Yahya related to me from Malik from Nafi from Abdullah ibn Umar that the Messenger of Allah ﷺ said, "If palm trees are sold after they have been pollinated, the fruit belongs to the seller unless the buyer makes a stipulation about its inclusion."

[Machine] "The Messenger of Allah ﷺ said: 'Whoever sells a palm tree that has been pollinated and its fruits have not yet ripened, its fruits belong to its owner (the seller) until the first. unless the buyer specifically states a condition.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ بَاعَ نَخْلًاقَدْ أُبِّرَتْ فَثَمَرَتُهَا لِرَبِّهَا الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ
