٢۔ بَابُ الْأَلِفِ
2.30.1 Subsection
٢۔٣٠۔١ الْأَشْعَثُ بْنُ قَيْسٍ الْكِنْدِيُّ وَيُكَنَّى أَبَا مُحَمَّدٍ
[Machine] There was a dispute between a man and Ma'dan over a piece of land. They both went to the Prophet ﷺ, who ruled in favor of one of them by taking an oath. The other man asked, "Will he take my land?" The Prophet ﷺ said, "If he swore falsely by Allah, then no." Ibn Awun then said something severe.
أَنَّ مَعْدَانَ كَانَ بَيْنَهُ وَبَيْنَ رَجُلٍ خُصُومَةٌ فِي أَرْضٍ فَارْتَفَعَا إِلَى النَّبِيِّ ﷺ فَقَضَى بِالْيَمِينِ عَلَى أَحَدِهِمَا فَقَالَ الْآخَرُ يَذْهَبُ بِأَرْضِي؟ قَالَ «فَإِنَّهُ إِنْ حَلَفَ بِاللهِ كَاذِبًا» قَالَ ابْنُ عَوْنٍ فَقَالَ قَوْلًا شَدِيدًا
A man of Kindah and a man of Hadramawt brought their dispute to the Prophet ﷺ about a land in the Yemen. Al-Hadrami said: Messenger of Allah, the father of this (man) usurped my land and it is in his possession. The Prophet asked: Have you any evidence? Al-Hadrami replied: No, but I make him swear (that he should say) that he does not know that it is my land which his father usurped from me. Al-Kindi became ready to take the oath. The Messenger of Allah ﷺ said: If anyone usurps the property by taking an oath, he will meet Allah while his hand is mutilated. Al-Kindi then said: It is his land. أَنَّ رَجُلًا مِنْ كِنْدَةَ وَرَجُلًا مِنْ حَضْرَمَوْتَ اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فِي أَرْضٍ بِالْيَمَنِ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ أَرْضِي اغْتَصَبَهَا أَبُو هَذَا؟ فَقَالَ لِلْكِنْدِيِّ «مَا تَقُولُ؟» قَالَ أَقُولُ إِنَّ أَرْضِي فِي يَدِي وَرِثْتُهَا مِنْ أَبِي فَقَالَ لِلْحَضْرَمِيِّ «هَلْ لَكَ مِنْ بَيِّنَةٍ؟» قَالَ لَا وَلَكِنْ يَحْلِفُ يَا رَسُولَ اللهِ بِالَّذِي لَا إِلَهَ إِلَّا اللهُ هُوَ مَا يَعْلَمُ أَنَّهَا أَرْضِي اغْتَصَبَهَا أَبُوهُ فَتَهَيَّأَ الْكِنْدِيُّ لِلْيَمِينِ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّهُ لَا يَقْتَطِعُ رَجُلٌ مَالًا إِلَّا لَقِيَ اللهَ ﷻ يَوْمَ الْقِيَامَةِ وَهُوَ أَجْذَمُ» فَرَدَّهَا الْكِنْدِيُّ
[Machine] "A man from the Hadrami people disputed with a man from our group, known as al-Hafshish, in the presence of the Prophet, ﷺ , in a land that belonged to him. The Prophet, ﷺ , said to the Hadrami man, 'Bring your witnesses regarding your right, or else he can take an oath.' The Hadrami man said, 'I consider my land to be more important than not swearing an oath on it.' The Messenger of Allah, ﷺ , said, 'The Muslim's oath is binding according to what he has testified to, even if it is less significant than that.' The man left to swear an oath, and the Prophet, ﷺ , said, 'If he swears falsely, Allah will enter him into the Hellfire.' Then al-Ash'ath came and informed the Prophet, ﷺ , that they had reconciled."
خَاصَمَ رَجُلٌ مِنَ الْحَضْرَمِيِّينَ رَجُلًا مِنَّا يُقَالُ لَهُ الْحَفْشِيشُ إِلَى النَّبِيِّ ﷺ فِي أَرْضٍ لَهُ فَقَالَ النَّبِيُّ ﷺ لِلْحَضْرَمِيِّ «جِئْ بِشُهُودِكَ عَلَى حَقِّكَ وَإِلَّا حَلَفَ لَكَ» قَالَ لَهُ أَرْضِي أَعْظَمُ شَأْنًا مِنْ أَنْ لَا يَحْلِفَ عَلَيْهَا فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ يَمِينَ الْمُسْلِمِ مِنْ وَرَاءِ مَا هُوَ أَعْظَمُ مِنْ ذَلِكَ» فَانْطَلَقَ لِيَحْلِفَ فَقَالَ النَّبِيُّ ﷺ «إِنْ هُوَ حَلَفَ كَاذِبًا أَدْخَلَهُ اللهُ ﷻ النَّارَ» فَانْطَلَقَ الْأَشْعَثُ فَأَخْبَرَهُ فَقَالَ أَصْلِحْ بَيْنِي وَبَيْنَهُ فَأَصْلَحَ بَيْنَهُمَا
[Machine] I bought my livelihood once for seventy thousand, because I heard the Messenger of Allah ﷺ say, "Whoever unlawfully takes away a Muslim's right through an oath, he will meet Allah while He is angry with him."
لَقَدِ اشْتَرَيْتُ يَمِينِي مَرَّةً بِسَبْعِينَ أَلْفًا وَذَلِكَ أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنِ اقْتَطَعَ حَقَّ مُسْلِمٍ بِيَمِينٍ لَقِيَ اللهَ ﷻ وَهُوَ عَلَيْهِ غَضْبَانُ»
[Machine] In this verse, it was revealed to me that I had a piece of land in the possession of my paternal uncle. So, I went to the Messenger of Allah ﷺ and he said, "Do you want me to arbitrate or shall I uphold his oath?" I said, "If he has taken an oath, then you should arbitrate, O Messenger of Allah." So, the Messenger of Allah ﷺ said, "Whoever takes an oath, while he is still a sinner and uses it to wrongfully take the wealth of a Muslim, he will meet Allah while He is angry with him." So, Allah revealed the verse: "Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price..." until the end of the verse.
فِيَّ أُنْزِلَتْ هَذِهِ الْآيَةُ كَانَتْ لِي أَرْضٌ فِي يَدِ عَمٍّ لِي فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَقَالَ «بَيِّنَتُكَ أَوْ يَمِينُهُ» قُلْتُ يَحْلِفُ إِذًا يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ صَبْرٍ يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ وَهُوَ فِيهَا فَاجِرٌ لَقِيَ اللهَ ﷻ وَهُوَ عَلَيْهِ غَضْبَانُ» فَأَنْزَلَ اللهُ ﷻ الْآيَةَ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} إِلَى آخِرِ الْآيَةِ
[Machine] "I accused a man in front of the Messenger of Allah ﷺ , and then the verse, 'Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price,' was revealed to me."
نَزَلَتْ فِيَّ هَذِهِ الْآيَةُ خَاصَمْتُ رَجُلًا إِلَى رَسُولِ اللهِ ﷺ فَنَزَلَتْ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا}
[Machine] The Messenger of Allah ﷺ said, "Whoever swears an oath in order to seize a Muslim's property, while he is angry and the dispute is unresolved, he meets Allah while He is angry." Al-Ash'ath entered and asked, "What did Abu 'Abd al-Rahman (referring to the Prophet) tell you?" We replied with what was said, so he recited the verse that was revealed to him, "I had a dispute with a man over a piece of land, so I referred the matter to the Prophet. I had no evidence, so he asked me, 'Do you swear?' I said, 'O Messenger of Allah, if I do, will it be permissible?' So the Messenger of Allah ﷺ said, 'Whoever swears an oath in order to take a person's property while knowing that he is false, he meets Allah while He is angry.' And the verse was revealed, "Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price..." until the end of the verse.
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ صَبْرٍ لِيَقْتَطِعَ بِهِ مَالَ امْرِئٍ مُسْلِمٍ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» فَدَخَلَ الْأَشْعَثُ فَقَالَ مَا حَدَّثَكُمَا أَبُو عَبْدِ الرَّحْمَنِ؟ فَقُلْنَا بِكَذَا وَكَذَا فَقَالَ فِيَّ نَزَلَتْ كَانَ بَيْنِي وَبَيْنَ رَجُلٍ خُصُومَةٌ فِي أَرْضٍ لَنَا خَاصَمْتُ إِلَى النَّبِيِّ ﷺ فَلَمْ يَكُنْ لِي بَيِّنَةٌ فَقَالَ «أُحَلِّفُهُ؟» فَقُلْتُ يَا رَسُولَ اللهِ إِذًا يَحْلِفُ فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ لِيَقْتَطِعَ بِهَا مَالَ امْرِئٍ وَهُوَ فِيهَا فَاجِرٌ لَقِيَ اللهَ ﷻ وَهُوَ عَلَيْهِ غَضْبَانُ» وَنَزَلَتْ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} إِلَى آخِرِ الْآيَةِ
[Machine] "In this situation, I had a dispute with a man over money or land. So I went to the Messenger of Allah ﷺ and told him about it. He asked, 'Do you have any evidence?' I replied, 'No.' He said, 'Then let your companion swear an oath.' So this verse was revealed: 'Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price...'"
فِيَّ نَزَلَتْ هَذِهِ الْآيَةُ كَانَ بَيْنِي وَبَيْنَ رَجُلٍ تَدَارٍ فِي مَالٍ أَوْ أَرْضٍ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «لَكَ بَيِّنَةٌ؟» فَقُلْتُ لَا قَالَ «فَسَيُسْتَحْلَفُ صَاحِبُكَ» قَالَ إِذًا يَحْلِفُ فَنَزَلَتْ هَذِهِ الْآيَةُ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} إِلَى آخِرِ الْآيَةِ
