"A man came to Abu Musa and Salman bin Rabiah and asked them about a daughter, a son's daughter, a father's sister and a mother's sister. So they said: 'For the daughter is half, for the sister of the father and the mother is what remains.' And they said to him: Go to Abdullah (bin Masud) and ask him, for surely he will concur with us.' So he went to 'Abdullah mentioning that to him and informing him what they had said. 'Abdulah said: 'If that were the case, then I would ave erred and not been among the rightly-guided (on the matter). Rather, I will judge with what the Messenger of Allah ﷺ judged: For the daughter is half, for the son's daughter a sixth, totaling two-thirds and for the sister is what remains.'"

Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you."

He then said, "Go to Ibn Mas'ud, for he will follow me." They went to Ibn Mas'ud and informed him of Abu Musa's statement. Ibn Mas'ud said, "I have gone astray then, for I am not among the guided ones. I will judge according to the decree of the Messenger of Allah ﷺ ." البيهقي:١٢٣٢٩أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ ثنا وَهْبُ بْنُ جَرِيرٍ ثنا شُعْبَةُ عَنْ أَبِي قَيْسٍ عَنْ هُزَيْلٍ قَالَ أَتَى أَبَا مُوسَى رَجُلٌ يَسْأَلُهُ عَنِ امْرَأَةٍ تَرَكَتِ ابْنَتَهَا وَابْنَةَ ابْنِهَا وَأُخْتَهَا فَقَالَ لِابْنَتِهَا النِّصْفُ وِلِأُخْتِهَا النِّصْفُ وَلَيْسَ لَابْنَةِ ابْنِهَا شَيْءٌ وَائْتِ عَبْدَ اللهِ بْنَ مَسْعُودٍ فَإِنَّهُ سَيَقُولُ لَكَ مِثْلَ الَّذِي قُلْتُ لَكَ فَأَتَى عَبْدَ اللهِ فَسَأَلَهُ فَحَدَّثَهُ بِالَّذِي قَالَ أَبُو مُوسَى قَالَ

{قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ} لَا بَلْ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِابْنَتِهَا النِّصْفُ وَلِابْنَةِ ابْنِهَا السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ لِأُخْتِهَا فَرَجَعَ إِلَى أَبِي مُوسَى فَأَخْبَرَهُ فَقَالَ لَا تَسْأَلُونَا عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

"عَنْ هُذَيْلِ بْن شُرَحْبِيل، قَالَ: جَاءَ رَجُلٌ إِلَى أَبى مُوسَى الأَشْعَرِىَّ، وَسَلْمَانَ بْنِ رَبِيعَةَ الْبَاهِلِىِّ، فَسَأَلَهُمَا عَنْ رَجُلٍ تَرَكَ ابْنَتَهُ وَابْنَةَ ابْنِه وَأُخْتَهُ، فَقَالَا: لِلابْنَةِ النِّصْفُ ولِلأُخْتِ النِّصْفُ، وَلَيْسَ لاِبْنَةِ الاِبْنِ شَىْءٌ، وائتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابعُنا، فَجَاء الرَّجُلُ إِلَى عَبْد الله فَأَخْبَرَهُ بمَا قَالَا، قَالَ: قَدْ ضَللْتُ إِذَا وَمَا أَنَا مِنَ الْمُهْتَدَينَ، وَلَكِنِّى سَأَقْضى فِيهَا بِقَضَاءِ رَسُولِ الله ﷺ فَقَضَى رَسُولُ الله ﷺ فِى تَرْكِ ابْنَةٍ وَابْنَةِ ابنه وَأُخْتِهِ، فَجَعَلَ للابْنَةِ النَّصْفَ، وَلاِبْنَةِ الاِبْنِ السُّدُسَ، وَمَا بَقىَ لِلأُخْتِ".
