٢٤۔ كِتَابُ الْبُيُوعِ ص ١
ذِكْرُ تَرَحُّمِ اللَّهِ جَلَّ وَعَلَا، عَلَى الْمُسَامِحِ فِي الْبَيْعِ، وَالشِّرَاءِ، وَالْقَبْضِ، وَالْإِعْطَاءِ
"May Allah have mercy on a person who is lenient when he sells, lenient when he buys, and lenient when he asks for payment. " (Using translation from Ibn Mājah 2203)
قَالَ رَسُولُ اللَّهِ ﷺ «رَحِمَ اللَّهُ عَبْدًا سَمْحًا إِذَا بَاعَ سَمْحًا إِذَا اشْتَرَى سَمْحًا إِذَا اقْتَضَى سَمْحًا إِذَا قَضَى»
ذِكْرُ الْأَمْرِ لِلْبَيْعَيْنِ أَنْ يَلْزَمَا الصِّدْقَ فِي بَيْعِهِمَا وَيُبَيِّنَا عَيْبًا عَلِمَاهُ لِأَنَّ ذَلِكَ سَبَبُ الْبَرَكَةِ فِي بَيْعِهِمَا
"The Messenger of Allah said: 'The two parties to a transaction have the choice so long as they have not separated. If they are honest and open, their transaction will be blessed, but if they tell lies and conceal anything, the blessing of their transaction will be lost." (Using translation from Nasāʾī 4457)
قَالَ رَسُولُ اللَّهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذِبَا وَكَتَمَا مُحِقَ بَرَكَةُ بَيْعِهِمَا»
ذِكْرُ الزَّجْرِ عَنْ غَشَّ الْمُسْلِمِينَ بَعْضُهُمْ بَعْضًا فِي الْبَيْعِ، وَالشِّرَاءِ، وَمَا أَشْبَهَهُمَا مِنَ الْأَحْوَالِ
[Machine] The Prophet passed by a dish of food, so he dipped his fingers in it and found moisture in it. He said, "What is this, O owner of the food?" He said, "Rain fell on it, O Messenger of Allah." He said, "Why didn't you put it on top of the food so that people could see it? Whoever deceives us is not one of us."
أَنَّ النَّبِيَّ مَرَّ عَلَى صُبْرَةِ طَعَامٍ فَأَدْخَلَ أَصَابِعَهُ فِيهَا فَإِذَا فِيهِ بَلَلٌ فَقَالَ «مَا هَذَا يَا صَاحِبَ الطَّعَامِ؟ » قَالَ أَصَابَتْهُ سَمَاءٌ يَا رَسُولَ اللَّهِ قَالَ «فَهَلَّا جَعَلْتَهُ فَوْقَ الطَّعَامِ حَتَّى يَرَاهُ النَّاسُ مَنْ غَشَّنَا فَلَيْسَ مِنَّا»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُنْفِقَ الْمَرْءُ سِلْعَتَهُ بِالْحَلِفِ الْكَاذِبَةِ
"Taking oaths may help you to make a sale but it takes (blessing) away from the earnings "(Sahih ) (Using translation from Nasāʾī 4461)
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «الْيَمِينُ الْكَاذِبَةُ مَنْفَقَةٌ لِلسِّلْعَةِ مَمْحَقَةٌ لِلْكَسْبِ»
ذِكْرُ الْبَيَانِ بِأَنَّ اللَّهَ جَلَّ وَعَلَا لَا يَنْظُرُ فِي الْقِيَامَةِ إِلَى مَنْ نَفَقَ سِلْعَتَهُ فِي الدُّنْيَا بِالْيَمِينِ الْكَاذِبَةِ
The Prophet ﷺ as saying: There are three to whom Allah will not speak and at whom He will not look on the Day of Resurrection, and whom He will not declare pure, and they will have a painful punishment. I asked: Who are they, Messenger of Allah, they are losers and disappointed ? He repeated it three times. I asked: Who are they. Messenger of Allah, they are losers and disappointed ? He replied: The one who wears a trailing robe, the one who takes account of what he gives, and the one who produces a ready sale of a commodity by false swearing. قَالَ رَسُولُ اللَّهِ ﷺ «ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللَّهُ وَلَا يَنْظُرُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ» قُلْتُ يَا رَسُولَ اللَّهِ مَنْ هُمْ خَابُوا وَخَسِرُوا؟ فَأَعَادَهَا فَقُلْتُ مَنْ هُمْ فَقَالَ «الْمُسْبِلُ وَالْمَنَّانُ وَالْمُنْفِقُ سِلْعَتَهُ بِالْحَلِفِ كَاذِبًا»
ذِكْرُ وَصْفِ بَعْضِ الْحَلِفِ الَّذِي مِنْ أَجْلِهِ يُبْغِضُ اللَّهُ جَلَّ وَعَلَا الْبَيَّاعَ
[Machine] The Messenger of Allah ﷺ said, "There are three types of people whom Allah does not speak to, nor looks at: a man who swears after Asr (the afternoon prayer) about the property of a Muslim, and he takes it unjustly; a man who swears that he has given more in exchange for his goods than he has actually given; and a man who prevents the surplus of water from reaching others, saying, 'Allah today I will prevent Your favor just as You prevented what I did not do with my hands.'"
قَالَ رَسُولُ اللَّهِ ﷺ «ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللَّهُ وَلَا يَنْظُرُ إِلَيْهِمْ رَجُلٌ حَلَفَ بَعْدَ الْعَصْرِ عَلَى مَالِ امْرِئٍ مُسْلِمٍ فَاقْتَطَعَهُ وَرَجُلٌ حَلَفَ لَقَدْ أَعْطَى بِسِلْعَتِهِ أَكْثَرَ مِمَّا أَعْطَى وَرَجُلٌ مَنَعَ فَضْلَ الْمَاءِ يَقُولُ اللَّهُ الْيَوْمَ أَمْنَعُكَ فَضْلِي كَمَا مَنَعْتَ فَضْلَ مَا لَمْ تَعْمَلْهُ يَدَاكَ»
ذِكْرُ وَصْفِ الْبَعْضِ الْآخَرِ مِنَ الْحَلِفِ الَّذِي مِنْ أَجْلِهِ يُبْغِضُ اللَّهُ جَلَّ وَعَلَا الْبَيَّاعَ
[Machine] An Arab man passed by with a sheep, so I said, "Will you sell it to me for three dirhams?" He said, "No, by Allah!" Then he sold it to someone else. I mentioned this to the Messenger of Allah ﷺ, and he said, "He sold his hereafter for his worldly life."
مَرَّ أَعْرَابِيٌّ بِشَاةٍ فَقُلْتُ تَبِيعُنِيهَا بِثَلَاثَةِ دَرَاهِمَ؟ قَالَ لَا وَاللَّهِ ثُمَّ بَاعَنِيهَا فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «بَاعَ آخِرَتَهُ بِدُنْيَاهُ»
ذِكْرُ إِثْبَاتِ الْفُجُورِ لِلتُّجَّارِ الَّذِينَ لَا يَتَّقُونَ اللَّهَ فِي بَيْعِهِمْ وَشِرَائِهِمْ
From his father, from his grandfather, that he went with the Messenger of Allah ﷺ to the Musalla, and he saw the people doing business so he said: 'O people of trade!' and they replied to the Messenger of Allah ﷺ turning their necks and their gazes towards him, and he said: Indeed the merchants will be resurrected on the Day of judgement with the wicked, except the one who has Taqwa of Allah, who behaves charitably and is truthful.'" (Using translation from Tirmidhī 1210)
أَنَّهُ خَرَجَ مَعَ رَسُولِ اللَّهِ ﷺ إِلَى الْبَقِيعِ وَالنَّاسُ يَتَبَايَعُونَ فَنَادَى يَا مَعْشَرَ التُّجَّارِ فَاسْتَجَابُوا لَهُ وَرَفَعُوا إِلَيْهِ أَبْصَارَهُمْ وَقَالَ «إِنَّ التُّجَّارَ يُبْعَثُونَ يَوْمَ الْقِيَامَةِ فُجَّارًا إِلَّا مَنِ اتَّقَى وَبَرَّ وَصَدَقَ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْبَيْعَ يَقَعُ بَيْنَ الْمُتَبَايِعَيْنِ بِلَفْظَةٍ تُؤَدِّي إِلَى رِضَاهُمَا، وَإِنْ لَمْ يَقُلِ الْبَائِعُ بِعْتُ وَلَا الْمُشْتَرِي اشْتَرَيْتُ
[Machine] "We traveled from Mecca to Medina and we stopped at a place outside of Medina. The Prophet ﷺ said, 'Sell me your camel.' I said, 'No, it belongs to you.' He said, 'No, sell it to me.' I said, 'No, it is yours, O Messenger of Allah.' He said, 'No, I mean sell it to me.' I said, 'There was a man who owed me some gold, so it is yours in exchange for that.' The Prophet ﷺ said, 'I have taken it, so take it to Medina.' When I arrived in Medina, the Messenger of Allah ﷺ said to Bilal, 'Give him a piece of gold and increase it.' Bilal gave me a piece of gold and added another carat. I said, 'Do not separate me from the extra gift of the Messenger of Allah ﷺ .' So, it was in a bag and the people of Sham took it during the free nights."
أَقْبَلْنَا مِنْ مَكَّةَ إِلَى الْمَدِينَةِ فَنَزَلْنَا مَنْزِلًا دُونَ الْمَدِينَةِ فَقَالَ النَّبِيُّ ﷺ «بِعْنِي جَمَلَكَ هَذَا» قُلْتُ لَا بَلْ هُوَ لَكَ قَالَ فَقَالَ «لَا بِعْنِيهِ» قُلْتُ لَا بَلْ هُوَ لَكَ يَا رَسُولَ اللَّهِ قَالَ «لَا بِعْنِيهِ» قُلْتُ كَانَ لِرَجُلٍ عَلَيَّ أُوقِيَّةٌ مِنْ ذَهَبٍ فَهُوَ لَكَ بِهَا قَالَ ﷺ «قَدْ أَخَذْتُهُ فَتَبَلَّغْ عَلَيْهِ إِلَى الْمَدِينَةِ» فَلَمَّا قَدِمْتُ الْمَدِينَةَ قَالَ رَسُولُ اللَّهِ ﷺ لِبِلَالٍ «أَعْطِهِ أُوقِيَّةً مِنْ ذَهَبٍ وَزِدْهُ» قَالَ فَأَعْطَانِي أُوقِيَّةً مِنْ ذَهَبٍ وَزَادَنِي قِيرَاطًا قَالَ فَقُلْتُ لَا تُفَارِقُنِي زِيَادَةُ رَسُولِ اللَّهِ ﷺ فَكَانَ فِي كِيسٍ فَأَخَذَهُ أَهْلُ الشَّامِ لَيَالِيَ الْحَرَّةِ
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُتَبَايِعَيْنِ لِكُلِّ وَاحِدٍ مِنْهُمَا فِي بَيْعِهِمَا الْخِيَارُ قَبْلَ أَنْ يَتَفَرَّقَا
”The two parties to a transaction have the choice (of annulling it) so long as they have not yet parted." (Using translation from Ibn Mājah 2182)
قَالَ رَسُولُ اللَّهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا»
ذِكْرُ خَبَرٍ فِيهِ كَالدَّلِيلِ عَلَى أَنَّ الْفِرَاقَ فِي خَبَرِ ابْنِ عُمَرَ الَّذِي ذَكَرْنَاهُ إِنَّمَا هُوَ فِرَاقُ الْأَبْدَانِ
The Prophet ﷺ said, "No deal is settled and finalized unless the buyer and the seller separate, except if the deal is optional (whereby the validity of the bargain depends on the stipulations agreed upon). (Using translation from Bukhārī 2113)
عَنِ النَّبِيِّ ﷺ قَالَ «كُلُّ بَيِّعَيْنِ لَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «فَإِنْ فَارَقَهُ فَلَا خِيَارَ لَهُ»، أَرَادَ بِهِ فِي غَيْرِ بَيْعِ الْخِيَارِ
Messenger of Allah ﷺ said, "Both the buyer and the seller have the option of canceling or confirming a bargain unless they separate, or the sale is optional." (See Hadith No.320). (Using translation from Bukhārī 2111)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْمُتَبَايعَانِ كُلُّ وَاحِدٍ مِنْهُمَا عَلَى صَاحِبِهِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
"When two men enter into a transaction, each of them has the choice (of annulling it) so long as they have not yet parted and are still together, or one of them has given the option or choice to the other. Once he has accepted the terms of the other, then the transaction is binding. If they part after concluding the transaction and neither of them has rescinded the transaction then the transaction is binding.” (Using translation from Ibn Mājah 2181)
عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ قَالَ «إِذَا تَبَايَعَ الرَّجُلَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعًا أَوْ يُخَيِّرُ أَحَدُهُمَا الْآخَرَ فَإِنْ خَيَّرَ أَحَدُهُمَا الْآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ فَإِنْ تَفَرَّقَا بَعْدَ أَنْ تَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ»
ذِكْرُ الْأَمْرِ لِمَنِ اشْتَرَى طَعَامًا، أَنْ يَكِيلَهُ رَجَاءَ وُجُودِ الْبَرَكَةِ فِيهِ
"I heard the Messenger of Allah ﷺ say: 'Measure your food, may you be blessed therein."' (Using translation from Ibn Mājah 2231)
قَالَ رَسُولُ اللَّهِ ﷺ «كِيلُوا طَعَامَكُمْ يُبَارَكْ لَكُمْ فِيهِ»
ذِكْرُ السَّبَبِ الَّذِي مِنْ أَجْلِهِ أَنْزَلَ اللَّهُ جَلَّ وَعَلَا {وَيْلٌ لِلْمُطَفِّفِينَ}
"When the Prophet ﷺ came to Al-Madinah, they were the worst people in weights and measures. Then Allah, Glorious is He revealed: "Woe to the Mutaffifun (those who give less in measure and weight)",[1] and they were fair in weights and measures after that. (Using translation from Ibn Mājah 2223)
«لَمَّا قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ كَانُوا مِنْ أَخْبَثِ النَّاسِ كَيْلًا فَأَنْزَلَ اللَّهُ ﷻ {وَيْلٌ لِلْمُطَفِّفِينَ} فَأَحْسَنُوا الْكَيْلَ بَعْدَ ذَلِكَ»
ذِكْرُ الْإِخْبَارِ عَنْ جَوَازِ أَخْذِ الْمَرْءِ فِي ثَمَنِ سِلْعَتِهِ الْمَبِيعَةِ الْعَيْنِ، الَّذِي لَمْ يَقَعِ الْعَقْدُ عَلَيْهِ مِنْ غَيْرِ أَنْ يَكُونَ بَيْنَهُمَا فِرَاقٌ
[Machine] "I used to sell camels in the (market) of Al-Baqi' and would take (payment) in dinars and give (change) in dirhams. I would also sell in dirhams and take (payment) in dinars. So I came to the Prophet ﷺ while he was in Hafsa's house and said, 'O Messenger of Allah, I sell camels in Al-Baqi' and take (payment) in dinars and give (change) in dirhams. The Prophet ﷺ said, 'There is no harm if you take them at their current day price and separate them, as long as there is no transaction between you two (i.e., no interest-based transaction).'"
كُنْتُ أَبِيعُ الْإِبِلَ فِي الْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ وَأَبِيعُ بِالدَّرَاهِمِ وَآخُذُ الدَّنَانِيرَ فَأَتَيْتُ النَّبِيَّ ﷺ وَهُوَ فِي بَيْتِ حَفْصَةَ فَقُلْتُ يَا رَسُولَ اللَّهِ إِنِّي أَبِيعُ الْإِبِلَ بِالْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ وَأَبِيعُ بِالدَّرَاهِمِ وَآخُذُ الدَّنَانِيرَ فَقَالَ النَّبِيُّ ﷺ «لَا بَأْسَ إِذَا أَخَذْتُهُمَا بِسِعْرِ يَوْمِهِمَا فَافْتَرَقْتُمَا وَلَيْسَ بَيْنَكُمَا شَيْءٌ»
ذِكْرُ الْبَيَانِ بِأَنَّ مُشْتَرِيَ النَّخْلَةِ بَعْدَمَا أُبِّرَتْ لَا يَكُونُ لَهُ مِنْ ثَمَرِهَا شَيْءٌ إِذَا لَمْ يَتَقَدَّمْهُ الشَّرْطُ
[Machine] The Messenger of Allah ﷺ said: "Whoever buys a palm tree after it has been pollinated and does not stipulate its fruit, then he has nothing. And whoever buys a slave and does not stipulate his money, then he has nothing."
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ اشْتَرَى نَخْلًا بَعْدَمَا أُبِّرَتْ وَلَمْ يَشْتَرِطْ ثَمَرَهَا فَلَا شَيْءَ لَهُ وَمَنِ اشْتَرَى عَبْدًا وَلَمْ يَشْتَرِطْ مَالَهُ فَلَا شَيْءَ لَهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ فَلَا شَيْءَ لَهُ أَرَادَ بِهِ الْبَائِعَ لَا الْمُشْتَرِيَ
The Prophet ﷺ as saying: If anyone buys a slave who possesses property. his property belongs to the seller unless buyer makes a provision and if anyone buys palm-trees after they have been fecundated, the fruit belongs to the seller unless the buyer make a provision. (Using translation from Abū Dāʾūd 3433)
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي بَاعَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»
ذِكْرُ الْبَيَانِ بِأَنَّ النَّخْلَ إِذَا أُبِّرَتْ وَالْعَبْدَ الَّذِي لَهُ مَالٌ، إِذَا بِيعَا يَكُونُ الثَّمَرُ وَالْمَالُ لِلْبَائِعِ مَا لَمْ يَتَقَدَّمْ لِلْمُبْتَاعِ فِيهِ الشَّرْطُ

النَّبِيَّ ﷺ قَالَ «مَنْ بَاعَ نَخِيلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلَّذِي بَاعَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْعَبْدَ الْمَأْذُونَ لَهُ فِي التِّجَارَةِ إِذَا بِيعَ وَلَهُ مَالٌ وَعَلَيْهِ دَيْنٌ يَكُونُ مَالُهُ لِبَائِعِهِ وَدَيْنُهُ عَلَيْهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys a slave who has wealth, the wealth belongs to him, and he is responsible for the slave's debt, unless the buyer specifies a condition. And whoever pollinates a date palm and then sells it after pollination, he has the right to its fruits, unless the buyer specifies a condition."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنِ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَلَهُ مَالُهُ وَعَلَيْهِ دَيْنُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَهُ بَعْدَ تَأْبِيرِهِ فَلَهُ ثَمَرُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»
24.1.12 Subsection
٢٤۔١۔١٢ ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْفِرَاقَ فِي خَبَرِ ابْنِ عُمَرَ الَّذِي ذَكَرْنَاهُ إِنَّمَا هُوَ فِرَاقُ الْأَبْدَانِ دُونَ الْفِرَاقِ الَّذِي يَكُونُ بِالْكَلَامِ
[Machine] "From the Prophet (PBUH), he said: 'Whoever makes a purchase, it is obligatory for him, and he is in the best position with regards to the owner of the item, as long as he does not separate from it. If he wishes, he may take it, and if he wishes, he may leave it. But if he separates from it, he has no choice.'"
عَنِ النَّبِيِّ ﷺ قَالَ «مَنِ ابْتَاعَ بَيْعًا فَوَجَبَ لَهُ فَهُوَ فِيهِ بِالْخِيَارِ عَلَى صَاحِبِهِ مَا لَمْ يُفَارِقْهُ إِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِنْ فَارَقَهُ فَلَا خِيَارَ لَهُ»
عَنِ النَّبِيِّ ﷺ مِثْلَهُ
24.2 [Machine] The Translation is "The Peace.
٢٤۔٢ بَابُ السَّلَمِ
ذِكْرُ الزَّجْرِ عَنِ اسْتِسْلَافِ الْمَرْءِ مَالَهُ إِلَّا فِي الشَّيْءِ الْمَعْلُومِ
[Machine] The Messenger of Allah ﷺ arrived in Medina and the people were lending to one another. The Messenger of Allah ﷺ said to them, "Whoever lends should not lend except in a known measure and weight." Abu Al-Minhaal, whose name is Abdul Rahman bin Mut'im.
قَدِمَ رَسُولُ اللَّهِ ﷺ الْمَدِينَةَ وَالنَّاسُ يُسْلِفُونَ فَقَالَ لَهُمْ رَسُولُ اللَّهِ ﷺ «مَنْ أَسْلَفَ فَلَا يُسْلِفْ إِلَّا فِي كَيْلٍ مَعْلُومٍ وَوَزْنٍ مَعْلُومٍ» أَبُو الْمِنْهَالِ هَذَا اسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ مُطْعِمٍ
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ أَنْ يُسْلِمَ وَإِنْ لَمْ يُعْلَمْ فِي ذَلِكَ الْوَقْتِ عِنْدَ الْمُسَلَّمِ إِلَيْهِ أَصْلُ مَا أَسْلَمَ فِيهِ
[Machine] "Yes, we used to receive a share of the spoils during the time of the Messenger of Allah ﷺ , and we would use it for wheat, barley, dates, and raisins." So I asked, "Did you distribute it among those who had crops and those who did not?" He replied, "We never asked them about that."
«نَعَمْ كُنَّا نَصِيبُ غَنَائِمَ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فَنُسْلِفُهَا فِي الْبُرِّ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ» فَقُلْتُ «عِنْدَ مَنْ لَهُ زَرْعٌ أَوْ عِنْدَ مَنْ لَيْسَ لَهُ زَرْعٌ؟ » فَقَالَ «مَا كُنَّا نَسْأَلُهُمْ عَنْ ذَلِكَ»
24.3 [Machine] The choice of defect
٢٤۔٣ بَابُ خِيَارِ الْعَيْبِ
ذِكْرُ الْبَيَانِ بِأَنَّ مُشْتَرِيَ الدَّابَّةِ إِذَا وَجَدَ بِهَا عَيْبًا بَعْدَ أَنْ نُتِجَتْ عِنْدَهُ كَانَ لَهُ رَدُّ الدَّابَّةِ عَلَى الْبَائِعِ بِالْعَيْبِ دُونَ النِّتَاجِ
The Messenger of Allah ﷺ said: Profit follows responsibility. (Using translation from Abū Dāʾūd 3508)
قَالَ رَسُولُ اللَّهِ ﷺ «الْخَرَاجُ بِالضَّمَانِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْغُلَامَ الْمَبِيعَ إِذَا وَجَدَ بِهِ الْعَيْبَ يَجِبَ أَنْ يَرُدَّهُ إِلَى بَائِعِهِ دُونَ مَا اسْتَغَلَّ مِنْهُ بَعْدَ شِرَائِهِ إِيَّاهُ
[Machine] "There was a slave between me and my partners, so we agreed among ourselves and some of the partners were absent. He came and refused to settle. So we disputed and brought the case to Hisham, who ruled in favor of returning the slave and paying the rent. The rent amounted to a thousand. I then went to Urwah ibn Zubair and informed him. He said, 'Aisha informed me that the Messenger of Allah ﷺ ruled that the rent should be paid with guarantee.' I went to Hisham and informed him, and he returned the slave but did not return the rent."
«كَانَ بَيْنِي وَبَيْنَ شُرَكَاءَ لِي عَبْدٌ فَاحْتَوَيْنَاهُ بَيْنَنَا وَكَانَ بَعْضُ الشُّرَكَاءِ غَائِبًا فَقَدِمَ وَأَبَى أَنْ يُجِيزَهُ فَخَاصَمْنَا إِلَى هِشَامٍ فَقَضَى بِرَدِّ الْغُلَامِ وَالْخَرَاجِ وَكَانَ الْخَرَاجُ بَلَغَ أَلْفًا فَأَتَيْتُ عُرْوَةَ بْنَ الزُّبَيْرِ فَأَخْبَرْتُهُ» فَقَالَ «أَخْبَرَتْنِي عَائِشَةُ عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ قَالَ » فَأَتَيْتُ هِشَامًا فَأَخْبَرْتُهُ فَرَدَّهُ وَلَمْ يَرُدَّ الْخَرَاجَ «
24.4 [Machine] The sale of the arranged
٢٤۔٤ بَابُ بَيْعِ الْمُدَبَّرِ
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ نَفَى جَوَازَ بَيْعِ الْمُدَبَّرِ فِي حَالَةٍ مِنَ الْأَحْوَالِ
the Prophet sold a Mudabbar. (Using translation from Nasāʾī 4654)
«أَنَّ النَّبِيَّ ﷺ بَاعَ الْمُدَبَّرَ»
ذِكْرُ إِبَاحَةِ بَيْعِ الْمُدَبَّرِ إِذَا كَانَ الْمُدَبَّرُ عَدِيمًا لَا مَالَ لَهُ
[Machine] A man from the Ansar had emancipated a boy he owned, although he did not have any wealth except for the boy. The Messenger of Allah ﷺ was informed of this, so he said, "Who will buy him from me?" Nuaim ibn Abdullah al-Nahham bought him for eight hundred dirhams and paid the amount to the man. Jabir said, "He was a Coptic slave who died in the first year."
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ غُلَامًا لَهُ لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ «مَنْ يَشْتَرِيهِ مِنِّي؟ » فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللَّهِ النَّحَّامُ بِثَمَانِ مِائَةِ دِرْهَمٍ فَدَفَعَهَا إِلَيْهِ قَالَ جَابِرٌ كَانَ عَبْدًا قِبْطِيًّا مَاتَ عَامَ الْأَوَّلِ
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَ جَابِرٍ إِنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ غُلَامًا لَهُ أَرَادَ بِهِ أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ دُونَ الْعِتْقِ الْبَتَاتِ
[Machine] It is said that Abu Mazkoor appointed a servant for himself. When the Prophet ﷺ heard about it, he said, "He has someone else's wealth." They replied, "No." He said, "Who will buy him from me?" So, Nuaim Al-Nahham bought him for eight hundred dirhams. The Prophet ﷺ said, "Spend it on yourself. If there is any surplus, then on your relatives. If there is still surplus, then here and there."
يُقَالُ لَهُ أَبُو مَذْكُورٍ دَبَّرَ غُلَامًا لَهُ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَقَالَ «لَهُ مَالُ غَيْرِهِ» قَالُوا لَا قَالَ «مَنْ يَشْتَرِيهِ مِنِّي» فَاشْتَرَاهُ نُعَيْمٌ النَّحَّامُ بِثَمَانِ مِائَةِ دِرْهَمٍ وَقَالَ النَّبِيُّ ﷺ «أَنْفِقْهَا عَلَى نَفْسِكَ فَإِنْ كَانَ فَضْلًا فَعَلَى أَقَارِبِكَ فَإِنْ كَانَ فَضْلًا فَهَاهُنَا وَهَاهُنَا»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِأَنَّ بَيْعَ الْمُدَبَّرِ يَجُوزُ عِنْدَ حَاجَةِ الْمُدَبَّرِ إِلَيْهِ
[Machine] "That Abu Madhkoor arranged a boy for himself and then became in need, so the Prophet ﷺ sold him, and said, 'If any of you is in need, let him start with himself. If there is any surplus, then for his family. And if there is still surplus, then for his relatives.'"
أَنَّ أَبَا مَذْكُورٍ دَبَّرَ غُلَامًا لَهُ فَاحْتَاجَ فَبَاعَهُ النَّبِيُّ ﷺ وَقَالَ «إِذَا كَانَ أَحَدُكُمْ مُحْتَاجًا فَلْيَبْدَأْ بِنَفْسِهِ فَإِنْ كَانَ فَضْلًا فَلِأَهْلِهِ فَإِنْ كَانَ فَضْلًا فَلِأَقَارِبِهِ»
ذِكْرُ جَوَازِ بَيْعِ الْمُدَبَّرِ إِذَا كَانَ الْمُدَبَّرُ عَدِيمًا لَا مَالَ لَهُ غَيْرَ مُدَبَّرِهِ
[Machine] A man from the companions of the Prophet ﷺ freed a slave that he owned after the death of the Prophet ﷺ . He did not possess any other wealth except for the slave. So, the Messenger of Allah ﷺ took the slave and sold him saying, "You are more in need of its price, and Allah is the richest."
أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَعْتَقَ عَبْدًا لَهُ مِنْ بَعْدِهِ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَأَخَذَهُ رَسُولُ اللَّهِ ﷺ فَبَاعَهُ وَقَالَ «أَنْتَ أَحْوَجُ إِلَى ثَمَنِهِ وَاللَّهُ عَنْهُ أَغْنَى»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا أَجَازَ الْمُصْطَفَى ﷺ بَيْعَ الْمُدَبَّرِ
[Machine] A man from the Ansar (helpers) had freed a slave boy named Ya'qub whose master was known as Abu Madhkur. The man did not have any wealth other than him, so he called upon the Prophet Muhammad ﷺ and asked, "Who will buy this from me?" Then, Nu'aim ibn Abdullah, the brother of Banu Adiy ibn Ka'b, bought him for eight hundred dirhams. Later, the man called upon the Prophet again, and he said to him, "If you are poor, start with yourself. If you have excess, take care of your family. If there is still extra, take care of your relatives. And if there is still extra, then give it to others." Whenever the Prophet relayed this story, he mentioned that Ya'qub was an Abyssinian slave who died in the first year.
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ وَاسْمُ الْغُلَامِ يَعْقُوبُ وَالَّذِي أَعْتَقَهُ يُدْعَى أَبَا مَذْكُورٍ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَدَعَا بِهِ النَّبِيُّ ﷺ فَقَالَ «مَنْ يَشْتَرِي هَذَا مِنِّي؟ » فَاشْتَرَاهُ مِنْهُ نُعَيْمُ بْنُ عَبْدِ اللَّهِ أَخُو بَنِي عَدِيِّ بْنِ كَعْبٍ بِثَمَانِ مِائَةِ دِرْهَمٍ ثُمَّ دَعَا بِهِ فَقَالَ «إِذَا كُنْتَ فَقِيرًا فَأَبْدَأُ بِنَفْسِكَ فَإِنْ كَانَ فَضْلًا فَعَلَى عِيَالِكَ فَإِنْ كَانَ فَضْلًا فَعَلَى قَرَابَتِكَ فَإِنْ كَانَ فَضْلًا فَهَاهُنَا وَهَاهُنَا» وَكَانَ إِذَا حَدَّثَ هَذَا الْحَدِيثَ قَالَ كَانَ عَبْدًا قِبْطِيًّا مَاتَ عَامَ أَوَّلٍ
24.5 [Machine] Pricing and Monopoly
٢٤۔٥ بَابُ التَّسْعِيرِ وَالِاحْتِكَارِ
ذِكْرُ مَا يُسْتَحَبُّ لِلْإِمَامِ تَرْكُ التَّسْعِيرِ لِلنَّاسِ فِي بِيَاعَاتِهِمْ
The people said: Messenger of Allah , prices have shot up, so fix prices for us. Thereupon the Messenger of Allah ﷺ said: Allah is the one Who fixes prices, Who withholds, gives lavishly and provides, and I hope that when I meet Allah, none of you will have any claim on me for an injustice regarding blood or property. غَلَا السِّعْرُ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فَقَالُوا يَا رَسُولَ اللَّهِ غَلَا السِّعْرُ فَسَعِّرْ لَنَا سِعْرًا فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ اللَّهَ هُوَ الْخَالِقُ الْقَابِضُ الْبَاسِطُ الرَّازِقُ وَإِنِّي لَأَرْجُو أَنْ لَا أَلْقَى اللَّهَ بِمَظْلِمَةٍ ظَلَمْتُهَا أَحَدًا مِنْكُمْ فِي أَهْلٍ وَلَا مَالٍ»
ذِكْرُ الزَّجْرِ عَنِ احْتِكَارِ الْمَرْءِ أَقْوَاتَ الْمُسْلِمِينَ الَّتِي لَا بُدَّ لَهُمْ مِنْهَا
"No one hoards but a sinner."' (Using translation from Ibn Mājah 2154)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَحْتَكِرُ إِلَّا خَاطِئٌ»
24.6 [Machine] Prohibited Sale
٢٤۔٦ بَابُ الْبَيْعِ الْمَنْهِيِّ عَنْهُ
ذِكْرُ الزَّجْرِ، عَنْ بَيْعِ الْخَنَازِيرِ وَالْأَصْنَامِ ضِدَّ قَوْلِ مَنْ أَبَاحَ بَيْعَهُمَا
[Machine] I heard the Messenger of Allah ﷺ say on the day of the conquest of Mecca: "Indeed, Allah and His Messenger have forbidden the sale of pigs, dead animals, and idols." A man then asked, "O Messenger of Allah, what do you think about the fat of dead animals? We use it to grease our skins and ship hulls, and we use it for lighting." The Messenger of Allah ﷺ replied, "May Allah fight the Jews! Indeed, Allah has forbidden them from using the fat of dead animals, so they melted it down, sold it, and consumed its price."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ يَوْمَ فَتْحِ مَكَّةَ «إِنَّ اللَّهَ وَرَسُولَهُ حَرَّمَا بَيْعَ الْخَنَازِيرِ وَبَيْعَ الْمَيْتَةِ وَبَيْعَ الْأَصْنَامِ» فَقَالَ رَجُلٌ يَا رَسُولَ اللَّهِ فَمَا تَرَى فِي شَحْمِ الْمَيْتَةِ فَإِنَّا نَدْهِنُ بِهِ الْجُلُودَ وَالسُّفُنَ وَنَسْتَصْبِحُ بِهِ فَقَالَ «قَاتَلَ اللَّهُ الْيَهُودَ إِنَّ اللَّهَ حَرَّمَ عَلَيْهِمْ شُحُومَهَا فَجَمَلُوهَا ثُمَّ بَاعُوهَا وَأَكَلُوا أَثْمَانَهَا»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ بَيْعَ الْخَنَازِيرِ وَالْكِلَابِ مُحَرَّمٌ، وَلَا يَجُوزُ اسْتِعْمَالُهُ
[Machine] "The Prophet ﷺ looked at the sky and said, 'May Allah curse the Jews! They have been prohibited from consuming fat, so they sold it and ate its price. Indeed, when Allah prohibits something, He also prohibits its price.'"
أَنَّ النَّبِيَّ ﷺ نَظَرَ إِلَى السَّمَاءِ وَقَالَ «قَاتَلَ اللَّهُ الْيَهُودَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا وَإِنَّ اللَّهَ إِذَا حَرَّمَ شَيْئًا حَرَّمَ ثَمَنَهُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْكِلَابِ وَالدِّمَاءِ
The Prophet ﷺ forbade payment for dog and cat. (Using translation from Abū Dāʾūd 3479)
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ ثَمَنِ الدَّمِ وَثَمَنِ الْكَلْبِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ السَّنَانِيرِ
I asked Jabir about the price of a dog and a cat; he said: Messenger of Allah ﷺ disapproved of that. (Using translation from Muslim 1569)
«زَجَرَ رَسُولُ اللَّهِ ﷺ عَنْ ذَلِكَ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ أَبَاحَ بَيْعَ السَّنَانِيرِ
[Machine] From the Messenger of Allah ﷺ , he said: "The dowry of a fornicator, the price of a dog, the earnings of a fortune teller, and the income of a blood money collector are all considered unlawful."
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «إِنَّ مَهْرَ الْبَغِيِّ وَثَمَنَ الْكَلْبِ وَالسِّنَّوْرِ وَكَسْبِ الْحَجَّامِ مِنَ السُّحْتِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْخَمْرِ وَشِرَائِهِ إِذِ اللَّهُ جَلَّ وَعَلَا حَرَّمَ شُرْبَهَا
"A man gave the Messenger of Allah a skin full of wine, and the Prophet said to him;' did you know that Allah has forbidden it?' He whispered something and I did not understand what he whispered as I wanted to. I asked a person who was beside him and the Prophet said to him; 'What are you whispering about?' He said: 'I told him to sell it.' The Prophet said: 'The One Who forbade drinking it also forbade selling it.' Then he opened the vessels and poured out their contents. ابْنُ عَبَّاسٍ أَهْدَى رَجُلٌ لِرَسُولِ اللَّهِ ﷺ رَاوِيَةَ خَمْرٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «أَمَا عَلِمْتَ أَنَّ اللَّهَ جَلَّ وَعَلَا حَرَّمَ شُرْبَهَا» فَسَارَ الرَّجُلُ إِنْسَانًا إِلَى جَنْبِهِ فَقَالَ النَّبِيُّ ﷺ «بِمَ سَارَرْتَهُ؟ » فَقَالَ أَمَرْتُهُ أَنْ يَبِيعُهَا فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا فَفَتَحَ الْمَزَادَتَيْنِ حَتَّى ذَهَبَ مَا فِيهِمَا»
ذِكْرُ تَحْرِيمِ الْمُصْطَفَى ﷺ التِّجَارَةَ فِي الْخَمْرِ
“When the Verses at the end of Surat Al-Baqarah concerning usury were revealed, the Messenger of Allah ﷺ went out and forbade dealing in wine.” (Using translation from Ibn Mājah 3382)
«لَمَّا أُنْزِلَتِ الْآيَاتُ مِنْ آخِرِ الْبَقَرَةِ فِي الرِّبَا خَرَجَ رَسُولُ اللَّهِ ﷺ فَحَرَّمَ التِّجَارَةَ فِي الْخَمْرِ»
ذِكْرُ الْبَيَانِ بِأَنَّ اللَّهَ جَلَّ وَعَلَا حَرَّمَ بَيْعَ الْخَمْرِ كَمَا حَرَّمَ شُرْبَهَا
[Machine] “A man went out and alcohol (khamr) was permissible. So, he gifted the Messenger of Allahﷺ a container of alcohol. He carried it on a camel until he found the Messenger of Allahﷺ sitting. The man said, 'What is this with you?' The man replied, 'It is a container of alcohol that I have gifted to you.' The Messenger of Allahﷺ said, 'Do you know that Allah, the Most High, has prohibited it?' He replied, 'No.' The Messenger of Allahﷺ said, 'Verily, Allah has forbidden it.' The man turned to the leader of the camel, whispered something to him, and the man got up. The Messenger of Allahﷺ asked, 'What did you say to him?' He replied, 'I commanded him to sell it.' The Messenger of Allahﷺ said, 'Whoever has forbidden its consumption has also forbidden its sale.' The man instructed for the container to be broken open and emptied in the sand. So, I looked towards it in the open space and found nothing in it."
أَنَّ رَجُلًا خَرَجَ وَالْخَمْرُ حَلَالٌ فَأَهْدَى لِرَسُولِ اللَّهِ ﷺ رَاوِيَةَ خَمْرٍ فَأَقْبَلَ بِهَا عَلَى بَعِيرٍ حَتَّى وَجَدَ رَسُولَ اللَّهِ ﷺ جَالِسًا فَقَالَ «مَا هَذَا مَعَكَ؟ » قَالَ رَاوِيَةٌ مِنْ خَمْرٍ أَهْدَيْتُهَا لَكَ قَالَ «هَلْ عَلِمْتَ أَنَّ اللَّهَ جَلَّ وَعَلَا حَرَّمَهَا» قَالَ لَا قَالَ «فَإِنَّ اللَّهَ قَدْ حَرَّمَهَا» فَالْتَفَتَ الرَّجُلُ إِلَى قَائِدِ الْبَعِيرِ فَكَلَّمَهُ بِشَيْءٍ فِيمَا بَيْنَهُ وَبَيْنَهُ فَقَامَ فَقَالَ ﷺ «مَاذَا قُلْتَ لَهُ» قَالَ أَمَرْتُهُ بِبَيْعِهَا قَالَ «إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا» قَالَ فَأَمَرَ بِعَزَالِي الْمَزَادَةِ فَفُتِحَتْ فَخَرَجْتُ فِي التُّرَابِ فَنَظَرْتُ إِلَيْهَا فِي الْبَطْحَاءِ مَا فِيهَا شَيْءٌ
ذِكْرُ الْبَيَانِ بِأَنَّ الْخَمْرَ لَا يَحِلُّ بَيْعُهَا وَإِنْ كَانَ عِنْدَ الْمُحْتَاجِ إِلَى ثَمَنِهَا
[Machine] On that day, I gave drink to eleven men. They commanded me to do so, and I served them with vessels full of intoxicants until the cups almost refused to contain the scent. Anas said: Their wine on that day was only mixed with grapes and dates. Then, a man came to the Prophet ﷺ and said: I had some orphan's money, and I bought wine with it. Should I sell it or give back his money? The Prophet ﷺ said: May Allah fight the Jews! They have been forbidden from consuming fats, but they sold it and consumed its price. The Prophet ﷺ did not permit me to sell the wine.
إِنِّي يَوْمَئِذٍ أَسْقِي أَحَدَ عَشَرَ رَجُلًا قَالَ فَأَمَرُونِي فَكَفَأْتُهَا وَكَفَأَ النَّاسُ آنِيَتَهُمْ بِمَا فِيهَا حَتَّى كَادَتِ السِّكَكُ تَمْتَنِعُ مِنْ رِيحِهَا قَالَ أَنَسٌ وَمَا خَمْرُهُمْ يَوْمَئِذٍ إِلَّا الْبُسْرُ وَالتَّمْرُ مَخْلُوطَيْنِ فَجَاءَ رَجُلٌ النَّبِيَّ ﷺ فَقَالَ إِنَّهُ قَدْ كَانَ عِنْدِي مَالُ يَتِيمٍ فَاشْتَرَيْتُ بِهِ خَمْرًا أَفَتَرَى أَنْ أَبِيعَهُ فَأَرُدَّ عَلَى الْيَتِيمِ مَالَهُ فَقَالَ النَّبِيُّ ﷺ «قَاتَلَ اللَّهُ الْيَهُودَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا» وَلَمْ يَأْذَنْ لِيَ النَّبِيُّ ﷺ فِي بَيْعِ الْخَمْرِ
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ
It was narrated from Ibn ʿUmar that the Messenger of Allah ﷺ forbade selling the offspring of the offspring that is still in the womb of a camel. (Using translation from Aḥmad 394)
«أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ»
ذِكْرُ وَصْفِ بَيْعِ حَبَلِ الْحَبَلَةِ الَّذِي نُهِيَ عَنْهُ
the Messenger of Allah forbade selling the offspring of the offspring of a pregnant animal (Habal Al-Habalah), which was a transaction practiced by the people of the Jahiliyyah, whereby a man would buy camel to slaughter, but he would wait until the she-camel had produced offspring and the offspring in her belly had then produced offspring. «أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ وَكَانَ بَيْعًا يَتَبَايَعُهُ أَهْلُ الْجَاهِلِيَّةِ كَانَ الرَّجُلُ يَبْتَاعُ الْجَزُورَ إِلَى أَنْ تُنْتَجَ النَّاقَةُ ثُمَّ تُنْتَجُ الَّتِي فِي بَطْنِهَا»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ
The Messenger of Allah ﷺ forbade selling or giving away the right to inheritance by a manumitted slave. (Using translation from Abū Dāʾūd 2919)
سَمِعْتُ ابْنَ عُمَرَ يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
The Prophet ﷺ forbade the selling of the Wala' (of slaves) or giving it as a present. (Using translation from Bukhārī 6756)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ» قَالَ زُهَيْرٌ وَحَدَّثَنِي بِهِ ابْنُ عَبْدِ اللَّهِ بْنِ دِينَارٍ عَنْ أَبِيهِ بِمِثْلِ ذَلِكَ اسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللَّهِ بْنِ دِينَارٍ
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا نُهِيَ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ
[Machine] The Messenger of Allah ﷺ said, "Al-Walaa' (loyalty and allegiance) is like the bond of kinship, it cannot be bought or given away."
قَالَ رَسُولُ اللَّهِ ﷺ «الْوَلَاءُ لُحْمَةٌ كَلُحْمَةِ النَّسَبِ لَا يُبَاعُ وَلَا يُوهَبُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْحَمْلِ فِي الْبَطْنِ وَالطَّيْرِ فِي الْهَوَاءِ وَالسَّمَكِ فِي الْمَاءِ قَبْلَ أَنْ يُصْطَادَ
"The Messenger of Allah ﷺ forbade Gharar transactions. " (Using translation from Ibn Mājah 2195)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْغَرَرِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمَاءِ بِذِكْرِ لَفْظَةٍ غَيْرِ مُفَسَّرَةٍ
[Machine] From Iyas ibn Abd al-Muzanni, who was one of the companions of the Messenger of Allah ﷺ , he said, "The Messenger of Allah ﷺ prohibited the selling of water." It is unclear which specific water he was referring to.
عَنْ إِيَاسِ بْنِ عَبْدِ الْمُزَنِيِّ وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ قَالَ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْمَاءِ» لَا يَدْرِي عَمْرٌو أَيَّ مَاءٍ هُوَ
