١٩۔١۔٦٦ بَابٌ
[Machine] Umar and Ibn Masood said, "If she chooses her husband, then there is no problem. But if she chooses herself, then she is one and she has the right to return."
عُمَرُ وَابْنُ مَسْعُودٍ «إِنِ اخْتَارَتْ زَوْجَهَا فَلَا بَأْسَ وَإِنِ اخْتَارَتْ نَفْسَهَا فَهِيَ وَاحِدَةٌ وَلَهُ عَلَيْهَا الرَّجْعَةُ»
«هِي ثَلَاثٌ»
[Machine] They gather during the day, then each one of them returns to her house at night.
«تَجْتَمِعْنَ بِالنَّهَارِ ثُمَّ تَرْجِعُ كُلُّ وَاحِدَةٍ مِنْهُنَّ إِلَى بَيْتِهَا بِاللَّيْلِ»
[Machine] Ali and Ibn Mas'ood said: "If a man divorces his wife and then takes her back, he may not curse her. And if he divorces her and then marries her, he may not curse her."
عَلِيٌّ وَابْنُ مَسْعُودٍ «إِنْ قَذَفَهَا وَقَدْ طَلَّقَهَا وَلَهُ عَلَيْهَا رَجْعَةٌ لَاعَنَهَا وَإِنْ قَذَفَهَا وَقَدْ طَلَّقَهَا وَبَتَّهَا لَمْ يُلَاعِنْهَا»
«لَا يَجْتَمِعُ الْمُتَلَاعِنَانِ أَبَدًا»
[Machine] "The entire inheritance of the cursed son belongs to his mother."
«مِيرَاثُ ابْنِ الْمُلَاعَنَةِ كُلُّهُ لِأُمِّهِ»
[Machine] Ali and Ibn Mas'ud said, "The offspring of the cursed one is also cursed, just as his mother is cursed."
عَنْ عَلِيٍّ وَابْنِ مَسْعُودٍ قَالَا «عَصَبَةُ ابْنُ الْمُلَاعَنَةِ عَصَبَةُ أُمِّهِ»
[Machine] If Allah were to take a covenant from a breath in the womb of a man, then pour it onto a line, surely He would bring it out from that line. So, if you wish, complete it, and if you wish, leave it.
«لَوْ أَخَذَ اللهُ مِيثَاقَ نَسَمَةٍ فِي صُلْبِ رَجُلٍ ثُمَّ أَفْرَغَهُ عَلَى صَفًا لَأَخْرَجَهُ مِنْ ذَلِكَ الصَّفَا فَإِنْ شِئْتَ فَأَتِمَّ وَإِنْ شِئْتَ فَلَا تَعْزِلْ»
فِي الْعَزْلِ «هِيَ الْمَوْءُودَةُ الْخَفِيَّةُ»
[Machine] Ibn Masood disliked combining the two sisters (in marriage) through the right of inheritance.
«أَنَّ ابْنَ مَسْعُودٍ كَرِهَ جَمْعًا بَيْنَ الْأُخْتَيْنِ فِي مِلْكِ الْيَمِينِ»
[Machine] That Ibn Mas'ood used to hate the slave and her mother.
«أَنَّ ابْنَ مَسْعُودٍ كَانَ يَكْرَهُ الْأَمَةَ وَأُمَّهَا»
[Machine] Ibn Mas'ood used to dislike Al-A'mah and her mother.
«أَنَّ ابْنَ مَسْعُودٍ كَانَ يَكْرَهُ الْأَمَةَ وَأُمَّهَا»
[Machine] "I detest that your people associate partners with Me."
«وَأَكْرَهُ أَمَتَكَ مُشْرِكَةً»
[Machine] We debated about the reading of this verse {وَيَعْلَمُ مَا تَفْعَلُونَ} or ['tata'loon']? So I went to Ibn Mas'ood to ask him about that. While I was with him, a man came to him and said, "O Abu 'Abd al-Rahman, a man has committed adultery with his wife, but then they repented and resolved it." So Abdullah recited this verse {وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ}.
امْتَرَيْنَا فِي قِرَاءَةِ هَذَا الْحَرْفِ {وَيَعْلَمُ مَا تَفْعَلُونَ} أَوْ تَفْعَلُونَ؟ فَأَتَيْتُ ابْنَ مَسْعُودٍ لِأَسْأَلَهُ عَنْ ذَلِكَ فَبَيْنَا أَنَا عِنْدَهُ إِذْ أَتَاهُ آتٍ فَقَالَ يَا أَبَا عَبْدِ الرَّحْمَنِ رَجُلٌ أَصَابَ مِنِ امْرَأَتِهِ فُجُورًا ثُمَّ تَابَا وَأَصْلَحَا فَتَلَا عَبْدُ اللهِ هَذِهِ الْآيَةَ {وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ وَيَعْلَمُ مَا تَفْعَلُونَ}
[Machine] "They are both adulterers who have come together." Ibn Mas'ud was asked, "What do you think if they repent?" He said, "He is the One who accepts repentance from His servants and pardons sins." Ibn Mas'ud kept repeating this statement until I said, "Indeed, he does not see any harm in it."
«هُمَا زَانِيَانِ مَا اجْتَمَعَا» فَقِيلَ لِابْنِ مَسْعُودٍ أَفَرَأَيْتَ إِنْ تَابَا؟ فَقَالَ {وَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ} فَلَمْ يَزَلِ ابْنُ مَسْعُودٍ يُرَدِّدُهَا حَتَّى قُلْتُ إِنَّهُ لَا يَرَى بِهِ بَأْسًا
عَنِ السَّيِّئَاتِ} الْآيَةُ
[Machine] He said, "They both committed adultery by having sexual relations."
أَنَّهُ قَالَ «هُمَا زَانِيَانِ مَا اجْتَمَعَا»
[Machine] Ibn Mas'ud and Aisha both said, "They will continue to be adulterers as long as they continue to meet."
عَنِ ابْنِ مَسْعُودٍ وَعَائِشَةَ قَالَا «لَا يَزَالَانِ زَانِيَيْنِ مَا اجْتَمَعَا»
أَنْ يَطَأَ الرَّجُلُ أَمَتَهُ بَغْيًا»
[Machine] "Half of the punishment is upon it, and it does not have half of the leniency."
«يَكُونُ عَلَيْهَا نِصْفُ الْعَذَابِ وَلَا يَكُونُ لَهَا نِصْفُ الرُّخْصَةِ»
«تُسْتَبْرَأُ الْأَمَةُ بِحَيْضَةٍ»
«الطَّلَاقُ وَالْعِدَّةُ بِالْمَرْأَةِ»
[Machine] "Divorce is for men, and waiting period is for women."
«الطَّلَاقُ بِالرِّجَالِ وَالْعِدَّةُ بِالنِّسَاءِ»
[Machine] "If a slave woman is freed by someone, and she does not know whether she has the option [to stay or to leave] or she was not given a choice, until her husband frees her or until he dies or she dies [in which case] they [her children or inheritors] inherit [her]."
«إِنْ أُعْتِقَتْ عِنْدَ عَبْدٍ فَلَمْ تَعْلَمْ أَنَّ لَهَا الْخِيَارَ أَوْ لَمْ تُخَيَّرْ حَتَّى عَتَقَ زَوْجُهَا أَوْ حَتَّى يَمُوتَ أَوْ تَمُوتَ تَوَارَثَا»
[Machine] Ibn Mas'ood said: "The similitude of one who frees his secret thoughts and then marries them is like the similitude of someone who presents his body and then rides upon it."
ابْنُ مَسْعُودٍ «مَثَلُ الَّذِي يَعْتِقُ سَرِيَّتَهُ ثُمَّ يَنْكِحُهَا كَمَثَلِ الَّذِي أَهْدَى بَدَنَتَهُ ثُمَّ رَكِبَهَا»
«بَيْعُهَا طَلَاقُهَا»
[Machine] "If you must do it, then make it part of her share."
«إِنْ كُنْتُمْ لَا بُدَّ فَاعِلِينَ فَاجْعَلُوهَا فِي نَصِيبِ وَلَدِهَا»
[Machine] Omar, we definitely find this to be true. I don't desire anything, and yet I am told that I only go to the daughters of so-and-so to look at them. At this point, Abdullah bin Mas'ood said to him, "Didn't you know that Ibrahim complained to Allah about the nature of Sarah's womb? It was said to him, 'She was created from a rib, so wear her according to what she had in her, as long as it does not bring disgrace upon her in her religion.'" Upon hearing this, Omar said, "Indeed, Allah has filled your heart with much knowledge."
عُمَرُ إِنَّا لَنَجِدُ ذَلِكَ حَتَّى إِنِّي لَأُرِيدُ الْحَاجَةَ فَيُقَالُ لِي مَا تَذْهَبُ إِلَّا إِلَى فَتَيَاتِ بَنِي فُلَانٍ تَنْظُرُ إِلَيْهِنَّ فَقَالَ لَهُ عِنْدَ ذَلِكَ عَبْدُ اللهِ بْنُ مَسْعُودٍ أَمَا بَلَغَكَ أَنَّ إِبْرَاهِيمَ شَكَى إِلَى اللهِ ﷻ ذَرَا خُلُقَ سَارَةَ فَقِيلَ لَهُ إِنَّمَا خُلِقَتْ مِنْ ضِلْعٍ فَالْبَسْهَا عَلَى مَا كَانَ فِيهَا مَا لَمْ تَرَ عَلَيْهَا خِزْيَةً فِي دِينِهَا فَقَالَ لَهُ عُمَرُ لَقَدْ حَشَى اللهُ بَيْنَ أَضْلَاعِكَ عِلْمًا كَثِيرًا
[Machine] Abdullah ibn Mas'ud in the pre-islamic era committed adultery, and the punishment for this is one hundred lashes and a year of exile.
عَبْدُ اللهِ بْنُ مَسْعُودٍ فِي الْبِكْرِ يَزْنِي بِالْبِكْرِ «يُجْلَدَانِ مِائَةً مِائَةً وَيُنْفَيَانِ سَنَةً»
[Machine] Ibn Masud regarding a man who causes harm to the fetus of his wife: "If he forced her, she is to be set free and he must pay her a fine equal to what he caused. And if she willingly obeyed him, he shall keep her and pay her a fine equal to what he caused."
ابْنُ مَسْعُودٍ فِي الرَّجُلِ يُصِيبُ وَلِيدَةَ امْرَأَتِهِ «إِنْ كَانَ اسْتَكْرَهَهَا عَتَقَتْ وَغُرِّمَ لَهَا مِثْلَهَا وَإِنْ كَانَتْ طَاوَعَتْهُ أَمْسَكَهَا هُوَ وَغُرِّمَ لَهَا مِثْلَهَا»
[Machine] "Then we will stone you, if you are telling the truth," they said. He replied: "He only had relations with his neighbor's wife." Abdullah then said: "If you are compelled to do it, then free her and give your wife a slave girl in her place." He said: "By Allah, I did indeed compel her and strike her." However, he was not stoned because the Prophet had ordered that he be struck, not stoned, and this punishment was carried out without exceeding the prescribed limit."
«إِذًا نَرْجُمُكَ إِنْ كُنْتَ أَحْصَنْتَ» فَقَالُوا إِنَّمَا أَتَى جَارِيَةَ امْرَأَتِهِ فَقَالَ عَبْدُ اللهِ «إِنْ كُنْتَ اسْتَكْرَهْتَهَا فَأَعْتِقْهَا وَأَعْطِ امْرَأَتَكَ جَارِيَةً مَكَانَهَا» فَقَالَ وَاللهِ لَقَدِ اسْتَكْرَهْتُهَا وَضَرَبْتُهَا فَلَمْ يَرْجُمْهُ وَأَمَرَ بِهِ فَضُرِبَ دُونَ الْحَدِّ
[Machine] "It is not permissible in this nation to be naked, nor is it allowed to be partially naked, nor to be shamelessly exposed, nor to be indecent."
«لَا يَحِلُّ فِي هَذِهِ الْأَمَةِ التَّجْرِيدُ وَلَا مَدٌّ وَلَا غَلٌّ وَلَا صَفْدٌ»
«إِسْلَامُهَا إِحْصَانُهَا»
[Machine] "Abdullah, O you who have believed, do not prohibit the good things which Allah has made lawful to you. Set free a slave."
عَبْدُ اللهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ} أَعْتِقْ رَقَبَةً
[Machine] Abdullah (O you who have believed, do not declare unlawful the good things which Allah has made lawful for you.) Set free a slave.
عَبْدُ اللهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ} أَعْتِقْ رَقَبَةً
[Machine] "Abdullah, O believers, do not forbid the good things that Allah has made lawful for you. Set free a person in bondage."
عَبْدُ اللهِ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ} أَعْتِقْ رَقَبَةً
[Machine] "O Abu Abdur Rahman, indeed I have sworn not to sleep on my bed for a year, then Abdullah recited this verse to me, 'O you who have believed, do not prohibit the good things which Allah has made lawful to you and do not transgress. Indeed, Allah does not like the transgressors.' Cancel your oath and sleep on your bed." He said, "Indeed, I am unable." He said, "Then free a slave."
يَا أَبَا عَبْدِ الرَّحْمَنِ إِنِّي حَلَفْتُ أَنْ لَا أَنَامَ عَلَى فِرَاشِي سَنَةً فَتَلَا عَبْدُ اللهِ هَذِهِ الْآيَةَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ وَلَا تَعْتَدُوا إِنَّ اللهَ لَا يُحِبُّ الْمُعْتَدِينَ} كَفِّرْ يَمِينَكَ وَنَمْ عَلَى فِرَاشِكَ قَالَ إِنِّي مُوسِرٌ قَالَ أَعْتِقْ رَقَبَةً
[Machine] "O Abu Abdullah, I have sworn not to sleep on my bed for a year, so Abdullah recited this verse { O you who have believed, do not prohibit the good things which Allah has made lawful to you and do not transgress. Indeed, Allah does not like the transgressors.} Cancel your oath and sleep on your bed." He said, "I am determined." He said, "Then free a slave."
يَا أَبَا عَبْدِ الرَّحْمَنِ إِنِّي حَلَفْتُ أَنْ لَا أَنَامَ عَلَى فِرَاشِي سَنَةً فَتَلَا عَبْدُ اللهِ هَذِهِ الْآيَةَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ وَلَا تَعْتَدُوا إِنَّ اللهَ لَا يُحِبُّ الْمُعْتَدِينَ} كَفِّرْ يَمِينَكَ وَنَمْ عَلَى فِرَاشِكَ قَالَ إِنِّي مُوسِرٌ قَالَ أَعْتِقْ رَقَبَةً
[Machine] "O Abu Abdurrahman, verily I have taken an oath to not sleep on my bed for a year, but Abdullah recited this verse to me: O you who have believed, do not prohibit the good things which Allah has made lawful to you and do not transgress. Indeed, Allah does not like transgressors." He said, "Break your oath and sleep on your bed." I said, "I am unable." He said, "Then free a slave."
يَا أَبَا عَبْدِ الرَّحْمَنِ إِنِّي حَلَفْتُ أَنْ لَا أَنَامَ عَلَى فِرَاشِي سَنَةً فَتَلَا عَبْدُ اللهِ هَذِهِ الْآيَةَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُحَرِّمُوا طَيِّبَاتِ مَا أَحَلَّ اللهُ لَكُمْ وَلَا تَعْتَدُوا إِنَّ اللهَ لَا يُحِبُّ الْمُعْتَدِينَ} كَفِّرْ يَمِينَكَ وَنَمْ عَلَى فِرَاشِكَ قَالَ إِنِّي مُوسِرٌ قَالَ أَعْتِقْ رَقَبَةً
[Machine] "What does 'Umar, the son of Mas'ud, say?" He said, "I did that." They said, "Did you see that?" He said, "Yes." So they said, "We came to seek his advice, and there he is seeking theirs."
عُمَرُ لِابْنِ مَسْعُودٍ مَا يَقُولُ هَؤُلَاءِ؟ قَالَ قَدْ فَعَلْتُ ذَلِكَ قَالَ أَوَرَأَيْتَ ذَلِكَ؟ قَالَ نَعَمْ فَقَالُوا أَتَيْنَاهُ نَسْتَأْدِيهِ فَإِذَا هُوَ يَسْأَلُهُ
[Machine] "From the servants of Allah, do whatever you are able to do."
عَنْ عَبَّادِ اللهِ مَا اسْتَطَعْتُمْ»
[Machine] About Ali and Ibn Masood, concerning virginity, she hesitates "that for the virgin there is a dowry equivalent to that of one of her fellow women, and for the non-virgin there is a dowry equivalent to hers."
عَنْ عَلِيٍّ وَابْنِ مَسْعُودٍ فِي الْبِكْرِ تُسْتَكْرَهُ نَفْسُهَا «أَنَّ لِلْبِكْرِ مِثْلُ صَدَاقِ إِحْدَى نِسَائِهَا وَلِلثَّيِّبِ مِثْلُ صَدَاقِ مِثْلِهَا»
[Machine] "Ali and Ibn Masood said about the captives (of war): If it is a virgin, her price is one-tenth, and if she is not a virgin, her price is half of it."
أَنَّ عَلِيًّا وَابْنَ مَسْعُودٍ قَالَا فِي الْأَمَةِ تُسْتَكْرَهُ «إِنْ كَانَتْ بِكْرًا فَعُشْرُ ثَمَنِهَا وَإِنْ كَانَتْ ثَيِّبًا فَنِصْفُ عُشْرِ ثَمَنِهَا»
[Machine] Ali and Ibn Masood said, "Both small and large amounts of breastfeeding are prohibited."
عَنْ عَلِيٍّ وَابْنِ مَسْعُودٍ قَالَا «يُحَرَّمُ مِنَ الرَّضَاعِ قَلِيلُهُ وَكَثِيرُهُ»
[Machine] Ali and Ibn Mas'ood said about breastfeeding, "Both a little and a lot of breastfeeding are prohibited."
أَنَّ عَلِيًّا وَابْنَ مَسْعُودٍ قَالَا فِي الرَّضَاعِ «يُحَرِّمُ قَلِيلُهُ وَكَثِيرُهُ»
[Machine] Umar and Ibn Mas'ood said, "The divorced woman has the right to housing and financial support."
أَنَّ عُمَرَ وَابْنَ مَسْعُودٍ قَالَا «الْمُطَلَّقَةُ ثَلَاثًا لَهَا السَّكَنُ وَالنَّفَقَةُ»
[Machine] The passage translates to: "He was among those who perform the morning prayer."
«كَانْصِرَافِ الْقَوْمِ الْمُسْفِرِينَ مِنْ صَلَاةِ الْغَدَاةِ»
[Machine] "You and your companions should donate a third of your wealth, and send a third to the family of your brother 'Utba." It was said to Sufyan, "Is this voluntary?" He said, "Yes."
«كُلْ أَنْتَ وَأَصْحَابُكَ ثُلُثًا وَتَصَدَّقَ بِثُلُثِهِ وَابْعَثْ إِلَى آلِ أَخِي عُتْبَةَ بِثُلُثٍ» قِيلَ لِسُفْيَانَ تَطَوُّعٌ؟ قَالَ «نَعَمْ»
[Machine] You hear Allah saying, "Hajj is [during] well-known months." I see nothing but the months of Hajj.
تَسْمَعِ اللهَ يَقُولُ {الْحَجُّ أَشْهُرٌ مَعْلُومَاتٌ} مَا أَرَى هَؤُلَاءِ إِلَّا أَشْهُرَ الْحَجِّ
[Machine] "The wedding is postponed for a year, and if he enters during that time, otherwise they will be separated."
«يُؤَجَّلُ الْعِنِّينُ سَنَةً فَإِنْ دَخَلَ بِهَا وَإِلَّا فُرِّقَ بَيْنَهُمَا»
