ذِكْرُ وَصْفِ بَيْعِ الْمُلَامَسَةِ وَكَيْفِيَّةِ الْمُنَابَذَةِ

ibnhibban:4976Muḥammad b. al-Ḥasan b. Qutaybah Biʿasqalān > Ibn Abū al-Sarī > ʿAbd al-Razzāq > Maʿmar > al-Zuhrī > ʿAṭāʾ b. Yazīd al-Laythī > Abū Saʿīd al-Khudrī

"The Messenger of Allah forbade two kinds of garments and two kinds of transactions. As for the two kinds of transactions, they are Mulamash and Munabadhaha. Munabadha is when a man says, 'I throw this garment, and the transaction becomes binding, and Mulamasah is when a man touches it with his had, without spreading it out and checking it, and once he touches it, the transaction becomes binding." «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعَتَيْنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ فَالْمُنَابَذَةُ هُوَ أَنْ يَقُولَ إِذَا نَبَذْتُ إِلَيْكَ هَذَا الثَّوْبَ فَقَدْ وَجَبَ الْبَيْعُ وَالْمُلَامَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ وَلَا يَنْشُرُهُ وَلَا يُقَلِّبُهُ يَقُولُ إِذَا مَسَّهُ وَجَبَ الْبَيْعُ»

"Wearing the samma' means that a man puts his garment over his left shoulder and keeps his right side uncovered. Munabadhah means that a man says (to another): If I throw this garment to you, the sale will be certain. Mulamasah means that a man touches it (another's garment) with his hand and neither he unfolds it nor turns it over. When he touched it, the sale becomes binding.

[Machine] The Messenger of Allah ﷺ forbade wearing of two garments and the sale of two garments. As for the wearing of two garments, it encompasses the wearing of a garment that has both ends placed on his left shoulder, while its opening is over his right shoulder. The other is wearing a single garment that has nothing else on it, and he lets down his lower garment area up towards the sky. As for the sale of two garments, it includes throwing away and relinquishing a garment, where he says, "If you throw away this garment, the sale is binding." And the contact means touching it with his hand without wearing or flipping it, and if he touches it, the sale becomes binding.
