38. Division of Charity
٣٨۔ كِتَابُ قَسْمِ الصَّدَقَاتِ
I became a guarantor for a payment, and I came to Messenger of Allah (May peace be upon him). He said: Wait till I receive the sadaqah and I shall order it to be given to you. He then said : Begging, Qabisah, is allowable only to one of three classes: a man who has become a guarantor for a payment to whom begging is allowed till he gets it, after which he must stop (begging); a man who has been stricken by a calamity and it destroys his property to whom begging is allowed till he gets what will support life (or he said, what will provide a reasonable subsistence); and a man who has been smitten by poverty, about whom three intelligent members of his people confirm by saying: So and so has been smitten by poverty, to such a person begging is allowed till be gets what will support life (or he said, what will provide a reasonable subsistence), after which he must stop (begging). Any other reason for begging, Qabisah, is forbidden, and one who engages in such consumes it as a thing which is forbidden. (Using translation from Abū Dāʾūd 1640)
تَحَمَّلْتُ حَمَالَةً فَقَدِمْتُ عَلَى رَسُولِ اللهِ ﷺ فِيهَا فَقَالَ أَقِمْ يَا قَبِيصَةُ حَتَّى تَأْتِيَنَا الصَّدَقَةُ فَنَأْمُرَ لَكَ بِهَا ثُمَّ قَالَ يَا قَبِيصَةُ إنَّ الْمَسْأَلَةَ لَا تَحِلُّ إِلَّا لِإِحْدَى ثَلَاثٍ رَجُلٍ تَحَمَّلَ حَمَالَةً فَسَأَلَ فِيهَا حَتَّى يُصِيبَهَا بِهَا ثُمَّ يُمْسِكُ وَرَجُلٍ أَصَابَتْهُ جَائِحَةٌ اجْتَاحَتْ مَالَهُ فَسَأَلَ حَتَّى يُصِيبَ سِدَادًا ثُمَّ يُمْسِكُ وَرَجُلٍ أَصَابَتْهُ حَاجَةٌ شَدِيدَةٌ فَقَامَ ثَلَاثَةٌ مِنْ ذَوِي الْحِجَا مِنْ قَوْمِهِ فَقَالُوا أَصَابَتْ فُلَانًا فَاقَةٌ أَوْ حَاجَةٌ شَدِيدَةٌ فَسَأَلَ حَتَّى يُصِيبَ سِدَادًا مِنْ عَيْشٍ أَوْ قِوَامًا مِنْ عَيْشٍ ثُمَّ يُمْسِكُ وَمَا سِوَاهُنَّ مِنَ الْمَسَائِلِ سُحْتٌ يَأْكُلُهَا صَاحِبُهَا سُحْتًا قَالَهَا مَرَّتَيْنِ أَوْ ثَلَاثًا
[Machine] The Messenger of Allah said to the questioner, "It is a right, even if it comes on a horse," and in another narration, "even if it comes on his horse. 13205 Abu Ali informed us, Abu Bakr narrated to us, Abu Dawud narrated to us, Muhammad ibn Rafi narrated to us, Yahya ibn Adam narrated to us, Zuhair narrated from a sheikh, I saw Sufyan with him, from Fatimah bint Husayn, from her father, from Ali, from the Prophet, ﷺ , something similar to it."
قَالَ رَسُولُ اللهِ ﷺ لِلسَّائِلِ حَقٌّ وَإِنْ جَاءَ عَلَى فَرَسٍ وَفِي رِوَايَةِ الْفِرْيَابِيِّ وَإِنْ جَاءَ عَلَى فَرَسِهِ 13205 وَأَخْبَرَنَا أَبُو عَلِيٍّ أنبأ أَبُو بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ رَافِعٍ ثنا يَحْيَى بْنُ آدَمَ ثنا زُهَيْرٌ عَنْ شَيْخٍ رَأَيْتُ سُفْيَانَ عِنْدَهُ عَنْ فَاطِمَةَ بِنْتِ حُسَيْنٍ عَنْ أَبِيهَا عَنْ عَلِيٍّ ؓ عَنِ النَّبِيِّ ﷺ مِثْلَهُ
[Machine] Indeed, Allah has obligated upon the wealthy in their wealth to the extent of what is sufficient for their poor. So if they are hungry and naked, they strive in preventing the rich. It is a right upon Allah to hold them accountable on the Day of Resurrection and to punish them for it. إِنَّ اللهَ فَرَضَ عَلَى الْأَغْنِيَاءِ فِي أَمْوَالِهِمْ بِقَدْرِ مَا يَكْفِي فُقَرَاءَهُمْ فَإِنْ جَاعُوا وَعَرُوا جَهَدُوا فِي مَنْعِ الْأَغْنِيَاءِ فَحَقٌّ عَلَى اللهِ أَنْ يُحَاسِبَهُمْ يَوْمَ الْقِيَامَةِ وَيُعَذِّبَهُمْ عَلَيْهِ مُحَمَّدُ بْنُ عَلِيٍّ هَذَا هُوَ ابْنُ الْحَنَفِيَّةِ وَأَبُو جَعْفَرٍ هُوَ مُحَمَّدُ بِنُ عَلِيِّ بْنِ الْحُسَيْنِ وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said, "Whoever asks for what is sufficient for him will come on the Day of Resurrection with silent or wounded cheeks on his face." It was said, "O Messenger of Allah, what is sufficiency?" He said, "Fifty dirhams or their equivalent in gold." Yahya ibn Adam said, Abdullah ibn Uthman told Sufyan, my recorder, that Shu'bah was not narrating from Hakim ibn Jubayr. Sufyan said, "Zubayd informed us about Muhammad ibn Abdur Rahman ibn Yazid 13208, and Abu al-Husayn ibn al-Fadl informed us that Abdullah ibn Ja'far narrated to us, and Ya'qub ibn Sufyan mentioned the meaning of this story. Rather, it was narrated from Yahya ibn Adam from Sufyan, then Ya'qub said, "It is a distant story, and if it was a narration from Hakim ibn Jubayr to Zubayd, it would not be hidden from the people of knowledge."
قَالَ رَسُولُ اللهِ ﷺ مَنْ سَأَلَ وَلَهُ مَا يُغْنِيهِ جَاءَ يَوْمَ الْقِيَامَةِ خُمُوشٌ أَوْ خُدُوشٌ أَوْ كُدُوحٌ فِي وَجْهِهِ فَقِيلَ يَا رَسُولَ اللهِ وَمَا الْغِنَى؟ قَالَ خَمْسُونَ دِرْهَمًا أَوْ قِيمَتُهَا مِنَ الذَّهَبِ قَالَ يَحْيَى بْنُ آدَمَ فَقَالَ عَبْدُ اللهِ بْنُ عُثْمَانَ لِسُفْيَانَ حِفْظِي أَنَّ شُعْبَةَ كَانَ لَا يَرْوِي عَنْ حَكِيمِ بْنِ جُبَيْرٍ فَقَالَ سُفْيَانُ فَقَدْ حَدَّثَنَا زُبَيْدٌ عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ 13208 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يَعْقُوبُ بْنُ سُفْيَانَ فَذَكَرَ مَعْنَى هَذِهِ الْحِكَايَةِ بَلْ إِنَّمَا عَنْ يَحْيَى بْنِ آدَمَ عَنْ سُفْيَانَ ثُمَّ قَالَ يَعْقُوبُ هِيَ حِكَايَةٌ بَعِيدَةٌ وَلَوْ كَانَ حَدِيثُ حَكِيمِ بْنِ جُبَيْرٍ عَنْ زُبَيْدٍ مَا خَفِيَ عَلَى أَهْلِ الْعِلْمِ
A man from Banu Asad said : I and my family alighted at Baqi al-Gharqad. My wife said to me : Go the Messenger of Allah ﷺ and beg something from him for our eating, and made a mention of there need. So I went to the Messenger of Allah(May peace be upon him). I found with a man who was begging from him and he was saying to him: I have nothing to give you. The man turned away from him in anger while he was saying: By my life, you give anyone you wish. The Messenger of Allah(May peace be upon him) said : He’s anger with me, for I have nothing to give him. If any of you begs when he has an Uqiyah or its equivalent, he has begged immoderately. The man of Banu Asad said : So I said : The she camel of ours is better than an uqiyah, while an uqiyah is equivalent to 40 Dirhams. I therefore returned and did not beg from him. Afterwards some barley and raisins where brought to the Messenger of Allah (May peace be upon him). He gave us a share from them (or as he reported)till Allah, the Exalted, made us self-sufficient(i.e well off). Abu Dawud said: Al-Thawri narrated it as Malik narrated. لِي أَهْلِي اذْهَبْ إِلَى رَسُولِ اللهِ ﷺ فَوَجَدْتُ عِنْدَهُ رَجُلًا يَسْأَلُهُ وَرَسُولُ اللهِ ﷺ يَقُولُ مَا أَجِدُ مَا أُعْطِيكَ فَتَوَلَّى الرَّجُلُ عَنْهُ وَهُو مُغْضَبٌ وَهُوَ يَقُولُ لَعَمْرِي إِنَّكَ تُعْطِي مَنْ شِئْتَ فَقَالَ رَسُولُ اللهِ ﷺ يَغْضَبُ عَلَيَّ أَنِّي لَا أَجِدُ مَا أُعْطِيهِ مَنْ سَأَلَ مِنْكُمْ وَلَهُ أُوقِيَّةٌ أَوْ عَدْلُهَا فَقَدْ سَأَلَ إِلْحَافًا قَالَ الْأَسَدِيُّ فَقُلْتُ اللِّقْحَةُ لَكَ خَيْرٌ مِنْ أُوقِيَّةٍ وَالْأُوقِيَّةُ أَرْبَعُونَ دِرْهَمًا قَالَ فَرَجَعْتُ وَلَمْ أَسْأَلْهُ فَقَدِمَ عَلَى رَسُولِ اللهِ ﷺ بَعْدَ ذَلِكَ شَعِيرٌ وَزَبِيبٌ فَقَسَمَ لَنَا مِنْهُ حَتَّى أَغْنَانَا اللهُ قَالَ أَبُو دَاوُدَ هَكَذَا
[Machine] To my mother, O my son, go to the Messenger of Allah ﷺ and ask him something for us. So I went to him, greeted him, and sat down while he was sitting with his companions. When he faced me, he said, "Indeed, whoever seeks richness, Allah will enrich him. And whoever seeks chastity, Allah will make him chaste. And whoever seeks self-sufficiency, Allah will suffice him." He said, "I said, 'He does not want anyone except me,' so I turned away and did not speak to him about anything." My mother said to me, "What did you do?" So I informed her of the matter. She said, "We will be patient, and Allah will provide us with something." She continued to whisper to us until a need arose that was more urgent than before. She said to me, "Go to the Messenger of Allah ﷺ and ask him for something." So I went to him while he was sitting with his companions, greeted him, and sat down. He faced me and said the same words as before, and added, "And whoever asks and has livestock, then he is mutahaffif." I said to myself, "We have a ruby, which is better than livestock." He said, "The price of the ruby is forty dirhams." So I turned back without asking him. Abu 'Ubaid reported that the ruby was a female camel.
لِي أُمِّي يَا بُنِيَّ ائْتِ رَسُولَ اللهِ ﷺ فَسَلْهُ لَنَا شَيْئًا فَجِئْتُهُ فَسَلَّمْتُ عَلَيْهِ وَجَلَسْتُ وَهُوَ فِي أَصْحَابِهِ جَالِسٌ فَقَالَ حِينَ اسْتَقْبَلَنِي إِنَّهُ مَنْ يَسْتَغْنِ أَغْنَاهُ اللهُ وَمَنْ يَسْتَعْفِفْ أَعَفَّهُ اللهُ وَمَنِ اسْتَكْفَ كَفَّهُ قَالَ قُلْتُ مَا يُرِيدُ غَيْرِي فَانْصَرَفْتُ وَلَمْ أُكَلِّمْهُ فِي شَيْءٍ فَقَالَتْ لِي أُمِّي مَا فَعَلْتَ؟ فَأَخْبَرْتُهَا الْخَبَرَ قَالَ فَصَبَرْنَا وَاللهُ يَرْزُقُنَا شَيْئًا فَتَبَلَّغْنَا بِهِ حَتَّى أَلَحَّتْ عَلَيْنَا حَاجَةٌ هِيَ أَشَدُّ مِنْهَا فَقَالَتْ لِي أُمِّي ائْتِ رَسُولَ اللهِ ﷺ فَسَلْهُ لَنَا شَيْئًا قَالَ فَجِئْتُهُ وَهُوَ جَالِسٌ فِي أَصْحَابِهِ فَسَلَّمْتُ وَجَلَسْتُ فَاسْتَقْبَلَنِي وَقَالَ بِالْقَوْلِ الْأَوَّلِ وَزَادَ فِيهِ وَمَنْ سَأَلَ وَلَهُ أُوقِيَّةٌ فَهُوَ مُلْحِفٌ قُلْتُ فِي نَفْسِي لَنَا الْيَاقُوتَةُ وَهِيَ خَيْرٌ مِنْ أُوقِيَّةٍ قَالَ وَالْأُوقِيَّةُ أَرْبَعُونَ دِرْهَمًا قَالَ فَرَجَعْتُ وَلَمْ أَسْأَلْهُ قَالَ أَنْبَأَ أَبُو عُبَيْدٍ الْيَاقُوتَةُ نَاقَةٌ
"The Messenger of Allah said: 'Whoever asks when he has forty Dirhams I being too demanding when asking."' (Using translation from Nasāʾī 2594)
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ سَأَلَ وَلَهُ أَرْبَعُونَ دِرْهَمًا فَهُوَ مُلْحِفٌ
[Machine] He heard Ibn al-Hanzaliyyah al-Ansari, the companion of the Messenger of Allah ﷺ , saying that Abu al-Hasan Ali ibn Ahmad ibn Abdan informed him, and the wording is his, that Ahmad ibn Ubayd al-Saffar narrated to him, who narrated from Abu Shu'aib al-Harani, who narrated from al-Nufayliyy, who narrated from Miskin ibn Bukayr, who narrated from Muhammad ibn Muhajir, from Rabi'ah ibn Yazid, from Abu Kabsha al-Saluli. Sahl ibn al-Hanzaliyyah said, "Uyaynah ibn Hisn and al-Aqr ibn Habis came to the Messenger of Allah ﷺ and asked him for something. He ordered them to be given what they had asked for. He also ordered Mu'awiyah to write for them what they had asked for. As for al-Aqr, he wrapped his letter in his turban and left. Uyaynah took his letter and went to the Prophet ﷺ . He said, 'O Muhammad, I am carrying a letter to my people. I do not know what is in it, like a sealed document.' The Prophet ﷺ took it from him and looked at it. He said, 'What I ordered for you has been written therein.' He then mentioned the hadith and said, 'Whoever asks for something and he is wealthy, he is only increasing from the Fire.' They said, 'O Messenger of Allah, what kind of wealth is it that does not require asking?' He said, 'To have satiety for a day and night, or a night and day, without needing to ask for anything.' None of these hadiths differ, as if the Prophet ﷺ knew what would make each of them wealthy, so he made their wealth with it. This is because people differ in their sufficiency, so some are enriched with fifty dirhams, while others have income that provides them with what they need for every day's food and dinner, and they have no dependents, so they are self-sufficient with it."
أَنَّهُ سَمِعَ ابْنَ الْحَنْظَلِيَّةِ الْأَنْصَارِيَّ صَاحِبَ رَسُولِ اللهِ ﷺ يَقُولُ ح وَأنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ وَاللَّفْظُ لَهُ ثنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا أَبُو شُعَيْبٍ الْحَرَّانِيُّ ثنا النُّفَيْلِيُّ ثنا مِسْكِينُ بْنُ بُكَيْرٍ ثنا مُحَمَّدُ بْنُ مُهَاجِرٍ عَنْ رَبِيعَةَ بْنَ يَزِيدَ عَنْ أَبِي كَبْشَةَ السَّلُولِيِّ ثنا سَهْلُ ابْنُ الْحَنْظَلِيَّةِ قَالَ قَدِمَ عَلَى رَسُولِ اللهِ ﷺ عُيَيْنَةُ بْنُ حِصْنٍ وَالْأَقْرَعُ بْنُ حَابِسٍ فَسَأَلَاهُ فَأَمَرَ لَهُمَا بِمَا سَأَلَا وَأَمَرَ مُعَاوِيَةَ أَنْ يَكْتُبَ لَهُمَا بِمَا سَأَلَا قَالَ فَأَمَّا الْأَقْرَعُ فَلَفَّ كِتَابَهُ فِي عِمَامَتِهِ وَانْطَلَقَ وَأَمَّا عُيَيْنَةُ فَأَخَذَ كِتَابَهُ فَأَتَى النَّبِيَّ ﷺ فَقَالَ يَا مُحَمَّدُ تَرَى إِنِّي حَامِلٌ إِلَى قَوْمِي كِتَابًا لَا أَدْرِي مَا فِيهِ كَصَحِيفَةِ الْمُلْتَمِسِ قَالَ فَأَخَذَهُ النَّبِيُّ ﷺ فَنَظَرَ فِيهِ فَقَالَ قَدْ كُتِبَ لَكَ بِالَّذِي أَمَرْتُ لَكَ بِهِ فَذَكَرَ الْحَدِيثَ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ مَنْ سَأَلَ مَسْأَلَةً وَهُوَ مِنْهَا غَنِيٌّ فَإِنَّمَا يَسْتَكْثِرُ مِنَ النَّارِ قَالُوا يَا رَسُولَ اللهِ وَمَا الْغِنَى الَّذِي لَا يَنْبَغِي مَعَهُ الْمَسْأَلَةُ؟ قَالَ أَنْ يَكُونَ لَهُ شِبَعُ يَوْمٍ وَلَيْلَةٍ أَوْ لَيْلَةٍ وَيَوْمٍ وَلَيْسَ شَيْءٌ مِنْ هَذِهِ الْأَحَادِيثِ بِمُخْتَلِفٍ فَكَأَنَّ النَّبِيَّ ﷺ عَلِمَ مَا يُغْنِي كُلَّ وَاحِدٍ مِنْهُمْ فَجَعَلَ غِنَاهُ بِهِ وَذَلِكَ لِأَنَّ النَّاسَ يَخْتَلِفُونَ فِي قَدْرِ كِفَايَاتِهِمْ فَمِنْهُمْ مَنْ يُغْنِيهِ خَمْسُونَ دِرْهَمًا لَا يُغْنِيهِ أَقَلُّ مِنْهَا وَمِنْهُمْ مَنْ لَهُ كَسْبٌ يُدِرُّ عَلَيْهِ كُلَّ يَوْمٍ مَا يُغَدِّيهِ وَيُعَشِّيهِ وَلَا عِيَالَ لَهُ فَهُوَ مُسْتَغْنٍ بِهِ
[Machine] A man came to the Prophet ﷺ and complained to him about poverty. Then he returned and the Prophet said to him, "Go until you find something." He went and came back with a blanket and a bowl, and said, "O Messenger of Allah, they used to sleep on this blanket and wear it, and they used to drink from this bowl." The Messenger of Allah ﷺ said, "Who will take these from me for a dirham?" A man said, "I will, O Messenger of Allah." The Messenger of Allah ﷺ said, "Who will give more than a dirham?" A man said, "I will take them for two dirhams." The Prophet ﷺ said, "They are yours." Then he called the man and said to him, "Buy a dirham bundle and a dirham of food for your family." He did so and then returned to the Prophet ﷺ. The Prophet ﷺ said to him, "Go to this valley and do not leave any travelers without helping them, do not pass by any thorns without removing them, and do not bring me anything for fifteen days." He said, "I went and helped ten people." The Prophet ﷺ said, "Go and buy five dirhams of food for your family." The man said, "O Messenger of Allah, Allah has blessed me in what you have commanded me to do." The Prophet ﷺ said, "This is better for you than coming on the Day of Judgment with a dot on your face. Indeed, asking for help is only suitable for three types of people: someone with a painful wound, someone who is burdened with excessive debt, or someone who is extremely poor. The scholar said, "If he cannot fulfill his needs except with 200 or 1,000, then give him the minimum amount, as stated in the hadith of Qabeesah ibn Al-Mukhariq from the Prophet ﷺ, until he can support himself or have a sufficient livelihood. And with Allah is success."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَشَكَا إِلَيْهِ الْفَاقَةَ ثُمَّ رَجَعَ فَقَالَ لَهُ انْطَلِقْ حَتَّى تَجِدَ مِنْ شَيْءٍ قَالَ فَانْطَلَقَ فَجَاءَ بِحِلْسٍ وَقَدَحٍ فَقَالَ يَا رَسُولَ اللهِ هَذَا الْحِلْسُ كَانُوا يَفْتَرِشُونَ بَعْضَهُ وَيَلْبِسُونَ بَعْضَهُ وَهَذَا الْقَدَحُ كَانُوا يَشْرَبُونَ فِيهِ فَقَالَ رَسُولُ اللهِ ﷺ مَنْ يَأْخُذُهُمَا مِنِّي بِدِرْهَمٍ؟ فَقَالَ رَجُلٌ أَنَا يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ مَنْ يَزِيدُ عَلَى دِرْهَمٍ فَقَالَ رَجُلٌ أَنَا آخُذُهُمَا بِاثْنَيْنِ فَقَالَ هُمَا لَكَ قَالَ فَدَعَا الرَّجُلَ فَقَالَ لَهُ اشْتَرِ بِدِرْهَمٍ فَأْسًا وَبِدِرْهَمٍ طَعَامًا لِأَهْلِكَ قَالَ فَفَعَلَ ثُمَّ رَجَعَ إِلَى النَّبِيِّ ﷺ فَقَالَ انْطَلِقْ إِلَى هَذَا الْوَادِي فَلَا تَدَعْ حَاجًّا وَلَا شَوْكًا وَلَا حَطَبًا وَلَا تَأْتِينِي خَمْسَةَ عَشَرَ يَوْمًا قَالَ فَانْطَلَقَ فَأَصَابَ عَشَرَةً قَالَ فَانْطَلِقْ فَاشْتَرِ بِخَمْسَةٍ طَعَامًا لِأَهْلِكَ فَقَالَ يَا رَسُولَ اللهِ لَقَدْ بَارَكَ اللهُ لِي فِيمَا أَمَرْتَنِي فَقَالَ هَذَا خَيْرٌ مِنْ أَنْ تَجِيءَ يَوْمَ الْقِيَامَةِ وَفِي وَجْهِكَ نُكْتَةُ الْمَسْأَلَةِ إِنَّ الْمَسْأَلَةَ لَا تَصْلُحُ إِلَّا لِثَلَاثَةٍ لِذِي دَمٍ مُوجِعٍ أَوْ غُرْمٍ مُفْظِعٍ أَوْ فَقْرٍ مُفْقِعٍ قَالَ الشَّيْخُ فَإِنْ لَمْ تَقَعْ لَهُ الْكِفَايَةُ إِلَّا بِمِائَتَيْنِ أَوْ بِأُلُوفٍ أُعْطِيَ قَدْرَ أَقَلِّ الْكِفَايَةِ بِدَلِيلِ مَا رُوِّينَا فِي حَدِيثِ قَبِيصَةَ بْنِ الْمُخَارِقِ عَنِ النَّبِيِّ ﷺ حَتَّى تُصِيبَ قِوَامًا مِنْ عَيْشٍ أَوْ سِدَادًا مِنْ عَيْشٍ وَبِاللهِ التَّوْفِيقُ
