Abu Hurairah said “When Allah, the Exalted, granted the conquest of Makkah to his Apostle, the Prophet ﷺ stood among them(the people) and praised Allaah and extolled Him. He then said, Verily Allaah stopped the Elephant from Makkah, and gave His Apostle and the believers sway upon it and it has been made lawful for me only for one hour on one day then it will remain sacred till the Day of Resurrection. Its trees are not to be cut, its game is not to be molested and the things dropped there are to be picked up only by one who publicly announces it. ‘Abbas or Al ‘Abbas suggested “Apostle of Allaah ﷺ except the rush(idhkir) for it is useful for our graves and our houses. The Apostle of Allaah ﷺ said “Except the rush.” Abu Dawud said “Ibn Al Musaffa added on the authority of Al Walid Abu Shah a man from the people of the Yemen stood and said “Give me in writing, Apostle of Allaah ﷺ”. The Apostle of Allaah ﷺ said “Give in writing to Abu Shah. I said to Al Awza’i “What does the statement mean? Give Abu Shah in writing?” He said “This was an address which he heard from the Apostle of Allaah ﷺ.”

قَالَ أَبُو دَاوُدَ وَزَادَنَا فِيهِ ابْنُ الْمُصَفَّى عَنِ الْوَلِيدِ فَقَامَ أَبُو شَاهٍ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَقَالَ يَا رَسُولَ اللَّهِ اكْتُبُوا لِي فَقَالَ رَسُولُ اللَّهِ ﷺ اكْتُبُوا لأَبِي شَاهٍ قُلْتُ لِلأَوْزَاعِيِّ مَا قَوْلُهُ اكْتُبُوا لأَبِي شَاهٍ قَالَ هَذِهِ الْخُطْبَةَ الَّتِي سَمِعَهَا مِنْ رَسُولِ اللَّهِ ﷺ

When Allah gave victory to His Apostle over the people of Mecca, Messenger of Allah ﷺ stood up among the people and after glorifying Allah, said, "Allah has prohibited fighting in Mecca and has given authority to His Apostle and the believers over it, so fighting was illegal for anyone before me, and was made legal for me for a part of a day, and it will not be legal for anyone after me. Its game should not be chased, its thorny bushes should not be uprooted, and picking up its fallen things is not allowed except for one who makes public announcement for it, and he whose relative is murdered has the option either to accept a compensation for it or to retaliate." Al-ʿAbbas said, "Except Al-Idhkhir, for we use it in our graves and houses." Messenger of Allah ﷺ said, "Except Al-Idhkhir." Abu Shah, a Yemenite, stood up and said, "O Messenger of Allah ﷺ! Get it written for me." Messenger of Allah ﷺ said, "Write it for Abu Shah." (The sub-narrator asked Al-Auza'i): What did he mean by saying, "Get it written, O Allah's Apostle?" He replied, "The speech which he had heard from Messenger of Allah ﷺ ."

"The Prophet ﷺ said, 'Allah has made Mecca, a sanctuary, so it was a sanctuary before me and will continue to be a sanctuary after me. It was made legal for me (i.e. I was allowed to fight in it) for a few hours of a day. It is not allowed to uproot its shrubs or to cut its trees, or to chase (or disturb) its game, or to pick up its luqata (fallen things) except by a person who would announce that (what he has found) publicly.' Al-ʿAbbas said, 'O Messenger of Allah ﷺ! Except Al-Idhkhir (a kind of grass) (for it is used) by our goldsmiths and for our graves.' The Prophet ﷺ then said, 'Except Al-Idhkhir.' " ʿIkrima said, 'Do you know what "chasing or disturbing" the game means? It means driving it out of the shade to occupy its place."

Verily Allah held back the elephants from Mecca and gave the domination of it to His Messenger and believers, and it (this territory) was not violable to anyone before me and it was made violable to me for an hour of a day, and it shall not be violable to anyone after me. So neither molest the game, nor weed out thorns from it. And it is not lawful for anyone to pick up a thing dropped but one who makes public announcement of it. And it a relative of anyone is killed he is entitled to opt for one of two things. Either he should be paid blood-money or he can take life as (a just retribution). 'Abbas (Allah be pleased with him) said: Messenger of Allah, but Idhkhir (a kind of herbage), for we use it for our graves and for our houses, whereupon Messenger of Allah ﷺ said: With the exception of Idhkhir. A person known as Abu Shah, one of the people of Yemen, stood up and said: Messenger of Allah, (kindly) write it for me. Thereupon Messenger of Allah ﷺ said I Write it for Abu Shah. Walid said: I asked al-Auzai': What did his saying mean:" Write it for me, Messenger of Allah"? He said: This very address that he had heard from Messenger of Allah ﷺ.

"This Makkah was made sacred by Allah, the Mighty and Sublime, the day He created the heavens and the Earth. Fighting therein was not permitted for any one before me or after me rather it was permitted for me for a short part of a day. At this moment it is a sanctuary that is sacred by the decree of Allah until the Day of Resurrection. Its green grass is not to be uprooted or cut, its trees are not to be cut and its game is not to be distributed. IT is not permissible to pick up its lost property except by one who will announce it publicly." Al-Abbas who was a man of experience, stood up and said: "Except Idkhair, for we use it for our raves and houses." He said: "Except Idhkhir."

“I heard the Prophet ﷺ delivering a sermon in the Year of the Conquest (of Makkah), and he said: ‘O people, Allah made Makkah sacred the day He created the heavens and the earth, and it is sacred until the Day of Resurrection. أَنَّهُ عَامَ فُتِحَتْ مَكَّةُ قَامَ رَسُولُ اللَّهِ ﷺ فَقَالَ «إِنَّ اللَّهَ حَبَسَ عَنْ مَكَّةَ الْفِيلَ وَسَلَّطَ عَلَيْهِمْ رَسُولَ اللَّهِ ﷺ وَالْمُؤْمِنِينَ أَلَا وَإِنَّهَا لَمْ تَحِلَّ لِأَحَدٍ قَبْلِي وَلَا تَحِلُّ لِأَحَدٍ بَعْدِي أَلَا وَإِنَّهَا سَاعَتِي هَذِهِ حَرَامٌ لَا يُخْتَلَى خَلَاهَا وَلَا يُعْضَدُ شَجَرُهَا وَلَا تُلْتَقَطُ سَاقِطَتُهَا إِلَّا لِمُنْشِدٍ»  

ذِكْرُ الزَّجْرِ عَنِ اخْتِلَاءِ شَوْكِ حَرَمِ اللَّهِ جَلَّ وَعَلَا وَالْتِقَاطِ سَاقِطَهَا إِلَّا أَنْ يَكُونَ الْمَرْءُ مُنْشِدًا

[Machine] When Allah, the Most High, opened Mecca for His Messenger ﷺ , these two men from the Banu Layth tribe killed a man with pre-Islamic blood-money rights. The Messenger of Allah ﷺ was informed about it, so he stood up and said, "Verily, Allah, the Most High, has restricted the conquest of Mecca from the people and has bestowed it upon His Messenger and the believers. It is not permissible for anyone before me or after me. It was only made permissible for me for an hour during the day, and this hour has passed. Then, it is haram (forbidden), and its trees are not to be cut, its thorns are not to be broken, and its fallen branches are not to be picked up except by a reciter. And whoever is killed for it, he is the best of two options: either he is killed or he pays the blood money." Then, a man from Yemen known as Abu Shah stood up and said, "O Messenger of Allah, write it for me." The Messenger of Allah ﷺ said, "Write it for Abu Shah." Then, Abbas stood up and said, "Except for the ithkur (a type of tree), for we make it in our graves and in our houses." The Messenger of Allah ﷺ said, "Except for the ithkur."

[Machine] "The Prophet of Allah ﷺ said on the day of Mecca's conquest, 'Indeed, Allah, may His remembrance be glorified, made Mecca sacred on the day He created the heavens and the earth. It is sacred by the sanctity of Allah until the Day of Judgment. Its game should not be disturbed, its trees should not be cut, its grass should not be uprooted, and its prey should not be chased except by a skilled poet.' So Al-Abbas ibn Abd al-Muttalib said, 'Except for the incense, O Messenger of Allah, the needs of the people and homes require it.' The Prophet ﷺ remained silent for a while and then said, 'Except for incense, for it is permissible.'"

[Machine] The Messenger of Allah ﷺ said, "Indeed, Allah has prohibited Mecca, and it is not permissible for anyone before me or after me. It was only made permissible for me for a period of time during the day that cannot be surpassed, its thorny bushes cannot be uprooted, its prey cannot be frightened away, and its lost items cannot be picked up except by someone who announces it." Abbas said, "O Messenger of Allah, except for the Izdir for our goldsmiths?" He said, "Except for the Izdir."

When Allah gave victory to His Apostle over the people of Mecca, Messenger of Allah ﷺ stood up among the people and after glorifying Allah, said, "Allah has prohibited fighting in Mecca and has given authority to His Apostle and the believers over it, so fighting was illegal for anyone before me, and was made legal for me for a part of a day, and it will not be legal for anyone after me. Its game should not be chased, its thorny bushes should not be uprooted, and picking up its fallen things is not allowed except for one who makes public announcement for it, and he whose relative is murdered has the option either to accept a compensation for it or to retaliate." Al-ʿAbbas said, "Except Al-Idhkhir, for we use it in our graves and houses." Messenger of Allah ﷺ said, "Except Al-Idhkhir." Abu Shah, a Yemenite, stood up and said, "O Messenger of Allah ﷺ! Get it written for me." Messenger of Allah ﷺ said, "Write it for Abu Shah." (The sub-narrator asked Al-Auza'i): What did he mean by saying, "Get it written, O Allah's Apostle?" He replied, "The speech which he had heard from Messenger of Allah ﷺ ." (Using translation from Bukhārī 2434)

Its green grass is not to be uprooted or cut, its trees are not to be cut and its game is not to be distributed. IT is not permissible to pick up its lost property except by one who will announce it publicly." Messenger of Allah ﷺ got up on the day of the Conquest of Mecca and said, "Allah has made Mecca a sanctuary since the day He created the Heavens and the Earth, and it will remain a sanctuary by virtue of the sanctity Allah has bestowed on it till the Day of Resurrection. It (i.e. fighting in it) was not made lawful to anyone before me!, nor will it be made lawful to anyone after me, and it was not made lawful for me except for a short period of time. Its game should not be chased, nor should its trees be cut, nor its vegetation or grass uprooted, not its Luqata (i.e. Most things) picked up except by one who makes a public announcement about it." Al-Abbas bin ʿAbdul Muttalib said, "Except the Idhkhir, O Messenger of Allah ﷺ, as it is indispensable for blacksmiths and houses." On that, the Prophet ﷺ kept quiet and then said, "Except the Idhkhir as it is lawful to cut." (Using translation from Bukhārī 4313)
