٢٤۔ كِتَابُ الْبُيُوعِ ص ٣
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ بَيْعِ الثَّمَرِ بِالثَّمَرِ
Which of them is better? He replied: Soft and white kind of wheat. So he forbade him from it and said: I heard the Messenger of Allah (sawa) say, when he was asked about buying dry dates for fresh. The Messenger of Allah (sawa) said: Are fresh dates diminished when they become dry? The (the people) replied: Yes. So the Messenger of Allah ﷺ forbade that. Abu Dawud said: A similar tradition has also been transmitted by Isma'il b. Umayyah. (Using translation from Abū Dāʾūd 3359)
وَقَالَ سَمِعْتُ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنْ يَبِسِ التَّمْرِ بِالرُّطَبِ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ؟ » قَالَ نَعَمْ فَنَهَاهُ عَنْ ذَلِكَ
ذِكْرُ إِبَاحَةِ بَعْضِ الْمُزَابَنَةِ لِلْعِلَّةِ الْمَعْلُومَةِ فِيهِ
"Zaid bin Thabit narrated to me that the Messenger of Allah ﷺ gave a concession regarding the sale of 'Araya.” (Using translation from Ibn Mājah 2268)
«أَنَّ رَسُولَ اللَّهِ ﷺ رَخَّصَ فِي الْعَرَايَا بِخَرْصِهَا»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
[Machine] From the Prophet ﷺ that he permitted the sale of used clothing.
عَنِ النَّبِيِّ ﷺ أَنَّهُ «رَخَّصَ فِي بَيْعِ الْعَرَايَا بِخَرْصِهَا»
ذِكْرُ الْقَدْرِ الَّذِي يَجُوزُ بَيْعُ الْعَرَايَا بِهِ
That the Messenger of Allah ﷺ permitted Al-'Araya in cases less than five Wasq. Or similar. (Using translation from Tirmidhī 1301)
«أَنَّ رَسُولَ اللَّهِ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ أَوْ خَمْسَةِ أَوْسُقٍ»
ذِكْرُ وَصْفِ الْقَدْرِ، الَّذِي يَجُوزُ بِهِ، بَيْعُ الْعَرَايَا
That the Messenger of Allah ﷺ permitted Al-'Araya in cases less than five Wasq. Or similar. (Using translation from Tirmidhī 1301)
أَنَّ رَسُولَ اللَّهِ ﷺ «رَخَّصَ فِي بَيْعِ الْعَرَايَا فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ أَوْ خَمْسَةِ أَوْسُقٍ»
ذِكْرُ الِاسْتِحْبَابِ لِلْمَرْءِ أَنْ يَكُونَ بَيْعُهُ الْعَرَايَا فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ وَلَا يُجَاوِزُ بِهِ إِلَى أَنْ يَبْلُغَ خَمْسَةَ أَوْسُقٍ احْتِيَاطًا
[Machine] I heard the Messenger of Allah ﷺ when he allowed the poor to sell grapes by the bunch, he said, "Al-Wasq, al-Wasqayn, ath-Thalathah, wal-Arba'ah."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ حِينَ أَذِنَ لِلْعَرَايَا أَنْ يَبِيعُوهَا بِخَرْصِهَا يَقُولُ «الْوَسْقُ وَالْوَسْقَيْنِ وَالثَّلَاثَةُ وَالْأَرْبَعَةُ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُزَابَنَةَ الْمَنْهِيَّ عَنْهَا لَمْ يُرَخَّصْ فِيهَا إِلَّا بَيْعُ الْعَرَايَا فَقَطْ
"The Messenger of Allah granted a concession allowing 'Araya sales for fresh dates and for dried dates, but he did not allow anything other than that." (Using translation from Nasāʾī 4540)
«أَنَّ رَسُولَ اللَّهِ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا وَلَمْ يُرَخِّصْ فِي غَيْرِ ذَلِكَ»
ذِكْرُ خَبَرٍ يُوهِمُ بَعْضَ الْمُسْتَمِعِينَ مِمَّنْ لَمْ يَطْلُبِ الْعِلْمَ مِنْ مَظَانِّهِ أَنَّ بَيْعَ الْمُسْلِمِ السِّلَاحَ مِنَ الْحَرْبِيِّ جَائِزٌ
[Machine] "I will not give you anything until you disbelieve in Muhammad." So I said, "I will not disbelieve in Muhammad until Allah causes you to die, then brings you back to life." He said, "If Allah causes me to die and then resurrects me, I will have wealth and children which I will give to you." So I said, "That is for the Messenger of Allah ﷺ ." Then Allah revealed the verse: "Have you seen the one who disbelieves in Our signs and says, 'I will surely be given wealth and children'?" (Quran 19:77)
«لَا أُعْطِيكَ حَتَّى تَكْفُرَ بِمُحَمَّدٍ» فَقُلْتُ «لَا أَكْفُرُ بِمُحَمَّدٍ حَتَّى يُمِيتَكَ اللَّهُ ثُمَّ يُحْيِيَكَ» قَالَ «إِذَا أَمَاتَنِي اللَّهُ ثُمَّ يَبْعَثُنِي وَلِي مَالٌ وَوَلَدٌ أَعْطَيْتُكَ» فَقُلْتُ «ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَأَنْزَلَ اللَّهُ {أَفَرَأَيْتَ الَّذِي كَفَرَ بِآيَاتِنَا وَقَالَ لَأُوتَيَنَّ مَالًا وَوَلَدًا} » الْآيَةَ
24.7 [Machine] Interest
٢٤۔٧ بَابُ الرِّبَا
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْجِنْسِ مِنَ الطَّعَامِ بِجِنْسِهِ إِلَّا مِثْلًا بِمِثْلٍ
[Machine] Buy it and then buy barley with it. The boy went and took a measure and some additional barley. When Ma'mar came, the boy informed him about that. Ma'mar asked him, "Why did you do that?" Go and return it, and do not take anything unless it is like for like. For I used to hear the Messenger of Allah ﷺ saying, 'Food should be exchanged like for like, and our food in those days was barley.'"
بِعْهُ ثُمَّ اشْتَرِ بِهِ شَعِيرًا فَذَهَبَ الْغُلَامُ وَأَخَذَ صَاعًا وَزِيَادَةَ بَعْضِ صَاعٍ فَلَمَّا جَاءَ مَعْمَرٌ أَخْبَرَهُ بِذَلِكَ فَقَالَ لَهُ مَعْمَرٌ لِمَ فَعَلْتَ ذَلِكَ انْطَلَقَ فَرُدَّهُ وَلَا تَأْخُذْ إِلَّا مِثْلًا بِمِثْلٍ فَإِنِّي كُنْتُ أَسْمَعُ رَسُولَ اللَّهِ ﷺ يَقُولُ «الطَّعَامُ بِالطَّعَامِ مِثْلًا بِمِثْلٍ وَكَانَ طَعَامُنَا يَوْمَئِذٍ الشَّعِيرَ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الدَّنَانِيرِ وَالدَّرَاهِمِ بِأَجْنَاسِهَا وَبَيْنَهُمَا فَضْلٌ
"Dinar for Dinar Dirham for Dirham, no difference between them." (Using translation from Nasāʾī 4567)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا»
ذِكْرُ الْبَيَانِ بِأَنَّ بَيْعَ الْأَشْيَاءِ الَّتِي وَصَفْنَاهَا بِأَجْنَاسِهَا وَبَيْنَهُمَا فَضْلُ رِبًا
The Messenger of Allah ﷺ said - and on one occasion Sufyan said: ['Umar] heard the Messenger of Allah ﷺ say “Gold for silver is riba unless it is exchanged on the spot [lit. ‘this for that'), wheat for wheat is riba unless it is exchanged on the spot, barley for barley is riba unless it is exchanged on the spot, dates for dates is riba unless it is exchanged on the spot.” (Using translation from Aḥmad 162)
يَسْمَعُ فَقَالَ عُمَرُ وَاللَّهِ لَا تُفَارِقُهُ حَتَّى تَأْخُذَ مِنْهُ ثُمَّ قَالَ عُمَرُ قَالَ رَسُولُ اللَّهِ ﷺ «الذَّهَبُ بِالْوَرِقِ رِبًا إِلَّا هَاءً وَهَاءً وَالْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَاءً وَهَاءً وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَاءً وَهَاءً وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَاءً وَهَاءً»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْفِضَّةِ بِالْفِضَّةِ، وَالذَّهَبِ بِالذَّهَبِ، إِلَّا مِثْلًا بِمِثْلٍ
"The Messenger of Allah forbade selling silver for silver and gold for gold, unless it was of equal amounts. And he told us to sell gold for silver however we wanted, and silver for gold however we wanted. (Using translation from Nasāʾī 4578)
أَبُو بَكْرَةَ «نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يَبْتَاعَ الْفِضَّةَ بِالْفِضَّةِ وَالذَّهَبَ بِالذَّهَبِ إِلَّا سَوَاءً بِسَوَاءٍ وَأَمَرَ أَنْ يَبْتَاعَ الْفِضَّةَ بِالذَّهَبِ كَيْفَ شَاءَ وَالذَّهَبَ بِالْفِضَّةِ كَيْفَ شَاءَ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْأَشْيَاءِ الْمَعْلُومَةِ بِأَجْنَاسِهَا إِلَّا مِثْلًا بِمِثْلٍ
[Machine] There were people who were trading silver items in a market for food and provisions. Ubada said, "The Messenger of Allah ﷺ prohibited trading gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates, and salt for salt unless it is done hand to hand. Whoever exceeds or is exceeded has engaged in usury."
كَانَ أُنَاسٌ يَتَبَايَعُونَ آنِيَةَ فِضَّةٍ فِي مَغْنَمٍ إِلَى الْعَطَاءِ فَقَالَ عُبَادَةُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الذَّهَبِ بِالذَّهَبِ وَالْفِضَّةِ بِالْفِضَّةِ وَالْبُرِّ بِالْبُرِّ وَالشَّعِيرِ بِالشَّعِيرِ وَالتَّمْرِ بِالتَّمْرِ وَالْمِلْحِ بِالْمِلْحِ إِلَّا مِثْلًا بِمِثْلٍ يَدًا بِيَدٍ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أَرْبَى»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ هَذِهِ الْأَشْيَاءِ بِأَجْنَاسِهَا مِثْلًا بِمِثْلٍ وَأَحَدُهُمَا غَائِبٌ
Do not sell gold for gold, except like for like, and don't increase something of it upon something; and don't sell silver unless like for like, and don't increase some thing of it upon something, and do not sell for ready money something to be given later. (Using translation from Muslim 1584a)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا شَيْئًا مِنْهَا غَائِبًا بِنَاجِزٍ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ نَافِعًا لَمْ يَسْمَعْ هَذَا الْخَبَرَ مِنْ أَبِي سَعِيدٍ الْخُدْرِيِّ
[Machine] Abu Sa'id al-Khudri narrated that the Messenger of Allah ﷺ said: "Nafi' set out while I was with them until we entered upon Abu Sa'id al-Khudri. Ibn 'Umar said to Abu Sa'id al-Khudri, 'Have you heard anything from this man regarding a Hadith in which you narrate from the Messenger of Allah ﷺ ?' Abu Sa'id al-Khudri replied, 'What is it?' Ibn 'Umar said, 'The exchange of gold for gold, and silver for silver, should be equal in weight and hand-to-hand. Do not sell gold for gold which is not present, nor silver for silver which is not present, nor sell some of it hand to hand while the rest is not present, nor sell sufficient quantities of it while leaving the measuring process to be completed later.'"
أَنَّ أَبَا سَعِيدٍ الْخُدْرِيَّ يُحَدِّثُ هَذَا الْحَدِيثَ عَنْ رَسُولِ اللَّهِ ﷺ قَالَ نَافِعٌ فَانْطَلَقَ ابْنُ عُمَرَ وَذَلِكَ الرَّجُلُ وَأَنَا مَعَهُمْ حَتَّى دَخَلْنَا عَلَى أَبِي سَعِيدٍ الْخُدْرِيِّ فَقَالَ ابْنُ عُمَرَ لِأَبِي سَعِيدٍ أَرَأَيْتَ حَدِيثًا حَدَّثَنِيهِ هَذَا الرَّجُلُ أَنَّكَ تُحَدِّثُهُ عَنْ رَسُولِ اللَّهِ ﷺ أَسَمِعْتَهُ؟ قَالَ أَبُو سَعِيدٍ وَمَا هُوَ؟ فَقَالَ ابْنُ عُمَرَ بَيْعُ الذَّهَبِ بِالذَّهَبِ وَالْوَرِقِ بِالْوَرِقِ فَأَشَارَ أَبُو سَعِيدٍ بِأُصْبُعِهِ إِلَى عَيْنَيْهِ وَإِلَى أُذُنَيْهِ فَقَالَ بَصُرَ عَيْنِي وَسَمِعَ أُذُنِيَ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا مِنْهَا شَيْئًا غَائِبًا بِنَاجِزٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذِهِ الْأَجْنَاسَ إِذَا بِيعَتْ بِغَيْرِ أَجْنَاسِهَا وَبَيْنَهَا التَّفَاضُلُ كَانَ ذَلِكَ جَائِزًا إِذَا لَمْ يَكُنْ، إِلَّا يَدًا بِيَدٍ
[Machine] The Messenger of Allah ﷺ said, "Gold is to be exchanged for gold, silver for silver, wheat for wheat, barley for barley, dates for dates, and salt for salt, like for like, hand in hand. So, if these species differ, then sell as you wish if it is hand to hand."
قَالَ رَسُولُ اللَّهِ ﷺ «الذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ مِثْلًا بِمِثْلٍ يَدًا بِيَدٍ فَإِذَا اخْتَلَفَتْ هَذِهِ الْأَصْنَافُ فَبِيعُوا كَيْفَ شِئْتُمْ إِذَا كَانَ يَدًا بِيَدٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذِهِ الْأَجْنَاسَ إِذَا بِيعَ أَحَدُهَا بِغَيْرِ جِنْسِهَا إِلَّا يَدًا بِيَدٍ كَانَ ذَلِكَ رِبًا
l brought some dinars of mine and wanted to exchange them. Talhah bin ‘Ubaidullah met me and we agreed to an exchange. Then he took them and said: Wait until my storekeeper comes - Abu ʿAmir said. From al-Ghalal (a place). And he said concerning it. All of it should be ‘Take this’ and ʿtake thisʿ [i.e., exchanged on the spot]. - I asked ‘Umar bin al-Khattab ؓ about that and he said: I heard the Messenger of Allah ﷺ say: ʿSilver for gold is riba, unless it is exchanged on the spot, wheat for wheat is riba, unless it is exchanged on the spot; barley for barley is riba, unless it is exchanged on the spot dates for dates is ribu unless it is exchanged on the spot.” (Using translation from Aḥmad 314)
عُمَرُ لَا تُفَارِقْهُ لَا تُفَارِقْهُ حَتَّى تُنْقِدَهُ قَالَ رَسُولُ اللَّهِ ﷺ «الذَّهَبُ بِالْوَرِقِ رِبًا إِلَّا هَاءً وَهَاتِ وَالْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَاءً وَهَاتِ وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَاءً وَهَاتِ وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَاءً وَهَاتِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الصَّاعِ مِنَ التَّمْرِ بِالصَّاعَيْنِ وَإِنْ كَانَ أَحَدُهُمَا أَرْدَأَ مِنَ الْآخَرِ
some dates from trees that were irrigated artificially were brought to the Messenger of Allah and the dates of the messenger of Allah were dates from trees that were nourished by their roots. He said: "Where did you get these from?" They said: "We bought a Sa of them for two Sa s of our dates: He said: "Do not do that, for this is not right. Rather sell your dates and but what you need of these," (Using translation from Nasāʾī 4554)
أَنَّ رَسُولَ اللَّهِ ﷺ أُتِيَ بِتَمْرٍ رَيَّانَ وَكَانَ تَمْرُ رَسُولِ اللَّهِ ﷺ بَعْلًا فِيهِ يُبْسٌ فَقَالَ «أَنَّى لَكُمْ هَذَا؟ » قَالُوا ابْتَعْنَاهُ صَاعًا بِصَاعَيْنِ مِنْ تَمْرِنَا قَالَ «فَلَا تَفْعَلْ إِنَّ هَذَا لَا يَصْلُحُ وَلَكِنْ بِعْ تَمْرَكَ ثُمَّ اشْتَرِ مِنْ هَذَا حَاجَتَكَ»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ بِعْ تَمْرَكَ أَرَادَ بِهِ بِالدَّرَاهِمِ
the Messenger of Allah appointed a man in charge of kharibar and he brought some Janib dates. The messenger of Allah said; "Are all the dates if khaibar like this?" He said: "No (by Allah, O Messenger of Allah) we take a Sa of these for two for three Sas (of other types of dates)." The messenger of Allah said: "do not do that Sell the mixed dates for Dirhams then buy the Janib dates with the Dirhams" ," (Using translation from Nasāʾī 4553)
أَنَّ رَسُولَ اللَّهِ ﷺ اسْتَعْمَلَ رَجُلًا عَلَى خَيْبَرَ فَجَاءَهُ بِتَمْرٍ جَنِيبٍ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَكَلَ تَمْرَكَ هَكَذَا» قَالَ لَا وَاللَّهِ يَا رَسُولَ اللَّهِ إِنَّا لَنَأْخُذُ الصَّاعَ مِنْ هَذَا بِالصَّاعَيْنِ وَالصَّاعَيْنِ بِالثَّلَاثِ فَقَالَ رَسُولُ اللَّهِ ﷺ «فَلَا تَفْعَلْ بِعِ الْجَمْعَ بِالدَّرَاهِمِ ثُمَّ ابْتَعْ بِالدَّرَاهِمِ جَنِيبًا»
ذِكْرُ الْبَيَانِ بِأَنَّ بَيْعَ الصَّاعِ مِنَ التَّمْرِ بِالصَّاعَيْنِ يَكُونُ رِبًا
"Bilal brought some Bami dates to the Messenger of Allah and he said: 'What is this? 'He said: 'I bought a Sa of them for two Sas. The Messenger of Allah said: "O! The essence of Riba, do not approach it."' (Using translation from Nasāʾī 4557)
أَنَّ رَجُلًا أَتَى رَسُولَ اللَّهِ ﷺ بِتَمْرٍ بَرْنِيٍّ فَقَالَ مَا هَذَا؟ قَالَ اشْتَرَيْتُهُ صَاعًا بِصَاعَيْنِ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَوَّهْ عَيْنُ الرِّبَا لَا تَفْعَلْ» *
ذِكْرُ خَبَرٍ أَوْهَمَ عَالِمًا مِنَ النَّاسِ أَنَّ الدِّرْهَمَ بِالدِّرْهَمَيْنِ جَائِزٌ نَقْدًا وَإِنَّمَا حَرُمَ ذَلِكَ نَسِيئَةً
"There is no Riba except in credit.' (Using translation from Nasāʾī 4580)
حَدَّثَنِي أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا رِبَا إِلَّا فِي النَّسِيئَةِ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الصَّاعِ مِنَ التَّمْرِ بِالصَّاعَيْنِ مِنْهُ
"We used to sell two Sa s of mixed dates for a Sa but the Prophet said (Do not sell) two Sa s dates for a Sa or two Sa s wheat or a Sa or two Dirhams for a Dirham. ," (Using translation from Nasāʾī 4556)
كُنَّا نَبِيعُ تَمْرَ الْجَمْعِ صَاعَيْنِ بِصَاعٍ مِنْ تَمْرِ الْجَنِيبِ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَا صَاعَيْ تَمْرٍ بِصَاعِ تَمْرٍ وَلَا صَاعَيْ حِنْطَةٍ بِصَاعِ حِنْطَةٍ وَلَا دِرْهَمَيْنِ بِدِرْهَمٍ»
ذِكْرُ لَعْنِ الْمُصْطَفَى ﷺ مَنْ أَعَانَ فِي الرِّبَا عَلَى أَيِّ حَالَةٍ كَانَ
Xthe Messenger of Allah ﷺ cursed the one who consumes usury, the one who pays it, those who witness it and the one who writes it down. (Using translation from Ibn Mājah 2277)
وَأَنَّ رَسُولَ اللَّهِ ﷺ لَعَنَ آكِلَ الرِّبَا وَمُوكِلَهُ وَشَاهِدَيْهِ وَكَاتِبَهُ»
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْكَيْلَةِ مِنَ التَّمْرِ بِشَيْءٍ مَعْلُومٍ مِنْهُ
Jabir b. Abdullah (Allah be pleased with them) is reported to have said that Messenger of Allah ﷺ forbade the sale of a heap of dates the weight of which is unknown in accordance with the known weight of dates. (Using translation from Muslim 1530a)
سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ «نَهَى رَسُولُ اللَّهِ ﷺ عَنْ بَيْعِ الصَّبْرِ مِنَ التَّمْرِ لَا يُعْلَمُ مَكِيلَتُهَا بِالْكَيْلِ الْمُسَمَّى مِنَ التَّمْرِ»
ذِكْرُ جَوَازِ بَيْعِ الْمَرْءِ الْحَيَوَانَ بَعْضَهَا بِبَعْضٍ وَإِنْ كَانَ الَّذِي يَأْخُذُ أَقَلَّ فِي الْعَدَدِ مِنَ الَّذِي يُعْطِي
"A slave came and pledged to the Prophet to emigrate, and the Prophet did not realize that he was a slave. Then his master came looking for him. The Prophet said: 'Sell him to me,' and he bought him for two black slaves. Then he did not accept the pledge from anyone until he asked: 'Is he a slave?"' (Using translation from Nasāʾī 4184)
جَاءَ عَبْدٌ فَبَايَعَ نَبِيَّ اللَّهِ ﷺ عَلَى الْهِجْرَةِ وَلَمْ يَشْعُرْ أَنَّهُ عَبْدٌ فَجَاءَ سَيِّدُهُ يُرِيدُهُ فَقَالَ النَّبِيُّ ﷺ «بِعْنِيهِ» فَاشْتَرَاهُ بِعَبْدَيْنِ أَسْوَدَيْنِ ثُمَّ لَمْ يُبَايعْ أَحَدًا حَتَّى يَسْأَلَهُ أَعْبُدٌ هُوَ؟
ذِكْرُ الزَّجْرِ عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ إِلَّا يَدًا بِيَدٍ
The Prophet ﷺ forbade selling animals for animals when payment was to be made at a later date. (Using translation from Abū Dāʾūd 3356)
«عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً»

٢٤۔٨ بَابُ الْإِقَالَةِ
ذِكْرُ إِقَالَةِ اللَّهِ جَلَّ وَعَلَا فِي الْقِيَامَةِ عَثْرَةَ مَنْ أَقَالَ نَادِمًا بَيْعَتَهُ
Whoever agrees with a Muslim to cancel a transaction Allah will forgive his sins on the Day of Resurrection. " (Using translation from Ibn Mājah 2199)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ أَقَالَ نَادِمًا بَيْعَتَهُ أَقَالَ اللَّهُ عَثْرَتَهُ يَوْمَ الْقِيَامَةِ»
ذِكْرُ إِقَالَةِ اللَّهِ جَلَّ وَعَلَا فِي الْقِيَامَةِ عَثْرَةَ مَنْ أَقَالَ عَثْرَةَ أَخِيهِ الْمُسْلِمِ فِي الدُّنْيَا

٢٤۔٩ بَابُ الْجَائِحَةِ
ذِكْرُ الْأَمْرِ بِالْوَضْعِ عَمَّنِ اشْتَرَى ثَمَرَةً فَأَصَابَتْهَا جَائِحَةٌ وَهُوَ مُعْدِمٌ
the Prophet annulled transaction in the event of crop faioure. (Using translation from Nasāʾī 4529)
«أَنَّ النَّبِيَّ ﷺ أَمَرَ بِوَضْعِ الْجَوَائِحِ»
ذِكْرُ الْبَيَانِ بِأَنَّ وَضْعَ الْجَوَائِحِ مِنَ الْخَيْرِ الَّذِي يَتَقَرَّبُ بِهِ إِلَى الْبَارِئِ جَلَّ وَعَلَا
[Machine] A woman entered upon the Prophet ﷺ and said, "By my father and mother, I and my son bought something from so-and-so and we weighed it. By the One who honored you with what He honored you with, we did not take anything from it except what we ate in our stomachs or fed to a needy person, hoping for blessings. And we have been setting aside what we owe from it until we receive the complete amount." Then the Prophet ﷺ took an oath by Allah three times, saying, "He who does not act with righteousness will not be successful." The news reached the owner of the merchandise, and he said, "By my father and mother, if you wish, I will return what you are owed, and if you wish, I will donate from the capital."
دَخَلَتِ امْرَأَةٌ عَلَى النَّبِيِّ ﷺ فَقَالَتْ بِأَبِي وَأُمِّي إِنِّي ابْتَعْتُ أَنَا وَابْنِي مِنْ فُلَانٍ ثَمَرَ مَالِهِ فَأَحْصَيْنَاهُ لَا وَالَّذِي أَكْرَمَكَ بِمَا أَكْرَمَكَ بِهِ مَا أَحْصَيْنَا مِنْهُ شَيْئًا إِلَّا شَيْئًا نَأْكُلُهُ فِي بُطُونِنَا أَوْ نُطْعِمُ مِسْكِينًا رَجَاءَ الْبَرَكَةِ وَجِئْنَا نَسْتَوْضِعُهُ مَا نَقَصْنَا فَحَلَفَ بِاللَّهِ لَا يَضَعُ لَنَا شَيْئًا فَقَالَ نَبِيُّ اللَّهِ ﷺ «تَأَلَّى لَا يَصْنَعُ خَيْرًا» ثَلَاثَ مَرَّاتٍ قَالَتْ فَبَلَغَ ذَلِكَ صَاحِبَ الثَّمَرِ فَقَالَ بِأَبِي وَأُمِّي إِنْ شِئْتَ وَضَعْتُ مَا نَقَصُوا وَإِنْ شِئْتَ مِنْ رَأْسِ الْمَالِ فَوَضَعَ مَا نَقَصُوا
ذِكْرُ الْبَيَانِ بِأَنَّ الْبَائِعَ لَيْسَ لَهُ أَنْ يَأْخُذَ شَيْئًا مِنْ بَاقِي ثَمَنِ ثَمَرِهِ الَّذِي أَصَابَتْهُ الْجَائِحَةُ
In the time of the Messenger of Allah ﷺ a man suffered loss affecting fruits he had bought and owed a large debt, so the Messenger of Allah ﷺ said: Give him sadaqah (alms). So the people gave him sadaqah (alms), but as that was not enough to pay the debt in full, the Messenger of Allah ﷺ said: Take what you find. But that is all you may have. (Using translation from Abū Dāʾūd 3469)
أَنَّهُ قَالَ أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ فِي ثِمَارٍ ابْتَاعَهَا فَكَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «تَصَدَّقُوا عَلَيْهِ» فَتُصُدِّقَ عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «خُذُوا مَا وَجَدْتُمْ وَلَيْسَ لَكُمْ إِلَّا ذَلِكَ»
ذِكْرُ الْبَيَانِ بِأَنَّ زَجْرَ الْمَرْءِ عَنْ أَخْذِ ثَمَنِ ثَمَرِهِ بَعْدَ أَنْ أَصَابَتْهُ الْجَائِحَةُ زَجْرُ تَحْرِيمٍ لَا زَجْرُ نَدْبٍ
The Messenger of Allah ﷺ as saying: If you were to sell dried dates to your brother and they were smitten by blight, it will not be allowable for you to take your brother's property unjustly. (Using translation from Abū Dāʾūd 3470)
قَالَ رَسُولُ اللَّهِ ﷺ «إِنْ بِعْتَ مِنْ أَخِيكَ ثَمَرًا فَأَصَابَتْهُ جَائِحَةٌ فَلَا يَحِلُّ لَكَ أَنْ تَأْخُذَ مِنْهُ شَيْئًا بِمَ تَأْخُذُ مِنْ مَالِ أَخِيكَ بِغَيْرِ حَقٍّ؟ » قُلْتُ لِأَبِي الزُّبَيْرِ هَلْ سَمَّى لَكُمُ الْجَوَائِحَ؟ قَالَ لَا
ذِكْرُ الزَّجْرِ، عَنْ أَخْذِ الْمَرْءِ ثَمَنَ ثَمَرَتِهِ الْمَبِيعَةِ، إِذَا أَصَابَتْهَا جَائِحَةٌ بَعْدَ بَيْعِهِ إِيَّاهَا

٢٤۔١٠ باب الفلس
The Messenger of Allah ﷺ as saying: If anyone becomes insolvent and the man (i.e. creditor) finds his very property with him, he is more entitled to it than anyone else. (Using translation from Abū Dāʾūd 3519)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ أَفْلَسَ فَأَدْرَكَ رَجُلٌ مَالَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ مِنْ غَيْرِهِ
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ وَرَدَ فِي الْوَدَائِعِ دُونَ الْبِيَاعَاتِ
[Machine] On the authority of the Prophet ﷺ who said, "When a man buys a commodity, and then pays for it, while the commodity is still in front of him, he has more right to it than those who are at a distance (from it)."
عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا ابْتَاعَ الرَّجُلُ سِلْعَةً ثُمَّ فَلَّسَ وَهِيَ عِنْدَهُ بِعَيْنِهَا فَهُوَ أَحَقُّ بِهَا مِنَ الْغُرَمَاءِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِأَنَّ خِطَابَ هَذَا الْخَبَرِ وَرَدَّ لِلْبَائِعِ سِلْعَتَهُ دُونَ الْمُودِعِ إِيَّاهَا
[Machine] The translation of the given sentence into English is: "The Messenger of Allah (Peace be upon him) said, 'If a person becomes bankrupt and finds his merchandise in front of him, then he has more right to it than the creditors.'"
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «إِذَا أَفْلَسَ الرَّجُلُ فَوَجَدَ الْبَائِعُ سِلْعَتَهُ بِعَيْنِهَا فَهُوَ أَحَقُّ بِهَا دُونَ الْغُرَمَاءِ»
ذِكْرُ خَبَرٍ ثَالِثٍ يُصَرِّحُ بِأَنَّ الْمُشْتَرِيَ إِذَا أَفْلَسَ تَكُونُ عَيْنُ سِلْعَةِ الْبَائِعِ لَهُ دُونَ أَنْ يَكُونَ أُسْوَةَ، الْغُرَمَاءِ
[Machine] The Messenger of Allah ﷺ said: "When a man is executed and his merchandise is found in his possession, then the one who bought it rightfully owns it."
قَالَ رَسُولُ اللهِ ﷺ إِذَا أُعْدِمَ الرَّجُلُ فَوَجَدَ الْبَائِعُ مَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ
24.12 [Machine] The mention of debt in the books of Allah, the Most High, for the lender twice the reward of charity, one of them.
٢٤۔١٢ بَابُ الدُّيُونِ ذكر كتبة الله جل وعلا للمقرض مرتين الصدقة بإحداهما
[Machine] "The black (person), if you wish, I can delay (it) for you, for indeed there were rights upon us in this payment." So the merchant said to him, "You are not doing (it)," so the black (person) paid him five hundred dirhams. Then, when he received it, the merchant said to him, "Abandon it, take it," so the black (person) said to him, "I asked you for this and you refused." So the merchant said to him, "Indeed, I have heard you speaking to us about Abdullah bin Mas'ood, that the Prophet ﷺ used to say, 'Whoever loans to Allah twice, he will have the reward of one (loan) if he gives it in charity.'"
الْأَسْوَدُ إِنْ شِئْتَ أَخَّرْتُ عَنْكَ فَإِنَّهُ قَدْ كَانَتْ عَلَيْنَا حُقُوقٌ فِي هَذَا الْعَطَاءِ فَقَالَ لَهُ التَّاجِرُ لَسْتَ فَاعِلًا فَنَقَدَهُ الْأَسْوَدُ خَمْسَ مِائَةِ دِرْهَمٍ حَتَّى إِذَا قَبَضَهَا قَالَ لَهُ التَّاجِرُ دُونَكَهَا فَخُذْ بِهَا فَقَالَ لَهُ الْأَسْوَدُ قَدْ سَأَلْتُكَ هَذَا فَأَبَيْتَ فَقَالَ لَهُ التَّاجِرُ إِنِّي سَمِعْتُكَ تُحَدِّثُنَا عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ أَنَّ نَبِيَّ اللَّهِ ﷺ كَانَ يَقُولُ «مَنْ أَقْرَضَ اللَّهَ مَرَّتَيْنِ كَانَ لَهُ مِثْلُ أَجْرِ أَحَدِهِمَا لَوْ تَصَدَّقَ بِهِ»
ذِكْرُ قَضَاءِ اللَّهِ جَلَّ وَعَلَا فِي الدُّنْيَا دَيْنَ مَنْ نَوَى الْأَدَاءَ فِيهِ
"Maimunah used to take out loans frequently, and some of her family criticized her and denounced her for that. She said: 'I will not stop taking loans, for I heard my close friend and my beloved say: "There is no one who takes out a loans, and Allah knows that he intends to pay it back, but Allah will pay it back for him in this world." (Using translation from Nasāʾī 4686)
لَهَا أَهْلُهَا فِي ذَلِكَ وَوَجَدُوا عَلَيْهَا فَقَالَتْ لَا أَتْرُكُ وَقَدْ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَا مِنْ أَحَدٍ يَدَّانُ دَيْنًا يَعْلَمُ اللَّهُ أَنَّهُ يُرِيدُ قَضَاءَهُ إِلَّا أَدَّاهُ اللَّهُ عَنْهُ فِي الدُّنْيَا»
ذِكْرُ رَجَاءِ تَجَاوَزِ اللَّهِ جَلَّ وَعَلَا فِي الْقِيَامَةِ عَنِ الْمُيَسِّرِ عَلَى الْمُعْسِرِينَ فِي الدُّنْيَا
The prophet said: "A man used to lend to people, but if he realized that someone was going through hardship, he would say to his slave: 'Let him off, perhaps Allah, the Most High, will let us off.' And when he met Allah, He let him off." (Using translation from Nasāʾī 4695)
أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ كَانَ رَسُولُ اللَّهِ ﷺ يَقُولُ «كَانَ رَجُلٌ تَاجِرٌ يُدَايِنُ النَّاسَ فَإِذَا رَأَى إِعْسَارَ الْمُعْسِرِ» قَالَ لِفَتَاهُ تَجَاوَزْ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا قَالَ رَسُولُ اللَّهِ ﷺ «فَلَقِيَ اللَّهَ فَتَجَاوَزَ عَنْهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الرَّجُلَ لَمْ يَعْمَلْ خَيْرًا قَطُّ إِلَّا التَّجَاوزَ عَنِ الْمُعْسِرِينَ
"There was a man who never did any good deed, but he used to lend to people and he would say to this messenger: "Take what can be paid easily and leave what is difficult, let them off, and perhaps Allah, the Mighty and Sublime, said to him: 'Did you ever do any good did? He said: No, but I had a slave and I used to lend to people. When I sent him to collect the debts I said to him: Take what can he paid easily and leave what is difficult; let them off, and perhaps Allah will let us off. Allah, the Most High, said: 'I have let you off."' (Using translation from Nasāʾī 4694)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «إِنَّ رَجُلًا لَمْ يَعْمَلْ خَيْرًا قَطُّ وَكَانَ يُدَاينُ النَّاسُ» فَيَقُولُ لِرَسُولِهِ خُذْ مَا تَيَسَّرَ وَاتْرُكْ مَا تَعَسَّرَ وَتَجَاوَزْ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا قَالَ فَلَمَّا هَلَكَ قَالَ اللَّهُ هَلْ عَمِلْتَ خَيْرًا قَطُّ؟ قَالَ لَا إِلَّا أَنَّهُ كَانَ لِي غُلَامٌ وَكُنْتُ أُدَاينُ النَّاسَ فَإِذَا بَعَثْتُهُ لِيَتَقَاضَى قُلْتُ لَهُ خُذْ مَا تَيَسَّرَ وَاتْرُكْ مَا تَعَسَّرَ وَتَجَاوَزْ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا قَالَ اللَّهُ تَعَالَى قَدْ قَالَ تَجَاوَزْتُ عَنْكَ
ذِكْرُ إِظْلَالِ اللَّهِ جَلَّ وَعَلَا فِي الْقِيَامَةِ فِي ظِلِّهِ مَنْ أَنْظَرَ مُعْسِرًا أَوْ وَضَعَ لَهُ
[Machine] I and my father went out to seek knowledge in this neighborhood from the Ansar before they perish. The first person we met was Abu Al-Yasir, the companion of the Messenger of Allah ﷺ , and with him was his son. Abu Al-Yasir was wearing a cloak, as were his guests, and his son was also wearing a cloak. My father said to him, "I see anger on your face." He replied, "Indeed, I had some wealth that belonged to so-and-so, the thief. So I went to his family and asked them, 'Is it accepted?' They said, 'No.' Then his son came out to me, so I asked him, 'Where is your father?' He said, 'He heard your voice and came out. I told him to come out, for I knew where you were.' Then he came out and I asked him, 'What made you hide?' He said, 'I swear by Allah, I wanted to talk to you and not lie to you. I was afraid that if I spoke to you, I would then lie to you and break my promise. And you were the companion of the Messenger of Allah ﷺ , and by Allah, I was in a difficult situation.' I asked, 'By Allah?' He replied, 'By Allah.' I asked again, 'By Allah?' He replied, 'By Allah.' Then he reached for his scriptures and erased them. He said, 'If you find a just cause, then judge accordingly. Otherwise, you are in a permissible state. I bear witness with my eyes to this oath, and my heart confirms it.' He pointed to the veins on his chest and said, 'I heard the Messenger of Allah ﷺ saying, "Whoever protects the rights of a debtor in financial difficulty, Allah will protect him in His shade."'
خَرَجْتُ أَنَا وَأَبِي نَطْلُبُ الْعِلْمَ فِي هَذَا الْحَيِّ مِنَ الْأَنْصَارِ قَبْلَ أَنْ يَهْلِكُوا فَكَانَ أَوَّلَ مَنْ لَقِيَنَا أَبُو الْيَسَرِ صَاحِبُ رَسُولِ اللَّهِ ﷺ وَمَعَهُ غُلَامٌ لَهُ وَعَلَى أَبِي الْيَسَرِ بُرْدَةٌ وَمَعَافِرِيٌّ وَعَلَى غُلَامِهِ بُرْدَةٌ وَمَعَافِرِيٌّ فَقَالَ لَهُ أَبِي إِنِّي أَرَى فِي وَجْهِكَ شَيْئًا مِنْ غَضَبٍ قَالَ أَجَلْ كَانَ لِي عَلَى فُلَانِ بْنِ فُلَانٍ الْحَرَامِيِّ مَالٌ فَأَتَيْتُ أَهْلَهُ فَقُلْتُ أَثَمَّتْ؟ قَالُوا لَا فَخَرَجَ عَلَيَّ ابْنٌ لَهُ فَقُلْتُ أَيْنَ أَبُوكَ؟ فَقَالَ سَمِعَ صَوْتَكَ فَدَخَلَ فَقُلْتُ اخْرُجْ إِلَيَّ فَقَدْ عَلِمْتُ أَيْنَ أَنْتَ فَخَرَجَ عَلَيَّ فَقُلْتُ مَا حَمَلَكَ عَلَى أَنِ اخْتَبَأْتَ؟ قَالَ أَنَا وَاللَّهِ أُحَدِّثُكَ ثُمَّ لَا أَكْذِبُكَ خَشِيتُ وَاللَّهِ أَنْ أُحَدِّثَكَ فَأَكْذِبَكَ وَأَعِدَكَ فَأُخْلِفَكَ وَكُنْتَ صَاحِبَ رَسُولِ اللَّهِ ﷺ وَكُنْتُ وَاللَّهِ مُعْسِرًا قَالَ قُلْتُ آللَّهِ؟ قَالَ اللَّهِ قَالَ قُلْتُ آللَّهِ؟ قَالَ اللَّهِ قَالَ فَقَالَ بِصَحِيفَتِهِ فَمَحَاهَا وَقَالَ إِنْ وَجَدْتَ قَضَاءً فَاقْضِ وَإِلَّا فَأَنْتَ فِي حِلٍّ فَأَشْهَدُ بَصُرَ عَيْنَايَ هَاتَانِ وَوَعَاهُ قَلْبِي وَأَشَارَ إِلَى نِيَاطِ قَلْبِهِ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ أَنْظَرَ مُعْسِرًا أَوْ وَضَعَ لَهُ أَظَلَّهُ اللَّهُ فِي ظِلِّهِ»
ذِكْرُ تَيْسِيرِ اللَّهِ جَلَّ وَعَلَا الْأُمُورَ فِي الدُّنْيَا وَالْآخِرَةِ عَلَى الْمُيَسِّرِ عَلَى الْمُعْسِرِينَ
Whoever is easy with (a debtor) who is in difficulty, Allah will be easy with him in this world and in the Hereafter.” (Using translation from Ibn Mājah 2417)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ يَسَّرَ عَلَى مُعْسِرٍ يَسَّرَ اللَّهُ عَلَيْهِ فِي الدُّنْيَا وَالْآخِرَةِ»
ذِكْرُ رَجَاءِ تَجَاوُزِ اللَّهِ جَلَّ وَعَلَا عَمَّنْ تَجَاوَزَ عَنِ الْمُعْسِرِ
[Machine] I heard the Messenger of Allah ﷺ saying, "There was a man who used to lend money to people. When a debtor faced financial difficulty, he would say to his servant, 'Let him go, maybe Allah will forgive us.' So, when he met Allah, He forgave him."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «كَانَ رَجُلٌ يُدَايِنُ النَّاسَ فَإِذَا أَعْسَرَ الْمُعْسِرُ قَالَ لِفَتَاهُ تَجَاوَزْ عَنْهُ لَعَلَّ اللَّهَ يَتَجَاوَزُ عَنَّا فَلَقِيَ اللَّهَ فَتَجَاوَزَ عَنْهُ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الرَّجُلَ لَمْ تُوجَدْ لَهُ حَسَنَةٌ خَلَا تَجَاوُزَهُ عَنِ الْمُعْسِرِينَ
That the Messenger of Allah ﷺ said: "A man among those before you was called to reckon and nothing good was found with him. Except that he was a wealthy man so he used to mix with the pople and he would tell his servant to be lenient with the insolvent. So Allah, Mighty and Sublime is He, said: 'We are more worthy of that than him, so be lenient with him.'" (Using translation from Tirmidhī 1307)
قَالَ رَسُولُ اللَّهِ ﷺ «حُوسِبَ رَجُلٌ مِمَّنْ كَانَ قَبْلَكُمْ فَلَمْ يُوجَدْ لَهُ مِنَ الْخَيْرِ شَيْءٌ إِلَّا أَنَّهُ كَانَ رَجُلًا مُوسِرًا فَكَانَ يُخَالِطُ النَّاسَ فَيَقُولُ لِغُلَامِهِ تَجَاوَزْ عَنِ الْمُعْسِرِ فَقَالَ اللَّهُ جَلَّ وَعَلَا لِمَلَائِكَتِهِ نَحْنُ أَحَقُّ بِذَلِكَ تَجَاوَزُوا عَنْهُ»
ذِكْرُ مَا يُسْتَحَبُّ لِمَنْ تَنَازَعَ هُوَ وَأَخُوهُ الْمُسْلِمُ فِي دَيْنٍ أَنْ يَضَعَ الْمُوسِرُ بَعْضَ دَيْنِهِ لِلْمُعْسِرِ
"Ka'b!" He said: "At your service, Messenger of Allah." Thereupon he made a gesture with is hand indicating: Remit half the debt due to you. Ka'b said: "I shall do so, Messenger of Allah." The Prophet ﷺ then said: "Get up and discharge" (Using translation from Abū Dāʾūd 3595)
أَنَّهُ تَقَاضَى ابْنَ أَبِي حَدْرَدٍ دَيْنًا كَانَ لَهُ عَلَيْهِ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ فِي الْمَسْجِدِ فَارْتَفَعَتْ أَصْوَاتُهُمَا حَتَّى سَمِعَهَا رَسُولُ اللَّهِ ﷺ وَهُوَ فِي بَيْتِهِ فَخَرَجَ إِلَيْهِمَا رَسُولُ اللَّهِ ﷺ حَتَّى كَشَفَ سِجْفَ حُجْرَتِهِ وَنَادَى كَعْبَ بْنَ مَالِكٍ «يَا كَعْبُ بْنَ مَالِكٍ» قَالَ لَبَّيْكَ يَا رَسُولَ اللَّهِ فَأَشَارَ بِيَدِهِ أَنْ ضَعِ الشَّطْرَ مِنْ دَيْنِكَ قَالَ كَعْبٌ قَدْ فَعَلْتُ يَا رَسُولَ اللَّهِ قَالَ «قُمْ فَاقْضِهِ»
