23. Book of Endowments
٢٣۔ كِتَابُ الْوَقْفِ
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ نَفَى جَوَازَ اتِّخَاذِ الْأَحْبَاسِ فِي سَبِيلِ اللَّهِ
[Machine] Omar sought advice from the Prophet ﷺ regarding his charity of a sum of money. The Prophet ﷺ said, "Keep its principal and spend its fruits." Abdullah (ibn Masud) said that Omar kept the money for the people in need, the forbidden individuals, the wayfarers, those fighting in the cause of Allah, slaves, and the poor. He appointed someone to manage it and allowed him to eat from it without greed for wealth.
أَنَّ عُمَرَ اسْتَشَارَ النَّبِيَّ ﷺ فِي صَدَقَتِهِ بِثَمْغٍ فَقَالَ «احْبِسْ أَصْلَهَا وَسَبِّلْ ثَمَرَتَهَا» قَالَ عَبْدُ اللَّهِ فَحَبَسَهَا عُمَرُ عَلَى السَّائِلِ وَالْمَحْرُومِ وَابْنِ السَّبِيلِ وَفِي سَبِيلِ اللَّهِ وَفِي الرِّقَابِ وَالْمَسَاكِينِ وَجَعَلَ قَيِّمَهَا يَأْكُلُ وَيُؤْكِلُ غَيْرَ مُتَأَثِّلٍ مَالًا
ذِكْرُ الْبَيَانِ بِأَنَّ الْأَحْبَاسَ فِي سَبِيلِ اللَّهِ لَا يَحِلُّ بَيْعُهَا وَلَا هِبَتُهَا
[Machine] Omar ibn Al-Khattab sought the advice of the Messenger of Allah ﷺ regarding donating his wealth with a specific condition. The Messenger of Allah ﷺ responded, "Give it as charity, but divide its yield and preserve its principle, it shall neither be sold nor given as a gift."
أَنَّ عُمَرَ بْنَ الْخَطَّابِ اسْتَشَارَ رَسُولَ اللَّهِ ﷺ أَنْ يَتَصَدَّقَ بِمَالِهِ بِثَمْغٍ فَقَالَ رَسُولُ اللَّهِ ﷺ «تَصَدَّقْ بِهِ تَقْسِمُ ثَمَرَهُ وَتَحْبِسُ أَصْلَهُ لَا يُبَاعُ وَلَا يُوهَبُ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ أَجَازَ بَيْعَ الْأَحْبَاسِ فِي سَبِيلِ اللَّهِ بَعْدَ أَنْ تُحْبَسَ أَوْ تَوْرِيثَهَا بَعْدَ أَنْ تُوقَفَ
'Umar got some land in Khaibar, and when to the Prophet ﷺ and said: I have acquired land in Khaibar which I consider to be more valuable than any I have acquired ; so what do you command me to do with it ? He replied: If you wish, you may make the property as inalienable possession, and give its produce as sadaqah (charity). So 'Umar gave it as a sadaqah declaring that the property must not be sold, given away, or inherited : (and gave its produce as sadaqah to be devoted) to poor, relatives, the emancipation of slaves, Allah's path, travellers. The narrator Bishr added: "and guests". Then the agreed version goes: No sin being committed by the one who administers it if he eats something from it in a reasonable manner, or gives something to a friend, who does not make his own property. The narrator Bishr added: "(provided) he is not storing-up goods (for himself)". (Using translation from Abū Dāʾūd 2878)
أَصَابَ عُمَرُ أَرْضًا بِخَيْبَرَ فَأَتَى فِيهَا رَسُولُ اللَّهِ ﷺ فَاسْتَأْمَرَهُ فَقَالَ إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ قَطُّ مَالًا أَنْفَسَ عِنْدِي مِنْهُ فَمَا تَأْمُرُ فِيهَا؟ فَقَالَ «إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَتَصَدَّقْتَ بِهَا عَلَى أَنَّهُ لَا يُبَاعُ وَلَا يُوهَبُ وَلَا يُورَثُ فَتَصَدَّقْ بِهَا فِي الْفُقَرَاءِ وَفِي الْغُرَبَاءِ وَفِي الرِّقَابِ وَفِي سَبِيلِ اللَّهِ وَابْنِ السَّبِيلِ وَفِي الضَّيْفِ لَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ أَوْ يُطْعِمَ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهِ» قَالَ وَقَالَ مُحَمَّدٌ «غَيْرَ مُتَأَثِّلٍ مَالًا»
ذِكْرُ الْبَيَانِ بِأَنَّ اتِّخَاذَ الْأَحْبَاسِ فِي سَبِيلِ اللَّهِ مِنْ خَيْرِ مَا يَخْلُفُ الْمَرْءُ بَعْدَهُ
[Machine] I heard the Prophetﷺ saying, "The best thing that remains for a person after his death are three: a righteous child who supplicates for him, a continuous charity whose reward reaches him, and a beneficial knowledge that is acted upon after him."
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «خَيْرُ مَا يَخْلُفُ الْمَرْءُ بَعْدَ مَوْتِهِ ثَلَاثٌ وَلَدٌ صَالِحٌ يَدْعُو لَهُ وَصَدَقَةٌ تَجْرِي يَبْلُغُهُ أَجْرُهَا وَعَمَلٌ يُعْمَلُ بِهِ مِنْ بَعْدِهِ»
