Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you."

لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي فِيهَا بِمَا قَضَى النَّبِيُّ ﷺ لِلاِبْنَةِ النِّصْفُ وَلاِبْنَةِ ابْنٍ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلأُخْتِ فَأَتَيْنَا أَبَا مُوسَى فَأَخْبَرْنَاهُ بِقَوْلِ ابْنِ مَسْعُودٍ فَقَالَ لاَ تَسْأَلُونِي مَا دَامَ هَذَا الْحَبْرُ فِيكُمْ

[AI] A man asked Abu Musa Al-Ash'ari about a woman who left her daughter, her granddaughter, and her sister. Abu Musa replied, "Half is for the daughter and the sister." He then said, "Go to Ibn Mas'ud, for he will follow me." They went to Ibn Mas'ud and informed him of Abu Musa's statement. Ibn Mas'ud said, "I have gone astray then, for I am not among the guided ones. I will judge according to the decree of the Messenger of Allah ﷺ ." Shu'bah said, "I found this letter written, and I will judge accordingly. Half is for the daughter, and a sixth for the granddaughter of the son. This completes two-thirds, and what remains is for the sister." They went to Abu Musa and informed him of Ibn Mas'ud's statement. Abu Musa replied, "Do not ask me about anything as long as this ink is among you."

سَأَلَ رَجُلٌ أَبَا مُوسَى الْأَشْعَرِيَّ عَنِ امْرَأَةٍ تَرَكَتِ ابْنَتَهَا وَابْنَةَ ابْنِهَا وَأُخْتَهَا؟ فَقَالَ النِّصْفُ لِلِابْنَةِ وَلِلْأُخْتِ النِّصْفُ وَقَالَ ائْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنِي قَالَ فَأَتَوْا ابْنَ مَسْعُودٍ فَأَخْبَرُوهُ بِقَوْلِ أَبِي مُوسَى فَقَالَ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَلَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ قَالَ شُعْبَةُ وَجَدْتُ هَذَا الْحَرْفَ مَكْتُوبًا لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ فَأَتَوْا أَبَا مُوسَى فَأَخْبَرُوهُ بِقَوْلِ ابْنِ مَسْعُودٍ فَقَالَ أَبُو مُوسَى لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

[AI] "For the daughter, half. And for the sister, half. And nothing is allocated for the daughter of the son. They asked Ibn Mas'ood, and he said, 'Ask Ibn Mas'ood, for he follows me.' So they asked Ibn Mas'ood and he informed them of the statement of Ash'ari, and he said, 'I have indeed gone astray, and I am not among the guided. I judge among you by the decree of the Messenger of Allah ﷺ , who said, 'For the daughter, half. And for the daughter of the son, one-sixth. And for the sister, one-third.' The news reached Ash'ari and he said, 'Do not ask me about anything as long as this ink is among you.'"

لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَلَمْ يَجْعَلْ لِابْنَةِ الِابْنِ شَيْئًا وَقَالَ سَلُوا ابْنَ مَسْعُودٍ؛ فَإِنَّهُ يُتَابِعُنِي فَسَأَلُوا ابْنَ مَسْعُودٍ وَأَخْبَرَهُ بِقَوْلِ الْأَشْعَرِيِّ فَقَالَ قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي بَيْنَكُمْ بِقَضَاءِ رَسُولِ اللهِ ﷺ قَالَ رَسُولُ اللهِ ﷺ «لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَلِلْأُخْتِ الثُّلُثُ» فَبَلَغَ الْأَشْعَرِيَّ فَقَالَ لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

[AI] "For the daughter, it is half, and for the sister, it is half. Come to Abdullah and he will follow me. So Abdullah came and mentioned that to him. He said, 'I found in the book that I have gone astray, and I am not one of the guided ones. I will judge in it according to what the Messenger of Allah ﷺ has decreed: for the daughter, it is half, for the daughter of the son, it is one-sixth, and what remains is for the sister.' So he came to Abu Musa and mentioned that to him. He said, 'Do not ask me about anything as long as this ink is between your faces.'"

لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَائْتِ عَبْدَ اللهِ فَسَيُتَابِعُنِي فَأَتَى عَبْدَ اللهِ فَذَكَرَ ذَلِكَ لَهُ قَالَ فَوَجَدْتُ فِي الْكِتَابِ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُخْتِ فَأَتَى أَبَا مُوسَى فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

However, I will follow it as the Messenger of Allah ﷺ has ruled for the daughter, half for the son's daughter, two-thirds completion for two-thirds, and for the sister, what remains of the narration of Abu Abdullah, and in the narration of Janaah, according to what the Prophet ﷺ has ruled."

{قَدْ ضَلَلْتُ} إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنْ أَقْضِي فِيهَا كَمَا قَضَى رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَلِلْأُخْتِ مَا بَقِيَ لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ وَفِي رِوَايَةِ جَنَاحٍ بِمَا قَضَى النَّبِيُّ ﷺ

[AI] "I have gone astray, and I am not one of the guided ones. Rather, I will decide in it according to what the Messenger of Allah ﷺ has decided for his daughter, which is half, and for his granddaughter, which is two-thirds, and what is left for her sister will be returned to Abu Musa who will inform him. He said, ‘Do not ask us about anything as long as this ink is between you.’"

{قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ} لَا بَلْ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِابْنَتِهَا النِّصْفُ وَلِابْنَةِ ابْنِهَا السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ لِأُخْتِهَا فَرَجَعَ إِلَى أَبِي مُوسَى فَأَخْبَرَهُ فَقَالَ لَا تَسْأَلُونَا عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

"عَنْ هُذَيْلِ بْن شُرَحْبِيل، قَالَ: جَاءَ رَجُلٌ إِلَى أَبى مُوسَى الأَشْعَرِىَّ، وَسَلْمَانَ بْنِ رَبِيعَةَ الْبَاهِلِىِّ، فَسَأَلَهُمَا عَنْ رَجُلٍ تَرَكَ ابْنَتَهُ وَابْنَةَ ابْنِه وَأُخْتَهُ، فَقَالَا: لِلابْنَةِ النِّصْفُ ولِلأُخْتِ النِّصْفُ، وَلَيْسَ لاِبْنَةِ الاِبْنِ شَىْءٌ، وائتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابعُنا، فَجَاء الرَّجُلُ إِلَى عَبْد الله فَأَخْبَرَهُ بمَا قَالَا، قَالَ: قَدْ ضَللْتُ إِذَا وَمَا أَنَا مِنَ الْمُهْتَدَينَ، وَلَكِنِّى سَأَقْضى فِيهَا بِقَضَاءِ رَسُولِ الله ﷺ فَقَضَى رَسُولُ الله ﷺ فِى تَرْكِ ابْنَةٍ وَابْنَةِ ابنه وَأُخْتِهِ، فَجَعَلَ للابْنَةِ النَّصْفَ، وَلاِبْنَةِ الاِبْنِ السُّدُسَ، وَمَا بَقىَ لِلأُخْتِ".
