32. Bequest
٣٢۔ كِتَابُ الْإحْبَاسِ
"I was allocated some land of Khaibar. I came to the Messenger of Allah and said: 'I have acquired some land and I have never acquired any wealth that is dearer to me or more precious than it.' He said: 'If you wish, you can give it in charity.'" So he gave it in charity on condition that it would not be bought or given away, for the poor, relatives, slaves, guests and wayfarers. And there is no sin on the administrator if he eats from it or feeds others on a reasonable basis, with no intention of becoming wealthy from it. (Using translation from Nasāʾī 3597)
أَصَبْتُ أَرْضًا مِنْ أَرْضِ خَيْبَرَ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ أَصَبْتُ أَرْضًا لَمْ أُصِبْ مَالًا أَحَبَّ إِلَيَّ وَلَا أَنْفَسَ عِنْدِي مِنْهَا قَالَ «إِنْ شِئْتَ تَصَدَّقْتَ بِهَا» فَتَصَدَّقَ بِهَا عَلَى أَلَّا تُبَاعَ وَلَا تُوهَبَ فِي الْفُقَرَاءِ وَذِي الْقُرْبَى وَالرِّقَابِ وَالضَّيْفِ وَابنِ السَّبِيلِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ غَيْرَ مُتَمَوِّلٍ مَالًا وَيُطْعِمَ 6392 أَخْبَرَنِي هَارُونُ بْنُ عَبْدِ اللهِ الْبَزَّارُ قَالَ حَدَّثَنَا مُعَاوِيَةُ بْنُ عَمْرٍو عَنْ أَبِي إِسْحَاقَ الْفَزَارِيِّ عَنْ ابْنِ عَوْنٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ عَنِ النَّبِيِّ ﷺ نَحْوَهُ
When ʿUmar got a piece of land in Khaibar, he came to the Prophet ﷺ saying, "I have got a piece of land, better than which I have never got. So what do you advise me regarding it?" The Prophet ﷺ said, "If you wish you can keep it as an endowment to be used for charitable purposes." So, ʿUmar gave the land in charity (i.e. as an endowments on the condition that the land would neither be sold nor given as a present, nor bequeathed, (and its yield) would be used for the poor, the kinsmen, the emancipation of slaves, Jihad, and for guests and travelers; and its administrator could eat in a reasonable just manner, and he also could feed his friends without intending to be wealthy by its means." أَصَابَ عُمَرُ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ فَقَالَ أَصَبْتُ أَرْضًا لَمْ أُصِبْ مَالًا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ فَكَيْفَ تَأْمُرُ بِهِ؟ قَالَ «إِنْ شِئْتَ حَبَّسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا» فَتَصَدَّقَ بِهَا عُمَرُ أَنَّهُ لَا يُبَاعَ أَصْلُهَا وَلَا يُوهَبَ وَلَا يُورَثَ فِي الْفُقَرَاءِ أَوِ الْقُرْبَى وَالرِّقَابِ وَفِي سَبِيلِ اللهِ وَالضَّيْفِ وَابْنِ السَّبِيلِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ وَيُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ
Umar bin Khattab got some land in Khaibar and he went to the Prophet ﷺ to consult him about it saying, "O Messenger of Allah ﷺ I got some land in Khaibar better than which I have never had, what do you suggest that I do with it?" The Prophet ﷺ said, "If you like you can give the land as endowment and give its fruits in charity." So ʿUmar gave it in charity as an endowment on the condition that would not be sold nor given to anybody as a present and not to be inherited, but its yield would be given in charity to the poor people, to the Kith and kin, for freeing slaves, for Allah's Cause, to the travelers and guests; and that there would be no harm if the guardian of the endowment ate from it according to his need with good intention, and fed others without storing it for the future." أَصَابَ عُمَرُ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ فَاسْتَأْمَرَهُ فِيهَا فَقَالَ إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ مَالًا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ فَمَا تَأْمُرُ فِيهَا؟ قَالَ «إِنْ شِئْتَ حَبَّسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا» فَتَصَدَّقَ بِهَا عَلَى أَنَّهُ لَا يُبَاعُ أَصْلُهَا وَلَا يُوهَبُ وَلَا يُورَثُ فَتَصَدَّقَ بِهَا فِي الْفُقَرَاءِ أَوِ الْقُرْبَى وَفِي الرِّقَابِ وَفِي سَبِيلِ اللهِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لَا جُنَاحَ ثُمَّ انْقَطَعَ عَلَى أَبِي مُعَاوِيَةَ أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ وَاللَّفْظُ لِإِسْمَاعِيلَ
"If you wish, you may 'freeze' it and give it in charity." So he 'froze' it, stipulating that it should not be sold, given as a gift or inherited, and he gave it in charity to the poor, relatives, slaves, the needy, wayfarers and guests. There is no sin on the administrator if he eats from it on a reasonable basis or feeds a friend with no intention of becoming wealthy from it. (Using translation from Nasāʾī 3601)
أَنَّ عُمَرَ أَصَابَ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِيَّ ﷺ يَسْتَأْمِرُهُ فِي ذَلِكَ فَقَالَ «إِنْ شِئْتَ حَبَّسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا» فَحَبَّسَ أَصْلَهَا أَنْ لَا يُبَاعَ وَلَا يُوهَبَ وَلَا يُورَثَ فَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ وَالْقُرْبَى وَالرِّقَابِ وَفِي الْمَسَاكِينِ وَابْنِ السَّبِيلِ وَالضَّيْفِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقَهُ غَيْرَ مُتَمَوِّلٍ فِيهِ
"When this Verse was revealed -'By no means shall you attain Al Birr (piety, righteousness--here it means Allah's reward, i.e. Paradise), unless you spend (in Allah's cause) of that which you love'- Abu Talha said: 'Our Lord will ask us about our wealth. I adjure you, O Messenger of Allah! I am giving my land to Allah.' The Messenger of Allah said: 'Make it for your relatives, Hassan bin Thabit and Ubayy bin Ka'b.'" لَمَّا نَزَلَتْ هَذِهِ الْآيَةُ {لَنْ تَنَالُوا الْبِرَّ حَتَّى تُنْفِقُوا مِمَّا تُحِبُّونَ} [آل عمران 92] قَالَ أَبُو طَلْحَةَ أَرَى رَبَّنَا يَسْأَلُنَا مِنْ أَمْوَالِنَا فَأُشْهِدُكَ يَا رَسُولَ اللهِ أَنِّي قَدْ جَعَلْتُ أَرْضِي لِلَّهِ فَقَالَ رَسُولُ اللهِ ﷺ «اجْعَلْهَا فِي قَرَابَتِكَ فِي حَسَّانَ بْنِ ثَابِتٍ وَأُبَيِّ بْنِ كَعْبٍ»
