"I think that she should have a dowry like that of her peers no less, with no injustice and she may inherit from him and she has to observe the 'Iddah." Ma'qil bin Sinan Al-Ashja'i testified: "The Messenger of Allah passed a similar judgment concerning Birwa' bint Washiq."

أَنَّهُ أُتِيَ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ فَمَاتَ عَنْهَا وَلَمْ يَفْرِضْ لَهَا صَدَاقًا وَلَمْ يَدْخُلْ بِهَا فَاخْتَلَفُوا إِلَيْهِ قَرِيبًا مِنْ شَهْرٍ لاَ يُفْتِيهِمْ ثُمَّ قَالَ أَرَى لَهَا صَدَاقَ نِسَائِهَا لاَ وَكْسَ وَلاَ شَطَطَ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ فَشَهِدَ مَعْقِلُ بْنُ سِنَانٍ الأَشْجَعِيُّ أَنَّ رَسُولَ اللَّهِ ﷺ قَضَى فِي بِرْوَعَ بِنْتِ وَاشِقٍ بِمِثْلِ مَا قَضَيْتَ

"She should have the dowry, and she has to observe the 'Iddah, and she may inherit." Ma'qil bin Sinan said: "I heard the Prophet pass the same judgment concerning Birwa' bint Washiq."

Masruq said on the authority of Abdullah ibn Mas'ud: Abdullah (ibn Mas'ud ) was asked about a man who had married a woman without cohabiting with her or fixing any dower for her till he died. Ibn Mas'ud said: She should receive the full dower (as given to women of her class), observe the waiting period ('Iddah), and have her share of inheritance. Thereupon Ma'qil ibn Sinan said: I heard the Messenger of Allah ﷺ giving the same decision regarding Birwa' daughter of Washiq (as the decision you have given).

Abdullah was asked about a man who married a woman and died without having consummated the marriage with her, nor stipulating the dowry. Abdullah said: “The dowry is hers, and the inheritance is hers and she has to observe the waiting period.” Ma'qil bin Sinan Al-Ashja'i said: “I saw the Messenger of Allah ﷺ pass a similar ruling concerning Birwa' bint Washiq.” (Sahih) Another chain from 'Alqamah, from Abdullah, with similar wording. It was narrated from Masruq that: Abdullah was asked about a man who married a woman and died without having consummated the marriage with her, nor stipulating the dowry. [Machine] "Abdullah narrated that there was a man who married a woman without giving her any dowry, nor did he consummate the marriage with her. Then, he passed away from her. The Prophet ﷺ ruled that she should receive her bridal gift, observe the waiting period (iddah), and inherit from him. Ma'qil al-Ashja'i said, 'The Messenger of Allah ﷺ ruled similarly regarding Bura' bint Washiq, a woman from the Banu Ru'as tribe.' Hearing this, Muhammad and Sufyan rejoiced, and both said, 'We will follow this ruling.'"

[Machine] Narrated by Abdullah, a man married a woman but died before consummating the marriage or establishing the dowry for her. The narrator says that the full dowry must be given to the woman, she must observe the waiting period (iddah), and she is entitled to her inheritance. Maqil ibn Sinan stood up and said, "I bear witness that the Messenger of Allah ﷺ ruled in a similar case involving Burwa bint Washiq." This hadith is considered authentic and includes the mention of Maqil ibn Sinan as a famous companion. It was narrated by Yazid ibn Harun, who was one of the reliable hadith narrators, alongside Abdur Rahman ibn Mahdi and others with a different authentic chain of narration. Similarly, (the ruling applies to this case).
