[Machine] About a man who married a woman and did not impose upon her or harm her until he died. His inheritors disputed about her, so he said, "Verily, I will give my opinion concerning her, if it is correct, then it is from Allah, and if it is wrong, then it is from me. I see that she should be given the dowry of a woman from her own relatives, neither exceeding nor diminishing, and she should observe the waiting period, and she should have her share of the inheritance." Maqil bin Sinan Al-Ashja'i stood up and said, "I bear witness that you have judged regarding her according to the judgment of the Messenger of Allah ﷺ in the case of Barwa' bint Washiq, a woman from the Banu Rawas, a neighbor of the Banu 'Amir bin Sa'sa'a, and Sufyan takes her."
عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً وَلَمْ يَفْرِضْ لَهَا وَلَمْ يُصِبْهَا حَتَّى مَاتَ فَرَدَّدَهُمْ ثُمَّ قَالَ فَإِنِّي أَقُولُ فِيهَا بِرَأْيِي فَإِنْ كَانَ صَوَابًا فَمِنَ اللهِ وَإِنْ كَانَ خَطَأً فَمِنِّي أَرَى «لَهَا صَدَاقَ امْرَأَةٍ مِنْ نِسَائِهَا لَا وَكْسَ وَلَا شَطَطَ وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ» فَقَامَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ فَقَالَ «أَشْهَدُ لَقَضَيْتَ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ فِي بَرْوَعَ بِنْتِ وَاشِقٍ» امْرَأَةٌ مِنْ بَنِي رَوَاسٍ حَيٍّ مِنْ بَنِي عَامِرِ بْنِ صَعْصَعَةَ وَبِهِ يَأْخُذُ سُفْيَانُ
