24. Book of Transactions
٢٤۔ كِتَابُ الْبُيُوعِ
[Machine] "The black (person), if you wish, I can delay (it) for you, for indeed there were rights upon us in this payment." So the merchant said to him, "You are not doing (it)," so the black (person) paid him five hundred dirhams. Then, when he received it, the merchant said to him, "Abandon it, take it," so the black (person) said to him, "I asked you for this and you refused." So the merchant said to him, "Indeed, I have heard you speaking to us about Abdullah bin Mas'ood, that the Prophet ﷺ used to say, 'Whoever loans to Allah twice, he will have the reward of one (loan) if he gives it in charity.'"
الْأَسْوَدُ إِنْ شِئْتَ أَخَّرْتُ عَنْكَ فَإِنَّهُ قَدْ كَانَتْ عَلَيْنَا حُقُوقٌ فِي هَذَا الْعَطَاءِ فَقَالَ لَهُ التَّاجِرُ لَسْتَ فَاعِلًا فَنَقَدَهُ الْأَسْوَدُ خَمْسَ مِائَةِ دِرْهَمٍ حَتَّى إِذَا قَبَضَهَا قَالَ لَهُ التَّاجِرُ دُونَكَهَا فَخُذْ بِهَا فَقَالَ لَهُ الْأَسْوَدُ قَدْ سَأَلْتُكَ هَذَا فَأَبَيْتَ فَقَالَ لَهُ التَّاجِرُ إِنِّي سَمِعْتُكَ تُحَدِّثُنَا عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ أَنَّ نَبِيَّ اللَّهِ ﷺ كَانَ يَقُولُ «مَنْ أَقْرَضَ اللَّهَ مَرَّتَيْنِ كَانَ لَهُ مِثْلُ أَجْرِ أَحَدِهِمَا لَوْ تَصَدَّقَ بِهِ»
ذِكْرُ قَضَاءِ اللَّهِ جَلَّ وَعَلَا فِي الدُّنْيَا دَيْنَ مَنْ نَوَى الْأَدَاءَ فِيهِ
"Maimunah used to take out loans frequently, and some of her family criticized her and denounced her for that. She said: 'I will not stop taking loans, for I heard my close friend and my beloved say: "There is no one who takes out a loans, and Allah knows that he intends to pay it back, but Allah will pay it back for him in this world." (Using translation from Nasāʾī 4686)
لَهَا أَهْلُهَا فِي ذَلِكَ وَوَجَدُوا عَلَيْهَا فَقَالَتْ لَا أَتْرُكُ وَقَدْ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَا مِنْ أَحَدٍ يَدَّانُ دَيْنًا يَعْلَمُ اللَّهُ أَنَّهُ يُرِيدُ قَضَاءَهُ إِلَّا أَدَّاهُ اللَّهُ عَنْهُ فِي الدُّنْيَا»
ذِكْرُ رَجَاءِ تَجَاوَزِ اللَّهِ جَلَّ وَعَلَا فِي الْقِيَامَةِ عَنِ الْمُيَسِّرِ عَلَى الْمُعْسِرِينَ فِي الدُّنْيَا
The prophet said: "A man used to lend to people, but if he realized that someone was going through hardship, he would say to his slave: 'Let him off, perhaps Allah, the Most High, will let us off.' And when he met Allah, He let him off." (Using translation from Nasāʾī 4695)
أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ كَانَ رَسُولُ اللَّهِ ﷺ يَقُولُ «كَانَ رَجُلٌ تَاجِرٌ يُدَايِنُ النَّاسَ فَإِذَا رَأَى إِعْسَارَ الْمُعْسِرِ» قَالَ لِفَتَاهُ تَجَاوَزْ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا قَالَ رَسُولُ اللَّهِ ﷺ «فَلَقِيَ اللَّهَ فَتَجَاوَزَ عَنْهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الرَّجُلَ لَمْ يَعْمَلْ خَيْرًا قَطُّ إِلَّا التَّجَاوزَ عَنِ الْمُعْسِرِينَ
"There was a man who never did any good deed, but he used to lend to people and he would say to this messenger: "Take what can be paid easily and leave what is difficult, let them off, and perhaps Allah, the Mighty and Sublime, said to him: 'Did you ever do any good did? He said: No, but I had a slave and I used to lend to people. When I sent him to collect the debts I said to him: Take what can he paid easily and leave what is difficult; let them off, and perhaps Allah will let us off. Allah, the Most High, said: 'I have let you off."' (Using translation from Nasāʾī 4694)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «إِنَّ رَجُلًا لَمْ يَعْمَلْ خَيْرًا قَطُّ وَكَانَ يُدَاينُ النَّاسُ» فَيَقُولُ لِرَسُولِهِ خُذْ مَا تَيَسَّرَ وَاتْرُكْ مَا تَعَسَّرَ وَتَجَاوَزْ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا قَالَ فَلَمَّا هَلَكَ قَالَ اللَّهُ هَلْ عَمِلْتَ خَيْرًا قَطُّ؟ قَالَ لَا إِلَّا أَنَّهُ كَانَ لِي غُلَامٌ وَكُنْتُ أُدَاينُ النَّاسَ فَإِذَا بَعَثْتُهُ لِيَتَقَاضَى قُلْتُ لَهُ خُذْ مَا تَيَسَّرَ وَاتْرُكْ مَا تَعَسَّرَ وَتَجَاوَزْ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا قَالَ اللَّهُ تَعَالَى قَدْ قَالَ تَجَاوَزْتُ عَنْكَ
ذِكْرُ إِظْلَالِ اللَّهِ جَلَّ وَعَلَا فِي الْقِيَامَةِ فِي ظِلِّهِ مَنْ أَنْظَرَ مُعْسِرًا أَوْ وَضَعَ لَهُ
[Machine] I and my father went out to seek knowledge in this neighborhood from the Ansar before they perish. The first person we met was Abu Al-Yasir, the companion of the Messenger of Allah ﷺ , and with him was his son. Abu Al-Yasir was wearing a cloak, as were his guests, and his son was also wearing a cloak. My father said to him, "I see anger on your face." He replied, "Indeed, I had some wealth that belonged to so-and-so, the thief. So I went to his family and asked them, 'Is it accepted?' They said, 'No.' Then his son came out to me, so I asked him, 'Where is your father?' He said, 'He heard your voice and came out. I told him to come out, for I knew where you were.' Then he came out and I asked him, 'What made you hide?' He said, 'I swear by Allah, I wanted to talk to you and not lie to you. I was afraid that if I spoke to you, I would then lie to you and break my promise. And you were the companion of the Messenger of Allah ﷺ , and by Allah, I was in a difficult situation.' I asked, 'By Allah?' He replied, 'By Allah.' I asked again, 'By Allah?' He replied, 'By Allah.' Then he reached for his scriptures and erased them. He said, 'If you find a just cause, then judge accordingly. Otherwise, you are in a permissible state. I bear witness with my eyes to this oath, and my heart confirms it.' He pointed to the veins on his chest and said, 'I heard the Messenger of Allah ﷺ saying, "Whoever protects the rights of a debtor in financial difficulty, Allah will protect him in His shade."'
خَرَجْتُ أَنَا وَأَبِي نَطْلُبُ الْعِلْمَ فِي هَذَا الْحَيِّ مِنَ الْأَنْصَارِ قَبْلَ أَنْ يَهْلِكُوا فَكَانَ أَوَّلَ مَنْ لَقِيَنَا أَبُو الْيَسَرِ صَاحِبُ رَسُولِ اللَّهِ ﷺ وَمَعَهُ غُلَامٌ لَهُ وَعَلَى أَبِي الْيَسَرِ بُرْدَةٌ وَمَعَافِرِيٌّ وَعَلَى غُلَامِهِ بُرْدَةٌ وَمَعَافِرِيٌّ فَقَالَ لَهُ أَبِي إِنِّي أَرَى فِي وَجْهِكَ شَيْئًا مِنْ غَضَبٍ قَالَ أَجَلْ كَانَ لِي عَلَى فُلَانِ بْنِ فُلَانٍ الْحَرَامِيِّ مَالٌ فَأَتَيْتُ أَهْلَهُ فَقُلْتُ أَثَمَّتْ؟ قَالُوا لَا فَخَرَجَ عَلَيَّ ابْنٌ لَهُ فَقُلْتُ أَيْنَ أَبُوكَ؟ فَقَالَ سَمِعَ صَوْتَكَ فَدَخَلَ فَقُلْتُ اخْرُجْ إِلَيَّ فَقَدْ عَلِمْتُ أَيْنَ أَنْتَ فَخَرَجَ عَلَيَّ فَقُلْتُ مَا حَمَلَكَ عَلَى أَنِ اخْتَبَأْتَ؟ قَالَ أَنَا وَاللَّهِ أُحَدِّثُكَ ثُمَّ لَا أَكْذِبُكَ خَشِيتُ وَاللَّهِ أَنْ أُحَدِّثَكَ فَأَكْذِبَكَ وَأَعِدَكَ فَأُخْلِفَكَ وَكُنْتَ صَاحِبَ رَسُولِ اللَّهِ ﷺ وَكُنْتُ وَاللَّهِ مُعْسِرًا قَالَ قُلْتُ آللَّهِ؟ قَالَ اللَّهِ قَالَ قُلْتُ آللَّهِ؟ قَالَ اللَّهِ قَالَ فَقَالَ بِصَحِيفَتِهِ فَمَحَاهَا وَقَالَ إِنْ وَجَدْتَ قَضَاءً فَاقْضِ وَإِلَّا فَأَنْتَ فِي حِلٍّ فَأَشْهَدُ بَصُرَ عَيْنَايَ هَاتَانِ وَوَعَاهُ قَلْبِي وَأَشَارَ إِلَى نِيَاطِ قَلْبِهِ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ أَنْظَرَ مُعْسِرًا أَوْ وَضَعَ لَهُ أَظَلَّهُ اللَّهُ فِي ظِلِّهِ»
ذِكْرُ تَيْسِيرِ اللَّهِ جَلَّ وَعَلَا الْأُمُورَ فِي الدُّنْيَا وَالْآخِرَةِ عَلَى الْمُيَسِّرِ عَلَى الْمُعْسِرِينَ
Whoever is easy with (a debtor) who is in difficulty, Allah will be easy with him in this world and in the Hereafter.” (Using translation from Ibn Mājah 2417)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ يَسَّرَ عَلَى مُعْسِرٍ يَسَّرَ اللَّهُ عَلَيْهِ فِي الدُّنْيَا وَالْآخِرَةِ»
ذِكْرُ رَجَاءِ تَجَاوُزِ اللَّهِ جَلَّ وَعَلَا عَمَّنْ تَجَاوَزَ عَنِ الْمُعْسِرِ
[Machine] I heard the Messenger of Allah ﷺ saying, "There was a man who used to lend money to people. When a debtor faced financial difficulty, he would say to his servant, 'Let him go, maybe Allah will forgive us.' So, when he met Allah, He forgave him."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «كَانَ رَجُلٌ يُدَايِنُ النَّاسَ فَإِذَا أَعْسَرَ الْمُعْسِرُ قَالَ لِفَتَاهُ تَجَاوَزْ عَنْهُ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا فَلَقِيَ اللَّهَ فَتَجَاوَزَ عَنْهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الرَّجُلَ لَمْ تُوجَدْ لَهُ حَسَنَةٌ خَلَا تَجَاوُزَهُ عَنِ الْمُعْسِرِينَ
That the Messenger of Allah ﷺ said: "A man among those before you was called to reckon and nothing good was found with him. Except that he was a wealthy man so he used to mix with the pople and he would tell his servant to be lenient with the insolvent. So Allah, Mighty and Sublime is He, said: 'We are more worthy of that than him, so be lenient with him.'" (Using translation from Tirmidhī 1307)
قَالَ رَسُولُ اللَّهِ ﷺ «حُوسِبَ رَجُلٌ مِمَّنْ كَانَ قَبْلَكُمْ فَلَمْ يُوجَدْ لَهُ مِنَ الْخَيْرِ شَيْءٌ إِلَّا أَنَّهُ كَانَ رَجُلًا مُوسِرًا فَكَانَ يُخَالِطُ النَّاسَ فَيَقُولُ لِغُلَامِهِ تَجَاوَزْ عَنِ الْمُعْسِرِ فَقَالَ اللَّهُ جَلَّ وَعَلَا لِمَلَائِكَتِهِ نَحْنُ أَحَقُّ بِذَلِكَ تَجَاوَزُوا عَنْهُ»
ذِكْرُ مَا يُسْتَحَبُّ لِمَنْ تَنَازَعَ هُوَ وَأَخُوهُ الْمُسْلِمُ فِي دَيْنٍ أَنْ يَضَعَ الْمُوسِرُ بَعْضَ دَيْنِهِ لِلْمُعْسِرِ
"Ka'b!" He said: "At your service, Messenger of Allah." Thereupon he made a gesture with is hand indicating: Remit half the debt due to you. Ka'b said: "I shall do so, Messenger of Allah." The Prophet ﷺ then said: "Get up and discharge" (Using translation from Abū Dāʾūd 3595)
أَنَّهُ تَقَاضَى ابْنَ أَبِي حَدْرَدٍ دَيْنًا كَانَ لَهُ عَلَيْهِ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فِي الْمَسْجِدِ فَارْتَفَعَتْ أَصْوَاتُهُمَا حَتَّى سَمِعَهَا رَسُولُ اللَّهِ ﷺ وَهُوَ فِي بَيْتِهِ فَخَرَجَ إِلَيْهِمَا رَسُولُ اللَّهِ ﷺ حَتَّى كَشَفَ سِجْفَ حُجْرَتِهِ وَنَادَى كَعْبَ بْنَ مَالِكٍ «يَا كَعْبُ بْنَ مَالِكٍ» قَالَ لَبَّيْكَ يَا رَسُولَ اللَّهِ فَأَشَارَ بِيَدِهِ أَنْ ضَعِ الشَّطْرَ مِنْ دَيْنِكَ قَالَ كَعْبٌ قَدْ فَعَلْتُ يَا رَسُولَ اللَّهِ قَالَ «قُمْ فَاقْضِهِ»
