18. Emancipation of Slaves (3/4)

١٨۔ كِتَابُ الْعِتْقِ ص ٣

nasai-kubra:4957Muḥammad b. ʿAbdullāh b. Bazīʿ > Yazīd > Yūnus > al-Ḥasan > ʿImrān b. Ḥaṣīn

A man who had no other property emancipated six slaves of his at the time of the death. When the Prophet ﷺ was informed about it, he spoke severely of him. He then called them, divided them into three sections, cast lots among them, and emancipated two and kept four in slavery. (Using translation from Abū Dāʾūd 3958)

أَنَّ رَجُلًا أَعْتَقَ سِتَّةَ أَعْبُدٍ لَمْ يَكُنْ لَهُ مَالٌ غَيْرَهُمْ فَأَعْتَقَهُمْ عِنْدَ مَوْتِهِ فَرُفِعَ إِلَى النَّبِيِّ ﷺ «فَكَرِهَ ذَلِكَ ثُمَّ جَزَّأَهُمْ ثَلَاثَةَ أَجْزَاءٍ فَأَقْرَعَ بَيْنَهُمْ فَأَعْتَقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً»

[Machine] A man freed six slaves he had upon his death, and he had no other wealth besides them. So the Messenger of Allah heard about them, struck his hand to his thigh between them, freed two and returned four to slavery.  

الكبرى للنسائي:٤٩٥٨أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا الْحَجَّاجُ بْنُ الْمِنْهَالِ قَالَ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ أَيُّوبَ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ عِمْرَانَ بْنِ حَصِينٍ وَقَتَادَةُ وَحُمَيْدٌ وَسِمَاكُ بْنُ حَرْبٍ عَنِ الْحَسَنِ عَنْ عِمْرَانَ بْنِ حَصِينٍ

أَنَّ رَجُلًا أَعْتَقَ سِتَّةً مَمْلُوكِينَ لَهُ عِنْدَ مَوْتِهِ وَلَيْسَ لَهُ مَالٌ غَيْرَهُمْ «فَأَقْرَعَ رَسُولُ اللهِ ﷺ بَيْنَهُمْ فَأَعْتَقَ اثْنَيْنِ وَرَدَّ أَرْبَعَةً فِي الرِّقِّ»

[Machine] A man from among the Muslims during the time of the Messenger of Allah ﷺ passed away, leaving behind six slaves. He had emancipated them all before his death and did not leave any wealth other than them. So, it was raised to the Messenger of Allah ﷺ , who then divided them amongst themselves, freeing two of them and distributing the remaining four among the other companions.

أَنَّ رَجُلًا مِنَ الْمُسْلِمِينَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ تُوُفِّيَ وَتَرَكَ سِتَّةً مِنَ الرَّقِيقِ وَأَنَّهُ أَعْتَقَهُمْ عِنْدَ الْمَوْتِ أَجْمَعِينَ وَلَمْ يَدَعْ مَالًا غَيْرَهُمْ فَرُفِعَ إِلَى رَسُولِ اللهِ ﷺ «فَأَقْرَعَ رَسُولُ اللهِ ﷺ بَيْنَهُمْ فَأَعْتَقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً»

[Machine] A man freed six slaves that he owned at the time of his death. He had no other wealth except for them during the time of the Prophet ﷺ. So he divided them into six parts and freed two and gifted four.

أَنَّ رَجُلًا أَعْتَقَ سِتَّةَ أَعْبُدٍ لَهُ عِنْدَ مَوْتِهِ لَمْ يَكُنْ لَهُ مَالٌ غَيْرَهُمْ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ «فَجَزَّأَهُمْ أَجْزَاءً فَأَعْتَقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً»

If anyone emancipates a slave who has property, the property of the slave belongs to him except that the master makes a stipulation. (Using translation from Abū Dāʾūd 3962)

[Machine] The Messenger of Allah ﷺ said: "Whoever frees a slave and he has wealth, then his wealth belongs to him unless he chooses to give it to him."

قَالَ رَسُولُ اللهِ ﷺ «مَنْ أَعْتَقَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لَهُ إِلَّا أَنْ يَسْتَثْنِيَهُ السَّيِّدُ»

[Machine] The Messenger of Allah ﷺ said: "Whichever man sells a palm tree that has been pollinated and its fruit has ripened, its fruit belongs to the buyer unless the seller specifies otherwise. And whichever man sells a slave while still possessing wealth, his wealth belongs to his lord unless the buyer stipulates otherwise." Shu'bah said: "I told him this Hadith with the narration of Ayyub from Nafi' that he narrated from the Prophet ﷺ regarding the palm tree and from 'Umar regarding the slave." 'Abd, said: "I do not know both of them except from the Prophet ﷺ" Then he repeated it another time and narrated it from the Prophet ﷺ without any doubt.

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْأَوَّلِ وَأَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا وَلَهُ مَالٌ فَمَالُهُ لِرَبِّهِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» قَالَ شُعْبَةُ فَحَدَّثْتُهُ بِحَدِيثِ أَيُّوبَ عَنْ نَافِعٍ أَنَّهُ حَدَّثَنِي بِالنَّخْلِ عَنِ النَّبِيِّ ﷺ وَالْمَمْلُوكِ عَنْ عُمَرَ فَقَالَ عَبْدُ رَبِّهِ لَا أَعْلَمُهُمَا جَمِيعًا إِلَّا عَنِ النَّبِيِّ ﷺ ثُمَّ قَالَ مَرَّةً أُخْرَى فَحَدَّثَ عَنِ النَّبِيِّ ﷺ وَلَمْ يَشُكَّ

[Machine] The Messenger of Allah ﷺ said, "Whoever sells a slave and has wealth, then the wealth is his except if the buyer specifies a condition. And whoever irrigates a palm tree and then sells it after it has been watered, then its fruits are his except if the buyer specifies a condition."  

الكبرى للنسائي:٤٩٦٤أَخْبَرَنِي عَمْرُو بْنُ عُثْمَانَ عَنِ الْوَلِيدِ عَنْ حَفْصٍ وَهُوَ ابْنُ غَيْلَانَ عَنْ سُلَيْمَانَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ وَعَنْ عَطَاءٍ عَنْ جَابِرٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَلَهُ مَالُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَهُ بَعْدَ تَأْبِيرِهِ فَلَهُ ثَمَرُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»

The Prophet ﷺ as saying: If anyone buys a slave who possesses property. his property belongs to the seller unless buyer makes a provision and if anyone buys palm-trees after they have been fecundated, the fruit belongs to the seller unless the buyer make a provision. (Using translation from Abū Dāʾūd 3433)

قَالَ رَسُولُ اللهِ ﷺ «مَنِ ابْتَاعَ نَخْلًا مُؤَبَّرًا فَثَمَرَتُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِسَيِّدِهِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»

[Machine] Umar spent his life as a slave being sold, and he had wealth. However, his wealth belongs to his master who sold him, unless the buyer stipulates his own payment.

«قَضَى عُمَرُ فِي الْعَبْدِ يُبَاعُ وَلَهُ مَالٌ فَإِنَّ مَالَهُ لِسَيِّدِهِ الَّذِي بَاعَهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ مَالَهُ»

الكبرى للنسائي:٤٩٧٠أَخْبَرَنَا هِلَالُ بْنُ الْعَلَاءِ بْنِ هِلَالٍ قَالَ حَدَّثَنِي أَبِي حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ عَنِ ابْنِ إِسْحَاقَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «مَنِ ابْتَاعَ نَخْلًا مُؤَبَّرًا فَثَمَرَتُهُ لِلْبَائِعِ الْأَوَّلِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»

"Whoever buys a date-palm tree after it has been pollinated, its fruits belong to the seller, unless the purchaser has stipulated otherwise. And whoever buys a slave who has wealth, his wealth belongs to the seller, unless the purchaser has stipulated otherwise. "(sahih) (Using translation from Nasāʾī 4636)  

الكبرى للنسائي:٤٩٧١أَخْبَرَنَا هِلَالُ بْنُ الْعَلَاءِ حَدَّثَنِي أَبِي قَالَ حَدَّثَنَا هُشَيْمٌ عَنْ سُفْيَانَ بْنِ حُسَيْنٍ عَنِ الزُّهْرِيِّ عَنْ سَالِمٍ عَنْ أَبِيهِ عَنْ عُمَرَ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «مَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا قَدْ أُبِّرَ فَثَمَرَتُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»

"Whoever buys a date-palm tree after it has been pollinated, its fruits belong to the seller, unless the purchaser has stipulated otherwise. And whoever buys a slave who has wealth, his wealth belongs to the seller, unless the purchaser has stipulated otherwise. "(sahih) (Using translation from Nasāʾī 4636)

عَنِ النَّبِيِّ ﷺ قَالَ «مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»

[Machine] The Messenger of Allah ﷺ said, "Whoever sells a slave, his wealth belongs to the seller unless the purchaser stipulates otherwise. And whoever sells a palm tree that has borne fruit, the fruit belongs to the seller unless the purchaser stipulates otherwise." And the wording is from Muhammad 4974. Muhammad ibn Raaf' said that Abdul Razzaq narrated to us, and Isaac ibn Ibrahim narrated to us, saying that Abdul Razzaq said that Ma'mar narrated from Matar al-Warraq from Ikrimah ibn Khalid from Ibn Umar from the Prophet ﷺ the same hadith as Al-Zuhri. And Isaac said the same.

قَالَ رَسُولُ اللهِ ﷺ «مَنْ بَاعَ عَبْدًا فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ بَاعَ نَخْلًا فِيهَا ثَمَرَةٌ قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» وَاللَّفْظُ لِمُحَمَّدٍ 4974 أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ النَّيْسَابُورِيُّ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ وَأَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ حَدَّثَنَا مَعْمَرٌ عَنْ مَطَرٍ الْوَرَّاقِ عَنْ عِكْرِمَةَ بْنِ خَالِدٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ مِثْلَ حَدِيثِ الزُّهْرِيِّ هَذَا وَقَالَ إِسْحَاقُ مِثْلَهُ

[Machine] About the Prophet Muhammad ﷺ who said: "Whoever buys a slave and he has money..." and then he mentioned a similar hadith from Ibn Uyaynah about Az-Zuhri.

Safinah said: I was a slave of Umm Salamah, and she said: I shall emancipate you, but I stipulate that you must serve the Messenger of Allah ﷺ as long as you live. I said: Even if you do not make a stipulation, I shall not leave the Messenger of Allah ﷺ. She then emancipated me and made the stipulation with me. (Using translation from Abū Dāʾūd 3932)

A man pledged that his slave would be manumitted after his death. The Prophet ﷺ asked, "Who will buy the slave from me?" Nu'aim bin ʿAbdullah bought the slave and the Prophet ﷺ took its price and gave it to the owner. (Using translation from Bukhārī 2403)

[Machine] About Dubur, who was in need, this was mentioned to the Messenger of Allah ﷺ so he called him and said, "Have you freed your slave?" He replied, "Yes." The Prophet ﷺ then said, "You are more in need of him." Then he asked, "Who will buy him?" Nuaim bin Abdullah said, "I will." So he bought him, and then the Prophet ﷺ took the price and gave it to his owner.

عَنْ دُبُرٍ وَكَانَ مُحْتَاجًا فَذُكِرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَدَعَاهُ فَقَالَ «أَعْتَقْتَ غُلَامَكَ؟» قَالَ نَعَمْ فَقَالَ النَّبِيُّ ﷺ أَنْتَ أَحْوَجُ إِلَيْهِ ثُمَّ قَالَ مَنْ يَشْتَرِيهِ؟ قَالَ نُعَيْمُ بْنُ عَبْدِ اللهِ أَنَا فَاشْتَرَاهُ ثُمَّ أَخَذَ النَّبِيُّ ﷺ ثَمَنَهُ فَدَفَعَهُ إِلَى صَاحِبِهِ

[Machine] A man said that a person was appointed as a servant to the Messenger of Allah ﷺ who did not possess any wealth besides him. After some time, the Messenger of Allah ﷺ took the slave and sold him, then he gave the owner the price of the slave.

قَالَ جَعَلَ رَجُلٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ غُلَامًا لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ حُرًّا مِنْ بَعْدِهِ فَأَخَذَ رَسُولُ اللهِ ﷺ الْعَبْدُ «فَبَاعَهُ ثُمَّ أَعْطَى صَاحِبَهُ ثَمَنَهُ»

[Machine] A man from the companions of the Prophet ﷺ freed a slave that he owned in exchange for a dhubur, and he did not have any other wealth except for him. So the Messenger of Allah ﷺ sold the slave for 800 dirhams and gave the amount to his master.

أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَعْتَقَ عَبْدًا لَهُ عَنْ دُبُرٍ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ «فَبَاعَ رَسُولُ اللهِ ﷺ الْعَبْدَ بِثَمَانِمِائَةِ دِرْهَمٍ وَدَفَعَهُ إِلَى مَوْلَاهُ»

[Machine] About Dubur who was needy and had a debt, so the Messenger of Allah ﷺ sold him for eight hundred dirhams and gave him the amount, then said, "Pay off your debt."

عَنْ دُبُرٍ وَكَانَ مُحْتَاجًا وَكَانَ عَلَيْهِ دَيْنٌ فَبَاعَهُ رَسُولُ اللهِ ﷺ بِثَمَانِمِائَةِ دِرْهَمٍ فَأَعْطَاهُ فَقَالَ «اقْضِ دَيْنَكَ»

[Machine] Narrated by the Prophet ﷺ that a man freed a slave of his from the back end, and then his master became in need. So, he ordered the slave to be sold for eight hundred. The Messenger of Allah ﷺ said to him, "Spend it on your family, for charity is only from surplus wealth. Begin with those whom you are responsible for."

عَنِ النَّبِيِّ ﷺ أَنَّ رَجُلًا أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ فَاحْتَاجَ مَوْلَاهُ فَأَمَرَ بِبَيْعِهِ فَبَاعَهُ بِثَمَانِمِائَةٍ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «أَنْفِقْهَا عَلَى عِيَالِكَ فَإِنَّمَا الصَّدَقَةُ عَنْ ظَهْرِ غِنًى وَابْدَأْ بِمَنْ تَعُولُ»

A man of the Ansar called Abu Madhkur declared that his slave called Ya'qub would be free after his death, but he had no other property. So the Messenger of Allah ﷺ called him and said: Who will buy him ? Nu'aim b. 'Abd Allah b. al-Nahham bought him for eight hundred dirhams. When he handed them over to him, he (Prophet) said: If any of you is poor, he should begin from himself ; if anything is left over, give it to your family; if anything is left over, give it to your relatives ; if anything is left over (when they received something), then here and here. (Using translation from Abū Dāʾūd 3957)   

الكبرى للنسائي:٤٩٨٧أَخْبَرَنِي زِيَادُ بْنُ أَيُّوبَ قَالَ حَدَّثَنَا إِسْمَاعِيلُ قَالَ أَخْبَرَنَا أَيُّوبُ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ أَنَّ رَجُلًا مِنَ الْأَنْصَارِ يُقَالُ لَهُ أَبُو مَذْكُورٍ §أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ

يُقَالُ لَهُ يَعْقُوبُ لَمْ يَكُنْ لَهُ غَيْرُهُ فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَقَالَ «مَنْ يَشْتَريهِ؟ مَنْ يَشْتَريهِ؟» فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ بِثَمَانِمِائَةِ دِرْهَمٍ فَبَعَثَهَا إِلَيْهِ وَقَالَ «إِذَا كَانَ أَحَدُكُمْ فَقِيرًا فَلْيَبْدَأْ بِنَفْسِهِ فَإِنْ كَانَ فَضْلٌ فَعَلَى عِيَالِهِ فَإِنْ كَانَ فَضْلٌ فَعَلَى قَرَابَتِهِ أَوْ عَلَى ذِي رَحِمِهِ فَإِنْ كَانَ فَضْلٌ فَهَاهُنَا وَهَاهُنَا»  

nasai-kubra:4988Qutaybah b. Saʿīd > al-Layth > Abū al-Zubayr > Jābir > Aʿtaq a man from Banī ʿUdhrah ʿAbd Lah

A person from the Banu 'Udhra set a slave free after his death. This news reached the Messenger of Allah (may peace be upon hhn). Upon this he said: Have you any property besides it? He said: No. Upon this he said: Who would buy (this slave) from me? Nulaim b. Abdullah bought it for eight hundred dirhams and (this amount was) brought to the Messenger of Allah ﷺ who returned it to him (the owner), and then said: Start with your own self and spend it on yourself, and if anything is left, it should be spent on your family, and if anything is left (after meeting the needs of the family) it should be spent on relatives, and if anything is left from the family, it should be spent like this, like this. And he was saying: In front of you, on your right and on your left. (Using translation from Muslim 997a)  

الكبرى للنسائي:٤٩٨٨أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا اللَّيْثُ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ أَنَّهُ قَالَ §أَعْتَقَ رَجُلٌ مِنْ بَنِي عُذْرَةَ عَبْدًا لَهُ

عَنْ دُبُرٍ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ «أَلَكَ مَالٌ غَيْرَهُ؟» قَالَ لَا قَالَ رَسُولُ اللهِ ﷺ «مَنْ يَشْتَرِيهِ مِنِّي؟» فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ الْعَدَوِيُّ بِثَمَانِمِائَةِ دِرْهَمٍ فَجَاءَ بِهَا رَسُولُ اللهِ ﷺ فَدَفَعَهَا إِلَيْهِ ثُمَّ قَالَ «ابْدَأْ بِنَفْسِكَ فَتَصَدَّقْ عَلَيْهَا فَإِنْ فَضَلَ شَيْءٌ فَلِأَهْلِكَ فَإِنْ فَضَلَ عَنْ أَهْلِكَ شَيْءٌ فَلِذِي قَرَابَتِكَ فَإِنْ فَضَلَ عَنْ ذِي قَرَابَتِكَ شَيْءٌ فَهَكَذَا وَهَكَذَا» يَقُولُ بَيْنَ يَدَيْكَ وَعَنْ يَمِينِكَ وَعَنْ شِمَالِكَ

A man manumitted a slave and he had no other property than that, so the Prophet ﷺ canceled the manumission (and sold the slave for him). Nu'aim bin Al-Nahham bought the slave from him. (Using translation from Bukhārī 2415)

أَنَّ رَجُلًا «أَعْتَقَ عَبْدًا لَهُ لَمْ يَكُنْ لَهُ مَالٌ غَيْرَهُ فَرَدَّهُ عَلَيْهِ رَسُولُ اللهِ ﷺ وَابْتَاعَهُ نُعَيْمُ بْنُ النَّحَّامِ»

[Machine] We had a slave from the Banu Muqarrin tribe, and a man from us slapped him. So, he complained to the Messenger of Allah ﷺ, and it was said to him that there was no other solution for him. So, he said, "Either I will continue serving them until they are independent of me."  

الكبرى للنسائي:٤٩٩٠أَخْبَرَنَا أَبُو دَاوُدَ قَالَ حَدَّثَنَا أَبُو الْوَلِيدِ قَالَ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ مُطَرِّفٍ عَنِ الشَّعْبِيِّ عَنْ مُعَاوِيَةَ بْنِ سُوَيْدٍ قَالَ لَطَمَ ابْنُهُ مَوْلًى لَهُ فَقَالَ لَهُ الْطِمْهُ قَالَ فَتَرَكَهُ ثُمَّ قَالَ

كَانَ لَنَا بَنُو مُقَرِّنٍ مَمْلُوكٌ فَلَطَمَهُ رَجُلٌ مِنَّا فَشَكَا ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَقِيلَ لَهُ لَيْسَ لَهُ غَيْرُهُ فَقَالَ «إمَّا لَا لِيَخْدِمْهُمْ حَتَّى يَسْتَغْنُوا عَنْهُ»

[Machine] There was a slave of the Banu Muqarrin. One of us slapped him, so he went to the Prophet ﷺ and complained to him. The Prophet ﷺ freed him. It was then said, "O Messenger of Allah, he does not have any other servant besides him." He said, "Let him serve them until they become independent of him."  

الكبرى للنسائي:٤٩٩١أَخْبَرَنَا أَحْمَدُ بْنُ حَرْبٍ قَالَ حَدَّثَنَا أَسْبَاطٌ عَنْ مُطَرِّفٍ عَنْ أَبِي السَّفَرِ عَنْ مُعَاوِيَةَ بْنِ سُوَيْدِ بْنِ مُقَرِّنٍ قَالَ

كَانَ لِبَنِي مُقَرِّنٍ غُلَامٌ فَلَطَمَهُ بَعْضُنَا فَأَتَى النَّبِيَّ ﷺ فَشَكَا إِلَيْهِ فَأَعْتَقَهُ فَقِيلَ يَا رَسُولَ اللهِ لَيْسَ لَهُ خَادِمٌ غَيْرَهُ قَالَ «لِيَخْدِمْهُمْ حَتَّى يَسْتَغْنُوا عَنْهُ»

[Machine] We, the people of the Banu Muqarrin tribe, were seven individuals who had only one servant. One of us slapped her, so the Prophet ﷺ said, "Set her free." It was said that they did not have any other servants besides her, to which he said, "Let her serve them, and when they no longer need her, then set her free." This hadith has been narrated from another perspective that does not include this statement.  

الكبرى للنسائي:٤٩٩٢أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ سَلَمَةَ عَنْ مُعَاوِيَةَ بْنِ سُوَيْدٍ قَالَ لَطَمْتُ خَادِمًا لَنَا فَقَالَ أَبِي اقْتَصَّ ثُمَّ قَالَ

كُنَّا مَعْشَرَ بَنِي مُقَرِّنٍ سَبْعَةً لَيْسَ لَنَا خَادِمٌ إِلَّا وَاحِدَةٌ فَلَطَمَهَا أَحَدُنَا فَقَالَ النَّبِيُّ ﷺ «أَعْتِقُوهَا» فَقِيلَ إِنَّهُ لَيْسَ لَهُمْ خَادِمٌ غَيْرَهَا قَالَ «لِتَخْدِمْهُمْ فَإِذَا اسْتَغْنَوْا عَنْهَا فَلْيُعْتِقُوهَا» وَقَدْ رُوِيَ هَذَا الْحَدِيثُ مِنْ وَجْهٍ آخَرَ لَيْسَ فِيهِ هَذَا الْكَلَامُ

[Machine] "That the image is prohibited, I have seen myself as the seventh of seven brothers during the time of the Prophet ﷺ, we only had one male child, so one of us slapped him. The Messenger of Allah ﷺ commanded us to set him free."

أَنَّ الصَّورَةَ مُحَرَّمَةٌ لَقَدْ رَأَيْتُنِي سَابِعَ سَبْعَةٍ إِخْوَةٍ عَلَى عَهْدِ النَّبِيِّ ﷺ مَا لَنَا إِلَّا غُلَامٌ وَاحِدٌ فَلَطَمَهُ أَحَدُنَا «فَأَمَرَنَا رَسُولُ اللهِ ﷺ أَنْ نُعْتِقَهُ»

[Machine] Did you slap her? I saw that I was the seventh of my brothers with the Messenger of Allah, and we only had one servant, so one of us slapped her. So the Messenger of Allah commanded us to set her free.  

الكبرى للنسائي:٤٩٩٤أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّى قَالَ حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ عَنْ شُعْبَةَ عَنْ حَصِينٍ عَنْ هِلَالِ بْنِ يَسَافٍ قَالَ كُنَّا نَبِيعُ الْبَزَّ فِي دَارِ سُوَيْدِ بْنِ مُقَرِّنٍ فَخَرَجَتْ جَارِيَةٌ فَقَالَتْ لِرَجُلٍ مِنَّا كَلِمَةً فَلَطَمَهَا فَغَضِبَ سُوَيْدٌ فَقَالَ

لَطَمْتَ وَجْهَهَا؟ ‍ لَقَدْ رَأَيْتُنِي سَابِعَ سَبْعَةٍ مِنْ إِخْوَتِي مَعَ رَسُولِ اللهِ ﷺ مَا لَنَا مِنْ خَادِمٍ إِلَّا وَاحِدَةً فَلَطَمَهَا أَحَدُنَا «فَأَمَرَنَا رَسُولُ اللهِ ﷺ فَأَعْتَقْنَاهَا»

It was narrated from Abu Hurairah that the Messenger of Allah said: "There are three who are promised the help of Allah: The Mukatab who wants to buy his freedom, the one who gets married seeking to keep himself chaste, and the Mujahid who fights in the cause of Allah." *Mukatab: the slave who has made a contract of manumission. (Using translation from Nasāʾī 3218)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «ثَلَاثَةٌ حَقٌّ عَلَى اللهِ عَوْنُهُمُ الْمُكَاتَبُ الَّذِي يُرِيدُ الْأَدَاءَ وَالنَّاكِحُ الَّذِي يُرِيدُ الْعَفَافَ وَالْمُجَاهِدُ فِي سَبِيلِ اللهِ»

"Barirah made a contract that she would be freed in return for nine Awaq, one Uqiyyah to be paid each year." She came to 'Aishah asking for help and she said: "No, not unless they agree to accept the sum in one payment, and that the Wala' will go to me." Barirah went and spoke to her masters but they insisted that the Wala' should be for them. She came to 'Aishah and the Messenger of Allah came, and she told her what her masters had said. She said: "No, by Allah, not unless Wala' is to me." The Messenger of Allah said: "What is this?" She said: "O Messenger of Allah, Barirah came to me and asked me to help her with her contract of manumission, and I said no, not unless they agree to accept the sum in one payment, and that the Wala' will be for me. She mentioned that to her masters and they insisted that the Wala' should be for them." The Messenger of Allah said: "Buy her, and stipulate that the Wala' is for the one who sets the slave free." Then he stood up and addressed the people and said: "What is the matter with people who stipulate conditions that are not in the Book of Allah, the Mighty and Sublime? They say: 'I set so-and-so free but the Wala' will be to me.' Every condition that is not in the Book of Allah, the Mighty and Sublime, is a false condition, even if there are a hundred conditions." And the Messenger of Allah gave her the choice with regard to her husband who was still a slave, and she chose herself. 'Urwah said: "If he had been free the Messenger of Allah would not have given her the choice." (Using translation from Nasāʾī 3451)

كَاتَبَتْ بَرِيرَةُ عَلَى نَفْسِهَا بِتِسْعِ أَوَاقٍ فِي كُلِّ سَنَةٍ أُوقِيَّةٌ فَأَتَتْ عَائِشَةَ تَسْتَعِينُهَا فَقَالَتْ لَا إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونُ الْوَلَاءُ لِي فَذَهَبَتْ بَرِيرَةُ فَكَلَّمَتْ بِذَلِكَ أَهْلَهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَجَاءَتْ إِلَى عَائِشَةَ وَجَاءَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ فَقَالَتْ لَهَا مَا قَالَ أَهْلُهَا فَقَالَتْ لَاهَا اللهُ إِذَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لِي فَقَالَ رَسُولُ اللهِ ﷺ «مَا هَذَا؟» فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ بَرِيرَةَ أَتَتْنِي تَسْتَعِينُ بِي عَلَى كِتَابَتِهَا فَقُلْتُ لَا إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا عَدَّةً وَاحِدَةً وَيَكُونُ الْوَلَاءُ لِي فَذَكَرَتْ ذَلِكَ لِأَهْلِهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَقَالَ رَسُولُ اللهِ ﷺ «ابْتَاعِيهَا وَاشْتَرِطِي لَهُمُ الْوَلَاءَ فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» ثُمَّ قَامَ فَخَطَبَ النَّاسَ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَ فِي كِتَابِ اللهِ يَقُولُونَ أُعْتِقُ فُلَانًا وَالْوَلَاءُ لِي كِتَابُ اللهِ أَحَقُّ وَشَرْطُ اللهِ أَوْثَقُ وَكُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ» فَخَيَّرَهَا رَسُولُ اللهِ ﷺ مِنْ زَوْجِهَا وَكَانَ عَبْدًا فَاخْتَارَتْ نَفْسَهَا قَالَ عُرْوَةُ وَلَوْ كَانَ حُرًّا مَا خَيَّرَهَا رَسُولُ اللهِ ﷺ

"Barirah came to me and said: 'O 'Sishah, I have drawn up a contract of manumission with my master, (to buy my freedom) in return for nine Uwqiyah, one Uwqiyah to be paid each year; help me,' she had not yet paid anything toward her contract of manumission.' 'Aishah, who liked her and wanted to help her, said: 'Go back to your masters and if they agree to let me pay the whole sum and that your loyalty will be to me, I will do it.' So Barirah went to her masters and suggested that to them, but they refused and said: 'if she wants to seek reward (with Allah) by freeing you, let her do so, but (you loyalty) will be to us, 'Aishah told the Messenger of Allah about that and he said: 'Do not let that stop you. Buy her and set her free, and loyalty belongs to the one who sets the slave free.; so she did that, then the Messenger of Allah stood up before the people, praised and glorified Allah, then said: 'What is the matter with people who stipulate conditions that are not in the Book of Allah? Whoever stipulates conditions that are not in even if there are a hundred conditions? The decree of Allah takes priority, and the conditions of Allah binding. And loyalty belongs to the one who sets the slaves free.' (Using translation from Nasāʾī 4656)

عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ جَاءَتْ بَرِيرَةُ إِلَيَّ فَقَالَتْ يَا عَائِشَةُ إِنِّي كَاتَبْتُ أَهْلِي عَلَى تِسْعِ أَوَاقٍ فِي كُلِّ عَامٍ أُوقِيَّةٌ فَأَعِينِينِي وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا فَقَالَتْ لَهَا عَائِشَةُ وَنَفِسَتْ فِيهَا ارْجِعِي إِلَى أَهْلِكِ فَإِنْ أَحَبُّوا أَنْ أُعْطِيَهُمْ ذَلِكَ جَمِيعًا وَيَكُونُ وَلَاؤُكِ لِي فَعَلْتُ فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا فَعَرَضَتْ ذَلِكَ عَلَيْهِمْ فَأَبَوْا وَقَالُوا إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ فَلْتَفْعَلْ وَيَكُونُ وَلَاؤُكِ لَنَا فَذَكَرَتْ عَائِشَةُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ «لَا يَمْنَعُكِ ذَلِكَ مِنْهَا ابْتَاعِي وَأَعْتِقِي فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» فَفَعَلْتُ وَقَامَ رَسُولُ اللهِ ﷺ فِي النَّاسِ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ «مَا بَالُ النَّاسِ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ قَضَاءُ اللهِ أَحَقُّ وَشَرْطُ اللهِ أَوْثَقُ وَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»

[Machine] She said, "Three years ago, people used to give me meat as charity and I would give it to Aisha. Then the Messenger of Allah ﷺ entered and said, 'What is this meat?' She said, 'It is meat that people give me as charity for Barirah (a freed slave woman). She gifted it to us.' He said, 'It is charity for Barirah and a gift for us.' Aisha wrote down on nine slips and said, 'If you wish, I will count it as one payment for them.' She said, 'They (the people) will not agree unless you stipulate loyalty for them.' So I mentioned that to the Prophet ﷺ and he said, 'Buy it and stipulate loyalty for them. Verily, loyalty belongs to the one who sets free.' She said, 'He set me free and I had the choice.'"  

الكبرى للنسائي:٤٩٩٨أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا الثَّقَفِيُّ قَالَ حَدَّثَنَا عُبَيْدُ اللهِ بْنُ عُمَرَ مُنْذُ سِتِّينَ سَنَةً عَنْ يَزِيدَ بْنِ رُومَانَ عَنْ عُرْوَةَ عَنْ بَرِيرَةَ

أَنَّهَا قَالَتْ كَانَ فِي ثَلَاثٍ مِنَ السَّنَةِ تُصُدِّقَ عَلَيَّ بِلَحْمٍ فَأَهْدَيْتُهُ لِعَائِشَةَ فَدَخَلَ رَسُولُ اللهِ ﷺ فَقَالَ «مَا هَذَا اللَّحْمُ؟» فَقَالَتْ لَحْمٌ تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ فَأَهْدَتْهُ لَنَا فَقَالَ «هُوَ عَلَى بَرِيرَةَ صَدَقَةٌ وَلَنَا هَدِيَّةٌ» وَكَاتَبَتْ عَلَى تِسْعِ أَوَاقٍ فَقَالَتْ عَائِشَةُ إِنْ شَاءَ مَوَالِيكِ عَدَدْتُ لَهُمْ ثَمَنَكِ عَدَّةً وَاحِدَةً فَقَالَتْ إِنَّهُمْ يَقُولُونَ إِلَّا أَنْ تَشْتَرِطِي لَهُمُ الْوَلَاءَ فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «اشْتَرِيهَا وَاشْتَرِطِي لَهُمْ فَإِنَّمَا الْوَلَاءَ لِمَنْ أَعْتَقَ» قَالَتْ وَأَعْتَقَنِي فَكَانَ لِيَ الْخِيَارُ

Aisha said that Barirah came to seek her help in the writing of her emancipation. ʿAisha said to her, "If you wish, I will pay your masters (your price) and the wala' will be for me." When Messenger of Allah ﷺ came, she told him about it. The Prophet ﷺ said to her, "Buy her (i.e. Barirah) and manumit (free) her, for the Wala is for the one who manumits." Then Messenger of Allah ﷺ ascended the pulpit and said, "What about those people who stipulate conditions which are not in Allah's Laws? Whoever stipulates such conditions as are not in Allah's Laws, then those conditions are invalid even if he stipulated a hundred such conditions." (Using translation from Bukhārī 2735)   

الكبرى للنسائي:٤٩٩٩أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ عَنْ سُفْيَانَ قَالَ حَفِظْتُ مِنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ أَنَّ بَرِيرَةَ جَاءَتْ إِلَى عَائِشَةَ تَسْأَلُهَا فِي كِتَابَتِهَا فَقَالَ

أَهْلُهَا إِنْ شِئْتِ أُعْطِيتِ بَاقِيَ كِتَابَتِهَا وَيَكُونُ لَنَا الْوَلَاءُ فَلَمَّا أَنْ جَاءَ النَّبِيُّ ﷺ ذَكَرَتْ ذَلِكَ لَهُ فَقَالَ اشْتَرِيهَا فَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ ثُمَّ صَعِدَ رَسُولُ اللهِ ﷺ الْمِنْبَرَ فَقَالَ «مَا شَأْنُ النَّاسِ يَشْتَرِطُونَ شُرُوطًا لَيْسَ فِي كِتَابِ اللهِ مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ لَمْ يَجُزْ لَهُ وَإِنِ اشْتَرَطَ مِائَةَ شَرْطٍ»

[Machine] The Messenger of Allah ﷺ said, "The one who is enslaved will be given freedom according to the ransom paid for the free person, and the one who is enslaved will be given freedom according to the ransom paid for the slave."  

الكبرى للنسائي:٥٠٠٠أَخْبَرَنَا سُلَيْمَانُ بْنُ سَلْمٍ الْبَلْخِيُّ قَالَ أَخْبَرَنَا النَّضْرُ قَالَ أَخْبَرَنَا هِشَامٌ وَأَخْبَرَنَا عُبَيْدُ اللهِ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا مُعَاذُ بْنُ هِشَامٍ قَالَ حَدَّثَنَا أَبِي عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ عَنْ عِكْرِمَةَ عَنْ عَبْدِ اللهِ بْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «يُؤَدِّي الْمُكَاتَبُ بِقَدْرِ مَا عَتَقَ مِنْهُ دِيَةَ الْحُرِّ وَبِقَدْرِ مَا رَقَّ مِنْهُ دِيَةَ الْعَبْدِ»

the Prophet of Allah ruled that the Diyah for a Mukatab should be (equivalent) to the Diyah for a free man, proportionate to the amount he had paid off (toward buying his freedom). (Using translation from Nasāʾī 4809)

أَنَّ رَسُولَ اللهِ ﷺ «قَضَى فِي الْمُكَاتَبِ أَنْ يُؤَدِّيَ بِقَدْرِ مَا عَتَقَ مِنْهُ دِيَةَ الْحُرِّ»

[Machine] "From the Prophet ﷺ, he said: 'If a slave is afflicted with a limit or inheritance, he shall inherit based on the value of his emancipation and the limit shall be established based on the value of his emancipation.'"

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا أَصَابَ الْمُكَاتَبُ حَدًّا أَوْ مِيرَاثًا وَرِثَ بِحِسَابِ مَا عَتَقَ مِنْهُ وَأُقِيمَ عَلَيْهِ الْحَدُّ بِحِسَابِ مَا عَتَقَ مِنْهُ»

[Machine] Narrated by the Prophet ﷺ, he said, "The message will be delivered as much as it has been conveyed." [52] Zakariya bin Yahya informed us, he said: Is-haq informed us, he said: Ismail bin Ulayyah informed us, from Ayyub, from Ikrimah, from Ali, similar to it but not word-for-word.

عَنِ النَّبِيِّ ﷺ قَالَ «يُؤَدِّي الْمُكَاتَبُ بِقَدْرِ مَا أَدَّى» [52] 5004 أَخْبَرَنَا زَكَرِيَّا بْنُ يَحْيَى قَالَ حَدَّثَنَا إِسْحَاقُ قَالَ حَدَّثَنَا إِسْمَاعِيلُ ابْنُ عُلَيَّةَ عَنْ أَيُّوبَ عَنْ عِكْرِمَةَ عَنْ عَلِيٍّ مِثْلَهُ وَلَمْ يَرْفَعْهُ

a Mukatab was killed at the time of the Messenger of Allah and he commanded that the Diyah be paid (equivalent) to the Diyah for a free man, (proportionate to the amount he had paid off towards buying his freedom). (Using translation from Nasāʾī 4812)

أَنَّ مُكَاتَبًا قُتِلَ عَلَى عَهْدِ النَّبِيِّ ﷺ وَقَدْ أَدَّى طَائِفَةً «فَأَمَرَ أَنْ يُودَى مَا أَدَّى مِنْهُ دِيَةَ الْحُرِّ وَمَالًا دِيَةَ الْمَمْلُوكِ»

«إِذَا أَدَّى النِّصْفَ فَهُوَ غَرِيمٌ»

قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا عَبْدٍ كُوتِبَ عَلَى مِائَةِ وُقِيَّةٍ فَأَدَّاهَا إِلَّا عَشْرَ أَوَاقٍ ثُمَّ عَجَزَ فَهُوَ رَقِيقٌ»

On his father's authority, told that his grandfather reported the Prophet ﷺ said: If any slave entered into an agreement to buy his freedom for one hundred uqiyahs and he pays them all but ten, he remains a slave (until he pays the remaining ten); and if a slave entered into an agreement to purchase his freedom for one hundred dinars, and he pays them all but ten dinars, he remains a slave (until he pays the remaining ten). Abu Dawud said: This narrator 'Abbas al-Jariri is not the same person. They said: It is misunderstanding. He is some other narrator. (Using translation from Abū Dāʾūd 3927)   

الكبرى للنسائي:٥٠٠٨أَخْبَرَنَا أَبُو دَاوُدَ قَالَ حَدَّثَنَا أَبُو الْوَلِيدِ قَالَ حَدَّثَنَا هَمَّامٌ عَنِ الْعَلَاءِ الْجُرَيْرِيِّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا عَبْدٍ كَاتَبَ عَلَى مِائَةِ دِينَارٍ فَأَدَّاهَا إِلَّا عَشَرَةَ دَنَانِيرَ فَهُوَ عَبْدٌ وَأَيُّمَا عَبْدٍ كَاتَبَ عَلَى مِائَةِ وَقِيَّةٍ فَأَدَّاهَا إِلَّا عَشْرَ أَوَاقٍ فَهُوَ عَبْدٌ» الْعَلَاءُ الْجُرَيْرِيُّ كَذَا قَالَ
