ذِكْرُ الْبَيَانِ بِأَنَّ مُشْتَرِيَ النَّخْلَةِ بَعْدَمَا أُبِّرَتْ لَا يَكُونُ لَهُ مِنْ ثَمَرِهَا شَيْءٌ إِذَا لَمْ يَتَقَدَّمْهُ الشَّرْطُ

[Machine] The Messenger of Allah ﷺ said: "Whoever buys a palm tree after it has been pollinated and does not stipulate its fruit, then he has nothing. And whoever buys a slave and does not stipulate his money, then he has nothing."  

ابن حبّان:٤٩٢١أَخْبَرَنَا أَبُو يَعْلَى حَدَّثَنَا عَلِيُّ بْنُ الْجَعْدِ حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ عَنِ ابْنِ شِهَابٍ عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ عَنِ ابْنِ عُمَرَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ اشْتَرَى نَخْلًا بَعْدَمَا أُبِّرَتْ وَلَمْ يَشْتَرِطْ ثَمَرَهَا فَلَا شَيْءَ لَهُ وَمَنِ اشْتَرَى عَبْدًا وَلَمْ يَشْتَرِطْ مَالَهُ فَلَا شَيْءَ لَهُ»
