Masruq said on the authority of Abdullah ibn Mas'ud: Abdullah (ibn Mas'ud ) was asked about a man who had married a woman without cohabiting with her or fixing any dower for her till he died. Ibn Mas'ud said: She should receive the full dower (as given to women of her class), observe the waiting period ('Iddah), and have her share of inheritance. Thereupon Ma'qil ibn Sinan said: I heard the Messenger of Allah ﷺ giving the same decision regarding Birwa' daughter of Washiq (as the decision you have given).

"I think that she should have a dowry like that of her peers no less, with no injustice and she may inherit from him and she has to observe the 'Iddah." Ma'qil bin Sinan Al-Ashja'i testified: "The Messenger of Allah passed a similar judgment concerning Birwa' bint Washiq."

[AI] "Abdullah narrated that there was a man who married a woman without giving her any dowry, nor did he consummate the marriage with her. Then, he passed away from her. The Prophet ﷺ ruled that she should receive her bridal gift, observe the waiting period (iddah), and inherit from him. Ma'qil al-Ashja'i said, 'The Messenger of Allah ﷺ ruled similarly regarding Bura' bint Washiq, a woman from the Banu Ru'as tribe.' Hearing this, Muhammad and Sufyan rejoiced, and both said, 'We will follow this ruling.'"

[AI] About a man who married a woman but died before consummating the marriage or establishing a dowry for her. He did not say anything on the matter and they went on repeating their marriage for a month. Then he said, "I will state my opinion, if it is right, it is from Allah, and if it is wrong, it is from me. I see that she should receive her husband's dowry and inherit from him, and she is in her waiting period." Fulan Al-Ashji stood up and said, "The Messenger of Allah ﷺ ruled in the case of Bura' bint Washiq with the same verdict." Upon hearing this, Abdullah was happy and praised Allah.

[AI] About a man who married a woman and did not impose upon her or harm her until he died. His inheritors disputed about her, so he said, "Verily, I will give my opinion concerning her, if it is correct, then it is from Allah, and if it is wrong, then it is from me. I see that she should be given the dowry of a woman from her own relatives, neither exceeding nor diminishing, and she should observe the waiting period, and she should have her share of the inheritance." Maqil bin Sinan Al-Ashja'i stood up and said, "I bear witness that you have judged regarding her according to the judgment of the Messenger of Allah ﷺ in the case of Barwa' bint Washiq, a woman from the Banu Rawas, a neighbor of the Banu 'Amir bin Sa'sa'a, and Sufyan takes her."
