45.26 Explanation Of that

٤٥۔٢٦ باب تَفْسِيرِ ذَلِكَ

nasai:4513Muḥammad b. al-Muṣaffá b. Buhlūl > Muḥammad b. Ḥarb > al-Zubaydī > al-Zuhrī > Saʿīd > Abū Hurayrah

"The Messenger of Allah forbade Munabadhah and Mulamash. Mulamasah is when two men trade garments with each other under cover of night, each man touching the garment of the other with his hand> and Munabadhah is when one man throws a garment to another and the other throws a garment to him, and they trade them with each other in that manner."  

النسائي:٤٥١٣أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُصَفَّى بْنِ بُهْلُولٍ عَنْ مُحَمَّدِ بْنِ حَرْبٍ عَنِ الزُّبَيْدِيِّ عَنِ الزُّهْرِيِّ قَالَ سَمِعْتُ سَعِيدًا يَقُولُ

سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الْمُلاَمَسَةِ وَالْمُنَابَذَةِ وَالْمُلاَمَسَةُ أَنْ يَتَبَايَعَ الرَّجُلاَنِ بِالثَّوْبَيْنِ تَحْتَ اللَّيْلِ يَلْمِسُ كُلُّ رَجُلٍ مِنْهُمَا ثَوْبَ صَاحِبِهِ بِيَدِهِ وَالْمُنَابَذَةُ أَنْ يَنْبِذَ الرَّجُلُ إِلَى الرَّجُلِ الثَّوْبَ وَيَنْبُذَ الآخَرُ إِلَيْهِ الثَّوْبَ فَيَتَبَايَعَا عَلَى ذَلِكَ  

nasai:4514Abū Dāwud > Yaʿqūb b. Ibrāhīm from my father > Ṣāliḥ > Ibn Shihāb > ʿĀmir b. Saʿd > Abū Saʿīd al-Khudrī ؓ

"The Messenger of Allah forbade Mulamasah, which means touching a garment without looking at it; (and he forbade) Munabadhah which is where one man sells his garment to another man by throwing it to him, without him checking it or looking at it."  

النسائي:٤٥١٤أَخْبَرَنَا أَبُو دَاوُدَ قَالَ حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا أَبِي عَنْ صَالِحٍ عَنِ ابْنِ شِهَابٍ أَنَّ عَامِرَ بْنَ سَعْدٍ

أَخْبَرَهُ أَنَّ أَبَا سَعِيدٍ الْخُدْرِيَّ ؓ قَالَ نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الْمُلاَمَسَةِ وَالْمُلاَمَسَةُ لَمْسُ الثَّوْبِ لاَ يَنْظُرُ إِلَيْهِ وَعَنِ الْمُنَابَذَةِ وَالْمُنَابَذَةُ طَرْحُ الرَّجُلِ ثَوْبَهُ إِلَى الرَّجُلِ قَبْلَ أَنْ يُقَلِّبَهُ  

nasai:4515Muḥammad b. Rāfiʿ > ʿAbd al-Razzāq > Maʿmar > al-Zuhrī > ʿAṭāʾ b. Yazīd > Abū Saʿīd al-Khudrī

"The Messenger of Allah forbade two kinds of garments and two kinds of transactions. As for the two kinds of transactions, they are Mulamash and Munabadhaha. Munabadha is when a man says, 'I throw this garment, and the transaction becomes binding, and Mulamasah is when a man touches it with his had, without spreading it out and checking it, and once he touches it, the transaction becomes binding."  

النسائي:٤٥١٥أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ حَدَّثَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ عَنْ عَطَاءِ بْنِ يَزِيدَ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَ

نَهَى رَسُولُ اللَّهِ ﷺ عَنْ لُبْسَتَيْنِ وَعَنْ بَيْعَتَيْنِ أَمَّا الْبَيْعَتَانِ فَالْمُلاَمَسَةُ وَالْمُنَابَذَةُ وَالْمُنَابَذَةُ أَنْ يَقُولَ إِذَا نَبَذْتُ هَذَا الثَّوْبَ فَقَدْ وَجَبَ يَعْنِي الْبَيْعَ وَالْمُلاَمَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ وَلاَ يَنْشُرَهُ وَلاَ يُقَلِّبَهُ إِذَا مَسَّهُ فَقَدْ وَجَبَ الْبَيْعُ  

nasai:4516Hārūn b. Zayd b. Abū al-Zarqāʾ from my father > Jaʿfar b. Burqān > Balaghanī > al-Zuhrī > Sālim from his father

"The Messenger of Allah forbade two kinds of garments, and he forbade two kinds of transactions for us: Munabadhah and Mulamasah, which are kinds of transactions which were common during the Jahiliyyah."  

النسائي:٤٥١٦أَخْبَرَنَا هَارُونُ بْنُ زَيْدِ بْنِ أَبِي الزَّرْقَاءِ قَالَ حَدَّثَنَا أَبِي قَالَ حَدَّثَنَا جَعْفَرُ بْنُ بُرْقَانَ قَالَ بَلَغَنِي عَنِ الزُّهْرِيِّ عَنْ سَالِمٍ عَنْ أَبِيهِ قَالَ

نَهَى رَسُولُ اللَّهِ ﷺ عَنْ لُبْسَتَيْنِ وَنَهَانَا رَسُولُ اللَّهِ ﷺ عَنْ بَيْعَتَيْنِ عَنِ الْمُنَابَذَةِ وَالْمُلاَمَسَةِ وَهِيَ بُيُوعٌ كَانُوا يَتَبَايَعُونَ بِهَا فِي الْجَاهِلِيَّةِ  

nasai:4517Muḥammad b. ʿAbd al-Aʿlá > al-Muʿtamir > ʿUbaydullāh > Khubayb > Ḥafṣ b. ʿĀṣim > Abū Hurayrah

Munabadhah and Mulamasha. And he said that Mulamasah means when one man says to another: "I will sell you my garment for your garment," and neither of them looks at the garment of the others, rather he just touches it. And Munabadhah is when he says: "I will throw what I have and you throw what you have," so that they buy from one another, and neither of them knows how much the other has, and so on.  

النسائي:٤٥١٧أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الأَعْلَى قَالَ حَدَّثَنَا الْمُعْتَمِرُ قَالَ سَمِعْتُ عُبَيْدَ اللَّهِ عَنْ خُبَيْبٍ عَنْ حَفْصِ بْنِ عَاصِمٍ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعَتَيْنِ أَمَّا الْبَيْعَتَانِ فَالْمُنَابَذَةُ وَالْمُلاَمَسَةُ وَزَعَمَ أَنَّ الْمُلاَمَسَةَ أَنْ يَقُولَ الرَّجُلُ لِلرَّجُلِ أَبِيعُكَ ثَوْبِي بِثَوْبِكَ وَلاَ يَنْظُرَ وَاحِدٌ مِنْهُمَا إِلَى ثَوْبِ الآخَرِ وَلَكِنْ يَلْمِسُهُ لَمْسًا وَأَمَّا الْمُنَابَذَةُ أَنْ يَقُولَ أَنْبُذُ مَا مَعِي وَتَنْبُذُ مَا مَعَكَ لِيَشْتَرِيَ أَحَدُهُمَا مِنَ الآخَرِ وَلاَ يَدْرِي كُلُّ وَاحِدٍ مِنْهُمَا كَمْ مَعَ الآخَرِ وَنَحْوًا مِنْ هَذَا الْوَصْفِ
