The people of the Khuza'ah tribe killed a man of the tribe of Laith in the Year of Victory as a retaliation for one whom they had killed (whom the people of the tribe of Laith had killed). It was reported to Messenger of Allah ﷺ. He mounted his camel and delivered this address: Verily Allah, the Exalted and Majestic, held back the Ele- phants from Mecca, and gave its domination to His Messenger and believers. Behold, it was not violable for anyone before me and it will not be violable for anyone after me. Behold, it was made violable for me for an hour of a day; and at this very hour it has again been made inviolable (for me as well as for others). So its thorns are not to be cut, its trees are not to be lopped, and (no one is allowed to) pick up a thing dropped, but the one who makes an announcement of it. And one whose fellow is killed is allowed to opt between two alternatives: either he should receive blood-money or get the life of the (murderer) in return. He (the narrator said): A person from the Yemen, who was called Abu Shah, came to him and said: Messenger of Allah, write it down for me, whereupon he (Messenger of Allah) said: Write it down for Abu Shah. One of the persons from among the Quraish also said: Except Idhkhir, for we use it in our houses ant our graves. Thereupon Messenger of Allah ﷺ said: Except Idhkhir.

مسلم:١٣٥٥بحَدَّثَنِي إِسْحَاقُ بْنُ مَنْصُورٍ أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى عَنْ شَيْبَانَ عَنْ يَحْيَى أَخْبَرَنِي أَبُو سَلَمَةَ

In the year of the Conquest of Mecca, the tribe of Khuzaʿa killed a man from the tribe of Bani Laith in revenge for a killed person, belonging to them. They informed the Prophet ﷺ about it. So he rode his Rahila (she-camel for riding) and addressed the people saying, "Allah held back the killing from Mecca. (The sub-narrator is in doubt whether the Prophet ﷺ said "elephant or killing," as the Arabic words standing for these words have great similarity in shape), but He (Allah) let His Apostle and the believers over power the infidels of Mecca. Beware! (Mecca is a sanctuary) Verily! Fighting in Mecca was not permitted for anyone before me nor will it be permitted for anyone after me. It (war) in it was made legal for me for few hours or so on that day. No doubt it is at this moment a sanctuary, it is not allowed to uproot its thorny shrubs or to uproot its trees or to pick up its Luqat (fallen things) except by a person who will look for its owner (announce it publicly). And if somebody is killed, then his closest relative has the right to choose one of the two-- the blood money (Diyya) or retaliation having the killer killed. In the meantime a man from Yemen came and said, "O Messenger of Allah ﷺ! Get that written for me." The Prophet ﷺ ordered his companions to write that for him. Then a man from Quraish said, "Except Al-Idhkhir (a type of grass that has good smell) O Messenger of Allah ﷺ, as we use it in our houses and graves." The Prophet ﷺ said, "Except Al-Idhkhir i.e. Al-Idhkhir is allowed to be plucked."

"The Prophet ﷺ said, 'Allah has made Mecca, a sanctuary, so it was a sanctuary before me and will continue to be a sanctuary after me. It was made legal for me (i.e. I was allowed to fight in it) for a few hours of a day. It is not allowed to uproot its shrubs or to cut its trees, or to chase (or disturb) its game, or to pick up its luqata (fallen things) except by a person who would announce that (what he has found) publicly.' Al-ʿAbbas said, 'O Messenger of Allah ﷺ! Except Al-Idhkhir (a kind of grass) (for it is used) by our goldsmiths and for our graves.' The Prophet ﷺ then said, 'Except Al-Idhkhir.' " ʿIkrima said, 'Do you know what "chasing or disturbing" the game means? It means driving it out of the shade to occupy its place."

When Allah gave victory to His Apostle over the people of Mecca, Messenger of Allah ﷺ stood up among the people and after glorifying Allah, said, "Allah has prohibited fighting in Mecca and has given authority to His Apostle and the believers over it, so fighting was illegal for anyone before me, and was made legal for me for a part of a day, and it will not be legal for anyone after me. Its game should not be chased, its thorny bushes should not be uprooted, and picking up its fallen things is not allowed except for one who makes public announcement for it, and he whose relative is murdered has the option either to accept a compensation for it or to retaliate." Al-ʿAbbas said, "Except Al-Idhkhir, for we use it in our graves and houses." Messenger of Allah ﷺ said, "Except Al-Idhkhir." Abu Shah, a Yemenite, stood up and said, "O Messenger of Allah ﷺ! Get it written for me." Messenger of Allah ﷺ said, "Write it for Abu Shah." (The sub-narrator asked Al-Auza'i): What did he mean by saying, "Get it written, O Allah's Apostle?" He replied, "The speech which he had heard from Messenger of Allah ﷺ ."

Verily! Fighting in Mecca was not permitted for anybody before me, nor will it be permitted for anybody after me; It was permitted for me only for a while (an hour or so) of that day. No doubt! It is at this moment a sanctuary; its thorny shrubs should not be uprooted; its trees should not be cut down; and its Luqata (fallen things) should not be picked up except by the one who would look for its owner. Verily Allah held back the elephants from Mecca and gave the domination of it to His Messenger and believers, and it (this territory) was not violable to anyone before me and it was made violable to me for an hour of a day, and it shall not be violable to anyone after me. So neither molest the game, nor weed out thorns from it. And it is not lawful for anyone to pick up a thing dropped but one who makes public announcement of it. And it a relative of anyone is killed he is entitled to opt for one of two things. Either he should be paid blood-money or he can take life as (a just retribution). 'Abbas (Allah be pleased with him) said: Messenger of Allah, but Idhkhir (a kind of herbage), for we use it for our graves and for our houses, whereupon Messenger of Allah ﷺ said: With the exception of Idhkhir. A person known as Abu Shah, one of the people of Yemen, stood up and said: Messenger of Allah, (kindly) write it for me. Thereupon Messenger of Allah ﷺ said I Write it for Abu Shah. Walid said: I asked al-Auzai': What did his saying mean:" Write it for me, Messenger of Allah"? He said: This very address that he had heard from Messenger of Allah ﷺ.

Abu Hurairah said “When Allah, the Exalted, granted the conquest of Makkah to his Apostle, the Prophet ﷺ stood among them(the people) and praised Allaah and extolled Him. He then said, Verily Allaah stopped the Elephant from Makkah, and gave His Apostle and the believers sway upon it and it has been made lawful for me only for one hour on one day then it will remain sacred till the Day of Resurrection. Its trees are not to be cut, its game is not to be molested and the things dropped there are to be picked up only by one who publicly announces it. ‘Abbas or Al ‘Abbas suggested “Apostle of Allaah ﷺ except the rush(idhkir) for it is useful for our graves and our houses. The Apostle of Allaah ﷺ said “Except the rush.” Abu Dawud said “Ibn Al Musaffa added on the authority of Al Walid Abu Shah a man from the people of the Yemen stood and said “Give me in writing, Apostle of Allaah ﷺ”. The Apostle of Allaah ﷺ said “Give in writing to Abu Shah. I said to Al Awza’i “What does the statement mean? Give Abu Shah in writing?” He said “This was an address which he heard from the Apostle of Allaah ﷺ.”

"This Makkah was made sacred by Allah, the Mighty and Sublime, the day He created the heavens and the Earth. Fighting therein was not permitted for any one before me or after me rather it was permitted for me for a short part of a day. At this moment it is a sanctuary that is sacred by the decree of Allah until the Day of Resurrection. Its green grass is not to be uprooted or cut, its trees are not to be cut and its game is not to be distributed. IT is not permissible to pick up its lost property except by one who will announce it publicly." Al-Abbas who was a man of experience, stood up and said: "Except Idkhair, for we use it for our raves and houses." He said: "Except Idhkhir."

It remains sacred from Allah's sanctity until the Day of Resurrection. It is not permissible for anyone who believes in Allah and the Last Day to shed blood therein or to support a tree therewith that was not allowed for anyone before me or will be allowed for anyone after me. It is not allowed for me except during the state of falling into divine wrath. Verily, it has now returned to its state of sanctity as it was yesterday. So, let those who witnessed it inform those who were absent. For anyone who says to you that the Messenger of Allah ﷺ fought with Mecca, say, "Allah ﷻ has allowed it for His Messenger and has not allowed it for you, O people of Huza'il. Put your hands off killing, for it has become common that if you kill a person, you will have to bear the burden of his guilt. So, whoever is killed after my statement, his relatives will have the choice to either take the blood money or retaliate. Then the Messenger of Allah ﷺ approached the man whom Huza'il had killed and said so, then Amr ibn Sa'id said to Abu Shuraih, "You may go, O Sheik, as we know better than you its sanctity, that it does not prevent shedding blood, disobeying, or paying compensation. So, I said, "I was present and you were absent, and I conveyed it. The Messenger of Allah ﷺ commanded us to convey to our absentees what we witnessed, and I have conveyed it to you, and it is your matter now."

And whoever is killed for it, he is the best of two options: either he is killed or he pays the blood money." Then, a man from Yemen known as Abu Shah stood up and said, "O Messenger of Allah, write it for me." The Messenger of Allah ﷺ said, "Write it for Abu Shah." Then, Abbas stood up and said, "Except for the ithkur (a type of tree), for we make it in our graves and in our houses." The Messenger of Allah ﷺ said, "Except for the ithkur."

أَنَّ رَسُولَ اللهِ ﷺ وقف عام الفتح بالحجون فقال والله إنك لأخير أرض الله وأحب أرض الله إلى الله ولولاَ أني أخرجت منك ما خرجت وإنها لم تحل لأحد كان قبلي ولاَ تحل لأحد بعدي وَإنَّما أحلت لي ساعة من نهار ثُمَّ هي حرام ساعتي هذه لا يعضد شجرها ولاَ يحتش كلأها ولاَ تلتقط ضالتها إلاَّ لمنشد قال فقال رجل قال وزعم الناس أنه عباس يا رَسولَ اللهِ إلاَّ الإذخر فإنه لبيوتنا ولقبورنا ولعيوننا فَقَالَ رَسُولُ اللَّهِ ﷺ إلاَّ الإذخر

[AI] The Messenger of Allah ﷺ said, "Indeed, Allah has prohibited Mecca, and it is not permissible for anyone before me or after me. It was only made permissible for me for a period of time during the day that cannot be surpassed, its thorny bushes cannot be uprooted, its prey cannot be frightened away, and its lost items cannot be picked up except by someone who announces it." Abbas said, "O Messenger of Allah, except for the Izdir for our goldsmiths?" He said, "Except for the Izdir."

[AI] He heard from the Messenger of Allah ﷺ, then he went out to his people's gathering and sat in it. So I went to him and sat with him. He addressed his people as 'Amr Ibn Sa'id narrated. Abu Shurayh said, "I said, O people, we were with the Messenger of Allah ﷺ when he conquered Makkah. When the next day came after the day of the conquest, Khuzay'ah attacked a man from Hudhayl and killed him. He was a polytheist. The Messenger of Allah ﷺ then stood up to deliver a sermon and said, 'O people, Allah has forbidden Makkah since the day He created the heavens and the earth. It is a sanctuary of Allah's sanctuary until the Day of Resurrection. It is not permissible for anyone who believes in Allah and the Last Day to shed blood therein or to support it with anything. It has not been lawful to anyone before me, nor is it lawful to anyone after me, and it was not lawful for me except for this hour. Its sanctity will be restored just like it was sanctified yesterday. Let the witness among you inform the absent one. So whoever told you that the Messenger of Allah ﷺ fought with it, then say that Allah has made it lawful for His Messenger, but He did not make it lawful for you, O people of Khuzay'ah. So put away your hands from killing, for it is a grave sin that you have committed. You have killed a man in violation of his covenant. Whoever kills after my statement, then his relatives have the choice between two good things, whether to pay the blood money for his killer, or to retaliate with his life.' Then the Messenger of Allah ﷺ paid the blood money for the man who was killed from Hudhayl, and the wording is according to the narration of Nufayl."

"This Makkah was made sacred by Allah, the Mighty and Sublime, the day He created the heavens and the Earth. Fighting therein was not permitted for any one before me or after me rather it was permitted for me for a short part of a day. At this moment it is a sanctuary that is sacred by the decree of Allah until the Day of Resurrection. Its green grass is not to be uprooted or cut, its trees are not to be cut and its game is not to be distributed. IT is not permissible to pick up its lost property except by one who will announce it publicly." Al-Abbas who was a man of experience, stood up and said: "Except Idkhair, for we use it for our raves and houses." He said: "Except Idhkhir." (Using translation from Nasāʾī 2892)

When Allah gave victory to His Apostle over the people of Mecca, Messenger of Allah ﷺ stood up among the people and after glorifying Allah, said, "Allah has prohibited fighting in Mecca and has given authority to His Apostle and the believers over it, so fighting was illegal for anyone before me, and was made legal for me for a part of a day, and it will not be legal for anyone after me. Its game should not be chased, its thorny bushes should not be uprooted, and picking up its fallen things is not allowed except for one who makes public announcement for it, and he whose relative is murdered has the option either to accept a compensation for it or to retaliate." Al-ʿAbbas said, "Except Al-Idhkhir, for we use it in our graves and houses." Messenger of Allah ﷺ said, "Except Al-Idhkhir." Abu Shah, a Yemenite, stood up and said, "O Messenger of Allah ﷺ! Get it written for me." Messenger of Allah ﷺ said, "Write it for Abu Shah." (The sub-narrator asked Al-Auza'i): What did he mean by saying, "Get it written, O Allah's Apostle?" In the year of the Conquest of Mecca, the tribe of Khuzaʿa killed a man from the tribe of Bani Laith in revenge for a killed person, belonging to them. They informed the Prophet ﷺ about it. So he rode his Rahila (she-camel for riding) and addressed the people saying, "Allah held back the killing from Mecca. (The sub-narrator is in doubt whether the Prophet ﷺ said "elephant or killing," as the Arabic words standing for these words have great similarity in shape), but He (Allah) let His Apostle and the believers over power the infidels of Mecca. Beware! (Mecca is a sanctuary) Verily! Fighting in Mecca was not permitted for anyone before me nor will it be permitted for anyone after me. It (war) in it was made legal for me for few hours or so on that day. No doubt it is at this moment a sanctuary, it is not allowed to uproot its thorny shrubs or to uproot its trees or to pick up its Luqat (fallen things) except by a person who will look for its owner (announce it publicly). And if somebody is killed, then his closest relative has the right to choose one of the two-- the blood money (Diyya) or retaliation having the killer killed. In the meantime a man from Yemen came and said, "O Messenger of Allah ﷺ! Get that written for me." The Prophet ﷺ ordered his companions to write that for him. Then a man from Quraish said, "Except Al-Idhkhir (a type of grass that has good smell) O Messenger of Allah ﷺ, as we use it in our houses and graves." The Prophet ﷺ said, "Except Al-Idhkhir i.e. Al-Idhkhir is allowed to be plucked." (Using translation from Bukhārī 112)
