18. Emancipation of Slaves
١٨۔ كِتَابُ الْعِتْقِ
If anyone emancipates a slave who has property, the property of the slave belongs to him except that the master makes a stipulation. (Using translation from Abū Dāʾūd 3962)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ أَعْتَقَ عَبْدًا وَلَهُ مَالٌ فَمَالُ الْعَبْدِ لَهُ إِلَّا أَنْ يَشْتَرِطَ السَّيِّدُ فَيَكُونَ لَهُ»
[Machine] The Messenger of Allah ﷺ said: "Whoever frees a slave and he has wealth, then his wealth belongs to him unless he chooses to give it to him."
قَالَ رَسُولُ اللهِ ﷺ «مَنْ أَعْتَقَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لَهُ إِلَّا أَنْ يَسْتَثْنِيَهُ السَّيِّدُ»
[Machine] The Messenger of Allah ﷺ said: "Whichever man sells a palm tree that has been pollinated and its fruit has ripened, its fruit belongs to the buyer unless the seller specifies otherwise. And whichever man sells a slave while still possessing wealth, his wealth belongs to his lord unless the buyer stipulates otherwise." Shu'bah said: "I told him this Hadith with the narration of Ayyub from Nafi' that he narrated from the Prophet ﷺ regarding the palm tree and from 'Umar regarding the slave." 'Abd, said: "I do not know both of them except from the Prophet ﷺ" Then he repeated it another time and narrated it from the Prophet ﷺ without any doubt.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْأَوَّلِ وَأَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا وَلَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» قَالَ شُعْبَةُ فَحَدَّثْتُهُ بِحَدِيثِ أَيُّوبَ عَنْ نَافِعٍ أَنَّهُ حَدَّثَنِي بِالنَّخْلِ عَنِ النَّبِيِّ ﷺ وَالْمَمْلُوكِ عَنْ عُمَرَ فَقَالَ عَبْدُ رَبِّهِ لَا أَعْلَمُهُمَا جَمِيعًا إِلَّا عَنِ النَّبِيِّ ﷺ ثُمَّ قَالَ مَرَّةً أُخْرَى فَحَدَّثَ عَنِ النَّبِيِّ ﷺ وَلَمْ يَشُكَّ
[Machine] The Messenger of Allah ﷺ said, "Whoever sells a slave and has wealth, then the wealth is his except if the buyer specifies a condition. And whoever irrigates a palm tree and then sells it after it has been watered, then its fruits are his except if the buyer specifies a condition."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَلَهُ مَالُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَهُ بَعْدَ تَأْبِيرِهِ فَلَهُ ثَمَرُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»
The Prophet ﷺ as saying: If anyone buys a slave who possesses property. his property belongs to the seller unless buyer makes a provision and if anyone buys palm-trees after they have been fecundated, the fruit belongs to the seller unless the buyer make a provision. (Using translation from Abū Dāʾūd 3433)
قَالَ رَسُولُ اللهِ ﷺ «مَنِ ابْتَاعَ نَخْلًا مُؤَبَّرًا فَثَمَرَتُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِسَيِّدِهِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»
[Machine] Umar spent his life as a slave being sold, and he had wealth. However, his wealth belongs to his master who sold him, unless the buyer stipulates his own payment.
«قَضَى عُمَرُ فِي الْعَبْدِ يُبَاعُ وَلَهُ مَالٌ فَإِنَّ مَالَهُ لِسَيِّدِهِ الَّذِي بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ مَالَهُ»

عَنِ النَّبِيِّ ﷺ قَالَ «مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»
[Machine] The Messenger of Allah ﷺ said, "Whoever sells a slave, his wealth belongs to the seller unless the purchaser stipulates otherwise. And whoever sells a palm tree that has borne fruit, the fruit belongs to the seller unless the purchaser stipulates otherwise." And the wording is from Muhammad 4974. Muhammad ibn Raaf' said that Abdul Razzaq narrated to us, and Isaac ibn Ibrahim narrated to us, saying that Abdul Razzaq said that Ma'mar narrated from Matar al-Warraq from Ikrimah ibn Khalid from Ibn Umar from the Prophet ﷺ the same hadith as Al-Zuhri. And Isaac said the same.
قَالَ رَسُولُ اللهِ ﷺ «مَنْ بَاعَ عَبْدًا فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا فِيهَا ثَمَرَةٌ قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» وَاللَّفْظُ لِمُحَمَّدٍ 4974 أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ النَّيْسَابُورِيُّ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ وَأَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ حَدَّثَنَا مَعْمَرٌ عَنْ مَطَرٍ الْوَرَّاقِ عَنْ عِكْرِمَةَ بْنِ خَالِدٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ مِثْلَ حَدِيثِ الزُّهْرِيِّ هَذَا وَقَالَ إِسْحَاقُ مِثْلَهُ
[Machine] About the Prophet Muhammad ﷺ who said: "Whoever buys a slave and he has money..." and then he mentioned a similar hadith from Ibn Uyaynah about Az-Zuhri.
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ» فَذَكَرَ مِثْلَ حَدِيثِ ابْنِ عُيَيْنَةَ عَنِ الزُّهْرِيِّ
