In the lifetime of Messenger of Allah ﷺ , ʿUmar gave in charity some of his property, a garden of date-palms called Thamgh. ʿUmar said, "O Messenger of Allah ﷺ! I have some property which I prize highly and I want to give it in charity." The Prophet; said, "Give it in charity (i.e. as an endowment) with its land and trees on the condition that the land and trees will neither be sold nor given as a present, nor bequeathed, but the fruits are to be spent in charity." So ʿUmar gave it in charity, and it was for Allah's Cause, the emancipation of slaves, for the poor, for guests, for travelers, and for kinsmen. The person acting as its administrator could eat from it reasonably and fairly, and could let a friend of his eat from it provided he had no intention of becoming wealthy by its means. “Umar bin Khattab acquired some land at Khaibar, and he came to the Prophet ﷺ and consulted him. He said: 'O Messenger of Allah ﷺ, I have been given some wealth at Khaibar and I have never been given any wealth that is more precious to me than it. What do you command me to do with it? He said: 'If you wish, you can make it an endowment and give (its produce) in charity.' So 'Umar gave it on the basis that it would not be sold, given away or inherited, and (its produce) was to be given to the poor, to relatives, for freeing slaves, in the cause of Allah, to way fares and to guests; and there was nothing wrong if a person appointed to be in charge of it consumed from it on a reasonable basis or feeding a fried, without accumulating it for himself.”  

ابن ماجة:٢٣٩٦حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ الْجَهْضَمِيُّ حَدَّثَنَا مُعْتَمِرُ بْنُ سُلَيْمَانَ عَنِ ابْنِ عَوْنٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ

أَصَابَ عُمَرُ بْنُ الْخَطَّابِ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ فَاسْتَأْمَرَهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي أَصَبْتُ مَالاً بِخَيْبَرَ لَمْ أُصِبْ مَالاً قَطُّ هُوَ أَنْفَسُ عِنْدِي مِنْهُ فَمَا تَأْمُرُنِي بِهِ فَقَالَ إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا قَالَ فَعَمِلَ بِهَا عُمَرُ عَلَى أَنْ لاَ يُبَاعَ أَصْلُهَا وَلاَ يُوهَبَ وَلاَ يُورَثَ تَصَدَّقَ بِهَا لِلْفُقَرَاءِ وَفِي الْقُرْبَى وَفِي الرِّقَابِ وَفِي سَبِيلِ اللَّهِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لاَ جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ

[Machine] O Messenger of Allah, I have obtained a valuable wealth and I want to give it in charity. He said, "Then make it a charity that is neither sold nor given as a gift, nor inherited. Those who have good judgment from the family of Umar should follow it. Whatever remains of its fruits should be spent in the way of Allah, on the wayfarer, on slaves, on the poor, on relatives, and on guests. It is not forbidden for the guardian of the wealth to eat according to what is reasonable or to feed a friend who is not financially supported by him. Hammad said that Amr ibn Dinar claimed that Abdullah ibn Umar used to give gifts from it to Abdullah ibn Safwan. Hafsah also gave charity from her land for this purpose, and Ibn Umar also gave charity from his land for this purpose, and Hafsah was responsible for it.  

أحمد:٦٠٧٨حَدَّثَنَا يُونُسُ حَدَّثَنَا حَمَّادٌ يَعْنِي ابْنَ زَيْدٍ حَدَّثَنَا أَيُّوبُ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَصَابَ أَرْضًا مِنْ يَهُودِ بَنِي حَارِثَةَ يُقَالُ لَهَا ثَمْغٌ فَقَالَ

يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ مَالًا نَفِيسًا أُرِيدُ أَنْ أَتَصَدَّقَ بِهِ قَالَ فَجَعَلَهَا صَدَقَةً لَا تُبَاعُ وَلَا تُوهَبُ وَلَا تُورَثُ يَلِيهَا ذَوُو الرَّأْيِ مِنْ آلِ عُمَرَ فَمَا عَفَا مِنْ ثَمَرَتِهَا جُعِلَ فِي سَبِيلِ اللهِ تَعَالَى وَابْنِ السَّبِيلِ وَفِي الرِّقَابِ وَالْفُقَرَاءِ وَلِذِي الْقُرْبَى وَالضَّيْفِ وَلَيْسَ عَلَى مَنْ وَلِيَهَا جُنَاحٌ أَنْ يَأْكُلَ بِالْمَعْرُوفِ أَوْ يُؤْكِلَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ مِنْهُ مَالًا قَالَ حَمَّادٌ فَزَعَمَ عَمْرُو بْنُ دِينَارٍ أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ كَانَ يُهْدِيإِلَى عَبْدِ اللهِ بْنِ صَفْوَانَ مِنْهُ قَالَ فَتَصَدَّقَتْ حَفْصَةُ بِأَرْضٍ لَهَا عَلَى ذَلِكَ وَتَصَدَّقَ ابْنُ عُمَرَ بِأَرْضٍ لَهُ عَلَى ذَلِكَ وَوَلِيَتْهَا حَفْصَةُ

'Umar got some land in Khaibar, and when to the Prophet ﷺ and said: I have acquired land in Khaibar which I consider to be more valuable than any I have acquired ; so what do you command me to do with it ? He replied: If you wish, you may make the property as inalienable possession, and give its produce as sadaqah (charity). So 'Umar gave it as a sadaqah declaring that the property must not be sold, given away, or inherited : (and gave its produce as sadaqah to be devoted) to poor, relatives, the emancipation of slaves, Allah's path, travellers. The narrator Bishr added: "and guests". Then the agreed version goes: No sin being committed by the one who administers it if he eats something from it in a reasonable manner, or gives something to a friend, who does not make his own property. The narrator Bishr added: "(provided) he is not storing-up goods (for himself)". (Using translation from Abū Dāʾūd 2878)
