٢١۔ كِتَابُ النِّكَاحِ ص ٥
Abdullah was asked about a man who married a woman and died without having consummated the marriage with her, nor stipulating the dowry. Abdullah said: “The dowry is hers, and the inheritance is hers and she has to observe the waiting period.” Ma'qil bin Sinan Al-Ashja'i said: “I saw the Messenger of Allah ﷺ pass a similar ruling concerning Birwa' bint Washiq.” (Sahih) Another chain from 'Alqamah, from Abdullah, with similar wording. It was narrated from Masruq that: Abdullah was asked about a man who married a woman and died without having consummated the marriage with her, nor stipulating the dowry. Abdullah said: “The dowry is hers, and the inheritance is hers and she has to observe the waiting period.” Ma'qil bin Sinan Al-Ashja'i said: “I saw the Messenger of Allah pass a similar ruling concerning Birwa' bint Washiq.” (Sahih) Another chain from 'Alqamah, from Abdullah, with similar wording. عَنْ عَبْدِ اللهِ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا قَالَ لَهَا الصَّدَاقُ وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ فَقَالَ مَعْقِلُ بْنُ سِنَانٍ فَقَدْ سَمِعْتُ النَّبِيَّ ﷺ «قَضَى بِهِ فِي بِرْوَعِ بِنْتِ وَاشِقٍ» 5493 أَخْبَرَنَا إِسْحَاقُ بْنُ مَنْصُورٍ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ عَنْ سُفْيَانَ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ عَنْ عَبْدِ اللهِ مِثْلَهُ
"A man among us married a woman, but he did not name a dowry for her, and he did not have intercourse with her before he died." 'Abdullah said: 'Since I left the Messenger of Allah I have never been asked a more difficult question than this. Go to someone else.' They kept coming to him for a month, then at the end of that they said: 'Who shall we ask if we do not ask you? You are one of the most prominent Companions of Muhammad in this land and we cannot find anyone else.' He said: 'I will say what I think, and if it is correct then it is from Allah alone, with no partner, and if it is wrong then it is from me and from the Shaitan, and Allah and His Messenger have nothing to do with it. I think she should be given a dowry like that of her peers and no less, with no injustice, and she may inherit from him, and she has to observe the 'Iddah, four months and ten days.'" He said: "And that was heard by some people from Ashja', who stood up and said: 'We bear witness that you have passed the same judgment as the Messenger of Allah did concerning a woman from among us who was called Birwa' bint Washiq.'" He said: "Abdullah was never seen looking so happy as he did on that day, except with having accepted Islam." (Using translation from Nasāʾī 3358)
أَنَّهُ أَتَاهُ قَوْمٌ فَقَالُوا إِنَّ رَجُلًا مِنَّا تَزَوَّجَ امْرَأَةً وَلَمْ يَفْرِضْ لَهَا صَدَاقًا وَلَمْ يَجْمَعْهَا إِلَيْهِ حَتَّى مَاتَ فَقَالَ عَبْدُ اللهِ مَا سُئِلْتُ مُنْذُ فَارَقْتُ رَسُولَ اللهِ ﷺ أَشَدَّ عَلَيَّ مِنْ هَذِهِ فَأْتُوا غَيْرِي فَاخْتَلَفُوا إِلَيْهِ فِيهَا شَهْرًا ثُمَّ قَالُوا لَهُ فِي آخِرِ ذَلِكَ مَنْ نَسْأَلُ إِنْ لَمْ نَسْأَلْكَ وَأَنْتَ مِنْ جُلَّةِ أَصْحَابِ مُحَمَّدٍ ﷺ بِهَذَا الْبَلَدِ وَلَا نَجْدُ غَيْرَكَ؟ قَالَ سَأَقُولُ فِيهَا بِجَهْدِ رَأْيِي فَإِنْ كَانَ صَوَابًا فَمِنَ اللهِ وَحْدَهُ لَا شَرِيكَ لَهُ وَإِنْ كَانَ خَطَأً فَمِنِّي وَمِنَ الشَّيْطَانِ وَاللهُ وَرَسُولُهُ مِنْهُ بُرَآءٌ أَرَى أَنْ أَجْعَلَ لَهَا صَدَاقَ نِسَائِهَا لَا وَكْسَ وَلَا شَطَطَ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا قَالَ وَذَلِكَ بِسَمْعِ أُنَاسٍ مِنْ أَشْجَعَ فَقَامُوا فَقَالُوا نَشْهَدُ أَنَّكَ قَضَيْتَ بِمَا «قَضَى بِهِ رَسُولُ اللهِ ﷺ فِي امْرَأَةٍ مِنَّا يُقَالُ لَهَا بِرْوَعُ بِنْتُ وَاشِقٍ» قَالَ فَمَا رُئِيَ عَبْدُ اللهِ فَرِحَ فَرْحَةً يَوْمَئِذٍ إِلَّا بِإِسْلَامِهِ
[Machine] The man, if I hesitated for a month, I would not have asked anyone about her except you, and I did not find anyone asking about her except you. He said, "I will give my opinion about her. If I am right, then may Allah guide me, and I see her having a charity from her wealth without mockery or extravagance, and she must observe the waiting period." Al-Ashja'i said, "I witnessed the Prophet ﷺ deciding regarding her, and he was so delighted that his joy was unmatched."
الرَّجُلُ لَوْ تَرَدَّدَتُ شَهْرًا مَا سَأَلْتُ عَنْهَا أَحَدًا غَيْرَكَ وَمَا وَجَدْتُ أَحَدًا أَسْأَلُ عَنْهَا غَيْرَكَ فَقَالَ إِنِّي سَأَقُولُ فِيهَا بِرَأْيِي فَإِنْ أَصَبْتُ فَاللهُ ﷻ يُوَفِّقُنِي أَرَى لَهَا صَدُقَةَ نِسَائِهَا لَا وَكْسَ وَلَا شَطَطَ وَعَلَيْهَا الْعِدَّةُ فقَالَ الْأَشْجَعِيُّ شَهِدْتُ النَّبِيَّ ﷺ قَضَى بِهَا فَفَرِحَ فَرْحَةً مَا فَرِحَ مَثَلَهَا
[Machine] There was a woman whose husband died without consummating the marriage with her and without leaving her a dowry. Ibn Mas'ud said, "Ask the people, as there are many people and they may have more knowledge." The man replied, "By Allah, if I had waited a while, I would not have asked anyone but you." So Ibn Mas'ud repeated the question after a month, then he performed ablution, prayed two units of prayer, and said, "O Allah, whatever was correct in this matter is from You, and whatever was wrong is from me." Then he said, "I see that she should receive her dowry and inherit, and she is entitled to her waiting period." A brave man stood up and said, "The Messenger of Allah ﷺ ruled the same in the case of a woman among us called Barwah bint Washiq." Ibn Mas'ud asked, "Does anyone here have anyone with him?" So some people stood up and testified. [225] 5497 Ahmad bin Abdullah bin Al-Hakam Al-Basri narrated to us, from Muhammad bin Ja'far, from Sha'bah, from Sayyar, from Ash-Sha'bi who said, "There was a dispute between Abd-Allah and me concerning a man who died without leaving a dowry for his wife, so Abd-Allah mentioned this Hadith. At that time, Ma'qil bin Sinan stood up and said, 'The Messenger of Allah ﷺ ruled the same in the case of Barwah bint Washiq.'" [225] 5498 Ahmad bin Sulayman Ar-Ruhawi narrated to us, from Ya'la bin Ubaid, from Isma'il bin Abi Khalid, from 'Aamir, meaning Ash-Sha'bi, who said, "I went to Ibn Mas'ud when a man died and did not leave anything for his wife. He mentioned the Hadith and Ma'qil bin Sinan said, 'The Messenger of Allah ﷺ ruled the same in the case of Barwah bint Washiq.'"
عَنِ امْرَأَةٍ تُوُفِّيَ عَنْهَا زَوْجُهَا وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا فَقَالَ ابْنُ مَسْعُودٍ سَلِ النَّاسَ فَإِنَّ النَّاسَ كَثِيرٌ أَوْ كَمَا قَالَ فَقَالَ الرَّجُلُ وَاللهِ لَوْ مَكَثْتُ حَوْلًا مَا سَأَلْتُ غَيْرَكَ قَالَ فَرَّدَدَهُ ابْنُ مَسْعُودٍ شَهْرًا ثُمَّ قَامَ فَتَوَضَّأَ ثُمَّ رَكَعَ رَكْعَتَيْنِ ثُمَّ قَالَ اللهُمَّ مَا كَانَ مِنْ صَوَابٍ فَمِنْكَ وَمَا كَانَ مِنْ خَطَأٍ فَمِنِّي ثُمَّ قَالَ أَرَى لَهَا صَدَاقَ إِحْدَى نِسَائِهَا وَلَهَا الْمِيرَاثُ مَعَ ذَلِكَ وَعَلَيْهَا الْعِدَّةُ فَقَامَ رَجُلٌ مِنْ أَشْجَعَ فَقَالَ قَضَى فِينَا رَسُولُ اللهِ ﷺ بِمِثْلِ ذَلِكَ فِي امْرَأَةٍ مِنَّا يُقَالُ لَهَا بَرْوَعُ بِنْتُ وَاشِقٍ فَقَالَ ابْنُ مَسْعُودٍ هَلْ مَعَكَ أَحَدٌ؟ فَقَامَ أُنَاسٌ مِنْهُمْ فَشَهِدُوا [225] 5497 أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللهِ بْنِ الْحَكَمِ الْبَصْرِيُّ عَنْ مُحَمَّدِ بْنِ جَعْفَرٍ عَنْ شُعْبَةَ عَنْ سَيَّارٍ عَنِ الشَّعْبِيِّ قَالَ اخْتُلِفَ إِلَى عَبْدِ اللهِ شَهْرًا فِي رَجُلٍ مَاتَ وَلَمْ يَفْرِضْ لِامْرَأَتِهِ صَدَاقًا فَذَكَرَهُ وَفِيهِ فَقَامَ مَعْقِلُ بْنُ سِنَانٍ فَقَالَ قَضَى رَسُولُ اللهِ ﷺ فِي بَرْوَعَ بِنْتِ وَاشِقٍ مِثْلَ هَذَا 5498 أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ الرُّهَاوِيُّ عَنْ يَعْلَى هُوَ ابْنُ عُبَيْدٍ عَنْ إِسْمَاعِيلَ هُوَ ابْنُ أَبِي خَالِدٍ عَنْ عَامِرٍ يَعْنِي الشَّعْبِيَّ قَالَ أُتِيَ ابْنُ مَسْعُودٍ فِي امْرَأَةٍ مَاتَ زَوْجُهَا وَلَمْ يَفْرِضْ لَهَا وَسَاقَ الْحَدِيثَ قَالَ فَقَالَ مَعْقِلُ بْنُ سِنَانٍ قَضَى رَسُولُ اللهِ ﷺ فِي بَرْوَعَ بِنْتِ وَاشِقٍ مِثْلَ هَذَا
21.73 [Machine] The gift of a woman to a man without friendship, the dialogue that leads to marriage, and mentioning the differences in the words of the narrators of the news of Sahl ibn Sa'd in that.
٢١۔٧٣ بَابُ هِبَةِ الْمَرْأَةِ نَفْسَهَا لِرَجُلٍ بِغَيْرِ صَدَاقٍ، وَالْكَلَامِ الَّذِي يَنْعَقِدُ بِهِ النِّكَاحُ، وَذِكْرِ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ سَهْلِ بْنِ سَعْدٍ فِي ذَلِكَ
A woman came to the Messenger of Allah ﷺ and said: Messenger of Allah, I have offered myself to you. When she stood for a long time, a man got up and said: Messenger of Allah, marry her to me if you have no need for her. The Messenger of Allah ﷺ asked: Have you anything to give her as dower ? He replied: I have nothing by this lower garment of mine. The Messenger of Allah ﷺ said: If you give your lower garment, you will sit while you have no lower garment. So look for something else. He said: I do not find anything. He said: Look for something, even though it should be an iron ring. The man sought it but found nothing. The Messenger of Allah ﷺ said: Do you know anything from the Qur'an ? He said: Yes, I know surah so and so, which he named. The Messenger of Allah ﷺ said: I have given you her in marriage for the part of the Qur'an which you know. (Using translation from Abū Dāʾūd 2111)
أَنَّ رَسُولَ اللهِ ﷺ جَاءَتْهُ امْرَأَةٌ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي قَدْ وَهَبْتُ نَفْسِي لَكَ فَقَامَتْ قِيَامًا طَوِيلًا فَقَامَ رَجُلٌ فَقَالَ زَوِّجْنِيهَا إِنْ لَمْ يَكُنْ لَكَ بِهَا حَاجَةٌ قَالَ رَسُولُ اللهِ ﷺ «هَلْ عِنْدَكَ شَيْءٌ؟» قَالَ إِزَارِي هَذَا فقَالَ رَسُولُ اللهِ ﷺ «إِنْ أَعْطَيْتَهَا إِيَّاهُ جَلَسْتَ لَا إِزَارَ لَكَ فَالْتَمِسْ شَيْئًا» قَالَ مَا أَجِدُ شَيْئًا قَالَ «الْتَمِسْ وَلَوْ خَاتَمًا مِنْ حَدِيدٍ» فَالْتَمَسَ فَلَمْ يَجِدْ شَيْئًا فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «هَلْ مَعَكَ مِنَ الْقُرْآنِ شَيْءٌ؟» قَالَ نَعَمْ سُورَةُ كَذَا وَسُورَةُ كَذَا لِسُوَرٍ سَمَّاهَا قَالَ رَسُولُ اللهِ ﷺ «قَدْ زَوَّجْتُكَهَا عَلَى مَا مَعَكَ مِنَ الْقُرْآنِ»
"I was among the people with the Prophet when a woman stood up and said: 'O Messenger of Allah, she has offered herself in marriage to you, so see what you think of her.' He remained silent and the Prophet did not give any answer. Then she stood up (again) and said: 'O Messenger of Allah, she has offered herself in marriage to you, so see what you think of her.' A man stood up and said: 'Marry her to me, O Messenger of Allah!' He said: 'Do you have anything?' He said: 'No.' He said: 'Go and look, even if it is just an iron ring.' So he went and looked then he came and said: 'I could not find anything, not even an iron ring.' He said: 'Have you memorized anything of the Qur'an?' He said: 'Yes, Surah such-and-such and Surah such-and-such.' He said: 'I will marry you to her on the basis of what you have memorized of the Qur'an.'" (Using translation from Nasāʾī 3280)
سَمِعْتُ سَهْلَ بْنَ سَعْدٍ يَقُولُ إِنِّي لَفِي الْقَوْمِ عِنْدَ النَّبِيِّ ﷺ فَقَامَتِ امْرَأَةٌ فَقَالَتْ يَا رَسُولَ اللهِ إِنَّهَا قَدْ وَهَبَتْ نَفْسَهَا لَكَ فَرَ فِيهَا رَأْيَكَ فَسَكَتَ فَلَمْ يُجِبْهَا النَّبِيُّ ﷺ بِشَيْءٍ ثُمَّ قَامَتْ فَقَالَتْ يَا رَسُولَ اللهِ إِنَّهَا قَدْ وَهَبَتْ نَفْسَهَا لَكَ فَرَ فِيهَا رَأْيَكَ فَقَامَ رَجُلٌ فَقَالَ زَوِّجْنِيهَا يَا رَسُولَ اللهِ قَالَ «هَلْ مَعَكَ شَيْءٌ؟» قَالَ لَا قَالَ «اذْهَبْ فَاطْلُبْ شَيْئًا» فَذَهَبَ فَطَلَبَ ثُمَّ جَاءَ فَقَالَ يَا رَسُولَ اللهِ لَمْ أَجِدْ شَيْئًا قَالَ «اذْهَبْ فَاطْلُبْ وَلَوْ خَاتَمًا مِنْ حَدِيدٍ» فَذَهَبَ فَطَلَبَ ثُمَّ جَاءَ فَقَالَ لَمْ أَجِدْ شَيْئًا وَلَا خَاتَمًا مِنْ حَدِيدٍ قَالَ «هَلْ مَعَكَ مِنَ الْقُرْآنِ شَيْءٌ؟» قَالَ نَعَمْ مَعِي سُورَةُ كَذَا وَسُورَةُ كَذَا قَالَ «قَدْ أَنْكَحْتُكَهَا عَلَى مَا مَعَكَ مِنَ الْقُرْآنِ»
A lady came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ! I have come to you to offer myself to you." He raised his eyes and looked at her and then lowered his head. When the lady saw that he did not make any decision, she sat down. On that, a man from his companions got up and said. "O Allah's Apostle! If you are not in need of this woman, then marry her to me." Messenger of Allah ﷺ said, "Do you have anything to offer her?" He replied. "No, by Allah, O Messenger of Allah ﷺ!" The Prophet ﷺ said to him, "Go to your family and see if you can find something.' The man went and returned, saying, "No, by Allah, O Messenger of Allah ﷺ! I have not found anything." The Prophet ﷺ said, "Try to find something, even if it is an iron ring.'' He went again and returned, saying, "No, by Allah, O Messenger of Allah ﷺ, not even an iron ring, but I have this waist sheet of mine." The man had no upper garment, so he intended to give her, half his waist sheet. So Messenger of Allah ﷺ said, ''What would she do with your waist sheet? If you wear it, she will have nothing of it over her body, and if she wears it, you will have nothing over your body." So that man sat for a long period and then got up, and Messenger of Allah ﷺ saw him going away, so he ordered somebody to call him. When he came, the Prophet ﷺ asked him, " How much of the Qur'an do you know?" He replied, "I know such Surat and such Surat and such Surat," and went on counting it, The Prophet ﷺ asked him, "Can you recite it by heart?" he replied, "Yes." The Prophet ﷺ said, "Go, I have married this lady to you for the amount of the Qur'an you know by heart." (Using translation from Bukhārī 5030)
أَنَّ امْرَأَةً جَاءَتْ رَسُولَ اللهِ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ جِئْتُ لِأَهَبَ نَفْسِي لَكَ فَنَظَرَ إِلَيْهَا رَسُولُ اللهِ ﷺ فَصَعَّدَ النَّظَرَ إِلَيْهَا وَصَوَّبَهُ ثُمَّ طَأْطَأَ رَأْسَهُ فَلَمَّا رَأَتِ الْمَرْأَةُ أَنَّهُ لَمْ يَقْضِ فِيهَا شَيْئًا جَلَسَتْ فَقَامَ رَجُلٌ مِنْ أَصْحَابِهِ فَقَالَ أَيْ رَسُولَ اللهِ ﷺ إِنْ لَمْ يَكُنْ لَكَ بِهَا حَاجَةٌ فَزَوِّجْنِيهَا فَقَالَ «هَلْ عِنْدَكَ شَيْءٌ؟» قَالَ لَا وَاللهِ مَا وَجَدْتُ شَيْئًا قَالَ «انْظُرْ وَلَوْ خَاتَمًا مِنْ حَدِيدٍ» فَذَهَبَ ثُمَّ رَجَعَ فَقَالَ لَا وَاللهِ يَا رَسُولَ اللهِ وَلَا خَاتَمٌ مِنْ حَدِيدٍ وَلَكِنْ هَذَا إِزَارِي قَالَ سَهْلٌ مَا لَهُ رِدَاءٌ قَالَ رَسُولُ اللهِ ﷺ «مَا تَصْنَعُ بِإِزَارِكَ إِنْ لَبِسْتَهُ لَمْ يَكُنْ عَلَيْهَا فِيهِ شَيْءٌ وَإِنْ لَبِسَتْهُ لَمْ يَكُنْ عَلَيْكَ فِيهِ شَيْءٌ» فَجَلَسَ الرَّجُلُ حَتَّى طَالَ مَجْلِسُهُ ثُمَّ قَامَ فَرَآهُ رَسُولُ اللهِ ﷺ مُوَلِّيًا فَأَمَرَ بِهِ فَدُعِيَ فَلَمَّا جَاءَ قَالَ «مَاذَا مَعَكَ مِنَ الْقُرْآنِ؟» قَالَ مَعِي سُورَةُ كَذَا وَسُورَةُ كَذَا عَدَّدَهَا قَالَ «تَقْرَأُهُنَّ عَنْ ظَهْرِ قَلْبِكَ؟» قَالَ نَعَمْ قَالَ «فَقَدْ مَلَّكْتُكَهَا بِمَا مَعَكَ مِنَ الْقُرْآنِ»
21.74 [Machine] What is recommended to say during marriage, and mention of the difference of opinion regarding the narration of Abdullah concerning Abu Ishaq in it.
٢١۔٧٤ مَا يُسْتَحَبُّ مِنَ الْكَلَامِ عِنْدَ النِّكَاحِ، وَذِكْرُ الِاخْتِلَافِ عَلَى أَبِي إِسْحَاقَ فِي حَدِيثِ عَبْدِ اللهِ فِيهِ
"The Messenger of Allah taught us the Tashahhud for Salah and the Tashahhud upon Al-Hajah. He said: 'The Tashahhud upon the occasion of marriage is: Alhamdu lillahi nasta'inahu wa nastaghfiruhu, wa na'udhu billahi min shururi anfusina, man yahdih Illahu fala mudilla lahu wa man yudlil Illahu fala hadiya lahu, wa ashhadu an la ilaha illallah, wa ashhadu anna Muhammadan 'abduhu wa rasuluhu (Praise be to Allah, we seek His help and His forgiveness. We seek refuge with Allah from the evil of our own souls. Whomsoever Allah guides will never be led astray, and whomsoever Allah leaves astray, no one can guide. I bear witness that there is none worthy of worship but Allah, and I bear witness that Muhammad is His slave and Messenger).' Then he recited three Verses." (Using translation from Nasāʾī 3277)
عَلَّمَنَا رَسُولُ اللهِ ﷺ التَّشَهُّدَ فِي الصَّلَاةِ وَالتَّشَهُّدَ فِي الْحَاجَةِ قَالَ التَّشَهُّدُ فِي الْحَاجَةِ أَنَّ الْحَمْدَ لِلَّهِ نَسْتَعِينُهُ وَنَسْتَغْفِرُهُ وَنَعُوذُ بِاللهِ مِنْ شُرُرِ أَنْفُسِنَا مَنْ يَهْدِهِ اللهُ فَلَا مُضِلَّ لَهُ وَمَنْ يُضْلِلِ اللهُ فَلَا هَادِيَ لَهُ وَأَشْهَدُ أَنَّ لَا إِلَهَ إِلَّا اللهُ وَأَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ وَيَقْرَأُ ثَلَاثَ آيَاتٍ خَالَفَهُ شُعْبَةُ بْنُ الْحَجَّاجِ
"The Prophet ﷺ taught us Khutbat Al-Hajah: Alhamduu lillahi nasta'inuhu wa nastagfiruhu, wa na'udhu billahi min shururi anfusina wa sayi'ati a'malina. Man yahdihillahu fala mudilla lahu wa man yudlil fala hadiya lahu. Wa ashhadu an la ilaha illallahu wa ashhadu anna Muhammadan 'abduhu wa rasuluhu. (Praise be to Allah, we seek His help and His forgiveness. We seek refuge in Allah from the evil of our own souls and from our bad deeds. Whomsoever Allah guides will never be led astray,and whomsoever Allah leaves astray, no one can guide. I bear witness that there is none worthy of worship except Allah, and I bear witness that Muhammad is His slave and Messenger.) Then he recited the following three verses: O you who believe! Fear Allah as He should be feared, and die not except as Muslims; O Mankind! Be dutiful to your Lord, Who created you from a single person, and from him he created his wife, and from them he created many men and women, and fear Allah through Whom you demand your mutual (rights), and (do not cut the relations of) the wombs (kinship). Surely, Allah is Ever an All-Watcher over you); O you who believe! Keep your duty to Allah and fear Him, and speak (always) the truth.)" (Using translation from Nasāʾī 1404)
عَنِ النَّبِيِّ ﷺ قَالَ عَلَّمَهُمْ خُطْبَةَ الْحَاجَةِ الْحَمْدُ لِلَّهِ نَسْتَعِينُهُ وَنَسْتَغْفِرُهُ وَنَعُوذُ بِاللهِ مِنْ شُرُورِ أَنْفُسِنَا مَنْ يَهْدِهِ اللهُ فَلَا مُضِلَّ لَهُ وَمَنْ يُضْلِلْ فَلَا هَادِيَ لَهُ وَأَشْهَدُ أَنَّ لَا إِلَهَ إِلَّا اللهُ وَأَشْهَدُ أَنَّ مُحَمَّدًا عَبْدُهُ وَرَسُولُهُ ثُمَّ يُقْرَأُ بَعْدَ ذَلِكَ ثَلَاثَ آيَاتٍ {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللهَ حَقَّ تُقَاتِهِ وَلَا تَمُوتُنَّ إِلَّا وَأَنْتُمْ مُسْلِمُونَ} [آل عمران 102] {يَا أَيُّهَا النَّاسُ اتَّقُوا رَبَّكُمُ الَّذِي خَلْقَكُمْ مِنْ نَفْسٍ وَاحِدَةٍ وَخَلَقَ مِنْهَا زَوْجَهَا وَبَثَّ مِنْهُمَا رِجَالًا كَثِيرًا وَنِسَاءً} [النساء 1] {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللهَ وَقُولُوا قَوْلًا سَدِيدًا} [الأحزاب 70] ثُمَّ يَذْكُرُ حَاجَتَهُ
"Innal-hamda lillahi nahmaduhu wa nasta'inahu, man yahdih Illahu fala mudilla lahu wa man yudlil Illahu fala hadiya lahu, wa ashhadu an la ilaha illallahu (wahdahu lasharika lahu) wa ashhadu anna Muhammadan 'abdahu wa rasuluhu. Amma ba'd (Praise be to Allah, we seek His help. Whomsoever Allah guides will never be led astray, and whomsoever Allah leaves astray, no one can guide. I bear witness that there is none worthy of worship but Allah (alone with no partners) and I bear witness that Muhammad is His slave and Messenger. To proceed)." (Using translation from Nasāʾī 3278)

٢١۔٧٥ مَا يُكْرَهُ مِنَ الْخُطْبَةِ
"Two men recited a Tashahhud before the Prophet and one of them said: 'Whoever obeys Allah and His Messenger has been guided aright and whoever disobeys them has gone astray.' The Messenger of Allah said: 'What a bad speaker you are!'" (Using translation from Nasāʾī 3279)

٢١۔٧٦ الشُّرُوطُ فِي النِّكَاحِ
‘Uqbah bin ‘Amir reported the Apostle of Allaah ﷺ as saying “The condition worthier to be fulfilled by you is the one by which you made the private parts (of your wife) lawful (for you). (Using translation from Abū Dāʾūd 2139)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «إِنَّ أَحَقَّ الشُّرُوطِ أَنْ تُوفُوا بِهِ مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ»
A woman who marries on a dower or a reward or a promise before the solemnisation of marriage is entitled to it; and whatever is fixed for her after solemnisation of marriage belongs to whom it is given. A man is more entitled to receive a thing given as a gift on account of his daughter or sister (than other kinds of gifts). (Using translation from Abū Dāʾūd 2129)
أَنَّ النَّبِيَّ ﷺ قَالَ «أَيُّمَا امْرَأَةٍ أُنْكِحَتْ عَلَى صَدَاقٍ أَوْ جِبَاءٍ أَوْ عِدَّةٍ قَبْلَ عِصْمَةِ النِّكَاحِ فَهُوَ لَهَا وَمَا كَانَ بَعْدَ عِصْمَةِ النِّكَاحِ فَهُوَ لِمَنْ أُعْطِيَهُ وَأَحَقُّ مَا أُكْرِمَ عَلَيْهِ الرَّجُلُ ابْنَتُهُ أَوْ أُخْتُهُ»

٢١۔٧٧ النِّكَاحُ الَّذِي يُحِلُّ الْمُطَلَّقَةَ ثَلَاثًا لِمُطَلِّقِهَا
"The wife of Rifa'ah came to the Messenger of Allah and said: 'Rifa'ah divorced me and made it irrevocable. Then I married 'Abdur-Rahman bin Az-Zubair, and what he has is like the fringe of a garment.' The Messenger of Allah smiled and said: 'Do you want to go back to Rifa'ah? No, not unitl he ('Abdur-Rahman) tastes your sweetness and you taste his sweetness.'" (Using translation from Nasāʾī 3283)
جَاءَتِ امْرَأَةُ رِفَاعَةَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ إِنَّ رِفَاعَةَ طَلَّقَنِي فَأَبَتَّ طَلَاقِي وَإِنِّي تَزَوَّجْتُ بَعْدَهُ عَبْدَ الرَّحْمَنِ بْنَ الزُّبَيْرِ وَمَا مَعَهُ إِلَّا مِثْلُ هُدْبَةِ الثَّوْبِ فَضَحِكَ رَسُولُ اللهِ ﷺ وَقَالَ «أَتُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ لَا حَتَّى يَذُوقَ عُسَيْلَتَكِ وَتَذُوقِي عُسَيْلَتَهُ»
21.78 [Machine] Facilitation in abstaining from testimony on marriage
٢١۔٧٨ التَّسْهِيلُ فِي تَرْكِ الْإِشْهَادِ عَلَى النِّكَاحِ
The Prophet ﷺ stayed for three days between Khaibar and Medina, and there he consummated his marriage to Safiyya bint Huyai. I invited the Muslims to the wedding banquet in which neither meat nor bread was offered. He ordered for leather dining-sheets to be spread, and dates, dried yoghurt and butter were laid on it, and that was the Prophet's wedding banquet. The Muslims wondered, "Is she (Saffiyya) considered as his wife or his slave girl?" Then they said, "If he orders her to veil herself, she will be one of the mothers of the Believers; but if he does not order her to veil herself, she will be a slave girl. So when the Prophet ﷺ proceeded from there, he spared her a space behind him (on his shecamel) and put a screening veil between her and the people. (Using translation from Bukhārī 5085)
أَقَامَ النَّبِيُّ ﷺ بَيْنَ خَيْبَرَ وَالْمَدِينَةِ ثَلَاثًا يَبْنِي بِصَفِيَّةَ بِنْتِ حُيَيٍّ فَدَعَوْتُ الْمُسْلِمِينَ إِلَى وَلِيمَةٍ فَمَا كَانَ فِيهَا مِنْ خُبْزٍ وَلَا لَحْمٍ وَأُمِرَ بِالْأَنْطَاعِ فَأُلْقِيَ عَلَيْهَا مِنَ التَّمْرِ وَالْأَقِطِ وَالسَّمْنِ فَكَانَتْ وَلِيمَتَهُ فَقَالَ الْمُسْلِمُونَ إِحْدَى أُمَّهَاتِ الْمُؤْمِنِينَ أَوْ مِمَّا مَلَكَتْ يَمِينُهُ فَقَالَ إِنْ حَجَبَهَا فَهِيَ مِنْ أُمَّهَاتِ الْمُؤْمِنِينَ وَإِنْ لَمْ يَحْجُبْهَا فَهِيَ مِمَّا مَلَكَتْ يَمِينُهُ فَلَمَّا ارْتَحَلَ وَطَّأَ لَهَا خَلْفَهُ وَمَدَّ الْحِجَابَ بَيْنَهَا وَبَيْنَ النَّاسِ
21.79 [Machine] The marriage of the permissible and the one permissible for him and what is in it of the provocation.
٢١۔٧٩ نِكَاحُ الْمُحِلِّ، وَالْمُحَلَّلِ لَهُ وَمَا فِيهِ مِنَ التَّغْلِيظِ
"The Messenger of Allah cursed the woman who tattoos and the one tattooed, the woman who fixed hair extensions and the one who had her hair get extended, the consumer of Riba and the one who pays it, and Al-Muhallil and Al-Muhallal Lahu." (Using translation from Nasāʾī 3416)
«لَعَنَ رَسُولُ اللهِ ﷺ الْوَاشِمَةَ وَالْمُوتَشِمَةَ وَالْوَاصِلَةَ وَالْمَوْصُولَةَ وَآكِلَ الرِّبَا وَمُوكِلَهُ وَالْمُحِلِّ وَالْمُحَلَّلَ لَهُ»
[Machine] "Eating riba (usury), and the one who consumes it, and the witness to it, and the writer of the contract, they are all cursed. Those who get tattoos, and those who tattoo others for beauty purposes, they are cursed, according to the words of Muhammad (PBUH), until the Day of Judgment. However, it doesn't mention the one who is forced to engage in riba or the one who is forced to consume it."
«آكِلُ الرِّبَا وَمُوكِلُهُ وَشَاهِدَاهُ وَكَاتِبُهُ إِذَا عَلِمُوا وَالْوَاشِمَةُ وَالْمُسْتَوْشِمَةُ لِلْحُسْنِ وَلَاوِي الصَّدَقَةِ مَلْعُونُونَ عَلَى لِسَانِ مُحَمَّدٍ ﷺ إِلَى يَوْمِ الْقِيَامَةِ» وَلَمْ يَذْكُرِ الْمُحِلِّ وَالْمُحَلَّلَ لَهُ
21.80 [Machine] The pleasure
٢١۔٨٠ الْمُتْعَةُ
[Machine] We were practicing it, meaning the pleasure of women, during the time of the Prophet Muhammad ﷺ , during the time of Abu Bakr, and at the beginning of Umar's caliphate, until Shu'bah disagreed with it and prohibited us from it.
حَدَّثَنَا أَبُو عَاصِمٍ يَعْنِي النَّبِيلَ قَالَ حَدَّثَنَا زَكَرِيَّا بْنُ إِسْحَاقَ قَالَ أَخْبَرَنَا عَمْرُو بْنُ دِينَارٍ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ «كُنَّا نَعْمَلُ بِهَا يَعْنِي مُتْعَةَ النِّسَاءِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَفِي زَمَانِ أَبِي بَكْرٍ وَصَدْرًا مِنْ خِلَافَةِ عُمَرَ حَتَّى نَهَانَا عَنْهَا خَالَفَهُ شُعْبَةُ»
There came to us the proclaimer of Messenger of Allah ﷺ and said: Messenger of Allah ﷺ has granted you permission to benefit yourselves, i. e. to contract temporary marriage with women. (Using translation from Muslim 1405a)
عَنْ جَابِرِ بْنِ عَبْدِ اللهِ وَسَلَمَةَ بْنِ الْأَكْوَعِ قَالَا خَرَجَ مُنَادِي رَسُولِ اللهِ ﷺ فَقَالَ إِنَّ «اللهَ قَدْ أَذِنَ لَكُمْ فَاسْتَمْتِعُوا يَعْنِي مُتْعَةَ النِّسَاءِ »
[Machine] "We did it during the time of the Messenger of Allah ﷺ ."

21.81 [Machine] Prohibition of pleasure.
٢١۔٨١ تَحْرِيمُ الْمُتْعَةِ
[Machine] I heard the Messenger of Allah ﷺ saying in his farewell pilgrimage: "Verily, Allah has prohibited indulgence, so do not come near it." He meant the indulgence of women. "And whoever is involved in any form of it, let him leave it."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِي حَجَّةِ الْوَدَاعِ «إِنَّ اللهَ قَدْ حَرَّمَ الْمُتْعَةَ فَلَا تَقْرَبُوهَا» يُرِيدُ مُتْعَةَ النِّسَاءِ «وَمَنْ كَانَ عَلَى شَيْءٍ مِنْهَا فَلْيَدَعْهَا»
[Machine] That the Prophet ﷺ "allowed temporary marriage, so a man spoke to a woman and afterwards I heard him strongly forbid it and say the most severe statements about it"
أَنَّ النَّبِيَّ ﷺ «رَخَّصَ فِي الْمُتْعَةِ فَكَلَّمَ رَجُلٌ امْرَأَةً فَلَمَّا كَانَ بَعْدُ سَمِعْتُهُ يَنْهَى عَنْهَا أَشَدَّ النَّهْيِ وَيَقُولُ فِيهَا أَشَدَّ الْقَوْلِ»
عَنِ النَّبِيِّ ﷺ أَنَّهُ «أَمْرَهُمْ بِالْمُتْعَةِ فَخَطَبْتُ أَنَا وَرَجُلٌ امْرَأَةً فَأَتَيْتُ النَّبِيَّ ﷺ بَعْدَ ثَلَاثَةٍ فَإِذَا هُوَ يُحَرِّمُهَا أَشَدَّ التَّحْرِيمِ وَيَنْهَى عَنْهَا أَشَدَّ النَّهْيِ»
Messenger of Allah ﷺ prohibited the contracting of temporary marriage and said: Behold, it is forbidden from this very day of yours to the Day of Resurrection, and he who has given something (as a dower) should not take it back. (Using translation from Muslim 1406l)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُتْعَةِ وَقَالَ «أَلَا إِنَّهَا حَرَامٌ مِنْ يَوْمِكُمْ هَذَا إِلَى يَوْمِ الْقِيَامَةِ وَمَنْ كَانَ أَعْطَى شَيْئًا فَلَا يَأْخُذْهُ»
Rabi' b. Sabra reported on the authority of his father that Messenger of Allah ﷺ forbade on the Day of Victory to contract temporary marriage with women. (Using translation from Muslim 1406i)
أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَنِ الْمُتْعَةِ يَوْمَ الْفَتْحِ»
Rabi' b. Sabra reported on the authority of his father that Messenger of Allah ﷺ forbade on the Day of Victory to contract temporary marriage with women. (Using translation from Muslim 1406i)
أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَامَ الْفَتْحِ عَنْ مُتْعَةِ النِّسَاءِ»
"You are confused, the Messenger of Allah forbade it, and the meat of domestic donkeys on the day of Khaibar." (Using translation from Nasāʾī 3365)
«إِنَّكَ تَائِهٌ نَهَى رَسُولُ اللهِ ﷺ عَنْهَا وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ يَوْمَ خَيْبَرَ»
The Messenger of Allah forbade on the Day of Khaibar, the temporary marriage of women and (he forbade) the flesh of domestic donkeys. (Using translation from Ibn Mājah 1961)
أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَنْ مُتْعَةِ النِّسَاءِ يَوْمَ خَيْبَرَ وَعَنْ لُحُومِ الْحُمُرِ الْإِنْسِيَّةِ»
"The Messenger of Allah on the Day of Khaibar forbade temporary marriage to women." (One of the narrators) Ibn Al-Muthanna said: "The Day of Hunain." He said: "This is what 'Abdul-Wahhab narrated to us from his book." (Using translation from Nasāʾī 3367)
«نَهَى رَسُولُ اللهِ ﷺ يَوْمَ خَيْبَرَ عَنْ مُتْعَةِ النِّسَاءِ» وَقَالَ ابْنُ الْمُثَنَّى يَوْمَ حُنَيْنٍ وَقَالَ هَكَذَا حَدَّثَنَا عَبْدُ الْوَهَّابِ مِنْ كِتَابِهِ
"The Messenger of Allah gave permission for Mut'ah, so I and another man went to a woman from Bani 'Amir and offered ourselves to her (for Mut'ah). She said: 'What will you give me?' I said: 'My Rida' (upper garment).' My companion also said: 'My Rida'.' My companion's Rida' was finer than mine, but I was younger than him. When she looked at my companion's Rida' she liked it, but when she looked at me, she liked me. Then she said: 'You and your Rida' are sufficient for me.' I stayed with her for three (days), then the Messenger of Allah said: 'Whoever has any of these women whom he married temporarily should let them go.'" (Using translation from Nasāʾī 3368)
أَنَّهُ قَالَ أَذِنَ رَسُولُ اللهِ ﷺ بِالْمُتْعَةِ فَانْطَلَقْتُ أَنَا وَرَجُلٌ إِلَى امْرَأَةٍ مِنْ بَنِي عَامِرٍ فَعَرَضْنَا عَلَيْهَا أَنْفُسَنَا فَقَالَتْ مَا تُعْطِينِي؟ فَقُلْتُ رِدَائِي وَقَالَ صَاحِبِي رِدَائِي وَكَانَ رِدَاءُ صَاحِبِي أَجْوَدَ مِنْ رِدَائِي وَكُنْتُ أَشَبَّ مِنْهُ فَإِذَا نَظَرَتْ إِلَى رِدَاءِ صَاحِبِي أَعْجَبَهَا وَإِذَا نَظَرَتْ إِلَيَّ أَعْجَبْتُهَا فَقَالَتْ أَنْتَ وَرِدَاؤُكَ يَكْفِينِي فَمَكَثْتُ مَعَهَا ثَلَاثًا ثُمَّ إِنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ كَانَ عِنْدَهُ مِنْ هَذِهِ النِّسَاءِ اللَّاتِي يَتَمَتَّعُ فَلْيُخَلِّ سَبِيلَهَا» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ هَذَا حَدِيثٌ صَحِيحٌ
21.82 [Machine] The Solution of Pubic Hair
٢١۔٨٢ إِحْلَالُ الْفَرْجِ
"If she let him do that, I will flog him with one hundred stripes , and if she did not let him, I will stone him (to death)." (Using translation from Nasāʾī 3360)
عَنِ النَّبِيِّ ﷺ قَالَ فِي الرَّجُلِ يَأْتِي جَارِيَةَ امْرَأَتِهِ قَالَ «إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ»
[Machine] I will tell you about the Messenger of Allah, ﷺ , that "If you had given him permission, I would have struck him a hundred times, and if you hadn't given him permission, I would have stoned him."
أُحَدِّثْهُ عَنْ رَسُولِ اللهِ ﷺ إِنْ «كُنْتِ أَذِنْتِ لَهُ ضَرَبْتُهُ مِائَةً وَإِنْ كُنْتِ لَمْ تَأْذَنِي لَهُ رَجَمْتُهُ»
“A man who had intercourse with the slave woman of his wife was brought to Nuʿman bin Bashir. He said: 'I will pass no other judgement than that of the Messenger of Allah ﷺ He said: 'If (his wife) had made her lawful for him, then I will give him one hundred lashes, but if she has not given permission, I will stone him.' ” (Using translation from Ibn Mājah 2551)
«لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ»
Habib ibn Salim said: A man called AbdurRahman ibn Hunayn had intercourse with his wife's slave-girl. The matter was brought to an-Nu'man ibn Bashir who was the Governor of Kufah. He said: I shall decide between you in accordance with the decision of the Messenger of Allah ﷺ. If she made her lawful for you, I shall flog you one hundred lashes. If she did not make her lawful for you, I shall stone you to death. So they found that she had made her lawful for him. He, therefore, flogged him one hundred lashes. Qatadah said: I wrote to Habib b. Salim; so he wrote this (tradition) to me. (Using translation from Abū Dāʾūd 4458)
«لَأَقْضِيَنَّ فِيكَ بِقَضِيَّةِ رَسُولِ اللهِ ﷺ إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَكَ رَجَمْتُكَ بِالْحِجَارَةِ» فَقَالَتْ أَحْلَلْتُهَا لَهُ فَجُلِدَ مِائَةً قَالَ قَتَادَةُ فَكَتَبْتُ إِلَى حَبِيبِ بْنِ سَالِمٍ فَكَتَبَ إِلَيَّ بِهَذَا
"If she let him do that, I will flog him with one hundred stripes, and if she did not let him do that, I will stone him (to death)." (Using translation from Nasāʾī 3362)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي رَجُلٍ وَقَعَ بِجَارِيَةِ امْرَأَتِهِ «إِنْ كَانَتْ أَحَلَّتْهَا لَهُ فَاجْلِدُوهُ مِائَةَ جَلْدَةٍ وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ فَارْجُمُوهُ»
[Machine] The Prophet ﷺ ruled regarding a man who had sexual intercourse with his slave-woman, whether it was against her will, she is free, and the man has to give her mistress the same punishment, and if she willingly obeyed him, then she belongs to him and her mistress has the same right over her.
«قَضَى النَّبِيُّ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا»
"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well." (Using translation from Nasāʾī 3364)
أَنَّ رَجُلًا غَشِيَ جَارِيَةَ امْرَأَتِهِ فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ مِنْ مَالِهِ وَعَلَيْهِ الشَّرْوَى لِسَيِّدَتِهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لِسَيِّدَتِهَا وَمِثْلُهَا مِنْ مَالِهِ»

٢١۔٨٣ فِي الصُّفْرَةِ عِنْدَ التَّزْوِيجِ
"What's this for?" He said: "I have married a woman." He said: "What dowry did you give?" He said: "The weight of a Nawah (five Dirhams) of gold." He said: "Give a Walimah (wedding feast) even if it is with one sheep." (Using translation from Nasāʾī 3373)
رَسُولُ اللهِ ﷺ «مَهْيَمْ» قَالَ تَزَوَّجْتُ امْرَأَةً قَالَ «وَمَا أَصْدَقْتَ؟» قَالَ وَزْنُ نَوَاةٍ مِنْ ذَهَبٍ قَالَ «أَوْلِمْ وَلَوْ بِشَاةٍ»
21.84 [Machine] Those who have not witnessed marriage are called.
٢١۔٨٤ بَابٌ: يُدْعَى مَنْ لَمْ يَشْهَدِ التَّزْوِيجَ
"The Messenger of Allah saw traces of yellow perfume on 'Abdur-Rahman and said: 'What is this?' He said: 'I married a woman for a Nawah (five Dirhams) of gold.' He said: 'May Allah bless you. Give a Walimah (wedding feast) even if it is with one sheep.'" (Using translation from Nasāʾī 3372)
أَنَّ رَسُولَ اللهِ ﷺ رَأَى عَلَى عَبْدِ الرَّحْمَنِ أَثَرَ صُفْرَةٍ فَقَالَ «مَا هَذَا؟» قَالَ تَزَوَّجْتُ امْرَأَةً عَلَى وَزْنِ نَوَاةٍ مِنْ ذَهَبٍ فَقَالَ «بَارَكَ اللهُ لَكَ أَوْلِمْ وَلَوْ بِشَاةٍ»
"The Messenger of Allah saw a trace of yellow perfume on me" -as if he meant 'Abdur-Rahman bin 'Awf- "and said: 'What's this for?' He said: 'I have married a woman from among the Ansar.' He said: 'Give a Walimah (wedding feast) even if it is with one sheep.'" (Using translation from Nasāʾī 3374)
رَأَى رَسُولُ اللهِ ﷺ عَلَى عَبْدِ الرَّحْمَنِ أَثَرَ صُفْرَةٍ فَقَالَ «مَهْيَمْ» قَالَ تَزَوَّجْتُ امْرَأَةً مِنَ الْأَنْصَارِ فَقَالَ «أَوْلِمْ وَلَوْ بِشَاةٍ» مُخْتَصَرٌ
21.85 [Machine] How to pray for a man when he gets married
٢١۔٨٥ كَيْفَ الدُّعَاءُ لِلرَّجُلِ إِذَا تَزَوَّجَ
"Aqil bin Abi Talib married a woman from Banu Jusham, and it was said to him: 'May you live in harmony and have many sons.' He said: 'Say what the Messenger of Allah said: Barak Allahu fikum, wa baraka lakum. (May Allah bless you and bestow blessings upon you.)'" (Using translation from Nasāʾī 3371)
قَالَ رَسُولُ اللهِ ﷺ «بَارَكَ اللهُ فِيكُمْ وَبَارَكَ لَكُمْ»
21.86 [Machine] Announcing the marriage by voice, and beating the drum.
٢١۔٨٦ إِعْلَانُ النِّكَاحِ بِالصَّوْتِ، وَضَرْبِ الدُّفِّ
“What differentiates between the lawful and the unlawful is (beating) the Daff and raising the voices (in song) at the time of marriage.” (Using translation from Ibn Mājah 1896)
قَالَ رَسُولُ اللهِ ﷺ «فَصْلُ مَا بَيْنَ الْحَلَالِ وَالْحَرَامِ الدُّفُّ وَالصَّوْتُ فِي النِّكَاحِ»
"The morning after the consummation of my marriage, the Prophet came and sat on my bed as far from me as you are sitting now, and our little girls started beating the Duff and reciting verses mourning my father who had been killed in the battle of Badr. One of them said: 'Among us is a Prophet who knows what will happen tomorrow.' On that the Prophet said: 'Stop saying this, and keep on saying what you were saying before.'" دَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ غَدَاةَ بَنَى بِي فَجَلَسَ عَلَى فِرَاشِي وَجُوَيْرِيَاتٌ لَنَا يَضْرِبْنَ بِدُفٍّ وَيَنْدُبْنَ مَنْ قَتَلَ أَبَائِي فَقَالَتْ إِحْدَاهُنَّ وَفِينَا نَبِيٌّ يَعْلَمُ مَا فِي غَدِ فَقَالَ لَهَا اسْكُتِي عَنْ هَذَا وَقُولِي الَّذِي كُنْتِ تَقُولِينَ قَبْلَهَا
21.87 [Machine] Recreation and singing at weddings
٢١۔٨٧ اللهْوُ وَالْغِنَاءُ عِنْدَ الْعُرْسِ
"I entered upon Qurazah bin Ka'b and Abu Mas'ud Al-Ansari during a wedding and there were some young girls singing. I said: 'You are two of the Companions of the Messenger of Allah who were present at Badr, and this is being done in your presence!' They said: 'Sit down if you want and listen with us, or if you want you can go away. We were granted a concession allowing entertainment at weddings.'" (Using translation from Nasāʾī 3383)
دَخَلْتُ عَلَى قَرَظَةَ بْنِ كَعْبٍ وَأَبِي مَسْعُودٍ الْأَنْصَارِيِّ فِي عُرْسٍ وَإِذَا جَوَارٍ يَتغَنَّيْنَ قُلْتُ أَنْتُمَ أَصَحَابُ رَسُولِ اللهِ ﷺ وَأَهْلُ بَدْرٍ يَفْعَلُ هَذَا عِنْدَكُمْ قَالَا اجْلِسْ إِنْ شِئْتَ فَاسْمَعْ مَعَنَا وَإِنْ شِئْتَ فَاذْهَبْ فَإِنَّهُ قَدْ «رُخِّصَ لَنَا فِي اللهْوِ عِنْدَ الْعُرْسِ»
[Machine] "O messengers of Allah, did you give the girl as a gift, so that we sent along with her someone who would say: 'We have come to you, we have come to you', and would greet us and greet you?"
رَسُولُ اللهِ ﷺ أَهْدَيْتُمُ الْفَتَاةَ أَلَا بَعَثْتُمْ مَعَهَا مَنْ يَقُولُ أَتَيْنَاكُمْ أَتَيْنَاكُمْ فَحَيَّانَا وَحَيَّاكُمْ؟
21.88 [Machine] The decoration of the solitude and the presentation of the gift before the construction.
٢١۔٨٨ تَحِلَّةُ الْخَلْوَةِ وَتَقْدِيمُ الْعَطِيَّةِ قَبْلَ الْبِنَاءِ
"I got married to Fatimah, may Allah be pleased with her, and I said: 'O Messenger of Allah, let me consummate the marriage.' He said: 'Give her something.' I said: 'I do not have anything.' He said: 'Where is your Hutami armor?' I said: 'It is with me.' He said: 'Give it to her.'" (Using translation from Nasāʾī 3375)
تَزَوَّجْتُ فَاطِمَةَ فَقُلْتُ يَا رَسُولَ اللهِ ابْنِ لِي قَالَ «أَعْطِهَا شَيْئًا» قَالَ مَا عِنْدِي شَيْءٌ قَالَ «فَأَيْنَ دِرْعُكَ الْحُطَمِيَّةُ؟» قُلْتُ عِنْدِي قَالَ «فَأَعْطِهَا إِيَّاهُ» خَالَفَهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ
When Ali married Fatimah, the Prophet ﷺ said to him: Give her something. He said: I have nothing with me. He said: Where is your Hutamiyyah (coat of mail). (Using translation from Abū Dāʾūd 2125)
لَهُ رَسُولُ اللهِ ﷺ «أَعْطِهَا شَيْئًا» قَالَ مَا عِنْدِي شَيْءٌ قَالَ «فَأَيْنَ دِرْعُكَ الْحُطَمِيَّةُ؟»
21.89 [Machine] The building has a daughter of nine years.
٢١۔٨٩ الْبِنَاءُ بِابْنَةِ تِسْعٍ
"The Messenger of Allah married me when I was six, and consummated the marriage with me when I was nine, and I used to play with dolls." (Using translation from Nasāʾī 3378)
«تَزَوَّجَنِي رَسُولُ اللهِ ﷺ وَأَنَا ابْنَةُ سِتِّ سِنِينَ وَدَخَلَ عَلَيَّ وَأَنَا بِنْتُ تِسْعِ سِنِينَ وَكُنْتُ أَلْعَبُ بِالْبَنَاتِ»
'A'isha (Allah be pleased with her) reported that Allah's Apostle ﷺ married her when she was seven years old, and he was taken to his house as a bride when she was nine, and her dolls were with her; and when he (the Holy Prophet) died she was eighteen years old. «نَكَحَ النَّبِيُّ ﷺ عَائِشَةَ وَهِيَ بِنْتُ سِتِّ سَنَوَاتٍ أَوْ سَبْعٍ وَزُفَّتْ إِلَيْهِ وَهِيَ بِنْتُ تِسْعِ سِنِينَ وَلُعَبُهَا مَعَهَا وَمَاتَ عَنْهَا وَهِيَ بِنْتُ ثَمَانِ عَشْرَةَ سَنَةً»
