٢٤۔ كِتَابُ الْبُيُوعِ
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ نَفَى جَوَازَ بَيْعِ الْمُدَبَّرِ فِي حَالَةٍ مِنَ الْأَحْوَالِ
the Prophet sold a Mudabbar. (Using translation from Nasāʾī 4654)
«أَنَّ النَّبِيَّ ﷺ بَاعَ الْمُدَبَّرَ»
ذِكْرُ إِبَاحَةِ بَيْعِ الْمُدَبَّرِ إِذَا كَانَ الْمُدَبَّرُ عَدِيمًا لَا مَالَ لَهُ
[Machine] A man from the Ansar had emancipated a boy he owned, although he did not have any wealth except for the boy. The Messenger of Allah ﷺ was informed of this, so he said, "Who will buy him from me?" Nuaim ibn Abdullah al-Nahham bought him for eight hundred dirhams and paid the amount to the man. Jabir said, "He was a Coptic slave who died in the first year."
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ غُلَامًا لَهُ لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ «مَنْ يَشْتَرِيهِ مِنِّي؟ » فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللَّهِ النَّحَّامُ بِثَمَانِ مِائَةِ دِرْهَمٍ فَدَفَعَهَا إِلَيْهِ قَالَ جَابِرٌ كَانَ عَبْدًا قِبْطِيًّا مَاتَ عَامَ الْأَوَّلِ
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَ جَابِرٍ إِنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ غُلَامًا لَهُ أَرَادَ بِهِ أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ دُونَ الْعِتْقِ الْبَتَاتِ
[Machine] It is said that Abu Mazkoor appointed a servant for himself. When the Prophet ﷺ heard about it, he said, "He has someone else's wealth." They replied, "No." He said, "Who will buy him from me?" So, Nuaim Al-Nahham bought him for eight hundred dirhams. The Prophet ﷺ said, "Spend it on yourself. If there is any surplus, then on your relatives. If there is still surplus, then here and there."
يُقَالُ لَهُ أَبُو مَذْكُورٍ دَبَّرَ غُلَامًا لَهُ فَبَلَغَ ذَلِكَ النَّبِيَّ ﷺ فَقَالَ «لَهُ مَالُ غَيْرِهِ» قَالُوا لَا قَالَ «مَنْ يَشْتَرِيهِ مِنِّي» فَاشْتَرَاهُ نُعَيْمٌ النَّحَّامُ بِثَمَانِ مِائَةِ دِرْهَمٍ وَقَالَ النَّبِيُّ ﷺ «أَنْفِقْهَا عَلَى نَفْسِكَ فَإِنْ كَانَ فَضْلًا فَعَلَى أَقَارِبِكَ فَإِنْ كَانَ فَضْلًا فَهَاهُنَا وَهَاهُنَا»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِأَنَّ بَيْعَ الْمُدَبَّرِ يَجُوزُ عِنْدَ حَاجَةِ الْمُدَبَّرِ إِلَيْهِ
[Machine] "That Abu Madhkoor arranged a boy for himself and then became in need, so the Prophet ﷺ sold him, and said, 'If any of you is in need, let him start with himself. If there is any surplus, then for his family. And if there is still surplus, then for his relatives.'"
أَنَّ أَبَا مَذْكُورٍ دَبَّرَ غُلَامًا لَهُ فَاحْتَاجَ فَبَاعَهُ النَّبِيُّ ﷺ وَقَالَ «إِذَا كَانَ أَحَدُكُمْ مُحْتَاجًا فَلْيَبْدَأْ بِنَفْسِهِ فَإِنْ كَانَ فَضْلًا فَلِأَهْلِهِ فَإِنْ كَانَ فَضْلًا فَلِأَقَارِبِهِ»
ذِكْرُ جَوَازِ بَيْعِ الْمُدَبَّرِ إِذَا كَانَ الْمُدَبَّرُ عَدِيمًا لَا مَالَ لَهُ غَيْرَ مُدَبَّرِهِ
[Machine] A man from the companions of the Prophet ﷺ freed a slave that he owned after the death of the Prophet ﷺ . He did not possess any other wealth except for the slave. So, the Messenger of Allah ﷺ took the slave and sold him saying, "You are more in need of its price, and Allah is the richest."
أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَعْتَقَ عَبْدًا لَهُ مِنْ بَعْدِهِ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَأَخَذَهُ رَسُولُ اللَّهِ ﷺ فَبَاعَهُ وَقَالَ «أَنْتَ أَحْوَجُ إِلَى ثَمَنِهِ وَاللَّهُ عَنْهُ أَغْنَى»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا أَجَازَ الْمُصْطَفَى ﷺ بَيْعَ الْمُدَبَّرِ
[Machine] A man from the Ansar (helpers) had freed a slave boy named Ya'qub whose master was known as Abu Madhkur. The man did not have any wealth other than him, so he called upon the Prophet Muhammad ﷺ and asked, "Who will buy this from me?" Then, Nu'aim ibn Abdullah, the brother of Banu Adiy ibn Ka'b, bought him for eight hundred dirhams. Later, the man called upon the Prophet again, and he said to him, "If you are poor, start with yourself. If you have excess, take care of your family. If there is still extra, take care of your relatives. And if there is still extra, then give it to others." Whenever the Prophet relayed this story, he mentioned that Ya'qub was an Abyssinian slave who died in the first year.
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ وَاسْمُ الْغُلَامِ يَعْقُوبُ وَالَّذِي أَعْتَقَهُ يُدْعَى أَبَا مَذْكُورٍ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَدَعَا بِهِ النَّبِيُّ ﷺ فَقَالَ «مَنْ يَشْتَرِي هَذَا مِنِّي؟ » فَاشْتَرَاهُ مِنْهُ نُعَيْمُ بْنُ عَبْدِ اللَّهِ أَخُو بَنِي عَدِيِّ بْنِ كَعْبٍ بِثَمَانِ مِائَةِ دِرْهَمٍ ثُمَّ دَعَا بِهِ فَقَالَ «إِذَا كُنْتَ فَقِيرًا فَأَبْدَأُ بِنَفْسِكَ فَإِنْ كَانَ فَضْلًا فَعَلَى عِيَالِكَ فَإِنْ كَانَ فَضْلًا فَعَلَى قَرَابَتِكَ فَإِنْ كَانَ فَضْلًا فَهَاهُنَا وَهَاهُنَا» وَكَانَ إِذَا حَدَّثَ هَذَا الْحَدِيثَ قَالَ كَانَ عَبْدًا قِبْطِيًّا مَاتَ عَامَ أَوَّلٍ
