19.1.64 Subsection
١٩۔١۔٦٤ بَابٌ
[Machine] Abdullah said, "Do not buy fish in the water, for it is deception."
عَبْدُ اللهِ «لَا تَشْتَرُوا السَّمَكَ فِي الْمَاءِ فَإِنَّهُ غَرَرٌ»
«الرِّبَا بِضْعٌ وَسَبْعُونَ بَابًا»
[Machine] "The transaction in both transactions involves usury."
«الصَّفْقَةُ فِي الصَّفْقَتَيْنِ رِبًا»
[Machine] "Tahiran min ghayr jima'in" translates to "purified without physical contact."
«طَاهِرًا مِنْ غَيْرِ جِمَاعٍ»
[Machine] "If a person wants to divorce his wife according to the Sunnah, then he divorces her three times while she is in a state of purity. After the third divorce, she should have a waiting period (iddah)."
«طَاهِرًا مِنْ غَيْرِ جِمَاعٍ إِذَا أَرَادَ أَنْ يُطَلِّقَهَا لِلسُّنَّةِ ثَلَاثًا طَلَّقَهَا فِي طُهْرٍ وَاحِدَةً ثُمَّ عَلَيْهَا حَيْضَةٌ بَعْدَ آخِرِ تَطْلِيقَةٍ»
[Machine] If someone divorces his wife due to the Sunnah, as Allah has commanded, then he should divorce her while she is pure, without sexual intercourse.
أَنْ يُطَلِّقَ لِلسُّنَّةِ كَمَا أَمَرَهُ اللهُ ﷻ فَلْيُطَلِّقْهَا طَاهِرًا مِنْ غَيْرِ جِمَاعٍ»
[Machine] "Abdullah ibn Mas'ud said, 'O Prophet, when you divorce women, divorce them for their waiting period.' Divorce for the waiting period means to divorce a woman when she is in a state of purity, then leave her until she completes her waiting period or reconcile with her if you wish.' Shu'bah narrated that the people of Kufa say, 'without sexual intercourse.'"
عَبْدُ اللهِ بْنُ مَسْعُودٍ {يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ} قَالَ الطَّلَاقُ لِلْعِدَّةِ أَنْ تُطَلِّقَهَا طَاهِرًا ثُمَّ تَدَعَهَا حَتَّى تَقْضِيَ عِدَّتَهَا أَوْ تُرَاجِعَهَا إِنْ شِئْتَ قَالَ شُعْبَةُ وَأَهْلُ الْكُوفَةِ يَقُولُونَ «عَنْ غَيْرِ جِمَاعٍ»
[Machine] On the authority of Abdullah regarding His statement {then, [in consequence], keep them in good manner or release them in a good manner}, he said, "Whoever intends to divorce, which is the divorce itself, he should wait until the woman purifies from menstruation, then he should divorce her while she is in a state of purity and not during intercourse."
عَنْ عَبْدِ اللهِ فِي قَوْلِهِ {فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ} قَالَ «مَنْ أَرَادَ الطَّلَاقَ الَّذِي هُوَ الطَّلَاقُ فَلْيُمْهِلْ حَتَّى إِذَا طَهُرَتِ الْمَرْأَةُ مِنَ الْحَيْضِ فَلْيُطَلِّقْهَا طَاهِرًا فِي غَيْرِ جِمَاعٍ»
[Machine] On the authority of Abdullah regarding his statement, "So divorce them for their waiting period," he said, "Whoever intends the divorce which is indeed divorce, let him wait for the woman until she purifies herself in a non-menstrual period. Then, he shall inform her, and if he regrets it and she experiences her menstrual cycle, then he shall bear witness of two men witnessing her return. Otherwise, he shall leave her until her waiting period expires. He shall not divorce her thrice while she is pregnant, lest Allah makes him regret it and He will provide for her expenses during her pregnancy and breastfeeding."
عَنْ عَبْدِ اللهِ فِي قَوْلِهِ {فَطَلِّقُوهُنَّ لِعِدَّتِهِنَّ} قَالَ مَنْ أَرَادَ الطَّلَاقَ الَّذِي هُوَ الطَّلَاقُ فَلْيُمْهِلِ الْمَرْأَةَ حَتَّى إِذَا طَهُرَتْ فِي غَيْرِ جِمَاعٍ قَالَ لَهَا اعْتَدِّي فَإِنْ نَدِمَ وَتَتَبَّعَهَا نَفْسَهُ أَشْهَدَ رَجُلَيْنِ عَلَى رَجْعَتِهَا وَإِلَّا تَرَكَهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا وَلَا يُطَلِّقْهَا ثَلَاثًا وَهِي حَامِلٌ فَيُنَدِّمْهُ اللهُ فَيُنْفِقْ عَلَيْهَا حَمْلَهَا وَرَضَاعَهَا
[Machine] "O commander of the faithful, my husband divorced me, so I have not had my menstrual period for three months. He came to me while I was in my postnatal bleeding and he knocked on my door and I undressed myself. He said, 'I have reconsidered, I have reconsidered.' Umar asked Ibn Mas'ud, 'What do you see in this situation?' He replied, 'I see that she is his wife without having the permission to pray.' Umar said, 'And I see that too.'"
يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّ زَوْجِي طَلَّقَنِي فَانْقَطَعَ عَنِّي الدَّمُ مُنْذُ ثَلَاثِ حِيَضٍ فَأَتَانِي وَقَدْ وَضَعْتُ مَائِي وَرَدَدْتُ بَابِي وَخَلَعْتُ ثِيَابِي فَقَالَ قَدْ رَاجَعْتُكِ قَدْ رَاجَعْتُكِ فَقَالَ عُمَرُ لِابْنِ مَسْعُودٍ مَا تَرَى فِيهَا؟ قَالَ «أَرَى أَنَّهَا امْرَأَتُهُ مَا دُونَ أَنْ تَحِلَّ لَهَا الصَّلَاةُ» قَالَ عُمَرُ «وَأَنَا أَرَى ذَلِكَ»
[Machine] The woman said, "Indeed, he did not fulfill his obligation to me by discussing the matter face to face with me." So Umar said, "Tell me what happened." She said, "He divorced me and then left me alone until I reached the end of my menstrual cycle and the bleeding stopped. I performed ghusl (ritual bath) and put on my clothes. Then he knocked on the door and said, 'I have taken you back, I have taken you back.' So I left off my ghusl and put on my clothes again." Umar asked, "What is your opinion on this matter, O son of Umme Abd?" I said, "I consider him more deserving of her without her being allowed to pray." Umar said, "Yes, that is what I see as well."
فَقَالَتِ الْمَرْأَةُ أَمَا إِنَّهُ لَمْ يَحْمِلْنِي الَّذِي كَانَ مِنْكَ أَنْ أُحَدِّثَ الْأَمْرَ عَلَى وَجْهِهِ فَقَالَ عُمَرُ حَدِّثِينِي فَقَالَتْ طَلَّقَنِي ثُمَّ تَرَكَنِي حَتَّى إِذَا كُنْتُ فِي آخِرِ ثَلَاثِ حِيَضٍ وَانْقَطَعَ عَنِّي الدَّمُ وَضَعْتُ غُسْلِي وَرَدَدْتُ بَابِي وَنَزَعْتُ ثِيَابِي فَقَرَعَ الْبَابَ قَالَ قَدْ رَجَعْتُكِ قَدْ رَجَعْتُكِ فَتَرَكْتُ غُسْلِي وَلَبِسْتُ ثِيَابِي فَقَالَ عُمَرُ مَا تَقُولُ فِيهَا يَا ابْنَ أُمِّ عَبْدٍ؟ فَقُلْتُ «أُرَاهُ أَحَقُّ بِهَا مَا دُونَ أَنْ تَحِلَّ لَهَا الصَّلَاةُ» فَقَالَ عُمَرُ «نِعْمَ مَا رَأَيْتَ وَأَنَا أَرَى ذَلِكَ»
[Machine] Uthman sent a message to my father asking him about it, so my father said, "How can a hypocrite issue a fatwa?" Uthman said, "I seek refuge with Allah from you being a hypocrite, and I seek refuge with Allah from labeling you a hypocrite, and I seek refuge with Allah from something like this being in Islam and then he dies without clarifying it." He said, "I think that he has more right to it until she purifies herself from the third menstruation and prayer becomes permissible for her." He said, "I do not know Uthman except that he took that."
أَرْسَلَ عُثْمَانُ إِلَى أَبِي يَسْأَلُهُ عَنْهَا فَقَالَ أَبِي «كَيْفَ يُفْتِي مُنَافِقٌ؟» فَقَالَ عُثْمَانُ نُعِيذُكَ بِاللهِ أَنْ تَكُونَ مُنَافِقًا وَنَعُوذُ بِاللهِ أَنْ نُسَمِّيَكَ مُنَافِقًا وَنُعِيذُكَ بِاللهِ أَنْ يَكُونَ مِثْلُ هَذَا فِي الْإِسْلَامِ ثُمَّ يَمُوتُ وَلَمْ يُبَيِّنْهُ قَالَ «فَإِنِّي أَرَى أَنَّهُ أَحَقُّ بِهَا حَتَّى تَغْتَسِلَ مِنَ الْحَيْضَةِ الثَّالِثَةِ وَتَحِلُّ لَهَا الصَّلَاةُ» قَالَ فَلَا أَعْلَمُ عُثْمَانَ إِلَّا أَخَذَ ذَلِكَ
[Machine] A man divorced his wife with a single divorce. Then she experienced three menstruation cycles. When she sat down to perform ghusl (ritual bath) after menstruation, her husband came and wanted to take her back. She said, "This is not for you." So they went to Ibn Mas'ood (may Allah be pleased with him). He swore her by Allah, by Whom there is no god except Him, that he had indeed divorced her, and that she was now legally permissible for him and the prayer was no longer forbidden upon her. But she refused to take an oath, so he returned her to her husband.
أَنَّ رَجُلًا طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً فَحَاضَتْ ثَلَاثَ حِيَضْ فَلَمَّا قَعَدَتْ لِتَغْتَسِلَ جَاءَ زَوْجُهَا فَرَاجَعَهَا فَقَالَتْ لَيْسَ ذَلِكَ لَكَ فَارْتَفَعَا إِلَى ابْنِ مَسْعُودٍ «فَاسْتَحْلَفَهَا بِاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ لَقَدْ رَاجَعَكِ وَقَدْ حَلَّتْ لَكِ الصَّلَاةُ؟ فَلَمْ تَحْلِفْ فَرَجَعَهَا إِلَيْهِ»
[Machine] To enter through it is not permissible for him until she marries another husband
أَنْ يُدْخَلَ بِهَا لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ
[Machine] "He cannot enter it until he marries someone else."
أَنْ يُدْخَلَ بِهَا لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ
[Machine] From Abdullah regarding a man who divorces his wife three times before having intercourse with her, he said: "Abdullah used to consider it as if he had already entered her."
عَنْ عَبْدِ اللهِ فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ «كَانَ عَبْدُ اللهِ يَجْعَلُهَا بِمَنْزِلَةِ الَمْدَخُولِ بِهَا»
[Machine] "That menstruation has passed from her and it has not become clear that she is waiting for a year, so if she does not menstruate in it, she waits three months after the year. If she menstruates in the three months, she counts it as menstruation, and if she menstruates and her menstruation has not completed after those three months after the year," he said, "Do not rush her until she knows whether her menstruation is complete or not."
أَنَّ الْحَيْضَةَ قَدْ أَدْبَرَتْ عَنْهَا وَلَمْ يَتَبَيَّنْ ذَلِكَ أَنَّهَا تَنْتَظِرُ سَنَةً فَإِنْ لَمْ تَحِضْ فِيهَا اعْتَدَّتْ بَعْدَ السَّنَةِ ثَلَاثَةَ أَشْهُرٍ فَإِنْ حَاضَتْ فِي الثَّلَاثَةِ الْأَشْهُرِ اعْتَدَّتْ بِالْحَيْضِ وَإِنْ حَاضَتْ فَلَمْ يَتِمَّ حَيْضُهَا بَعْدَمَا اعْتَدَّتْ تِلْكَ الثَّلَاثَةَ الْأَشْهُرِ الَّتِي بَعْدَ السَّنَةِ» قَالَ «لَا تَعْجَلْ عَلَيْهَا حَتَّى تَعْلَمَ أَتَمَّ حَيْضُهَا أَمْ لَا»
[Machine] Yes, he married her and she gave birth to a child for him. He presented himself to Umar and asked him. Umar said, "Separate between them." He said, "Indeed, she gave birth to a child for him." He said, "Even if she gives birth to ten, separate between them."
نَعَمْ فَتَزَوَّجَهَا فَوَلَدَتْ لَهُ فَقَدِمَ عَلَى عُمَرَ فَسَأَلَهُ فَقَالَ «فَرِّقْ بَيْنَهُمَا» فَقَالَ إِنَّهَا وَلَدَتْ لَهُ فَقَالَ «وَإِنْ وَلَدَتْ عَشَرَةً فَرِّقْ بَيْنَهُمَا»
[Machine] "In the case of the gift, if they accept it, it is one and more entitled to it. And if they do not accept it, it is nothing."
فِي الْمَوْهُوبَةِ «إِنْ قَبِلُوهَا فَهِيَ وَاحِدَةٌ وَهِي أَحَقُّ بِهَا وَإِنْ لَمْ يَقْبَلُوهَا فَلَيْسَ بِشَيْءٍ»
«إِنْ قَبِلُوهَا فَهِيَ وَاحِدَةٌ بَائِنَةٌ»
[Machine] The translation of the passage into English is: "The man said to his wife, 'Your command is in your hands, succeed with your order or give it as a gift to your family, and they accepted it, so it is a clear one'."
الرَّجُلُ لِامْرَأَتِهِ أَمْرُكِ بِيَدِكِ أَوِ اسْتَفْلِحِي بِأَمْرِكِ أَوْ وَهَبَهَا لِأَهْلِهَا فَقَبِلُوهَا فَهِيَ وَاحِدَةٌ بَائِنَةٌ
[Machine] "Allah ﷻ has clearly explained divorce, so whoever divorces as Allah ﷻ has commanded, it has been made clear to him. And whoever took upon himself the clothing of someone else, we made it his clothing, and Allah is not burdening you with what you say upon yourselves." He said, "And we see the statement of Ibn Sirin as an expression that I do not remember well, as he said, 'If he had the women of the people of the earth, then he said, 'All of them have gone away.'"
«قَدْ بَيَّنَ اللهُ ﷻ الطَّلَاقَ فَمَنْ طَلَّقَ كَمَا أَمَرَهُ اللهُ فَقَدْ بُيِّنَ لَهُ وَمَنْ لَبَسَ عَلَى نَفْسِهِ جَعَلْنَا بِهِ لَبْسَهُ وَاللهِ لَا تَلْبِسُونَ عَلَى أَنْفُسِكُمْ نَتَحَمَّلُهُ عَنْكُمْ هُوَ كَمَا تَقُولُونَ» قَالَ وَنَرَى قَوْلَ ابْنَ سِيرِينَ كَلِمَةً لَا أَحْفَظُهَا إِنَّهُ قَالَ «لَوْ كَانَ عِنْدَهُ نِسَاءُ أَهْلِ الْأَرْضِ ثُمَّ قَالَ هَذَا ذَهَبْنَ كُلُّهُنَّ»
[Machine] "He is just as you said," then a man came to him and said, "I divorced my wife the number of stars." He said, "Did you say it once?" He said, "Yes," He said, "So you want to clarify from yourself?" He said, "Yes." Abdullah mentioned at that time the women of the people of the earth with something that I do not remember. Then Abdullah said, "Allah has made clear to you how divorce is. So whoever divorces as Allah has commanded, then he has been made clear to him. And whoever wears a garment, we have made it a garment for him, and O Allah! Do not load upon yourselves burdens which you cannot bear. It is as you say."
«هُوَ كَمَا قُلْتَ» ثُمَّ أَتَاهُ رَجُلٌ فَقَالَ طَلَّقْتُ امْرَأَتِي عَدَدَ النُّجُومِ فَقَالَ «مَرَّةً وَاحِدَةً قُلْتَهَا؟» قَالَ نَعَمْ قَالَ «فَتُرِيدُ أَنْ تَبِينَ مِنْكَ؟» قَالَ نَعَمْ قَالَ فَذَكَرَ عَبْدُ اللهِ عِنْدَ ذَلِكَ نِسَاءَ أَهْلِ الْأَرْضِ بِشَيْءٍ لَا أَحْفَظُهُ ثُمَّ قَالَ عَبْدُ اللهِ «قَدْ بَيَّنَ اللهُ لَكُمْ كَيْفَ الطَّلَاقُ فَمَنْ طَلَّقَ كَمَا أَمَرَهُ اللهُ فَقَدْ بُيِّنَ لَهُ وَمَنْ لَبَسَ جَعَلْنَا بِهِ لَبْسَهُ وَاللهِ لَا تَلْبِسُونَ عَلَى أَنْفُسِكُمْ وَنَتَحَمَّلُهُ عَنْكُمْ هُوَ كَمَا تَقُولُونَ»
[Machine] I divorced my wife ninety-nine times and when I asked, it was said, "you have separated from her." Ibn Masoud said, "Indeed, they wanted to create division between you and her." He said, "What do you say? May Allah have mercy on you." So he thought that he would receive permission, and he said, "Three things are clear from you, and the rest are transgressions."
إِنِّي طَلَّقْتُ امْرَأَتِي تِسْعًا وَتِسْعِينَ وَإِنِّي سَأَلْتُ فَقِيلَ قَدْ بَانَتْ مِنِّي فَقَالَ ابْنُ مَسْعُودٍ «لَقَدْ أَحَبُّوا أَنْ تُفِرَّقَ بَيْنَكَ وَبَيْنَهَا» قَالَ فَمَا تَقُولُ رَحِمَكَ اللهُ؟ فَظَنَّ أَنَّهُ سَيُرَخِّصُ لَهُ فَقَالَ «ثَلَاثٌ تُبِينُهَا مِنْكَ وَسَائِرُهُنَّ عُدْوَانٌ»
[Machine] "I divorced my wife ninety times, and I have a child from her. There are people who want to separate me from my family," Abdullah said, "Three is enough for you, and the rest of them are oppressive."
إِنِّي طَلَّقْتُ امْرَأَتِي تِسْعِينَ وَإِنَّ لِي مِنْهَا وَلَدًا وَإِنَّ نَاسًا يُرِيدُونَ أَنْ يُفَرِّقُوا بَيْنِي وَبَيْنَ أَهْلِي فَقَالَ عَبْدُ اللهِ «إِنَّمَا يَكْفِيكَ ثَلَاثٌ وَسَائِرُهُنَّ عُدْوَانٌ»
[Machine] "In the Haram, there is a vow that can be expiated."
«فِي الْحَرَامِ يَمِينٌ يُكَفِّرُهَا»
[Machine] "In the Haram, there is an oath that is expiated."
«فِي الْحَرَامِ يَمِينٌ يُكَفِّرُهَا»
[Machine] "In the Haram, the expiation for breaking an oath is to feed ten poor people."
«فِي الْحَرَامِ كَفَّارَةُ يَمِينٍ»
[Machine] "Omar and Ibn Mas'ud said, 'In the sacred precinct, the expiation for breaking an oath is to feed ten poor people.'"
أَنَّ عُمَرَ وَابْنَ مَسْعُودٍ قَالَا «فِي الْحَرَامِ كَفَّارَةُ يَمِينٍ»
[Machine] "To touch them and did not say when you divorce the believing women then marry them."
أَنْ تَمَسُّوهُنَّ} وَلَمْ يَقُلْ إِذَا طَلَّقْتُمُ الْمُؤْمِنَاتِ ثُمَّ نَكَحْتُمُوهُنَّ
[Machine] "Indeed, Allah has made it clear, so whoever follows the commandments according to His guidance, it is clear for them. And whoever goes against it, by Allah, we cannot bear your opposition."
«إِنَّ اللهَ قَدْ بَيَّنَ فَمَنْ أَتَى الْأَمْرَ مِنْ قِبَلِ وَجْهِهِ فَقَدْ بُيِّنَ وَمَنْ خَالَفَ فَوَاللهِ مَا نُطِيقُ خِلَافَكُمْ»
[Machine] "If four months have passed, then it is a divorce."
«إِنْ مَضَتْ أَرْبَعَةُ أَشْهُرٍ فَهُوَ إِيلَاءٌ»
[Machine] And he said, "If four months have passed, then acknowledge the divorce."
وَقَالَ «إِذَا مَضَتْ أَرْبَعَةُ أَشْهُرٍ فَاعْتَرِفْ بِتَطْلِيقَةٍ»
[Machine] Ali, Ibn Mas'ud, and Ibn Abbas said, "When the four months have passed, it is considered a divorce that is valid and it is entitled to its own (rights)." Qatadah said, Ali and Ibn Mas'ud said, "The waiting period of a divorced woman is observed."
أَنَّ عَلِيًّا وَابْنَ مَسْعُودٍ وَابْنَ عَبَّاسٍ قَالُوا «إِذَا مَضَتِ الْأَشْهُرُ الْأَرْبَعَةُ فَهِيَ تَطْلِيقَةٌ وَهِي أَحَقُّ بِنَفْسِهَا» قَالَ قَتَادَةُ قَالَ عَلِيٌّ وَابْنُ مَسْعُودٍ «تَعْتَدُّ عِدَّةَ الْمُطَلَّقَةِ»
19.1.65 Subsection

[Machine] "It is now apparent to you, so propose to her for yourself." So he proposed to her for himself and gave her a weight of silver as a dowry.
«قَدْ بَانَتْ مِنْكَ فَاخْطُبْهَا إِلَى نَفْسِهَا» فَخَطَبَهَا إِلَى نَفْسِهَا فَأَصْدَقَهَا رِطْلًا مِنْ فِضَّةٍ
[Machine] That verse in Surah An-Nisa' which says, "And for those who are pregnant, their term is until they give birth" was revealed after the verse in Al-Baqarah which says, "And those who are taken in death among you and leave wives behind." Ali, may Allah be pleased with him, said, "It is the last of the two terms." He said that.
أَنَّ هَذِهِ الْآيَةَ الَّتِي فِي سُورَةِ النِّسَاءِ الْقُصْرَى {وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ} نَزَلَتْ بَعْدَ الَّتِي فِي الْبَقَرَةِ {وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا} الْآيَةَ قَالَ وَبَلَغَهُ أَنَّ عَلِيًّا قَالَ «هِي آخِرُ الْأَجَلَيْنِ» فَقَالَ ذَلِكَ
[Machine] "Whomsoever he wills to curse, I shall curse him as well. The term of the pregnant women will not be fulfilled [i.e., they will not give birth] except after [the passing of] a sign from the deceased [husband]. And those among you who pass away and leave behind wives, the wives will wait for [the completion of] four months and ten [days]."
مَنْ شَاءَ لَاعَنْتُه مَا نَزَلَتْ {وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ} إِلَّا بَعْدَ آيَةِ الْمُتَوَفَّاةِ عَنْهَا {وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا}
[Machine] The Surah An-Nisa Al-Qusra was revealed after four months and ten days.
أَنَّ سُورَةَ النِّسَاءِ الْقُصْرَى نَزَلَتْ بَعْدَ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا»
[Machine] "The waiting period of a divorced woman is from the time of divorce, and for a woman whose husband has passed away, it is from the time of his death. And whoever wishes, I share with him that Surah Al-Qasas was revealed after Al-Baqarah."
«عِدَّةُ الْمُطَلَّقَةِ مِنْ حِينِ تُطَلَّقُ وَالْمُتَوَفَّى عَنْهَا مِنْ حِينِ يُتَوَفَّى وَمَنْ شَاءَ قَاسَمْتُهُ أَنَّ سُورَةَ الْقُصْرَى أُنْزِلَتْ بَعْدَ الْبَقَرَةِ»
It was narrated from 'Abdullah that the shorter Surah, that speaks of women (At-Talaq), was revealed after Al-Baqarah. (Using translation from Nasāʾī 3523)
أَنَّ سُورَةَ الْقُصْرَى نَزَلَتْ بَعْدَ الطُّوَلِ» يَعْنِي النِّسَاءَ
[Machine] "To lay down their burdens, after the one in al-Baqarah (the cow), and those of you who pass away and leave behind wives, they should wait by themselves."
أَنْ يَضَعْنَ حَمْلَهُنَّ} بَعْدَ الَّتِي فِي الْبَقَرَةِ {وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ}
[Machine] Abdullah said, "Have you not seen if four months and ten have passed and she has not delivered her pregnancy?" They said, "Wait until she delivers." Abdullah then said, "You impose hardship on her and do not allow her leniency, even though the verse of Al-Qasas was revealed after At-Tulah (i.e. she has reached the age of 40) [saying], 'And the pregnant women, their term [of pregnancy] is until they give birth.'" So when she delivers her pregnancy, the waiting period is considered completed.
عَبْدُ اللهِ أَفَرَأَيْتُمْ إِنْ مَضَتْ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ وَلَمْ تَضَعْ حَمْلَهَا؟ فَقَالُوا حَتَّى تَضَعَ فَقَالَ عَبْدُ اللهِ فَتَجْعَلُونَ عَلَيْهَا التَّغْلِيظَ وَلَا تَجْعَلُونَ لَهَا الرُّخْصَةَ إِنْ نَزَلَتْ آيَةُ الْقُصْرَى لَبَعْدَ الطُّولَى {وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ} إِذَا وَضَعَتْ حَمْلَهَا فَقَدِ انْقَضَتِ الْعِدَّةُ

[Machine] However, his uncle did not say this. I met Malik ibn 'Amir al-Hamdani, so I asked him. He began mentioning the hadith of Subay'ah, so I said, "I am not asking you about this. Have you heard Ibn Mas'ud say anything about it?" He said, "Yes, they mentioned it to him and he said, 'What do you say if she gives birth before the completion of the four months and ten days?' We said, 'You wait until the four months and ten days are over.' He said, 'What do you say if the four months and ten days pass before she gives birth?' We said, 'Until she gives birth.' He said, 'You make it difficult for her and you do not give her permission.' Then Surah an-Nisa' as-Sughra or al-Qusra was revealed, 'And those who are pregnant.'"
لَكِنَّ عَمَّهُ لَمْ يَكُنْ يَقُولُ هَذَا قَالَ فَلَقِيتُ مَالِكَ بْنَ عَامِرٍ الْهَمْدَانِيَّ فَسَأَلْتُهُ فَذَهَبَ يَذْكُرُ حَدِيثَ سُبَيْعَةَ فَقُلْتُ لَيْسَ عَنْ هَذَا أَسْأَلُكَ أَسَمِعْتَ ابْنَ مَسْعُودٍ يَقُولُ فِيهِ شَيْئًا؟ قَالَ نَعَمْ ذَكَرُوا ذَاكَ عِنْدَهُ فَقَالَ «مَا تَقُولُونَ إِنْ وَضَعَتْ قَبْلَ انْقِضَاءِ الْأَرْبَعَةِ أَشْهُرٍ وَعَشْرٍ؟» قُلْنَا تَنْتَظِرُ حَتَّى يَمْضِيَ الْأَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ قَالَ «فَمَا تَقُولُونَ إِنْ مَضَتِ الْأَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ قَبْلَ أَنْ تَضَعَ؟» قُلْنَا حَتَّى تَضَعَ قَالَ تَجْعَلُونَ عَلَيْهَا التَّغْلِيظَ وَلَا تَجْعَلُونَ لَهَا الرُّخْصَةَ لَنَزَلَتْ سُورَةُ النِّسَاءِ الصُّغْرَى أَوِ الْقُصْرَى بَعْدَ الطُّولَى {وَأُولَاتُ الْأَحْمَالِ}
[Machine] There was something between me and my wife that doesn't usually exist between people. She said, "If what is in your hands is under my control, then you would know what to do." He responded, "Indeed, what is in my hands is in your hands as well." She said, "Then you are divorced three times." He said, "I view it as one and you have more right to return." So, he sought the guidance of Caliph Umar and informed him of the situation. Umar then narrated the story to him and said, "Allah has dealt with men and as men they intend to do what Allah has allowed them to do, but they delegate it to women. By doing so, they mix it with soil. What do you say?" He replied, "I view it as one and he is more entitled to it." Umar said, "And I see it that way too. If you saw it differently, I would have concluded that you made a mistake." Mansoor said, "So, I said to Ibrahim, Ibn Abbas used to say, 'Allah made her statement a mistake if she said, 'I have divorced myself.' Ibrahim said, 'They are equal.'"
كَانَ بَيْنِي وَبَيْنَ امْرَأَتِي مَا يَكُونُ بَيْنَ النَّاسِ فَقَالَتْ لَوْ أَنَّ الَّذِي بِيَدِكَ مِنْ أَمْرِي بِيَدِي لَعَلِمْتَ كَيْفَ أَصْنَعُ فَقَالَ فَإِنَّ الَّذِي بِيَدِي مِنْ أَمْرِكِ بِيَدِكِ قَالَتْ فَأَنْتَ طَالِقٌ ثَلَاثًا قَالَ «أُرَاهَا وَاحِدَةً وَأَنْتَ أَحَقُّ بِالرَّجْعَةِ» وَسَأَلْقَى أَمِيرَ الْمُؤْمِنِينَ عُمَرَ فَلَقِيَهُ فَقَصَّ عَلَيْهِ الْقِصَّةَ فَقَالَ «فَعَلَ اللهُ بِالرِّجَالِ وَفَعَلَ اللهُ بِالرِّجَالِ يَعْمِدُونَ إِلَى مَا جَعَلَهُ اللهُ بِأَيْدِيهِمْ فَيَجْعَلُونَهُ بِأَيْدِي النِّسَاءِ بِفِيهَا التُّرَابُ مَاذَا قُلْتَ؟» قَالَ قُلْتُ «أُرَاهَا وَاحِدَةً وَهُوَ أَحَقُّ بِهَا» قَالَ «وَأَنَا أَرَى ذَلِكَ وَلَوْ رَأَيْتَ غَيْرَ ذَلِكَ رَأَيْتُ أَنَّكَ لَمْ تُصِبْ» قَالَ مَنْصُورٌ فَقُلْتُ لِإِبْرَاهِيمَ فَإِنَّ ابْنَ عَبَّاسٍ كَانَ يَقُولُ خَطَّأَ اللهُ نَوْءَهَا لَوْ كَانَتْ قَالَتْ قَدْ طَلَّقْتُ نَفْسِي قَالَ إِبْرَاهِيمُ هُمَا سَوَاءٌ
[Machine] There was some conversation between me and my wife. She said, "If the matter was in my hands, you would know what I would do." So I said, "Indeed, I testify that the matter in your hands is in your hands." She said, "Then you are divorced three times." Ibn Mas'ood said, "It is only one divorce and you have more right to her. I will ask the Commander of the Faithful about this." He mounted his camel and met Umar and told him the story. Umar said, "By Allah, Allah has placed authority in men's hands and they act according to what Allah has placed in their hands regarding the matter of women. Do you not see?" I said, "I see it as one divorce and he has more right to her." He said, "Yes, what you have seen is correct. If you had seen something different, it would not have been correct."
إِنَّهُ كَانَ بَيْنِي وَبَيْنَ امْرَأَتِي بَعْضُ الْكَلَامِ فَقَالَتْ لَوْ أَنَّ الَّذِي مِنْ أَمْرِي بِيَدِي لَعَلِمْتَ كَيْفَ أَصْنَعُ فَقُلْتُ فَإِنِّي أُشْهِدُكِ أَنَّ الَّذِي مِنْ أَمْرِكِ بِيَدِي بِيَدِكِ قَالَتْ فَأَنْتَ طَالِقٌ ثَلَاثًا قَالَ ابْنُ مَسْعُودٍ «فَهِيَ وَاحِدَةٌ وَأَنْتَ أَحَقُّ بِهَا وَسَأَسْأَلُ عَنْ ذَلِكَ أَمِيرَ الْمُؤْمِنِينَ» فَرَكِبَ فَلَقِيَ عُمَرَ فَقَصَّ عَلَيْهِ الْقِصَّةَ فَقَالَ «بِفِيهَا الْحَجَرُ فَعَلَ اللهُ بِالرِّجَالِ وَفَعَلَ يَعْمِدُونَ إِلَى مَا جَعَلَ اللهُ فِي أَيْدِيهِمْ مِنْ أَمْرِ النِّسَاءِ فَيَجْعَلُونَهُ فِي أَيْدِيَهِنَّ مَا تَرَى؟» قُلْتُ «أُرَاهَا وَاحِدَةً وَهُوَ أَحَقُّ بِهَا» قَالَ «نَعْمَ مَا رَأَيْتَ وَلَوْ رَأَيْتَ غَيْرَ ذَلِكَ لَمْ تُصِبْ»
عُمَرُ «وَأَنَا أَرَى ذَلِكَ»
أَنْ تَقْضِيَ شَيْئًا فَلَا أَمْرَ لَهَا»
[Machine] "If she chooses her husband, it is nothing. And if she chooses herself, she is one."
«إِنِ اخْتَارَتْ زَوْجَهَا فَلَيْسَ بِشَيْءٍ وَإِنِ اخْتَارَتْ نَفْسَهَا فَهِيَ وَاحِدَةٌ»
[Machine] Umar and Ibn Mas'ud said, "If a woman chooses herself, then she is one, and if she chooses her husband, then there is nothing."
عُمَرُ وَابْنُ مَسْعُودٍ «إِنِ اخْتَارَتْ نَفْسَهَا فَهِيَ وَاحِدَةٌ وَإِنِ اخْتَارَتْ زَوْجَهَا فَلَا شَيْءَ»
[Machine] 'Omar and Ibn Mas'ud said regarding your matter, "If she chooses for herself, then it is her right, and if she chooses her husband, then there is nothing wrong with it."
أَنَّ عُمَرَ وَابْنَ مَسْعُودٍ قَالَا فِي أَمْرِكِ بِيَدِكِ «إِنِ اخْتَارَتْ نَفْسَهَا فَوَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا وَإِنِ اخْتَارَتْ زَوْجَهَا فَلَيْسَ بِشَيْءٍ»
