسُولُ اللهِ ﷺ فَقَالَ عُمَرُ وَاللهِ لَتَفْعَلَنَّ فَأَخَذَ مِنْهُ مَا عَجَزَ عَنْ عِمَارَتِهِ فَقَسَمَهُ بَيْنَ الْمُسْلِمِينَ
[Machine] The Prophet ﷺ slaughtered one sheep. When Omar grew older, he gave him a part of it and distributed the rest to the people.
قَطَعَ النَّبِيُّ ﷺ الْعَقِيقَ رَجُلًا وَاحِدًا فَلَمَّا كَانَ عُمَرُ ؓ كَثُرَ عَلَيْهِ فَأَعْطَاهُ بَعْضَهُ وَقَطَعَ سَائِرَهُ النَّاسَ
30.10 [Machine] Who Cut a Piece and Sold It
٣٠۔١٠ بَابُ مَنْ أُقْطِعَ قَطِيعَةً فَبَاعَهَا
The Prophet ﷺ alighted at a place where a mosque has been built under a large tree. He tarried there for three days, and then proceeded to Tabuk. Juhaynah met him on a wide plain. He asked them: who are the people of Dhul-Marwah? They replied: Banu Rifa'ah of Juhaynah. He said: I have given this (land) to Banu Rifa'ah as a fief. Therefore, they divided it. Some of them sold (their share) and others retained and worked on it. (Sub-narrator Ibn Wahab said: I then asked AbdulAziz about this tradition. He narrated a part of it to me and did not narrate it in full. (Using translation from Abū Dāʾūd 3068)
أَنَّ النَّبِيَّ ﷺ نَزَلَ فِي مَوْضِعِ الْمَسْجِدِ تَحْتَ دَوْمَةٍ فَأَقَامَ ثَلَاثًا ثُمَّ خَرَجَ إِلَى تَبُوكَ وَإِنَّ جُهَيْنَةَ لَحِقُوهُ بِالرَّحْبَةِ فَقَالَ لَهُمْ مَنْ أَهْلُ ذِي الْمَرْوَةِ؟ فَقَالُوا بَنُو رِفَاعَةَ مِنْ جُهَيْنَةَ فَقَالَ قَدِ أَقْطَعْتُهَا لِبَنِي رِفَاعَةَ فَاقْتَسَمُوهَا فَمِنْهُمْ مَنْ بَاعَ وَمِنْهُمْ مَنْ أَمْسَكَ فَعَمِلَ ثُمَّ سَأَلْتُ أَبَاهُ عَبْدَ الْعَزِيزِ عَنْ هَذَا الْحَدِيثِ فَحَدَّثَنِي بِبَعْضِهِ وَلَمْ يُحَدِّثْنِي بِهِ كُلِّهِ
30.11 [Machine] What is not permissible to be deducted from apparent minerals
٣٠۔١١ بَابُ مَا لَا يَجُوزُ إِقْطَاعُهُ مِنَ الْمَعَادِنِ الظَّاهِرَةِ
Abyad went to the Messenger of Allah ﷺ and asked him for assigning him (the mines of) salt as fief. (The narrator Ibn al-Mutawakkil said: which was in Ma'arib.) So he assigned it to him as a fief. When he returned, a man in the meeting asked: Do you know what you have assigned him as a fief? You have assigned him the perennial spring water. So he took it back from him. He asked him about protecting land which had arak trees growing in it. He replied: He could have such as was beyond the region where the hoofs (of camels) went. The narrator Ibn al-Mutwakkil said: "that is the camel hoofs." (Using translation from Abū Dāʾūd 3064)
أَنَّهُ وَفَدَ إِلَى النَّبِيِّ ﷺ فَاسْتَقْطَعَهُ الْمِلْحَ قَالَ ابْنُ الْمُتَوَكِّلِ الَّذِي بِمَأْرِبَ فَقَطَعَهُ لَهُ فَلَمَّا أَنْ وَلَّى قَالَ رَجُلٌ مِنَ الْمَجْلِسِ أَتَدْرِي مَا قَطَعْتَ لَهُ إِنَّمَا قَطَعْتَ لَهُ الْمَاءَ الْعِدَّ قَالَ فَانْتُزِعَ مِنْهُ قَالَ وَسَأَلْتُهُ عَمَّا يُحْمَى مِنَ الْأَرَاكِ قَالَ مَا لَمْ تَنَلْهُ خِفَافٌ وَقَالَ ابْنُ الْمُتَوَكِّلِ أَخْفَافُ الْإِبِلِ
[Machine] The Prophet ﷺ asked for the salt that was in Ma'rib, intending to cut it. A man said, "It is like flowing water," so he refused to cut it. Al-Asma'ee said, "It is the perpetual flowing water that does not cease, and it is like the water of a spring and a well."
أَنَّهُ اسْتَقْطَعَ النَّبِيَّ ﷺ الْمِلْحَ الَّذِي بِمَأْرِبَ فَأَرَادَ أَنَ يُقْطِعَهُ إِيَّاهُ فَقَالَ رَجُلٌ إِنَّهُ كَالْمَاءِ الْعِدِّ فَأَبَى أَنَ يُقْطِعَهُ قَالَ الْأَصْمَعِيُّ الْمَاءُ الْعِدُّ الدَّائِمُ الَّذِي لَا انْقِطَاعَ لَهُ وَهُوَ مِثْلُ مَاءِ الْعَيْنِ وَمَاءِ الْبِئْرِ
My father sought permission from the Prophet ﷺ. (When permission was granted and he came near him) he lifted his shirt, and began to kiss him and embrace him (out of love for him). He asked: Messenger of Allah, what is the thing which it is unlawful to refuse? He replied: Water. He again asked: Prophet of Allah, what is the thing which it is unlawful to refuse? He replied: Salt. He again asked: Prophet of Allah, what is the thing which it is unlawful to refuse? He said: To do good is better for you. (Using translation from Abū Dāʾūd 1669)
قَالَتِ اسْتَأْذَنَ أَبِي النَّبِيَّ ﷺ فَدَخَلَ بَيْنَهُ وَبَيْنَ قَمِيصِهِ فَجَعَلَ يُقَبِّلُ وَيَلْتَزِمُ ثُمَّ قَالَ يَا نَبِيَّ اللهِ مَا الشَّيْءُ الَّذِي لَا يَحِلُّ مَنْعُهُ؟ قَالَ الْمَاءُ قَالَ يَا نَبِيَّ اللهِ مَا الشَّيْءُ الَّذِي لَا يَحِلُّ مَنْعُهُ؟ قَالَ الْمِلْحُ قَالَ يَا نَبِيَّ اللهِ مَا الشَّيْءُ الَّذِي لَا يَحِلُّ مَنْعُهُ؟ قَالَ أَنْ تَفْعَلَ الْخَيْرَ خَيْرٌ لَكَ
Abdullah ibn Hasan al-Anbari said: My grandmothers, Safiyyah and Duhaybah, narrated to me, that hey were the daughters of Ulaybah and were nourished by Qaylah, daughter of Makhramah. She was the grandmother of their father. She reported to them, saying: We came upon the Messenger of Allah ﷺ. My companion, Hurayth ibn Hassan, came to him as a delegate from Bakr ibn Wa'il. He took the oath of allegiance of Islam for himself and for his people. He then said: Messenger of Allah ﷺ, write a document for us, giving us the land lying between us and Banu Tamim at ad-Dahna' to the effect that not one of them will cross it in our direction except a traveller or a passer-by. He said: Write down ad-Dahna' for them, boy. When I saw that he passed orders to give it to him, I became anxious, for it was my native land and my home. I said: Messenger of Allah, he did not ask you for a true border when he asked you. This land of Dahna' is a place where the camels have their home, and it is a pasture for the sheep. The women of Banu Tamim and their children are beyond it. He said: Stop, boy! A poor woman spoke the truth: a Muslim is a brother of a Muslim. Each one of them may benefit from water and trees, and they should cooperate with each other against Satan. (Using translation from Abū Dāʾūd 3070)
حَدَّثَتْنِي جَدَّتَايَ صَفِيَّةُ وَدُحَيْبَةُ ابْنَتَا عُلَيْبَةَ وَكَانَتَا رَبِيبَتَيْ قَيْلَةَ بِنْتِ مَخْرَمَةَ وَكَانَتْ جَدَّةَ أَبِيهِمَا أَنَّهَا أَخْبَرَتْهُمَا قَالَتْ قَدِمْنَا عَلَى رَسُولِ اللهِ ﷺ قَالَتْ فَقَدِمَ صَاحِبِي تَعْنِي حُرَيْثَ بْنَ حَسَّانَ وَافِدَ بَنِي بَكْرِ بْنِ وَائِلٍ فَبَايَعَهُ عَلَى الْإِسْلَامِ عَلَيْهِ وَعَلَى قَوْمِهِ ثُمَّ قَالَ يَا رَسُولَ اللهِ اكْتُبْ بَيْنَنَا وَبَيْنَ بَنِي تَمِيمٍ بِالدَّهْنَاءِ أَنْ لَا يُجَاوِزَهَا إِلَيْنَا مِنْهُمْ إِلَّا مُسَافِرٌ أَوْ مُجَاوِرٌ فَقَالَ اكْتُبْ لَهُ يَا غُلَامُ بِالدَّهْنَاءِ فَلَمَّا رَأَيْتُهُ قَدْ أَمَرَ لَهُ بِهَا شُخِصَ بِي وَهِيَ وَطَنِي وَدَارِي فَقُلْتُ يَا رَسُولَ اللهِ إِنَّهُ لَمْ يَسْأَلْكَ السَّوِيَّةَ مِنَ الْأَرْضِ إِذْ سَأَلَكَ إِنَّمَا هِيَ هَذِهِ الدَّهْنَاءُ عِنْدَكَ مُقَيَّدُ الْجَمَلِ وَمَرْعَى الْغَنَمِ وَنِسَاءُ بَنِي تَمِيمٍ وَأَبْنَاؤُهَا وَرَاءَ ذَلِكَ فَقَالَ أَمْسِكْ يَا غُلَامُ صَدَقَتِ الْمِسْكِينَةُ الْمُسْلِمُ أَخُو الْمُسْلِمِ يَسَعُهُمَا الْمَاءُ وَالشَّجَرُ وَيَتَعَاوَنَانِ عَلَى الْفَتَّانِ
[Machine] He heard a man from the Muhajirin, from the companions of the Prophet ﷺ , saying, "I participated in three battles with the Prophet ﷺ , and I heard him saying, 'The Muslims are partners in three things: water, pasture, and fire.' Abu Khidash is Hubbān ibn Zayd al-Sharabi, and likewise..."
أَنَّهُ سَمِعَ رَجُلًا مِنَ الْمُهَاجِرِينَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَالَ غَزَوْتُ مَعَ النَّبِيِّ ﷺ ثَلَاثًا أَسْمَعُهُ يَقُولُ الْمُسْلِمُونَ شُرَكَاءُ فِي ثَلَاثٍ الْمَاءِ وَالْكَلَأِ وَالنَّارِ أَبُو خِدَاشٍ هُوَ حِبَّانُ بْنُ زَيْدٍ الشَّرْعَبِيُّ وَكَذَلِكَ
[Machine] From Thawr ibn Yazid that he narrated it to the Prophet ﷺ, he said, "The Muslims are partners in grazing land, water, and fire." Thawr transmitted it from Thawr and indeed Thawr took it from Hariz.
عَنْ ثَوْرِ بْنِ يَزِيدَ يَرْفَعُهُ إِلَى النَّبِيِّ ﷺ قَالَ الْمُسْلِمُونَ شُرَكَاءُ فِي الْكَلَأِ وَالْمَاءِ وَالنَّارِ أَرْسَلَهُ الثَّوْرِيُّ عَنْ ثَوْرٍ وَإِنَّمَا أَخَذَهُ ثَوْرٌ عَنْ حَرِيزٍ
[Machine] About a man from the companions of the Prophet ﷺ who said, "I participated in seven or three military expeditions with the Prophet ﷺ and I heard him saying, 'Muslims are partners in three things: water, pasture, and fire.'" He said, "I also heard Abu Hafs saying that I asked Mu'adh (may Allah be pleased with him) about this matter and he narrated to me that Hariz ibn Uthman narrated to us that Hibban ibn Zaid ash-Sharabi narrated from a man from the companions of the Prophet ﷺ who said, 'I participated in a military expedition with the Prophet ﷺ .' Abu Hafs then came to us and Yazid ibn Harun narrated to us which I think is from Hariz. Hibban ibn Zaid ash-Sharabi. As for Yazid ibn Harun, he says it alone: 'Hibban.'"
عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَالَ غَزَوْتُ مَعَ النَّبِيِّ ﷺ سَبْعَ غَزَوَاتٍ أَوْ ثَلَاثَ غَزَوَاتٍ فَسَمِعْتُهُ يَقُولُ الْمُسْلِمُونَ شُرَكَاءُ فِي ثَلَاثٍ فِي الْمَاءِ وَالْكَلَأِ وَالنَّارِ قَالَ وَسَمِعْتُ أَبَا حَفْصٍ يَقُولُ وَسَأَلْتُ عَنْهُ مُعَاذًا فَحَدَّثَنِي قَالَ حَدَّثَنِي حَرِيزُ بْنُ عُثْمَانَ حَدَّثَنَا حِبَّانَ بْنُ زَيْدٍ الشَّرْعَبِيُّ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَالَ غَزَوْتُ مَعَ النَّبِيِّ ﷺ قَالَ أَبُو حَفْصٍ ثُمَّ قَدِمَ عَلَيْنَا يَزِيدُ بْنُ هَارُونَ فَحَدَّثَنَا بِهِ أَظُنُّهُ عَنْ حَرِيزٍ ثنا حِبَّانُ بْنُ زَيْدٍ الشَّرْعَبِيُّ يَزِيدُ بْنُ هَارُونَ وَحْدَهُ يَقُولُ حَبَّانَ
30.12 [Machine] What is found in market seats and others
٣٠۔١٢ بَابُ مَا جَاءَ فِي مَقَاعِدِ الْأَسْوَاقِ وَغَيْرِهَا
[Machine] The Prophet of Allah ﷺ said, "A man should not get up from his seat and then sit in it again."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يُقِيمُ الرَّجُلُ الرَّجُلَ مِنْ مَجْلِسِهِ ثُمَّ يَجْلِسُ فِيهِ
[Machine] Ali went out to the market and saw that there were shops built in the market, so he ordered them to be demolished and leveled. He then passed by the houses of the Banu Bakka' and said, "These are from the market of the Muslims." He ordered them to relocate and demolish them. Ali said, "Whoever arrives at a place in the market first, he is more entitled to it." He said, "Indeed, I have seen us pledge allegiance to a man today here, and tomorrow from another direction."
أَنَّ عَلِيًّا ؓ خَرَجَ إِلَى السُّوقِ فَإِذَا دَكَاكِينُ قَدْ بُنِيَتْ بِالسُّوقِ فَأَمَرَ بِهَا فَخُرِّبَتْ فَسُوِّيَتْ قَالَ وَمَرَّ بِدُورِ بَنِي الْبَكَّاءِ فَقَالَ هَذِهِ مِنْ سُوقِ الْمُسْلِمِينَ قَالَ فَأَمَرَهُمْ أَنْ يَتَحَوَّلُوا وَهَدَمَهَا قَالَ وَقَالَ عَلِيٌّ مَنْ سَبَقَ إِلَى مَكَانٍ فِي السُّوقِ فَهُوَ أَحَقُّ بِهِ قَالَ فَلَقَدْ رَأَيْتُنَا يُبَايِعُ الرَّجُلُ الْيَوْمَ هَهُنَا وَغَدًا مِنْ نَاحِيَةٍ أُخْرَى
[Machine] "We were in the time of Al-Mughirah ibn Shu'bah, whoever arrived at a place in the market, he had the right to it until night."
كُنَّا فِي زَمَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ مَنْ سَبَقَ إِلَى مَكَانٍ فِي السُّوقِ فَهُوَ أَحَقُّ بِهِ إِلَى اللَّيْلِ
[Machine] The Messenger of Allah ﷺ said, "There is no inviolability except in three places: the vicinity of wells, the stable of horses, and the gathering of a community." This is a message.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا حِمَى إِلَّا فِي ثَلَاثٍ ثُلَّةِ الْبِئْرِ وَمَرْبَطِ الْفَرَسِ وَحَلْقَةِ الْقَوْمِ هَذَا مُرْسَلٌ
[Machine] The Prophet Muhammad (PBUH) said: "When a man gets up from his seat and then comes back to it, he has more right to it. So a man got up from his seat and I sat in it, then he came back and Abu Salih made me stand up from it."
قَالَ رَسُولُ اللهِ ﷺ إِذَا قَامَ الرَّجُلُ مِنْ مَجْلِسِهِ ثُمَّ عَادَ إِلَيْهِ فَهُوَ أَحَقُّ بِهِ فَقَامَ رَجُلٌ مِنْ مَجْلِسِهِ فَجَلَسْتُ فِيهِ ثُمَّ عَادَ فَأَقَامَنِي أَبُو صَالِحٍ عَنْهُ
The Messenger of Allah ﷺ would sit and we would also sit around him. If he got up intending to return, he would take off his sandals or something he was wearing, and his Companions recognising his purpose (that he would return) would stay where they were. (Using translation from Abū Dāʾūd 4854)
أَبُو الدَّرْدَاءِ كَانَ رَسُولُ اللهِ ﷺ إِذَا جَلَسَ وَجَلَسْنَا حَوْلَهُ فَقَامَ فَأَرَادَ الرُّجُوعَ نَزَعَ نَعْلَيْهِ أَوْ بَعْضَ مَا يَكُونُ عَلَيْهِ فَيَعْرِفُ ذَلِكَ أَصْحَابُهُ فَيَثْبُتُونَ
30.13 [Machine] What was in the mining ban?
٣٠۔١٣ بَابُ مَا جَاءَ فِي إِقْطَاعِ الْمَعَادِنِ الْبَاطِنَةِ
Rabi'ah reported on the authority of more than one person saying: The Messenger of Allah ﷺ assigned as a fief to Bilal ibn al-Harith al-Muzani the mines of al-Qabaliyyah which is in the neighbourhood of al-Fur', and only zakat is levied on those mines up to the present day. أَنَّ النَّبِيَّ ﷺ أَقْطَعَ بِلَالَ بْنَ الْحَارِثِ الْمُزَنِيَّ مَعَادِنَ الْقَبَلِيَّةِ وَهِيَ مِنْ نَاحِيَةِ الْفُرْعِ فَتِلْكَ الْمَعَادِنُ لَا يُؤْخَذُ مِنْهَا إِلَّا الزَّكَاةُ إِلَى الْيَوْمِ
[Machine] "He said that the Prophet ﷺ gave Bilal bin Al-Harith Al-Muzani the belongings of the tribes of Qabilah, their sitting and sleeping places, and the place where farming is good."
أَنَّهُ قَالَ أَعْطَى النَّبِيُّ ﷺ بِلَالَ بْنَ الْحَارِثِ الْمُزَنِيَّ مَعَادِنَ الْقَبَلِيَّةِ جَلْسِيَّهَا وَغَوْرِيَّهَا وَحَيْثُ يَصْلُحُ الزَّرْعُ
30.14 [Machine] What does the prohibition of preventing water mean?
٣٠۔١٤ بَابُ مَا جَاءَ فِي النَّهْيِ عَنْ مَنْعِ فَضْلِ الْمَاءِ
[Machine] The Messenger of Allah ﷺ said, "The abundance of water should not be prevented in order to prevent coldness."
قَالَ رَسُولُ اللهِ ﷺ لَا يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلَأُ
[Machine] The Messenger of Allah, ﷺ , said: "The abundance of water should not be withheld in order to prevent dirt." In another narration by Al-Layth, he said: "Ibn Al-Musayyib and Abu Salamah narrated to me that Abu Hurairah said: The Messenger of Allah, ﷺ , said: 'Do not withhold the abundance of water in order to prevent dirt.'"
عَنْ رَسُولِ اللهِ ﷺ قَالَ لَا يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلَأُ وَفِي رِوَايَةِ اللَّيْثِ قَالَ حَدَّثَنِي ابْنُ الْمُسَيِّبِ وَأَبُو سَلَمَةَ أَنَّ أَبَا هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللهِ ﷺ لَا تَمْنَعُوا فَضْلَ الْمَاءِ لِتَمْنَعُوا بِهِ الْكَلَأَ
[Machine] On the authority of the Prophet ﷺ , he said: "There are three people whom Allah will neither speak to nor look at on the Day of Judgment, and they will have a painful punishment. It is a man who swears falsely by taking an oath on the property of a Muslim and deprives him of it, a man who takes an oath after the Asr prayer that he has given more in charity than he actually has, and a man who withholds the provision of water. Indeed, Allah, the Exalted and Majestic, will say on the Day: 'I shall withhold My blessings from you just as you withheld the provision of water that you did not work for with your own hands.'"
عَنِ النَّبِيِّ ﷺ قَالَ ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللهُ يَوْمَ الْقِيَامَةِ وَلَا يَنْظُرُ إِلَيْهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ رَجُلٌ حَلَفَ عَلى يَمِينٍ عَلَى مَالِ مُسْلِمٍ فَاقْتَطَعَهُ وَرَجُلٌ حَلَفَ عَلى يَمِينٍ بَعْدَ صَلَاةِ الْعَصْرِ أَنَّهُ أَعْطَى بِسِلْعَتِهِ أَكْثَرَ مِمَّا أَعْطَى وَهُوَ كَاذِبٌ وَرَجُلٌ مَنَعَ فَضْلَ مَاءٍ؛ فَإِنَّ اللهَ سُبْحَانَهُ وَتَعَالَى يَقُولُ الْيَوْمَ أَمْنَعُكَ فَضْلِي كَمَا مَنَعْتَ فَضْلَ مَا لَمْ تَعْمَلْ يَدَاكَ
[Machine] The Messenger of Allah ﷺ said, "The pouring of a well should not be prevented."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يُمْنَعُ نَقْعُ بِئْرٍ
[Machine] I heard my mother say that the Messenger of Allah ﷺ prohibited the blocking of the water flow from a well. This is what was transmitted.
سَمِعْتُ أُمِّي تَقُولُ نَهَى رَسُولُ اللهِ ﷺ أَنْ يُمْنَعَ نَقْعُ بِئْرٍ هَذَا هُوَ الْمَحْفُوظُ مُرْسَلٌ
[Machine] "The Messenger of Allah ﷺ prohibited blocking the well's spout. This was conveyed to us connectedly (with a chain of narrators). It is only considered connectedly conveyed through the narration of Abdur-Rahman ibn Abi Rajal from his father."
رَسُولَ اللهِ ﷺ نَهَى أَنْ يُمْنَعَ نَقْعُ الْبِئْرِ هَكَذَا أَتَى بِهِ مَوْصُولًا وَإِنَّمَا يُعْرَفُ مَوْصُولًا مِنْ حَدِيثِ عَبْدِ الرَّحْمَنِ بْنِ أَبِي الرِّجَالِ عَنْ أَبِيهِ
[Machine] The Prophet ﷺ said, "The watering of a well should not be denied to others when it belongs to a group of people who share it, as each person is entitled to benefit from it and the owner should not prevent others from using it."
النَّبِيِّ ﷺ قَالَ لَا يُمْنَعُ نَقْعُ الْبِئْرِ وَهُوَ الرَّهْوُ قَالَ عَبْدُ الرَّحْمَنِ سَمِعْتُ أَبِي يَقُولُ الرَّهْوُ أَنْ تَكُونَ الْبِئْرُ بَيْنَ شُرَكَاءَ فِيهَا الْمَاءُ فَيَكُونُ لِلرَّجُلِ فِيهَا فَضْلٌ فَلَا يَمْنَعُ صَاحِبَهُ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "The abundance of water and the depth of the well should not be prevented, as this is the weakness of this matter."
رَسُولَ اللهِ ﷺ يَقُولُ لَا يُمْنَعُ فَضْلُ الْمَاءِ وَلَا نَقْعُ الْبِئْرِ حَارِثَةُ هَذَا ضَعِيفٌ
[Machine] A man came to a people who had water and asked them for water, but they did not give him any until he died of thirst. So, Umar ibn al-Khattab imposed a penalty on them.
أَنَّ رَجُلًا أَتَى أَهْلَ مَاءٍ فَاسْتَسْقَاهُمْ فَلَمْ يَسْقُوهُ حَتَّى مَاتَ عَطَشًا فَأَغَرَمَهُمْ عُمَرُ بْنُ الْخَطَّابِ ؓ الدِّيَةَ
30.15 [Machine] Water, contamination, and others are extracted from visible minerals then sold.
٣٠۔١٥ بَابٌ: الْمَاءُ وَالْكَلَأُ وَغَيْرُ ذَلِكَ يُؤْخَذُ مِنَ الْمَعَادِنِ الظَّاهِرَةِ ثُمَّ يُبَاعُ
[Machine] The Messenger of Allah, ﷺ , said, "It is better for one of you to take his rope and go to the mountain to gather a bundle of firewood on his back and sell it, so he may support himself with its price, than to ask people to give him or refuse him."
قَالَ رَسُولُ اللهِ ﷺ لَأَنْ يَأْخُذَ أَحَدُكُمْ حَبْلَهُ فَيَأْتِيَ الْجَبَلَ فَيَجِيءَ بِحُزْمَةٍ مِنْ حَطَبٍ عَلَى ظَهْرِهِ فَيَبِيعَهَا فَيَسْتَغْنِيَ بِثَمَنِهَا خَيْرٌ لَهُ مِنْ أَنْ يَسْأَلَ النَّاسَ أَعْطَوْهُ أَوْ مَنَعُوهُ
I got an old she-camel as my share from the booty, and the Prophet ﷺ had given me another from Al- Khumus. And when I intended to marry Fatima (daughter of the Prophet), I arranged that a goldsmith from the tribe of Bani Qainuqa' would accompany me in order to bring Idhkhir and then sell it to the goldsmiths and use its price for my marriage banquet. كَانَتْ لِي شَارِفٌ مِنْ نُصُبِي مِنَ الْمَغْنَمِ يَوْمَ بَدْرٍ وَكَانَ رَسُولُ اللهِ ﷺ أَعْطَانِي شَارِفًا مِنَ الْخُمُسِ يَوْمَئِذٍ فَلَمَّا أَرَدْتُ أَنْ أَبْتَنِيَ بِفَاطِمَةَ بِنْتِ رَسُولِ اللهِ ﷺ وَاعَدْتُ رَجُلًا صَوَّاغًا مِنْ بَنِي قَيْنُقَاعَ أَنْ يَرْتَحِلَ مَعِي فَنَأْتِيَ بِإِذْخِرٍ أَرَدْتُ أَنْ أَبِيعَهُ مِنَ الصَّوَّاغِينَ وَأَسْتَعِينَ بِهِ فِي وَلِيمَةِ عُرْسِي وَذَكَرَ الْحَدِيثَ
30.16 [Machine] Arrangement of Irrigation for Crops and Trees from Permissible Valleys
٣٠۔١٦ بَابُ تَرْتِيبِ سَقْيِ الزَّرْعِ وَالْأَشْجَارِ مِنَ الْأَوْدِيَةِ الْمُبَاحَةِ
An Ansari man quarreled with Az-Zubair in the presence of the Prophet ﷺ about the Harra Canals which were used for irrigating the date-palms. The Ansari man said to Az-Zubair, "Let the water pass' but Az-Zubair refused to do so. So, the case was brought before the Prophet ﷺ who said to Az-Zubair, "O Zubair! Irrigate (your land) and then let the water pass to your neighbor." On that the Ansari got angry and said to the Prophet, "Is it because he (i.e. Zubair) is your aunt's son?" On that the color of the face of Messenger of Allah ﷺ changed (because of anger) and he said, "O Zubair! Irrigate (your land) and then withhold the water till it reaches the walls between the pits round the trees." Zubair said, "By Allah, I think that the following verse was revealed on this occasion": "But no, by your Lord They can have No faith Until they make you judge In all disputes between them." أَنَّ رَجُلًا مِنَ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ عِنْدَ رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ فَقَالَ الْأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرُّ فَأَبَى عَلَيْهِ فَاخْتَصَمَا عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْ إِلَى جَارِكَ فَغَضِبَ الْأَنْصَارِيُّ فَقَالَ يَا رَسُولَ اللهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ فَقَالَ الزُّبَيْرُ ؓ وَاللهِ إِنِّي لَأَحْسِبُ هَذِهِ الْآيَةَ نَزَلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء 65] إِلَى قَوْلِهِ {وَيُسَلِّمُوا تَسْلِيمًا} [النساء 65]
Az-Zubair quarrelled with a man from the Ansar because of a natural mountainous stream at Al-Harra. The Prophet ﷺ said "O Zubair! Irrigate (your lands and the let the water flow to your neighbor The Ansar said, "O Messenger of Allah ﷺ (This is because) he (Zubair) is your cousin?" At that, the Prophet's face became red (with anger) and he said "O Zubair! Irrigate (your land) and then withhold the water till it fills the land up to the walls and then let it flow to your neighbor." So the Prophet ﷺ enabled Az- Zubair to take his full right after the Ansari provoked his anger. The Prophet ﷺ had previously given a order that was in favor of both of them Az-Zubair said, "I don't think but the Verse was revealed in this connection: "But no, by your Lord, they can have no faith, until they make you judge in all disputes between them." النَّبِيُّ ﷺ اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْهُ إِلَى جَارِكَ فَقَالَ الْأَنْصَارِيُّ يَا رَسُولَ اللهِ وَأَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ اسْقِ يَا زُبَيْرُ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ ثُمَّ أَرْسِلِ الْمَاءَ إِلَى جَارِكَ فَقَالَ وَاسْتَوْعَبَ رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ حَقَّهُ فِي صَرِيحِ الْحُكْمِ حِينَ أَحْفَظَهُ الْأَنْصَارِيُّ وَكَانَ أَشَارَ عَلَيْهِمَا قَبْلَ ذَلِكَ بِأَمْرٍ كَانَ لَهُمَا فِيهِ سَعَةٌ قَالَ الزُّبَيْرُ فَمَا أَحْسِبُ هَذِهِ الْآيَةَ إِلَّا نَزَلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء 65] قَالَ فَسَمِعْتُ غَيْرَ الزُّهْرِيِّ يَقُولُ نَظَرْتُ فِي قَوْلِ النَّبِيِّ ﷺ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ فَكَانَ ذَلِكَ إِلَى الْكَعْبَيْنِ
[Machine] The Messenger of Allah ﷺ said, "Give water to drink, then hold it back until the water returns to the gullet." Abu Amr Al-Adib narrated to us, Abu Bakr Al-Isma'ili informed me, Abdullah bin Muhammad bin Muslim narrated to me, Yusuf bin Sa'id narrated to me, Hujjaj narrated from Ibn Jurayj, who narrated from Ibn Shihab, and he mentioned it. He said, "And Ibn Shihab said, 'Restraining oneself with a piece of cloth."
قَالَ رَسُولُ اللهِ ﷺ اسْقِ ثُمَّ احْبِسْ حَتَّى يَرْجِعَ الْمَاءُ إِلَى الْجَدْرِ كَانَ ذَلِكَ إِلَى الْكَعْبَيْنِ أَخْبَرَنَاهُ أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ مُسْلِمٍ ثنا يُوسُفُ بْنُ سَعِيدٍ ثنا حَجَّاجٌ عَنِ ابْنِ جُرَيْجٍ عَنِ ابْنِ شِهَابٍ فَذَكَرَهُ قَالَ وَقَالَ ابْنُ شِهَابٍ إِخَاذٌ بِالْحَرَّةِ يَحْبِسُ الْمَاءَ
Tha'labah heard his elders say that a man from the Quraysh had his share with Banu Qurayzah (in water). He brought the dispute to the Messenger of Allah ﷺ about al-Mahzur, a stream whose water they shared together. The Messenger of Allah ﷺ then decided that when water reached the ankles waters should not be held back to flow to the lower. (Using translation from Abū Dāʾūd 3638)
أَنَّ رَجُلًا مِنْ قُرَيْشٍ كَانَ لَهُ سَهْمٌ فِي بَنِي قُرَيْظَةَ فَخَاصَمَ إِلَى رَسُولِ اللهِ ﷺ فِي مَهْزُورِ السَّيْلِ الَّذِي يَقْتَسِمُونَ مَاءَهُ فَقَضَى بَيْنَهُمْ رَسُولُ اللهِ ﷺ إِنَّ الْمَاءَ إِلَى الْكَعْبَيْنِ لَا يَحْبِسُ الْأَعْلَى عَنِ الْأَسْفَلِ
'Amr bin Shu'aib on his father's authority said that his grandfather told that the Messenger of Allah ﷺ decided regarding the stream al-Mahzur that its water should be held back till it reached the ankles, and that the upper waters should then be allowed to flow to the lower. أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِي السَّيْلِ الْمَهْزُورِ أَنْ يُمْسَكَ حَتَّى يَبْلُغَ إِلَى الْكَعْبَيْنِ ثُمَّ يُرْسِلُ الْأَعْلَى عَلَى الْأَسْفَلِ
the Messenger of Allah ﷺ ruled concerning the irrigation of palm trees from streams, that the higher ground should be irrigated before the lower, and that the water should be allowed to reach the ankles, then released to flow the nearest lower ground, and so on, until all the fields were watered or until the water ran out. إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّهُ قَضَى فِي مَشْرَبِ النَّخْلِ مِنَ السَّيْلِ أَنَّ الْأَعْلَى فَالْأَعْلَى يَشْرَبُ قَبْلَ الْأَسْفَلِ وَيُتْرَكُ فِيهِ الْمَاءُ إِلَى الْكَعْبَيْنِ ثُمَّ يُرْسَلُ الْمَاءُ إِلَى الْأَسْفَلِ الَّذِي يَلِيهِ وَكَذَلِكَ حَتَّى يَنْقَضِيَ الْحَوَائِطُ إِسْحَاقُ بْنُ يَحْيَى بْنِ عُبَادَةَ مُرْسَلٌ
30.17 [Machine] People differ in the breadth of the path they take to what they love
٣٠۔١٧ بَابُ الْقَوْمِ يَخْتَلِفُونَ فِي سَعَةِ الطَّرِيقِ الْمِئْتَاءِ إِلَى مَا أَحَبُّوهُ
[Machine] I heard Abu Huraira saying that the Messenger of Allah ﷺ decreed that a neighbor may place his logs or pieces of wood in his neighbor's wall if he wishes or refuses. And I heard the Messenger of Allah ﷺ decree that if people dispute over their pathways, it should be made seven cubits long.
سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ إِنَّ رَسُولَ اللهِ ﷺ قَضَى أَنَّ الْجَارَ يَضَعُ جُذُوعَهُ أَوْ خَشَبَهُ فِي حَائِطِ جَارِهِ إِنْ شَاءَ وَإِنْ أَبَى وَسَمِعَ رَسُولَ اللهِ ﷺ قَضَى إِنْ تَنَازَعَ النَّاسُ فِي طُرُقِهِمْ جُعِلَتْ سَبْعَةَ أَذْرُعٍ
[Machine] From the Prophet ﷺ , he said: "When you differ in the path, its width is set at seven arms' length."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا اخْتَلَفْتُمْ فِي الطَّرِيقِ جُعِلَ عَرْضُهُ سَبْعَةَ أَذْرُعٍ
[Machine] The Messenger of Allah ﷺ said, "When you are in doubt about a path, make it seven cubits long; the two carrying loads will vary in it."
قَالَ رَسُولُ اللهِ ﷺ إِذَا شَكَكْتُمْ فِي طَرِيقٍ فَاجْعَلُوا سَبْعَةَ أَذْرُعٍ؛ تَخْتَلِفُ فِيهِ الْحَامِلَتَانِ
[Machine] Certainly, one of the decrees of the Messenger of Allah ﷺ is that he ruled in regards to the open space that is between the road and the area where his family wanted to build. He ruled that a portion of that land, seven arms length, should be left for the road. He said, and those roads were called "Al-Mi'ata".
إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّهُ قَضَى فِي الرَّحَبَةِ تَكُونُ بَيْنَ الطَّرِيقِ ثُمَّ يُرِيدُ أَهْلُهَا الْبِنَاءَ فِيهَا فَقَضَى أَنْ يُتْرَكَ لِلطَّرِيقِ مِنْهَا سَبْعَةُ أَذْرُعٍ قَالَ وَكَانَتْ تِلْكَ الطُّرُقُ تُسَمَّى الْمِئْتَاءَ
30.18 [Machine] Date Palm is planted in a plot of land or a man has a palm tree between two rows of palm trees belonging to someone else, and they disagreed about its ownership.
٣٠۔١٨ بَابُ النَّخْلِ يُغْرَسُ فِي مَوَاتٍ، أَوْ يَكُونُ لِرَجُلٍ نَخْلَةٌ بَيْنَ ظَهْرَانَيْ نَخِيلٍ لِغَيْرِهِ فَاخْتَلَفَا فِي حَرِيمِهَا
[Machine] Two men disputed over a date palm tree, so the Prophet ﷺ cut a branch from it and shook it. He found it had five dates, so he gave them to the woman who owned the tree. Yahya ibn Muhammad reported to me from Ibn Abi Tuwala that he said, "He found it had seven dates." Abu al-Hasan ibn Abdan informed Ahmad ibn Ubayd, who narrated from Abbas ibn al-Fadl, who narrated from Ibn Kaseb, who narrated from Abdul Aziz ibn Muhammad, who narrated from Abu Tuwala Abdul Rahman ibn Ma'mar, who narrated from Amr ibn Yahya al-Mazini, who narrated from his father, who narrated from Abu Sa'id al-Khudri, who mentioned it in the hadith of Amr. He found it had five cubits, and Abu Tuwala said it had seven cubits.
اخْتَصَمَ رَجُلَانِ فِي نَخْلَةٍ فَقَطَعَ النَّبِيُّ ﷺ جَرِيدَةً مِنْ جَرِيدِهَا فَذَرَعَهَا فَوَجَدَهَا خَمْسًا فَجَعَلَهَا حَرِيمَهَا قَالَ يَحْيَى بْنُ مُحَمَّدٍ وَأَخْبَرَنِيهِ ابْنُ أَبِي طُوَالَةَ أَنَّهُ قَالَ وَجَدَهَا سَبْعًا 11865 وَأَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا عَبَّاسُ بْنُ الْفَضْلِ ثنا ابْنُ كَاسِبٍ ثنا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ عَنْ أَبِي طُوَالَةَ عَبْدِ اللهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ مَعْمَرٍ وَعَمْرِو بْنِ يَحْيَى الْمَازِنِيِّ عَنْ أَبِيهِ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ فَذَكَرَهُ فِي حَدِيثِ عَمْرٍو فَوَجَدَهُ خَمْسَةَ أَذْرُعٍ وَقَالَ أَبُو طُوَالَةَ سَبْعَةَ أَذْرُعٍ
[Machine] Indeed, from the rulings of the Messenger of Allah ﷺ is that he ruled in regards to the single palm tree, the two palm trees, and the three palm trees, for a man who possessed palm trees and they disagreed regarding their rights. So he ruled that each palm tree should be given its full amount of dates. And in what Abu Dawood narrated in the Maraseel with his chain of narration from Uruwah ibn Zubayr, he said that the Messenger of Allah ﷺ ruled regarding the length of the palm tree's shade.
إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّهُ قَضَى فِي النَّخْلَةِ وَالنَّخْلَتَيْنِ وَالثَّلَاثَةِ لِرَجُلٍ فِي نَخْلٍ فَيَخْتَلِفُونَ فِي حُقُوقِ ذَلِكَ فَقَضَى أَنَّ لِكُلِّ نَخْلَةٍ لِأُولَئِكَ مِنَ الْأَرْضِ مَبْلَغَ جَرِيدِهَا وَفِيمَا رَوَى أَبُو دَاوُدَ فِي الْمَرَاسِيلِ بِإِسْنَادِهِ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ قَالَ قَضَى رَسُولُ اللهِ ﷺ فِي حَرِيمِ النَّخْلِ طُولَ عَسِيبِهَا
30.19 [Machine] What came in the depths of the wells?
٣٠۔١٩ بَابُ مَا جَاءَ فِي حَرِيمِ الْآبَارِ
[Machine] The Prophet ﷺ said: "The forbidden area around a well extends for forty cubits from all sides. It belongs to the owners of camels and sheep and the wayfarer has the right to drink from it first. No one should prevent the excess water from being used to prevent the growth of vegetation." Ibn Mubarak narrated it from 'Awf who said: "I heard from Abu Huraira that the Messenger of Allah ﷺ said." He then mentioned a portion of his statement in which he said "11868" and mentioned that we have written it down from the hadith of Musaddad from Hushaym. 'Awf narrated to us, Muhammad ibn Sirin narrated from Abu Huraira that the Messenger of Allah ﷺ said." He then mentioned it.
قَالَ رَسُولُ اللهِ ﷺ حَرِيمُ الْبِئْرِ أَرْبَعُونَ ذِرَاعًا مِنْ جَوَانِبِهَا كُلِّهَا لِأَعْطَانِ الْإِبِلِ وَالْغَنَمِ وَابْنُ السَّبِيلِ أَوَّلُ شَارِبٍ وَلَا يُمْنَعُ فَضْلُ مَاءٍ لِيُمْنَعَ بِهِ الْكَلَأُ وَرَوَاهُ ابْنُ الْمُبَارَكِ عَنْ عَوْفٍ قَالَ بَلَغَنِي عَنْ أَبِي هُرَيْرَةَ فَذَكَرَهُ مِنْ قَوْلِهِ 11868 وَقَدْ كَتَبْنَاهُ مِنْ حَدِيثِ مُسَدَّدٍ عَنْ هُشَيْمٍ أَخْبَرَنَا عَوْفٌ ثنا مُحَمَّدُ بْنُ سِيرِينَ عَنْ أَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ فَذَكَرَهُ أَخْبَرَنَاهُ أَبُو الْحَسَنِ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُسَدَّدٌ ثنا هُشَيْمٌ فَذَكَرَهُ
[Machine] The women of the rural well are 25 cubits all around, and the women of the Adiyyah well are 50 cubits all around, and the women of the Zir' well are 300 cubits all around. Al-Zuhri said, "I heard people saying that the women of the springs are 500 cubits, and likewise."
أَنَّ حَرِيمَ الْبِئْرِ الْبَدِيِّ خَمْسَةٌ وَعِشْرُونَ ذِرَاعًا نَوَاحِيهَا كُلُّهَا وَحَرِيمَ الْعَادِيَّةِ خَمْسُونَ ذِرَاعًا نَوَاحِيهَا كُلُّهَا وَحَرِيمَ بِئْرِ الزَّرْعِ ثَلَاثُمِائَةِ ذِرَاعٍ مِنْ نَوَاحِيهَا كُلِّهَا قَالَ وَقَالَ الزُّهْرِيُّ وَسَمِعْتُ النَّاسَ يَقُولُونَ حَرِيمُ الْعُيُونِ خَمْسُمِائَةِ ذِرَاعٍ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "The depth of a regular well is fifty cubits, and the depth of a rural well is twenty-five cubits." Sa'id ibn al-Musayyib narrated on his own authority that the depth of a well in the cultivated land is three hundred cubits. Abu Bakr ibn Muhammad ibn Muhammad informed us, Abu al-Husayn al-Fasawi narrated to us, Abu 'Ali al-La'lawi narrated to us, Abu Dawud narrated to us, Muhammad ibn Kathir narrated to us, Sufyan al-Thawri narrated to us from Ismail ibn Umayyah, who mentioned it. It was also narrated from the hadith of Ma'mar and Ibrahim ibn Abi Abullah from al-Zuhri from Sa'id from Abu Hurayrah, raised and continuous, and he is weak.
قَالَ رَسُولُ اللهِ ﷺ حَرِيمُ الْبِئْرِ الْعَادِيَّةِ خَمْسُونَ ذِرَاعًا وَحَرِيمُ الْبِئْرِ الْبَدِيِّ خَمْسَةٌ وَعِشْرُونَ ذِرَاعًا قَالَ سَعِيدُ بْنُ الْمُسَيِّبِ مِنْ قِبَلِ نَفْسِهِ وَحَرِيمُ قُلَيْبِ الزَّرْعِ ثَلَاثُمِائَةِ ذِرَاعٍ أَخْبَرَنَاهُ أَبُو بَكْرِ بْنُ مُحَمَّدِ بْنِ مُحَمَّدٍ أنبأ أَبُو الْحُسَيْنِ الْفَسَوِيُّ ثنا أَبُو عَلِيٍّ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ كَثِيرٍ ثنا سُفْيَانُ الثَّوْرِيُّ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ فَذَكَرَهُ وَرُوِيَ مِنْ حَدِيثِ مَعْمَرٍ وَإِبْرَاهِيمَ بْنِ أَبِي عَبْلَةَ عَنِ الزُّهْرِيِّ عَنْ سَعِيدٍ عَنْ أَبِي هُرَيْرَةَ مَرْفُوعًا مَوْصُولًا وَهُوَ ضَعِيفٌ
[Machine] The rooms of the well are fifty cubits, and the rooms of the spring are two hundred cubits.
حَرِيمُ الْبِئْرِ خَمْسُونَ ذِرَاعًا وَحَرِيمُ الْعَيْنِ مِائَتَا ذِرَاعٍ
[Machine] I witnessed Habib bin Muslimah spending fifty arms-lengths in the vicinity of the ordinary well and twenty-five arms-lengths in the desert.
شَهِدْتُ حَبِيبَ بْنَ مَسْلَمَةَ قَضَى فِي حَرِيمِ الْبِئْرِ الْعَادِيَّةِ خَمْسِينَ ذِرَاعًا وَفِي الْبَدِيِّ خَمْسَةً وَعِشْرِينَ ذِرَاعًا
[Machine] The Messenger of Allah ﷺ said: "Verily, Allah has made a sacred boundary for cultivation from a distance of three hundred to four hundred fifty cubits."
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ جَعَلَ لِلزَّرْعِ حُرْمَةً غَلْوَةً بِسَهْمٍ قَالَ يَحْيَى قَالُوا وَالْغَلْوَةُ ما بَيْنَ ثَلَاثِمِائَةِ ذِرَاعٍ وَخَمْسِينَ إِلَى أَرْبَعِمِائَةٍ
[Machine] "Prophet Muhammad ﷺ said, 'Do not harm each other while digging wells, as it benefits Sa'id (a person's name), which means a person digs next to another person to save his water.'"
عَنِ النَّبِيِّ ﷺ قَالَ لَا تَضَارُّوا فِي الْحَفْرِ زَادَ سَعِيدٌ وَذَلِكَ أَنْ يَحْفِرَ الرَّجُلُ إِلَى جَنْبِ الرَّجُلِ لِيَذْهَبَ بِمَائِهِ
[Machine] From the Prophet ﷺ that he said: "There is no contagion except in three: gathering at the well, close contact with a sick camel, and being in the midst of a plague-stricken people."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ لَا حِمَى إِلَّا فِي ثَلَاثٍ ثُلَّةِ الْبِئْرِ وَطِوَلِ الْفَرَسِ وَحَلْقَةِ الْقَوْمِ
30.20 [Machine] What were the plans of the migrant women concerning inheritance in the city?
٣٠۔٢٠ بَابُ مَا جَاءَ فِي تَوْرِيثِ نِسَاءِ الْمُهَاجِرِينَ خِطَطَهُنَّ بِالْمَدِينَةِ
She was picking lice from the head of the Messenger of Allah ﷺ while the wife of Uthman ibn Affan and the immigrant women were with him. They complained about their houses that they had been narrowed down to them and they were evicted from them. The Messenger of Allah ﷺ ordered that the houses of the Immigrants should be given to their wives. Thereafter Abdullah ibn Mas'ud died, and his wife inherited his house in Medina. أَنَّهَا كَانَتْ تَفْلِي رَأْسَ رَسُولِ اللهِ ﷺ وَعِنْدَهُ امْرَأَةُ عُثْمَانَ بْنِ عَفَّانَ وَنِسَاءٌ مِنَ الْمُهَاجِرَاتِ وَهُنَّ يَشْتَكِينَ مَنَازِلَهُنَّ أَنَّهَا تَضِيقُ عَلَيْهِنَّ وَيَخْرُجْنَ مِنْهَا فَأَمَرَ رَسُولُ اللهِ ﷺ أَنْ يُوَرِّثَ دُورَ الْمُهَاجِرِينَ النِّسَاءَ فَمَاتَ عَبْدُ اللهِ بْنُ مَسْعُودٍ فَوَرِثَتْهُ امْرَأَتُهُ دَارًا بِالْمَدِينَةِ
