[Machine] The Messenger of Allah ﷺ said, "Whoever buys a palm tree that has been pruned and its fruits belong to the one who pruned it, except unless they make a separate agreement with the one who bought it."  

أحمد:٥٧٨٨حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ حَدَّثَنَا عُبَيْدُ اللهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ اشْتَرَى نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلَّذِي أَبَّرَهَا إِلَّا أَنْ يَشْرِطَ الَّذِي اشْتَرَاهَا

Messenger of Allah ﷺ said, "If somebody sells pollinated date palms, the fruits will be for the seller unless the buyer stipulates that they will be for himself (and the seller agrees).

If anyone buys palm-trees after they have been fecundated the fruit belongs to the seller unless the buyer makes a proviso.

Whichever tree is bought with its roots, and if it is fecundatedits fruit would belong to one who has grafted it except when the provision is laid down by the buyer.

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ أَيُّمَا نَخْلٍ اشْتُرِيَ أُصُولُهَا وَقَدْ أُبِّرَتْ فَإِنَّ ثَمَرَهَا لِلَّذِي أَبَّرَهَا إِلاَّ أَنْ يَشْتَرِطَ الَّذِي اشْتَرَاهَا  

malik:31-9Yaḥyá > Mālik > Nāfiʿ > ʿAbdullāh b. ʿUmar

Yahya related to me from Malik from Nafi from Abdullah ibn Umar that the Messenger of Allah ﷺ said, "If palm trees are sold after they have been pollinated, the fruit belongs to the seller unless the buyer makes a stipulation about its inclusion."  

مالك:٣١-٩حَدَّثَنِي يَحْيَى عَنْ مَالِكٍ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ بَاعَ نَخْلاً قَدْ أُبِّرَتْ فَثَمَرُهَا لِلْبَائِعِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ

[Machine] "The Messenger of Allah ﷺ said: 'Whoever sells a palm tree that has been pollinated and its fruits have not yet ripened, its fruits belong to its owner (the seller) until the first. unless the buyer specifically states a condition.'"

[Machine] From the Prophet ﷺ , he said: "Any date palm whose roots have been sold, and its fruits have grown, it belongs to the one who nurtured it, unless the buyer stipulates otherwise."
