In the lifetime of Messenger of Allah ﷺ , ʿUmar gave in charity some of his property, a garden of date-palms called Thamgh. ʿUmar said, "O Messenger of Allah ﷺ! I have some property which I prize highly and I want to give it in charity." The Prophet; said, "Give it in charity (i.e. as an endowment) with its land and trees on the condition that the land and trees will neither be sold nor given as a present, nor bequeathed, but the fruits are to be spent in charity." So ʿUmar gave it in charity, and it was for Allah's Cause, the emancipation of slaves, for the poor, for guests, for travelers, and for kinsmen. The person acting as its administrator could eat from it reasonably and fairly, and could let a friend of his eat from it provided he had no intention of becoming wealthy by its means.

The Prophet ﷺ said, "If you like you can give the land as endowment and give its fruits in charity." So ʿUmar gave it in charity as an endowment on the condition that would not be sold nor given to anybody as a present and not to be inherited, but its yield would be given in charity to the poor people, to the Kith and kin, for freeing slaves, for Allah's Cause, to the travelers and guests; and that there would be no harm if the guardian of the endowment ate from it according to his need with good intention, and fed others without storing it for the future."

"Ibn 'Awn narrated to us, from Nafi', from Ibn 'Umar, from 'Umar, who said: 'I acquired some land at Khaibar. He said: If you wish, you can 'freeze' it and give it in charity. So he gave it in charity on condition that it would not be sold, given away or inherited, to the poor, relatives, slaves, for the cause of Allah, guests and wayfarers. There is no sin on the one who administers it if he eats from it on a reasonable basis and feeds his friend, with no intention of becoming wealthy from it.'"

“Umar bin Khattab acquired some land at Khaibar, and he came to the Prophet ﷺ and consulted him. [Machine] O Messenger of Allah, I have obtained a valuable wealth and I want to give it in charity. He said, "Then make it a charity that is neither sold nor given as a gift, nor inherited. Those who have good judgment from the family of Umar should follow it. Whatever remains of its fruits should be spent in the way of Allah, on the wayfarer, on slaves, on the poor, on relatives, and on guests. It is not forbidden for the guardian of the wealth to eat according to what is reasonable or to feed a friend who is not financially supported by him. Hammad said that Amr ibn Dinar claimed that Abdullah ibn Umar used to give gifts from it to Abdullah ibn Safwan. Hafsah also gave charity from her land for this purpose, and Ibn Umar also gave charity from his land for this purpose, and Hafsah was responsible for it.

When ʿUmar got a piece of land in Khaibar, he came to the Prophet ﷺ saying, "I have got a piece of land, better than which I have never got. So what do you advise me regarding it?" The Prophet ﷺ said, "If you wish you can keep it as an endowment to be used for charitable purposes." So, ʿUmar gave the land in charity (i.e. as an endowments on the condition that the land would neither be sold nor given as a present, nor bequeathed, (and its yield) would be used for the poor, the kinsmen, the emancipation of slaves, Jihad, and for guests and travelers; and its administrator could eat in a reasonable just manner, and he also could feed his friends without intending to be wealthy by its means." 'Umar got some land in Khaibar, and when to the Prophet ﷺ and said: I have acquired land in Khaibar which I consider to be more valuable than any I have acquired ; so what do you command me to do with it ? He replied: If you wish, you may make the property as inalienable possession, and give its produce as sadaqah (charity). So 'Umar gave it as a sadaqah declaring that the property must not be sold, given away, or inherited : (and gave its produce as sadaqah to be devoted) to poor, relatives, the emancipation of slaves, Allah's path, travellers. The narrator Bishr added: "and guests". Then the agreed version goes: No sin being committed by the one who administers it if he eats something from it in a reasonable manner, or gives something to a friend, who does not make his own property. أَنَّ عُمَرَ ؓ تَصَدَّقَ بِمَالٍ لَهُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَكَانَ يُقَالُ لَهُ ثَمْغٌ وَكَانَ نَخْلًا فَقَالَ عُمَرُ ؓ يَا رَسُولَ اللهِ إِنِّي اسْتَفَدْتُ مَالًا وَهُوَ عِنْدِي نَفِيسٌ فَأَرَدْتُ أَنْ أَتَصَدَّقَ بِهِ فَقَالَ النَّبِيُّ ﷺ تَصَدَّقْ بِأَصْلِهِ لَا يُبَاعُ وَلَا يُوهَبُ وَلَا يُورَثُ وَلَكِنْ يُنْفَقُ ثَمَرُهُ فَتَصَدَّقَ بِهِ عُمَرُ فَصَدَقَتُهُ ذَلِكَ فِي سَبِيلِ اللهِ وَفِي الرِّقَابِ وَالْمَسَاكِينِ وَالضَّيْفِ وَابْنِ السَّبِيلِ وَلِذِي الْقُرْبَى وَلَا جُنَاحَ عَلَى مَنْ وَلِيَه أَنْ يَأْكُلَ مِنْهُ بِالْمَعْرُوفِ أَوْ يُؤْكِلَ صَدِيقَهُ غَيْرَ مُتَمَوِّلٍ بِهِ  

أَخْرَجَهُ الْبُخَارِيُّ فِي الصَّحِيحِ هَكَذَا
