٢٤۔ كِتَابُ الْبُيُوعِ ص ١
ذِكْرُ الزَّجْرِ، عَنْ بَيْعِ الْخَنَازِيرِ وَالْأَصْنَامِ ضِدَّ قَوْلِ مَنْ أَبَاحَ بَيْعَهُمَا
[Machine] I heard the Messenger of Allah ﷺ say on the day of the conquest of Mecca: "Indeed, Allah and His Messenger have forbidden the sale of pigs, dead animals, and idols." A man then asked, "O Messenger of Allah, what do you think about the fat of dead animals? We use it to grease our skins and ship hulls, and we use it for lighting." The Messenger of Allah ﷺ replied, "May Allah fight the Jews! Indeed, Allah has forbidden them from using the fat of dead animals, so they melted it down, sold it, and consumed its price."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ يَوْمَ فَتْحِ مَكَّةَ «إِنَّ اللَّهَ وَرَسُولَهُ حَرَّمَا بَيْعَ الْخَنَازِيرِ وَبَيْعَ الْمَيْتَةِ وَبَيْعَ الْأَصْنَامِ» فَقَالَ رَجُلٌ يَا رَسُولَ اللَّهِ فَمَا تَرَى فِي شَحْمِ الْمَيْتَةِ فَإِنَّا نَدْهِنُ بِهِ الْجُلُودَ وَالسُّفُنَ وَنَسْتَصْبِحُ بِهِ فَقَالَ «قَاتَلَ اللَّهُ الْيَهُودَ إِنَّ اللَّهَ حَرَّمَ عَلَيْهِمْ شُحُومَهَا فَجَمَلُوهَا ثُمَّ بَاعُوهَا وَأَكَلُوا أَثْمَانَهَا»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ بَيْعَ الْخَنَازِيرِ وَالْكِلَابِ مُحَرَّمٌ، وَلَا يَجُوزُ اسْتِعْمَالُهُ
[Machine] "The Prophet ﷺ looked at the sky and said, 'May Allah curse the Jews! They have been prohibited from consuming fat, so they sold it and ate its price. Indeed, when Allah prohibits something, He also prohibits its price.'"
أَنَّ النَّبِيَّ ﷺ نَظَرَ إِلَى السَّمَاءِ وَقَالَ «قَاتَلَ اللَّهُ الْيَهُودَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا وَإِنَّ اللَّهَ إِذَا حَرَّمَ شَيْئًا حَرَّمَ ثَمَنَهُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْكِلَابِ وَالدِّمَاءِ
The Prophet ﷺ forbade payment for dog and cat. (Using translation from Abū Dāʾūd 3479)
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ ثَمَنِ الدَّمِ وَثَمَنِ الْكَلْبِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ السَّنَانِيرِ
I asked Jabir about the price of a dog and a cat; he said: Messenger of Allah ﷺ disapproved of that. (Using translation from Muslim 1569)
«زَجَرَ رَسُولُ اللَّهِ ﷺ عَنْ ذَلِكَ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ أَبَاحَ بَيْعَ السَّنَانِيرِ
[Machine] From the Messenger of Allah ﷺ , he said: "The dowry of a fornicator, the price of a dog, the earnings of a fortune teller, and the income of a blood money collector are all considered unlawful."
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «إِنَّ مَهْرَ الْبَغِيِّ وَثَمَنَ الْكَلْبِ وَالسِّنَّوْرِ وَكَسْبِ الْحَجَّامِ مِنَ السُّحْتِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْخَمْرِ وَشِرَائِهِ إِذِ اللَّهُ جَلَّ وَعَلَا حَرَّمَ شُرْبَهَا
"A man gave the Messenger of Allah a skin full of wine, and the Prophet said to him;' did you know that Allah has forbidden it?' He whispered something and I did not understand what he whispered as I wanted to. I asked a person who was beside him and the Prophet said to him; 'What are you whispering about?' He said: 'I told him to sell it.' The Prophet said: 'The One Who forbade drinking it also forbade selling it.' Then he opened the vessels and poured out their contents. ابْنُ عَبَّاسٍ أَهْدَى رَجُلٌ لِرَسُولِ اللَّهِ ﷺ رَاوِيَةَ خَمْرٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «أَمَا عَلِمْتَ أَنَّ اللَّهَ جَلَّ وَعَلَا حَرَّمَ شُرْبَهَا» فَسَارَ الرَّجُلُ إِنْسَانًا إِلَى جَنْبِهِ فَقَالَ النَّبِيُّ ﷺ «بِمَ سَارَرْتَهُ؟ » فَقَالَ أَمَرْتُهُ أَنْ يَبِيعُهَا فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا فَفَتَحَ الْمَزَادَتَيْنِ حَتَّى ذَهَبَ مَا فِيهِمَا»
ذِكْرُ تَحْرِيمِ الْمُصْطَفَى ﷺ التِّجَارَةَ فِي الْخَمْرِ
“When the Verses at the end of Surat Al-Baqarah concerning usury were revealed, the Messenger of Allah ﷺ went out and forbade dealing in wine.” (Using translation from Ibn Mājah 3382)
«لَمَّا أُنْزِلَتِ الْآيَاتُ مِنْ آخِرِ الْبَقَرَةِ فِي الرِّبَا خَرَجَ رَسُولُ اللَّهِ ﷺ فَحَرَّمَ التِّجَارَةَ فِي الْخَمْرِ»
ذِكْرُ الْبَيَانِ بِأَنَّ اللَّهَ جَلَّ وَعَلَا حَرَّمَ بَيْعَ الْخَمْرِ كَمَا حَرَّمَ شُرْبَهَا
[Machine] “A man went out and alcohol (khamr) was permissible. So, he gifted the Messenger of Allahﷺ a container of alcohol. He carried it on a camel until he found the Messenger of Allahﷺ sitting. The man said, 'What is this with you?' The man replied, 'It is a container of alcohol that I have gifted to you.' The Messenger of Allahﷺ said, 'Do you know that Allah, the Most High, has prohibited it?' He replied, 'No.' The Messenger of Allahﷺ said, 'Verily, Allah has forbidden it.' The man turned to the leader of the camel, whispered something to him, and the man got up. The Messenger of Allahﷺ asked, 'What did you say to him?' He replied, 'I commanded him to sell it.' The Messenger of Allahﷺ said, 'Whoever has forbidden its consumption has also forbidden its sale.' The man instructed for the container to be broken open and emptied in the sand. So, I looked towards it in the open space and found nothing in it."
أَنَّ رَجُلًا خَرَجَ وَالْخَمْرُ حَلَالٌ فَأَهْدَى لِرَسُولِ اللَّهِ ﷺ رَاوِيَةَ خَمْرٍ فَأَقْبَلَ بِهَا عَلَى بَعِيرٍ حَتَّى وَجَدَ رَسُولَ اللَّهِ ﷺ جَالِسًا فَقَالَ «مَا هَذَا مَعَكَ؟ » قَالَ رَاوِيَةٌ مِنْ خَمْرٍ أَهْدَيْتُهَا لَكَ قَالَ «هَلْ عَلِمْتَ أَنَّ اللَّهَ جَلَّ وَعَلَا حَرَّمَهَا» قَالَ لَا قَالَ «فَإِنَّ اللَّهَ قَدْ حَرَّمَهَا» فَالْتَفَتَ الرَّجُلُ إِلَى قَائِدِ الْبَعِيرِ فَكَلَّمَهُ بِشَيْءٍ فِيمَا بَيْنَهُ وَبَيْنَهُ فَقَامَ فَقَالَ ﷺ «مَاذَا قُلْتَ لَهُ» قَالَ أَمَرْتُهُ بِبَيْعِهَا قَالَ «إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا» قَالَ فَأَمَرَ بِعَزَالِي الْمَزَادَةِ فَفُتِحَتْ فَخَرَجْتُ فِي التُّرَابِ فَنَظَرْتُ إِلَيْهَا فِي الْبَطْحَاءِ مَا فِيهَا شَيْءٌ
ذِكْرُ الْبَيَانِ بِأَنَّ الْخَمْرَ لَا يَحِلُّ بَيْعُهَا وَإِنْ كَانَ عِنْدَ الْمُحْتَاجِ إِلَى ثَمَنِهَا
[Machine] On that day, I gave drink to eleven men. They commanded me to do so, and I served them with vessels full of intoxicants until the cups almost refused to contain the scent. Anas said: Their wine on that day was only mixed with grapes and dates. Then, a man came to the Prophet ﷺ and said: I had some orphan's money, and I bought wine with it. Should I sell it or give back his money? The Prophet ﷺ said: May Allah fight the Jews! They have been forbidden from consuming fats, but they sold it and consumed its price. The Prophet ﷺ did not permit me to sell the wine.
إِنِّي يَوْمَئِذٍ أَسْقِي أَحَدَ عَشَرَ رَجُلًا قَالَ فَأَمَرُونِي فَكَفَأْتُهَا وَكَفَأَ النَّاسُ آنِيَتَهُمْ بِمَا فِيهَا حَتَّى كَادَتِ السِّكَكُ تَمْتَنِعُ مِنْ رِيحِهَا قَالَ أَنَسٌ وَمَا خَمْرُهُمْ يَوْمَئِذٍ إِلَّا الْبُسْرُ وَالتَّمْرُ مَخْلُوطَيْنِ فَجَاءَ رَجُلٌ النَّبِيَّ ﷺ فَقَالَ إِنَّهُ قَدْ كَانَ عِنْدِي مَالُ يَتِيمٍ فَاشْتَرَيْتُ بِهِ خَمْرًا أَفَتَرَى أَنْ أَبِيعَهُ فَأَرُدَّ عَلَى الْيَتِيمِ مَالَهُ فَقَالَ النَّبِيُّ ﷺ «قَاتَلَ اللَّهُ الْيَهُودَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَبَاعُوهَا وَأَكَلُوا أَثْمَانَهَا» وَلَمْ يَأْذَنْ لِيَ النَّبِيُّ ﷺ فِي بَيْعِ الْخَمْرِ
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ
It was narrated from Ibn ʿUmar that the Messenger of Allah ﷺ forbade selling the offspring of the offspring that is still in the womb of a camel. (Using translation from Aḥmad 394)
«أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ»
ذِكْرُ وَصْفِ بَيْعِ حَبَلِ الْحَبَلَةِ الَّذِي نُهِيَ عَنْهُ
the Messenger of Allah forbade selling the offspring of the offspring of a pregnant animal (Habal Al-Habalah), which was a transaction practiced by the people of the Jahiliyyah, whereby a man would buy camel to slaughter, but he would wait until the she-camel had produced offspring and the offspring in her belly had then produced offspring. (Using translation from Nasāʾī 4625)
«أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ وَكَانَ بَيْعًا يَتَبَايَعُهُ أَهْلُ الْجَاهِلِيَّةِ كَانَ الرَّجُلُ يَبْتَاعُ الْجَزُورَ إِلَى أَنْ تُنْتَجَ النَّاقَةُ ثُمَّ تُنْتَجُ الَّتِي فِي بَطْنِهَا»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ
The Messenger of Allah ﷺ forbade selling or giving away the right to inheritance by a manumitted slave. (Using translation from Abū Dāʾūd 2919)
سَمِعْتُ ابْنَ عُمَرَ يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
The Prophet ﷺ forbade the selling of the Wala' (of slaves) or giving it as a present. (Using translation from Bukhārī 6756)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ» قَالَ زُهَيْرٌ وَحَدَّثَنِي بِهِ ابْنُ عَبْدِ اللَّهِ بْنِ دِينَارٍ عَنْ أَبِيهِ بِمِثْلِ ذَلِكَ اسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللَّهِ بْنِ دِينَارٍ
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا نُهِيَ عَنْ بَيْعِ الْوَلَاءِ وَعَنْ هِبَتِهِ
[Machine] The Messenger of Allah ﷺ said, "Al-Walaa' (loyalty and allegiance) is like the bond of kinship, it cannot be bought or given away."
قَالَ رَسُولُ اللَّهِ ﷺ «الْوَلَاءُ لُحْمَةٌ كَلُحْمَةِ النَّسَبِ لَا يُبَاعُ وَلَا يُوهَبُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْحَمْلِ فِي الْبَطْنِ وَالطَّيْرِ فِي الْهَوَاءِ وَالسَّمَكِ فِي الْمَاءِ قَبْلَ أَنْ يُصْطَادَ
"The Messenger of Allah ﷺ forbade Gharar transactions. " (Using translation from Ibn Mājah 2195)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْغَرَرِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمَاءِ بِذِكْرِ لَفْظَةٍ غَيْرِ مُفَسَّرَةٍ
[Machine] From Iyas ibn Abd al-Muzanni, who was one of the companions of the Messenger of Allah ﷺ , he said, "The Messenger of Allah ﷺ prohibited the selling of water." It is unclear which specific water he was referring to.
عَنْ إِيَاسِ بْنِ عَبْدِ الْمُزَنِيِّ وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ قَالَ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْمَاءِ» لَا يَدْرِي عَمْرٌو أَيَّ مَاءٍ هُوَ
ذِكْرُ الْخَبَرِ الْمُفَسِّرِ لِلَّفْظَةِ الْمُجْمَلَةِ الَّتِي ذَكَرْنَاهَا
That the Prophet ﷺ said: "Do not withhold surplus water so that it is prevented from the pasture." (Using translation from Tirmidhī 1272)
«أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ فَضْلِ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلَأُ»
ذِكْرُ الزَّجْرِ عَنْ مَنْعِ فَضْلِ الْمَاءِ قَصْدَ الضَّرَرِ فِيهِ عَلَى الْمُسْلِمِينَ
Messenger of Allah ﷺ said, "Do not withhold the superfluous water, for that will prevent people from grazing their cattle." (Using translation from Bukhārī 2353)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلَأُ»
ذِكْرُ الزَّجْرِ عَنْ مَنْعِ الْمَرْءِ فَضْلَ الْمَاءِ الَّذِي لَا حَاجَةَ بِهِ إِلَيْهِ
[Machine] The Messenger of Allah ﷺ prohibited blocking or preventing the flow of water from a well.
«نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يُمْنَعَ نَقْعُ الْبِئْرِ يَعْنِي فَضْلَ الْمَاءِ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ هَذَا الْفِعْلِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Do not withhold the blessing of water, and do not withhold charity, for wealth will become worthless and families will go hungry."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا تَمْنَعُوا فَضْلَ الْمَاءِ وَلَا تَمْنَعُوا الْكَلَأَ فَيَهْزُلَ الْمَالُ وَيَجُوعَ الْعِيَالُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْأَرْضِ الْمَبْذُورِ فِيهَا مَعَ الْبَذْرِ قَبْلَ أَنْ يَظْهَرَ مَا يَتَوَلَّدُ مِنْهُ
This hadith has been reported on the authority of Jabir b. 'Abdullah through another chain of transmitters. (Using translation from Muslim 2116b)
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيَاضِ الْأَرْضِ»
ذِكْرُ الزَّجْرِ عَنْ تَلَقِّي الْمُشْتَرِي الْبُيُوعَ
"The Messenger of Allah ﷺ forbade meeting traders on the way." (Using translation from Ibn Mājah 2179)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ تَلَقِّي الْبُيُوعِ»
ذِكْرُ الْبَيَانِ بِأَنَّ التَّلَقِّيَ لِلْبُيُوعِ إِنَّمَا زُجِرَ عَنْهُ إِلَى أَنْ تَهْبِطَ الْأَسْوَاقُ
[Machine] "That the Messenger of Allah ﷺ prohibited receiving goods until the markets settle down."
«أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ تَلَقِّي السِّلَعِ حَتَّى تَهْبِطَ الْأَسْوَاقُ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَبِيعَ الْمَرْءُ الْحَاضِرُ لِلْبَادِي مِنَ الْأَعْرَابِ
"The Messenger of Allah said: 'A town-dweller should not sell for a direst-dweller. Leave the people alone and let Allah provide for them from one another."" (Sahih ) (Using translation from Nasāʾī 4495)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ وَدَعُوا النَّاسَ يَرْزُقُ اللَّهُ بَعْضَهُمْ مِنْ بَعْضٍ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْحَاضِرِ الْمُهَاجِرِ لِلْأَعْرَابِ
[Machine] Narrated by the Prophet ﷺ: "He forbade the act of barter and the exchanging of goods for another on the spot between a migrant and an Arab."
عَنِ النَّبِيِّ ﷺ «أَنَّهُ نَهَى عَنِ التَّلَقِّي وَأَنْ يَبِيعَ حَاضِرٌ الْمُهَاجِرُ لِلْأَعْرَابِيِّ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْحَاضِرَ قَدْ زُجِرَ عَنْ أَنْ يَبِيعَ لِلْبَادِي وَإِنْ لَمْ يَكُنْ بِالْمُهَاجِرِ
[Machine] The Messenger of Allah ﷺ prohibited selling a product that is not in the possession of the seller and said, "Do not engage in present transactions."
نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَقَالَ «لَا تَلَقُّوا الْبُيُوعَ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ هَذَا الْفِعْلِ
The Messenger of Allah ﷺ as saying: A townsman must not sell for a man from the desert ; and leave people alone, Allah will give them provision from one another. (Using translation from Abū Dāʾūd 3442)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ دَعُوا النَّاسَ يَرْزُقُ بَعْضُهُمْ بَعْضًا»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «يَرْزُقُ بَعْضُهُمْ، بَعْضًا» أَرَادَ بِهِ أَنَّ اللَّهَ يَرْزُقُهُمْ عَلَى أَيْدِيهِمْ
The Messenger of Allah ﷺ as saying: A townsman must not sell for a man from the desert ; and leave people alone, Allah will give them provision from one another. (Using translation from Abū Dāʾūd 3442)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَبِيعُ حَاضِرٌ لِبَادٍ دَعُوا النَّاسَ يَرْزُقُ اللَّهُ بَعْضَهُمْ مِنْ بَعْضٍ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمَرْءِ عَلَى بَيْعِ أَخِيهِ قَبْلَ أَنْ يَتَفَرَّقَ الْبَائِعُ وَالْمُشْتَرِي
"Let one of you not undersell another."[1] (Using translation from Ibn Mājah 2171)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَبِعْ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الْفِعْلَ إِنَّمَا زُجِرَ عَنْهُ مَا لَمْ يَأْذَنِ الْبَائِعُ الْأَوَّلُ فِيهِ
[Machine] The Messenger of Allah ﷺ said, "None of you should sell the property of his brother without his permission."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَبِعْ أَحَدُكُمْ عَلَى بَيْعِ أَخِيهِ إِلَّا بِإِذْنِهِ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ هَذَا الْبَيْعِ
[Machine] "A Jewish man came to the Prophet ﷺ during his time with thirty loads of wheat and dates. He sold them for a high price, the same price as the Prophet ﷺ , while the people did not have any other food that day. They had already experienced hunger and hadn't found any food. So, they came to complain to the Prophet ﷺ about the high prices. He ascended the pulpit, praised and thanked Allah, and then said, 'I will not cast Allah away before giving something to someone without any good intention. Only permitted trading is based on mutual consent. But in your transactions, there are some traits that I will mention to you, so do not mix them up or argue about them. Do not envy one another, do not cheat or deceive one another, and do not hate one another. Do not outbid one another, and do not sell what is not present. Trading is based on mutual consent, and be the brothers of Allah's servants.'"
أَنَّ يَهُودِيًّا قَدِمَ زَمَنَ النَّبِيِّ ﷺ بِثَلَاثِينَ حِمْلِ شَعِيرٍ وَتَمْرٍ فَسَعَّرَ مُدًّا بِمُدِّ النَّبِيِّ ﷺ وَلَيْسَ فِي النَّاسِ يَوْمَئِذٍ طَعَامٌ غَيْرُهُ وَكَانَ قَدْ أَصَابَ النَّاسَ قَبْلَ ذَلِكَ جُوعٌ لَا يَجِدُونَ فِيهِ طَعَامًا فَأَتَى النَّبِيَّ ﷺ النَّاسُ يَشْكُونَ إِلَيْهِ غَلَاءَ السِّعْرِ فَصَعِدَ الْمِنْبَرَ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ «لَا أَلْقَيَنَّ اللَّهَ مِنْ قَبْلِ أَنْ أُعْطِيَ أَحَدًا مِنْ مَالِ أَحَدٍ مِنْ غَيْرِ طِيبِ نَفْسٍ إِنَّمَا الْبَيْعُ عَنْ تَرَاضٍ وَلَكِنَّ فِي بُيُوعِكُمْ خِصَالًا أَذْكُرُهَا لَكُمْ لَا تُضَاغِنُوا وَلَا تَنَاجَشُوا وَلَا تَحَاسَدُوا وَلَا يَسُومُ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَلَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ وَالْبَيْعُ عَنْ تَرَاضٍ وَكُونُوا عِبَادَ اللَّهِ إِخْوَانًا»
ذِكْرُ الزَّجْرِ عَنْ مُزَايَدَةِ الْمَرْءِ عَلَى الشَّيْءِ الْمَبِيعِ مِنْ غَيْرِ قَصْدِهِ لِشِرَائِهِ
the Prophet ﷺ forbade the Najsh. (Using translation from Ibn Mājah 2173)
«أَنَّ النَّبِيَّ ﷺ نَهَى عَنِ النَّجْشِ»
ذِكْرُ الزَّجْرِ عَنْ تَصْرِيَةِ ذَوَاتِ الْأَرْبَعِ، عِنْدَ بَيْعِهَا
"The Messenger of Allah said: 'If any one of you sells a sheep or a milch- camel, let him not refrain from milking it.'' (Sahih ) (Using translation from Nasāʾī 4486)
قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا بَاعَ أَحَدُكُمُ اللِّقْحَةَ أَوِ الشَّاةَ فَلَا يُحَفِّلْهَا»
ذِكْرُ وَصْفِ الْحُكْمِ فِي تَصْرِيَةِ ذَوَاتِ الْأَرْبَعِ عِنْدَ بَيْعِهَا
The Messenger of Allah ﷺ as saying: Do not go out to meet riders to conduct business with them ; none of you must buy in opposition to one another; and do not tie up the udders of camels and sheep, for he who buys them after that has been done has two courses open to him after milking them: he may keep them if he is pleased with them, or he may return them along with a sa' of dates is he is displeased with them. أَنَّ النَّبِيَّ ﷺ قَالَ «لَا تُصَرُّوا الْإِبِلَ وَالْغَنَمَ فَمَنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا إِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ»
ذِكْرُ الزَّجْرِ عَنِ اسْتِثْنَاءِ الْبَائِعِ الشَّيْءَ الْمَجْهُولَ مِنَ الشَّيْءِ الْمَبِيعِ فِي نَفْسِ الْعَقْدِ
The Messenger of Allah ﷺ forbade muzabanah, muhaqalah and thunya except it is known. (Using translation from Abū Dāʾūd 3405)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الثُّنَيَّا إِلَّا أَنْ تُعْلَمَ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَقَعَ بَيْعُ الْمَرْءِ عَلَى شَيْءٍ مَجْهُولٍ أَوْ إِلَى وَقْتٍ غَيْرِ مَعْلُومٍ
"The Messenger of Allah ﷺ forbade Gharar transactions. " (Using translation from Ibn Mājah 2195)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْغَرَرِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الشَّيْءِ بِمِئَةِ دِينَارٍ نَسِيئَةً وَبِتِسْعِينَ دِينَارًا نَقْدًا
[Machine] "From the Messenger of Allah ﷺ, it is narrated that he forbade two sales in one transaction."
عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ «نَهَى عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُشْتَرِيَ إِذَا اشْتَرَى بَيْعَتَيْنِ فِي بَيْعَةٍ عَلَى مَا وَصَفْنَا وَأَرَادَ مُجَانَبَةَ الرِّبَا كَانَ لَهُ أَوْكَسُهُمَا
The Prophet ﷺ said: If anyone makes two transactions combined in one bargain, he should have the lesser of the two or it will involve usury. (Using translation from Abū Dāʾūd 3461)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ بَاعَ بَيْعَتَيْنِ فِي بَيْعَةٍ فَلَهُ أَوْكَسُهُمَا أَوِ الرِّبَا»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ
the Messenger of Allah forbade Mulamash and Munabadha. (Using translation from Nasāʾī 4509)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُلامَسَةِ وَالْمُنَابَذَةِ
ذِكْرُ وَصْفِ بَيْعِ الْمُلَامَسَةِ وَكَيْفِيَّةِ الْمُنَابَذَةِ
"The Messenger of Allah forbade two kinds of garments and two kinds of transactions. As for the two kinds of transactions, they are Mulamash and Munabadhaha. Munabadha is when a man says, 'I throw this garment, and the transaction becomes binding, and Mulamasah is when a man touches it with his had, without spreading it out and checking it, and once he touches it, the transaction becomes binding." «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعَتَيْنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ فَالْمُنَابَذَةُ هُوَ أَنْ يَقُولَ إِذَا نَبَذْتُ إِلَيْكَ هَذَا الثَّوْبَ فَقَدْ وَجَبَ الْبَيْعُ وَالْمُلَامَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ وَلَا يَنْشُرُهُ وَلَا يُقَلِّبُهُ يَقُولُ إِذَا مَسَّهُ وَجَبَ الْبَيْعُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ مَا يَقَعُ عَلَيْهِ حَصَاةُ الْمُشْتَرِي
"The Messenger of Allah ﷺ forbade Gharar transaction sand Hasah transactions. " (Using translation from Ibn Mājah 2194)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْحَصَاةِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الطَّعَامِ الْمُشْتَرَى قَبْلَ اسْتِيفَائِهِ
He who buys foodgrain should not sell that before taking possession of it. He (the narrator) said: We used to buy foodgrain from the caravans in bulk, but Messenger of Allah ﷺ forbade us to re-sell that until we had shifted it to some other place. (Using translation from Muslim 1526b)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنِ اشْتَرَى طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «حَتَّى يَسْتَوْفِيَهُ» أَرَادَ بِهِ حَتَّى يَقْبِضَهُ
The Prophet ﷺ said, "He who buys foodstuff should not sell it till he has received it." (Using translation from Bukhārī 2133)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ»
ذِكْرُ خَبَرٍ قَدْ يُوهِمُ غَيْرَ الْمُتَبَحِّرِ فِي صِنَاعَةِ الْعِلْمِ أَنَّ خَبَرَ حَمَّادِ بْنِ سَلَمَةَ الَّذِي ذَكَرْنَاهُ مَوْهُومٌ
He who buys food-rain should not sell it until he has taken possession of it. Ibn Abbas (Allah be pleased with them) said: I regard everything like food (so far as this principle is concerned). (Using translation from Muslim 1525c)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ اشْتَرَى طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ» قَالَ ابْنُ عَبَّاسٍ وَأَحْسِبُ كُلَّ شَيْءٍ بِمَنْزِلَةِ الطَّعَامِ
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ خَبَرَ ابْنَ عُمَرَ الَّذِي ذَكَرْنَاهُ، لَمْ يَهِمُ فِيهِ حَمَّادُ بْنُ سَلَمَةَ، وَأَنَّ الْخَبَرَ مِنْ حَدِيثِ ابْنِ عُمَرَ لَهُ أَصْلٌ
Do not buy fruits (on the trees) until their good condition becomes clear. (Using translation from Muslim 1534g)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهَا وَمَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ»
ذِكْرُ وَصْفِ الْقَبْضِ الَّذِي يَحِلُّ بِهِ بَيْعُ الطَّعَامِ الْمُشْتَرَى
"We used to buy food from troops of riders (i.e., the caravans) without knowing the amount, but the Messenger of Allah ﷺ forbade us to sell it until it had been delivered to us." (Using translation from Ibn Mājah 2229)
«كُنَّا نَشْتَرِي الطَّعَامَ مِنَ الرُّكْبَانِ جُزَافًا فَنَهَانَا رَسُولُ اللَّهِ ﷺ أَنْ نَبِيعَهُ حَتَّى نَنْقُلَهُ مِنْ مَكَانِهِ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ كُلَّ شَيْءٍ بَيْعٌ سِوَى الطَّعَامِ حُكْمُهُ حُكْمُ الطَّعَامِ فِي هَذَا الزَّجْرِ
[Machine] He said, I said, "O Messenger of Allah, I am a man who buys goods, so what is permissible for me from them and what is forbidden for me?" He said, "O son of my brother, when you make a purchase, do not sell it until you have received it."
قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِنِّي رَجُلٌ أَشْتَرِي الْمَتَاعَ فَمَا الَّذِي يَحِلُّ لِي مِنْهَا وَمَا يَحْرُمُ عَلَيَّ فَقَالَ «يَا بْنَ أَخِي إِذَا ابْتَعْتَ بَيْعًا فَلَا تَبِعْهُ حَتَّى تَقْبِضَهُ»
ذِكْرُ الْخَبَرِ الْمُصَرِّحِ بِأَنَّ حُكْمَ الطَّعَامِ وَغَيْرِهِ مِنَ الْأَشْيَاءِ الْمَبِيعَةِ فِيهِ سَوَاءٌ
[Machine] "To me (he said): 'Do not follow him until you secure him to your journey, for the Messenger of Allah – peace be upon him – has prohibited that. Therefore, I held onto my own hands.'"
لِي «لَا تَبِعْهُ حَتَّى تَحُوزَهُ إِلَى رَحْلِكَ فَإِنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ ذَلِكَ فَأَمْسَكْتُ يَدَيَّ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمَرْءِ الطَّعَامَ الَّذِي اشْتَرَاهُ قَبْلَ قَبْضِهِ وَاسْتِيفَائِهِ
[Machine] He said, "I bought some food from the charity's food and I made a profit from it before I received it. Then I wanted to sell it, so I asked the Prophet peace be upon him. He said, 'Do not sell it until you receive it.'"
أَنَّهُ قَالَ اشْتَرَيْتُ طَعَامًا مِنْ طَعَامِ الصَّدَقَةِ فَأَرْبَحْتُ فِيهِ قَبْلَ أَنْ أَقْبِضَهُ فَأَرَدْتُ بَيْعَهُ فَسَأَلْتُ النَّبِيَّ ﷺ قَالَ «لَا تَبِعْهُ حَتَّى تَقْبِضَهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ حُكْمَ حَكِيمِ بْنِ حِزَامٍ وَغَيْرِهِ مِنَ الْمُسْلِمِينَ فِي هَذَا الزَّجْرِ سَوَاءٌ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys food should not sell it until he has received it in full." He also prohibited selling it until it is moved from its place or transferred.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ اشْتَرَى طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ» قَالَ وَنَهَى أَنْ يَبِيعَهُ حَتَّى يُحَوِّلَهُ مِنْ مَكَانِهِ أَوْ يَنْقُلَهُ
