٢٤۔ كِتَابُ الْبُيُوعِ ص ٢
ذِكْرُ الْخَبَرِ الْمُفَسِّرِ لِلَّفْظَةِ الْمُجْمَلَةِ الَّتِي ذَكَرْنَاهَا
That the Prophet ﷺ said: "Do not withhold surplus water so that it is prevented from the pasture." (Using translation from Tirmidhī 1272)
«أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ فَضْلِ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلَأُ»
ذِكْرُ الزَّجْرِ عَنْ مَنْعِ فَضْلِ الْمَاءِ قَصْدَ الضَّرَرِ فِيهِ عَلَى الْمُسْلِمِينَ
Messenger of Allah ﷺ said, "Do not withhold the superfluous water, for that will prevent people from grazing their cattle." (Using translation from Bukhārī 2353)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلَأُ»
ذِكْرُ الزَّجْرِ عَنْ مَنْعِ الْمَرْءِ فَضْلَ الْمَاءِ الَّذِي لَا حَاجَةَ بِهِ إِلَيْهِ
[Machine] The Messenger of Allah ﷺ prohibited blocking or preventing the flow of water from a well.
«نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يُمْنَعَ نَقْعُ الْبِئْرِ يَعْنِي فَضْلَ الْمَاءِ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ هَذَا الْفِعْلِ
[Machine] I heard the Messenger of Allah ﷺ saying, "Do not withhold the blessing of water, and do not withhold charity, for wealth will become worthless and families will go hungry."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا تَمْنَعُوا فَضْلَ الْمَاءِ وَلَا تَمْنَعُوا الْكَلَأَ فَيَهْزُلَ الْمَالُ وَيَجُوعَ الْعِيَالُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْأَرْضِ الْمَبْذُورِ فِيهَا مَعَ الْبَذْرِ قَبْلَ أَنْ يَظْهَرَ مَا يَتَوَلَّدُ مِنْهُ
This hadith has been reported on the authority of Jabir b. 'Abdullah through another chain of transmitters. (Using translation from Muslim 2116b)
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيَاضِ الْأَرْضِ»
ذِكْرُ الزَّجْرِ عَنْ تَلَقِّي الْمُشْتَرِي الْبُيُوعَ
"The Messenger of Allah ﷺ forbade meeting traders on the way." (Using translation from Ibn Mājah 2179)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ تَلَقِّي الْبُيُوعِ»
ذِكْرُ الْبَيَانِ بِأَنَّ التَّلَقِّيَ لِلْبُيُوعِ إِنَّمَا زُجِرَ عَنْهُ إِلَى أَنْ تَهْبِطَ الْأَسْوَاقُ
[Machine] "That the Messenger of Allah ﷺ prohibited receiving goods until the markets settle down."
«أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ تَلَقِّي السِّلَعِ حَتَّى تَهْبِطَ الْأَسْوَاقُ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَبِيعَ الْمَرْءُ الْحَاضِرُ لِلْبَادِي مِنَ الْأَعْرَابِ
"The Messenger of Allah said: 'A town-dweller should not sell for a direst-dweller. Leave the people alone and let Allah provide for them from one another."" (Sahih ) (Using translation from Nasāʾī 4495)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ وَدَعُوا النَّاسَ يَرْزُقُ اللَّهُ بَعْضَهُمْ مِنْ بَعْضٍ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْحَاضِرِ الْمُهَاجِرِ لِلْأَعْرَابِ
[Machine] Narrated by the Prophet ﷺ: "He forbade the act of barter and the exchanging of goods for another on the spot between a migrant and an Arab."
عَنِ النَّبِيِّ ﷺ «أَنَّهُ نَهَى عَنِ التَّلَقِّي وَأَنْ يَبِيعَ حَاضِرٌ الْمُهَاجِرُ لِلْأَعْرَابِيِّ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْحَاضِرَ قَدْ زُجِرَ عَنْ أَنْ يَبِيعَ لِلْبَادِي وَإِنْ لَمْ يَكُنْ بِالْمُهَاجِرِ
[Machine] The Messenger of Allah ﷺ prohibited selling a product that is not in the possession of the seller and said, "Do not engage in present transactions."
نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَقَالَ «لَا تَلَقُّوا الْبُيُوعَ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ هَذَا الْفِعْلِ
The Messenger of Allah ﷺ as saying: A townsman must not sell for a man from the desert ; and leave people alone, Allah will give them provision from one another. (Using translation from Abū Dāʾūd 3442)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ دَعُوا النَّاسَ يَرْزُقُ بَعْضُهُمْ بَعْضًا»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «يَرْزُقُ بَعْضُهُمْ، بَعْضًا» أَرَادَ بِهِ أَنَّ اللَّهَ يَرْزُقُهُمْ عَلَى أَيْدِيهِمْ
The Messenger of Allah ﷺ as saying: A townsman must not sell for a man from the desert ; and leave people alone, Allah will give them provision from one another. (Using translation from Abū Dāʾūd 3442)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَبِيعُ حَاضِرٌ لِبَادٍ دَعُوا النَّاسَ يَرْزُقُ اللَّهُ بَعْضَهُمْ مِنْ بَعْضٍ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمَرْءِ عَلَى بَيْعِ أَخِيهِ قَبْلَ أَنْ يَتَفَرَّقَ الْبَائِعُ وَالْمُشْتَرِي
"Let one of you not undersell another."[1] (Using translation from Ibn Mājah 2171)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَبِعْ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الْفِعْلَ إِنَّمَا زُجِرَ عَنْهُ مَا لَمْ يَأْذَنِ الْبَائِعُ الْأَوَّلُ فِيهِ
[Machine] The Messenger of Allah ﷺ said, "None of you should sell the property of his brother without his permission."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَبِعْ أَحَدُكُمْ عَلَى بَيْعِ أَخِيهِ إِلَّا بِإِذْنِهِ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ هَذَا الْبَيْعِ
[Machine] "A Jewish man came to the Prophet ﷺ during his time with thirty loads of wheat and dates. He sold them for a high price, the same price as the Prophet ﷺ , while the people did not have any other food that day. They had already experienced hunger and hadn't found any food. So, they came to complain to the Prophet ﷺ about the high prices. He ascended the pulpit, praised and thanked Allah, and then said, 'I will not cast Allah away before giving something to someone without any good intention. Only permitted trading is based on mutual consent. But in your transactions, there are some traits that I will mention to you, so do not mix them up or argue about them. Do not envy one another, do not cheat or deceive one another, and do not hate one another. Do not outbid one another, and do not sell what is not present. Trading is based on mutual consent, and be the brothers of Allah's servants.'"
أَنَّ يَهُودِيًّا قَدِمَ زَمَنَ النَّبِيِّ ﷺ بِثَلَاثِينَ حِمْلِ شَعِيرٍ وَتَمْرٍ فَسَعَّرَ مُدًّا بِمُدِّ النَّبِيِّ ﷺ وَلَيْسَ فِي النَّاسِ يَوْمَئِذٍ طَعَامٌ غَيْرُهُ وَكَانَ قَدْ أَصَابَ النَّاسَ قَبْلَ ذَلِكَ جُوعٌ لَا يَجِدُونَ فِيهِ طَعَامًا فَأَتَى النَّبِيَّ ﷺ النَّاسُ يَشْكُونَ إِلَيْهِ غَلَاءَ السِّعْرِ فَصَعِدَ الْمِنْبَرَ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ «لَا أَلْقَيَنَّ اللَّهَ مِنْ قَبْلِ أَنْ أُعْطِيَ أَحَدًا مِنْ مَالِ أَحَدٍ مِنْ غَيْرِ طِيبِ نَفْسٍ إِنَّمَا الْبَيْعُ عَنْ تَرَاضٍ وَلَكِنَّ فِي بُيُوعِكُمْ خِصَالًا أَذْكُرُهَا لَكُمْ لَا تُضَاغِنُوا وَلَا تَنَاجَشُوا وَلَا تَحَاسَدُوا وَلَا يَسُومُ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَلَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ وَالْبَيْعُ عَنْ تَرَاضٍ وَكُونُوا عِبَادَ اللَّهِ إِخْوَانًا»
ذِكْرُ الزَّجْرِ عَنْ مُزَايَدَةِ الْمَرْءِ عَلَى الشَّيْءِ الْمَبِيعِ مِنْ غَيْرِ قَصْدِهِ لِشِرَائِهِ
the Prophet ﷺ forbade the Najsh. (Using translation from Ibn Mājah 2173)
«أَنَّ النَّبِيَّ ﷺ نَهَى عَنِ النَّجْشِ»
ذِكْرُ الزَّجْرِ عَنْ تَصْرِيَةِ ذَوَاتِ الْأَرْبَعِ، عِنْدَ بَيْعِهَا
"The Messenger of Allah said: 'If any one of you sells a sheep or a milch- camel, let him not refrain from milking it.'' (Sahih ) (Using translation from Nasāʾī 4486)
قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا بَاعَ أَحَدُكُمُ اللِّقْحَةَ أَوِ الشَّاةَ فَلَا يُحَفِّلْهَا»
ذِكْرُ وَصْفِ الْحُكْمِ فِي تَصْرِيَةِ ذَوَاتِ الْأَرْبَعِ عِنْدَ بَيْعِهَا
The Messenger of Allah ﷺ as saying: Do not go out to meet riders to conduct business with them ; none of you must buy in opposition to one another; and do not tie up the udders of camels and sheep, for he who buys them after that has been done has two courses open to him after milking them: he may keep them if he is pleased with them, or he may return them along with a sa' of dates is he is displeased with them. (Using translation from Abū Dāʾūd 3443)
أَنَّ النَّبِيَّ ﷺ قَالَ «لَا تُصَرُّوا الْإِبِلَ وَالْغَنَمَ فَمَنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا إِنْ رَضِيَهَا أَمْسَكَهَا وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ»
ذِكْرُ الزَّجْرِ عَنِ اسْتِثْنَاءِ الْبَائِعِ الشَّيْءَ الْمَجْهُولَ مِنَ الشَّيْءِ الْمَبِيعِ فِي نَفْسِ الْعَقْدِ
The Messenger of Allah ﷺ forbade muzabanah, muhaqalah and thunya except it is known. (Using translation from Abū Dāʾūd 3405)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الثُّنَيَّا إِلَّا أَنْ تُعْلَمَ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَقَعَ بَيْعُ الْمَرْءِ عَلَى شَيْءٍ مَجْهُولٍ أَوْ إِلَى وَقْتٍ غَيْرِ مَعْلُومٍ
"The Messenger of Allah ﷺ forbade Gharar transactions. " (Using translation from Ibn Mājah 2195)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْغَرَرِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الشَّيْءِ بِمِئَةِ دِينَارٍ نَسِيئَةً وَبِتِسْعِينَ دِينَارًا نَقْدًا
[Machine] "From the Messenger of Allah ﷺ, it is narrated that he forbade two sales in one transaction."
عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ «نَهَى عَنْ بَيْعَتَيْنِ فِي بَيْعَةٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُشْتَرِيَ إِذَا اشْتَرَى بَيْعَتَيْنِ فِي بَيْعَةٍ عَلَى مَا وَصَفْنَا وَأَرَادَ مُجَانَبَةَ الرِّبَا كَانَ لَهُ أَوْكَسُهُمَا
The Prophet ﷺ said: If anyone makes two transactions combined in one bargain, he should have the lesser of the two or it will involve usury. (Using translation from Abū Dāʾūd 3461)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ بَاعَ بَيْعَتَيْنِ فِي بَيْعَةٍ فَلَهُ أَوْكَسُهُمَا أَوِ الرِّبَا»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ
the Messenger of Allah forbade Mulamash and Munabadha. (Using translation from Nasāʾī 4509)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُلامَسَةِ وَالْمُنَابَذَةِ
ذِكْرُ وَصْفِ بَيْعِ الْمُلَامَسَةِ وَكَيْفِيَّةِ الْمُنَابَذَةِ
"The Messenger of Allah forbade two kinds of garments and two kinds of transactions. As for the two kinds of transactions, they are Mulamash and Munabadhaha. Munabadha is when a man says, 'I throw this garment, and the transaction becomes binding, and Mulamasah is when a man touches it with his had, without spreading it out and checking it, and once he touches it, the transaction becomes binding." (Using translation from Nasāʾī 4515)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعَتَيْنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ فَالْمُنَابَذَةُ هُوَ أَنْ يَقُولَ إِذَا نَبَذْتُ إِلَيْكَ هَذَا الثَّوْبَ فَقَدْ وَجَبَ الْبَيْعُ وَالْمُلَامَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ وَلَا يَنْشُرُهُ وَلَا يُقَلِّبُهُ يَقُولُ إِذَا مَسَّهُ وَجَبَ الْبَيْعُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ مَا يَقَعُ عَلَيْهِ حَصَاةُ الْمُشْتَرِي
"The Messenger of Allah ﷺ forbade Gharar transaction sand Hasah transactions. " (Using translation from Ibn Mājah 2194)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الْحَصَاةِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الطَّعَامِ الْمُشْتَرَى قَبْلَ اسْتِيفَائِهِ
He who buys foodgrain should not sell that before taking possession of it. He (the narrator) said: We used to buy foodgrain from the caravans in bulk, but Messenger of Allah ﷺ forbade us to re-sell that until we had shifted it to some other place. (Using translation from Muslim 1526b)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنِ اشْتَرَى طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «حَتَّى يَسْتَوْفِيَهُ» أَرَادَ بِهِ حَتَّى يَقْبِضَهُ
The Prophet ﷺ said, "He who buys foodstuff should not sell it till he has received it." (Using translation from Bukhārī 2133)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ»
ذِكْرُ خَبَرٍ قَدْ يُوهِمُ غَيْرَ الْمُتَبَحِّرِ فِي صِنَاعَةِ الْعِلْمِ أَنَّ خَبَرَ حَمَّادِ بْنِ سَلَمَةَ الَّذِي ذَكَرْنَاهُ مَوْهُومٌ
He who buys food-rain should not sell it until he has taken possession of it. Ibn Abbas (Allah be pleased with them) said: I regard everything like food (so far as this principle is concerned). (Using translation from Muslim 1525c)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ اشْتَرَى طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ» قَالَ ابْنُ عَبَّاسٍ وَأَحْسِبُ كُلَّ شَيْءٍ بِمَنْزِلَةِ الطَّعَامِ
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ خَبَرَ ابْنَ عُمَرَ الَّذِي ذَكَرْنَاهُ، لَمْ يَهِمُ فِيهِ حَمَّادُ بْنُ سَلَمَةَ، وَأَنَّ الْخَبَرَ مِنْ حَدِيثِ ابْنِ عُمَرَ لَهُ أَصْلٌ
Do not buy fruits (on the trees) until their good condition becomes clear. (Using translation from Muslim 1534g)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهَا وَمَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ»
ذِكْرُ وَصْفِ الْقَبْضِ الَّذِي يَحِلُّ بِهِ بَيْعُ الطَّعَامِ الْمُشْتَرَى
"We used to buy food from troops of riders (i.e., the caravans) without knowing the amount, but the Messenger of Allah ﷺ forbade us to sell it until it had been delivered to us." (Using translation from Ibn Mājah 2229)
«كُنَّا نَشْتَرِي الطَّعَامَ مِنَ الرُّكْبَانِ جُزَافًا فَنَهَانَا رَسُولُ اللَّهِ ﷺ أَنْ نَبِيعَهُ حَتَّى نَنْقُلَهُ مِنْ مَكَانِهِ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ كُلَّ شَيْءٍ بَيْعٌ سِوَى الطَّعَامِ حُكْمُهُ حُكْمُ الطَّعَامِ فِي هَذَا الزَّجْرِ
[Machine] He said, I said, "O Messenger of Allah, I am a man who buys goods, so what is permissible for me from them and what is forbidden for me?" He said, "O son of my brother, when you make a purchase, do not sell it until you have received it."
قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِنِّي رَجُلٌ أَشْتَرِي الْمَتَاعَ فَمَا الَّذِي يَحِلُّ لِي مِنْهَا وَمَا يَحْرُمُ عَلَيَّ فَقَالَ «يَا بْنَ أَخِي إِذَا ابْتَعْتَ بَيْعًا فَلَا تَبِعْهُ حَتَّى تَقْبِضَهُ»
ذِكْرُ الْخَبَرِ الْمُصَرِّحِ بِأَنَّ حُكْمَ الطَّعَامِ وَغَيْرِهِ مِنَ الْأَشْيَاءِ الْمَبِيعَةِ فِيهِ سَوَاءٌ
[Machine] "To me (he said): 'Do not follow him until you secure him to your journey, for the Messenger of Allah – peace be upon him – has prohibited that. Therefore, I held onto my own hands.'"
لِي «لَا تَبِعْهُ حَتَّى تَحُوزَهُ إِلَى رَحْلِكَ فَإِنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ ذَلِكَ فَأَمْسَكْتُ يَدَيَّ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمَرْءِ الطَّعَامَ الَّذِي اشْتَرَاهُ قَبْلَ قَبْضِهِ وَاسْتِيفَائِهِ
[Machine] He said, "I bought some food from the charity's food and I made a profit from it before I received it. Then I wanted to sell it, so I asked the Prophet peace be upon him. He said, 'Do not sell it until you receive it.'"
أَنَّهُ قَالَ اشْتَرَيْتُ طَعَامًا مِنْ طَعَامِ الصَّدَقَةِ فَأَرْبَحْتُ فِيهِ قَبْلَ أَنْ أَقْبِضَهُ فَأَرَدْتُ بَيْعَهُ فَسَأَلْتُ النَّبِيَّ ﷺ قَالَ «لَا تَبِعْهُ حَتَّى تَقْبِضَهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ حُكْمَ حَكِيمِ بْنِ حِزَامٍ وَغَيْرِهِ مِنَ الْمُسْلِمِينَ فِي هَذَا الزَّجْرِ سَوَاءٌ
[Machine] The Messenger of Allah ﷺ said, "Whoever buys food should not sell it until he has received it in full." He also prohibited selling it until it is moved from its place or transferred.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ اشْتَرَى طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ» قَالَ وَنَهَى أَنْ يَبِيعَهُ حَتَّى يُحَوِّلَهُ مِنْ مَكَانِهِ أَوْ يَنْقُلَهُ
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الطَّعَامِ الَّذِي اشْتَرَى مُجَازَفَةً قَبْلَ أَنْ يُؤْوِيَهُ إِلَى رَحْلِهِ
[Machine] "I saw the companions of food striking during the time of the Messenger of Allahﷺ when they bought risky food, they sold it before bringing it to their caravans."
«رَأَيْتُ أَصْحَابَ الطَّعَامِ يَضْرِبُونَ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ إِذَا اشْتَرَوْا طَعَامًا مُجَازَفَةً فَبَاعُوهُ قَبْلَ أَنْ يُؤْوُوهُ إِلَى رِحَالِهِمْ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الثِّمَارِ عَلَى أَشْجَارِهَا حَتَّى تَطْعَمَ
"the Messenger of Allah forbade selling the fruit of date palms until they are fit to eat." (Using translation from Nasāʾī 4525)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَطْعَمَ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «حَتَّى يَطْعَمَ» أَرَادَ بِهِ ظُهُورَ صَلَاحِهَا
"Do not sell fruits until they have ripened."' (Using translation from Ibn Mājah 2215)
«نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهَا»
ذِكْرُ وَصْفِ ظُهُورِ الصَّلَاحِ فِي الثَّمَرِ الَّذِي يَحِلُّ بَيْعُهَا عِنْدَ ظُهُورِهِ
the Messenger of Allah forbade selling fruits before they ripen. It was said: "O Messenger of Allah what does ripen mean?" he said: 'when they turn red." And the Messenger of Allah said: "What do you think if Allah withholds the fruits (causes it not to ripen), why would any one of you take his brother's wealth?" (Using translation from Nasāʾī 4526)
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنْ بَيْعِ الثِّمَارِ حَتَّى تُزْهِيَ قِيلَ وَمَا تُزْهِي؟ قَالَ حَتَّى تَحْمَرَّ قَالَ رَسُولُ اللَّهِ ﷺ «أَرَأَيْتَ إِذَا مَنَعَ اللَّهُ الثَّمَرَةَ بِمَ يَأْخُذُ أَحَدُكُمْ مَالَ أَخِيهِ؟ »
ذِكْرُ الْبَيَانِ بِأَنَّ حُكْمَ الْبَائِعِ وَالْمُشْتَرِي فِي هَذَا الزَّجْرِ الَّذِي ذَكَرْنَاهُ سَوَاءٌ
The Messenger of Allah ﷺ forbade the sale of fruits till they were clearly in good condition, forbidding it both to the seller and to the buyer. (Using translation from Abū Dāʾūd 3367)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ بَيْعِ الثِّمَارِ حَتَّى يَبْدُوَ صَلَاحُهَا نَهَى الْبَائِعَ وَالْمُشْتَرِيَ»

عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ «نَهَى عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَعَنْ بَيْعِ النَّخْلِ حَتَّى يُشْقِحَ وَالْإِشْقَاحُ أَنْ يَحْمَرَّ أَوْ يَصْفَرَّ أَوْ يُؤْكَلَ مِنْهُ شَيْءٌ» قَالَ زَيْدٌ فَقُلْتُ لِعَطَاءِ بْنِ أَبِي رَبَاحٍ أَسَمِعْتَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَذْكُرُ ذَلِكَ عَنْ رَسُولِ اللَّهِ ﷺ؟ قَالَ نَعَمْ
ذِكْرُ وَصْفِ ظُهُورِ الصَّلَاحِ فِي الْحُبُوبِ الَّتِي يَحِلُّ بَيْعُهَا عِنْدَ وُجُودِهِ
The Prophet ﷺ forbade the sale of grapes till they became black and the sale of grain till it had become hard. (Using translation from Abū Dāʾūd 3371)
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ بَيْعِ النَّخْلِ حَتَّى تَزْهُوَ وَعَنْ بَيْعِ الْحَبِّ حَتَّى يَشْتَدَّ وَعَنْ بَيْعِ الْعِنَبِ حَتَّى يَسْوَدَّ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ بَيْعِ مَا وَصَفْنَا
The Messenger of Allah ﷺ forbade selling palm-trees till the dates began to ripen, and ears of corn till they were white and were safe from blight, forbidding it both to the buyer and to the seller. (Using translation from Abū Dāʾūd 3368)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ بَيْعِ السُّنْبُلِ حَتَّى يَبْيَضَّ وَيَأْمَنَ مِنَ الْعَاهَةِ نَهَى الْبَائِعَ وَالْمُشْتَرِيَ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْمَرْءِ ثَمَرَةَ نَخْلِهِ سِنِينَ مَعْلُومَةً مِمَّا بَاعَ السَّنَةَ الْأُولَى مِنْهَا

أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا «نَهَى عَنْ بَيْعِ الْمُزَابَنَةِ»
[Machine] Narrated by Al-Qa'nabi, from Malik, from Abdullah bin Yazid, the Mawla of Al-Aswad bin Sufyan, from Zaid bin Abi 'Ayyash, from Saad bin Abi Waqqas, that he was asked about selling white animals for silver coins. He replied, "I heard the Messenger of Allah ﷺ being asked about selling ripe dates for dried dates, and he said, 'Doesn't the dried date decrease in value when it becomes dry?' They replied, 'Yes.' He said, 'Then no.'"
حَدَّثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الْأَسْوَدِ بْنِ سُفْيَانَ عَنْ زَيْدِ أَبِي عَيَّاشٍ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ أَنَّهُ سُئِلَ عَنْ بَيْعِ الْبَيْضَاءِ بِالسُّلْتِ فَقَالَ سَمِعْتُ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنْ بَيْعِ الرُّطَبِ بِالتَّمْرِ فَقَالَ «أَلَيْسَ يَنْقُصُ الرُّطَبُ إِذَا جَفَّ؟ » قَالُوا نَعَمْ قَالَ «فَلَا إِذَا»
ذِكْرُ وَصْفِ الْمُزَابَنَةِ، الَّتِي نَهَى عَنْ بَيْعِهَا
Ibn Umar (Allah be pleased them) reported Messenger of Allah ﷺ having forbidden Muzabana, and Muzabana implies the selling of fresh dates for dry dates by measuring them out and the selling of raisins by measure for grapes. (Using translation from Muslim 1542a)
«أَنَّ النَّبِيَّ ﷺ نَهَى عَنِ الْمُزَابَنَةِ وَالْمُزَابَنَةُ بَيْعُ التَّمْرِ بِالتَّمْرِ كَيْلًا وَبَيْعُ الْكَرْمِ بِالزَّبِيبِ كَيْلًا»
ذِكْرُ وَصْفِ الْمُحَاقَلَةِ، الَّتِي زُجِرَ عَنْ بَيْعِهَا
The Prophet ﷺ forbade the sale of fruits on the tree for fruits by measure, and sale of grapes for raisins by measure, and sale of harvest for wheat by measure. (Using translation from Abū Dāʾūd 3361)
أَخْبَرَهُ أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ بَيْعِ ثَمَرِ النَّخْلِ بِالتَّمْرِ كَيْلًا وَعَنْ بَيْعِ الْعِنَبِ بِالزَّبِيبِ كَيْلًا وَعَنْ بَيْعِ الزَّرْعِ بِالْحِنْطَةِ كَيْلًا»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُزَابَنَةَ الَّتِي نُهِيَ عَنْهَا قَدْ رُخِّصَ فِي بَيْعِ بَعْضِهَا لِعِلَّةٍ مَعْلُومَةٍ
From Jabir that the Prophet ﷺ prohibited Al-Muhaqalah, Al-Muzabanah, Al-Mukhabarah, and Al-Mu'awamah, and he permitted it in the case of Al-'Araya. (Using translation from Tirmidhī 1313)
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ وَالْمُعَاوَمَةِ وَرَخَّصَ فِي الْعَرَايَا»

٢٤۔٦۔٦٥ ذِكْرُ الْبَيَانِ بِأَنَّ الْعَرِيَّةَ الَّتِي رُخِّصَ فِيهَا هِيَ بَيْعُ بَعْضِ الرُّطَبِ بِالثَّمَرِ
Zaid b. Thabit (Allah be pleased with him) reported Messenger of Allah (may peace he upon him) having given concession in case of 'ariyya for selling dry dates (with) fresh dates after measuring them out. (Using translation from Muslim 1539c)
«أَنَّ رَسُولَ اللَّهِ ﷺ رَخَّصَ لِصَاحِبِ الْعَرِيَّةِ أَنْ يَبِيعَهَا بِخَرْصِهَا مِنَ التَّمْرِ»
The Messenger of Allah ﷺ forbade the sale of fruits for dried dates, but gave license regarding the 'araya for its sale on the basis of a calculation of their amount. But those who buy them can eat them when fresh. (Using translation from Abū Dāʾūd 3363)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ بَيْعِ الثَّمَرِ بِالثَّمَرِ وَرَخَّصَ فِي الْعَرِيَّةِ أَنْ تُبَاعَ بِخَرْصِهَا وَالْعَرِيَّةُ أَنْ يَأْكُلَهَا أَهْلُهَا رُطَبًا»
