25. Chapter
٢٥۔ كِتَابُ الشُّفْعَةِ
[Machine] The Messenger of Allah, ﷺ , ruled in favor of intercession in everything that was not predetermined. But when the limits are violated and the paths are diverted, then there is no room for intercession.
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلَا شُفْعَةَ
[Machine] The Messenger of Allah ﷺ has made intercession only in matters that are not distributed. So when the limits are crossed and the paths are redirected, there is no intercession. And it has been narrated to us by Abu Ali Al-Rudhbari who reported from Muhammad bin Bakr who reported from Abu Dawood who reported from Ahmed bin Hanbal who reported from Abdul-Razzaq, and he mentioned it with its chain of narration, except that he said, "in every wealth that is not distributed."
إِنَّمَا جَعَلَ رَسُولُ اللهِ ﷺ الشُّفْعَةَ فِي كُلِّ مَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلَا شُفْعَةَ 11556 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ حَنْبَلٍ ثنا عَبْدُ الرَّزَّاقِ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ إِلَّا أَنَّهُ قَالَ فِي كُلِّ مَالٍ لَمْ يُقْسَمْ
[Machine] In wealth, there is what is not divided. So when the boundaries are divided and people know their rights, there is no need for intercession. Abu Amr Al-Adeeb informed us, Abu Bakr Al-Isma'ili told me, Al-Hasan told me, he is the son of Sufyan, Ishaaq ibn Ibrahim Al-Hanzhali informed us, Abdul Razzaq mentioned him.
فِي الْأَمْوَالِ مَا لَمْ يُقْسَمْ فَإِذَا قُسِمَتِ الْحُدُودُ وَعَرَفَ النَّاسُ حُقُوقَهُمْ فَلَا شُفْعَةَ أَخْبَرَنَاهُ أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي الْحَسَنُ هُوَ ابْنُ سُفْيَانَ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ أنبأ عَبْدُ الرَّزَّاقِ فَذَكَرَهُ
[Machine] The Messenger of Allah ﷺ decreed for intercession as long as it is not divided and its limits are observed.
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ مَا لَمْ يُقْسَمْ وَتُوِقِّتْ حُدُودُهُ
ثنا حَمَّادُ بْنُ زَيْدٍ فَذَكَرَهُ
[Machine] The Messenger of Allah ﷺ said, "When the prescribed punishments are implemented, there is no intercession to be followed except that of Abdur-Rahman bin Ishaq from Az-Zuhri."
قَالَ رَسُولُ اللهِ ﷺ إِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ تَابَعَهُمَا عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ عَنِ الزُّهْرِيِّ
[Machine] The Messenger of Allah ﷺ said: "When the punishments are imposed, there is no intercession."
قَالَ رَسُولُ اللهِ ﷺ إِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ
[Machine] The Messenger of Allah ﷺ decreed that intercession is valid in this world and the Hereafter as long as the boundaries have not been divided. But once they are divided and separated by boundaries, there is no intercession in them.
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالشُّفْعَةِ فِي الدُّورِ وَالْأَرَضِينَ مَا لَمْ تُقْسَمْ فَإِذَا قُسِمَتْ وَافْتَرَقَتْ فِيهَا الْحُدُودُ فَلَا شُفْعَةَ فِيهَا
[Machine] The Messenger of Allah ﷺ said, "Intercession is allowed in matters that have not been finalized (not yet decided). However, once the prescribed punishments are applied, there can be no intercession of this kind."
قَالَ رَسُولُ اللهِ ﷺ الشُّفْعَةُ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ هَكَذَا
Messenger of Allah ﷺ decided the validity of preemption in every joint undivided property, but if the boundaries were well marked or the ways and streets were fixed, then there was no pre-emption. (Using translation from Bukhārī 2214)
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ
Messenger of Allah ﷺ gave a verdict regarding Shuf'a in every undivided joint thing (property). But if the limits are defined (or demarcated) or the ways and streets are fixed, then there is no pre-emption. (Using translation from Bukhārī 2257)
قَالَ رَسُولُ اللهِ ﷺ الشُّفْعَةُ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ
[Machine] The Messenger of Allah, ﷺ , ruled in favor of intercession in matters that were not yet divided. But when the boundaries are defined and the roads are redirected, there is no intercession. Abu Abdullah Al-Hafiz informed us that Abu Bakr Ahmad bin Ishaq Al-Faqih narrated to us Ismail bin Ishaq Al-Qadi informed me that Ali bin Nasr bin Ali said they asked Abu Asim about his narration from Malik from Az-Zuhri from Sa'id and Abu Salamah from Abu Hurairah about intercession. He said, bring anyone who heard it from Malik at the time I heard it. Abu Ja'far Al-Mansour came to us in Makkah and the people gathered around him and asked him to order Malik to narrate it to them. So he ordered him and he narrated it in Makkah, and we heard it from Malik at that time. Abu Abdullah Al-Hafiz informed us that Abu Muhammad Abdullah bin Muhammad Al-Ka'bi narrated to me that Ali bin Al-Hussein bin Al-Jundaid narrated to me that Muhammad bin Hammad At-Taharani narrated to me that Abu Asim narrated from Malik. He said, At-Taharani said to me that Abu Asim told me that the narration of Abu Salamah from Abu Hurairah is Musnad, and the narration of Sa'id is Mursal. This is what At-Taharani said from Abu Asim.
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ فَإِذَا حُدَّتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلَا شُفْعَةَ 11567 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو بَكْرٍ أَحْمَدُ بْنُ إِسْحَاقَ الْفَقِيهُ أنبأ إِسْمَاعِيلُ بْنُ إِسْحَاقَ الْقَاضِي حَدَّثَنِي عَلِيُّ بْنُ نَصْرِ بْنِ عَلِيٍّ قَالَ قَالُوا لِأَبِي عَاصِمٍ فِي حَدِيثِهِ عَنْ مَالِكٍ عَنِ الزُّهْرِيِّ عَنْ سَعِيدٍ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ فِي الشُّفْعَةِ فَقَالَ هَاتُوا مَنْ سَمِعَهُ مِنْ مَالِكٍ فِي الْوَقْتِ الَّذِي سَمِعْتُهُ أَنَا قَدِمَ عَلَيْنَا أَبُو جَعْفَرٍ الْمَنْصُورُ بِمَكَّةَ فَاجْتَمَعَ إِلَيْهِ النَّاسُ وَسَأَلُوهُ أَنْ يَأْمُرَ مَالِكًا أَنْ يُحَدِّثَهُمْ فَأَمَرَهُ فَحَدَّثَ بِمَكَّةَ فَسَمِعْنَا مِنْ مَالِكٍ فِي ذَلِكَ الْوَقْتِ 11568 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو مُحَمَّدٍ عَبْدُ اللهِ بْنُ مُحَمَّدٍ الْكَعْبِيُّ حَدَّثَنِي عَلِيُّ بْنُ الْحُسَيْنِ بْنِ الْجُنَيْدِ حَدَّثَنِي مُحَمَّدُ بْنُ حَمَّادٍ الطِّهْرَانِيُّ ثنا أَبُو عَاصِمٍ عَنْ مَالِكٍ قَالَ فَذَكَرَ هَذَا الْحَدِيثَ قَالَ الطِّهْرَانِيُّ قَالَ لِي أَبُو عَاصِمٍ حَدِيثُ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ مُسْنَدٌ وَحَدِيثُ سَعِيدٍ مُرْسَلٌ هَكَذَا قَالَ الطِّهْرَانِيُّ عَنْ أَبِي عَاصِمٍ
[Machine] The Messenger of Allah ﷺ ruled for intercession in matters that were not yet divided. However, when it came to implementing the punishments (prescribed in Islamic law), there was no intercession allowed. This is how it was narrated from a narrator who had doubts about its authenticity, as well as from Ibn Juraij and Muhammad ibn Ishaq ibn Yasar, who reported it from Az-Zuhri.
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ هَكَذَا أَتَى بِهِ شَاكًّا فِي إِسْنَادِهِ وَكَذَلِكَ رُوِيَ عَنِ ابْنِ جُرَيْجٍ وَمُحَمَّدِ بْنِ إِسْحَاقَ بْنِ يَسَارٍ عَنِ الزُّهْرِيِّ
The Prophet ﷺ said: When land has been divided and boundaries have been set up, there is no right of pre-emption in it. (Using translation from Abū Dāʾūd 3515)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا قُسِمَتِ الْأَرْضُ وَحُدَّتْ فَلَا شُفْعَةَ فِيهَا لَفْظُهُمَا سَوَاءٌ
[Machine] The Messenger of Allah ﷺ decreed for intercession in matters that are not divided. And whatever wealth is divided, there shall be no intercession in it." The scholar said, "Based on the evidence from these narrations, it is known that Ibn Shihab az-Zuhri never doubted his narration from Abu Salamah, from Jaabir, from the Prophet ﷺ, as...
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ وَأَيُّمَا مَالٍ قُسِمَ عَلَيْهِ فَلَا شُفْعَةَ فِيهِ قَالَ الشَّيْخُ فَالَّذِي يُعْرَفُ بِالِاسْتِدْلَالِ مِنْ هَذِهِ الرِّوَايَاتِ أَنَّ ابْنَ شِهَابٍ الزُّهْرِيَّ مَا كَانَ يَشُكُّ فِي رِوَايَتِهِ عَنْ أَبِي سَلَمَةَ عَنْ جَابِرٍ عَنِ النَّبِيِّ ﷺ كَمَا
[Machine] The Messenger of Allah ﷺ has decreed intercession in every partnership that is not divided by a wall or a quarter, and he is not allowed to sell until he seeks the permission of his partner. And in some narrations, until his partner gives him permission. If he wishes, he can take it, and if he wishes, he can leave it. But if he sells it without his permission, then he is more entitled to it.
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ رَبْعَةٍ أَوْ حَائِطٍ لَا يَحِلُّ لَهُ أَنْ يَبِيعَ حَتَّى يَسْتَأْمِرَ شَرِيكَهُ وَفِي رِوَايَةِ بَعْضِهِمْ حَتَّى يُؤْذِنَ شَرِيكَهُ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِنْ بَاعَ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ
the Messenger of Allah ﷺ ruled concerning preemption of land that has not been divided; if the boundaries have been set then there is no preemption. (Using translation from Ibn Mājah 2497)
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ الشُّفْعَةُ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ
[Machine] "If the boundaries are removed and people know their limits, then there is no need for intercession between them."
إِذَا صُرِفَتِ الْحُدُودُ وَعَرَفَتِ النَّاسُ حُدُودَهُمْ فَلَا شُفْعَةَ بَيْنَهُمْ
[Machine] If the boundaries are violated on the land, there will be no intercession in it, no intercession in a well, and no female camel will be allowed.
إِذَا وَقَعَتِ الْحُدُودُ فِي الْأَرْضِ فَلَا شُفْعَةَ فِيهَا وَلَا شُفْعَةَ فِي بِئْرٍ وَلَا فَحْلِ نَخْلٍ
[Machine] Abu Ubayd said in the Hadith of Uthman: "When the two arrows are thrown, there should be no reciprocity." Al-Asmami said, "Reciprocity is when someone is imprisoned. He said, "When the boundaries are set, no one should be imprisoned against his rights, and the basis of this is the chain." Abu Ubayd said, "By the One in whose hand is this Hadith, it is a fiqhi matter that Uthman ibn Affan did not consider intercession for the neighbor except for the mixed participant, and this is clear in another Hadith of his." Abu Ubayd said, "It was narrated to us by Abdullah ibn Idris from Muhammad ibn Umamah from Abu Bakr ibn Hazm or from Abdullah ibn Abu Bakr ibn Hazm, doubt from Abu Ubayd from Aban ibn Uthman from Uthman, he said, "There is no intercession regarding a well or a pregnant camel, and Araff cuts off every intercession." Ibn Idris said, "Araff means landmarks." Al-Asmami said, "It means landmarks and boundaries." He said, "This is the saying of the people of Hijaz, when you say, 'I have divided and delineated the land.'" Ibn Idris said, "His statement 'There is no intercession regarding a well or a pregnant camel,' I believe the pregnant camel is the female camel, and we have narrated that from Saeed ibn Al-Musayyib, Sulaiman ibn Yasir, and Umar ibn Abdul Aziz."
قَالَ أَبُو عُبَيْدٍ فِي حَدِيثِ عُثْمَانَ ؓ إِذَا وَقَعَتِ السُّهْمَانُ فَلَا مُكَابَلَةَ قَالَ الْأَصْمَعِيُّ الْمُكَابَلَةُ تَكُونُ مِنَ الْحَبْسِ يَقُولُ إِذَا حُدَّتِ الْحُدُودُ فَلَا يُحْبَسُ أَحَدٌ عَنْ حَقِّهِ وَأَصْلُ هَذَا مِنَ الْكَبْلِ وَهُوَ الْقَيْدُ قَالَ أَبُو عُبَيْدٍ وَالَّذِي فِي هَذَا الْحَدِيثِ مِنَ الْفِقْهِ أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ كَانَ لَا يَرَى الشُّفْعَةَ لِلْجَارِ إِنَّمَا يَرَاهَا لِلْخَلِيطِ الْمُشَارِكِ وَهُوَ بَيِّنٌ فِي حَدِيثٍ لَهُ آخَرَ قَالَ أَبُو عُبَيْدٍ حَدَّثَنَاهُ عَبْدُ اللهِ بْنُ إِدْرِيسَ عَنْ مُحَمَّدِ بْنِ عُمَارَةَ عَنْ أَبِي بَكْرِ بْنِ حَزْمٍ أَوْ عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرِ بْنِ حَزْمٍ الشَّكُّ مِنْ أَبِي عُبَيْدٍ عَنْ أَبَانَ بْنِ عُثْمَانَ عَنْ عُثْمَانَ ؓ قَالَ لَا شُفْعَةَ فِي بِئْرٍ وَلَا فَحْلٍ وَالَأرَفُ يَقْطَعُ كُلَّ شُفْعَةٍ قَالَ ابْنُ إِدْرِيسَ الَأرَفُ الْمَعَالِمُ وَقَالَ الْأَصْمَعِيُّ هِيَ الْمَعَالِمُ وَالْحُدُودُ قَالَ وَهَذَا كَلَامُ أَهْلِ الْحِجَازِ يُقَالُ مِنْهُ أَرَفْتَ الدَّارَ وَالْأَرْضَ تَأْرِيفًا إِذَا قَسَّمْتَهَا وَحَدَّدْتَهَا قَالَ ابْنُ إِدْرِيسَ وَقَوْلُهُ لَا شُفْعَةَ فِي بِئْرٍ وَلَا فَحْلٍ أَظُنُّ الْفَحْلَ فَحْلَ النَّخْلِ وَرُوِّينَا فِي ذَلِكَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَسُلَيْمَانَ بْنِ يَسَارٍ وَعُمَرَ بْنِ عَبْدِ الْعَزِيزِ
25.2 [Machine] Intercession with neighbors.
٢٥۔٢ بَابُ الشُّفْعَةِ بِالْجِوَارِ
[Machine] "The Messenger of Allah ﷺ said, 'The neighbor has more right to be given a drink.' Abu Qilabah said, 'Al-Asma'i Al-Arabi said, The drink should be appropriate.' The Sheikh disputed him, Ibrahim ibn Maisarah disagreed with him with his chain of narrators."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْجَارُ أَحَقُّ بِسَقَبِهِ قَالَ أَبُو قِلَابَةَ قَالَ الْأَصْمَعِيُّ الْعَرَبُ تَقُولُ السَّقَبُ اللَّزِيقُ قَالَ الشَّيْخُ خَالَفَهُ إِبْرَاهِيمُ بْنُ مَيْسَرَةَ بِإِسْنَادِهِ
[Machine] The Messenger of Allah ﷺ said, "The neighbor has the most right to their neighbor's kindness."
قَالَ رَسُولُ اللهِ ﷺ الْجَارُ أَحَقُّ بِسَقَبِهِ
[Machine] He has Sa'd, and I swear to Allah, I will not increase you to more than four hundred dinars, either cut or intact. So Abu Rafi' said, "Glory to Allah! I have prevented them from five hundred cash. If only I had not heard the Messenger of Allah, ﷺ , say, 'The neighbor has more right to his neighbor's drain water.'"
لَهُ سَعْدٌ ؓ وَاللهِ لَا أَزِيدُكَ عَلَى أَرْبَعِمِائَةِ دِينَارٍ إِمَّا مُقَطَّعَةً وَإِمَّا مُنَجَّمَةً فَقَالَ أَبُو رَافِعٍ سُبْحَانَ اللهِ لَقَدْ مَنَعْتُهُمَا مِنْ خَمْسِمِائَةٍ نَقْدًا فَلَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الْجَارُ أَحَقُّ بِسَقَبِهِ مَا بِعْتُكَ
[Machine] That the Messenger of Allah ﷺ emphasized the importance of good neighborly relations, and Samurah narrated that the Prophet ﷺ said, "The neighbor of a house has more right to the house than others."
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالْجِوَارِ وَعَنْ سَمُرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ جَارُ الدَّارِ أَحَقُّ بِالدَّارِ مِنْ غَيْرِهِ
The Prophet ﷺ said: The neighbour is most entitled to the right of pre-emption, and he should wait for its exercise even if he is absent, when the two properties have one road. (Using translation from Abū Dāʾūd 3518)
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ الْجَارُ أَحَقُّ بِشُفْعَةِ أَخِيهِ يَنْتَظِرُ وَإِنْ كَانَ غَائِبًا إِذَا كَانَ طَرِيقُهُمَا وَاحِدًا
[Machine] Translation: "That this hadith is not memorized was told to him and he was asked, 'From where did you say that?' He replied, 'I only said.'"
أَنْ لَا يَكُونَ هَذَا الْحَدِيثُ مَحْفُوظًا قِيلَ لَهُ وَمِنْ أَيْنَ قُلْتَ؟ قَالَ إِنَّمَا
مِنْ حُسْنِهَا فَرَرْتُ
This hadith is narrated on the authority of Yahya b. Sa'id with the same chain of transmitters but with this variation that he said that ('A'isha did not observe fast but in Sha'ban) out of regard for the Messenger of Allah ﷺ. (Using translation from Muslim 1146b)
أَنَّهُ قَالَ ذَلِكَ
[Machine] About the Prophet ﷺ , he said, "This is a rejected/reprehensible narration."
عَنِ النَّبِيِّ ﷺ قَالَ هَذَا حَدِيثٌ مُنْكَرٌ
25.3 [Machine] The narrative of forbidden words mentioned by some jurists in matters of intercession.
٢٥۔٣ بَابُ رِوَايَةِ أَلْفَاظٍ مُنْكَرَةٍ يَذْكُرُهَا بَعْضُ الْفُقَهَاءِ فِي مَسَائِلِ الشُّفْعَةِ
[Machine] The Prophet ﷺ said, "There is no intercession for one who is absent, young, or has a partner, if the partner has preceded him in the purchase." Abu Sa'd narrated to us, and Abu Ahmad informed us, narrating from Muhammad ibn Sa'id ibn Mihran, who narrated from 'Umar ibn Shabba, who narrated from Muhammad ibn Al-Harith, with a similar chain of narration. And he added, "Intercession is like the blackness of a horse's eyeliner."
قَالَ النَّبِيُّ ﷺ لَا شُفْعَةَ لِغَائِبٍ وَلَا صَغِيرٍ وَلَا شَرِيكٍ عَلَى شَرِيكٍ إِذَا سَبَقَهُ بِالشِّرَاءِ 11588 وَأَخْبَرَنَا أَبُو سَعْدٍ قَالَ وَأنبأ أَبُو أَحْمَدَ ثنا مُحَمَّدُ بْنُ سَعِيدِ بْنِ مِهْرَانَ ثنا عُمَرُ بْنُ شَبَّةَ ثنا مُحَمَّدُ بْنُ الْحَارِثِ بِإِسْنَادِهِ نَحْوَهُ وَزَادَ وَالشُّفْعَةُ كَحَلِّ الْعِقَالِ
[Machine] On the authority of the Prophet ﷺ he said: "There is no intercession for a child or for an absent person. And if a partner precedes his partner in intercession, then there is no intercession. And intercession is like the mark of a camel's nose rope."
عَنِ النَّبِيِّ ﷺ قَالَ لَا شُفْعَةَ لِصَبِيٍّ وَلَا لِغَائِبٍ وَإِذَا سَبَقَ الشَّرِيكُ شَرِيكَهُ بِالشُّفْعَةِ فَلَا شُفْعَةَ وَالشُّفْعَةُ كَحَلِّ الْعِقَالِ
[Machine] The Prophet ﷺ said, "Intercession does not inherit nor is it inherited. Muhammad ibn Al-Harith Al-Basri is abandoned, and Muhammad ibn Abdur-Rahman Al-Baylmani is weak, weakened by Yahya ibn Ma'een and others from the scholars of Hadith. It has been narrated in opposition to the first Hadith a weak Hadith from Jabir, that the young boy will be raised on his intercession until he reaches puberty, and both of them are denied."
قَالَ رَسُولُ اللهِ ﷺ الشُّفْعَةُ لَا تَرِثُ وَلَا تُورَثُ مُحَمَّدُ بْنُ الْحَارِثِ الْبَصْرِيُّ مَتْرُوكٌ وَمُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ الْبَيْلَمَانِيُّ ضَعِيفٌ ضَعَّفَهُمَا يَحْيَى بْنُ مَعِينٍ وَغَيْرُهُ مِنْ أَئِمَّةِ أَهْلِ الْحَدِيثِ وَقَدْ رُوِيَ فِي مُعَارَضَةِ الْحَدِيثِ الْأَوَّلِ حَدِيثٌ ضَعِيفٌ عَنْ جَابِرٍ مَرْفُوعًا الصَّبِيُّ عَلَى شُفْعَتِهِ حَتَّى يُدْرِكَ وَكِلَاهُمَا مُنْكَرَانِ
[Machine] The Messenger of Allah ﷺ said, "The young boy will be given the chance to intercede until he reaches puberty. If he reaches puberty, then if he wants, he can take it, and if he wants, he can leave it." Abdullah ibn Bazia took this narration as unique, even though he is weak, and those lower than him refer to our sheikhs, and they cannot be used as evidence.
قَالَ رَسُولُ اللهِ ﷺ الصَّبِيُّ عَلَى شُفْعَتِهِ حَتَّى يُدْرِكَ فَإِذَا أَدْرَكَ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ تَفَرَّدَ بِهِ عَبْدُ اللهِ بْنُ بَزِيعٍ وَهُوَ ضَعِيفٌ وَمَنْ دُونَهُ إِلَى شَيْخِ شَيْخِنَا لَا يُحْتَجُّ بِهِمَا
[Machine] That the Messenger of Allah ﷺ said, "There is no intercession for a Christian." Abu Ahmad said, "The narrations of Nāʼil are very confusing, especially when he reports from Al-Thawri 11593." Ali ibn Ahmad ibn Abdan informed us, Sulayman ibn Ahmad Al-Lakhmi narrated to us, Hussein ibn Ali Al-Sarraj Al-Qadi narrated to us, Muhammad ibn Sinan Al-Qazzaz narrated to us, Nāʼil ibn Najih mentioned it except that he said, "He mentioned it once to the Prophet ﷺ and not another." The Shaykh said, "The hadith is from Sufyan, from Humaid Al-Tawiyl, from Hassan who said, 'There is no intercession for a Jew or a Christian.' Abu Bakr Al-Ardastani informed us, Abu Nasr Al-Iraqi narrated to us, Sufyan Al-Jawhari narrated to us, Ali ibn Al-Hasan Al-Hilali narrated to us, Abdullah ibn Al-Walid narrated from Sufyan and mentioned it. This is the correct statement of Al-Hassan and we have also narrated from Iyas ibn Muawiya that he ruled in favor of intercession for a dhimmi."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا شُفْعَةَ لِلنَّصْرَانِيِّ قَالَ أَبُو أَحْمَدَ أَحَادِيثُ نَائِلٍ مُظْلِمَةٌ جِدًّا وَخَاصَّةً إِذَا رَوَى عَنِ الثَّوْرِيِّ 11593 وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ سُلَيْمَانُ بْنُ أَحْمَدَ اللَّخْمِيُّ ثنا الْحُسَيْنُ بْنُ عَلِيٍّ السَّرَّاجُ الْقَاضِي ثنا مُحَمَّدُ بْنُ سِنَانٍ الْقَزَّازُ ثنا نَائِلُ بْنُ نَجِيحٍ فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ رَفَعَهُ مَرَّةً إِلَى النَّبِيِّ ﷺ وَلَمْ يَرْفَعْهُ أُخْرَى قَالَ الشَّيْخُ وَالْحَدِيثُ عِنْدَ سُفْيَانَ عَنْ حُمَيْدٍ الطَّوِيلِ عَنِ الْحَسَنِ قَالَ لَيْسَ لِلْيَهُودِيِّ وَالنَّصْرَانِيِّ شُفْعَةٌ أَخْبَرَنَاهُ أَبُو بَكْرٍ الْأَرْدَسْتَانِيُّ أَنْبَأَ أَبُو نَصْرٍ الْعِرَاقِيُّ ثنا سُفْيَانُ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ الْهِلَالِيُّ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ عَنْ سُفْيَانَ فَذَكَرَهُ هَذَا هُوَ الصَّوَابُ مِنْ قَوْلِ الْحَسَنِ وَقَدْ رُوِّينَا عَنْ إِيَاسِ بْنِ مُعَاوِيَةَ أَنَّهُ قَضَى بِالشُّفْعَةِ لِذِمِّيٍّ
[Machine] "That the absent one, when he arrives, sees the young one on his behalf when he grows up, he said, and there is no intercession in animals."
أَنَّ الْغَائِبَ عَلَى شُفْعَتِهِ إِذَا قَدِمَ وَيَرَى الصَّغِيرَ عَلَى شُفْعَتِهِ إِذَا كَبِرَ قَالَ وَلَيْسَ فِي الْحَيَوَانِ شُفْعَةٌ
25.4 [Machine] No intercession in what is transmitted and transferred
٢٥۔٤ بَابُ لَا شُفْعَةَ فِيمَا يُنْقَلُ وَيُحَوَّلُ
[Machine] The Messenger of Allah ﷺ said: Intercession is valid in every partnership, whether it be a quarter or a wall. It is not permissible to sell without the permission of one's partner. If one sells, then he has more right to it until he is given permission.
قَالَ رَسُولُ اللهِ ﷺ الشُّفْعَةُ فِي كُلِّ شِرْكٍ رَبْعَةٍ أَوْ حَائِطٍ لَا يَصْلُحُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ فَإِنْ بَاعَ فَهُوَ أَحَقُّ بِهِ حَتَّى يُؤْذِنَهُ
[Machine] The Messenger of Allah ﷺ decreed the intercession between partners in the heavens and the earth.
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ بَيْنَ الشُّرَكَاءِ فِي الدُّورِ وَالْأَرَضِينَ
[Machine] The Messenger of Allah ﷺ said, "There is no intercession except in a house or real estate." Abu Bakr ibn al-Harith narrated to us that Abu Muhammad ibn Hayyan narrated to us that Muhammad ibn Ibrahim ibn Dawud narrated to us that Abu Usamah Abdullah ibn Muhammad ibn Abi Usamah narrated to us that ad-Dahhak ibn Hajwah ibn ad-Dahhak al-Manbijiy narrated to us that Abu Hanifah mentioned it and Abu Ahmad al-Asal narrated it from Muhammad ibn Ibrahim ibn Dawud from Abu Usamah from ad-Dahhak from Abdullah ibn Waqid from Abu Hanifah, and this is the correct version, although the chain of narration is weak. We were also narrated from Shurayh that he said, "There is no intercession except in a house or real estate," and from Sa'id ibn al-Musayyib and Sulayman ibn Yasar who said, "Intercession is in the heavens and earth," and from al-Hasan who said, "There is no intercession in animals."
قَالَ رَسُولُ اللهِ ﷺ لَا شُفْعَةَ إِلَّا فِي دَارٍ أَوْ عَقَارٍ أَخْبَرَنَاهُ أَبُو بَكْرِ بْنُ الْحَارِثِ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ بْنِ دَاوُدَ ثنا أَبُو أُسَامَةَ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ أَبِي أُسَامَةَ ثنا الضَّحَّاكُ بْنُ حَجْوَةَ بْنِ الضَّحَّاكِ الْمَنْبِجِيُّ ثنا أَبُو حَنِيفَةَ فَذَكَرَهُ وَرَوَاهُ أَبُو أَحْمَدَ الْعَسَّالُ عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ بْنِ دَاوُدَ عَنْ أَبِي أُسَامَةَ عَنِ الضَّحَّاكِ عَنْ عَبْدِ اللهِ بْنِ وَاقِدٍ عَنْ أَبِي حَنِيفَةَ وَهُوَ الصَّوَابُ وَالْإِسْنَادُ ضَعِيفٌ وَرُوِّينَا عَنْ شُرَيْحٍ أَنَّهُ قَالَ لَا شُفْعَةَ إِلَّا فِي أَرْضٍ أَوْ عَقَارٍ وَعَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَسُلَيْمَانَ بْنِ يَسَارٍ قَالَا الشُّفْعَةُ فِي الدُّورِ وَالْأَرَضِينَ وَعَنِ الْحَسَنِ قَالَ لَيْسَ فِي الْحَيَوَانِ شُفْعَةٌ
[Machine] From the Prophet ﷺ , he said: "Partnership is a means of intercession, and intercession is in every matter." And Abu Abdur-Rahman As-Sulami and Abu Bakr ibn Al-Harith Al-Faqih informed us that Ali ibn Umar Al-Hafith narrated to us, and Abdullah ibn Muhammad ibn Abdul Aziz narrated to us, and Al-Husayn ibn Al-Hurayth Al-Marwazi narrated to us, and Al-Fadl ibn Musa narrated from Abu Hamza, who mentioned it in a similar way and said: The Messenger of Allah ﷺ said: "Ali opposed Shu'bah, Israel, Amr ibn Abi Qays, and Abu Bakr ibn 'Ayash, so they narrated it from Abdul Aziz ibn Rufay', who narrated it from Ibn Abi Mulaykah as Murasil, and this is the correct narration, while Abu Hamza was mistaken in his chain of narration."
عَنِ النَّبِيِّ ﷺ قَالَ الشَّرِيكُ شَفِيعٌ وَالشُّفْعَةُ فِي كُلِّ شَيْءٍ 11599 وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَا أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ثنا الْحُسَيْنُ بْنُ الْحُرَيْثِ الْمَرْوَزِيُّ ثنا الْفَضْلُ بْنُ مُوسَى عَنْ أَبِي حَمْزَةَ فَذَكَرَهُ بِنَحْوِهِ مَوْصُولًا وَقَالَ قَالَ رَسُولُ اللهِ ﷺ قَالَ عَلِيٌّ خَالَفَهُ شُعْبَةُ وَإِسْرَائِيلُ وَعَمْرُو بْنُ أَبِي قَيْسٍ وَأَبُو بَكْرِ بْنُ عَيَّاشٍ فَرَوَوْهُ عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ عَنِ ابْنِ أَبِي مُلَيْكَةَ مُرْسَلًا وَهُوَ الصَّوَابُ وَوَهِمَ أَبُو حَمْزَةَ فِي إِسْنَادِهِ
[Machine] The Messenger of Allah ﷺ said, "The partner is an intercessor in everything. This is the correct (narration) sent (to us) 11601. It has been said by Abu Hamzah, who heard it from Muhammad bin Ubaidullah, who heard it from Ata, who heard it from Ibn Abbas, raised (as a narration that) Abu Abdullah Al-Hafiz informed us through the narration of Al-Hasan bin Muhammad bin Halim, who informed us through Abu Al-Muwajjah, who informed us through Abdan, who informed us through Abu Hamzah, and he mentioned it, and Muhammad (narrated it). This is Al-Arzami, abandoned in narration, and it has been narrated with another weak chain from Ibn Abbas, connected (to the Prophet).
قَالَ رَسُولُ اللهِ ﷺ الشَّرِيكُ شَفِيعٌ فِي كُلِّ شَيْءٍ هَذَا هُوَ الصَّوَابُ مُرْسَلٌ 11601 وَقَدْ قِيلَ عَنْ أَبِي حَمْزَةَ عَنْ مُحَمَّدِ بْنِ عُبَيْدِ اللهِ عَنْ عَطَاءٍ عَنِ ابْنِ عَبَّاسٍ مَرْفُوعًا أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ حَلِيمٍ أنبأ أَبُو الْمُوَجِّهِ أنبأ عَبْدَانُ أنبأ أَبُو حَمْزَةَ فَذَكَرَهُ وَمُحَمَّدٌ هَذَا هُوَ الْعَرْزَمِيُّ مَتْرُوكُ الْحَدِيثِ وَقَدْ رُوِيَ بِإِسْنَادٍ آخَرَ ضَعِيفٍ عَنِ ابْنِ عَبَّاسٍ مَوْصُولًا
[Machine] "On the authority of the Prophet, ﷺ , he said: Intercession exists for the slaves and for everything. And according to the narration of 'Affan, there is intercession for the slave and for everything. 'Umar ibn Harun al-Balkhi has mentioned this claim, but he is weak and cannot be relied upon. And Allah knows best."
عَنِ النَّبِيِّ ﷺ قَالَ الشُّفْعَةُ فِي الْعَبِيدِ وَفِي كُلِّ شَيْءٍ وَفِي رِوَايَةِ عَفَّانَ فِي الْعَبْدِ شُفْعَةٌ وَفِي كُلِّ شَيْءٍ تَفَرَّدَ بِهِ عُمَرُ بْنُ هَارُونَ الْبَلْخِيُّ عَنْ شُعْبَةَ وَهُوَ ضَعِيفٌ لَا يُحْتَجُّ بِهِ وَاللهُ أَعْلَمُ
25.5 Section
٢٥۔٥ بَابٌ
[Machine] Intercession is according to the measure of the need.
الشُّفْعَةُ عَلَى قَدْرِ الْأَنْصِبَاءِ
[Machine] About the scholars who [have a ruling that] is concluded with their saying from the people of Madinah: they used to say concerning a man who has partners in a house, and the partners give him the option of intercession except for one man who wants to take his rightful share of the intercession, they said to him: that is not for him. Either he takes it all or he leaves it all. And they used to say concerning a group who inherit from their father money and one of them dies and leaves behind a child, and one of his children sells his right from that money, the child and his uncles become partners in the intercession according to their respective shares if the money is not divided and the boundaries are set. And Abdur-Rahman ibn Abi Zinad mentioned that Muhammad ibn Umarah al-Hazmi said: Abu Bakr ibn Muhammad ibn Amr ibn Hazm ruled with that.
عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ فِي الرَّجُلِ لَهُ شُرَكَاءُ فِي دَارٍ فَيُسَلِّمُ لَهُ الشُّرَكَاءُ الشُّفْعَةَ إِلَّا رَجُلًا وَاحِدًا أَرَادَ أَنْ يَأْخُذَ بِقَدْرِ حَقِّهِ مِنَ الشُّفْعَةِ قَالُوا لَيْسَ ذَلِكَ لَهُ إِمَّا أَنْ يَأْخُذَهَا جَمِيعًا وَإِمَّا أَنْ يَتْرُكَهَا جَمِيعًا وَكَانُوا يَقُولُونَ فِي النَّفَرِ يَرِثُونَ مِنْ أَبِيهِمْ مَالًا فَيَمُوتُ أَحَدُهُمْ وَيَتْرُكُ وَلَدًا فَيَبِيعُ أَحَدُ وَلَدِهِ حَقَّهُ مِنْ ذَلِكَ الْمَالِ فَالْوَلَدُ وَأَعْمَامُهُ شُرَكَاؤُهُ فِي الشُّفْعَةِ عَلَى قَدْرِ حِصَصِهِمْ إِذَا كَانَ الْمَالُ لَمْ يُقْسَمْ وَتَقَعُ فِيهِ الْحُدُودُ وَذَكَرَ عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ عَنْ مُحَمَّدِ بْنِ عُمَارَةَ الْحَزْمِيِّ أَنَّ أَبَا بَكْرِ بْنَ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ قَضَى بِذَلِكَ
