"She should have a Mahr like that of women like her, no less and no more; she has to observe the 'Iddah, and she is entitled to inherit." Ma'qil bin Sinan Al-Ashja'i stood up and said: "The Messenger of Allah passed a similar judgment among us concerning Birwa' bint Washiq." And Ibn Masud rejoiced at that.  

عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً وَلَمْ يَفْرِضْ لَهَا صَدَاقًا وَلَمْ يَدْخُلْ بِهَا حَتَّى مَاتَ قَالَ ابْنُ مَسْعُودٍ لَهَا مِثْلُ صَدَاقِ نِسَائِهَا لاَ وَكْسَ وَلاَ شَطَطَ وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ فَقَامَ مَعْقِلُ بْنُ سِنَانٍ الأَشْجَعِيُّ فَقَالَ قَضَى فِينَا رَسُولُ اللَّهِ ﷺ فِي بِرْوَعَ بِنْتِ وَاشِقٍ امْرَأَةٍ مِنَّا مِثْلَ مَا قَضَيْتَ فَفَرِحَ ابْنُ مَسْعُودٍ ؓ  

"I think that she should have a dowry like that of her peers no less, with no injustice and she may inherit from him and she has to observe the 'Iddah." Ma'qil bin Sinan Al-Ashja'i testified: "The Messenger of Allah passed a similar judgment concerning Birwa' bint Washiq."  

أَنَّهُ أُتِيَ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ فَمَاتَ عَنْهَا وَلَمْ يَفْرِضْ لَهَا صَدَاقًا وَلَمْ يَدْخُلْ بِهَا فَاخْتَلَفُوا إِلَيْهِ قَرِيبًا مِنْ شَهْرٍ لاَ يُفْتِيهِمْ ثُمَّ قَالَ أَرَى لَهَا صَدَاقَ نِسَائِهَا لاَ وَكْسَ وَلاَ شَطَطَ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ فَشَهِدَ مَعْقِلُ بْنُ سِنَانٍ الأَشْجَعِيُّ أَنَّ رَسُولَ اللَّهِ ﷺ قَضَى فِي بِرْوَعَ بِنْتِ وَاشِقٍ بِمِثْلِ مَا قَضَيْتَ  

"She should have the dowry, and she has to observe the 'Iddah, and she may inherit." Ma'qil bin Sinan said: "I heard the Prophet pass the same judgment concerning Birwa' bint Washiq."  

عَنْ عَبْدِ اللَّهِ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا قَالَ لَهَا الصَّدَاقُ وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ فَقَالَ مَعْقِلُ بْنُ سِنَانٍ فَقَدْ سَمِعْتُ النَّبِيَّ ﷺ قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ  

Masruq said on the authority of Abdullah ibn Mas'ud: Abdullah (ibn Mas'ud ) was asked about a man who had married a woman without cohabiting with her or fixing any dower for her till he died. Ibn Mas'ud said: She should receive the full dower (as given to women of her class), observe the waiting period ('Iddah), and have her share of inheritance. Thereupon Ma'qil ibn Sinan said: I heard the Messenger of Allah ﷺ giving the same decision regarding Birwa' daughter of Washiq (as the decision you have given).  

عَنْ عَبْدِ اللَّهِ فِي رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَ عَنْهَا وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا الصَّدَاقَ فَقَالَ لَهَا الصَّدَاقُ كَامِلاً وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ فَقَالَ مَعْقِلُ بْنُ سِنَانٍ سَمِعْتُ رَسُولَ اللَّهِ ﷺ قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ  

Ibn Mas'ud was asked about a man who married a woman and he did not stipulate the dowry for her, and he did not enter into her until he died. So Ibn Mas'ud said: "She gets the same dowry as other women, no less and no more, she has to observe the Iddah, and she gets inheritance." So Ma'qil bin Sinan Al-Ashja'I stood and said: "The Messenger of Allah judged the same as you have judged regarding Birwa bint Washiq, a woman of ours." So Ibn Mas'ud was happy about that.
