18. Emancipation of Slaves
١٨۔ كِتَابُ الْعِتْقِ
عَنْ دُبُرٍ فَدَعَا بِهِ النَّبِيُّ ﷺ فَبَاعَهُ»
[Machine] "At the end, the Prophet ﷺ called for Dubur and sold him."
عَنْ دُبُرٍ فَدَعَا بِهِ النَّبِيُّ ﷺ فَبَاعَهُ»
A man pledged that his slave would be manumitted after his death. The Prophet ﷺ asked, "Who will buy the slave from me?" Nu'aim bin ʿAbdullah bought the slave and the Prophet ﷺ took its price and gave it to the owner. (Using translation from Bukhārī 2403)
رَسُولُ اللهِ ﷺ «مَنْ يَشْتَرِيهِ؟» فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ فَأَخَذَ رَسُولُ اللهِ ﷺ ثَمَنَهُ فَأَعْطَاهُ إِيَّاهُ
[Machine] About Dubur, who was in need, this was mentioned to the Messenger of Allah ﷺ so he called him and said, "Have you freed your slave?" He replied, "Yes." The Prophet ﷺ then said, "You are more in need of him." Then he asked, "Who will buy him?" Nuaim bin Abdullah said, "I will." So he bought him, and then the Prophet ﷺ took the price and gave it to his owner.
عَنْ دُبُرٍ وَكَانَ مُحْتَاجًا فَذُكِرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَدَعَاهُ فَقَالَ «أَعْتَقْتَ غُلَامَكَ؟» قَالَ نَعَمْ فَقَالَ النَّبِيُّ ﷺ أَنْتَ أَحْوَجُ إِلَيْهِ ثُمَّ قَالَ مَنْ يَشْتَرِيهِ؟ قَالَ نُعَيْمُ بْنُ عَبْدِ اللهِ أَنَا فَاشْتَرَاهُ ثُمَّ أَخَذَ النَّبِيُّ ﷺ ثَمَنَهُ فَدَفَعَهُ إِلَى صَاحِبِهِ
[Machine] A man said that a person was appointed as a servant to the Messenger of Allah ﷺ who did not possess any wealth besides him. After some time, the Messenger of Allah ﷺ took the slave and sold him, then he gave the owner the price of the slave.
قَالَ جَعَلَ رَجُلٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ غُلَامًا لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ حُرًّا مِنْ بَعْدِهِ فَأَخَذَ رَسُولُ اللهِ ﷺ الْعَبْدُ «فَبَاعَهُ ثُمَّ أَعْطَى صَاحِبَهُ ثَمَنَهُ»
the Prophet sold a Mudabbar. (Using translation from Nasāʾī 4654)
أَنَّ النَّبِيَّ ﷺ «بَاعَ الْمُدَبِّرُ»
[Machine] A man from the companions of the Prophet ﷺ freed a slave that he owned in exchange for a dhubur, and he did not have any other wealth except for him. So the Messenger of Allah ﷺ sold the slave for 800 dirhams and gave the amount to his master.
أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَعْتَقَ عَبْدًا لَهُ عَنْ دُبُرٍ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ «فَبَاعَ رَسُولُ اللهِ ﷺ الْعَبْدَ بِثَمَانِمِائَةِ دِرْهَمٍ وَدَفَعَهُ إِلَى مَوْلَاهُ»
[Machine] About Dubur who was needy and had a debt, so the Messenger of Allah ﷺ sold him for eight hundred dirhams and gave him the amount, then said, "Pay off your debt."
عَنْ دُبُرٍ وَكَانَ مُحْتَاجًا وَكَانَ عَلَيْهِ دَيْنٌ فَبَاعَهُ رَسُولُ اللهِ ﷺ بِثَمَانِمِائَةِ دِرْهَمٍ فَأَعْطَاهُ فَقَالَ «اقْضِ دَيْنَكَ»
[Machine] Narrated by the Prophet ﷺ that a man freed a slave of his from the back end, and then his master became in need. So, he ordered the slave to be sold for eight hundred. The Messenger of Allah ﷺ said to him, "Spend it on your family, for charity is only from surplus wealth. Begin with those whom you are responsible for."
عَنِ النَّبِيِّ ﷺ أَنَّ رَجُلًا أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ فَاحْتَاجَ مَوْلَاهُ فَأَمَرَ بِبَيْعِهِ فَبَاعَهُ بِثَمَانِمِائَةٍ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «أَنْفِقْهَا عَلَى عِيَالِكَ فَإِنَّمَا الصَّدَقَةُ عَنْ ظَهْرِ غِنًى وَابْدَأْ بِمَنْ تَعُولُ»
A man of the Ansar called Abu Madhkur declared that his slave called Ya'qub would be free after his death, but he had no other property. So the Messenger of Allah ﷺ called him and said: Who will buy him ? Nu'aim b. 'Abd Allah b. al-Nahham bought him for eight hundred dirhams. When he handed them over to him, he (Prophet) said: If any of you is poor, he should begin from himself ; if anything is left over, give it to your family; if anything is left over, give it to your relatives ; if anything is left over (when they received something), then here and here. يُقَالُ لَهُ يَعْقُوبُ لَمْ يَكُنْ لَهُ غَيْرُهُ فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَقَالَ «مَنْ يَشْتَريهِ؟ مَنْ يَشْتَريهِ؟» فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ بِثَمَانِمِائَةِ دِرْهَمٍ فَبَعَثَهَا إِلَيْهِ وَقَالَ «إِذَا كَانَ أَحَدُكُمْ فَقِيرًا فَلْيَبْدَأْ بِنَفْسِهِ فَإِنْ كَانَ فَضْلٌ فَعَلَى عِيَالِهِ فَإِنْ كَانَ فَضْلٌ فَعَلَى قَرَابَتِهِ أَوْ عَلَى ذِي رَحِمِهِ فَإِنْ كَانَ فَضْلٌ فَهَاهُنَا وَهَاهُنَا»
A person from the Banu 'Udhra set a slave free after his death. This news reached the Messenger of Allah (may peace be upon hhn). Upon this he said: Have you any property besides it? He said: No. Upon this he said: Who would buy (this slave) from me? Nulaim b. Abdullah bought it for eight hundred dirhams and (this amount was) brought to the Messenger of Allah ﷺ who returned it to him (the owner), and then said: Start with your own self and spend it on yourself, and if anything is left, it should be spent on your family, and if anything is left (after meeting the needs of the family) it should be spent on relatives, and if anything is left from the family, it should be spent like this, like this. And he was saying: In front of you, on your right and on your left. (Using translation from Muslim 997a)
عَنْ دُبُرٍ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ «أَلَكَ مَالٌ غَيْرَهُ؟» قَالَ لَا قَالَ رَسُولُ اللهِ ﷺ «مَنْ يَشْتَرِيهِ مِنِّي؟» فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ الْعَدَوِيُّ بِثَمَانِمِائَةِ دِرْهَمٍ فَجَاءَ بِهَا رَسُولُ اللهِ ﷺ فَدَفَعَهَا إِلَيْهِ ثُمَّ قَالَ «ابْدَأْ بِنَفْسِكَ فَتَصَدَّقْ عَلَيْهَا فَإِنْ فَضَلَ شَيْءٌ فَلِأَهْلِكَ فَإِنْ فَضَلَ عَنْ أَهْلِكَ شَيْءٌ فَلِذِي قَرَابَتِكَ فَإِنْ فَضَلَ عَنْ ذِي قَرَابَتِكَ شَيْءٌ فَهَكَذَا وَهَكَذَا» يَقُولُ بَيْنَ يَدَيْكَ وَعَنْ يَمِينِكَ وَعَنْ شِمَالِكَ
A man manumitted a slave and he had no other property than that, so the Prophet ﷺ canceled the manumission (and sold the slave for him). Nu'aim bin Al-Nahham bought the slave from him. (Using translation from Bukhārī 2415)
أَنَّ رَجُلًا «أَعْتَقَ عَبْدًا لَهُ لَمْ يَكُنْ لَهُ مَالٌ غَيْرَهُ فَرَدَّهُ عَلَيْهِ رَسُولُ اللهِ ﷺ وَابْتَاعَهُ نُعَيْمُ بْنُ النَّحَّامِ»
