Abu bin Zamʿa and Saʿd bin Abi Waqqas carried the case of their claim of the (ownership) of the son of a slave-girl of Zamʿa before the Prophet. Saʿd said, "O Messenger of Allah ﷺ! My brother, before his death, told me that when I would return (to Mecca), I should search for the son of the slave-girl of Zamʿa and take him into my custody as he was his son." 'Abu bin Zamʿa said, 'the is my brother and the son of the slave-girl of my father, and was born or my father's bed." The Prophet ﷺ noticed a resemblance between ʿUtba and the boy but he said, "O 'Abu bin Zamʿa! You will get this boy, as the son goes to the owner of the bed. You, Sauda, screen yourself from the boy."  

أَنَّ عَبْدَ بْنَ زَمْعَةَ وَسَعْدَ بْنَ أَبِي وَقَّاصٍ اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فِي ابْنِ أَمَةِ زَمْعَةَ فَقَالَ سَعْدٌ يَا رَسُولَ اللَّهِ أَوْصَانِي أَخِي إِذَا قَدِمْتُ أَنْ أَنْظُرَ ابْنَ أَمَةِ زَمْعَةَ فَأَقْبِضَهُ فَإِنَّهُ ابْنِي وَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي فَرَأَى النَّبِيُّ ﷺ شَبَهًا بَيِّنًا فَقَالَ هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ  

Saʿd bin Abi Waqqas and 'Abu bin Zamʿa quarreled over a boy. Saʿd said, "O Messenger of Allah ﷺ! This boy is the son of my brother (ʿUtba bin Abi Waqqas) who took a promise from me that I would take him as he was his (illegal) son. Look at him and see whom he resembles." 'Abu bin Zamʿa said, "O Messenger of Allah ﷺ! This is my brother and was born on my father's bed from his slave-girl." Allah's Apostle cast a look at the boy and found definite resemblance to ʿUtba and then said, "The boy is for you, O 'Abu bin Zamʿa. The child goes to the owner of the bed and the adulterer gets nothing but the stones (despair, i.e. to be stoned to death). Then the Prophet ﷺ said, "O Sauda bint Zama! Screen yourself from this boy." So, Sauda never saw him again.  

سَعْدٌ هَذَا يَا رَسُولَ اللَّهِ ابْنُ أَخِي عُتْبَةَ بْنِ أَبِي وَقَّاصٍ عَهِدَ إِلَىَّ أَنَّهُ ابْنُهُ انْظُرْ إِلَى شَبَهِهِ وَقَالَ عَبْدُ بْنُ زَمْعَةَ هَذَا أَخِي يَا رَسُولَ اللَّهِ وُلِدَ عَلَى فِرَاشِ أَبِي مِنْ وَلِيدَتِهِ فَنَظَرَ رَسُولُ اللَّهِ ﷺ إِلَى شَبَهِهِ فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ بِنْتَ زَمْعَةَ فَلَمْ تَرَهُ سَوْدَةُ قَطُّ  

(the wife of the Prophet) ʿUtba bin Abi Waqqas entrusted (his son) to his brother Saʿd bin Abi Waqqas saying, "The son of the slave-girl of Zamʿa is my (illegal) son, take him into your custody." So during the year of the Conquest (of Mecca) Saʿd took the boy and said, "This is my brother's son whom my brother entrusted to me." 'Abu bin Zam's got up and said, "He is my brother and the son of the slave girl of my father and was born on my father's bed." Then both of them came to Allah's Apostle and Saʿd said, "O Messenger of Allah ﷺ! This is my brother's son whom my brother entrusted to me." Then 'Abu bin Zamʿa got up and said, "This is my brother and the son of the slave-girl of my father." Messenger of Allah ﷺ said, "O Abu bin Zamʿa! This boy is for you as the boy belongs to the bed (where he was born), and for the adulterer is the stone (i.e. deprivation)." Then the Prophet ﷺ said to his wife Sauda bint Zamʿa, "Screen yourself from this boy," when he saw the boy's resemblance to ʿUtba. Since then the boy did not see Sauda till he died.  

عَنْ عَائِشَةَ ؓ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ كَانَ عُتْبَةُ بْنُ أَبِي وَقَّاصٍ عَهِدَ إِلَى أَخِيهِ سَعْدِ بْنِ أَبِي وَقَّاصٍ أَنَّ ابْنَ وَلِيدَةِ زَمْعَةَ مِنِّي فَاقْبِضْهُ إِلَيْكَ فَلَمَّا كَانَ عَامُ الْفَتْحِ أَخَذَهُ سَعْدٌ فَقَالَ ابْنُ أَخِي قَدْ كَانَ عَهِدَ إِلَىَّ فِيهِ فَقَامَ عَبْدُ بْنُ زَمْعَةَ فَقَالَ أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِهِ فَتَسَاوَقَا إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ سَعْدٌ يَا رَسُولَ اللَّهِ ابْنُ أَخِي كَانَ عَهِدَ إِلَىَّ فِيهِ فَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ وَلِيدَةِ أَبِي وَقَالَ رَسُولُ اللَّهِ ﷺ هُوَ لَكَ يَا عَبْدُ ابْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ ثُمَّ قَالَ لِسَوْدَةَ بِنْتِ زَمْعَةَ احْتَجِبِي مِنْهُ لِمَا رَأَى مِنْ شَبَهِهِ بِعُتْبَةَ فَمَا رَآهَا حَتَّى لَقِيَ اللَّهَ  

Saʿd bin Abi Waqqas and 'Abu bin Zamʿa had a dispute over a boy. Saʿd said, "O Messenger of Allah ﷺ! This (boy) is the son of my brother, ʿUtba bin Abi Waqqas who told me to be his custodian as he was his son. Please notice to whom he bears affinity." And 'Abu bin Zamʿa said, "This is my brother, O Messenger of Allah ﷺ! He was born on my father's bed by his slave girl." Then the Prophet ﷺ looked at the boy and noticed evident resemblance between him and ʿUtba, so he said, "He (the toy) is for you, O 'Abu bin Zamʿa, for the boy is for the owner of the bed, and the stone is for the adulterer. Screen yourself before the boy, O Sauda bint Zamʿa." ʿAisha added: Since then he had never seen Sauda.  

سَعْدٌ هَذَا يَا رَسُولَ اللَّهِ ابْنُ أَخِي عُتْبَةَ بْنِ أَبِي وَقَّاصٍ عَهِدَ إِلَىَّ أَنَّهُ ابْنُهُ انْظُرْ إِلَى شَبَهِهِ وَقَالَ عَبْدُ بْنُ زَمْعَةَ هَذَا أَخِي يَا رَسُولَ اللَّهِ وُلِدَ عَلَى فِرَاشِ أَبِي مِنْ وَلِيدَتِهِ فَنَظَرَ رَسُولُ اللَّهِ ﷺ إِلَى شَبَهِهِ فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ بِنْتَ زَمْعَةَ قَالَتْ فَلَمْ يَرَ سَوْدَةَ قَطُّ  

"Sa'd bin Abi Waqqas and 'Abd bin Zam'ah disputed over a boy. Sa'd said: 'O Messenger of Allah! This is the son of my brother 'Utbah bin Abi Waqqas, who made me promise to look after him because he is his son. Look at whom he resembles.' 'Abd bin Zam'ah said: 'He is my brother who was born on my father's bed to his slave woman.' The Messenger of Allah looked to determine at whom he resembled, and saw that he resembled 'Utbah. He said: 'He is for you, O 'Abd! The child is the bed's and for the fornicator is the stone. Veil yourself from him, O Sawdah bint Zam'ah.' And he never saw Sawdah again."  

سَعْدٌ هَذَا يَا رَسُولَ اللَّهِ ابْنُ أَخِي عُتْبَةَ بْنِ أَبِي وَقَّاصٍ عَهِدَ إِلَىَّ أَنَّهُ ابْنُهُ انْظُرْ إِلَى شَبَهِهِ وَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وُلِدَ عَلَى فِرَاشِ أَبِي مِنْ وَلِيدَتِهِ فَنَظَرَ رَسُولُ اللَّهِ ﷺ إِلَى شَبَهِهِ فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ بِنْتَ زَمْعَةَ فَلَمْ يَرَ سَوْدَةَ قَطُّ  

Ibn Zam'ah and Sa'd (Ibn Abu Waqqas) referred a dispute to the Prophet concerning the son of Zam'ah's slave woman. Sa'd said : " O Messenger of Allah my brother (Utbah bin Abu Waqqas) left instructions in his will that when I come to Makkah, I should look for the son of the slave woman of Zam'ah and take him into my care." 'Abd bin Zam’ah said: "He is my brother and the son of the slave woman of my father; he was born on my father's bed." The Prophet ffi saw that he resembled 'Utbah, and said: "He belongs to you, O 'Abd bin Zam'ah. The child is for the bed. Observe Hijab before him, O Saudah." (sahih)  

إِنَّ عَبْدَ بْنَ زَمْعَةَ وَسَعْدًا اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فِي ابْنِ أَمَةِ زَمْعَةَ فَقَالَ سَعْدٌ يَا رَسُولَ اللَّهِ أَوْصَانِي أَخِي إِذَا قَدِمْتُ مَكَّةَ أَنْ أَنْظُرَ إِلَى ابْنِ أَمَةِ زَمْعَةَ فَأَقْبِضَهُ وَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي فَرَأَى النَّبِيُّ ﷺ شَبَهَهُ بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ بْنُ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَاحْتَجِبِي عَنْهُ يَا سَوْدَةُ  

"Sa'd bin Abi Waqqas and 'Abd bin Zam'ah disputed over a boy. Sa'd said: 'O Messenger of Allah! أَنَّهَا قَالَتْ اخْتَصَمَ سَعْدُ بْنُ أَبِي وَقَّاصٍ وَعَبْدُ بْنُ زَمْعَةَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ سَعْدٌ يَا رَسُولَ اللهِ ابْنُ أَخِي عُتْبَةَ بْنِ أَبِي وَقَّاصٍ عَهِدَ إِلَيَّ أَنَّهُ ابْنُهُ انْظُرْ إِلَى شَبَهِهِ وَقَالَ عَبْدُ بْنُ زَمْعَةَ هَذَا أَخِي يَا رَسُولَ اللهِ وُلِدَ عَلَى فِرَاشِ أَبِي فَنَظَرَ رَسُولُ اللهِ ﷺ إِلَى شَبَهِهِ فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ ابْنَةَ زَمْعَةَ قَالَتْ فَلَمْ يَرَ سَوْدَةَ قَطُّ

سَعْدٌ هَذَا يَا رَسُولَ اللهِ ابْنُ أَخِي عُتْبَةَ بْنِ أَبِي وَقَّاصٍ عَهِدَ إِلَيَّ أَنَّهُ ابْنُهُ انْظُرْ إِلَى شَبَهِهِ وَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وُلِدَ عَلَى فِرَاشِ أَبِي مِنْ وَلِيدَتِهِ فَنَظَرَ رَسُولُ اللهِ ﷺ إِلَى شَبَهِهِ فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ «هُوَ لَكَ يَا عَبْدُ الْوَلِيدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ بِنْتَ زَمْعَةَ» فَلَمْ يَرَ سَوْدَةَ قَطُّ  

[Machine] He heard Aisha saying that Sa'd ibn Abi Waqqas and Abd ibn Zam'ah had a dispute in the presence of the Messenger of Allah ﷺ. Sa'd said, "O Messenger of Allah, my brother Uthbah made me his heir." He replied, "When you reach Makkah, look for Ibn Amat Zam'ah and take hold of him, for he is my son." Abd ibn Zam'ah said, "O Messenger of Allah, my brother and the son of my father's maid was born on my father's bed, and the Messenger of Allah ﷺ saw a clear resemblance to Uthbah in him, so he said, "He belongs to you, O Abd ibn Zam'ah; the child belongs to the bed. And conceal yourself from him, O Sawdah, the wording of Al-Humaidi's narration."  

أَنَّهُ سَمِعَ عَائِشَةَ تَقُولُ اخْتَصَمَ عِنْدَ رَسُولِ اللهِ ﷺ سَعْدُ بْنُ أَبِي وَقَّاصٍ وَعَبْدُ بْنُ زَمْعَةَ فَقَالَ سَعْدٌ يَا رَسُولَ اللهِ إِنَّ أَخِي عُتْبَةَ أَوْصَانِي فَقَالَ إِذَا قَدِمْتَ مَكَّةَ فَانْظُرِ ابْنَ أَمَةِ زَمْعَةَ فَاقْبِضْهُ؛ فَإِنَّهُ ابْنِي وَقَالَ عَبْدُ بْنُ زَمْعَةَ يَا رَسُولَ اللهِ أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي فَرَأَى رَسُولُ اللهِ ﷺ شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ لَفْظُ حَدِيثِ الْحُمَيْدِيِّ  

A’ishah said “Sa’d bin Abi Waqqas and ‘Abd bin Zamah disputed amongst themselves about the (relationship of the) son of the slave girl of Zam’ah and brought the case to the Apostle of Allaah ﷺ. Sa’d said “My brother ‘Utbah enjoined me that when I came to Makkah I should see the son of the slave girl of Zam’ah and take his possession for that is his son”. ‘Abd bin Zam’ah said “He is my brother, the son of my father’s slave girl having been born on my father’s bed”. The Apostle of Allaah ﷺ saw his clear resemblance to ‘Utbah. So he said “The child is attributed to the one on whose bed it is born and the fornicator is deprived of any right (lit. the fornicator will have the stone). Veil yourself from him, Saudah. Musaddad added in his version “he is your brother ‘Abd”. (Using translation from Abū Dāʾūd 2273)   

عَبْدَ بْنَ زَمْعَةَ وَسَعْدًا اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فِي ابْنِ أَمَةِ زَمْعَةَ فَقَالَ سَعْدٌ يَا رَسُولَ اللهِ أَوْصَانِي أَخِي إِذَا قَدِمْتُ مَكَّةَ أَنْظُرُ إِلَى ابْنِ أَمَةِ زَمْعَةَ فَأَقْبِضُهُ فَإِنَّهُ ابْنِي فَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ أَخْرَجَاهُ فِي الصَّحِيحَيْنِ مِنْ حَدِيثِ سُفْيَانَ بْنِ عُيَيْنَةَ  

"عَنْ عَائِشَةَ قَالَتْ: اخْتَصَمَ سَعْدُ بنُ أَبِي وَقَاصٍ، وَعَبْدُ بْنُ زَمْعَةَ فِي غُلَامٍ، فَقَالَ سَعْدٌ: يَا رَسُولَ اللهِ! (أَخي) عتبة بنُ أَبِي وَقَّاصٍ (عَهد إليَّ) أَنَّه ابنه انْظُر إِلى شَبَهِهِ، قَالَ عَبْدُ بْنُ زَمْعَةَ: هَذَا أَخِي يَا رَسُولَ اللهِ، ولُدَ عَلَى فِرَاش أَبِي مِنْ وَلِيدَتِهِ، فَنَظَرَ رَسُولُ اللهِ ﷺ فَرَأَى بَيْنَهمَا شبها بينًا بعتبة، فَقَالَ: هُوَ لَكَ يَا عَبْدُ، الوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الحَجَرُ، وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ، فَلَمْ تَرَهُ سَوْدَةُ قَطُّ".
