2. Chapter of Alif (Male)
٢۔ بَابُ الْأَلِفِ
[Machine] "I was in the vicinity of the Prophet ﷺ at Arafat."
«كُنْتُ رِدْفَ النَّبِيِّ ﷺ بِعَرَفَةَ»
[Machine] "He (Abu Al-Minhāl) said that he sold a partner of mine in Al-Kufa, dirhams for dirhams, with some surplus. So, I said, this does not seem right. He replied, I sold it in the market, and no one blamed me for it. So, I went to Al-Barā' bin 'Āzib and asked him about it. He said, The Prophet ﷺ came to Al-Madinah, and our trade used to be like this. He (the Prophet) said, if it is hand to hand, then there is no harm in it, and if it includes deception, then there is no good in it. Then, I went to Zaid bin Arqam, as he was the greater merchant than me. I went to him and mentioned it to him. He (Zaid) said, Al-Barā' is right. Al-Humaydi said, This (transaction) is abrogated and should not be taken into consideration."
أَنَّهُ مَعَ أَبِي الْمِنْهَالِ يَقُولُ بَاعَ شَرِيكٌ لِي بِالْكُوفَةِ دَرَاهِمَ بِدَرَاهِمَ بَيْنَهُمَا فَضْلٌ فَقُلْتُ مَا أَرَى هَذَا يَصْلُحُ قَالَ لَقَدْ بِعْتُهَا فِي السُّوقِ فَمَا عَابَ ذَلِكَ عَلَيَّ أَحَدٌ فَأَتَيْتُ الْبَرَاءَ بْنَ عَازِبٍ فَسَأَلْتُهُ فَقَالَ قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ وَتِجَارَتُنَا هَكَذَا فَقَالَ «مَا كَانَ يَدًا بِيَدٍ فَلَا بَأْسَ بِهِ وَمَا كَانَ نَسِيئًا فَلَا خَيْرَ فِيهِ» وَأَتَيْتُ زَيْدَ بْنَ أَرْقَمَ فَإِنَّهُ أَعْظَمُ تِجَارَةً مِنِّي فَأَتَيْتُهُ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ صَدَقَ الْبَرَاءُ قَالَ الْحُمَيْدِيُّ «هَذَا مَنْسُوخٌ لَا يُأْخَذُ بِهَذَا»
[Machine] Abu Sa'eed Al-Khudri met Ibn Abbas and testified to the Messenger of Allah ﷺ saying, "Gold is to be exchanged for gold and silver for silver, equivalently. So whoever adds more, has indulged in usury." Ibn Abbas then said, "Shall I repent to Allah from what I used to give fatwas about?" Then he returned.
أَنَّ أَبَا سَعِيدٍ الْخُدْرِيَّ لَقِيَ ابْنَ عَبَّاسٍ فَشَهِدَ عَلَى رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ «الذَّهَبُ بِالذَّهَبِ وَالْفِضَّةُ بِالْفِضَّةِ مِثْلًا بِمِثْلٍ فَمَنْ زَادَ فَقَدْ أَرْبَى» فَقَالَ ابْنُ عَبَّاسٍ «أَتُوبُ إِلَى اللهِ ﷻ مِمَّا كُنْتُ أُفْتِي بِهِ» ثُمَّ رَجَعَ
[Machine] "I do not see any harm in what was hand in hand." Then I proceeded to Mecca in the following year, and he had "forbidden it"
«لَا أَرَى بِمَا كَانَ يَدًا بِيَدٍ بَأْسًا» ثُمَّ قَدِمْتُ مَكَّةَ مِنَ الْعَامِ الْمُقْبِلِ وَقَدْ «نَهَى عَنْهُ»
[Machine] I heard Ibn Abbas say, "O Allah, I repent to You from this act of departure. This is only my opinion and this is Abu Sa'id Al-Khudri narrating it from the Prophet ﷺ."
سَمِعْتُ ابْنَ عَبَّاسٍ يَقُولُ اللهُمَّ إِنِّي أَتُوبُ إِلَيْكَ مِنَ الصَّرْفِ إِنَّمَا هَذَا مِنْ رَأْيِي وَهَذَا أَبُو سَعِيدٍ الْخُدْرِيُّ يَرْوِيهِ عَنِ النَّبِيِّ ﷺ
[Machine] I heard Ibn Abbas saying, "I seek forgiveness from Allah and repent to Him from evil actions."
سَمِعْتُ ابْنَ عَبَّاسٍ يَقُولُ «أَسْتَغْفِرُ اللهَ وَأَتُوبُ إِلَيْهِ مِنَ الصَّرْفِ»
[Machine] Abu Sa'id said to Ibn Abbas, may Allah have mercy on him, "Repent to Allah and seek His forgiveness." Ibn Abbas replied, "Don't you know that the Messenger of Allah forbade exchanging gold with gold and silver with silver?" He also said, "I fear for you the sin of usury." I asked Atiyyah, "What is usury?" He replied, "It is the increase and excess between them."
أَبُو سَعِيدٍ لِابْنِ عَبَّاسٍ رَحِمَهُ اللهُ تُبْ إِلَى اللهِ ﷻ فَقَالَ أَسْتَغْفِرُ اللهَ وَأَتُوبُ إِلَيْهِ قَالَ أَلَمْ تَعْلَمْ «أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الذَّهَبِ بِالذَّهَبِ وَالْفِضَّةِ بِالْفِضَّةِ» وَقَالَ «إِنِّي أَخَافُ عَلَيْكُمُ الرِّبَا؟» قُلْتُ لِعَطِيَّةَ مَا الرِّبَا؟ قَالَ «الزِّيَادَةُ وَالْفَضْلُ بَيْنَهُمَا»
[Machine] "O people, there is no harm in conducting transactions as long as they are mutual. The only form of usury is when it involves unfairness. The word of usury has spread among the people of the East and the West until Abu Sa'id Al-Khudri entered and said, 'O Ibn Abbas, have you engaged in usury and benefited from it?' Ibn Abbas replied, 'Did I do that?' Abu Sa'id said, 'Yes, the Messenger of Allah, ﷺ , said: "Gold for gold, equal for equal, weight for weight, and silver for silver, equal for equal, weight for weight. Whoever gives more or takes more has engaged in usury."' This continued until the following year, when Ibn Abbas came and I accompanied him. He praised and thanked Allah, and then said, 'O people, I spoke with a word based on my own opinion last year, and I seek Allah's forgiveness for it and repent to Him. The Messenger of Allah, ﷺ , said: "Gold for gold, equal for equal, weight for weight. Whoever gives more or takes more has engaged in usury."' He repeated these six types of transactions to them."
أَيُّهَا النَّاسُ إِنَّهُ لَا بَأْسَ بِالصَّرْفِ مَا كَانَ مِنْهُ يَدًا بِيَدٍ إِنَّمَا الرِّبَا فِي النَّسِيئَةِ فَطَارَتْ كَلِمَةٌ فِي أَهْلِ الْمَشْرِقِ وَالْمَغْرِبِ حَتَّى إِذَا انْقَضَى الْمَوْسِمُ دَخَلَ عَلَيْهِ أَبُو سَعِيدٍ الْخُدْرِيُّ فَقَالَ يَا ابْنَ عَبَّاسٍ أَكَلْتَ الرِّبَا وَأَطْعَمْتَهُ؟ قَالَ أَوَفَعَلْتُ؟ قَالَ نَعَمْ قَالَ رَسُولُ اللهِ ﷺ «الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ مِثْلًا بِمِثْلٍ تِبْرُهُ وَعَيْنُهُ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أرْبَا وَالْفِضَّةُ بِالْفِضَّةِ وَزْنًا بِوَزْنٍ مِثْلًا بِمِثْلٍ تِبْرُهُ وَعَيْنُهُ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أرْبَا وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ مِثْلًا بِمِثْلٍ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أرْبَا» حَتَّى إِذَا كَانَ الْعَامُ الْمُقْبِلُ جَاءَ ابْنُ عَبَّاسٍ وَجِئْتُ مَعَهُ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ يَا أَيُّهَا النَّاسُ إِنِّي تَكَلَّمْتُ عَامَ أَوَّلٍ بِكَلِمَةٍ مِنْ رَأْيِي وَإِنِّي أَسْتَغْفِرُ اللهَ مِنْهُ وَأَتُوبُ إِلَيْهِ إِنَّ رَسُولَ اللهِ ﷺ قَالَ «الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ مِثْلًا بِمِثْلٍ تِبْرُهُ وَعَيْنُهُ فَمَنْ زَادَ وَاسْتَزَادَ فَقَدْ أرْبَا» وَأَعَادَ عَلَيْهِمْ هَذِهِ الْأَنْوَاعَ السِّتَّةَ
