bukhari:4313Isḥāq > Abū ʿĀṣim > Ibn Jurayj > Ḥasan b. Muslim > Mujāhid

Messenger of Allah ﷺ got up on the day of the Conquest of Mecca and said, "Allah has made Mecca a sanctuary since the day He created the Heavens and the Earth, and it will remain a sanctuary by virtue of the sanctity Allah has bestowed on it till the Day of Resurrection. It (i.e. fighting in it) was not made lawful to anyone before me!, nor will it be made lawful to anyone after me, and it was not made lawful for me except for a short period of time. Its game should not be chased, nor should its trees be cut, nor its vegetation or grass uprooted, not its Luqata (i.e. Most things) picked up except by one who makes a public announcement about it." Al-Abbas bin ʿAbdul Muttalib said, "Except the Idhkhir, O Messenger of Allah ﷺ, as it is indispensable for blacksmiths and houses." On that, the Prophet ﷺ kept quiet and then said, "Except the Idhkhir as it is lawful to cut."  

البخاري:٤٣١٣حَدَّثَنَا إِسْحَاقُ حَدَّثَنَا أَبُو عَاصِمٍ عَنِ ابْنِ جُرَيْجٍ قَالَ أَخْبَرَنِي حَسَنُ بْنُ مُسْلِمٍ عَنْ مُجَاهِدٍ

أَنَّ رَسُولَ اللَّهِ قَامَ يَوْمَ الْفَتْحِ فَقَالَ إِنَّ اللَّهَ حَرَّمَ مَكَّةَ يَوْمَ خَلَقَ السَّمَوَاتِ وَالأَرْضَ فَهْىَ حَرَامٌ بِحَرَامِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ لَمْ تَحِلَّ لأَحَدٍ قَبْلِي وَلاَ تَحِلُّ لأَحَدٍ بَعْدِي وَلَمْ تَحْلِلْ لِي إِلاَّ سَاعَةً مِنَ الدَّهْرِ لاَ يُنَفَّرُ صَيْدُهَا وَلاَ يُعْضَدُ شَوْكُهَا وَلاَ يُخْتَلَى خَلاَهَا وَلاَ تَحِلُّ لُقَطَتُهَا إِلاَّ لِمُنْشِدٍ فَقَالَ الْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ إِلاَّ الإِذْخِرَ يَا رَسُولَ اللَّهِ فَإِنَّهُ لاَ بُدَّ مِنْهُ لِلْقَيْنِ وَالْبُيُوتِ فَسَكَتَ ثُمَّ قَالَ إِلاَّ الإِذْخِرَ فَإِنَّهُ حَلاَلٌ وَعَنِ ابْنِ جُرَيْجٍ أَخْبَرَنِي عَبْدُ الْكَرِيمِ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ بِمِثْلِ هَذَا أَوْ نَحْوِ هَذَا رَوَاهُ أَبُو هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ

"The Prophet ﷺ said, 'Allah has made Mecca, a sanctuary, so it was a sanctuary before me and will continue to be a sanctuary after me. It was made legal for me (i.e. I was allowed to fight in it) for a few hours of a day. It is not allowed to uproot its shrubs or to cut its trees, or to chase (or disturb) its game, or to pick up its luqata (fallen things) except by a person who would announce that (what he has found) publicly.' Al-ʿAbbas said, 'O Messenger of Allah ﷺ! Except Al-Idhkhir (a kind of grass) (for it is used) by our goldsmiths and for our graves.' The Prophet ﷺ then said, 'Except Al-Idhkhir.' " ʿIkrima said, 'Do you know what "chasing or disturbing" the game means? It means driving it out of the shade to occupy its place."

On the day of the conquest of Mecca, the Prophet ﷺ said, "There is no more emigration (from Mecca) but Jihad and intentions, and whenever you are called for Jihad, you should go immediately. No doubt, Allah has made this place (Mecca) a sanctuary since the creation of the heavens and the earth and will remain a sanctuary till the Day of Resurrection as Allah has ordained its sanctity. Fighting was not permissible in it for anyone before me, and even for me it was allowed only for a portion of a day. So, it is a sanctuary with Allah's sanctity till the Day of Resurrection. Its thorns should not be uprooted and its game should not be chased; and its luqata (fallen things) should not be picked up except by one who would announce that publicly, and its vegetation (grass etc.) should not be cut." Al-ʿAbbas said, "O Messenger of Allah ﷺ! Except Al-Idhkhir, (for it is used by their blacksmiths and for their domestic purposes)." So, the Prophet ﷺ said, "Except Al-Idhkhir."  

البخاري:١٨٣٤حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ حَدَّثَنَا جَرِيرٌ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ

Messenger of Allah ﷺ said, "Allah made Mecca a sanctuary and it was neither permitted for anyone before, nor will it be permitted for anyone after me (to fight in it). And fighting in it was made legal for me for a few hours of a day only. None is allowed to uproot its thorny shrubs or to cut down its trees or to chase its game or to pick up its Luqata (fallen things) except by a person who would announce it publicly."

ʿAbbas bin ʿAbdul-Muttalib requested the Prophet, "Except Al-Idhkhir, for our goldsmiths and for the roofs of our houses." The Prophet ﷺ said, "Except Al-Idhkhir." ʿIkrima said, "Do you know what is meant by chasing its game? It is to drive it out of the shade and sit in its place." Khalid said, "(ʿAbbas said: Al-Idhkhir) for our goldsmiths and our graves."

Messenger of Allah ﷺ said on the day of the conquest of Mecca, "There is no migration now, but there is Jihad (i.e.. holy battle) and good intentions. And when you are called for Jihad, you should come out at once" Messenger of Allah ﷺ also said, on the day of the conquest of Mecca, "Allah has made this town a sanctuary since the day He created the Heavens and the Earth. So, it is a sanctuary by Allah's Decree till the Day of Resurrection. Fighting in it was not legal for anyone before me, and it was made legal for me only for an hour by daytime. So, it (i.e. Mecca) is a sanctuary by Allah's Decree till the Day of Resurrection. Its thorny bushes should not be cut, and its game should not be chased, its fallen property (i.e. Luqata) should not be picked up except by one who will announce it publicly; and its grass should not be uprooted," On that Al-ʿAbbas said, "O Messenger of Allah ﷺ! Except the Idhkhir, because it is used by the goldsmiths and by the people for their houses." On that the Prophet ﷺ said, "Except the Idhkhir."

There is no Hijra (emigration) but only Jihad and good intention; and when you are called to battle, then go forth. He also said on the Day of Victory over Mecca: Allah made this town sacred on the day He created the earth and the heavens; so it is -sacred by the sacred- ness conferred on it by Allah until the Day of Resurrection and fighting in it was not lawful to anyone before me, and it was made lawful for me only during an hour on one day, for it is sacred by the sacredness conferred on it by Allah until the Day of Resurrection. Its thorns are not to be cut, its game is not to be molested, and the things dropped are to be picked up only by one who makes a public announcement of it, and its fresh herbage is not to be cut. Abbas (Allah be pleased with him) said: Messenger of Allah, exception may be made in case of rush, for it is useful for their blacksmiths and for their houses. He (the Holy Prophet) conceding the suggestion of 'Abbas) said: Except rush.  

مسلم:١٣٥٣aحَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ أَخْبَرَنَا جَرِيرٌ عَنْ مَنْصُورٍ عَنْ مُجَاهِدٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ يَوْمَ الْفَتْحِ فَتْحِ مَكَّةَ لاَ هِجْرَةَ وَلَكِنْ جِهَادٌ وَنِيَّةٌ وَإِذَا اسْتُنْفِرْتُمْ فَانْفِرُوا وَقَالَ يَوْمَ الْفَتْحِ فَتْحِ مَكَّةَ إِنَّ هَذَا الْبَلَدَ حَرَّمَهُ اللَّهُ يَوْمَ خَلَقَ السَّمَوَاتِ وَالأَرْضَ فَهُوَ حَرَامٌ بِحُرْمَةِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ وَإِنَّهُ لَمْ يَحِلَّ الْقِتَالُ فِيهِ لأَحَدٍ قَبْلِي وَلَمْ يَحِلَّ لِي إِلاَّ سَاعَةً مِنْ نَهَارٍ فَهُوَ حَرَامٌ بِحُرْمَةِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ لاَ يُعْضَدُ شَوْكُهُ وَلاَ يُنَفَّرُ صَيْدُهُ وَلاَ يَلْتَقِطُ إِلاَّ مَنْ عَرَّفَهَا وَلاَ يُخْتَلَى خَلاَهَا فَقَالَ الْعَبَّاسُ يَا رَسُولَ اللَّهِ إِلاَّ الإِذْخِرَ فَإِنَّهُ لِقَيْنِهِمْ وَلِبُيُوتِهِمْ فَقَالَ إِلاَّ الإِذْخِرَ  

nasai:2892Saʿīd b. ʿAbd al-Raḥman > Sufyān > ʿAmr > ʿIkrimah > Ibn ʿAbbās

"This Makkah was made sacred by Allah, the Mighty and Sublime, the day He created the heavens and the Earth. Fighting therein was not permitted for any one before me or after me rather it was permitted for me for a short part of a day. At this moment it is a sanctuary that is sacred by the decree of Allah until the Day of Resurrection. Its green grass is not to be uprooted or cut, its trees are not to be cut and its game is not to be distributed. IT is not permissible to pick up its lost property except by one who will announce it publicly." Al-Abbas who was a man of experience, stood up and said: "Except Idkhair, for we use it for our raves and houses." He said: "Except Idhkhir."  

النسائي:٢٨٩٢أَخْبَرَنَا سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ عَمْرٍو عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ هَذِهِ مَكَّةُ حَرَّمَهَا اللَّهُ ﷻ يَوْمَ خَلَقَ السَّمَوَاتِ وَالأَرْضَ لَمْ تَحِلَّ لأَحَدٍ قَبْلِي وَلاَ لأَحَدٍ بَعْدِي وَإِنَّمَا أُحِلَّتْ لِي سَاعَةً مِنْ نَهَارٍ وَهِيَ سَاعَتِي هَذِهِ حَرَامٌ بِحَرَامِ اللَّهِ إِلَى يَوْمِ الْقِيَامَةِ لاَ يُخْتَلَى خَلاَهَا وَلاَ يُعْضَدُ شَجَرُهَا وَلاَ يُنَفَّرُ صَيْدُهَا وَلاَ تَحِلُّ لُقَطَتُهَا إِلاَّ لِمُنْشِدٍ فَقَامَ الْعَبَّاسُ وَكَانَ رَجُلاً مُجَرِّبًا فَقَالَ إِلاَّ الإِذْخِرَ فَإِنَّهُ لِبُيُوتِنَا وَقُبُورِنَا فَقَالَ إِلاَّ الإِذْخِرَ

[Machine] The Messenger of Allah ﷺ said on the day of the Conquest of Mecca: "Indeed, this city is sacred, which Allah made sacred on the day He created the heavens and the earth. It is prohibited and forbidden by Allah until the Day of Resurrection. No one is allowed to shed blood in it except for me, and it is not permissible for anyone after me until the Hour is established. And the only time it is permissible for me is an hour during the day. It is prohibited and forbidden by Allah Almighty until the Hour is established. Its thorns should not be uprooted, its grass should not be uprooted, its game should not be disturbed, and its prey should not be taken except by someone who is noble. Abbas, who was from the people of Mecca, said: "Messenger of Allah, they have a need for it, for it is theirs (their provision) for both graves and homes." The Messenger of Allah ﷺ said: "Except for the izhar."  

أحمد:٢٣٥٣حَدَّثَنَا عَبِيدَةُ حَدَّثَنِي مَنْصُورٌ عَنْ مُجَاهِدٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ قَالَ

[Machine] "The Prophet of Allah ﷺ said on the day of Mecca's conquest, 'Indeed, Allah, may His remembrance be glorified, made Mecca sacred on the day He created the heavens and the earth. It is sacred by the sanctity of Allah until the Day of Judgment. Its game should not be disturbed, its trees should not be cut, its grass should not be uprooted, and its prey should not be chased except by a skilled poet.' So Al-Abbas ibn Abd al-Muttalib said, 'Except for the incense, O Messenger of Allah, the needs of the people and homes require it.' The Prophet ﷺ remained silent for a while and then said, 'Except for incense, for it is permissible.'"

أَنَّ نَبِيَّ اللهِ ﷺ قَالَ يَوْمَ الْفَتْحِ «إِنَّ اللهَ جَلَّ ذِكْرُهُ حَرَّمَ مَكَّةَ يَوْمَ خَلَقَ السَّمَاوَاتِ وَالْأَرْضَ فَهِيَ حَرَامٌ بِحَرَامِ اللهِ إِلَى يَوْمِ الْقِيَامَةِ لَا يُنَفَّرُ صَيْدُهَا وَلَا يُعْضَدُ شَجَرُهَا وَلَا يُخْتَلَى خَلَاهَا وَلَا يَحِلُّ لُقَطَتُهَا إِلَّا لِمُنْشِدٍ» فَقَالَ الْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ إِلَّا الْإِذْخِرَ يَا رَسُولَ اللهِ إِنَّهُ لَا بُدَّ لِلْقَيْنِ وَالْبُيُوتِ فَسَكَتَ النَّبِيُّ ﷺ سَاعَةً فَقَالَ «إِلَّا الْإِذْخِرَ إِنَّهُ حَلَالٌ»

"This Makkah was made sacred by Allah, the Mighty and Sublime, the day He created the heavens and the Earth. Fighting therein was not permitted for any one before me or after me rather it was permitted for me for a short part of a day. At this moment it is a sanctuary that is sacred by the decree of Allah until the Day of Resurrection. Its green grass is not to be uprooted or cut, its trees are not to be cut and its game is not to be distributed. IT is not permissible to pick up its lost property except by one who will announce it publicly." Al-Abbas who was a man of experience, stood up and said: "Except Idkhair, for we use it for our raves and houses." He said: "Except Idhkhir." (Using translation from Nasāʾī 2892)  

الكبرى للنسائي:٣٨٦١أَخْبَرَنَا سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ أَبُو عُبَيْدِ اللهِ مَخْزُومِيٌّ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ عَمْرٍو يَعْنِي ابْنَ دِينَارٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «هَذِهِ مَكَّةُ حَرَّمَهَا اللهُ يَوْمَ خَلَقَ السَّمَوَاتِ وَالْأَرْضَ لَمْ تَحِلَّ لِأَحَدٍ قَبْلِي وَلَا تَحِلُّ لِأَحَدٍ بَعْدِي وَإِنَّمَا أُحِلَّتْ لِي سَاعَةً مِنْ نَهَارٍ وَهِيَ مِنْ سَاعَتِي هَذِهِ حَرَامٌ بِحَرَامِ اللهِ إِلَى يَوْمِ الْقِيَامَةِ لَا يُخْتَلَى خَلَاهَا وَلَا يُعْضَدُ شَجَرُهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا تَحِلُّ لُقَطَتُهَا إِلَّا لِمُنْشِدٍ» فَقَامَ الْعَبَّاسُ وَكَانَ رَجُلًا مُجَرِّبًا فَقَالَ إِلَّا الْإِذْخِرَ فَإِنَّهُ لِبُيُوتِنَا وَقُبُورِنَا وَقُيُونِنَا فَقَالَ «إِلَّا الْإِذْخِرَ»

Messenger of Allah ﷺ got up on the day of the Conquest of Mecca and said, "Allah has made Mecca a sanctuary since the day He created the Heavens and the Earth, and it will remain a sanctuary by virtue of the sanctity Allah has bestowed on it till the Day of Resurrection. It (i.e. fighting in it) was not made lawful to anyone before me!, nor will it be made lawful to anyone after me, and it was not made lawful for me except for a short period of time. Its game should not be chased, nor should its trees be cut, nor its vegetation or grass uprooted, not its Luqata (i.e. Most things) picked up except by one who makes a public announcement about it." Al-Abbas bin ʿAbdul Muttalib said, "Except the Idhkhir, O Messenger of Allah ﷺ, as it is indispensable for blacksmiths and houses." On that, the Prophet ﷺ kept quiet and then said, "Except the Idhkhir as it is lawful to cut." (Using translation from Bukhārī 4313)

"إِنَّ الله حَرَّمَ مَكَّة يَوْمَ خلقَ السَّمَوَاتِ والأَرْضَ، فهِيَ حرَامٌ بحُرْمَةِ الله إِلى يَوْم الْقِيَامَة، لمْ تَحِلَّ لأحَدٍ قبْلي، ولا تَحلُّ لأَحدٍ بَعْدِى، ولمْ تَحِلَّ لي قطُّ إلا ساعةً مِنَ الدَّهْرِ، لا يُنَفَّرُ صَيدُها، وَلَا يُعْضدُ شوْكُها، وَلَا يُختَلى خَلَاهَا، وَلَا تَحلُّ لُقطتُها إلا لِمُنْشِد، فقال العبَّاسُ: إلا الإِذخِرَ يا رسولَ الله؛ فإِنَّهُ لا بُدَّ مِنْهُ لِلقَينِ والبيوتِ؟ قال: إلا الإِذخِرَ، فإِنَّهُ حَلَالٌ".

"لا هِجْرَةَ وَلَكِنْ جِهَادٌ وَنِيَّة، وإذا اسْتُنْفِرْتُم فَانْفِرُوا، فَإِنَّ هذا بلد حرَّمه اللهُ يومَ خَلَق السمواتِ والأَرْضَ، وهو حرامٌ بحرمةِ الله إلَى يومِ القِيَامةِ، وَإِنَّه لا يَحِلُّ القتَالُ فيه لأَحدٍ قَبْلي، ولَمْ يحلَّ لي إلا سَاعةً من نَهَار، فهو حرامٌ بحرمةِ اللهِ إلى يوم القِيَامَةِ، لا يُعْضَد شَوْكُه ولا يُنَفَّر صيدُه، ولا تُلْتقط لُقَطَتُه إِلا من عَرَّفَهَا، ولا يُختَلى خَلَاها. قال العَبَّاسُ: يا رسولَ الله: إلا الإذخر فإنَّه لِقَينهم وبُيُوتِهم، قال: إلا الإذْخر".
